His medical school year book. Will Ralph Northam conclude that he can no longer effectively govern and resign . A lot of folks watching for his answer to that question. Lets begin with a closer look at the poll numbers. It is interesting, the president off his lows for Approval Ratings. What did we learn from this more broadly . It dipped down in our poll, too. Take a look at preshutdown and during the shutdown and you can see he is now at 40 . He was at 37 , 39 . So you see that he has come back a bit. This is all margin of error stuff. He does not operate outside of a pretty narrow band here no matter what the news environment is. The Government Shutdown being over has helped a bit. Lets look at how he looks compared to his predecessors at this point of his presidency. He is near the bottom of his 40 Approval Rating. Only reagan was below him. Reagan went on to win a resounding reelection victory in 1984. The fundamental question about 11 days from now, are we going to have a deal here that is going to prevent another Government Shutdown . Take a look at how pessimistic americans are. 64 say it is not likely that congress and the president are going to come to terms here with the next government funding deadline on friday february 15. In fact, the possible solutions here are also widely unpopular with the American People. The majority of americans do not want another Government Shutdown. You see there 57 would oppose that. 39 support it. Take a look, also, the majority of americans do not want the president to employ some National Emergency action. Here is the rug. That is the majority of americans. If you look at a majority of republicans, that shows you why trump is in a political box. A majority of republicans are okay with the shutdown. A majority of republicans are wanting him to employ that National Emergency action. That is fundamentally the political box he is in. He has another problem which is there is a new world order in washington. It will be nancy pelosi above his shoulder tomorrow night at the state of the union. 51 of americans say they would rather the democrats in congress set forth the policy agenda. Only 40 say so with trump. Speaker pelosis favorability rating in this poll is up. She is at 42 favorable now. That is her best favorable rating in cnn polling dating back to 2007. And it is largely coming from democrats who are so pleased with how she performed over the Government Shutdown period as she received the gavel and became speaker of the house again. As you know better than me, the president really governing to and for the base here. Do the numbers show he is keeping the base more broadly but also on this issue. They do. We saw last month in the middle of the shutdown some key part of his base, noncollege educated white voters. We saw their support dip a bit. It has snapped back now. Thats why we see him at 40 here. The base is fundamentally with him. That is why his calculation is that he does want to do nothing to offend the base or dissipate his support among the base even if that means risking going against the grain of where the majority of the American People would like him to be. As we speak another major story we are following, embattled governor of virginia Ralph Northam looking for support trying to decide whether he can survive the criticism coming in from all sides republicans and democrats. State and National Leaders calling on him to resign after he first apologized and admitted to appearing in a racist 1984 photo and insisted it was not him in thepicture. Ryan nobles has more. Are we getting inkling as to what is happening in the meeting and whether the governor might be changing his opinion on whether he stays or goes . Reporter not as of yet. I just checked in with a source close to the Governors Office and there has been no specific read out as to what the conversation is behind closed doors between the governor and his closest group of associates in virginia government. We need to emphasize the role of these meetings and this deliberation process for Governor Northam. He pretty much lost the support of elected leaders across the board. The only support remainsb are those people he has appointed to the specific government positions. He said he will only stay in office if he believes he can continue to govern effectively. If he loses one of these cabinet members there is evidence that that will be very difficult for him to hold on. We dont exactly know exactly what his message is to the cabinet members. This is a regularly scheduled Cabinet Meeting. Obviously, the focus had to change given the pressure on the governor. And then he has a meeting with a Broader Group of Staff Members where he could get a strong sense as to how these members of his administration feel about this Current Situation and whether or not they are going to allow him this time in space that he is asking for to convince them that he is not one of the two people in this photograph and that paragraph does not represent the type of person that he is or the type of governor that he is. He said northam should not resign and that he should be judged by the full expanse of his career and not just this one moment. Should Ralph Northam step down . He absolutely should. Number one, on friday he should have been able to tell us that it wasnt him. As jake tapper so eloquently pointed out yesterday, when your response was that wasnt me in that black face because i was in this other black face, you are losing. Moet importa most importantly, he doesnt seem to understand sincerely the current pain that is being caused by this imagery in terms of the ku klux klan and what that means and black face. And he does not have the support of the people that he would need to be effective. So it is long past time for him to just step down. I wonder if you agree . I do. I lived in richmond, virginia in the 70s and remember a lot of the racial strife. Its already come to a place where it is ungovernable for the governor to continue. There has been a lot of talk this weekend if northam has to resign what about this politician or that politician . We should remember, there is power in pictures. It is part of the reason that al franken is no longer in the senate. There is not talk or speculation about Ralph Northam, it is the pictures. That is what people are reacting to and ultimately why he will not be effective as a governor regardless of what he decides to do and then there is the press conference which is even further embarrassing for the governor. That wasnt me in that black face and also the talk of moon walking and so forth where he almost seemed to enjoy it. It was an embarrassment for the state. Let me move to the question of the border wall, state of the union tomorrow and continuing discussions on the Government Shutdown. Two thirds of americans do not want the president to build a border wall on his own by declare ag National Emergency. They dont want the Government Shutdown again here. You do hear from the president s own polling people that the border wall issue works for him in key swing districts. And i wonder if you buy those numbers because there was evidence in the mid term elections that doubling down on the border issue actually hurt republicans. What is your view and what numbers have you seen . I think polling is in the eye of the beholder. If you pelosi and the democrats you see a large number of the country doesnt want it. If you are donald trump and you are talking about the base, that is what is guiding this president. If he tries to do this on his own. I would say one thing to caution my republican friends and this white house, even if you think this is a good idea for this president , what that would do is set a precedent for future president s. If you dont want to see the next president or future democratic president use executive action to declare a crisis on immigration or guns or climate change, this would be a mistake for those reasons. Let me ask you because yes the president has dug in on this issue no question and changed his position because it was a continuing resolution before christmas that had less money for the border wall. Democrats have dug in and changed. In the past they voted for money for the border wall. I wonder if there is risk for democrats playing what is effectively a zero sum game saying we will not give a penny on it and from their point of view that is a winning political issue . In the mid terms many were elected to get things done in washington. Sure. I think there are a couple of things. Democrats have actually been consistent in talking about security, Border Security, Port Security. They have given him i think 1. 7 trillion, billion. Im losing counts these days already for the wall. Its not like they havent given him some. Nancy pelosi said not a dollar for a border wall. They have also put on the table supporting what the republicans in the senate have support chd talks about a range of things. This morning i was listening to the story about el chapo. What did they say . All the proof was they use submarines, trucks. They did not climb over a wall. They used tunnels. That is not going to stop drugs. So the arguments that the president is making are also completely false in most cases. And it is true that democrats have put on the table they said not money for a wall but we want security. We want things like tougher Port Security because that is how you stop sex trafficking. Thats where the folks come in through. Thats where you stop drugs. If we are talking about Real Security the last thing i would say is that i think pelosi part of the reason i thin she has polled so strongly in this cnn poll is that people understood from the beginning that her position is im not going to use the American People to bargain with you. I think the risk that the president runs tomorrow night is if he sounds like he is again willing to put americans at risk, their own Financial Security and their livelihoods in order to build this wall, i think there is a real danger. I dont think many republicans are ready to go with him for that. Doug, i have to ask you, in a normal world, you would have democrats saying give me money for the border wall but we want a deal for protections for dreamers. You talk to republicans and democrats on the hill, they kind of shake their heads when you can about even a simple compromise like that. Do you see any room realistically for a compromise in the next week and a half or so before the next deadline . I think it would be in Donald Trumps best Tropical Storm fin to be the negotiator he always said he is. One of the things we look at in this polling, it isnt just Donald Trumps popularity, washington is unpopular. Voters are unhappy that washington is. Getti isnt getting things done. We learned that the president now spends 60 of his time in executive time, unstructured time making phone calls, apparently watching tv, sending tweets. Does this show a president who is serious about the office of the presidency . I think yet again and we have seen it many times from his twitter feed sounds like he is probably watching television and thinking that governing by twitter rather than reading briefings that people put before him is the way to do the job in the office. I think it is certainly not the best use of time. This kind of a leak is an absolute betrayal from donald trump. If this happened to president obama or president george w. Bush i would say the same thing. Staff should not be doing this to their boss. What if they are alarmed about how the boss is spending their time . There are better ways of doing that. We want to give the government the ability to negotiate with Large Pharmaceutical Companies for lower Prescription Drug prices because there are tens of millions of american whose are having hard time making ends meet because of the Prescription Drug problem. We have a health care agenda. We have an infrastructure agenda. We want to increase wages for the American People. That is very much on the horizon for us. We have our hr 1 which is a democracy reform platform to eliminate gerrymandering. We want independent redistricting commissions in every state of the union. Said they wanted to keep redistricting in the hands of politicians. We have some very big policy differences. We want to focus on that. We are not for shutting the government down. We are for making the government work and keeping it open. I get that, but for all of those things you will need republican support because they control the senate. I wonder when you look at the debate over the border wall, you really have democrats digging their heels in on this as much as the president. To be fair, the president has reduced his demand from a wall from sea to shining sea to a barrier for a few hundred miles and the democratic leadership saying not a penny for any barrier. What is to stop folks from believing you are not being just as political as the president on this . We have a number of big ticket policy items where we got real bipartisan consensus. Take for example universal criminal background check on all firearm purchases which is supported by more than 95 of people but under republican control they wouldnt allow us to have a hearing much less a vote. We will move that through the house and we are hoping that the senate allows a vote on it and that Mitch Mcconnell will bring that to the floor. We have a majority of people that supports the dream act which was another clear common sense measure which was frustrated under republican control. Now, on immigration, we have put billions of dollars, more than 9 billion into Border Security. We have a proposal for improving cargo inspection, filling 3,000 i get all of that. You know the president is digging his heels in on a wall. We are facing a deadline. The president is giving ground here. Will democrats be willing to give some money perhaps 1. 3 billion as approved previously for an actual barrier on the border . We have invested in Border Security and fencing before. We are very willing to thicken the defense of the border. We have actually shown that we are the ones who are willing to sit down and compromise without shutting the government down. That is one thing rejected. We completely reject that and the American People reject that. I think there are clear grounds for us to get to yes on this. We never had a problem before. Its the president who seems sort of zealously committed to a border wall and nothing else. And he didnt raise that when the republicans controlled the house and the senate for two years. It wasnt until we beat them by more than 10 million votes that they decided suddenly this was a take it or leave it offering. There were opportunities before. I want to ask you about what is going on in the state of virginia right now. Ralph northam as you know holding a Cabinet Meeting this morning. You have called for his resignation. You say it is a time for moral clarity. I wonder if you are concerned that if he does not resign does this damage democrats attempt to draw a clear line on the issue of race . I think there is a clear line between our party and their party. When the president said after the debacle in charlottesville that they were very fine people who marched under the nazi flag and confederate battle flag i think that drew a very strong moral contrast between that party and our party which looks and sounds and acts like america. We are the greatest multi cultural democracy. I think Governor Northam is finding Political Leadership has to be held to the highest standards. He can act most honorbly by stepping aside and letting Lieutenant Governor become governor and he can continue to be involved in the party and continue to work to make things good. The images are too searing. We think they should get rid of steve king, the congressman from iowa who is continually engaged in racist provocations on the house floor. We dont think there is place for this in the 21st century. Final question, if i can, it is 24 months and two days since Jamal Khashoggi was murdered cia says likely with the approval of the crown prince of saudi arabia and yet the Trump Administration has not penalized the saudi since then. What are democrats doing to ensure that the saudi government is held accountable for this murder . Actually, we just had an event i think last week or two weeks ago about the khashoggi assassination and about making sure that saudi arabia is held accountable for what they did and also for ending the saudi war in yemen which has been an absolute atrocity against civilians there. Im glad you raise it because human rights has got to be the central commitment of American Foreign policy and the president has completely abandoned our role fighting for democracy and human rights. What is the materiality of the statements . Paul manafort is not remembering what time a meeting was. I think the judge would view that as inocue s. The prosecutors are saying there are five substantive areas. The real issue for prosecutors boils down to dont waste our time f. You are going to lie to us then dont come in or you will not get the benefit of what amounts to a constitutional contract because fundamentally what we have here is we have Paul Manafort or any other defendant who enters into a plea agreement with a cooperation component who is basically giving up his constitutional right to trial, constitutional right to appeal and various other Constitutional Rights such as cross examining witnesses. Fundamentally, the judge will make a determination, was the government or is the government acting in good faith and saying we dont want to honor our end of the deal. Does the special counsel need Paul Manafort for his larger case here . You would think he would be a central witness. He had a lot of contacts tied to russian intelligence. Is he essential to the case . The short answer is we dont know. We have to think about Paul Manafort already as a convicted felon. If he were to have been a bona fide cooperator, he has rendered himself useless to the government given he is being accused of lying. So obviously the fact that the prosecutors are able to make that really strong assertion that he lied means that they have the evidence already to test his credibility. Now they are basically saying we dont consider him credible. He has wasted our time. He has wasted investigative resources. It is critical for the lawyer to that client in those situations to make sure that does not happen because it really is unproductive for the client, as well. Final question, both the president and his nominee for attorney general have held out the possibility of not publically releasing the final mueller report. Who is it up to . What happens if they dont release it . That opens up a whole different area. My tour as a federal prosecutor was with the independent councils office. It required the independent counsel to write a public report to congress available for public consumption. Here we are talking about a report that is for the attorney general. I believe that is up to the attorney general because the statute does not provide, the regulation does not provide for the report to be public. It is certainly not up to the president. The interesting debate will be what happens if Congress Subpoenas the report . I think there is a lot to play out. I think we will be going to be looking at this for a long time. We are not at the end. The mere fact that roger stone was just indicted, these prosecutors are not going to walk away from being able to try roger stone.
