This comes on top of another cnn exclusive report about previously undisclosed emails that show followups to a meeting between that russian lawyer and the president s son, don junior, a meeting set up with the intent on getting dirt on Hillary Clinton. Lets get to our senior cnn correspondent. They received an email on september 16th offering a description key and website address on hacked wikileaks documents. This was provided to the trump organization. To put the timeframe in context, this email came months after the hacked of the dnc emails were made public, and one month before wikileaks began to leak the contents of podestas hacked emails, and shortly before don junior had contact. Who sent the email, the email also indicated the Trump Campaign could access records from the former secretary of state, colin powell, whose hacked emails were made public by a russian front group ten days later and the email came from somebody listed as mike erickson, and investigators are not certain who this individual is and we were not able to make contact with the person, and it is not clear if this is a legitimate person. Trump junior was asked about the email behind closed doors, according to sources, and trump juniors attorney told cnn his client has no recollection of the email and took no action on it. Poppy, the use of a website and use of description key, the idea is the wikileaks were supposed to put it on the internet and its impossible to open without the key. The question is, is that actually what happened here . Thats something we dont know the answer to quite yet. Yeah, when he was asked about it by congress and congressional investigators this week, the answer was, i dont know, i dont recall. We need a lot more answers. Meantime, cnn learned previously undisclosed emails also show there was a followup to that 2016 meeting between a russian lawyer and top Trump Campaign officials, including the president s son, don junior. These new emails about questions raised, what was talked about that meeting in trump tower. Donald trump, jr. , insists the meeting was about adoption. He has more on this. Your reporting is counter to what he said . He said some in the meeting, the publicist that brokered the meeting between trump senior officials and russians, between him and a russian that was in the meeting and others, there were multiple emails following that meeting. Five days after the trump tower meeting, Rob Goldstein forwards a cnn story on the news breaking that day that russia hacked dnc emails, and he forwarded that story with somewhat cryptic comments at the top, and it was referencing that there was more to the conversation than russian adoptions. Theres another series of emails where rob is talking about getting donald trump a page on the russian equivalent on facebook, its called vk, and he pitched it frequently and aggressively. It shows two days after the meeting there was back and forth between participants, and after that meeting there were references to other things talked about in that meeting besides russian adoptions, and the russian adoption story is falling apart from the beginning because theres an email in advance of the meeting that shows that donald trump, jr. , went in there expecting dirt on Hillary Clinton. And you have Rob Goldstein that sent those emails, and hopefully well get a few more answers. Don junior, the president s son was asked about that on the hill this week, and his answer . I dont recall. It was a long campaign, and they, like you and i receive a lot of emails over the course of that time. True. But that i dont recall answer is one he used here. Stay with me and lets bring into this conversation, laura coates, our legal analyst and former prosecutor. Lets talk about any legal implications here. Jim is right in saying the answer that don junior has given multiple times on both emails reported here is i dont recall, and theres no smoking gun evidence that there was direct Trump Campaign response to the outreach, for example, for the wikileak documents. Any legal implications here . You see a pattern. Amnesia may be a topic of a lifetime movie but not persuasive to mueller or a particular investigation. When you have a pattern of behavior, when amnesia is selective, and you have further indication there was advance notice of pass coded identifications for hacked emails, and et cetera, and you have a message trail between wikileaks and donald trump, jr. , and you have further details that say there may have been more information disclosed, more topics covered. The topic is whether or not muellers team is aware of this, and you suspect they are because there is an air of duh phreus tuesday throughout the investigation, and the amnesia is a persuasive Legal Defense here it seems. You covered the Russian Investigation so closely, and when you piece all the news cnn is reporting together, what does it tell you about where the investigation stands and where it may turn and some of the investigative committees may turn . Well, the story the tpheurblg story has fallen apart, right . This idea it was about adoptions, and you have email traffic on either end that shows its not the case. In that instance, the president was involved in crafting that misleading explanation for the trump tower meeting, and he was on air force one helping to write up the statement that came out, which was proven to be misleading, once the emails that donald trump had came out. So theres a consistency here in a couple of things. One, misleading statements, misleading explanations, and that goes to the larger picture, right . From the very beginning the trump world position was there was no communications or contacts with russia, and the fact is over time we found there have been a whole host of them. They raised questions, and we dont know what they were exchanging necessarily, and this goes to the core question if there was cooperation or collusion, and that has not been established yet, and at a minimum, there was communication, and thats something the house and Senate Investigators are trying to get to the bottom of. If you look back to George Papadopoulos who made the mistake of believing he knew what muellers team already knew and he found out late in the game they already obtained subpoena power and control and knew about the electronic paper trail he had on facebook, and it would be a mistake for anybody to assume that muellers team or the Congressional Team that has a corresponding investigation, is not aware of what evidence is out there. To get ahead of the story would be a good thing, but playing catchup is dangerous. It was not that long ago that the president was on an island criticizing, you know, all of this as a hoax and et cetera, et cetera. You have got bigname republicans increasingly going after Robert Mueller, and you have Newt Gingrich, let me remind you what he said back in may about Robert Mueller, and he said Robert Mueller is a suburb choice, and the media should calm down now. This is what he said this week on fox news. Mueller is corrupt. The senior fbi is corrupt. The system is corrupt. You have got mark meadows of the freedom caucus, the republican from North Carolina going after mueller, too. What is going on . Its a campaign, right . Its a campaign to discredit the investigation and the man at the top of the investigation. Why now and not then . Because the investigation is continuing, one, and its finding stuff that makes them uncomfortable. Keep in mind, Robert Mueller is a lifelong republican. There are things in the midst of this portrayal here, and not to mention, it was not just Newt Gingrich, it was many republicans that were happy when he was chosen to be the special mueller, but now its campaign to discredit the investigation by discrediting the man. You hear the president talking about the fbi in tatters. Keep in mind, the fbi is fronting on a lot of fronts, right . The fbi is principlely in charge of going after terror. Are you saying the fbi you rely on for, you know, Serious National Security issues and threats, are you saying the whole operation is in tatters . Right. Thats a question the president has to answer and Newt Gingrich has to answer, and Sarah Huckabee sanders, they are not answering that question. You heard the Strong Defense of the fbi from Christopher Wray yesterday on the hill over defending his teams against these attacks. Thats a good picture of how strong the economy is. The sectors, health care up 30,000. These are a broad array of jobs, and some of them pay very, very well. Businesses and services, again, a highly paid sector of the economy in many cases. And 31,000, thats a strong number for manufacturing. And construction, up 23,000 new net jobs there. Those tend to be higher paid jobs. When we look at wages, up 2. 5 . Overall weekly paychecks grew because people are working more hours, and thats a caution in the wage front. We have not seen wages off to the races yet. When i dig in the numbers, fewer under employed and discouraged workers, and all the numbers going in the right direction. When president s are president s during a strong economy, they can sustain a lot like impeachment numbers, and if you look at the new pew numbers, President Trump has the lowest approval rating, why when the market is doing well . So as these men are leading capitol hill over these actions and allegations, the president is holding a rally just 25 miles from the alabama border four days before their special election, and just days after he endorsed roy moore for senate, a man accused of molesting a 14yearold, and other Sexual Assault allegations and et cetera that he denies. The Republican Party is also pumping a lot of money back into Moores Campaign in the final days. The rn khfplt chair woman spoke to our randi kaye about it but never mentioned moore by name. Listen closely. This is a democracy and they will see it play out and they will make that decision and its not up to me and the president said we want to support the president s agenda. This is a question, no moment, we will see, the democrats have set the bar here, right, and now the question becomes, okay Republican Party, what are you going to do and what do you stand for on this . Where does it go . Lets look at the tuesday election in alabama. If moore is elected i would not be surprised if the Senate Democrats dont try to get him expelled. It takes 67 votes which means they will have to get 19 republicans to go along, presuming the democrats stick together. The impending departure of senator franken means the democrats can take a moral high ground and move ahead in talking about who i think the first target will be on this, which i think will be moore if hes elected. After that, where it goes, its a lot of cleaning and intra specktion with congress, and they pass laws for others that they do not impose upon themselves, and this episode, i think, will start having congress act like employers throughout the rest of the united states, where they have to take more responsibility. That would make sense, considering we pay their salaries. And the former adviser to president obama, he said tuesday the alabama election will be the test of the me too movement. What if it fails, what if it doesnt . Is he right, is tuesday the test . I dont think so. First of all, theres no single test as a movement as powerful as this, and the momentum it has is not going to stop because of one election, and elections are complicated. There are a lot of different variables here and a lot of alabama voters view it also as a partisan test, as the chairman of the rnc was saying there, this is also about republican versus democrat for a lot of people, and some voters may choose to overlook roy moores behavior and others will not. I think its more complicated than a single referendum on whether or not people want to punish people with the history of sexual misconduct, and its that, too. One of the things both parties will be watching is how powerful a force is this anger that women voters have already shown so far this year, if its powerful enough to change something in a state like alabama, then it is very powerful. Caitlyn, al franken resaoeig and he did not apologize to the women, and i noticed that listening to the live remarks yesterday, and he said i think there may be a misconception yeah, he was defiant in the speech saying why am i leaving when others facing similar accusations, some facing what some would argue more egregious accusations are staying in their posts. Yes, i think a lot of people are asking that question and asking whether democrats would have made this decision had the minnesota governor not been a democrat, and i want to note this could become a competitive seat next year, and theres that component. I think democrats were looking at this in the aggregate saying we have to take a stand on this and put the spotlight on republicans and we will see how voters respond to that. If republicans start doing the same thing, try to level of Playing Field in that way, i am wondering how this will play out, though, in terms of how, you know, voters are already kind of angry that congress has been lagging behind other institutions on this issue. The ground has certainly shifted in the past two months on capitol hill, it shifted in the past two weeks, and the situation last year during the election is certainly different than perhaps it would be next year. I think voters are waiting to see how that plays out. It was tweeted, its fascinating franken should not have resigned, and moore should drop out, and conyers should have resigned, and franken is a creep that acted inappropriately, and thats counter to what democratic senator gillibrand said this week, saying forget saying this is okay, and there has to be a single bar and thats how we have to operate on as a single party. What do you make of ari fleischers comment . He has more freedom to take on something now dividing democrats, and that is there was not a recognition that all issues of harassment are equal. What senator al franken did is not the same as what Harvey Weinstein did, as what others who were forced out of their jobs did. When you talk about equivalency there are issues. Our society recognizes the difference between going 20 miles over the speed limit and something far more serious. An electronic trail shows a new attempt to share hacked wikileak documents with the Trump Campaign, and donald trump, his son and others in the organization received an email offering access to wikileaks documents weeks before the 2016 election. No evidence that they did, indeed, do that, but this is an email that went to the president and his son and other members of the trump organization. As you sit on the house judiciary, what does that make you think . Do you have more questions given this . I do have more questions, and theres a closing in on the president s closest circle. Yes, theres no indication they acted on these emails, but if you are in the situation and you get an email like that, you should be reporting it. That didnt happen either, and you have to ask why. I think that combined with the whistleblower that has come forward, our ranking member, Elijah Cummings that sent a letter to tray gowdy saying we need to be investigating this, and Michael Flynn was texting during President Trumps inauguration speech and talking about how the russian sanctions were going to be ripped up and this was going to create wealth for all kinds of people wanting to build Nuclear Reactors in russia. And then the Trump Administration seemed to be to the russian contacts, its important that we investigate this and have an independent investigation, even as Robert Muellers investigation is continuing. On the senate side of the judiciary, feinstein has been critical of Chuck Grassley saying hes not taking some of the russia leads seriously enough, and do you feel the same way on the republican counterparts in your committee or are you confident they are following all of these leads . I wish i could say i was confident. Some would like to start impeachment hearings for Hillary Clinton, except Hillary Clinton is not the president. The reality is we have seen a tremendous lack of respect for judiciary committees roles in the house invest gating these issues, and we have asked them to take up investigations and its the only committee of record that is not holding investigations, and i think its a real disservice to the american people. Let me ask you this. In front of your committee, the house judiciary next week, you will have Rod Rosenstein testify about the russia investigation. There are multiple investigations about why he was not more tpoeuforthcoming with information, after he fired top agents on the case, peter strzok for texting about his leanings toward Hillary Clinton and against donald trump, and yes, he fired him right away but do you have concerns that this person was not on the team and it was not disclosed for months why he was fired . I think those are the questions the republicans are for sure going to spend the entire hearing focusing on. But arent those legitimate questions regardless of party . I think all the questions are legitimate. My question has been from the beginning in judiciary, ask whatever you want to ask but also let us ask whatever we want to ask. When i offered my inquiry, i said i understand you have questions about Hillary Clintons emails, and lets include them and lets delve into the things we need to delve into, but dont use these opportunities to just ask about one thing and refuse to actually hold real hearings around what is very serious before us. Before we go, another important topic, Sexual Harassment, assault, abuse. You cosponsored legislation with republicans and democrats this week on the hill to try to end this, to prevent it and make it more public when it happens, to give power to victims when it comes to not having to be forced into secret arbitration. You wrote an op ed for the huffington post, given that were you comfortable with the way that senator al franken of minnesota resigned yesterday without apology to the sixplus women that came forward or do you think that hurt the party on this front . No, i think its very important that we as democrats, and hopefully as republicans, draw a bright line in the sand for the women coming out across the country talking about things that have been talking for decades. I dont think we can pick and choose. I have a lot of respect for al franken and john conyers and others on our side that have done so much for the country, but we cant just say that that erases these other things that have happened. In the absence of having a real process that people believe in, and that is fast and transparent and accountable, this is what is going to happen. I hope that we in congress can quickly put together a process that allows for women to come forward, takes away the barriers to reporting, and then very quickly determines what the accountability should be, because i dont think its the right conversation for us to be having to say, well, if he gropes a breast verses a bottom, is that the conversation we should be having . Former fox news anchor Gretchen Carlson was on capitol hill this week supporting legislation to help victims. She, of course, became an activist after she sued fox news and roger ailes for Sexual Harassment. John and i asked her what needs to change. So franken may be gone, conyers resigned from the house of representatives, yet on the republican side, the Republican Party just backed roy moore officially in the Alabama Senate race. The president still backs him and, of course, the president has his own accusers, it does beg the question is there a partisan divide here, gretchen, on how people are being treated and these cases are being treated. I think its pretty obvious the answer to that is yes. Well, im smiling because this has been a year of arduous hard work, trying to work with both sides to realize that Sexual Harassment is something we should all care about and forced arbitration shoves all of these cases into complete secrecy and we have been fooling ourselves in the culture to believe this isnt going on and the reason we dont think its going on because we havent heard about the cases. The reason we havent heard about them because theyve been forced into secrecy. After a lot of hard work and meeting with a lot of senators and members of the house over the last year i was so proud to be able to announce that we had bipartisan support for this bill, not only in the house, but in the senate, and this is actually going to move forward now and wouldnt it be an amazing process to get something done for women. So often nothing gets done on the hill, but wouldnt it be amazing if we could do this for women and it would end up on the desk of President Trump and we would see what he would do with it. You know, its interesting, i hope you can explain what this bill doesnt do also, because there are some women who want to keep things secret, who do want silence about their cases. This isnt forcing people to come public, is it . No. This is giving women a choice. I mean thats why its so powerful because its giving women a choice to either go to arbitration if they want to keep it secret or to have their seventh amendment right which many people dont even realize theyre signing away when they go to work. 60 million americans have forced arbitration clauses that their employment contracts. When i ask groups of people to raise their hand and say if they have that or not most have no clue. What this bill does is it gives women and men the opportunity to choose do i want to adjudicate my case publicly, do i want the world to know whats happening to me, or do i want to keep it secret in arbitration. It really gives the power back to the victim. Youve said that forced arbitration clauses are unamerican. And now, you have had some experience on the hill with helping craft legislation.
