The president in his tweet this morning really illustrating in two tweets, four exclamation points how furious he is about this Newest Development in part because Michael Cohen is more than just the president s lawyer, hes also someone who is so close to the president s businesses, something that he said that if the special counsel came close to it would be his red line and hes also as close to the president as family, but we know the president talked to his white house lawyer ty cobb and john kelly his chiefofstaff yesterday trying to strategyize about what to do but when he ended up talking about this at the top of his dinner meeting with military leaders, that was all him our sources tell us and heres exactly what he had to say about what he thinks this means about the Mueller Investigation and where its going. The attorney general made a terrible mistake when he did this and when he recused himself. Why dont i just fire mueller . I think its a disgrace whats going on. This is the most bias group of people. These people have the biggest conflicts of interest ive ever seen. Democrats all or just about all either depends or a couple of republicans that worked for president obama reporter thats not exactly true. The people who are responsible for this latest decision by and large are republicans. Take a look at this graphic of some of the people involved in this investigation. Robert mueller, a registered republican, Rod Rosenstein, appointed by President Trump, christopher wray, the fbi director also appointed by President Trump and the u. S. Attorney for the Southern District of new york who is taken over this investigation after it was handed off from the Mueller Probe is also a trump appointee appointed in the last several months. The president is now dealing with a situation in which a very rare raid of an Attorneys Office was signed off by the highest levels of his own Justice Department by officials that he appointed to their positions but none of that matters, john, the president is upset. He thinks this is perhaps crossing a line and a source told cnn last night that he believes this could lead the president to take steps to fire attorney general Jeff Sessions and perhaps fire Rod Rosenstein, the Deputy Attorney general who is in charge of this Mueller Probe, john. Despite what he says, it is his people who are doing this who have made the key decisions here. Thank you so much. Keep us posted because what happens in the west wing today is crucial. I want to take a step back to get more details on the searches themselves. What have you learned . Certainly significant information here that the fbi would conduct these raids early in the morning. What we know is based on whats been published and whats out there is at least three locations were hit by the fbi in the Early Morning hours yesterday. Were told one of those locations was obviously cohens law office. He has an office at 30 Rockefeller Plaza in manhattan. That was one of the locations the fbi went to. They also went to his home in long island and then also a hotel he was staying at. The search was very broad based on what were told, it included documents obviously related to Stormy Daniels, a key issue thats been out there for quite some time. They also apparently searched for bank records, they also were looking for other records such as communications according to the the New York Times between the president and his lawyer, Michael Cohen. Those records were seized. Emails, tax documents, business records. It seems it was a whole bunch of information really that the fbi here was looking for. Certainly significant in the way that they did it, you know. Michael cohens lawyer was saying he had been cooperating with congressional investigators, with investigators in general. Did not see any reason for them to do it in such an aggressive manner but clearly something had changed in the last few days, perhaps maybe the last few weeks where the fbi had decided they needed to go to a court and obtain a warrant to do this secretly to hit him by surprise and obtain these records. We dont know what happened but certainly something has changed here. I want to get more insight here. Joining me now kim wailly and laura coates. There is process and theres substance. In this case, though, the process really tells us a lot about the substance, kim, because the hoop that they had to jump through to do these searches were so enormous the bar was so high it gives us a sense, perhaps, of the substance of what they were after. Explain. Sure. The bar was very high and i think that should also give everyone a sense of comfort that the process worked here and there are a lot of safeguards in place to prevent what is being called, i think, very erroneously a witch hunt. In this instance the special prosecutor has a scope of his investigation if new things come to light is the language of the regulation, he must go to Rod Rosenstein in this instant because hes acting attorney general and ask what to do about it and here it sounds like rosenstein made the decision not to expand the special prosecutors jurisdiction but instead to send it to the Southern District of new york which has a lot of expertise in which is the area in which mr. Cohen actually resides. Because mr. Cohen is an attorney, the internal Justice Department guidelines which bind the special prosecutor as well as the Southern District of new york, as you mentioned, require that this be a last resort tool, essentially before they go out and seek this warrant. It requires a signoff not only by the attorney general but also by the Criminal Division of the department of justice and it requires probable cause under the Fourth Amendment that is sufficient for a federal judge, a math straight judge, to signoff on this this was a lot of people with eyes on this in i think a nonpartisan professional way and i say that having been someone who worked in the white water investigation and was an assistant United States attorney. These are professionals handling this. And one of the people who looked at this was this guy jeffrey berman, the u. S. Attorney for the Southern District of new york was appointed during the trump administration, reports are President Trump met with him personally. This is a guy who maxed out in his donations to President Trump. So to call him a democratic partisan right now is absurd. One other thing thats absurd here, laura, the president made this statement on twitter. Attorneyclient privilege is dead he says. What are the facts here . Yes, there was this search of the president s personal lawyer Michael Cohen here. Can you never search a clients lawyer . Of course you can and the attorneyclient privilege is alive and well, but it was never intended john to be an absolute thing to be able to protect people who may have been involved in crimes. For example, theres a crime fraud exception which says that, if the communication was made in furtherance of a crime or an ongoing fraud or anything like that, then the privilege does not apply to that communication. It also doesnt apply in any event if its not between simply the attorney and the client. If there is a third party who was invited into the discussion either by a cc or bcc on an email, it does not apply, or if it was a conversation that had nothing to do with the legal end, for example, business advice, none of that applies under the privilege. Its an umbrella but its never intended to be absolute. It is inconvenient to the president to have this happen, im sure it put him on additional pins and needles and fuels a different level of paranoia. Its working as it should and, by the way, its not mueller who will ultimately determine whether privilege exists, its an independent court. Theyll isolate whatever documents that are there and figure out whether or not the privilege should apply in all respects to all the different documents. If i can, theres one bit of breaking news that just crossed my computer here. We just learned from the white house that the president will no longer be attending the annual summit of the americas in peru or traveling on to columbia. He was supposed to leave this weekend. It was a Big International summit. The president no longer going. The white house says hes going to stay here in the United States to monitor developments in syria. Vice president pence will be going but its significant. The president doesnt often cancel a Big International trip like this with just a few days to spare. Well get much more on what might be behind that coming up in a little bit. Weve been told that this search of Michael Cohen, kim, might have to do with possible allegations of bank fraud, wire fraud, election fraud. So with the investigators going through his office, his home, his hotel room, what would they be looking for specifically . So they already have to have identified in the application for a warrant a sense of what theyre looking for. The standard is one that requires the judge to make the conclusion that there is evidence of a crime likely at all three of these locations. So we have a little bit of information about what this could be. Bank fraud is fairly easy to demonstrate. It just really requires physical documents of particular transactions, but we dont know what was in that application so its difficult to imagine and i know this from my own experience in white water. We just are seeing the tip of the iceberg. There could be a lot of facts and dot connecting that could happen here and we have Stormy Daniels and that whole situation and the curious 130,000 payment that at a minimum was a violation of mr. Cohens ethical duties as an attorney if he made it without his clients knowledge and consent. So one way or the other, theres going to be information that is of great interest and as was mentioned in order to secure this process, the bar is really high. This is not something thats just done on a out of curiosity. Within the Justice Department, theyre going to be very conservative about making these decisions. Stand by if you will because we do have this breaking news we just learned that the president has canceled a planned trip to south america over the weekend. Abby phillip back at the white house with the latest on this. This is surprising. Reporter it is. The president was set to leave at the end of this week for this trip to south america. Really surprising for a lot of different reasons, one, they were always some questions about what was going to happen. He would be in this meeting, this context with the president of mexico. There have been all of these disputes over the last several days of immigration and the trip had already been cut short because of some political turmoil in peru and now this. The white house says in a statement that the president is staying back to deal with the situation in syria. As you know, hes been contemplating what the u. S. Response is going to be to these alleged nerve agent attacks in syria and last night sources told my colleagues that the president after he had that dinner with military leaders, huddled with a Smaller Group of his top mt advisers about how to proceed forward and it is very likely that the United States if they decided to go forward with any sort of military action would do it conjunction with the french, but all of this is hanging in the air. We also know, of course, and we cant separate this, the president dealing with these issues with his personal attorney, something that has so angered and infuriated him. There are a lot of open questions about why this is happening but mike pence, the Vice President , is going to be going in his stead and this last minute decision coming just days before the president is set to take off here, john. Right. The president says that these raids or searches of his friend arent an attack on perhaps his lawyer or an attack on perhaps criminal wrongdoing, he calls it an attack on the country. He says an attack on our country in a true sense. Its an attack on what we all stand for. Thats an incredible statement and something that should make people sit up straight and pay attention. Consistent with his the way he has responded to so many threats before. Essentially as we talked about before what the president does is equate any challenge to him as an attempt to silence his supporters. Thats almost always what he does, the way he basically says theyre going after me, elites are going after me to put you back in your place and its a way that he, you know, tries to in a manner turn any attack on him is a way to further solidify his bond with the portion of america thats behind him. The majority of americans say in polls, they believe this is a legitimate inquiry from the special counsel. They want it to be allowed to continue. Where the rubber really meets the road politically on all of this again is the reaction of the republicans in congress. Weve heard over and over again from Mitch Mcconnell and paul ryan they see no need for legislation to protect the special counsels investigation because there is no credible threat from the president against the investigation and each time he erupts as he did last night, that argument becomes more transparent and more difficult to justify. The republicans in congress will be the ones who are on the spot here politically and soon if the president pushes this much, much further. Molly, you had a fascinating moment or two with the attorney general Jeff Sessions who came under renewed attack yesterday from President Trump. Once again suggesting that Jeff Sessions made a mistake by reducing himself, he wishes he hasnt appointing Jeff Sessions or nominating him if he knew he was going to reduce himself. Do you see this new attack on Jeff Sessions and Rod Rosenstein by name directly as a new chapter for the president and does this put him any closer, do you think, to perhaps pushing them out . I dont think we know. I think that its not a new attack, but it is a renewed attack. He continues to say these things and the feeling that i think Jeff Sessions and people around him have is that they have no idea what the president is going to do. I asked Jeff Sessions, are you going to be fired and said, well, theres one man that can answer that question. And so for Jeff Sessions the policies hes implementing and the work hes doing at the department of justice are so important to him that he is just going to continue to do his job for as long as he has it. And he did tell me that he believes he did the right thing in recusing himself. He believed he was following the rules and he had no choice. He doesnt seem particularly sympathic to the investigation. He doesnt necessarily believe that its fair to trump but he believes that he had to do that recusal and so, you know, if he does get fired i think youll see all hell break loose. These republicans have tried to pretend that this is not their problem are going to be called to account to say where they stand on this. About 30 seconds left here. Weve been talking about Michael Cohen but there are new developments surrounding the president s former Campaign Chair who is now charged with a variety of crimes. Reporter so what weve learned from the court filing last night is that special counsel Robert Muellers team had executed a search warrant last august and in their application for that warrant they laid out that they were interested in Paul Manafort for his conduct related to the campaign. We remember Paul Manafort was indicted on charges relating to his work for a prorussian Ukrainian Group and the white house and Trump Supporters came out and said theres no connection to trump or collusion. Were learning from the search warrant application that mueller team is looking into the issues of manaforts role in the campaign specifically the communications when they raided his apartment in virginia relating to the 2016 trump tower meeting where manafort, donald trump jr. And Jared Kushner all attended under the umbrella of trying to get finding out some dirt on the Hillary Clinton campaign. They met with several russians. The muellers investigators were also looking for any information, communications or records involving this Real Estate Development family. Their important too because they facilitated the july 2016 trump tower meeting but they had also done business with donald trump before before he ran for office. They were instrumental in hosting the Miss Universe pageant in moscow and they were in talks with the Trump Organization to build trump tower in moscow, so thats very interesting. Hes complaining about Jeff Sessions, who he continues to fume that he recused himself from the probe. The president thats the original sin that Jeff Sessions has never gotten past. The president behind the scenes is even more vocal and colorful in his language than what he said last night publicly. Behind the scenes he says those things all the time. What really matters is what he does about it today. What were closely watching is whether this leads to any firings, if this leads to any intervention at the department of justice, whether the president makes any drastic moves or whether if this is simply just venting . We remember tobacco executives raising their right hand before testifying before congress. This is the first time that a major social Media Executive like zuckerberg has been in the hot seat. I think that were going to expect to see some level of contrition which i think is the first step. It is a positive step. And the company and the broader industry have to show responsibility for many of the egregious harms that have come to society, from hate speech to political disinformation to election interference. Were going to see that today, which i think is a positive step and were also going to see some politicians that are really going to try to get some answers out of facebook ceo to some very tough questions. And politicians like to grandstand, make a scene and people who testify before them, they have to be prepared for that. Just the way it is. Our laurie seegal reports that one thing that zuckerberg plans to say is to defend the facebook model and say it is a common misconception that the Company Sells user data. That seems like he may be parsing language right there. Because we all know that advertisers like to use the information that facebook makes available to target things at an incredibly minute level. Yes. And, of course this is the core Business Model, not just for facebook, but for most internet platform companies, whether it is facebook, google, twitter, and many other companies in this broader Digital Advertising ecosystem. It is the Business Model to leverage consumer data and enable targeted advertising with that data. But what facebook is saying is actually fooactually true. They dont sell sensitive Consumer Information to third parties. What they do is they store it, just like any other internet company, they store it and draw inferences from it within their systems. And they allow advertisers to tell them their preferences, and once facebook knows the preferences of the advertiser and knows their consumers, their users, it routes the ads in the most efficient manner possible. That might be a distinction without a difference for some viewers for the hearings today. If you can quickly explain to me, what does facebook fear the most . If Congress Wants to get involved and regulate, what do they fear the most . Well, i think they really fear the threat of regulation against this core Business Model. And i think the rest of the internet does as well. What can really threaten the core Business Model here is regulation that brings user privacy and competition policy to this industry.
