The dash cam video has a wider perspective. In it you see an officer behind a truck. It appears he has something in his hands, but you cant make out clearly it is a gun. It is just in a matter of seconds while police have their guns trained on mr. Scott, giving him verbal orders to drop b his weapon, drop the gun, drop the gun. As he is walking backwards, when he is walking backwards, wbrid wbr670 thats when the fatal shots were fired. The body cam video is just a minute long. The dash cam video is about two minutes long. You hear verbal commands by Police Officers as their weapons are trained on mr. Scott, but its not clear from watching the video that he had a gun in his hand. It does appear he had something in his right hand. Poppy. Just reading through the statement, i know you have just seen it as well, the police here are saying due to the combination of illegal guns and the gun, thats why the offices decided to take action. They outfitted themselves, they put vests on to mark them as Police Officers. They were there in plain clothes on a warrant trip for someone completely different. When they came back, the officers again witnessed mr. Scott in possession of the gun and they identified themselves as Police Officers. Repeated those verbal commands to drop the gun, and then another Police Officer came up in a marked vehicle to help them. That is the officer that used his baton, they say, to breech the front passenger window. As we heard from the video released from mr. Scotts wife, you hear her saying dont let them break the window. Come out of the car. This Police Statement goes on to say that mr. Scott exited the vehicle with the gun. He exited the vehicle with the gun, backed away from the vehicle while continuing, they say, to ignore officers repeated commands to drop the gun nap is when, and this is the key, right . That is when officer vincent says that he perceived those actions and movements an imminent physical threat to himself and other officers, nick. He is taking steps backwards, that much is clear. But looking at it and the police chief said as much in the press conference that there is no one piece of clear evidence that is going to satisfy the narrative of the story of what happened. Police are sticking to what theyre saying. Theyre saying they gave verbal commands for him to drop his gun and he did not comply. From what i saw in that video, he is never asked to put his hands up, and he is shot as he is taking those slow steps backwards. I think the real critical part of this reslaes that they say that mr. Scott got out of his car with the gun, even he backed away from the vehicle and did not follow the officers calls for him to drop the gun, and they perceived his actions and movements as an imminent threat to physical safety. What is the bar for feeling, or is there a bar, as an officer, when youre out in a situation like this, for feeling an imminent threat to your own safety. What is that bar, and does this meet it . That is certainly up to the officer and what his perception was. And if someone is raising their hand, and it has a weapon in it, they could in a second fire off of a round. Having written reports as a Police Officer and having approved reports as a police sergeant, im hearing someone trying to craft a situation that will fit this deadly use of force. If these officers were there under cover, plain clothes, mr. Scott doesnt know who they are. They have the presence of mind to back out, put a vest on, get a supervisor and tell them and decide tactically is the best way to go back in and approach him. They know he has a gun, theyre ordering him out of the car and yelling drop the gun, drop the gun, they had already seen it in his possession. So now theyre trying to justify something that im not really sure is justified based on this very detailed statement that was just read. Sedric alexander, to you, what is your reaction to what nick described in the video and about what the police are saying what caused officer vincent to believe his life was in danger. For him to make a decision to fire a shot, he will have to articulate what he experienced in that moment to make him pull the trigger. Here is the piece of all of this to me from an analyst perspective. We have piecemeal information. There is more information to be seen tonight, so for me, all thof of this is choppy and piecemeal. And to sheryls point, we have been around policing for a very long time and we have written a lot of Police Reports and we reviewed a lot of them. The important piece is when you start looking at all of the Police Officer statements, the witness statements, the physical evidence, and what we have in video. Its going to headline up or its not going to line up. I think that is what will be determined overtime here very shortly. You know, as we continue this discussion, just talking to our team in the control room. What i think would be helpful is for us to cue up some of the video from keith scotts wife, now we have what the Police Department is saying happened, and that video, when its ready, well show it to you again. Lets just listen into this again for a moment, okay . Dont shoot him, dont shoot him. He didnt do anything. Drop the gun drop the gun he doesnt have a gun. He has a tbi, hes not going to do anything to you guys. He just took his medicine. Keith, dont let them break the windows, come out of the car. Keith, dont do it. Drop the gun. There you have that part of the video that came out from keith scotts wife yesterday. We now know what that Second Police patrol car is that pulls up. We know he has a baton and he was trying to breakthrough the window of the car. They say mr. Scott had a gun and he refused to drop the gun when he got out of the car. Laura, legally speaking from a purely legalistic point of view, is there anything in the law that says what one has to be doing with a gun or not doing with a gun that an officer could perceive an imminent threat to their life and use lethal force . Is it case by case how does the officer feel at the time . It really is fact specific, and i think that is one of the frustrations. Most people are judged by what the common man and person would do. But when it comes to use of force, it is an objective officer standard. Whether or not it is reasonable for another officer in that situation to do that. Not whether or not you as a civilian would find it reasonable. So if is a standard to a Police Officer, what youre able to do. Youre able to determine what you thought, personally, would be appropriate. And its not a particular there is no one test to figure out whether or not a person perceived a threat, it is what another officer in the same situation would feel. Im looking at the case and im thinking i know we have a court of public opinion, but whether or not there will be kl charges or not, and you have to weigh that standard, and you have system from officers, and they provided photographs. And youre weighing it with the fact that they said they had time to go get vests. Youre weighing these two facts against whether or not another officer would have felt they needed to use lethal force. As we await this video that we should have to show our viewers at any moment, lets talk about the context of this. It is bigger than a tragic shooting and a tragic death. This is the protests that were seeing night after night in charlotte are sparked by this, yes, and by a lack of tra transparen transparency. And it comes amid concerns and anger about what they perceive as social injustice for many africanamericans in this state. Absolutely. There is a lack of accountability around this issue and around this country. When you have very little oversight of police. The police are basically empowered to police themselves, and they steam do a poor job of doing that, its hard to charge an officer for killing an unarmed citizen. You see so much frustration. There are times when someone dies in charleston, and the videotape comes out and the guy is running away and then planting a gun. Absent of the tape we dont have a charge or an arrest. Its this kind of sense that makes people frustrated. So when it takes this long to release a video tape, you see distrust and despair. In many minds they have died unnecessarily. When we talk about the reasonable officer standard in court, it potions the question of what would do i. We live in a place that is terrified of black bodies. We have codified the irrational fear of black people. Com fuentez to you, when we see this for the first time, what should they be looking at. More specifically what will you be looking for knowing what we know up to this point . I think at this point you want to look at is there any reason to disbelieve the officers in this case . Much has been made about whether or not there really was a gun, an aggressive move forward or backward. Look at the tape and see what is says to you. But if you combine the two, it makes you wonder. You flaerd Police Officers they saw him rolling a marijuana cigarette. She says he just took his injury. Was the medicine his marijuana or was he taking marijuana on top of other medication . We wont know that until the toxicology comes back. That takes a week or more to get all of the reports on what was in his system to see if he was on something and whether hey, tom. Let me jump in here. Tom, stand by for one moment. This is cnn breaking news. Breaking news, we do now have that dash camera video of the arrest and shooting of mr. Keith scott. Before you watch this video, its very difficult to watch. The content is disturbing. First, the dash camera video, that vantage point, its 2 00 long. Okay, these scripts drop the gun he doesnt have a gun drop the gun drop the gun drop the gun keith, dont do it, keith. Keith, keith [ bleep ] [ bleep ]. We have shots fired, one suspect down, legacy court. 104. All officers, 104, we have one suspect down. 104, were right in the front. That is what we have so far, about 2 00 of that dash camera video of the officers fulling back up to the scene, and you see the shots fired and mr. Keith scott is killed. Its difficult frankly to make out from that video, even if you watch it up close. This is the first time i viewed it as you have seen it and most of our Panel Members have seen it. Let me bring my panel back in. We were speaking before we played that video i dont have tom, Sheryl Dorsey to you, as a former eer lapd officer. Im second guessing the officers for sure to be clear, as he is stepping backwards i dont see that that poses any kind of a threat to the officers. I dont see movement that would justify the use of deadly force. Like i said in the beginning, im very bothered by the fact they left the scene, put on a vest, and came back. I think in case they may have exacerbated that situation, escalated that situation, and theyre yelling drop the gun. They know he has it, they saw him rolling a joint. They have escalated this now to a use of deadly force. We know as officers were creating an audio record. Witnesses and others will say i heard the officer say drop the gun. This is problematic for me. That is an important point. I i just want to make one quick note here, we have gone back to the Police Department to ask them whether or not these i tapes have been edited at all. This is just what they released to the public. We dont know what, if anything, has been edited. Yeah, have they been edited, is anything done to the sound or the video. I saw nothing that was immediately threatening. Im not a Police Officer. I have never been in that situation, but the point is looking at the video, there is no indication to me that there was anything that was a threat to officers. What is most compelling is the yelling of drop the weapon, i have seen this as an activist on the ground. Police when theyre beating people they say stop resisting. Saying drop the weapon as they shoot is a very common tactic. The timing and the urgency and the legitimacy of that is what we need to raise. Just tactically, and we saw this in the case in cleveland, if theyre such an imminent threat, do the tactics justify the response. We watch him coming back here. It doesnt look like he is an imminent threat. For you as a Law Enforcement analyst, what stands out to you . The key moment is when he is out of the car and he is backing away, he has a gun according to the police from their statement. You cannot see it in the video. What stands out to you here . The fact that we werent there, maybe we didnt see what they were seeing, and we dont know how much of this is edited. People will look at this piece of anotherage tonight and they will have problems with it, and they will because of the cloud of mistrust that exists between the police and the community. That will guide your perception about what you see in the video. Thats why i keep repeating, understanding that were seeing bits and pieces of this, even as graphic as this is, what were going to see, the next piece of video will probably be just as graphic, but the cloud and the lens were looking at now will be very difficult in my opinion for the public to look at this from any angle and be comfortable with it and that will be a challenge. There is opportunities for this to go before a district attorneys officer, and maybe before whatever other process may come into play, so there is a judgement based on what procedure and court of law may think about this. Paul to you, speaking about the legal ground here when it comes to a justifiable use of lethal force, is there any legal line or do the courts leave it up to the judgment of the police officer. Is that the line . How they perceive it at the time. When the courts judge the cases they use a double standard. They use a subjective standard meaning the officer has to say he or she was in fear at the time Deadly Physical force was used. Or that the officer perceived a realistic threat to the public. The second thing is the objective standard that laura was talking about earlier. That is a standard that is based on what other Police Officers might have felt under similar circumstances. In the end they will be judged by how a reasonable Police Officer would have judged the situation. I know from having tried many cases like this case, the one thing lawyers tell jurors is that it is very easy to monday morning quarterback and look back in time and say this could have been handled differently, but thats not the standard you judge a situation by. You to judge it by what is going on at the time. What im seeing in this case is a man who, by the statements of his wife, was mentally derranged. She said he just took his medication. She is suggesting to the officers that he is in a unsubstantial state. Then they find out he is armed with a weapon. Paul, let me jump in, stand by, we want to take you now to a Live Press Conference in charlotte, north carolina. The family of mr. Keith scott will be speaking. Right now you will listen to a former state respective and someone representing the family in this situation. Lets listen in. All of the puzzle pieces that complete the picture of what happened the day mr. Scott lost his life and why he lost his life. We know there was also three imaged that were produced by cmpd. Most notably a handgun, an ankle holster, and what appears to be a small piece of a marijuana blunt. I think it is important here to remember this is an ongoing process and there are still a lot of questions that need to be answered. That are going to continue to look into the facts of this case moving forward. One of the biggest questions is when you look at this dash cam footage, when you look at the time frame between mr. Scott stepping out of his vehicle, to the moment he unfortunately passes away on the pavement, it is do those actions, those precious seconds, justify the shooting . That is the most important question that has to be answered. And were going to continue to look into the facts. But i can tell you, again, what we see when we look at this dash cam video is mr. Scott steps out of the vehicle. He is not acting aggressive towards any officers on the scene. He doesnt appear to be making motions or gestures. He doesnt lunge at the officers. He appears to have his hands by his side. There is no definitive evidence in this video as to whether or not there an object in his hands and what it is. But the moment that he is shot, it appears as though he is not aggressively moving towards Law Enforcement, he is doing the opposite, he is passively stepping back. There is another key question that i think needs to be looked into. Of course were going to look into it. And that is this given the statement that was released, and the position that these officers saw some things go on, they left, they suited up, they came back, and they proceeded to move in on mr. Scott is this talk of body cameras. We need to know whether or not the policies and procedures of this department are for officer whos are now, as they say identifying themselves as Police Officers with this department, are they required to wear body cameras. We know one officer responding was. At the moment they put the vest on, it appears that they are Law Enforcement, do they need to have their cameras on. If they do, and they dont have them on, that is a problem. Quite frankly, we have no perspective from the alleged shooter, we dont know what he looked at. So with that said, lets pass it on. Identify yourselves. Im ray dodge. Im rachael. Were delighted as a family that the videos were released. Our goal has been from the beginning to get the absolute unfiltered truth. The only way to get that is for the police to release the videos that were released today. Unfortunately, we are left with far more questions than with have answers. Tornado watch does not make sense to us how this resulted in a loss of life. It just does not make sense and it is not clear in the videos released. Additionally, many of you, the media, of which im a part, have requested information about mr. Scott, what kind of person he is, was he a good father, husband, those issues surrounding his character. Of course he is wonderful and we loved him dearly. That should not be the issue. We should not have to humanize him for him to be treated fairly. He was an american citizen who deserved better. I respect our Police Department and understand the difficulty of the job they have to do. Quite frankly im shocked that less than two years after the conclusion of the Jonathan Ferrell case that were standing before you again to talk about whether or not the shooting of another black man was justified. We should not be here. We have to learn and change our police approach. One of the things that really disturbs me about what i see on the video is the failure of the police to use all of the resources they had at their disposal to avoid killing keith. Were a state with a huge number of veterans. Many are coming back with traumatic brain injuries. This is not going to be the last time that police face one of our citizens who suffer from a brain injury. His wife is trying to tell them this is a man with a brain injury. Why didnt they use that resource. Why didnt they get his wife . And get her assistant to deescalate the situation. It is supposed to be emphasized across the country to Police Departments. Deescalate, dont escalate. We have to ask why. The standards they have adopted for the use of deadly force are aggravated active aggression. Before a firearm can be discharged by an officer and be in compliance with their policy, the subject has to be active in aggravated active aggression. The imminent danger of serious Bodily Injury to an officer or another innocent bystander. Their policy talks about the discharge of a weapon. Not the presence of a weapon. So are there training problems here . From what we see, that policy is not being followed. We thoep is the last time that media has to gatter in charlotte and talk about whether or not the shooting of one of our citizens is justified. We hope the city and the police will learn from this encounter. At this time, well entertain a few questions. The relatives, if they could step forward, please . The family will not be taking any questions, well take the questions. Could you tell us the state of rekiya scott and her children and what message they have if any. Theyre doing as you would probably expect. Theyre still in a time of mourning. Funeral preparations are under way. Again, you know it is hard to flip through the Television Without seeing talk of what happens to mr. Scott and individuals like him. But i can tell you the family is strong, sticking together, and supporting one another. Theyre message is the same as it has been from the beginning, its okay to express your voice, let the frustrations with the justices and injustices of society, but you to do that in the appropriate way. They maintain they do not want violence or innocent individuals being injured or killed. Does it appear to you there is a gun in his hand . Absolutely not. The dash cam or the body cam, you cant clearly identify what, if anything, is in his hand, and that has not changed. Do you believe what officer shot him, are you debating that . Were still looking into all of the facts, of course, with regards to who pulled the trigger. We dont have access to any testing that may or may not have been done from the firearms. Were not here to hurl allegations, were here to find out what happened and why it happened, and more importantly were here to make sure that the best we can, that this doesnt have to happen again in the future. I have a question about the police. The police are saying that part of the reason why this happened is because he had marijuana and a gun. You can say whether or not he did, but im more interested in the idea that even if he had marijuana and a gun, even if that was the case, you take them at their word, it should not have ended fatally. How does the combination of marijuana and a gun constitute aggravated active aggression that put the officers in danger. Was that his gun . This is our first time seeing a photograph of not just that gun, but the holster and everything else. We are investigating and looking into the facts. We hope to continue to dig and find out the truth at the end of the day. If the fbi investigation does not lead to charges of the Police Officer, what will happen . In our Justice System, whether or not it is criminal or civil, and you know at this point we just dont know what enough of the facts to know whether this officer should be charged, whether or not it was appropriate. Were trying to do on appropriate investigation to keep an open mind. However, now it has been presented that dna evidence was on that gun, how do you explain his dna on that weapon . I cant answer that question. This is our opportunity to see what else is out there which is what we have been asking for from the beginning. We have to go back to the most important question here and that lies from the moments leading up to him stepping out of the vehicle to him dieing on the pavement. I can tell you that when i look at the dash cam footage, i dont see anything there, in my opinion, that would lead to him losing him life. Does the family still believe he was unarmed . Yes, nose that looked at it, she doesnt see him having a gun. One thing that everyone has to understand, and we said this before, is that every witness to this has different vantage points. Were trying to grab from here and there and create a picture. When a piece of information comes out, that doesnt change someone elses position because thats their position based on what they know. Thats when we say we dont speak on speculation. Were not hurling allegations. We want to know, again, what happened and exactly why it happened. One way or the other there will be reaction to this perhaps tonight, what is your message to those planning another round of protests this weekend. Just what we have said over and over again. We appreciate the support of the community, we want the support of the community, the community should express their opinions. Lawfully and peacefully. Thank you, no more questions. You also heard Charles Monet talking about the traumatic brain injury saying that there are many other people they will encounter with this kind of brain injury and they need to be prepared on how to deal with it. The body camera footage from one out of the officers involved in this shooting. It is not from the officer that fired the shots. That officer, officer vincent, was not wearing a body camera at the time. There is no audio for the first 23 seconds of this video. At the end of the video you will hear mr. Scott moaning at the end of the tape. It is very difficult to watch. Here it is. Here he comes, here he comes, handcuffs. Handcuffs. In his hands. Back up, back up. Hey, hey. There you have it, perspective from one of the body cameras of one of the Police Officers on tuesday afternoon when keith scott was shot and killed. Lets bring in ed, a few questions for you, first of all, correct me if im wrong, but we dont know what officer that body camera video is from, but we do know its not from officer vincent who shot and killed mr. Scott, direct . Correct, we only know the name of officer brentley vincent. We dont know the names of any of the officers. We know, we were told by a city official that as of now, Tactical Unit officers here dont wear body camera. Theyre usually in plain clothes. One thing i think really bears explanation is why there is no audio at the top of that, it takes about 23 seconds or so for the audio to kick in. Once we saw it we started asking questions about that, why there was no audio. Were told that the reason you do not hear audio for the first 20 seconds or so is that the way the cameras work is that once the officer turns on the camera, engages the camera, it instantly starts recording video but there is 20 seconds of preroll for the audio to kick in. That this is the way the cameras work. We asked repeatedly just to make sure the forces we have, other than being edited and condensed down to the length released today, the city official insists that none of what we have seen has been edited or altered in any way, poppy. Okay, that is very important, ed. So the Police Department is saying this is the video in its raw form. It has been cut down to the i dont know off hand, i have not had a chance to time out the two different videos. They have been condensed on the front and back ends clearly, but the portions we have contained in what were seeing have not been altered in any way. Were asking about why it took awhile for the audio to kick in on the body camera footage. When we first saw it we thought it was strange and something people would have quick questions about when they started processing what theyre seeing. This is coming from a Spokes Person for the city manager here. We have reached out to spokes people in Public Information officers with the Charlotte Police department to check back with them. We will keep trying, but that is the explanation that we have quickly gathered for you as people are starting to see the video for the first time. Ed, thank you for the reporting. You know, the police chief did say that no single piece of evidence that proves all of the complexities of this case is available. Theres a lot, paul, kellen, you cannot see even from this vantage point. Theres an awful lot, and it is one of the reasons you have to wait before reaching a definitive conclusion about any of these cases. You know, the point i want to make is theres no question that Law Enforcement has a credibility problem with africanamericans throughout the united states. There are constant complaints about disrespect and being expressed by Law Enforcement in their treatment of black americans on a daytoday basis. But the criminal Justice System decides these cases on a case by case basis, and in the end this case will come down to one fact, was there a loaded firearm in the hand of mr. Scott when the police were saying, drop the weapon, drop the weapon. Because if there was, and there have been reports that a loaded firearm has been recovered from the scene and it already has been linked to mr. Scott, you are left with a situation where there is no grand jury and theres no prosecutor in america who will indict or charge this Police Officer with a crime. And the reason is that even if the weapon was down and not pointed at the officer, it can be raised to a shooting position in a matter of less than a second. So that shot could be fired, it could have taken down a Police Officer, but it also could have taken down a civilian who might have been in the area. And for that reason paul callen police will be able to articulate a very good selfdefense theory here. You say to that . I say that paul callen articulated pretty much based on the law in all 50 states, thats exactly what the issue is going to be. We have a bigger problem here again. Is there something maybe we can learn from this . But the problem is, quite frankly, pointledly, theres a distrust issue in this country between police and community. No matter what had occurred out there that day, that Police Department, any Police Department is going to come up under this type of scrutiny. So we have a lot of work yet to do, and i think the best thing we can do in this case is allow for all of this information to come together, and during an investigation so that we can clearly see exactly what happens at the end of it. Now you have involved and engaged in something completely unrelated, and it has caused the death of someone that probably did not have to happen. They were there for a stakeout. They left their post.
