The important nugget in the New York Times story they broke is that don mcgahn felt he was being used as a trap and flipped his strategy with his lawyer. Absolutely. I think theres another inference if you can take from the reporting over the past few hours, that is that you have to ask the question whether the president and his legal team simply dont know what they dont know. I mean, our reporting is that among other things don mcgahn didnt give any incriminating information to the special counsel as far as we know. On the other hand, they dont know everything he said because he didnt give them a full download on what it was that he said to the special counsel. So a lot of questions there and some of them quite frankly in conflict. The president did tweet this morning that he gave his approval for don mcgahn to sit down for 30 hours and also indicating that he did so in the interest of transparency and as you said at the top there, poppy, he did also include quite a bit of vitreal as weve heard many many times before for the special counsels office. What about Rudy Giuliani . I mean, he again all over the air waves this weekend. Again, very clear that he does not want the president to sit down for an interview with mueller. Especially after something he said yesterday about the truth. Right, hes really been on a roll as you know in his interviews with the media and the latest quote has been compared to something you might have taken away from George Orwells book, 1984, all of this in an attempt to explain why he has concerns about the president sitting down with the special counsel. So listen. Im not going to be rushed into having him testify so he gets trapped into perjury. When you tell me that you know, he should testify because hes going to tell the truth and shouldnt worry, thats so silly because its somebodys version of the truth, not the truth. He didnt have a conversation truth is truth. No it isnt truth. Truth isnt truth. Right, so truth isnt truth. That is the kind of thing that leaves an interviewer speechless. Giuliani trying to clean that up this morning just a bit in two tweets, one tweet says my statement was not meant as a pontiff fiction but where people make precisely contradictory statement, the classic he said she said puzzle and sometimes further inquiry can lead to truth and others times does not. Lets talk about all of this with our legal analyst. John dowd insists this is a good strategy, he said he being mcgahn was a strong witness for the president s case and the strategy is working. His thinking behind this is that if muellers team gets all of these answers from all of the people around the president and 1. 4 million documents, then he has no need to question the president , right . And he would have no legal basis on which to argue it up through the Supreme Court to question the president. Do you agree with john dowd that this was the right strategy to just let mcgahn go and assert no attorneyclient privilege . No, i dont agree with it. Ill come back to sort of the pros and cons of that, but i think its very dangerous not to assert the privilege and its important for us all to remember, there are two kinds of privilege at stake here. Theres the socalled executive privilege, which got litigated in water gatd and then theres the more traditional attorneyclient privilege with a twist, which is mcgahn is the white House Counsel not trumps person lawyer. Hes really a government lawyer. And out of the three courts of appeals that looked at that, only one has upheld attorneyclient privilege for a government lawyer. So they may have been thinking that well, whats the point of fighting this, were probably going to lose. But whenever you waive the privilege its a dangerous thing. I would not have so cavalierly waived it. I do think its interesting on the attorneyclient privilege, it talks about how their followup report which was that the president s lawyers never fully asked mcgahn to detail all of the things he testified about and those 30 hours to mueller. They actually still believe according to the times reporting that they would have some legal ground to stand on to sort of retroactively assert attorneyclient privilege and stop muellers team from handing over at least the mcgahn testimony part of it in his report to congress. Good luck with that. Once its waived, its waived and first of all, i dont even know how they would figure out what parts to assert that privilege over. 30 hours is an enormous amount of time for him to have interviewed and they dont have any idea what he said. The idea that dowd could have been quote debriefed from a 30 hour interview is preposterous, they dont know what he said. They could try to assert something and maybe theres some control over exactly how much detail is given in the report that thats possible. They are on shaky ground now after the fact trying to reassert the privilege they already waived. What does it tell you and let me redo the reporting from the times, mr. Mcgahn and mr. Burt fear mr. Trump was setting up mcgahn to take blame for any wrong doing. They embrace the opening to fully cooperate with mueller in an order to demonstrate am medical g mcgahn has not done anything wrong. Egs not the president s Attorney Lawyer but the office of the presidency, for the white house, paid for by the taxpayers. The fact that he thought that the president may try be trying to use him as a scapegoat and that that changed his own legal strategy, concerning to the white house . Reporter i think its very worry some to the white house. And actually, thats very hard situation for mcgahn to be in but as an ethical matter, seems to me he has some conflicting loyalties there. And not necessarily a true conflict of interest in that his loyalty lies to the white house not President Trump. But certainly if hes concerned that hes being set up, im not sure how he can zealously advocate for his client meaning the white house. So that raises a question whether he should have stepped aside at that point. But he didnt and well get into that more of that later. Im thinking thats going to be a big problem because he has signaled loud and clear he wants to cooperate. And it looks very much like they are moving towards a quick indictment for him. Thats a lot of exposure with that amount of money and hes almost guaranteed to be looking to do a deal. That should worry the president. Right now hes getting squeezed by two of his former lawyers, not just one. So the obviously the federal Law Enforcement officials will want to talk to mcgahn and talking to him, hes being clear. His lawyer said hes telling them everything because hes worried the president is trying to basically screw him. Thats a problem for the president. Michael cohen, this is a whole other issue, they are squeezing right now, investigating him for potentially tax and bank fraud saying he potentially took out 20 million in loans that he wasnt supposed to get. And thats a problem for him. Its really a liability. And thats why they are trying to flip him and get him to talk about what he knows about what the president might have done during the election regarding trying to keep things secret, regarding former playboy models as you know. And his lawyer has reached out to former watergate counsel who flipped on nixon. He says theres parallels to their stories and again thats troubling for the president. Back to the times big scoop over the weekend that mcgahn has spoken for 30 hours with muellers team. Heres some pushback on that coming from former spokes dszman for the president s legal team. Heres what he says, i cant imagine that mcgahn would still be white House Counsel if he had produced any damaging information. Hed have resigned. And that is our reporting, that the information the times reports he questioned investigators area never saw the president go beyond the authority. Do you think mcgahn wouldnt be working there anymore . I do think he has a good point. It was good for mcgahn. Hes saying to everybody else, we now know hes cooperating. I wonder if people close to him leaked the story even. I do think in terms of what this means for trump, we dont know because we dont know what mcgahn actually said. If he said that trump asked him 27 times each hour to fire mueller, thats one thing but it is not i think it really we dont know how damaging this is to the president and dont know how much mcgahn how much he said things that are actually illegal or could lure the president did or whether the president did anything illegal. I think we should be cautious about the story itself. We do know a few things from the reporting in terms of topics. None of us were flies on the wall and dont know what was said, the transcript. But we do know that mcgahn told mueller and his team about really intense moments. And potentially obstruction, moments of a potential obstruction. One the comment and actions during the firing, what was the intent behind that. The obsession that the president had with putting a loyalist in term of the probe and his attempt desire to fire special counsel bob mueller at one point. The fact all this came forth and the white house strat by was freely testify, were not asserting any privilege, tell your story, put it out there. Does that reflect well on the white house . Well, they can say look, we tried to be transparent. We told mcgahn to go talk to special counsel. But according to a lot of reports from various newspapers, they are regretting that strategy. They are concerned and they dont know as perry just said, dont snknow exactly what mcgah told the special counsel. I do think its interesting that giuliani has gone out there and accused the special counsel of leaking this story, saying they are trying to trap the president with some sort of perjury charge. That doesnt make sense because obviously if the special counsel was trying to trap the president in some sort of perjury charge, they wont put out there don mcgahn had met with him for 30 hours. They would interview the president and compare what he said to what don mcgahn said. If anything this news helps them because it allows them to prepare the president if he is going to sit down with mueller, what toe say to say and not to say. Perry, is the truth the truth or the truth not the truth this monday morning . I hope the truth is the truth but i think the reality is, giuliani is trying to build a case for trump to not testify. Ive changed my mind because they were quiet on friday and are working pain stayingly as we just heard. I think thats probably a good sign for the prosecution. I understand the defense teams point. I agree about two things with them, first, if it goes really long, thats probably a good sign for them, particularly if we get notes saying the jury is having trouble reaching a unanimous decision. And then secondly, i think the defense team has a right to feel good. A lot of us thought this was going to be a slam dunk case and theyve kept the jury out and that first question from the jury, four questions indicated that the defense team succeeded in focusing the jury on some of the weaker parts of the governments case. This morning the pope is finally breaking his silence on the latest sex abuse scandal in the catholic church. He has written a letter to the victims. Let me read you part of it. The victims outcry was more powerful than all of the measures meant to silence it or sought even to resolve it by decisions that increased its gravity by falling into kplisty. The lord heard that cry and showed us on which side he stands. This follows that stunning report from the pennsylvania grand jury detailing allegations of widespread abuse by more than 300 priests against more than 1,000 children over seven decades. The report also suggests how Church Officials actively work to hide the abuse and silence the victims and alleges that this coverup went all the way up to the vatican. There you see the Pennsylvania Attorney general who detailed all of this last week. And now just now were hearing from the pope in detail. Lets go to barb who joins me from rome. A lot of people were saying, why havent we heard sooner . Why arent we hearing immediately from the pope but now he has written this letter. Thats right. And he calls for the greater Catholic Community to embrace the victims and clergy to listen to the victims. But he doesnt call for any resignations and thats something that the victims themselves have been calling for. They want to see greater accountability and heads roll in this scandal. He did not call for that. Let me read a little bit more of this letter from him. Its important the words he says are important, words we havent heard before, looking back to the past. No effort to beg pardon and seek to repair the harm done will ever be sufficient. Looking ahead to the future, no effort must be spared to create a culture able to prevent such situations from happening. But also to prevent the possibility of their being covered up and perpetuated. The pain of the victims and families is also our pain. Those are important words but the time and time again when weve talked to this victim, these victims, they want action, words arent enough, poppy. Youre talking about children raped in the hospital after she got her ton sills out and young boy tied up and whipped. This is what these priests did to these children, according to the attorney general. And you look at more of what the pope wrote and he said that the church is now implementing this zero tolerance policy. I mean, aside from the fact that it should have implemented a zero tolerance policy from the beginning, what do we know specifically about what will change . The law does not hold these people to account. The statute of limitations has run out on almost all of them. What will the Church Actually do . Thats right. The church needs to open their secret archives, they have records on a lot of complaints by family members when Young Children expressed what was happening to them. You also have to i think question, this is going to be a big question coming up. You have to question whether the Secular Society is in this . Why didnt the police act more . Were they kplis it in this on some level or protect the church. The catholic communities in so many states across the United States and across the world are so strong and so important and so influ enshal. A part of the country hard hit by the opioid epidemic. Two years ago, she had a miscarriage. Her doctors say due to her opioid addiction. When rachel found out she was pregnant again, she was terrified. How worried were you about the baby . I was very worried. I just thought that my body was not going to be able to carry it. Reporter its hard to overstate the risks of being pregnant while addicted to opioids. Miscarriage, stillbirth and the possibility a baby would be born in a crisis of withdrawal. This is tough to watch. The uncontrollable crying, unstoppable tremors and this distinctive scream. They are coming off of opioids like an adult except these are babies that have just been born . Thats correct. Reporter for this doctor, this was not acceptable. He decided to challenge the staff status quo. Conventional wisdom has been, if someone has a use disorder during pregnancy, dont try and detox. Wait until after they have delivered the baby. The thought was that would be safest. Is that right . Thats correct. But our two systematic reviews have shown that thats not the case. Reporter the doctor says he has detoxed more than 600 people from opioids while they were pregnant. Not a single baby has died. What was it that made you convinced could you get through this time . He asked me to trust him. Nobody has ever done that with me. You know . They give something that basically blocks all the opioid receptors in the body so if you take an opioid you get really sick. Its a big deterrent for them. The biggest risk you may know this. If they go back and take a higher dose or a street dose, that is when a real risk of death occurs.
