He faced Bob Woodwards book and some of the revelations in there about what his own aides think about him. Then this oped. The president may or may not have been sending a signal that this taken together is a good reason for you all to get out to the polls. But he is not laying off this Anonymous Senior Administration official who still has yet to be identified despite what some characterize as a witch hunt going on in the white house right now. He did call on the New York Times for National Security reasons to turn this person over to the government. Listen. Nobody knows who the hell he is or she. For the sake of our National Security, the New York Times should publish his name at once. Unelected deep state operatives who defy the voters to push their own secret agendas are truly a threat to democracy itself. Reporter we dont know who this person is or who it might be. We have now had dozens of the president s cabinet members and senior officials in his administration denying that it was them. Coming out in public statements saying, i did not write this oped. Some of the statements being delivered hand delivered to the president on paper so that he can read them and see who is coming to his defense at this critical moment. We will hear him later today, twice, in north dakota and in south dakota at campaignstyle fundraising events. Perhaps we will see him once again reprising this issue. Jeff, to you, lets pull up the full screen of all the people that are denying that they wrote this anonymous oped slamming the president. Someone who is a Senior Administration official all these people say it was not me. What is not in a lot of their statements of denial, jeff, is thats not how things are at the white house. Significant . True, absolutely true. I think its worth noting that despite how interesting this oped was, a lot of what was said are things that we have been reporting already. My colleagues in the White House Press corps and others, Bob Woodwards book this week as well about the atmosphere around the president and the way that he makes decisions. Certainly, it was a very critical oped. Its fascinating to watch Administration Officials kind of tripping over themselves to say that they didnt write it. I think they are doing that as much to reassure the president as they are to give fodder to those of us covering this and trying to figure out who the mystery writer was. What do you make of how some republicans in congress, amber, are responding to it . You have republican senator rand paul suggesting everyone should take a lie detector test. Mark meadows said we should investigate this. Some saying that democrats in congress are calling and agreeing with him on that. I dont know who they are if thats happening. What do republicans in congress end up doing with this . I have a hard time seeing republicans in Congress Taking this up for the simple reason two reasons, actually. House Speaker Paul Ryan who is the head of House Republicans said that isnt going to happen. And then most of the people that i hear talking about this and trying to help President Trump out in a way by offering suggestions about how to find this person are people who are inclined to pander to trump in a lot of ways. I think the risk here for those people if they wanted congress to do something is that it escalates this into something bigger than it already is. President trump came into the presidency from day one paranoid about a deep state thats out to get him. We have seen him twist facts about various fbi official stories to fit that narrative. With this oped he doesnt have to. If Congress Gets involved, it raises the drama a little bit. Thats true. To both of you, senator Lindsey Graham, who is a golfing buddy of the president , supports him on a number of things, publically disagrees with him when he doesnt like what he is seeing. He spoke to cameras on capitol hill about the oped. This oped piece about the personality of the president suggesting that he is unhinged and he is incapable of being a good president without being minded tells me a lot about the mueller investigation. I think whats happening here is a new line of attack, that is the best evidence yet that theres no collusion. This, to me, is a signal that if theres nothing there with russia in terms of the president working with the russians during his campaign, the next line of attack is the man is unfit for office, he is crazy. When you take the oped piece published by the that is really interesting, jeff. I mean, that is Lindsey Graham, who has been part of an effort to protect the special counsel, i should note, bob mueller, saying, this is the best evidence yet, the oped is the best evidence that theres no collusion. What do you make of it . Its hard to see how he is drawing that conclusion. The oped doesnt refer to collusion. Its not about the russia investigation. It doesnt suggest that Staff Members are hiding anything related to collusion or relating to the campaign or related to a coverup. The oped is focused exclusively on how President Trump governs. If you are an ally of the president as graham is, you have reasons to be critical of that oped, not the least of which is because it was written anonymously. The New York Times is taking criticism for that. This particular author is. Tieing that to the russia investigation or somehow Robert Mueller im not sure senator graham has made a clear case for that. Right. The argument there we heard a little bit of it at the end of the sound is he says, well, you know, the reason is that they cant show collusion, so this is democrats, he is saying, trying to say the president is crazy. I should note its not some radical left wing democrat outside of the administration who wrote this. Its a senior staffer in the administration who wrote this. Yeah. What i heard senator graham say is nothing short of a Conspiracy Theory with no evidence to it. He is ignoring all of the actual evidence that suggests otherwise, that this oped has nothing do with russia and is everything about people working with the president to try to control his worst impulses. The entire White House Press corps has corroborated much of what this oped said. We have a book by a Pulitzer Prize winning journalist with direct firsthand knowledge of his sources of his aides being worried about this. That sounds like a Conspiracy Theory from senator graham. Why do you think, jeff, that Lindsey Graham would do this . He chose to walk to the cameras. No one asked him this question. He chose to walk to the cameras and make this statement. Why . Well, i cant speak, obviously, for Lindsey Graham. But i think he and other people who are close to the president are trying to reassure the commander in chief and trying to give him other things to think about, other ways to perhaps divert his anger about this particular issue. You saw a little bit of that from the president himself at the rally last night talking about the deep state. What are you expecting . Thats exactly what im expe expecting. He will try to motivate democrats. I think he is one of the best people who can do that, being incredibly popular, being seen still as a leader of the Democratic Party. I think he will really lay out what is at stake in this upcoming election, how critical it is this moment, the opportunity. We are on the precipice. Democrats are of taking back the house and to be the stopgap to this runaway administration. I think he will lay that out clearly. Lets not forget in his Farewell Speech in january of 2017, he talked about being active, taking on action and making sure we protect the democracy and talked about being vigilant. We have seen that the last two years. Its taking that activism and turning really taking it to the polls. Do you think he will say President Trumps name . I know that might seem minor, but its not. He has purposefully avoided doing it in his other criticism, even in the speech that was rather pointed that he gave in south africa. I dont think he needs to. I think it will be very clear who he is talking about. The thing about president obama, he has spoken out in important times with aca last year, when it was being repealed and healthcare was being attacked, with immigration he has spoken out and this past weekend when he eulogized senator john mccain and he talked about values and how that transcends politics. He has been out there and its been really clear who he is talking about and what he is trying to state. So i think that he doesnt really need to do that. I dont think he will. Is he going to talk about whats happening with the pressleys of the part or will he talk about what he thinks defines the Democratic Party right now . What we are seeing is pretty amazing. Were seeing a massive turnout of young people, of the base that normally doesnt come out in midterm elections who are coming out, which is people of color, africanamericans, latinos, young people. Thats what has been considered to be the Obama Coalition. They are being engaged and activated because what have they see here at 1600 pennsylvania avenue. Is he going to say he worked for him. Is he going to say this is the future of the party or this is the future . Those are the people that he brought to the table just ten years ago, the same people that im talking about, those are the people he motivated. I think what he is going to say is now is the time. One of the biggest moments was cory bookers moment where he said that he would release the Committee Confidential emails. He did release those emails. Mitch mcconnell called it unusual and talked about a possible ethics investigation surrounding that. With me, our Supreme Court guru, joan bissics. Cory booker said, bring it on, i know im violating the rules, but i think its that important. Yeah. It shows that he did actually violate some of the senate rules. That was a question that occurred yesterday, whether or not the documents that he did release were, in fact, confidential or not. What we do know is there were four documents he released that the committee had green lighted for released. He released more than a dozen other documents that were considered confidential. He also read from confidential emails in a closed during the open hearing as well, in which the republicans accused him of breaking the rules. John cornyn tweeting this morning that there should be an ethics investigation to look into cory bookers handling of this. Clearly, this is something booker is open to, saying that he said bring it on, they view this as a good fight for them politically. Nevertheless, it shows that the intensity and unusual nature of this hearing. One thing i will point out, theres still protests going on in this during this hearing. In fact, behind me right now, there is a silent protest of sorts. A couple dozen women demonstrators are dressed up as a mock funeral procession to make the case that they believe their lives would be lost in kavanaugh were confirmed. This comes after many dozens more than 100 or so people were arrested for interrupting the proceedings over the last several days. Shows you even if the if he is confirmed, a lot of people pushing back. Joan, to you. What do you think is the moment important thing that we learned about judge kavanaugh, who would hold a lifetime appointment to the Supreme Court should he be confirmed . And he is young. Whats the most important thing we learned about him this week . Thats a great question. We probably learned more about cory booker than Brett Kavanaugh. You mean that he is running for president maybe . You are right, Brett Kavanaugh is young. He is 53. We learned he can stay on message. He is disciplined. He will probably be ready to enter the Supreme Court, hit the ground running, feel like a full player. He turned all the questioning to his advantage, and thats something he will probably do at the Supreme Court, too. What he held back on are the crucial things we want to know. His underlying thoughts and principals for big issues like affirmative action, abortion rights, gun control. He pretty much repeated standard principals and in some ways, pop poppy, could have been any other generic conservative nominee sitting there with different children, slightly different slogans, but i think that was his goal, get in, get out and say little. Here is the thing, joan. Do you remember the day when lets show you all of the other justices on the Supreme Court. Do you remember the day when scalia was confirmed unanimously by the senate . A very conservative ideological justice, 980. Kennedy, 970. Ruth Bader Ginsburg 963. It changed around roberts. Are those days over . I think so for now at least, poppy. Then you have the court itself tightly divided hanging on one vote. For the past ten years at least, it was hanging on Anthony Kennedys vote. So that makes it even stronger. I think theres a very good chance he does get pick up those three red state democrats. I talked to heidi during the questions. She said she had not seen any red flags at that moment, even as Many Democrats were voicing their significant concerns. Joe said he was not concerned about his kavanaughs evasiveness during the hearings. You can probably expect he may vote for him. Of course, it may be all moot. It depends on the two key republicans. He would get from one to six months. His lawyers are contending, he has served probation. You should go easy on him. I dont know why. Does he go to jail . I think he does. The range is 0 to 6 months. Probation would be within the guidelines range. Typically, judges give the low end if theres no reason to deviate from that. I think they want to send a message. Special counsel made clear that the lie did impact their investigation. I think the judge here sends a message, gives him somewhere in the middle, three months or so. I think its interesting that this week, a week before his sentencing, earlier this week we heard from his legal team. In this court filing they took a public swipe at the Trump Administration, at jeff sessions, saying essentially they say that sessions is not being honest about what happened in that meeting. Lets pull up the photo so people can remember. This is a big meeting during the campaign. Trump, sessions, also papadopoulos was there. Papadopoulos brought up the idea of i can arrange a meeting with russians and this was all about getting the emails and dirt on hillary clinton. Sessions said last year, quote, i pushed back against that suggestion. Now papadopoulos team in court in this filing are saying, no, mr. Sessions appeared to like the idea and stated the campaign should look into it. Why is that significant . I think what papadopoulos is trying to do here is to take some responsibility for what he has done. The judge never wants someone to sit there and say, you know, im i didnt do very much, its not a big deal. He is saying, i was on trump team trump. Thats why i lied. Now im not. Im taking responsibility for my actions. As part of that, i will tell you that when i raised this issue of a meeting, they were all over it, they were into it, they were smiling and nodding. I think thats his way of trying to gain credibility with the court to say, listen, im not under the thumb of trump and sessions anymore. Im my own person and i regret what i did. What about roger stones associates . Two men tied to roger stone who we know is a close and has been an adviser to the president. One of them spoke to muellers grand jury yesterday. One went into court this morning to talk to the grand jury today. And yet roger stone has not been subpoenaed to testify before the grand jury, which is significant, because if you are potentially a target of an investigation, you are not called to testify in that way. What do you make of these two men that have been called . You see one with a dog. I think thats his attorney next to him. Its pretty clear they have roger stone in their sights. He appears to be a target. It looks like theyre planning to indict him. They have brought at least spoken to Ten Associates of his. Theyre starting to circle in on him. What these two particular men know, i dont know. I think what they are looking for is corroboration of the fact that stone knew in advance of the wikileaks dissemination of that illegally hacked information. We know from his tweets it looks like he knew about it. Theyre looking for confirmation of that, conversations with people and whether there were other people involved in this. This is in the wake of the grand jury report out of pennsylvania a few weeks ago that was stunning. Detailing horrific sexual abuse by clergy members. Now new yorks attorney general is the latest to take action. They have issued subpoenaed for eight Catholic Diocese in the state as part of their investigation into the abuse allegations. My correspondent, my friend rosa flores is here with us. Its nice to have you in person, someone who has you have been with the pope. You have covered the vatican. You know this in and out. My initial gut is, its good that this is happening. But why has it taken so long . Thats the question that were getting from survivors as well, because they have, of course, have been talking about this for decades. They do say, its about time that civil authorities are doing something. So as you mentioned, new york is different, because it has issued these eight subpoenaed to all the diocese in the state. What the ag is doing, its using Charities Bureau, which investigates charities. We know the church gets a lot of donations. The Charities Bureau investigates unscrupulous charities, because its a Consumer Protection group. So thats the jurisdiction that the attorney general has. She doesnt have jurisdiction over criminal matters. But shes working with das around the state. She does say for most of the cases, the statute of limitations is probably run out. Its probably outside of that window. But they are looking into that. Here is what the archdiocese is saying. They say, the archdiocese of new york and the other seven are ready and eager to Work Together with her in the investigation. This is just one, like you mentioned, theres multiple states. New jersey is starting something similar. Here in new york, one thing i read that was interesting is that they have set up a victim hotline for witnesses of this or victims themselves. Again, im surprised knowing we have known this has happened for so long, that that hasnt been set up before. It looks like theyre trying to do what they can now. They are. That is so significant for survivors. Thats one of the things they specifically told me about. Finally, theres going to be an avenue where we dont have to go through the church to talk about these things with a Civil Authority that is willing to listen. The attorney general has an online form where people are going to be able to go and also type in their complaints, perhaps submit documents as well, which is what the attorney general is going to need if shes going to hold the church accountable. Seems like this is a moment, obviously, where a lot of change needs to happen. We will see who is ultimately held responsibility, not just for the abuse but for coverups and how high it end. The aellegations in pennsylvani that this went to the vatican. Thank you. The Trump Administration also, this week, is proposing a major change to the way that undocumented immigrant children in this country would be treated. Right now, still more than 400 children have been in government custody months after being separated from their parents at the southern border. Under that Court Settlement from years ago, those children can only be held legally for 20 days. The Homeland Security secretary is justifying this new challenge. Here is what she says. What the administration is doing is interestingly always in the settlement, it said it was pending, assuming the government would issue regulations that would sort of codify the spirit of the settlement into formal rule making. That never happened. Within the administration in the past 20 years. This administration is doing it. What they are hoping is they can nullify the settlement and set th their own rules. Sorry to jump in, but havent they tried that . Didnt they try that two months ago and got rejected . Thats a very good point. This is going to be a rule making. Theyre going to sort of call the courts bluff here. Theyre saying, once we propose these rules, then the court summit goes away. We can hold families longer than 20 days. We can license these facilities. The settlement says it nullifies if it is consistent with the rules of settlement. This is very much as you point out likely to end up before the same judge that has already rejected the arguments from the Trump Administration and from the Obama Administration before them.
