This week rick gates was communicating with a russian intelligence official during october 2016, during the height of the campaign, and this alleged russian agent is also an associate of Paul Manafort. He was doing work for Paul Manafort in the ukraine. All of this connection, certainly a key significant fact in the mueller investigation. What might gates actually know . Certainly the suggestions are that he knows a lot. He was Paul Manaforts deputy on the campaign. He had a seat at the table. Theres no indication, word is he wasnt very close to the president when he was running the campaign, but he was, as i said, man forts deputy, he was also involved in the Inauguration Committee with a man, a fund razor who is a close friend of the president , tom barrack. Certainly he would be in some of the finances that went behind the campaign, that went behind the inauguration. All of this all of this is part of the special counsels investigation. Shimon prokupecz reporting. Thank you for the update. Lets bring in legal analyst michael zeldin, Robert Muellers special assistant at the Justice Department. The big question here is does this show there is still no conclusion on the issue of collusion . Good morning, ana. Thank you. I think its fair to say that mueller is acting pursuant to his primary mandate objective which is to carry on the counterintelligence investigation that director comey testified to back in march which is coordination between the Trump Campaign and efforts on the part of the russians to interfere with the election. So overarchingly mueller is focused on that. Included within that mandate are other matters. But what we see in the gates pursuant to what shimon just presented, is the effort by mueller to determine whether or not there was coordination with an effort by the russians or other outside forces to meddle in the u. S. Election. That remains front and center to what hes doing. Thats why gates relevant testimony about communications with someone alleged to be a russian intelligence operative is so important. Why do you think were learning about this part of gates involvement in the investigation in muellers probe right now . Thats so something. It arose in the Public Domain as a sort of throwaway line in a sentencing memorandum against this fellow van devan ders swan with respect to a report he was working on related to the ukraine. His sentencing is upcoming. Mueller filed a memorandum explaining the lie and why they thought it was serious and material to his investigation in that pleading we hear that gates is communicating with the russian Intelligence Officer who was the head of the Consulting Firm in kiev, ukraine. One could posture that the reason that is in there is to again send a memo to manaforts attorneys saying we know way more than you know. Youre going to be convicted of the charges youve been indicted for. Come home, cooperate with us and we can work out a better deal. Manafort really may be the linchpin to understanding what if any communications there were between the Trump Campaign and outside foreign forces. As this investigation continues, the president is still silent on this issue. We know hes blamed the special counsel since Jeff Sessions recused himself. Now sessions has instead appointed a federal prosecutor to look into possible abuse of power in the fbi and Hillary Clintons ties to a Russian Nuclear agency commonly referred to as uranium one. Why go that route with the prosecutor instead of the special counsel . The special counsel regulations really are intended to be used for exceptional circumstances. There have been essentially two or three of these special counsel appointed since the regulations were put into effect i. s not something you want as a Law Enforcement matter to be the routine part of the way the Justice Department operates. So good for Jeff Sessions for saying, look, we dont need someone outside of the department to investigate something which the department can properly investigate itself. But to sort of prove a middle ground here, well point this United States attorney from utah, this guy huber, who was appointed originally by obama and reappointed by trump, so he has a bipartisan resume to look into these questions and make a report to the Justice Department. Included in that report will be a determination of whether, in fact, a special counsel is now needed or not. I think this is a good first step. Im not sure these matters are worthy of investigation to begin with. But assuming they are, i think this is the better way to proceed than ap pointing a new special counsel. Michael zeldin, thank you for your expertise. I want to bring in congressman mike turner, republican from ohio, a member of the Armed Services committee and select committee on intelligence. Congressman, good to see you. Does this new reporting on rick gates indicate to you that mueller is still focused on this question of collusion . That is his mandate. As the Intelligence Committee took a look at this, as you know, we had comey and clapper and brennan and everyone who initiated the investigation coming forward saying they have no evidence of collusion or collaboration, but they have questions. That certainly was the mandate given to the special counsel. I dont think anyone should prejudge whats coming out of the special counsel one way or the other. I think we need to let the investigation go forward. I think throughout the investigation there will be steps in which we will look to, as you just did, your own legal analysis, to try to give us perspective. I think its premature for us to determine at all either way as to what p special counsel is finding or what theyre undertaking other than understanding that is their mandate, including looking to russia meddling in the election. We need to stop that, make certain we find out exactly what occurred in the election and we take actions to prevent that type of action in the future. Do you have a problem with some of your republican colleagues going after mueller and suggesting that he is out of the scope of his investigation, especially when you see evidence that he is getting right at the heart of his mission, looking into collusion and potential russia election meddling involvement with members of the Trump Campaign . I dont think anybody who is in a responsible position, that being a position thats actually looked at the information and material undertaken, aspects and responsibilities of the election, review of what russia meddling was and of the Trump Campaign, has called for an end to the special counsel. In fact, i think its quite the opposite. I think everybody understands their function is different. The tools they have available to them are different. I think this is an important question overall for a country to get answered. What was the activity that was undertaken by russia . How do we stop it in the future . What actions were undertaken with both campaigns. Certainly i think it does bear scrutiny as to the Hillary Clinton campaign and the Democratic NationalCommittee FundingOpposition Research that made its way into the fisa court as evidence against the Trump Campaign. Thats wrong. It shouldnt happen. I dropped a bill to prevent that in the future. It absolutely bears special counsel review. I do want to ask you about sessions appointment of the new federal prosecutor to look into the issues you brought up. To tie a bow on the rick gates reporting, were you aware of his contacts with this former russian intelligence person, operative, and why didnt you call rick gates before the house Intelligence Committee in your investigation . Im not able to comment on the classified material that were reviewed. I will tell you the investigation the Intelligence Community did was very thorough in the mandate we had. I have the special counsel mandate is different and i think its important. Neither should be viewed as in conflict with the other. Certainly special counsel should continue. Whatever we find as a resulted of their hard work, i think the American People will be glad to have the answers. Are you saying the house Intelligence Committee didnt look into the possibility of collusion between the Trump Campaign and russia . No, i did not say that. You know that not to be the case. In fact, what i said in the beginning of the interview is we had witness after witness that we questioned including comey, brennan, claerp and all those who initiated the investigation and asked them specifically do you have evidence of collusion or corroboration between the campaigns, and all of them answered in the negative. They said there was sufficient information for questions for which the investigation was born. And even on your own news channel, those individuals have come forward and said there was at the time no evidence that they had of corroboration or that type of connection between the two campaigns. Thats the evidence we found. We asked each one of the individuals this, and that i think is the point at which our investigation stops and the investigation of special counsel begins. And i know other members of the house Intelligence Committee, other republicans have commented on the fact that they didnt actually call before the committee a lot of these members that weve now learned from the Trump Campaign who are part of Robert MuellersCampaign Like papadopoulos. Rick gates is another example. Let me pivot to other news out of the department of justice. I want to get to the appointment of this u. S. Attorney y utah to investigate potential fbi abuses of power and how the clinton investigations were handled. I know you wanted to see a special counsel, didnt you . I certainly do. I think the fbi and the department of justice do not have the ability to investigate themselves. Thats the tool for a special counsel. Thats why we look to appointing a special counsel, where we believe theres a conflict in the ability to undertake an investigation and come to a conclusion. In this instance, we have a serious disagreement as to processes at the department of justice and at the fbi. As youre aware, they used political Opposition Research, research that was funded by the Democratic National committee and the Hillary Campaign against an opposing president ial campaign. They did so rejecting that there was any conflict there in the materials that they had. They didnt use it to go find other evidence. They actually presented it to the court as evidence, even notifying the court that this was funded by the opposition campaign. I know thats what you weighed out in the memo i apologize for stepping on top of you. Theres a delay in our satellite transmission. Just to get back to again the fact that this person was appoi appointed, he is going to look into what you have just discussed. Why cant he do as good of a job as special counsel would . Whats the problem that you have with this u. S. Attorney . As we were just saying, in this instance hes asking a person within the organization to investigate the organization. We want special counsel thats independent, that has full ability to pursue these issues to wherever they go. This is goes to the heart of our trust of the Surveillance System that the fbi and the department of justice has. Remember, this is where they undertook surveillance of an american citizen by using information that was funded by the Democratic National committee and the Hillary Campaign. That should never happen again. Certainly, if it should happen, then the Trump Campaign in the future can do the same as they sit as an incumbent against their next opponent in 2020. Its wrong. Its a corruption of the system. It takes us one step closer to being very concerned about democracy. And that bears a special counsel. When you have those types of elements, surveillance of an american citizen, our constitutional rights, Campaign Money being used for dirt thats later presented as evidence, and the issue of our democratic system, those bear a special counsel. Es probably got a lot on his mind. He just fired another cabinet member. Theres a lot of controversy over the appointment who was made in his place. Theres a lot of controversy over a lot of things. The stock market is jgyratingyr. He started this fight with amazon. Nobody knows where thats going to go. I wouldnt be surprised. New developments in the russia investigation always seem to bring him out to comment. I wouldnt be surprised if we hear from him . We will wait for that. Pointed at her in front of the cameras. She becomes one of eight big departures at the white house in the last 30 days. Also on the list, a few white house aides, kohn, tillerson, mcmaster. Shulkin said he was going to have the best people on his team. But he cant seem to stick with anyone. Maybe he discovered that the first people he picked werent exactly the best. I think part of it is trump likes to work with people that suit the way he interacts with people. If he teels as though he cant communicate with them well or if theyre not performing to his satisfaction, its probably time for them to leave. That wasnt the case with hope hicks. I think she was just completely burnt out. With other people, with cabinetlevel members, i think that trump wants to have people that he feels he can trust and he feels that he can communicate with. Do you think he was just completely wrong . Would he acknowledge that he was wrong in his initial choices . President s have a difficult time ever admitting that they were wrong, i mean just throughout the history. They dont usually say that. He might Say Something like, look, he was a great earn or she was a great person, but our personalities didnt flesh or we werent on the same page. Youll probably get more of that kind of reaction. Honestly thats sometimes how we in our everyday lives interact with people. Business people hire people and they think this person is perfect, and maybe on paper they were, but after a few months they realize that they dont click, that they arent on the same page, and the person either resigns or theyre shown the door. Torquesolu, on this new development in the russia probe, mueller pushing for gates help. What should we be taking away from this development . One thing thats interesting is to see how weve shifted away from the white house saying there was no contact between russia and the campaign, no connection to various developments over the last year showing multiple connections between the Trump Campaign and russian officials, former officials, people who have ties to russian intelligence. Obviously the white houses response has shifted to changing the line of the goal post saying there is no collusion, the president himself wasnt involved in any collusion. But it now looks more and more likely that people who were close to the president did have contacts with people tied to russia. Its going to be up to Robert Mueller to help the rest of the country figure out whether that rises to the level of something nefarious or whether or not all the connections weve seen over time were merely a coincidence and its becoming harder and harder to believe that all of this was just coincidental. That may be the case. But the original white house response saying we had nothing to do with russia. There were no connections between the campaign and russia. That no longer holds water. Now theyre sticking to the president himself was not involved in collusion. Molly, you brought up the ohio event. We heard the president going on a rip a. M. wakeup call sorts of things, talking about north korea, roseannes ratings, the border wall. He didnt say anything about putin. He didnt say anything about Stormy Daniels. Why . Those are uncomfortable topics for him i think. With putin specifically, theres been a pattern where trump himself doesnt like to say bad things about putin or russia. On the levels below him, the administration has been tougher on russia, tougher than many expected given his positive rhetoric, particularly with the escalation this week, the tit for tat withdraw of diplomats on both sides. You see a dramatic worsening of relations between the United States and russia that could potentially get worse than that. Stormy danielss has a very difficult topic. I suppose he could come out and call her a liar, as he has other women who made accusations against him. It is honestly an unusual degree of restraint for him. He does usually, no matter how bad something maiks him look, he likes to take it on frontally. As you know, he has in the past called other accusers liars. He hasnt seemed to withhold anything. Thats right. In this case he seems to be avoiding it completely. Like i said, its an unusual display of restraint and well see if it keeps up. On the issue of putin specifically, salena zito, other republicans dont have a problem calling out putin and condemning the action, such as the poisoning in the uk of the former russian spy. Of course, the white house and this administration got rid of the diplomats here, 60 of them and closed the consulate in seattle. The president hasnt said anything about that. Why do you think he is so taken aback in terms of actually addressing putin verbally . He has, as molly pointed out, he has historically throughout his administration, has avoided that kind of conversation. I often wonder if its because he has been so angry and insulted that he that people believe that the russians had a direct impact on the election. And it wasnt because he feels as though he wasnt given his due in terms of the celebration of him winning and the shock of him winning, that i think that has always restrained him from attacking putin because he just wants to be like, hey, i won this, putin had nothing to do with it and im not going to go after putin. Its an interesting argument. I dont know if its true, but i always wonder if thats what holds him back. Salena, molly and toluse, i owe you a question next time. Thank you for joining us. Authorities are 2r50ig to piece together a mystery in california. A familys suv went over a cliff. Three children are still missing. The late evident on the investigation next. This morning a frantic search is undare way for three missing children after the familys van plunged off a cliff. Here is the mystery, where are the other three children. At this point its unclear if they were in the suv. Now the familys neighbors are speaking out about their suspicio suspicions. Miguel, where is the investigation right now . Any leads in the search for the three missing . They believe they were in the car and were probably swept out to sea. The other three children killed were not buckled in. They believe the other three probably were not either. The cliff is so steep that it went nearly into the pacific ocean, and the water, the waves were lapping up into the car and could have pulled other debris out. It is a mystery as to how this happened. One of those missing is 15yearold devontae hart. He came to National Attention in 2014 for hug during a black lives matter protest in portland, oregon. He was seen crying by Police Officers. The Police Officer approached him. Then he hugged the Police Officer. They had a long conversation. That photo went viral. The rest is history. Now he and two of his sisters are still missing. Just how this happened is very much a mystery. Police and Law Enforcement says that there were no skid marks, no sign of braking. Its not clear how that suv went over that very steep embankment along the Pacific Coast highway, this rough but obviously gorgeous part of california. Tell us more about this hart family. Neighbors say they had their suspicions . Well, neighbors say that the children, devontae and others, had come overlooking for food at different points and had burst into the house saying their mother was beating them. It is not clear how much of that is true. We do know there was a referral to Child Protective Services in Washington State on friday when officials from cps went over to the house to check on the children. They didnt find anybody there. Then they checked monday and tuesday, didnt find anyone then as well. Does he need a Communications Director . You have to start any of these conversations with, during 2016 he rewrote all the rules of politics. You have to take the traditional stuff with a grain of salt, but he does need a Communications Director. He does need a chief of staff. To be successful i think in politics over the long term when youre governing, you have to have a strategy and agenda. You have to go out and build on it day after day after day. What trump does, he just tries to build interest rather than build a message over a long term. It seems chaotic. He loves that. I dont think that sets him up for the long term for reelection and i dont think he really understands how different 2020 will be from 2016. Im hearing you say he basically sabotages himself when it comes to people working for him trying to strategize effectively. We have seen him go through now four Communications Director if you include spicer, scaramucci in there, and now hicks is gone. None have been able to keep him on message. What makes you think anybody would be effective . I dont know that anyone will be effective. I think hope served a broader role than communications. I think she got put in there because there was a need. She was i think the person who could best translate the rest of the political world to him and then him to the rest of the political world. I think she will be missed there. But there is no indication that theres a Silver Bullet staffer to come in and change his behavior. Its very hard that you have to do it this way and then he did it his way and he won, toreallycomprehendthe idea of now you really have to change. But i think for him to be successful, and for the administration to be successful, he does have to change and he hasnt shown the ability to evolve at all, you know, as a political leader. He has been quiet when it comes to the Stormy Daniels story. What do you make or how do you assess the way this white house has handled some of these salacious type stories . I think, you know, on Stormy Daniels, it is one of the places where i would say hes done the right thing. There is really nothing he can add to this beyond denial. And getting in and providing oxygen to this back and forth, you know, political fistfight with Stormy Daniels lawyer is not in his interest. It is a rare exception, though. He tends to look at his position running our government as a place to settle personal grievances, and his weapon is his twitter account. And while it may make him feel better and some of the people around him, you know, some of his base, it is a terrible way to communicate to the country as a whole. Real quickly in 30 seconds, i want to get your take real fast given you were a former Vice President of communications with facebook, everything that has come out in the last week or two, regarding that, what is your reaction to facebook now being questioned in terms of the public trust and where it is going to go in the future . I think there is facebook and all of the Technology Companies and all of the Media Companies have to do a better job of being more transparent about how information and data is used. 95 of it is to the benefit of the user, you know. You see ads that are useful to you. And thats a great thing. You dont have to sift through a thousand ads to say, but there is a real concern, i think, among consumers and customers about how data is used, how it is stored, who else has access to it. And i think transparency is the answer for facebook and all of the Technology Companies, because theyre all in the same business of using data, and they all use the advertising model and i think their Business Model wont necessarily change, but i think they really do have to educate consumers more on what theyre doing and how their information is being used and give them choices. The judge has already determined that five other women will be able to testify saying bill cosby drugged and sexually assaulted me too. A source close to the case confirmed with me that former superModel Janice Dickinson has been subpoenaed, she will fly into pennsylvania. But the prosecution also wants more witnesses. They want supporting witnesses, who these five women may have told at the time of what had happened to them. The defense is asking for someone named margo jackson, a temple employee, that says andrea constant told her she could fabricate the whole story and she could get a lot of money. But the reality is this criminal trial is happening because of one person, Andrea Constand, who went forward to police, and made herself public in 2005. Diana parsons is andreas older sister.
