Theres no sense right now that at the top levels people are willing to come off their stated positions. There is, however, a lot of grumbling in the rank and file and a lot of frustration and desire to get a green light to try and make a deal. They just need the folks at the top to give them that. The white house is moving forward with the plan as is and they havent heard from nancy pelosi directly on this. Remember her letter didnt formally disinvite the president from giving his state of the union on capitol hill but simply asked him to delay it. The white house says they will be ready. We always like to have a plan b, but the president should be able to address the American People whether he does that from the halls of congress or whether he does that in another location. The president will talk to the American People on january 29th, as he does nearly every single day. Were going to continue moving forward with the state of the union and well see what happ s happens. We had clay higgins on and he said im not going to support amnesty. I accept theres going to be some on the right that oppose it. I dont think that means its a nonstarter. I think the reality is youre going to see the vote this is week that i think put people on record. Ultimately i think that were still more likely to head toward a declaration from the president to just get this over with. I think it has gone on too long and i think people are suffering too much. Its apparent that congress is not going to find a resolution. A National Emergency declaration . I think thats likely a pathway forward. Hes not in the cabinet. This isnt a political role. Its a numbers role. He just told us unequivocally that if this shutdown continues through the First Quarter the u. S. Economy could see zero growth in q1. The white house hears a headline like that, thats got to be concerning, right . Because the president has consistently polled higher on the economy than anything else. One, i dont see how this could extend throughout the entire First Quarter. I think too many people are hurting, too much pressure is going to be applied to get this resolved. Certainly shutdowns dont help anybody. Its not good for either side to be in this position. I dont see scenario where you go through a shutdown the entire First Quarter. You say National Emergency declaration is the way out. And i know there are somes who that will get us through this. What kind of precedent does that set Going Forward that if a president cant get what he wants through Congress Just declares a National Emergency and he can define what an emergency is. Because the numbers dont support an emergency today. Well, fair point, jim. I think it is a bad precedent and i think its a fair criticism that republicans complained about the executive orders of the Obama Administration and i think its been too frequently relied upon in this administration. I think thats a very fair criticism. Having said that, i do think theres justification to say theres a crisis. I dont think you have to go back to just this year. In fact, it was president obama who used that terminology humanitarian crisis in a speech in 2014. Both sides at different times have acknowledged its a crisis. Im not suggesting this is the right way normally to go when congress cant solve it but it is something thats significant and in this case merits it. Crisis is different than a National Emergency. Its a Legal Definition empowered by congress, declared after 9 11 for instance. Thats different from a crisis. Thats a good point. If he does that, it will be litigated in court, the government would open up and at the end of the day we would be able to determine whether he has that power in court. If he doesnt, then he will learn that he just has a separate coequal branch of government that he has to deal with. I reject the idea that he has the power for this purpose.
