Pelosi pumping the brakes on impeachment talk. What is that about . Last night she held a 90minute Conference Call with her caucus, basically laying out the strategy going forward. Her argument is move forward with the investigations that each of the Committee Chairmen are already under going and then turned it over to the Committee Chairmen to makes their case. And jerry nadler, the chairman of the judiciary commit yes said he planned to subpoena don mcgahn, and you had people like richard neil talking about continuing to fight for the tax returns, step cummings epps continuing into the security clearances at the white house, and how that process is working out, but this is a difficult political calculation. One of the reasons for that is they have a lot of the freshmen members not some of the most vocal members we hear from all the time, but many freshmen actually won in districts that the president won in 2016, so its a question of whether or not you want to satisfy your base or actually satisfy those folks who, you know, made up the majority. Poppy . Lauren, you are the one who richard neil talks to, because he does not do a lot of interviews, and this is deadline number two that they have given s what are we expecting in terms of the democrat reaction . Well, we of course know that trumps associates have been very clear that democrats will not seed they tax returns. The president s personal lauer have sent two letters to the department of treasury urging them not to comply with the request, but richard neil has a couple options. He could just sue, basically that the department is not complying with the law, the statute that gives him the power to ask for the president s tax returns or he could add a subpoena on top of it, and legal experts have essential argued it could potential undermine the overall case, so its a legal strategy question on how they move forward, but we will of course keep you in the loop on the next steps, poppy and jim. Next question, is the president above that . Thank you, lauren. Im joined by aisha roscoe. So it strikes me that the democratic libel and actually members of the caucus have already made a decision on impeachment, investigate now, try to he. I think what they are doing is looking at polling. There was a poll that came out for morning consult. Even though the majority of democrats do support impeachment, even for democrats it was down 12 points from january. So you have them saying we just want to be driven by the facts. So people on the other side, is there something larger here than electoral politics . Should we try to set a standard . Fulfill their oversight ive spoken with both democrats and republicans on the trail that they dont often here in the cafes and the diners and so on from voters saying this is my number one issues this is not their top of the line argument, but you do have people like Elizabeth Warren coming out swinging saying we should look at impeachment and it doesnt really cost them anything to come out in full support. Theyre saying they want to replace him anyway. If they say we think this should happen, but congress doesnt move forward, they can day i supported impeachment, it just didnt get done. On this tax issue, theres a law that says the house ways and means can ask for any citizens tax returns, yours and mine. The president will clearly fight there in court and in the court of public opinion. Will he ever have to actually deliver these . The courts will decide. What i think is interesting is this is going to drag out. You could end up having the decisions come in the heat of a president ial campaign when it may or may not be advantageous to the president , but i would think if the courts say they have to turn over those documents, they would do it. If they dont, we have that constitutional crisis. Does it end up in the Supreme Court . The final decision there, is that the expectation . I think this president will fight it and take it as far as it can go. That would be keeping in common practice. Thank you ayesha. A subpoena has been served to don mcgahn, part of its continuing obstruction of up justice investigation. In the Mueller Report, mcgahn is one of the aides who defied the president s orders multiple times when asked to essential undermine the russian probe. Manu raju is with us. What more are you learning . Reporter jerry nadler wants don mcgahn in a public hearing by may 21st. Hes also asking for documents to be turned over all part of this investigation, democrats want to dive deeply into the facts of the incidents that mueller laid out about the president trying to undermine the russia investigation, all to look into what they believe are abuses of power, and also to tamp down the calls from the left to pursue impeachment. Theyre trying to argue there are other ways to get facts, including hearings with a witness like don mcgahn. Theres no comment yet from the mcgahn camp, but we expect, at least the democrats, do, to have an active months of may some the committee, bill barr first to testify t. Bob mueller will testify too, the democrats hope, theres no date set yet. And then don mcgahn. So the white house is telling telling the former head of security not to comply with a subpoena from the House Oversight committee . Why . What are they trying to block from public view here . Reporter this was a rather dramatic backandforth that occurred yet between Elijah Cummings and the white house over the House Oversights investigation into the security clearance process. Youll recall there was an individual that the democrats called a whistleblower that told the committee there were at least 25 incidents that the there were problems with the process, and the white house essential overrode the concerns. The individual who was in charge of that process, carl klein, he now works at the pentagon, the democrats issued a subpoena, asking for him to appear this hour this morning. Well, hes not going to appear, because the white house has told him not to. The white house said he should not be forced to answer questions about confidential matters, including the security clearance process, and democrats said he absolutely should. So as a result, Elijah Cummings in a strongly worded her to the white house yesterday said he could hold carl klein in contempt, and poppy, carl kline lynns to his employer because he works for the Defense Department now, says he will not appear. S. I did find manu his lures statement interesting on that, that he has two masters and will listen to the one who employs him now. Lets talk about that, Robert Driscoll represents carl kline, with two masters from equal branches, we will follow the instructions of the one whoa employs him. Theres that, and then Elijah Cummings say we maid hold you in contempt. If so, where does it go . They could also just file a civil suit. Theres a question about whether the process by which they would go for the contempts which is to use the u. S. Attorney in he d. C. , that would rate a problem because that person is part of an executive branch. So now were back to executive privilege before the Mueller Report came out. Did President Trump in his consultations with aides about let these security clearances should be granted over the objections being raised by the career folks, were there confidential discussions there that were worthy of except that would be a concession that the president knew about these and helped override the concerns in. Well, thats true, but to the extent that congress is investigating this, thats what they need to get into. If they can exert those privilege privileges so the white house has responded d. Elijah cummings said no to that. Is that an objectionable request from the white house, to have an attorney there with him . Thats the interesting question. Thats what theyll have to sort out in the litigation. The white house is saying there might be privileges, how can we protect the privilege the democrats are saying that your guy will tell him not to answer any questions. So thats the push and pull. I think the judge will eventually decide that there are some privileges here. Lets talk about don mcgahn, the yew dishary wants him to testify. May 21st, they want a whole list of docs, and doug collins societies this instead of looking at materials, they demand additional materials that they no are subject to confidenceal privilege, and is he right . To do that they need the evident. They dont just knead muellers report. They actually need witnesses, testimony, they knead documents and theyre entitled to all of that. So legally theres no issue here . Right. The question i guess becomes what is they can gel from mcgahn that 30 hours of talking to mueller and his prosecutors will not get them. Well see. Thank you very much, jennifer. We appreciate it. Bernie sanders says, quote, even terrible people shoo maintain the right to vote. More from cnn 2020 marathon. Five 2020 contender back to back and moderator chris cuomo said he might be cutting his own attack ad, but when asked, heres what Bernie Sanders said. This is what i believe. Do you believe in democracy . Do you believe that every sing the american 18 years of age or old are who is an american citizen has a right to vote . He fellow 2020 hopefuls, they responded. I agree that the right to vote is one of the very important components of citizenship. I think we should have that conversation. Part of the punishment when youre convicted of a crime and incarcerated is you lose certain rights. You lose your freedom. I think during that period, it does not make sense to have an exception for the right to vote. Joining us now m. J. Lee, shes in manchester new hampshire, and jackie al manni. M. J. , im curious here, florida this a Ballot Initiative to restore rights after felons serve that i time. This would be a significant step forward, in other words, folks kumpt will you serving time. Is there ra political push for there . Is there a constituency that bernie he sanders was speaking to here. This discussion was so interesting. We first had Bernie Sanders going out and saying, yes, even terrible people who are in prison i believe have a fundamental right to vote. Then weds saw the other candidates responding with different answers. When Pete Buttigieg answered that question and said, look, i just believe this is a form of punishment that when you are in prison and committed a horrific crime, i am okay with the idea of those people not having the right to vote while they were in prison. So clearly offering a different answer. I think a part of the audiences reaction we obviously dont know why they were applauding, but you have to imagine a part of the reaction, the positive reaction in the room was how quickly and sort of confidently he answered that question, right . Especially following on Bernie Sanders and the answer he gave that was different. Because the dynamic we are going to continue to see in this race is certain candidates in the race and namely Bernie Sanders and also in some ways Elizabeth Warren, and this was a practice that started a development that started years ago, starting with the last campaign, these candidates pushing the conversation and the party more to the left and more towards embracing these progressive more progress i was ideals. So i think the differences we will start to see between the candidates is are you going to fall in the camp of also embracing thor progressive ideals or are you going to stand your ground . Theres a primary electability question and general electability that is different. Thats a good point. Jackie, im fascinated about i this polls. Leading the pack is Bernie Sander at 30 trailed by joe biden at 18 . Right behind him mayor Pete Buttigieg. In late february, he was polls at 1 , and now rivalling joe bid biden. I dont want to bead a dead horse, but polls this early out need to be taken with a grain of salt. That being said Pete Buttigieg has maid leaps and bounds especially when you compare that to someone like beto orourke. But at this point in the race last year, especially in new hampshire, benties sanders was nearly 50 points behind hillary clinton. I think its safe to say here its not just mayor pete having his moment. But he is establishing himself as a viable opponent, if he does decide ultimately to decide in the race. Heres what im interested in, though. Go ahead, jim. Hes clearly in the national conversation, because hes popping up in the National Polls in a way he did not, but also in the key early state polls. Totally. When joe biden gets in, he has a long record to return on, which can help and hurt. Pete buttigieg has not. Anderson rightly pressed him on why hes not put forth many specific policy proposals and theres literally none listed on his website. Heres how the mayor answered. Well continue to roll out specific policy proposals too, but i also think its important that we node drown people in minutia before we have vindicated the values that animate our policies. As democrats, this is a habit we have. We go right to the policy proposals we expect people to figure out what our valuing must be from that. Its really op soft to what Elizabeth Warren is doing. Its also different to believe that this harvardeducated mackenzie consultant is not steeped in minutia, which may give us a bit of a window to he might be avoiding tacking harder positions, because he realizes his centrist policies are not as popular as bless warren or Bernie Sanders. Although i do think in this case, with the track record as it relates to anita hill, supporting the 94 crime bill, and potentially maybe being considered as an architect of the cycle of mass incarceration might hurt biden, especially someone like mayor pete, who doesnt have as long of a track record. There is still baggage yet to be uncovered. There hasnt been a lot of scrutiny yet. That comes with rising in the polls, but i do think as name recognition for the mayor well only see these polls go up. Okay. Ladies, thank you very much. M. J. Lee and jackie alemany. Meanwhile, a top Government Official claims the attacks were in retaliation for last months shootings in new zealand. The more we learn about this, the more sophisticated and wideranging, but still concerns perhaps about members of this cell at large . There are. The Security Forces have announced a curfew that should start in about saying he does believe that there are still people. The Security Forces have tightened up security at this Catholic Church that was attacked on sunday to such deadly effect. There shall two other the Security Forces have located suspected vehicles, for example, and have conducted controlled blasts. We witnessed one that was very powerful on monday in colombo, and learned from the police later that it did carry explosives, which was probably why the blast was so powerful. Clearly theyre word that there could be a threat out there. Certainly they say theyre worried that they could be started the the community here is traumatized by the scale of the loss of life some believe this is the work of a small local group that had previously been accused of damaging statues. Poppy and jim . Ivan watson, we appreciate you being there with all your work. Clarissa ward, you have a unique lens, having covered isis more than most have. What does this say about their tentacles . This exactly shows why isis wants to claim responsibility, why this is so important from the group. From a pr perspective after taking such a beat iing why it crucial that they are still thriving and that theyre able to carry out sophisticated, coordinated attacks. At the same time, while its clear this is a pr essential for isis to claim responsibility for this attack, whether or not they had something to do with it, it does appear plausible they may indeed have had a role. Why is that . Its for a number of reasons. Firstly, as youve heard ivan said, it doesnt add up that this small relatively obscure group, at the time would suddenly be able to launch an attack like this with the sophistication that that requires, with the bombmaking abilities that that requires. Several suicide bombers, different locations, churches, hotels, this is not an easy attack to pull off. So it is entirely he plausible that isis or a group like isis would have had some kind of role in this, especially as they try to sort of expand their Political Capital and their pr campaign outside of iraq and syria, outside of the middle east. S evening during whats been a relatively quiet period, but you know what im say saying. You have said, quote, theres nothing that changes your view of this president. They were you as a candidates, would you accept help, particularly an adversary . Would you accept that help . I would like to think i wouldnt. It doesnt seem like a good idea. It seems like it would cause me to have great pause and to look somewhere else. Are you disappointed that President Trumps aides, Campaign Staff does not make the same decision . Sure. Sure, but look id like to think if i had been, i might have raised a word of caution, but hindsight is 2020. I wasnt there. Senator, before we get to the book, which is fascinating, let me just talk about transparency. If the American People dont know, one thing about you, when you dont agree with the president , you do speak out. You were actually with democrats like Bernie Sanders when it comes to yemen. Feeling the burn on getting us out of the war on yemen. Would you ask for Bernie Sanders . I dont think you would go that far, but youve work with him. Correct. The president has lad transterrence and continuing to. Yesterday we saw the president file a law from, deadline day that the congress has asked for those tax return is today. Now the white house is telling carl kline who used to run the personnel security director, to not testify, even though the Oversight Committee has called for him to testify are you concerned about the not only lack of transparencies, but these pushes against it . I cant speak for the president but im asking you as a member of congress. I see a president who as undergone very significant, very prolonged twoyear investigation. They have shaken it, he every way they possibly can, and i think its easy for most americans to understand why he might not be overly eager to hand over even more information where its not required by law. Well, irs code, as you know, says shall furnish. Maybe this will go all the way to the Supreme Court to but it is irs code. Perhaps, but this will have to be ironed out between his lawyers and the congressional investigators looking for it. Im going to make your day. Im going to quote from your book. Heres the quote the steady use but thought is a creeping phenomenon. The peoples elected represent activities have made countly choices that steadily diminished their own power, delegating to others the difficult task of making law has a tendency to make reelection easier. Our taking a shot for in effect not defending their constitutional powers. You have a president who just bypassed congress to get money for a wall even when republicans controlled both houses, the president couldnt get that money. I wonder, do you believe this president is violating the spirit of the constitution that youre extolling in effect by taking the power away from you and your colleagues in the senate. One of the reason i wrote this book, one of the reasons i voted the way i did and one of the reasons i sponsored a resolution to get us out of undeclared war in yemen, i believe that congress has given too much authority to the executive branch. Pow tore make war, power to start trade wars, power to declare Broad National emergencies. This has been a convenience tool over time by congress u. Headed by the house of representatives, senates, and with the assistants of white houses of every conceivable partisan combinat n combination, so it shouldnt be surprising that our current president would maybe take advantage. Its our fault as a congress, and we as a Congress Need to take that pewer back. My whole book is all about the fact that the fight for liberty in america, as from day one, focused on the need to limit the amount of power that any one person or group of people can accumulate. And there are risks today as well as it was 2 had you beeniers, with one person exerting power. You say conservatives are still in danger of not only losing the culture war, but the hearts and minds of a an entire generation of young americans. That is a stark warning. Whats your advice to your own party . My advice is to get back to the basics, get back to the fundamentals of what made us a country. One of the central themes of this book, that i think could be a great give, any parent who wants to make they are their children has access to the stories that inform us but why we are our own country, can help with this. They certainly can help with the Republican Party being able to regain that which it purports to stand for. You write more about this, your point is you think many have resorted to simple phrases lie conservative judges, lower taxes, less regulation. It seems like you find that disingenuous. Not that so much as incomplete. Its incomplete if we focus only on putting conservatee judges on the cord most people dont enunderstand what it means. A good judge is a judge who reads the law based on what it says, but we need to focus on the legislative branch and what we are legislating, what were enacting, what we are not enacting, on the dozens, indeed hundreds Service Instances where weve handed over legislative power to the executive branch, thats inexcusable. We shouldnt rest until we have brought, pursuant to article 1, all that power back to our branch if not, well be acting similar to the way our government in london behaved prior to the american revolution. We appreciate your time. Congratulations on the book and come back on the show should not. Well be watching. Mike lee, thank you so much.
