The big speech is over and all eyes are on the white house and what seems to be the release alleging fbi abuses all tied to the trump dossier. The white house is pouring over this memo from devin nunes. John kelly said the memo will be released pretty quick, i think. Or as the president put it overnight, 100 . All right. Lets go to the white house. Kaitlyn c Kaitlan Collins is there for a sense of what is going on. This is the morning after the speech, but we are on the eve of maybe minutes before the release of the big memo. Reporter thats right. Its a big of question what is going on. The big question is has the president seen this memo yet and right now no one seems poised to answer that question. We know that according to the white house as of the state of the Union Address the president had not laid eyes on this memo yet and im told by a white house official that after the speech was over the president came back to the white house but he didnt go into the west wing. Instead he went straight into the residence. Im told by someone who spoke with the president last night as he was calling his allies and his friends to see how they thought the speech went that he didnt even bring up the memo to them and was more interested in their reviews of his big speech. Fast forward to this morning when the press secretary Sarah Sanders was on cnn and she said a final decision has still not been made regarding the release of this memo. I do know that were going through that process. I know that it will be part of whats taking place at the white house today. And well certainly keep you guys posted as i know youll continue to ask until you hear the final answer on that. Has the president seen the memo yet . Not that im aware of. I know he hadnt last night prior and immediately to the state of the union. Reporter regardless of what the press secretary says he heard from the president himself when he said 100 dont worry hes going to release the memo. We know top aides have advised the president to wait a few days so it seems like hes giving the Justice Departments concerns about releasing this memo due weight. He does have five days to decide about the release, but those closest to the president just dont see how he waits that long, john and poppy. I think his chief of staff made it very clear it could be any minute. Thank you very much. The daily beast has new reporting about what the author of the memo will and wont say had he was pressed by fellow member of his committee about whether he worked with the white house on this memo or not. He would not answer. Sarah sanders, she wont answer either. Listen. Not that i know of. He wouldnt answer that question. I just dont know the answer. I dont know of anybody that he did and i havent had a chance he has worked with the white house before when it comes to intelligence and the russia investigation. Look, we have certainly coordinated with members of congress as is appropriate. As to specifics on this, i dont know the answer. Im not aware of any conversations or coordination with congressman nunes. I am not aware. That is not a denial. It should be a fairly easy question to answer. What more can you tell us about this . Reporter in terms of whats going to happen with the memo, were still trying to work through that and try to find out. Were also learning this morning that the former spokesman for the president s legal team is scheduled to provide an interview with the special counsel in the next two weeks or so. He was a member of the initial legal team that was brought in. This is Marc Kasowitz who is also a personal attorney to the lawyer and we expect that mueller and the fbi agents on the special counsel team are going to ask questions about the air force one episode when the president and his aides crafted that statement about donald trump jr. s meeting at trump tower in 2016 with the russians, with that russian lawyer. Now also today weve learned that the department of justice has turned over documents to the special counsel regarding sessions Resignation Letter. Remember there was indications that Jeff Sessions had planned to resign. He had even written a Resignation Letter but that the president did not accept. That letter were told is now in the hands of the special counsel. Theres also a new argument being put forward by the president s lawyers and that is new reporting that your team has on whether or not they think sort of the legal bar has been met for the president to sit down for an interview with mueller and his team, right . Reporter thats right, poppy and there appears to be some pushback from the president s lawyers. This is from sources familiar with the ongoing negotiations between the special counsel and the president s lawyer. Theyve been given some indications that they intend to push back and argue that the special counsel has not met the threshold they believe is needed to interview a president. The president himself has said he wants to meet with mueller but has indicated that hes going to wait for his lawyers to tell him what to do. Now, all of this is ongoing and these are negotiations that were told are still in the works. It could be possible that the president ultimately does sit down with the special counsel. But the question is if the lawyers say no, you cant do this, what will mueller do . What will be his next course of action . What can he do . Thats still unclear. Subpoena. He can subpoena the president. And ultimately that will be a judge to decide. The president is plead the fifth. All these things could happen. Thanks so much. I want to bring in legal and National Security analyst and cnn intelligence and security analyst. Lets start with the president s lawyers now saying the special counsel hasnt met the Legal Standard for the approximate the to sit down with an interview. We wont go into the history, but it basically requires prosecutors to prove that they have an important reason to talk to the president , important to the ongoing grand jury investigation and they must demonstrate why the evidence is not available from another source. That seems like a low bar here for the special prosecutor to meet. It is and particularly for the case that hes investigating. If he is looking at obstruction of justice, then really what was going through the president s mind when he fired james comey, what he knew about what was happening with Michael Flynn and the Transition Team is directly relevant to that case. It could even exonerate him. So mueller absolutely has to talk to the president. He cannot get what was happening in his mind from anyone else. Ill just note that Kenneth Starr was able to issue a grand jury subpoena for bill clinton. Now, in that case the president president clinton did comply with that subpoena so it was never challenged, what kind of standard or what Kenneth Starr would have had to do to force him to comply, but there is that precedent and that was for a much lower bar in my opinion. That was about whether he committed perjury in a separate civil Sexual Harassment case. So i think mueller has met his burden very clearly here. Bob, switching gears here to the memo, right . Which could be released any moment, the memo on alleged fbi malpractice if you will when it comes to the use of surveillance laws. You had two republicans very high up in these agencies, right, rod rosenstein, the deputy a. G. And christopher wray, the head of the fbi going to the white house this week according to the reporting in the Washington Post and pleading with chief of staff john kelly do not release this memo. What does it tell you that they went that far and pleaded with the president s team on this . Well, poppy, we dont know whats in this memo so far, but its almost certain theres very highly classified intelligence in that from the National Security agency, from the Central Intelligence agency. And the people that control that declassification are those agencies. And not a committee on the hill. Not by the republican party. Not by the president. And if the department of justice said that is highly classified information, should not be put out in public, it shouldnt be. They put that on paper and rosenstein is going to tell the president that. Well, they havent seen it, right . Thats the thing. They want to see it first. Youve written extensively and youre skeptical. Let me ask you about a specific point. It has been reported one of the things it focuses on is to get the fisa warrant from the judge prosecutors presented the memo. The steel dossier. And did not explain that the steel dossier was funded by democrats. At a minimum, that in and of itself, should the prosecutors have told the judge this memo was funded by democrats . For its relevant, if its corroborated information, you know, the fbi gets information from a variety of sources. They could have human informants that have checkered pasts, for example. What they do is they will list a source based on their credibility. A credible source, a highly reliable source. Thats how they categorize the basis of the information that theyre getting and the judge will question the basis. If there is something thats asserted that is really coming down to one source, theyll say how do you know this . Have you corroborated this . And thats the part of the fisa process that really needs to be beefed up. So i think this is really an attack, i think, on the judge suggesting that this judge wouldnt know how to vet and ask questions of the Justice Department to ensure that this fisa application met the burden, the probable cause burden that they were required to meet. So i think theyre playing with fire here and really implicating even another branch of government. Bob, before we let you guys go, the Washington Post reporting that andy mccabe up until a few days ago, Deputy Director of the fbi, was apparently told look, there might be more Hillary Clinton emails on this Anthony Weiner computer. Weeks before the election finds this out. Late september, early october. Sits on that information three weeks before he does or instructs anyone on his team to do anything with that. Does it smell fishy to you . No, not at all. Mccabe wanted to see what was in those emails, whether it was new evidence. As it turned out it wasnt. They were duplicates of older emails that were investigated. The fbi hates to get into political elections to influence them one way or another. By sitting on this stuff and seeing what it was, no, not at all. You cant blame him. Translato the point is the Washington Post saying he sat on it. Theyre asking questions about why it took three weeks and were those three weeks essential to learn what was in them. Yeah, theyre essential, john. The fbi takes its time on all of this stuff. They seek advice. They get other agents in and the government investigations work very slowly. To go back and claim the fbi is part of the secret state is just preposterous. The white house said he was reaching across the aisle. Most democrats slow to cheer if they did at all and criquick to criticize the president s comments. Van jones, one the first things we heard in the analysis on cnn last night from van jones was that in his words this was selling sweet tasting candy with poison in it. Was it that or was it a unity speech . I dont think i can go as far as van, but i dont think it was a unity speech for a couple reasons. One is every president during the state of the union as weve all watched over the years talks about unity at the beginning, but it really, you know, gets into the crutch of the speech to find out if there are any bridges that can be built between the two political parties. He did talk about prison reform, prescription drugs, sure he can get that. The release of the memo or the expected release of this memo from devin nunes is only going to make things worse. Immigration is really very far away from being resolved. So i dont think that the president was unifying necessarily last night and i do think its interesting and ill leave it on this is that he noted that nobody gets everything that they want. Specifically to democrats on the immigration proposal. Does that mean that the president is willing to not get everything he wants . And i suspect he wants everything. Governor to you, in my ear we just heard that nancy pelosi is ripping this speech calling it a new low for the president. Youre looking at live pictures of her right now. Look, i doubt you like the speech. Im projecting what i think you might feel, but do you really feel it was a new low for the president . Well, the president has gone so low in so many places that i dont know that this is below some of the other things that have happened. But i do think that the president tried to project unity by using all of the people that he brought to make his points because their stories were so compelling. But underneath it all when he equated or linked the horrors of ms 13 with dreamers, that was shocking to many people. That he would suggest that dreamers are all, you know, gang members, not all, but he was making that link. When he referred again to the disaster that was obamacare, that was not a unifying gesture. Now, did he talk about some things that democrats and republicans could come together on . Infrastructure, some forms of Immigration Reform, some small narrow thing, certainly the prison reform, there are aspects that could come together. But it was not, you know, it was notunderneath it a unifying speech. There are a lot of members of his base that say wait, you said you wouldnt do this when you were running, but why do you think he fl telt the need to sa americans are dreamers too . I think it gets forgotten. The sort of Illegal Immigrants that were brought here, we put a lot of emphasis on that. That sort of supersedes that we also have other americans who are part of the American Dream and they should also be prioritized. I think thats why you looked at when he talked about Immigration Reform or daca reform he talked about adding two Million People to citizenship. Thats the biggest act of compassion ive ever seen out of any president. Obama never talked the juxtaposition, though, youre putting americans as he puts it in opposition to these dreamers by saying americans are dreamers too. That sets up aspirations as somehow different. I disagree. Who ever said americans arent dreamers . The democrats. Its not that they dont say theyre not dreamers hold on. Its not to say theyre not dreamers. They dont focus on the American Dreams for the young people. Who doesnt . The democrats. Youre saying all democrats dont focus on im saying a good number of them have only talked about these dreamers in the past year. Theres 350 million americans and theyre only focused on dreamers . Im glad the president is addressing this. Im disappointed barack obama created this whole dynamic. This is the result of bad policy that took place before an election and all the democrats want to do is talk about dreamers. Why dont we talk about the africanamerican communities. Talk about latino communities where the Graduation Rates are falling. These are large problems. When the president says americans are dreamers too, thats being ignored. Governor, do you want to respond to that too . I do. This is the different president the president s speech and joe kennedy speech. He was talking about all. The president tries to pit one group against another. This is not a zero sum game. If dreamers win that doesnt mean america loses. It means we all win. This is the point is that the democrats really want us to focus on all. When you say that he wasnt that the democrats dont talk about young people and their a aspirations, joe kennedy was talking about how we can lift everybody up to gain the jobs of the future. That kind of rhetoric is just wrong. The democrats are about everyone. We choose both he said. And thats the difference. Guys, we want to move on to this. We just heard from chief of staff john kelly just gave a radio interview and was asked about this controversial memo about alleged abuses within the fbi. Just listen to what the chief of staff just said. It will be released here pretty quick i think and the whole world can see it. Do you think things change the next day . Again, ill let all the experts decide that when we when its released. But this president , again, its so unique, brian, that he wants everything out so the American People can make up their own minds and if theres people to be held accountable, then so be it. Clearly the white house is going to do this. We heard President Trump saying it on the house floor as he was exiting last night. When pressed about it from a republican member of congress and he said 100 were going to release it. The issue with the memo is it was drafted by the republicans in the house without any input from the democrats. At the same time, the republicans decided to release it and voted on it out of committee but didnt allow the democratic rebuttal memo to be released. Theyll talk about logistics and a process that you need to go through, but the fact of the matter is if you can release one, how can you not release the other as well. Thats the biggest problem i see with this memo. And brian, and i guess governor, i want you both on something that happened last night also just before the state of the union. Hillary clinton put out this long facebook message saying that she was wrong not to fire this adviser from her 2008 campaign when allegations of Sexual Harassment came out during the campaign. She reasigned him to another post. She now says she wished she had. She wished she had done it differently. Quick takes from each of you. Governor, is that enough now . Yes. And good. Im glad she did that. There was a lot of questions swirling about this now ten yearold incident. So now what . Thats over. Lets talk about what the president has got in his background. Its just so our question is not about the president , governor. I understand that. I understand that. And so shes accepted responsibility. She said she was wrong. Thats a good thing. But shes not the issue. Shes not the president. Thats what drives me crazy about that as though something ten years ago that she did that she now admits she was wrong. It is an issue when you reassign the victim and let the perpetrator stay on your campaign despite the advice of your two pop officials and then this weekend you dont say you were wrong and you get slammed for your twitter statement and then you come out with it. She was tone deaf. Shes always been tone deaf about the victims coming forward. This is her blind spot. But do you agree that the statement that came outlast night is the appropriate response . I dont really think it is. What i understand of it, and i havent seen it in print, but what ive read is its a 10 or 12 year path which should put those applicants squarely in line for citizenship. On the point of the crafting of the memo, theres new reporting out of daily beast that devin nunes worked at the white house on it, that essentially there was some cooperation between the house and the chair of the house intel committee. If that is the case because he didnt deny it when he was asked it yesterday and the white house didnt deny it when they were asked this morning on cnn, Sarah Sanders about it, if the white house and devin nunes worked in any collaboration on this memo, does that concern you . It doesnt as long as its factually accurate. If it goes to its all about alleged surveillance abuses by the fbi tied to the trump russia dossier. Thats tied to the trump white house. Why would it not concern you if there was some collaboration on the memo . Again, all i care about is that its factually accurate. Whoever gets the information is not as important to me as that it be truthful and accurate so people can make their own decision based on facts and not rumors. Congressman, you were on the Foreign Affairs committee. You care a great deal about russia and you look at russia as a serious threat. Russia needs to know there is a high cost for voyeurism. You point out russias misdeeds around the world. This week the white house trying to meet a deadline for new sanctions on russia doesnt issue new sanctions and instead all it does is puts out a list of essentially russian oligarchs. Who might be sanctioned. Does that go far enough to deal with this threat that you think is so dire . I think we have the magnitsky act that does provide for sanctions for these people that have been involved in hurting the people over there and putting people in jail and killing them and stuff. But this is not an imple men tag implementation of sanctions. I think johns question is they didnt do that. Such a russia hawk, does it concern you they didnt slap these sanctions on these folks . It does if the people would be sanctioned under the bills that the house would pass in the magnitsky act because i think we need to enforce that stuff. Also were hearing from the president s legal team right now that theyre not sure that the special counsel has met the Legal Standard for the president to sit down with investigators right now. Do you think if he has nothing to hide as he says that he should answer whatever questions they have . Well, thats a little bit above my pay grade. I generally would say if you have nothing to hide, you ought to answer questions. But these prosecutorial things are there may are some concern about that that i dont know about. Id hate to see the president tripped up or something by a mistake thats inadvertent and not factual. If he can stick to the facts, why not . What kind of mistake is inadvertent . If hes saying things not true im sure he wouldnt say things untrue. I dont know if youve ever taken those personality tests like you do for intelligence or applications in a company like we do in our executives is youll ask the same question a lot of different ways. Sometimes you might not answer it the same way. They ask the same thing six different times out of 200 questions you might shade something the wrong way. I dont know. Its above my pay grade. They have the sports gymnasium called twist stars and this was a place for young olympic hopefuls to practice and train and the doctor that serviced them medically was larry nassar. So through the years they were so many, many young women that went on to olympic greatness from this gymnasium. Thats where the victims come in. He pled guilty to three charges of aggravated sexual conduct. There were three actual victims. As per the plea agreement, all of these other young women who are additional act witnesses who were also sexually assaulted can give statements.
