At about the same time police uncovered 87 detonatored as a bus depot. Still no claim of responsibility, but u. S. Officials say these attacks seemingly were inspired by isis. The Sri Lankan Government says its, quote, very, very sorry that it failed to act on multiple warnings that terror attacks could be coming. Lets go to sam kiley. He joins us from the sri lankan capital. Our heart is with all of them right now. What can you tell us in terms of what investigators are saying and the response . Huge admission from the government that they missed this. An amazing admission, really, poppy, isnt it . The reason for that is members of the legislature, indeed ministers themselves, have been leaking against their own government since almost day one of this atrocity on sunday, easter sunday. First, with a memo from which was written by the assistant Inspector General of police to his colleagues warning that sri lankan intelligence had information that indicated that a Suicide Attack of some kind was being planned. That was about nine or ten days before the atrocities, and then earlier in that month, we understand from officials here, they had intelligence from an International Intelligence organization warning of a complex attack of the sort that we did indeed see unfold. Three churches, three hotels attacked, and then two more explosions during Police Operations against suspects. One at a house and one at a hotel. That was all on easter sunday. On top of that, as you say, theres been this controlled explosion of another device here in the capital, colombo, and this mystery of the 87 detonators. Detonators are absolutely critical, clearly, to plotting any kind of terrorist attack, getting hold of explosives is quite easy or making them. Making them go off requires commercially produced detonators. Hard to make them at home. This is a Significant Development. In the context of the United States suggesting that there was an islamist connection, but so far, no sri lankan official has said that, only that this must have been part of a more multinational than local plot. We really appreciate you being there, and thank you for that reporting. Let me go to matthew rosenberg, National Security correspondent for the new york times. So many questions for you this morning. I guess im just going to begin on why now. Since the civil war there ended in 2009, you had basically a decade of relative calm. Why now and what does this tell you . Sri lanka has very deep sectarian divisions. The civil war was between the majority, elise, and the tigers. There has been political violence. Leaders on both sides have sought to whip up and make those sectarian appeals to promote themselves. This is the result of that, you see violence. Are you surprised there hasnt been an official claim of responsibility yet . Not entirely. When i hear people say, it looks like its isis inspired, what is isis is the question at this point. If you or i carry out an attack and say it was isis or isis inspired, it doesnt say much. Look, sri lanka also has a long history of attacks of terror. During the 20year rebellion of the separatist group, they helped perfect the suicide vest. They even had a squad that they called the black tigers, which was their suicide squad. This is in some ways, the violence in sri lanka, an islamic plot is new to sri lanka, but acts of terror in sri lanka are not new. The authorities are looking namely at this group that certainly before yesterday i had never heard of. I think most americans had never heard of it. They had been known in sri lanka for vandalizing buddhist statues, et cetera, but that was the extent of it. Is that a group uthink is equipped to carry out so many deadly coordinated attacks . Most people anywhere in the world hadnt heard of them before yesterday. It depends. Like i said, these things arent that hard to make. And sri lanka has a long experience with people making suicide vests, making explosives. That knowledge exists on the island. It also exists elsewhere. Its easy to transmit. The detonators, those are hard to come by, but again, you can obtain them. And sri lanka wasnt ready for this. I have stayed in two of the hotels that were attacked. Neither one had serious security because there was no history of this kind of thing. It wasnt something you thought you had to worry about. Matthew, we appreciate the expertise as always. Thank you, my friend. So right now, all of social media in sri lanka has been blacked out by the government. The government censoring sites like facebook and instagram in an effort to stop the flow of misinformation about the attacks. Lets bring in brian stelter, our chief media correspondent, host of reliable sources. Thats big. Its not the first time the government of sri lanka has done this. No, and it shows the countries all around the world are making these choices about the cost of social media versus the benefits. And its a very different debate depending on the country. Here in the United States, with a long history of freedom of speech and protections of freedom of speech, this would be a shocking move. In other countries like sri lanka, less shocking. In india, for example, theres been a scourge of misinformation. Instances where people get hyped up based on lies on social media and commit acts of violence. There was a fear in sri lanka that inflamed tensions and fear and heightened concerns about whats going on there would cause additional violence, additional emergencies. Thats according to the government why they decided to turn off the sites temporarily. Its a drastic move and it shows that many Different Countries are struggling with what to do with social media. Obviously, this comes in the wake of the horrific attack in new zealand where the viral video of the attack was spread so rapidly on social media. What is the scree laungen government going to do when it determines we deem it appropriate to turn it back on. Acceptable, and this is day two. According to companies who monitor these sorts of things, the internet is very much slowed down and these sites are still very hard to access. Heres what one tech expert wrote, he pointed out the difference of a few years ago to today. A few years ago, we would view the blocking of social media sites as outrageous censorship. Now we think of it as an essential duty of care to protect ourselves from threat. Thats a view from a skeptic, a critic of social media giants saying theyre not doing enough to protect users from misinformation and actual fake stories that spread in the wake of emergencies. Facebook, however, says hey, our site is used to connect loved ones and friends and family after emergencies. This is exactly when you need social media in order to communicate youre safe, your family is safe. Are they responding, facebook, which owns instagram, about sri lanka specifically . Are they saying we oppose this . Facebook owns instagram and whatsapp, which is oftentimes used in many countries to spread misinformation. They say theyre working hard as ever to stamp out misinformation, to report it, to flag it. This is the daily game of whackamole that has real world consequences. The first one is 40yearold deter kowalski. Hes originally from wisconsin. He had been living in denver. Initially in the hours after this, colleagues of his had reached out to our cnn social media team saying they were having trouble getting in touch with him. His phone had been answered by police and thats when they started getting worried about him. We now have confirmation from his brother and his company, peerson education, that he was in fact one of those victims. His brother put out a very brief statement on facebook saying he saw his friends as his family, and quote, we have all lost a brother today. The ceo of peerson, an educational publishing company, also put out a statement saying he was killed at the Cinnamon Grand Hotel just after arriving on the ground when one of the bombs went off. He said that he had been doing engineering type work and that he took pride in his work. He was fun to be around, a Problem Solver that you could really give your biggest engineering challenges to and he would jump in and fix them. We also know this was not his first time in sri lanka. He had gone there previously on a work trip as well. The company says it has about 800 employees or so in sri lanka and also an operation in denver. Theyre doing what they can to support those league colleagues, but were learning more about him, but we know at least at this point that both his company and his brother are confirming sadly he is one among the victims here. This all came after michael cohen, the president s former attorney, longtime personal fixer, testified before the House Oversight committee and alleged the president improperly and potentially illegally inflated his net worth as he tried to purchase the Buffalo Bills football team. Afterwards, elijah cummings, the chairman of the committee, sought to get information from the Accounting Firm that would have Financial Data of then individual private citizen donald trump and determine whether or not Michael Cohens allegations were correct. That film came back and said well comply, but you need to issue a subpoena first. Cummings issued a subpoena. Now, the Trump Legal Team pushing back, saying that the company should not comply with the subpoena because in the view of the Trump Organization, that exceeds constitutional limits. Now, in the lawsuit that was filed in d. C. Federal court in d. C. Today, it says because chairman cummings subpoena threatens to expose plaintiffs information, this court has the power to declare it invalid and to enjoin its enforcement. This lawsuit goes on to say that the subpoena is the, quote, weapon of choice of democrats. They say theres no reason for them seeking this. But only ratcheting up the stakes and the fights between the House Democrats who are not getting much compliance or any compliance from the white house over a range of its investigations. They have tried to go to individual firms to try to get data, Financial Data, separate committees are subpoenaing banks for other information involving the Trump Organization. You see the new tactsic launche by the Trump Organization. Try to prevent the companies from complying with congress. Well see what the courts say, but dramatic move this morning to try to prevent these records from being turned over to House Democrats. Poppy. Indeed, fascinating. Manu, thanks very much. Lets talk about this with asha and shan. Lets begin with you, shan. Is there any precedent for this . Im not aware of any precedent, and i havent had a chance to look at the complaint, but from what little i have seen of it, whats interesting is the president suing in his personal capacity, as opposed to having white House Counsel do anything. And theyre seeking declaratory and injunkative relieve. An injunction is something that forces an action, theyre going to have to show, they have to do a preliminary injunction first, and that standard requires them to show a substantial likelihood of success. Its going to bedecided very quickly on that legal issue. I think hes going to have a tough uphill battle on that point because i think its hard to challenge the legitimacy of Congress Oversight ability. Okay, and so to that point, this is, again, filed in District Court in d. C. And in terms of the legitimacy of this congressional reach or ask, if you will, heres what the Trump Organization said. Cristina alesci just got a statement. Quote, its an unprecedented overreach of congressional authority. Is it . Well, i agree with shan that this is going to be an uphill battle for the president. For three reasons. So, first of all, congress has the power to tax under the constitution. Which also gives them oversight power over, you know, tax fraud, tax evasion. Enforcement of the tax laws. But more specifically, this particular law was passed in 1924, the law that they are requesting these tax returns under. After a major scandal called the teapot dome scandal, which involved corruption within the executive branch. And the idea here was to create the ability for congress to be able to see tax returns of Public Officials to identify potential conflicts of interest or issues that are compromising their behavior, which is exactly whats going on here. The third reason is, these are thirdparty records. They belong to an Accounting Firm. These are not coming from trump or the irs himself, so there could be a standing issue on whether he can actually stop these from coming out. Thats interesting. Even though theyre his returns or his corporations returns, since they have been farmed out, if you will, to an outside Accounting Firm, will he have standing . Thats interesting. Shan, so theres the president as a civilian and a citizen and the personal side here, and then theres him in the office. Is there a distinction here on what they can where they may have more, congress may have more of this authority to request him, you know, during his time in office than beforehand. I wonder if you think the courts will see that separately, or will they see the president himself personally and the trump org records separately . I think there is a distinction, but i think its actually going to hurt the president , because as asha was pointing out, that particular law was passed so congress can look into these issues. And this is the perfect setting for it. The fact that hes a sitting president , i think, only adds to the oversight authority. And as an atmospheric, when the court looks at that, i think theyre going to look at this differently than if congress is like subpoenaing some shop owners records and the shop owner is saying this is a terrible invasion of my privacy. Trump by nature of his office, theres a strong Public Interest in it, and some of the themes with the potential conflicts of interest go along with the whole emoluments clause lawsuit going on as well. All of that will weigh in favor of congress being able to use the law. Asha, let me ask you this. Does the president , his legal team, trump org, need to win on this to be successful, or do they win simply by being able to tie it up in the courts . If they dont get the ruling they want in the District Court, they appeal to the appellate court. It could go to the Supreme Court. Is that a win, just run out the clock here . Right, i think what shan mentioned about the injunction will be key. So if the Court Determines that its likely to succeed on the merits and issues an injunction, then yes, it will tie it up and there will be some appeals. But i actually think that this kind of issue would move fairly quickly, i think, because of the fact that its essentially two branches of the government and it involves Public Interest issues. And because congress has, you know, a very broad oversight authority. But i do think that part of the strategy here is to tie up the issue so that they cannot come out. Okay. Shan, before we go, let me get you on something different. If anyone missed this great interview that jake tapper did yesterday with the president s private lawyer, Rudy Giuliani, they should go back and watch the entire thing. This really struck me when jake kept asking him about don mcgahn and the three times don mcgahn told muellers team, look, the president told me to fire the special counsel. Heres how Rudy Giuliani explains the bhoel thing. Guy has three different versions of something as important as this. You know what you do . You say i cant rely on him. Are you suggesting mcgahn is lying . No, im telling you hes confused. Three different versions. When the special prosecutor comes to a conclusion, hes definitively telling the truth. Theyre different words, but if you go back and read the special counsels report and the three times mcgahn is quoted, hes saying the same thing. Right . Meaning the same thing. How effective do you think Rudy Giuliani is for the president in the court of Public Opinion on this . I think as always, as youre pointing out, poppy, his point here is not a legal strategy. Its a pr strategy. To the extent he gets on air and makes these arguments, i think hes being as effective as he can be towards those folks who want to believe the president. The problem with what hes saying legally, of course, is thats exactly why you would want mcgahn to come and testify. If theres anything that seems inconsistent or confusing, youre going to want him to testify before congress to fully explain that. So thats kind of going to end up backfiring for giuliani. As far as a pr statement, its fine to say he has inconsistent statements. Hes unreliable, but as a legal strategy, i dont think it takes them very far. Thank you both. Asha, shan, nice to have you. Nick valencia has more on who this group is and why theyre causing such a stir on the border. U. S. Border patrol. The man speaking in the video is not a Border Patrol agent, but he appears to be acting like one. He gives commands to a migrant group, some of them children, which hes just intercepted. There you go. The clips were posted to the Facebook Page of jim benvy, a member of the united constitutional patriots, a Militia Group based on the new mexico border. We dont work well with Border Patrol. Thats the media. They describe themselves as concerned citizens helping to keep america safe. Plugging the holes, they say, for the Border Patrol. That Border Patrol is tied up. If we werent here right now, they could bring in bus loads, drop them over here, and running up the hill. The groups actions have drawn swift condemnation from the American Civil Liberties union and others who have equated the actions to kidnapping. This is exactly why we dont let private citizens enforce the laws of our country. This is an act of vigilanteism. We need federal, local, and state authorities stepping in as quickly as possible. In a statement to cnn, a spokesman for the new Mexico Governors Office said this about the Militia Group. They have absolutely not been authorized by our office or any other, that migrant families might be menaced or threatens in any way, shape, or form is completely unacceptable. We made several attempts to reach the constitutional patriots and jim. They did not reply. A spokesman for the group defended their actions to the new york times, saying what they do is legal, but in one of the nighttime videos posted by the group, a man can be heard alluding to another tactic he wishes the militia could use. The only problem is if we shoot on the hill, it will be an international crisis. Were too close to the border. Save some time, though, wouldnt it . Nick valencia, cnn, atlanta. All right, lets talk about this with peter, executive director of the aclu of new mexico. Peter, thank you for joining me. Look, we heard you in the next piece making it clear the aclu opposes this groups action. Legally, are they breaking the law . Well, i cant be the final arbiter of that decision. But on the face of it, you would have to have serious questions about whether or not these folks are first impersonating federal officers. Whether they are guilty of kidnapping under federal law. And there may be many other federal crimes that theyre guilty of. At the end of the day, the really important thing he is we dont allow private heavily armed citizens to enforce the laws of our nation. We reserve that right for the trained professionals that are authorized by our government. Those trained professionals, customs and Border Protection, say they do not endorse or condone private groups and organizations taking enforcement measures into their own hands. Thats your point. Let me get to what a spokesperson said. We havent been able to reach them, but they said look, this is a verbal citizens arrest. And, quote, were just here to support Border Patrol and show the public the reality of the border, if these people follow our verbal comanldz, we hold them until Border Patrol comes. They also say Border Patrol has never asked us to stand down. Whats your reaction to that . Well, that last point i think is particularly important. One of our outstanding questions is, why did Border Patrol apparently turn a blind eye to this activity, and even in some instances as the video seemed to show, actively collaborate with these folks . You can hear what they say in the press statement, but on the other hand, their actions would seem to contradict what their official position is. The videos bear that out. What part of the video are you talking about there specifically that you think shows that cbp is supporting this . Sure, there are multiple videos showing Border Patrol arriving on the scene, responding to their calls, and picking up immigrant families from the vigilantes. Buzzfeed ran a story the other day that suggested in one of the videos that a Border Patrol officer actually asked the vigilantes to hold some immigrants while he went back to get more officers to help. So you know, this is really an important question. I think our federal authorities need to draw a bright line between whos responsible for enforcing the laws of our nation and whos not. Are you seeing evidence that these groups of private, you know, citizens who are dressing like this in these fatigues, et cetera, heavily armed, are gaining more members . Are having more of a presence there . I dont know that theyre having more of a presence. We saw a surge in this kind of activity in the early 2000s. The difference is the aggressiveness with which theyre caring out their activity. Even with the surge of the minutemen on the border, we never saw activity like this where people were so bold as to actually detain people, probably kidnap people, under gunpoint. That seems to be a bridge much further than what we have ever seen before. So i do think that it raises significant concerns, and you know, if we dont see a swift harsh response to this from our government, my concern is that well see other groups mimicking the behavior of these vigilantes. I was going to ask you what does the aclu plan to do about it . We know one guy has been arrested. Is the aclu planning action . Were still looking at our various strategies right now. At the very moment, the most important thing is to insure that this activity has stopped completely. We are very concerned about the safety of immigrant families. And were urging our federal authorities to take this action, these activities entirely seriously, and bring the proper charges against these folks. Okay. Peter, i appreciate your time. Justices have agreed to hear a case deciding whether americans can lose their jobs simply for being gay or bisexual or transgender. Lets go to Jessica Schneider with more. This is hugely significant. This is a big fight over the Civil Rights Act that will no doubt have huge implications for gay and transgender individuals. Let me take you to the arguments. The Trump Administration, theyre pointing to this particular law, title vii of the Civil Rights Act. The administration saying it does not explicitly protect against employment discrimination for gay and transgender individuals. The two gay plen and one transgender woman who are suing their employers for firing them, they argue that title vii does protect them. Heres the issue here. Title vii explicitly prohibited employment discrimination on the basis of several things. Race, color, religion, and sex. But it does not explicitly say Sexual Orientation or gender identity. Because of that, the Trump Administration has repeatedly argued that since congress refused to include that specific terminology in the law itself, Sexual Orientation or transgender status, the Trump Administration says the Civil Rights Act cant be construed as protecting against that kind of discrimination. Thats the big fight here. What is title vii of the Civil Rights Act pertain to and protect. This question, poppy, it will be front and center at the court in the fall, when the arguments will be heard. And really, its where the divide on this court could be fully exposed, since we now have a conservative majority, and of course, Justice Anthony kennedy, who is typically the champion of protecting gay and transgender individuals, he has now retired. The court is taking this case up in the foul, the same time where the 2020 race will be in full swing. So this will all make for a very interesting and possibly explosive and important dynamic here. Now, senator Elizabeth Warren is unveiling a sweeping new education policy she wants to offer a way to completely cancel Student Loan Debt and for people to go to public colleges for free. Its come just in time for cnns series of town halls that are tonight in New Hampshire. She sat down with m. J. Lee to talk about it all. Senator Elizabeth Warren out with a sweeping new proposal to wipe clean millions of americans Student Loan Debt and overall the Higher Education system. The massachusetts democrat dropping the ambitious plan ahead of cnns fivecandidate young voter town hall in New Hampshire. Anyone whos got outstanding Student Loan Debt can have up to 50,000 worth of Student Loan Debt canceled out, so long as their income is under 100,000, then it kind of steps in up to theres no help for anybody whose Family Income is above 250,000. And thats it. The debt is gone. The proposal would also make all public colleges tuition and fee free, inject 100 billion into pell grants over ten years, and create a 50 billion fund for historically black colleges and other minority serving institutions. These are real access problems for lowincome students, for students of color. And that is its not just paying the tuition. Its how they pay for books. Its how they pay for the expenses of having a baby taken care of if they already have a child at home or being able to cover commuting expenses. Or maybe its a chance to live in a dorm. Make public colleges and universities tuitionfree. His latest legislation in the senate would make public colleges tuition free for families making 125,000 or less. And make Community Colleges tuitionfree for everyone. Warren says her plan does more. And you are already a cosponsor of Bernie Sanders free college bill. How is your plan better than that plan . Well, it goes further. Is it fair to say that your bill is more progressive than Bernie Sanders bill . Its certainly bigger. Not every democratic candidate a fan of the idea of free college. Americans who have a College Degree earn more on average than americans who dont. And as a progressive, i have a hard time getting my head around the idea. I think expecting somebody to pay zero might go further than whats reasonable. Do you agree with his analysis . You have confirmed cases in all of those blue states. 71 cases of the measles were confirmed last week alone. That brings the total number of cases in the u. S. To 626 this year alone. My colleague alex field is with me now. This is really, really scary, and so much is because of the antivaccination movement. Absolutely. You have to consider the fact that measles was declared eradicated back in 2000. This really shouldnt be happening. You do see these outbreaks happen periodically. There was a big one in 2014, and now Health Officials are warning were on track to beat that record. Certainly a record that you do not want to break. They expect in the next few weeks youll see even more cases than what we saw in 2014, and as you point out, a lot of this is being attributed to antivaccine rhetoric. When you look at the total number of cases, 626 this year, the cases are disproportionately among people who are age 19 and under. 72 of these patients have not received the measles vaccine. This is a highly infectious disease. We know theres a long incubation period. Thats one reason Health Officials fear in these outbreaks that it can get worse before it gets better. An alarming statistic is some 90 of people who are exposed and not immune will become infected. That number you had on the screen that 72 of people who have it do not have the vaccine, does that mean you can get it even if you have the vaccine . You have another 18 of people where they have an unknown vaccination status. Officials arent sure whether they have been vaccinated or not, but 10 of people reported they have been vaccinated. They may have received just one of the two doses. Im going today to get my young kids the pooster shots, earlier than you normally would. Doctors are recommending that for people now if youre traveling. Important in new york where were seeing the bulk of the cases. Thank you. So a judge has ruled flint, michigan, residents can sue the federal government over the citys water crisis. The lawsuit says the epa was too slow to intervene after the water was found to be contaminated with lead. In her opinion, the judge, judge linda parker, said quote, the impact of the health of nearly 100,000 residents of the city of flint remains untold. I should note, she did not rule on the epas negligence, but she did say the agency knew about the health risk posed by the lead exposure, and flint officials were not warning residents. This is a Significant Development for so many parents on the ground that i spoke with when i was reporting there, so concerned about the health of their children and what that means for them, for the rest of their future.
