Washington. The department of justice already pushing back on this subpoena from democrats. What more can you tell us about where things stand . Reporter thats right. Theres a stand off between the hill and the department of justice. Lawmakers saying they want the full unredacted version of the report and all underlying documents to conduct their own investigation. Thats the first step before they would consider moving forward on impeachment proceedings and we hear from the house leader, nancy pelosi, trying to give a sense of caution, not to jump the gun and rush toward impeachment. The democrats do want this information. They subpoenaed, on friday, the department of justice for that information. The doj is pushing back. They issued a statement which they say in the issue of transparency t attorney general released the confidential report with only minimal redactions. The department of justice made arrangements for chairman nadler and others to review the report with fewer redactions. In light of this, the subpoena is premature and unnecessary. The department will continue to work with congress to accommodate the requests consistent with the law and long recognized executive branch interest. Chairman nadler is jerry nadler, who issued the subpoena. If they are unable to reach an agreement between the democrats and the department of justice, it is likely this could end up in court. Fred . In your article out titled post white house criminal exposure for trump what can you tell us about those possibilities . Fred, when Robert Mueller issued the report, he said because of department of justice guidelines, procolludes them from indicting a sitting president. They didnt answer that question, yes or no. Interestingly, he included in the explanation the notes that the president does not have immunity after he leaves office and went on to say they conducted this factual down the road, the president could be investigated for it and prosecuted for it. Its not the only legal, criminal hurdle around the president. He was implicated by the u. S. Attorneys office in new york as part of the hush money Payment Scheme that Michael Cohen pleaded guilty to. Prosecutors identified trump as individual one who ordered him to make the payments. One prosecutor who i spoke with who is no longer a prosecutor said its possible someone down the road could pick it up, but unlikely because of the political challenges of that and the passage of time. One thing is for sure, the president s best defense is win reelection and run out the clock on the statute of limitations. What is the statute of limitations . Under the charges that could be on the table, if it was obstruction of jous tustice, fi years. That clock starts ticking from the date that one of these acts occurred. That spans from the payments in 2016 to these potentially obstructive acts until 2018. You can see how that would extend, you know, after this election cycle, but if the president were to rewin and stay in Office Another four years, he is outside that range. Now to the president s latest reversal on the Mueller Report after first praising the report as total vindication and saying Robert Mueller acted honorably, the president is changing his tune, describing mueller as highly conflicted now. Sarah westwood is in West Palm Beach near where the president is spending easter weekend with his family at the florida resort. Sarah, whats behind this about face . Reporter fred, we know that the president is unhappy with the way that him and his white house was depicted in the Mueller Report. We know he isdishonest leader, leading a chaotic white house. According to mueller, some of the aides who received directives from him, including don mcgahn ignored the orders. Thats someone like President Trump who likes to exerty with portrayal. The russia investigation is over, on twitter, since the report came out, the president has been lashing out at the russia probe and at special counsel Robert Mueller. He hasnt said a lot to the cameras, but has been active on social media. He took to twitter to write, despite the fact it should not have been authorized in the first place and written as nastily as possible, the team was bias, the end result is no collusion, no obstruction. He took to twitter to do what some people consider a swipe at mcgahn when he accused people of producing notes that never existed before they needed to. Theres a specific instance in the Mueller Report where President Trump chastises the former white House Counsel for taking notes. He said good lawyers dont take notes. In june, 2017, according to mueller, President Trump instructed mcgahn to essentially get rid of special counsel Robert Mueller. He ignored the directive. In january, 2018, when the New York Times reported the previous episode, mcgahn denial fact President Trump was urging them to say its not true. A lot is directed at don mcgahn and the former aides who cooperated with the special counsel, even though it was the orders of the president s legal team at the time. Hes letting frustration out on twitter, fred, but we havent seen him speak directly to the cameras since thursday. Thank you so much. Joining me to discuss this, retired fbi special agent, james, legal analyst, jennifer and writer for politico, gabby. Nice to see you all. Gabby, you first. What do you make of this messaging from the white house . Clearly, the president is trying to build out a messaging narrative around the findings in this report that he can use as he launches into the 2020 campaign. We are not really seeing a major difference in what he was saying before the report was made public last week and what he was saying over the course of the investigation. Hes continued to remind americans that this investigation was led by ha he believes were people with biases against him. He continues to say this was a waste of taxpayer money, this went on too long. I mean, hes returning to a lot of the same talking points he used, tweeted during the course of this to your investigation and, you know, what we are hearing from white house sources and people on the Trump Campaign is they are going to focus on bringing the president into a lot of states that he won in 2016, but where there are freshman democrats who are in districts that are walking a fine line in how they respond to the report. They are going to bring him in. Hes going to hold rallies and play up the fact he thinks this is a total exoneration of him. In the backyard of the vulnerable freshmen democrats who dont know, quite yet, how to respond to the mueller findings. Trying to up stage those moments. So, jennifer, the Justice Department, it is pushing back on this subpoena request, you know, from jerry nadler and democrats overall. How might this kind of legal battle play out if it gets to that . Well, i think the dems have the better of the legal argument here. Its one thing to say we havent given you all we are going give you, lets wait and see if we can come to an agreement. Its clear by the department of justice, they are not going to release an unredacted version of the report. Thats a final answer. The dems are going to go to court. They have the better end of the legal battle. Theres a running out of the clock aspect of this litigation. By cnns investigation in this report, Mueller Report, 8 of the report is redacted. Mostly for the reason of ongoing, you know, investigations. So, james, what does that tell you . We already know from the Mueller Report theres 14 jurisdictions who received referrals to pick up their investigations where this report leaves. So, where do you see these investigations potentially going . Sure, fred. First of all, its been a long slog, 675 days. Jennifer can speak to this, too. Thats generally the length of federal investigations. They generally last two years. In this instance, we have a 448 page report. We know there were some 900 redactions counted by the network and 1600 lines that were blocked out. Now, look, generally speaking, the grand jury material is protected. They have privacy so when they give their testimony, its protected unless theres circumstances that lead you elsewhere. In this instance, a number of ongoing investigations. You mentioned the 14 referrals, 12 we didnt know about before the release. Im certain they want to protect that. Im comfortable with it being released unredacted to the gang of eight, not all of congress. Im sure people have differing opinions on that. Gabby, you know this investigation was two years. You know, some members of the house are happy they got the redacted version, but that doesnt stop so many committees from launching their own investigations. You have judiciary, you know, you have house intelligence committee, oversight, ways and means. You know, is this really about transparency . Is that what the goal is . Or is it really in the pursuit of censure or Something Else . Its a good question. A lot of House Democrats are keen on figuring out ha the redactions meant and the actions that President Trump may have asked officials, aides to pursue that were redacted in the report. They want clarity on that. Theres a reason many, Many Democrats in the house of representatives are asking for the unredacted version to continue the investigations and drive closer to figuring out what some of those things are. On the other hand, you have Democratic Leaders who are treading very carefully. If you watch the language used in the wake of the report, if you look at how they responded to the progressive members calling for impeachment proceedings from President Trump, House Speaker nancy pelosi, House Majority leader hoyer saying proceed carefully. They are trying to gauge the voters . They are not sure where the American People are on this or primarily thinking how it potentially influences 2020 . Its probably a mix of both. If you look at public opinion, theres a large swath of voters who want everybody to move on. Others want the Oversight Committee and a lot of tools in the house of representatives to continue this Investigative Approach to the president and look beyond what was found in the Mueller Report. His financial dealings. Things that werent necessarily addressed in this 448 page report. They are trying to figure out how to walk that line and respond to both of those groups of democratic voters. Mueller is letting the report speak for itself. Hes been quiet throughout the entire investigation and post game now. Democrats are calling on mueller to publicly testify before congress. Will this be reluctantly that he appears or, you know, is he eager to set the record straight, do you think . Well, its hard to say, but from what folks say about mueller who worked with him and what we have seen from him during the course of the investigation, i think he will be reluctant to go beyond what he said in the report. He may fill in a little about how they got there and the process, but i think hes probably someone who wants to let the work speak for itself. So, you know, i actually think it would be illuminating if he would go into his thoughts of how bill barr represented his work and what the president has been saying. I suspect we wont do that. James, as everyone pours through the more than 400 pages, when you look at the conclusions or details of the discoveries, are you, you know, impressed by what you see . Do you feel like this was a, you know, honest, thorough, investigation . I do, fred. You and i have had conversations before under director mueller. I served under him 12 years half of my career. I did not agree with everything he did. I agree with jennifer. He is going to be red sent to go public on this. Let the work speak for itself. The most confounding thing for me, i thought he called it straight up on obstruction, he did on the collusion, but not the obstruction of justice. He laid out ten incidents, walked up to the line, talked about how congress could view it you dont think its because he knew he couldnt indict a president . So, giving this information to congress saying you do what you think is appropriate . Yes. I really cant because of the Justice Department policy. 100 spot on. Why not point it back to barr and inspector general. We found they are indictable, but cannot indict. Attorney general william barr coming under fire after his generous summary of the Mueller Report. Barr spent much of his thursday press conference framing the special counsel report on the premise the findings were favorable to donald trump. Saying it found no wrong doing by the president. The white house fully cooperated with the special counsels investigation providing unfettered access to campaign and white house documents, directing senior aides to testify freely and asserting no privilege claims. At the same time, the president took no act that, in fact, deprived the special counsel of the documents and witnesses necessary to complete his investigation. With me now is richard who is a former Watergate Special prosecutor and cnn legal analyst. Good to see you, richard. Good morning. What were your thoughts when you were watching and listening as it was happening . Well, i would say that attorney general barr was very generous toward mr. Trump in suggesting that he gave full cooperation to special counsel. I would say theres a big asterisk there. He refused to testify and meet with the special counsel. He refused to answer many, many, many questions that are still pending. So but barr said, he described it as unfettered access. He was voluntarily providing information. Well, the independent counsel has subpoena power. If it wasnt provided voluntarily, it would have to be provided under subpoena. I would say that it was less than an objective evaluation of whats in the report. The content of the 400page report is very disturbing. While there is no evidence that was shown to have been found regarding the president s or his campaigns active collaboration with the russian intent to put their finger on the scale of the 2016 election, quite clearly, the Trump Campaign was the beneficiary of an attempt fwi russians to affect the outcome. How much of the outcome was affected, we dont know. It is something we need to be aware of for the future, the russians didnt simply go away. So, in addition to analyzing, you know, this 480something page report, people are also trying to analyze, you know, william barr. Why . You know, whats in it for him . How do you explain exactly as you described, you know, his description is the antithesis of the body of the work. He came out of retirement. He wrote that memo, you know, in defense of the president. Why . Why jeopardize his legacy as i think you have to go back to the memorandum that he sent to the Justice Department that many have interpreted as a job application for attorney general. His views were predetermined and he simply acted inconsistently with that predetermination. Look, the report lays out in chapter and verse at least ten different episodes of obstructive behavior by the president , lies and attempts to curtail the investigation, to reward those who dont cooperate with the investigation and to punish or warn those who are cooperating. Under any traditional view of obstruction of justice such as we had in watergate, where there was less tolerance in the country for president ial lying and obstructive behavior toward the department of justice and a grand jury, we found very similar actions being regarded as part of the conspiracy to obstruct justice and here, mr. Mueller provided a similar road map to the one provided in watergate to the congress for potential follow up. Impeachment is not the only remedy. Certainly, there are lesser acts that can be taken, such as censure. If there is outrage over the nature of the activities. Right. We still dont have answers. Right. The answers to the question of why the president was so protective of the russians, why he continued to challenge the u. S. Intelligence community. Yeah, those answers are not in that report. Why did he do it . Right. You know, americans normally use their god given common sense to answer questions like this. Yeah. And that same question of why is being asked of a bill barr. This attorney general has been attorney general before and overseen special counsels and investigations before. It seems his motivation is, perhaps different or, you know, some believe it may be compromised. Still, its why . Why is his approach to Something Like this unfolding the way in which it is . There is an expression, fred. What . It means the thing speaks for its. I wont go beyond that. Objective analysts have not covered mr. Barr in glory for his interpretation of the Mueller Report. If theres a cross fire, Border Patrol doesnt know they are in the area and see men in military fatigues with guns that could create an incident. Interference by civilians and Law Enforcement could have Public Safety and illegal consequences. Not only are they taking exception with this, the Governors Office released a statement to us saying they have not been authorized by our office or any other. We are actively working with the attorney general into this. They call it unacceptable. The sequence of events is confusing. The video demonstrates they are holding them until Border Patrol arrives. Border patrol is saying we cant condone it, we condemn it. Does Border Control come to round up the 300 or so people who are there . Absolutely. You see it in the video. They are at the port of entries, deal with entry. It is used as a tool. You see them in the field. They see these individuals are sitting down with this man who is filming. White House Press SecretarySarah Sanders is down playing a section of the Mueller Report where she admitted to lying to the press and now some prominent journalists want her gone. This comes a day after President Trump fired fbi director, james comey back in may, 2017. The rank and file of the fbi lost confidence in their director. What is your response to the rank and file fbi agents who disagree they lost faith . We have heard from countless members of the fbi that say very different things. Under oath, the Mueller ReportStates Sanders told this office that her reference to hearing from countless members of the fbi was a slip of the tongue. She also recalled her statement in a separate interview that rank and file fbi agents lost confidence in comey was a comment she made in the heat of the moment. Since the release is public, sanders failed to say why she misled the public. Actually, if you look at what i said, the slip of the tongue was using the word countless. There were a number of fbi, former and current that agreed with the president s decision. They have continued to speak out and say that and send notice to the white house of that agreement with the president s decision. James comey was a disgraced leaker. Brian is cnns chief media correspondent and anchor of reliable resources. She fessed up, you know, to at least the mueller investigators the slip of the tongue, she didnt tell the truth, et cetera and a lot of experts in the fbi community who say they wouldnt be talking directly to the press secretary, they would be talking to white House Counsel if that was said. I digress. Anyway, now the message is, she should be fired, according to some. If shes removed from that position, sean spicer or someone else who doesnt tell the truth would say what the president wants her to say, truth or not . By showing loyalty to the president , they are showing contempt for the press and the public. That is the unfortunate environment we are in. The example with sanders is a small example of a large problem that this white house cant be trusted. Its so black and white. Its there in the Mueller Report where shes admitting she lied. She will continue in the role, i think, despite calls for her to step down or be fired. I mean, who would be responding to calls for her to be removed or a matter of her comfort, how long, you know, will she be able to do her job, knowing the cat is out of the bag . Partly because her job is changed, she stopped Holding Daily briefings. Thats why shes remained in the job as long as she has. Its been 40 days since a daily white briefing. White house ended those sorts of sessions. I asked sanders for comment and she declined to answer my questions. In the interviews on nbc and cbs, she said she was trying to tell a version of the truth and used a couple of words incorrectly. Another way of saying i think it is. I think the short answer is that her credibility has been erased. She does not have credibility. Its gone. Yet, this is something that doesnt have a clear solution. I know past administrations have bended the truth, bent the truth, this administration snapped the truth in half. The Mueller Report has more examples of that. That continues to be a problem. Lying is the line of this presidency. Because it starts at the top, it is something that is not going to change anytime soon. One has to wonder, though, after this administration, if there will be a return, you know, to the kind of responsibility that press secretaries and press corps are accustomed to. When they wanted to verify, check, double check something coming out of the white house, they could trust the press secretary would have that information. Now, you have to double, triple check, even what the press secretary is saying. Its one thing to spin. Its one thing to say the sky is a bright shade of blue when its a different shade. They say up is down and black is white. Its not illegal to lie to the press. Its not illegal to lie to the public, but it is immoral. Good to see you. What we know, based on the report findings, what stands out as the critical risk issues as it pertains to the hacking . The clear risk is the fact the United States and our democracy was attacked. The report confirmed that russian intelligence and their surrogates deliberately tried to interfere with the 2016 campaign through various different means and methods. Our National Infrastructure from a digital standpoint was compromised. That is the greatest risk in the 2020 campaign. Clear evidence of russian interference in the 2016 campaign is outlined in the report. Is there still, you know, a great risk today of hacking and interference . We know that, you know, many experts said theres promise of such. Could it be equally as bad . Its going to be worse. Here is why. What the Mueller Report did is confirmed what the threat was. Today, its almost four years later, technology has changed. Advancements in ai and Bot Technology in terms of changing a narrative at scale is going to change the environment and make it more difficult to counter act the disinformation campaigns that russian intelligence and their surrogates, the i. R. A. Are going to put forth and find pathways for vulnerabilities we have in our infrastructure, utilizing technology. Thats the greatest risk we face. The Mueller Report confirmed it. They confirmed the threat. Right now, the networks are still vulnerable. My fear is, we are not doing enough to mitigate those vulnerabilities. Especially hen you look at the large field of Democratic Candidates out there, every one is susceptible to the threats of russian interference. With the warnings in the Mueller Report and evidence of continued interference, how should all of these candidates and everybody else step up their protections . Listen, the Mueller Report is a warning sign. Its a big bell ringing saying listen, everybody, we need to create a culture of Security Awareness within the campaigns and within our society. Every campaign right now should take pause and look at internally, what are the cyber mitigation, you know, tactics in protocols they have in place today not to become a victim.
