Build his border wall in the process potentially triggering another Government Shutdown and even perhaps a constitutional crisis. This morning a growing number of republicans are speaking out against executive action to spend money at will on the president s desired wall. We begin with cnns joe johns at the white house. A message of unity from this president. Thats right, jim. Whats not so unifying is immigration. This is the issue thats torn up capitol hill and washington all month pretty much. We do know we had the big Government Shutdown, of course that was the longest shutdown in american history. The president is going to address immigration question. The question is whether hell declare an emergency in order to get his wall on the southern border built. As you say, unity is one of the key issues. Sarah sanders, the White House Press secretary a little while ago on new day talking about the issues she says can unite the president and the congress. Listen. Certainly i think you can expect that the president will talk about infrastructure. You will hear the president talk about the Opioid Crisis in this country. Im going to leave some things for the president to talk about. There are a number of policies democrats and republicans know need to be addressed. Infrastructure is one of the easiest ones to look at. Now lets talk about some of the guests that the president and first lady will have at the state of the union offering a clue about the direction the president is going. One guest we expect in the box with the first lady will be alice johnson. This is the convicted drug trafficker. The president granted her cl clemency after an appeal from kim kardashian. On great lakes we expect three family members of a couple murdered in nevada last year to be there as the president talks about immigration issues. Those people allegedly killed by an illegal immigrant. They are also expecting to see Police OfficerPolice Officers, Law Enforcement including one Police Officer shot at the synagogue in pittsburgh last year. Back to you. We should note next hour Kellyanne Conway, counselor to president will join me on cnn on set to talk about the state of the union and other pressing issues. Cnns Phil Mattingly is on the hill. Republicans seem increasingly worried about it and publicly expressing opposition to the president s possibility at least of declaring an emergency to fund the border wall. Some of his closest allies raising constitutional concerns here. It must concern the white house. Exactly right. The concern for the white house is that the National Emergency declaration is seen as the escape hatch. If they couldnt reach a deal between parties you would declare the National Emergency, allow the government not to shut down again and move forward with the wall. But now republicans are voicing concern. Im told Republican Leaders informed the rank and file if you have problems make it public now because people like mitch mcconnell, they have problems with it and thats what we are hearing. Take a listen to what Susan Collins had to say. I am concerned about it. I think it is of dubious constitutionality. As a member of the senate, i am concerned when any president , regardless of party, circumvents the appropriations process and repurposes large amounts of money. So you hear concerns on constitutional grounds, ideological grounds. The idea that a president can act unilaterally and like senator cornant who say its not necessarily always going to be a republican president in office. He said, quote, the whole idea that president s whether its President Trump, president warren or president sanders can declare an emergency and usurp the powers and get into the business of appropriating money without congress involved is a serious constitutional question. One of the big issues now besides the fact that republicans are raising concerns, they are trying to head it off before it occurs. The backdrop is negotiations trying to figure out a path forward on Boarder Security funding is Going Forward. If the president does declare a National Emergency, congress can actually push back on that. Im told House Democrats are planning to vote on a resolution of disapproval or vote on something to try and block this. If that occurs, Senate Republicans would be forced to vote on the same thing. Its something that could split the conference. You are hearing republicans on the leadership level and rank and file urge the white house to this course. Might set up a veto battle down the line. Is that a message the president can deliver . Not at this point. Given the divisions between democrats, divisions in his own party, its too little too late to say the least. Not to mention his recent actions and the actions look at what phil was talking about with the shutdown. There could be another Government Shutdown in just a few days because of the president s and the congresss stalemate over what to do about the border wall. There hasnt been trust. There continues not to be trust. I dont think a state of the union speech will heal a lot of divisions that are very present right now in this country. It was a similar message to last year. A message of unity. We saw how that went. David, is a shutdown a real possibility . Now hear on the hill, republicans included, working on a plan without the president s involvement here. If they dont have the president s support will they just find a way to keep government open . Good morning, jim. Happy Lunar New Year to everybody. To your question, heres my thought. I dont think either party has an appetite for another shutdown. Republicans see the democrats are dug in. The white house sees it too. I dont think democrats want it either. They see how government workers were hurt and air Traffic Control and things were messed up during the shutdown. You look at the potential for the president to declare a National Emergency. Even if its a loss for him its a win for this reason. It is the one way he can get out of this jam without looking to his base, the 40 of people supporting him like he has retreated on the issue. Even if it goes to the courts, even if the courts say its unconstitutional, he can go back to his base and say, i thought, i took it all the way, i took it to the courts and the courts thwarted my efforts. Before it gets to the courts, if republicans do stand firm on this, at least the ones who have come out in opposition to this, you could have a resolution of disapproval which would require a president ial veto to get the Emergency Declaration through. It may not even get to the courts if republicans are unified in opposing the move. Right. I dont know that well get its hard to say whether republicans will or wont be unified. We have seen republicans come out and say one thing and when the president s like, i need you, they come and back him up. They certainly dont want to publicly rebuke the president. Some of them are publicly coming out saying please dont do this. With john cornant calling it a constitutional issue thats going pretty far from a republican senator. Who is looking at a reelection battle. Politico has a great piece on this. Also consider those considerations from a politicians standpoint. I think they are trying to head it off at the pass. Well see if they are successful. Because the president only listens to himself at the end of the day. David, Bernie Sanders will give his own state of the Union Address for the Third Straight year. Democrats elected stacy abrams from georgia. Why is Bernie Sanders doing this . There are people saying it seems like senator sanders is stealing limelight away from stacy abrams, a rising star in the democratic party. Lost the governors race. Lots of democrats want her to run for senate next time around. She is seen as one of the new faces of the party. An africanamerican woman, yale graduate. You can see why Bernie Sanders wants to do it, but we know what he thinks on these issues. We have heard from him all through 2016. Why is he doing this now . Not 100 clear. One final note, the optics tonight will be interesting. The president , the speaker and the Vice President behind him. After years of republicans occupying the seats you will have nancy pelosi looking over the president s shoulder. Right. Do you think hell be aware of that and she will be as well . In the past the president stuck to decorum with the state of the union. Its one of the rare times hes stuck to the teleprompter. Really stuck to the format. Will he turn around and sneak a look at nancy pelosi here and there and say, hey, nancy, lets Work Together, i wouldnt past him. Well expect to see her reactions. Absolutely. She has a poker face. If im remembering correctly from years prior. She certainly has experience with this. David and jackie, thank you very much. Federal prosecutors have now subpoenaed president Trumps Inaugural Committee demanding wideranging documents related to donors, vendors and finances. We have the latest on that. Plus, governor of virginia Ralph Northam standing his ground saying he needs time to clear his name over a racist photo in his medical School Yearbook. And the Washington Post is reporting the Trump Organization has fired at least 18 undocumented workers in the past two months. One attorney said his client worked at a trump golf course for 18 years. The president and his inner circle are under new scrutiny but not by special counsel robert mueller. Subpoenas for president Trumps Inaugural Committee. The subpoena indicates that prosecutors are investigating a wide range of potential crimes from Money Laundering to conspiracy against the United States. I want to bring in cnn reporter kara skinel and carrie cordero. It is a wide ranging subpoena. Documents, list of donors and so on. How wide ranging and what appears to be the prosecutors goal . This is a wide ranging subpoena asking for the list of donors. Any communications they had with the committee, how they paid their committee. Its asking for the list of vendors, people who received the money. Specifically if vendors were paid directly by a donor which would imply they were skirting the disclosure obligations. In the subpoena they lay out a wide range of crimes that could have been violated here from both Money Laundering, mail fraud, wire fraud, disclosure obligations and whether any foreign donors might have donated to the. Ka pain through straw donors. Its a crime for foreign donors to donate to the inauguration and in other names. Interestingly, this is a wide ranging subpoena also seeking financial and bank records. They do identify one donor in particular, an american whose name is amad zoubari, a venture capitalist. Its not clear why he was singled out. There are 50 other individuals and corporations that donated more than him to the inauguration. Hes a longtime hillary clinton, barack obama supporter. Hes big in the space. His spokesman gave us a statement saying ahmad gave his own money from his own resources. He said they are bewildered why he appeared in the subpoena and only learned of it when prosecutors told him about this. Hes puzzled. With a wide ranging subpoena here, would federal prosecutors issue such a subpoena if they didnt have evidence to back up something here . Or can it be read as a fishing expedition or do you not go down the path unless you have evidence of a potential crime . I dont think its on either end of the spectrum. A grand jury subpoena is a basic investigative tool. It is a low standard to get it. The records requested and the information requested needs to be just relevant to the underlying investigation. There is an ongoing investigation. To be honest im surprised it took this long. It was five months ago that an individual by the last name of patton pled guilty to having funneled foreign money into the inaugural committee. I have been waiting for a while to see if we would see further information related to the inaugural committee. This is the initial step in the investigators process to gather a lot of information. It doesnt necessarily mean that the information they acquire will end up being able to be prosecuted. Its a necessary step if they are trying to explore these potential crimes. To be clear, accepting money from a foreign source is illegal, if you know. That would fall under the Campaign Finance violations. Thats not what that particular individual was charged with. It was other crimes. One of the things that it turned out he did was funneled information and at the time that plea came out, the american who he funneled the information through, the strawman wasnt identified in the documents. We are still waiting to see who it was. The significance of this being federal prosecutors in new york, is this a pardonable crime . If someone was to be charged and we are not there yet, but could it be pardoned . It would be a federal crime, investigated by the federal prosecutor. It could be pardoned. To carries point sam patton pled guilty and is cooperating with muellers team. We are now seeing it in new york. We see signs that mueller might be wrapping up, seeing the new york prosecutors take on more. It wasnt just sam patton. We knew muellers team stopped some russian oligarchs including victor vexelberg and questioned him if he had donated money to the campaign. He didnt cooperate. Its something muellers team has been poking around on for at least a year. Some information was picked up with michael cohen, a vendor for the committee. We are seeing it come together but under the new york umbrella, not mueller. Many of the cooperation agreements demand cooperation from the individual who is pleading with other Law Enforcement sources, other Law Enforcement agencies including other prosecutors that wouldnt have to be the special counsels team. Having said that, you have seen a number of lawmakers here in the state, community leaders. You have several candidates for president for 2020 who said, look, it is time for you to let it end. It is time to step down. This is one of the busiest time of the year to get Legislature Bills passed through the state. This man says i can be effective. I just need more time. Thats what hes doing today, reaching out to supporters. He says he has support from family and friends. His wife standing by saying he should not resign. Thanks for taking the time. Good to be with you. You heard the report. The governor of virginia is asking for time to clear his name. Does he deserve the time . I think he should step down. Its offensive to tens of millions of americans. Also, when you hear from senators tim kaine and warner, both served as governor. They can speak to the question of effectiveness. Thats conclusive. Moving on to the president s speech tonight, we are hearing consistently from advisers that his intended message will be one of unity and possibilities, areas of bipartisan cooperation. In your view, can this president unify the country . Well see. I hope hell speak to or use language of unity and have an affirmative plan Going Forward, especially on things like infrastructure. I would like him to focus on a broad agenda for children to finally have something akin to a marshal plan for kids to help everyone in the long run. Early learning and helping kids when they are young. He should say no more shutdowns while im president and work to make the federal workers whole with back pay and help as well. Ill have a young woman with me who suffered through it, an Army Reservist and tsa officer who is emblematic of the suffering. The president will say he wants to stick with his wall, however he gets there. There are other possibilities. Is there room for compromise to get votes on board . For instance, would you vote for money for a barrier on the border for a portion of the border if you receive, say, in return permanent protection for dreamers . Most of the negotiation will be between and among the appropriators. Thats the way it should be. When you look at what both sides said about Border Security, there is a lot we can agree on. This has to be real Border Security. When you have 90 of the cocaine and 80 of fentanyl coming through ports of entry, weve got to stop the drugs. The illegal crossings are at a 40 or 50year low. We have to recognize what works in Border Security and what doesnt. There is a lot of compromise within the negotiation. The president should try to unify. Legislation is about compromise. The president is committed to money for a barrier. More Border Patrol officers, et cetera. Im curious on the Sticking Point. The proven Sticking Point which is money for the border wall which Many Democrats said not a single dollar. Would you vote for something that included money for the barrier if, in washington style, there was something in return. Like protection for dreamers. As i said last week many of us voted for fencing. Just since i talked to you, the president is back to wall, wall, wall. If he wants a concrete wall over more than 1900 miles hell need much support for that. We should focus on what works, effective Border Security and there is a lot of Common Ground on that. Infrastructure comes up. It came up after the election in 2016 and said, well, democrats and republicans Work Together on infrastructure. Came up in the last state of the union. Its coming up again here. Im curious how you get it together, particularly in light of the fact that the deficit has grown. Where is the money coming from and what would it look like . No question. If the president speaks to this, will will be a tremendous support for it. He should have started with this at the beginning of the administration. He admitted that. We were in a meeting in october of 2017 on tax reform. He said i should have started with Border Security. He should have started with infrastructure. I heard him say that. In our state, for example, weve got more than 4,000 bridges structurally deficient. We have high Speed Internet thats not deployed in rural areas. If he speaks to that hell have a tremendous reception to that. Part of it in how you move forward will be how you finance it. You can borrow somewhat to leverage the dollars. There is a lot of support for that. Unfortunately the president uses the word infrastructure, talks about it. He moves on. He needs a sustained focus. He should travel the country talking about it and make it a priority. Its not been the president s style necessarily, issues like that. Im trying to encourage him. Hope hes listening. You have heard colleagues in the senate and house express grave concerns. Do you believe he would be overruled in congress . I believe he would be. I dont know the outcome in the courts. I havent taken a review of that. Theres strong sentiment based on what we have heard. Even within the Republican Senate caucus that this is not the way to go. To declare an emergency of that kind, its a high bar. I hope you think about that before he makes such declaration. On the state of the union, traditionally, you will hear a president s call for bipartisanship and unity. Thats not a new message. This president called for the same last year. You were around washington for the last year. Didnt see much bipartisanship and unity. I wonder in your view if the power of the that message is lost. Do you hold out hope that perhaps this is a president who can use his state of the union this time around to change the tone. People in both parties want it but the president has to lead it, not just say it. Once he has to lead and demonstrate it. He has an opportunity tonight. Well see what he does. It was quite a moment to have him on the hill. Hes the man who has to carry out the president s orders here. Discussions of withdrawal from afghanistan as well. You know better than me. Whats the reaction within u. S. Military and folks on the ground there to this decision. Do they think it makes the country less safe . The general is a superb officer and leader. He has his work out cut for him this morning. In both afghanistan and syria, arguably the president s decisions which seem to have been impulsive, cutting the force in half in afghanistan, pulling everyone out of syria have probably undercut our position in both countries. He has to explain why we are better off with the decisions the president made and not worse off. Afghanistan, i think there is widespread view that the president s desire to pull back is probably the right thing to do. To do it in the way he did at the moment we are negotiating with the taliban, undercutting leverage we have, giving them something for nothing probably wasnt smart. In syria, the 2000 guys there that the president ordered out, we are leveraging about 60,000 local forces to keep pressure on isil. Thats a small price to pay. The president said his plan b in effect was to keep isis at bay and syria from afar. Use forces in iraq to do it. Whats the difference of having folks on thing front lines versus a couple miles away. Its easier and less costly to keep a small presence there, to keep them down than to play what can a mole, watch them get back, wreak havoc and come in to deal with the fire instead of keeping the fire from erupting in the first place. The president will make a Public Comment which is out of line with miscommanders on the ground or other Senior National security officials. He did it on u. S. Forces in iraq to keep them there in large part to keep an eye on iran. That caused issues with iraqis. Explain why it is and how you get over it. Its one thing to say you want to keep u. S. Forces in iraq to keep an eye on isis or isil. It is another thing to say they are there to keep an eye on iran. The last thing you want is a launching ground for an attack on iran. To say we want the United States out if you are focused on dealing with isil, iraqis can support that. About iran, they wont. This is a mistake to capture it in those terms. There is talk the president may announce it tonight, the date and place. It may not happen. All things indicate this month there will be another summit. I was at the one last time around. Since then theres been no discernible progress based on the administrations standards. Thats right. Why have another summit now . The president likes big moments in the international spotlight. He thinks the way to get something done is leader to leader and it cant happen at a lower level. The first summit turned the art of the deal into the art of the steal. Jim congress got the international stage, was on par with the United States. The pressure, the economic pressure was less centuried. All of that acrewed to his benefit and he didnt give anything in return. This is the thing. Very little planning went into the initial summit. The president didnt really have a good game plan. He ended up basically giving away exercises in the region. He mused about pulling forces out. A surprise to south korean al lice. And japan. I hope this is better prepared wechl need to know what to get out of it. You wrote an on sed in the New York Times where you wrote the Trump Administration hasnt faced a real National Security crisis. In a way its been lucky in terms of Foreign Policy. Where do you see the greatest danger in the next two years of the trump mt si for a crisis . We have been lucky. We havent had a major terrorist attack, a major cyber conflict. We havent had a skid mark makeawish wi major skirmish. We havent had ebola though thats raring its head. We havent been tested. I worry this administration unfortunately is probably the least prepared to deal with a crisis. They dont have the three things you need people to make sure the president has good ideas and a process to bring everyone around the same table to make sure weve got the right plan and a basic policy for anything that is your starting point so every one of the administration is talking off the same page. The allies know what we are about and so do the enemies. In the absence of those things when you get into a crisis youre flailing about. Clarify necessary. Thank you very much, tony blinken. Christina, this is remarkable for a president who has made undocumented workers such a priority for him and yet they were working at his golf cour courses. 18 is the latest number the Washington Post is reporting across five golf courses in new york and new jersey. Those firings have happened over the last two months. This is not the first story. Last week the New York Times said that they knew of three golf courses. Now we have five golf kourbscou we dont know the extent to which the Trump Organization relies on undocumented workers. At the same time the president is out there blasting illegal immigration, trying to get border wall funding and opening himself up to criticism that this is just hypocrisy. That is playing out. We still do not know exactly how many workers in the Trump Organization are illegal. Part of the reason is we are in the winter season and some of them are seasonal. So they may be asked not to come back after this investigation, this review, this internal review happens. Based on my reporting i was told that the Trump Organization launched a review of the Employment Status of their workforce after some of the workers started going public and these stories began being published. I understand some workers are speaking out talking about their circumstances. What have they been saying . Well, they are trying to raise the profile around this issue. Some of them are going to the state of the union. Some of them are asking congress for protection against deportation. And some of them are just really upset. We have heard story after story about workers being employed at the Trump Organization for years and years and now having to find other work with Employment Status that is questionable if not illegal. So final question. What does this mean for the Trump Organization and are there legal consequences for employing undocumented workers . It doesnt seem like there is any legal trouble. This is more of just a headline issue for the organization. It really is according to my reporting and my sources the organization has really ground to a halt in terms of deal making because it has had to deal with so many other issues from investigations on the hill to providing documentation to investigators for possible criminal inquiries. All of that is quite distracting. This is just another negative headline the company has had to deal with. Part of it stems from the president s decision to keep ownership in the company. So how contentious do we think this fight will be . Reporter its a new congress. These judicial battles are heating up again. Today it is for the powerful seat on the d. C. Circuit. That seat was vacated by Brett Kavanaugh when he was elevated to the Supreme Court. She is 45 years old. She is an Indian American and serves as President Trumps socalled regulatory czar. Her opponents say there are times when the regulations coming out of those federal agencies are really important ask they protect people in areas like the environment. But they are also looking carefully at some of the things that rao wrote in college in her 20s. She wrote commentary for the yale journal and the Washington Times about issues like multi culturalism. She also wrote about a date rape that occurred at the time on the campus that had a lot of drinking involved. She said in this yale paper piece it has always seemed that even if i drank a lot, i would still be responsible for my actions. She went on to say a man who rapes a drunk girl should be prosecuted.
