You have really interesting color and reporting from a number of key lawmakers that are involved in these hearings this week, namely Elijah Cummings and chairs the Oversight Committee who will host that public hearing tomorrow. What is his goal . I thought his response was interesting to the republican criticism of this whole thing. Reporter i spoke to him last night about this public hearing that is going to happen tomorrow which we expect to cover a whole range of issues and whether the president committed crimes while with Michael Cohen as well as other thij things he may have with Trump Organization he has a lot of skepticism about his own credibility here on capitol hill after he lied to multiple congressional committees back in 2017. But cummings still talking about tomorrows hearing as a rather dramatic moment last night saying it may very well be a turning point in our countrys history. I dont know. What we want to do is conduct a fair hearing, a civil hearing and we want tobe effective and efficient. Now, todays hearing is not going to be about that. It is going to be behind closed doors about the russia investigation, about what he knew about the trump tower moscow project, why he lied about the duration of the talks back in 2016. Thats going to be a big focus for todays closed door hearing. Tomorrow will be the public hearing. And as i understand it, some new interesting reporting from our colleague pam brown in terms of the white house plan and the president s plan in terms of watching this even while he is in hanoi. Reporter according to pams reporting we are hearing that the white house plans to watch pretty intently tomorrow perhaps not surprisingly. The president himself likely to potentially stay up overnight to watch this public hearing because it will occur in the overnight hours when he is in vietnam. The president and the white house continues to down play this moment, attack Michael Cohens credibility and character, they are very, very attuned of what is going on and concerned about what he will say. Cohen begins the three day journey on capitol hill. A person nar with his preparations tells us that Michael Cohen is prepared to talk about Donald Trumps role in the crimes that he has pleaded guilty to, namely the hush money payments to the two women who alleged having affairs with donald trump. When cohen pled guilty last summer he said that he did these payments and helped facilitate these payments in coordination with. Cohen will likely be pressed by democrats and republicans about that. We will get a fuller picture about the president s role in that. The person who is familiar with the preparations told us that cohen is prepared to discuss trumps business dealings at the time that he was running for office. We might learn more about what Trump Organization was up to, the plans of the trump tower moscow and just what else is going on behind the scenes because cohen has had a front row seat to donald trump. He has been his attorney, his personal attorney for ten years. The Trump Organization is a small operation so Michael Cohen knows a lot of what was going on. He has really a front row seat and will be able to provide some information. The question about cohen is always his credibility. He was such a loyal defender to the president. The person familiar says he may bring documents to the hill to back up some of his claims t. Remains to be seen what the documents are. Given his relationship with trump and this opportunity to be not only just provide information but to be questioned about it is going to be very fascinating. For sure. Im joined now by federal former prosecutor and veteran of the white water probe. Elijah cummings got this public hearing tomorrow says this may be a turning point in our countrys history. And we know that Michael Cohen wants to be akin to john dean. The question is, will he just embarrass the president or will he actually be similar to john dean in terms of john deans crucial role in bringing down the president s seat . It is a really good question and one we dont have the answer to. I suspect we are in such a different media and political environment than when john dean provided his testimony, people are so dug in in our polarized electorate. And donald trump as you attract his Approval Ratings that hasnt impacted his numbers. So im a little doubtful that Michael Cohens testimony will be able to all of a sudden upend that trajectory that we have seen sort of baked in which doesnt it all mean that this is not a really big moment in the countrys history. This is somebody from the inside, a former loyalist very publically turning on the president. There is no doubt that that will have some sway with the American People. I just think that in this political environment, so few people are movable here that im not sure this one thing is going to be the thing that does it. It sounds like you saying it is a lot less likely there will be a howard baker moment here, what did the president know and when did he know it . A republican in the party asking the key question. One thing i think has been the story politically of the Trump Administration through this entire investigative process has been the real closings of the ranks among republicans. Howard baker went down to the white house when it was time to tell nixon that the party was turning on him. Nothing like that. We have had no indication that the president s supporters on capitol hill are ready to break from him. As kara was just suggesting, part of what they will use as why Michael Cohen is not the right vehicle for that is his own credibility issues in the past. We just had the white house come out with a statement. It is laughable that anyone would take a convicted liar like cohen at his word and pathetic to see him given yet another opportunity to spread his lies. He admitted to lying to congress. How do you as a prosecutor, how would you salvage the credibility of an admitted liar . This is not atypical. There are lots of times in trials where people cooperate in exchange for some kind of leniency. To say all of those people are not credible and their testimony never be taken as truthful would sort of break a lot of foundation of the criminal justice system. Mr. Cohen said he lied because he was wanting to cover for the president. He has been prosecuted for lying before congress. I think he has a different incentive at this point. If he is going to lie again here it wouldnt make sense to lie in a manner consistent with what he did before. If he tells the truth it will be in a manner that is inconsistent with his rationale for lying. I think it is actually a really important moment for representative cummings, that this is the first time the American People can sit at their Television Sets and watch someone under oath tell their story about what it was like to work for this president. And a lot of information will come out publically and will bear not just potentially on impeachment and oversight but on the next election which is crucial because if there were crimes committed and cannot be indicted then him not getting a second term would be critical to getting under the statute of limitations for federal crimes. Politically, is this the best time in the world for the president to literally hold a very important meeting about the future of Nuclear Proliferation on the globe . Or is it the worst time politically . I think it all depends on how the president handles that, handles this split screen moment. North korea has been one of his biggest potential successes. There is a long way to go in denuclearizing north korea. But he holds it out there as a real potential success. If he made Real Progress here and was able to be disciplined enough to focus on Real Progress you can imagine that he can sort of Counter Program a bit away from the Michael Cohen spectacle on capitol hill. However, that would belie everything we know about Donald Trumps behavior to date. We have seen how consumed he becomes with press coverage of anything related to the investigations into him and his campaign. We know how he feels about Michael Cohen. He has made that quite clear that he thinks hes a rat. So i doubt that he is going to be able to turn away and therefore by being on the world stage and getting consumed with something that irritates him like this could indeed impact his performance negatively over there. What we should focus on here is this week leading up to this Summit White House officials have admitted that they have not come to an agreement with North Koreans on what denuclearization is going to look like on both sides. I think they are trying to find a little breathing space to keep the north rkoreans at the table i think it is really important that we stick, we the United States stick with a conventional definition of denuclearization. Its important to already remember that we have a different mindset about denuclearization than they do. Caitlyn talked about the fact that there is no common definition. To the North Koreans when they talk about denuclearization they mean of all sides and they dont just mean the korean peninsula. They think about any territory that can threaten north korea with nuclear missiles. They have a much more expancyive geographical definition than we have. The president has some power here in terms of softening sanctions on north korea which we may see if the u. S. Gets some gives, but his hands are tied to a great extent in terms of how much of the economic sanctions can be lifted because of a 2017 bill that he signed into law, right, that basically bars any commerce between u. S. Companies and north korea or imports from this country to north korea. Thats right. Unilaterally he will have to work with congress to lift the u. S. Sanctions because of the law that he signed. He also has a very limited ability to affect u. N. Sanctions. We have a vote. It will take a lot more than just donald trump to move that. He does have a little flexibility working with president moon of south korea because they have economic measures that they put in place that they might be willing to lift. Its not a total surprise that this came from tom tillis but it is something that the president will not welcome and it is going on a limb against many in his party and saying we cant do this in good conscience because what we have said in the past and what it could mean for president s in the future. The expectation im told is about 10 or 15 republicans will likely join them and send it to the senate where it has been clear they were struggling with this idea. Struggling with it on is this hypocrisy grounds. I think the key issue is that senator tillis will not be alone. Senator collins said she will join him. There are probably about a half dozen who are considering the possibility of it. Dont necessarily view it as a policy issue but as an allegiance to the president. The president who leads the party and remains popular in the president. The president made clear this is the central issue not only that he ran on in 2016 but his administration believes in now and plans on running on to 2020. The president tweeting republican senators telling them to stay in line with this. Mike pence will pea meeting with senators in a couple hours. House republicans getting the same message from their leaders. Republicans trying to stay in line. That more than anything else will likely keep the numbers. The house and the senate will keep it below the veto override threshold meaning the declaration will likely stay in place. Thats a good point. Thank you very much. The numbers matter a lot here. Do not be quote weak on border security. The numbers arent there. 67 votes in the senate to override the president ial veto on this just arent there. There is a stand being made by tom tillis and susan collins. We know the makeup of those they represent and part of the politics behind why they may be making the statement. I mean, this is a vote that republicans are going to have to defend. It is a vote theyll have to defend. I think the first question is will they be able to hold their republicans in line so it doesnt pass the senate . You have to bring over four republicans to have the democrats win. The democrats would very much like to have this sent to the white house and have the president veto it. That would be some symbolic victory for them. This particular set of legislative actions have never been overturned through such an action by congress. The democrats do have something riding on how many republicans they can bring over in the senate. They dont have the chance of winning the enough enough nor do the republicans anything to override a veto. The veto carries a lot of weight. So in terms of where this goes from here, the president was warned that and he knows that this is the kind of position with declaring a National Emergency that he would put republicans in. Mcconnell has to bring this into floor. Republican senators have to be on record with their position here. Does the president just not care about the position that that puts many of his fellow republicans in the senate in . You raise a good point because for some of these senators when they go home on the republican side, they are going to find that their public supporters, their voters are not happy about the law. The majority support in the country is against the president and against what the republicans have been standing for. Let me show people what you are talking about. Lets pull up the polling if we have it here because our latest polling from just a few weeks ago is that. It is only three in ten americans that support declaring a National Emergency to actually build the wall. Thats exactly right. I think if you can take a vote in the dark nobody knows who voted how, i think you would probably wind up with only about a third of the Senate Voting for it. Many people there are in the senate and are very, they dont like this approach. They warn the president against doing it. Senator Mitch Mcconnell issued warnings saying it is not a good idea. When the democrats win back the white house as they one day will, we dont know when, they are going to cite this president for doing a lot of very, very aggressive executive orders and executive actions on their own. This just invides the other side. Do you expect, though, that we will continue to hear out of this administration criticism of the Obama Administration for what they deem to be executive overreach on immigration issues . I think theyll let that go for a while. I wouldnt think that is their number one message at this point. They are going to have their hands full with mueller and cohen and north korea and other issue issues. There is a lot on his plate right now as you mentioned. Very consequential. Thank you. A federal Appeals Court upholding a District Courts decision that the merger between at t and time warner can go through, is legal. Justice correspondent Jessica Schneider joins us now. A lot of folks were surprised the appeal happened after the language. The government tried again and lost here. Remember that opinion from the District Court judge. It was very scathing against the department of justice. This opinion is from the d. C. Circuit court of appeals, not quite the same language but the outcome is in fact the same. The three judges in this case ruling that in fact the at t acquisition of time warner, the Parent Company of cnn, it was in fact legal. That was the exact same decision that the District Court came to back in june. The arguments on appeal were heard in december and now it has taken until the end of february for this court to rule that at t acquisition is in fact legal and does not break any economic laws, does not improperly influence economics. These judges, this oral argument went on an hour longer than the time was snilsh linitially slat we saw the judges were grilling into department of justice lawyers. From the very beginning here, it has been asked by at ts lawyers whether or not this lawsuit was even politically motivated. Remember, it was brought in november 2017. And the implications were that because President Trump didnt like cnn that perhaps he pushed the Justice Department to sue, that was never brought up at trial. That was never definitively decided upon. But today this Appeals Court ruling that this acquisition was in fact legal. Now the question becomes is the government going to try to push again . Will the Justice Department take this to the highest court . Will they take it to the Supreme Court . That is the big question. There are two different factors here. First of all, this was a panel of three judges on the Appeals Court. It is possible that the Justice Department could ask for a decision on bond where the entire slate of judges asks questions and makes a ruling. The Justice Department could also go forward to the Supreme Court to ask them to issue a decision. I want to point out real quickly that the new attorney general here william barr was actually on the board for time warner. And when this lawsuit was going forward, he actually questioned it in a deposition wondering if it was politically motivated so that is an interesting wrinkle here that he is at the head of the Justice Department. We heard from ramus that it was when he showed footage of children eating out of bins that he felt that Nicolas Maduro seems to have snapped it is probably fair to say and called the interview off. The crew were put into a room and had the equipment taken from them and left and went to their hotel. They say they were surrounded by authorities unable to leave. They were taken to the airport and we understand they will be leaving venezuela, deported effectively. They havent had their equipment back as far as we can tell, unable to air the interview and the moment that Nicolas Maduro didnt like. These are foreign journalists. They get to leave.
