Today on the one Year Anniversary of this Mueller Probe we were supposed to have an opportunity to question President Trump at the white house. There was a press conference scheduled between him and the nato secretary general for this afternoon around 3 00, but instead the white house has scrapped those plans. Sources say its in part to keep the president on script when it comes to the Mueller Probe but meanwhile, the president has taken an opportunity to weigh in himself on twitter and he tweeted this morning multiple times but this one specifically calling out the anniversary of the probe saying, congratulations, america, we are now into the second year of the greatest witch hunt in american history. Theres still no collusion and no obstruction. The only collusion was that done by democrats who were unable to win an election despite the spending of far more money. Now the president has not been sort is not planning to be in the public eye today and under the scrutiny of reporters for questioning, however his aides have been on television this morning reiterating the same message the president wants the American People wants to know today that he believes this is still a witch hundred. They believe the Mueller Probe is not justified at the same time President Trump also has a lot of other things on his plate including north korea and that same source tells cnn that the white house is also trying to keep a wraps on his comments about that brewing issue under the surface here, john and poppy. The president s newest attorney, Rudy Giuliani back on television, fox news, claiming President Trump cannot be indicted in the russia probe. It seems like his focus on indicting the president or not is a diversion from the other i word, impeachment. Rudy giuliani is really saying impeachment could be possible. The special counsel here could write a report. Rudy giuliani is attempting to draw really clear lines in the legal landscape here. He says that the special counsels team has concluded that they cannot indict a sitting president and theyve informed the president s legal team of that legal conclusion. Giuliani says that really only means one option for the special counsel if this moves forward, it would be to write a report that could then be referred to congress for any possible impeachment proceedings. Interestingly, giuliani is going even farther than that. Hes saying not only can the special counsel not indict but he argues they also have no Legal Authority to even subpoena the president. Take a listen to this. Were going to see what kind of legal remedies are available to us including if they subpoena us, challenge the subpoena. The same reason they cant indict him, they cant issue a subpoena to him. So if you follow the logic there from Rudy Giuliani, its that under the legal teams view of the law, the only way the special counsel could force the president s testimony is to show that they need to investigate a crime of great significance. So the logic is if you cant indict a president for any crime, maybe like obstruction of justice, then theres no crime to justify a subpoena. Thats the logic giulianis using there but it doesnt square, of course, because subpoenas are issued all the time for witness testimony. Its not only this tool used for the target potentially of a crime. Jessica, thanks so much. Joining us now errol lus and jackie cue sin niche. Lets try to navigate the legal and political logic here of Rudy Giuliani. The debate over whether or not a sitting president can be indicted is a fascinating discussion. I dont think thats what Rudy Giuliani is doing here. I think hes trying to make a political case. What does he get out of this . Hes trying to make sure his client, the president , doesnt go anywhere near a grand jury, doesnt put himself under oath or doesnt put himself in danger of perjury or obstruction of justice. Hes doing what a good lawyer should do. On the other hand, its not as cut and dry as he makes it seem. Weve come close to this point before in the clinton impeachment case, in the nixon watergate case but we never worked through this and the point is we have principals and we have institutions and we have traditions that enable us to walk through these. Whats important is not whether theres a report, whether theres an indictment or impeachment. Thats what the president is worried about understandably, for the rest of us we should be concerned about, do we have a way to respond do we have a way of finding out the actual truth, do we have a way of responding to it with all of the different mechanisms and it includes impeachment but it includes elections and includes laws that could be passed to make sure that whatever went wrong here doesnt happen again. Jackie, the use of the word report, sure mueller can write a report is what Rudy Giuliani said, like this is a fifth grade social studies essay. This would be a report recommending or laying out all the facts to congress and talking about potentially impeachable offenses, not innocuous. Especially when you consider the ears it might be hitting. He will not have the same congress he has now. Whether more democrats or republicans, we dont know. This does have repercussions. What those will be is a big question mark. If democrats dont want to talk about impeachment right now. Ill say that. They dont want to run on it. They want to talk about a whole plethora of other things. That said, the idea that this would not land in their lap is not farfetched. A lot of it could be scathing and to the legal point, which maybe the biggest jump that Rudy Giuliani makes here, if you think a president cant be indicted, that means hes not subject to any subpoena. Exactly. The fact is its like giulianis coming out, hes coming out with the statement saying believe me, this is the way this is going to be. There wont be an indictment and they can write a report like what i it on my summer vacation. Subpoenas can issue and a subpoena can be issue the in this case. He cant set the stage for this for mueller but hes setting stage publicly for his client. I think hes doing a good job right now in framing those issues but at the end of the day a subpoena will be issued and it could be scathing. It doesnt have any history on his side. And Rudy Giuliani himself, then attorney still attorney but with a very different view of the law i suppose, heres giuliani in 98 on this issue. If the president is asked to testify, subpoenaed to testify before a grand jury and says no, not going to do it. You got to do it. You dont have a choice. Change of opinion to be political political politically skpeeient. That Rudy Giuliani didnt have a client that was facing this sticky proposition. What well find is that what ends up happening for they dance around it in exchange for not subpoenaing the president , he agreed to sit down clinton . Yeah and give information under oath. Only after a subpoena came, only after his hand was forced. The notion of whether or not he has to respond to it, obviously the president President Trump can fight against this. It can go to the Supreme Court and bounce around. Theres no particular reason to prejudge where its going to end up. I think we all agree that wed be in a crisis if that were to happen and Rudy Giuliani should be trying to steer his client away from that. To simply announce that it cant happen, absolutely wrong. Does the president want to tie this up in the courts and make himself the center of attention and have this legal battle, maybe, but theres also the idea of him giving a statement or having an interview with mueller, hes a uniquely flawed individual in that case because he has trouble staying on task, telling the truth and when youre talking to the special counsel that can be a really big problem and put him in potential legal jeopardy. Also this story breaking this this morning, the anonymous source that leaked Michael Cohens bank records to the press is now coming forward claiming they did this because they were worried that important financial documents which may contain suspicious Financial Transactions were being purposefully, possibly hidden from investigators. M. J. Lee joins us with this story. What are they saying . Poppy, these documents are called suspicious activity reports and they are exactly as they sound. These are reports that banks are required to file with the Treasury Department if they suspect that there is something suspicious going on at their bank. One of the banks that filed such a report is First Republic bank. This is the blank that Michael Cohen used to set up a bank account for thinks company essential consultants. This is a bank account he used to pay Stormy Daniels and we now know he used to also receive a lot of money from companies that he was trying to do Business Consulting deals with. Now one Law Enforcement official now tells the ronan farrow that he notice thats two of these sar reports were missing and he found this to be alarming that he decided to leak the rest of the sar reports to the press. Now heres ronan narrow on new day this morning taking stock of what he thinks all of this means. Its possible that the Southern District of new york or special counsel mueller went in and said please kwarnen teen these, restrict these in some way. Every expert we spoke to said that almost never happens, they didnt know of a procedure for doing that. If indeed thats the case, it suggests that there is something very, very sensitive in these remaining reports. Now this Law Enforcement official is emphatic that for these sars reports should go missing that is troubling. Heres a part of what he told ronan. I have never seen something pulled off the system. That system is a safeguard for the bank. Stockpile of information and when something not there that should be somethings not there that should be i immediately became concerned. Thats why i came forward. Why just those two missing . Thats what alarms me the most. In terms of how he is personally doing right now, he simply says hes terrified. He told ronan to say im terrified right now would be an understatement and this is a terrifying time to be an american to be in this situation and to watch all of this unfold. Making it clear that he knows that he has taken a big personal risk but he felt that it was important to do it any way. Thank you for the important reporting. Lets go back to our panel and ann, let me begin with you from a legal perspective, given what she just said and even the most benign explanation that ronan laid out there this morning still is a world of trouble for Michael Cohen that there were these suspicious activity reports, multiple ones about 3 million worth of transactions. If youre investigating this and the prosecutor looking at this, what are you looking at most . Im looking for a coverup. To go to this level to get rid of evidence and obviously talking about being terrified maybe thats where he is right now in terms of his legal position. Desperate men do desperate things. As a prosecutor, my antenna is up and ready. If ronan the other possibility is that maybe Robert Mueller or the Southern District of new york tried to quarantine those records and it did happen it would mean theyre so important that theres another world of hurt for Michael Cohen. Exactly. Theres just no good end to this right now for him i think. Of course, on the end of a lot of other troubling things were seeing. Errol, i want to ask you about the Washington Post reporting also about Michael Cohen that Michael Cohen solicited 1 million from the government of qatar for access and basically advice on the trump administration. Now we know he went after a drug manufacturer, he went after a Tell Communication giant but now were talking about a foreign country here. He provided nothing of any real value to any of these clients. That raises the question of what was this all about . Were you trying to rip them off . Which is itself not quite legal depending on how its done. It can end up being something akin to extortion or were you trying to funnel money to some where else . Were you soliciting a bribe . What was this . If theres no tangible service that you can reasonably be expected to offer or was there . Or was there some implied connection . Im the president s lawyer right now. I handle his personal business. Pay me a lot of money and what i do for you down the road will figure that out later. This is all very unsavory and can easily cross legal lines. Michael cohen has made more problems for himself. Perhaps out of simple greed or perhaps of not really understanding how the law works or more likely out of some combination or some environment in which somebody wanted to profit off of this presidency. Qatar said no which makes it even more interesting that he aggressively went after this and they said were good. The office of government ethics came out with the president s disclosure forms for 2017 which he has to detail any liabilities he has, any debts he oweses and the payment and debt to Michael Cohen for the Stormy Daniels payoff was included but the oje wants to make it clear that this was not disclosed in the previous filing, in the 2016 numbers and they laid that out in their explanation. Do you feel like the white house or the president or Anyone Around him has yet given a very clear explanation of the payment to Stormy Daniels, jackie . They seem to think that that didnt have to be disclosed. Oge disagrees with that and now we know why Rudy Giuliani decided to just spit this forth during an interview his numbers are double what the numbers are on this report. Which is why we have some explaining to do. They have not explained why the numbers are doubled. They have not explained why this wasnt on the initial disclosure forms because, i guess, because we didnt want to tell anyone isnt that great of an explanation. That may not hold up in a court of law. Yes, it is the one Year Anniversary of the day that the special counsel Robert Mueller took over. It is. The president s comments this morning come a day after the Senate Intelligence committee publicly issued this bipartisan statement concluding that yes, russia did interfere with the election with the intention of helping donald trump with the presidency. Their assessment breaks with the findings last month of the house intelligence committee. So joining us now is republican congressman chris stuart a member of the house intel committee. Thank you for being here. Good morning. Let me redo part of the statement that came out yesterday. Quote, the russian effort was extensive, sophisticated and ordered by president putin himself for the purpose of helping donald trump and hurting Hillary Clinton. Do you agree . I just dont think we know for certain and look theres only one person in the world and i really mean this, theres only one person in the world who can actually answer that question and thats vladimir putin. Because if he wanted to hurt hillary, clearly by extension hes helping donald trump. I think our committee and my concern wasnt so much with whether he was trying to hurt hillary or help mr. Trump, because really there are different sides of the same coin but have the same outcome our concern was it the cia and those other associated intelligence agency, were they careful in their analysis, did they go through proper trade craft and proper review of their conclusions . From our report we felt like they didnt do a great job that have and that was our primary concern was how was the process. Theres a big difference, here, though. You guys chose to say, chose to publicly doubt the assessment of the intelligence communities that russia was in this to help donald trump. That was your choice. That was a big point in your report and now we have the Senate Intelligence committee including the chair whos presumably as chair seen even more than you have here who says he has no reason to doubt the assessment of the Intelligence Community. Thats a huge discrepancy. Well, i would counter two things with you. One of them its a big part of our report. It was one of only 47 suggestions and recommendations and observations and we didnt emphasize it any more than the other and the second thing is, i dont know that the chairman of the Senate Intelligence committee has seen anything that i havent seen and it would be an interesting question. Ask him, has he been out to the cia like i have and spent hours out there like i have looking at this information. We spent thousands of hours and im not exaggerating for effect. Literally thousands of hours in the last week looking at this one question because we agree with you. This is a very important thing to know and we wanted to be careful in coming to our conclusion and i think that we were. I understand that you spent in your words days looking over this intelligence in a secure setting. I know you cannot disclose what exact intelligence you saw that you think the Intelligence Community missed on, but what area was it in . What what topic . What area did it cover . Where do you think the cia the Intelligence Community, youre saying they failed, they got it wrong in what way . Well, again, just be careful. I dont mean to pick at words. When i say ive spent days. I dont want to indicate that i was out there for days and days and there for ten hours a day. Ive been out there several times and i spent hours out there. To your more specific question, it was once again in the trade craft. They had a fusion cell that i think theyve talked about, but was that fusion cell isolated . Did they have go through proper review which any intelligence analysis should and especially something that i know that we can agree on, this is a very important issue. Youre saying that one of the candidates for president of the United States may have been influenced or helped by a Foreign Government and i think if youre going to say that, youve got to be extraordinarily careful that youve gone through the right procedures and youve got a very thorough review of that analysis and once again, we didnt feel like they had been as careful as they should have been. I think youre right. I think both sides of that argument are true. If they were helping donald trump we need to know that. And if they werent helping donald trump, i would hope that your committee was equally as careful in the statement that you guys make. Can i ask you because the president has weighed in yet again on this investigation this morning and specifically a the New York Times report that came out overnight about the entire intelligence investigation which the New York Times reports was called cross fire hurricane and was launched after George Papadopoulos was bragging that the russians had dirt on Hillary Clint clinton. The president in his tweet today is suggesting that somehow the investigation itself is a scandal, that it was bigger than watergate. The fact that a government informant, according to the the New York Times had discussions about papadopoulos and carter page is somehow scandalous. I dont know if you see the evidence the president is talking about there but do you think there was anything scandalous in how type the fbi kept this investigation in the early months . Theres so much to unpack in the things youve said and so many elements to this and its hard for me to separate into bins or silos if you will the president s comments. By the way, i dont follow him on twitter. The only time i talk about it is when im asked about it by other people. Theres a couple different elements to this. Hes always called it a witch hunt because he has said and the evidence to this point concludes there wasnt collusion, which was the impetus the beginning of this investigation. The evidence hasnt been released yet. The special counsel has not concluded that. Your committee did. Okay. To be fair maybe the special counsel will finds something but every indication is i think most people accept this, every indication from him and others he hasnt found evidence of collusion. If there was i say this tongue in cheek, if there was, it would have been leaked because Everything Else has been leaked actually no. Actually, a lot from muellers team has not been leaked. Theyve kept a remarkable lid on information. One this is important. If there was evidence of collusion, muellers team wouldnt be the only people who knew about that. Other people would be aware of that and they are the ones that would leak that. Before we go, you said in your town hall this and it struck us. I think probably every president has lied and i dont think we can set that as the threshold. You were talking about impeachment. But if you think every president has lied, are you worried that the president lying is just a new normal . I hope not, and look, to be fair there are times when i have criticized the president. Theres times when he has made my job much more difficult. He says things that i dont agree with and he says them in ways that i dont agree with, but i could give you examples where president obama was not honest with the American People. I could give you examples where probably every president we went back and looked in history wasnt entirely honest with the American People. I was just making the point, the question you need to him yichl peach and for what. You said he lied to us. If thats our threshold then well never have a president who serves four terms of his office ever again because i just think that its probabliy likely that president s will do that. We want to hold them accountable. There seems to be a threshold that maybe is beyond what we would accept, but once again if that one lie is impeachable were in a bit of a problem. Delegation negotiating with the chinese to try and avoid the trade war that seems to be heading our way, but two sources tell me that Peter Navarro erupted at Steve Mnuchin on the sidelines of these talks. There was shouting and cursing. Navarro was frustrated with the direction that Steve Mnuchin who was leading negotiations was taking them in and the fact that Steve Mnuchin was setting up more oneonone negotiations with his counter part the vice premier of china li. One source does stress that these this confrontation happened outside of a government building out of the view of chinese officials but it really just underscores the extent to which the Administration Remains at logger heads internal over trade policies. Peter navarro is the more nationalist voice, very much in lock step with the president often times whereas Steve Mnuchin has disagreed with the president on some of the trade tariffs. He argued against those steel and aluminum tariffs that the president and both in a rar roe advocated for. The chinese vice premier is in washington today for the next round of trade negotiations and as of now, Peter Navarro is not listed, either is larry kudlow on the delegation for these talks. He will still be participating, however, but it is notable given the timing what the direction of these talks will take now that it appears that navarro has been clipped a little bit in some of these discussions with his u. A portion of the 23 minute provided to cnn shows the recovery of sergeant la David Johnsons body just two days after he was killed. Lets go to the pentagon. Barbara starr is there. What more are we learning now that this video is out there . Reporter the pentagon had a press conference about all of this, they still, until last night had not provided to the public the full amount of information that they had, including this video. I want to tell everyone, sarkt la David Johnsons family has seen this video. They are aware of it. And the part that is so compelling is you see the local troops finding his body under a very dense thorn tree where he was killed by isis militants and they take his body, they put it on a helicopter so it can be returned to his family. One of the key things this tells us according to the pentagon is sergeant johnson, 25 years old was not ever alive in the hands of the enemy. He made his last stand hero irkly fighting isis by himself under that thorn tree. Such difficult news to hear. There are other elements of the video giving us more information about how valiantly this team of american and african troops fought to save each other. There were a team of survivors that made their way into a sort of wooded swampy area. They were eventually recovered. You see the helicopters moving in. Those men including the americans thought they were going to die and we now know the americans at least were able to write messages home to their families on their personal devices. They didnt believe they were going to make it out alive. One american troop making his way into a clearing waving an American Flag to signal that they were friendly forces. Local forces moved in again but that fire you see there, they did not understand right away that they were americans and they actually fired on them for about 40 seconds. Thankfully no one was hurt. The big message here remains how did all of this happen. The troops were originally sent out to look for a high value isis target, they were neither trained, equipped or authorized to do that mission. The investigation is done but there are still many questions about whether there will be disciplinary action against troops, how this all turned into such a disaster, john, poppy. Our national xacorrespondent jan carroll has more on Meghan Markles story. Reporter Meghan Markles life began here in los angeles, it is the city where she was born. Her mother, doria, a social worker is africanamerican and her father thomas an Emmy Award Winning lighting director is white. Even at an early age while growing up in los angeles, markle started showing early signs of speaking up about issues that would later help define her as an adult, namely her biracial identity and gender equality. I dont think it is right for kids to grow up thinking these things that just mom does everything. Reporter markle was offended by an ivory dish washing detergent commercial because it focussed on women doing housework. Women are fighting greasy pots and pans. I said, wait a minute, how could somebody say that . Reporter so the then 11yearold markle wrote to procter gamble. I was wondering if you would be able to change your commercial to people all over america. Reporter her letter worked. They changed their commercial. Around that same year, markle took a stand on her racial background, she told elle while in class she was asked to check a box for the census, caucasian or black. She wrote, my teacher told me to check the box for caucasian because thats how you look, meghan. Markle refused. Her father later telling her to draw her own box. Markles parents eventually enrolled her at emack lat heart, a private all Girl Middle School and high school and some of her teachers here still have fond memories of her. My first thought actually was he is so lucky. Reporter maria polio was markles theology teacher and talked about markle wanting to volunteer at a soup kitchen in downtown l. A. s skid row and the advice she offered to help markle overcome her fear of volunteering in a dangerous neighborhood. You need to simply put the needs of others above your own fears. And meghan says she remembered that conversation ever since. Reporter markle ended up volunteering on skid row for years. She also performed in school plays. In 2016, a mutual friend of markles and prince harry set them up on a blind date. We met once and twice backtoback, two dates in london. Reporter the two bonded while camping in botswana and after about a year and a half of courtship came the proposal. So sweet and natural and very romantic. He got on one knee. Of course.
