Secretary of state john kerry helicoptered to a Geneva Switzerland hospital earlier today after being injured in an accident while biking in the french alps. Kerry is an avid cyclist. Nick robinson is tracking the story for us. Reporter secretary kerry sustained this injury when negotiating a curb when on his bicycle about 30 miles outside geneva early sunday morning. He was in france. He was taken by medical helicopter to this hospital in geneva, back in switzerland. Hes been treated by doctors throughout the afternoon. The fracture detected in his femur is close to a previous operation where he had hip replacement surgery in his right femur. Secretary kerry decided it would be better to go back to boston to be treated by his doctor there who did the hip replacement surgery. Hes been in the hands of doctors here in geneva throughout the afternoon. Clearly, the determination is made it is better for him to allow his staff to travel back on his own plane while he will wait a medicallyequipped aircraft state Department Officials made available to him. He is using that aircraft to fly back to boston. How will this impact the important iranian negotiations under way right now that have a deadline june 30th . The reason secretary kerry was in geneva. Secretary kerry has a lot of experts on his team. It is his own personal relationship with the Iranian Foreign minister that has been key and critical in talks up until now. For a man of secretary kerrys age, of an injury of this type in the femur, recovery is often slow. Secretary kerry said he will not be going to madrid obviously. He will not be going to those important isis talks in paris tuesday. He does hope to attend them remotely. The iranian talks, thats another question. Nic robertson, our thanks to you. Freedom act which endses the bulk collection of telephone data passed the house. Utah republican senator mike lee told cnn he believes a deal will get done. I do believe we have the votes. At this point, i think the question is not really about whether well get this passed but when. It will happen either tonight or it will happen on wednesday. Some in the senate want a temporary extension of the current program. Here is what we expect to happen today. 3 59 p. M. Today, eight hours before the midnight lapse, the National Security agency will begin shutting down that bulk collection system. At 4 00 p. M. The senate will be back. However senators will need at least 60 votes to defeat the current filibuster which could lead to 60 more hours of debate. A vote is expected before 6 00 p. M. With no decision by the senate patriot provisions expired a midnight. There is more on the debate going on in washington. Reporter yeah. Thats right. The senate will gather in about two hours. One minute before that gathering time is when the white house says the nsa will have to start winding down parts of their surveillance program. That is unless there is a quick resolution which as of now does not seem likely. On capitol hill time is almost up. The scramble in the senate is about to beyond. Unless the senate acts at midnight tonight to keep pro vigs of the patriot act will expire including one which the controversial bulk phone data program operates. It collects numbers dialed and how long calls lasted but does not capture the contents of conversation and other surveillance provisions set to expire one allowing the government to seek a court order on individuals for business records. The ability to track a nonamerican lone wolf. All powers the administration claims are essential to fighting terrorists. It would be irresponsible, it would be reckless. We shouldnt allow it to happen. Reporter the house passed a compromised bill supported by the administration which would extend the key provisions but reform the bulk data program. That telephone data would be kept in the hands of phone companies instead. Will require the government to seek a court order for access. Today republican senator rand paul is preparing to get back in the ring vowing to do all he can to stop the surveillance programs unless changes are made to weaken them. There is no constitutional justification for the government to collect all of your phone records without your name on a warrant, without suspicion and not signed by a judge. Your privacy is yours, the government needs to leave us alone. Reporter unless rand paul unexpectedly gives in this afternoon, its likely some of these programs could be shut down at least several days. That would force the government to adjust its counterterrorism strategy at a time where the threat is still high. A lot of people concerned about that possibility being shut down 72 hours. Its not like its going to be pulled and there is a terrorist attack the next day. No one believes that. What happens though in this instance if we pulled plug its no way to run National Security. You dont say at 11 59 its going and midnight its over. Its destructive to the men and women trying to protect us. The difficulty what is about to happen i think well lose these authorities. I see nothing about rand paul that suggests we are not going to come to a standstill. The final thing to remember is there are thousands of investigations going on right now. There is an increased threat. What you dont want right now is people who are serving our country to protect it to wonder what their authorities are. In that instance they are afraid theyll break the law or not do what they are authorized to do. Thats the confusion we are entering in the next day. Tom, let me turn to you for the Law Enforcement perspective. Will this make it harder for Law Enforcement agencies to track suspects . Dont they still have access to court orders for surveillance . Lets go with that, court orders. Right now i would refer to the program as mini data. Its the storage of old phone bills for a longer period of time than any one phone company or Internet Provider would want to do. Usually they dont want to hold it longer than the appeal period two, three months. You have two, three months to argue your bill. If you dont, its too late and they can destroy it. I heard some senators say well create it where the government can subpoena the private companies. You dont know if the private companies will stay in business more than two years, merge with other companies who will have the data. Second of all, i dont think people realize there are over 3,000 separate Internet Service providers in this country with voice over internet capability. You are asking the fbi if you have a suspect issue 3,000 subpoenas to track down which possible phone company it might be. Right now, you basically have onestop shopping. If you have a Boston Marathon bombing, you have the cell phone numbers of suspects in that you can go back on those phone numbers and see what other numbers were called or texted or calls received from going back two, three years. If the bombing happens 6 00 p. M. On a friday you dont have to wait till monday Business Hours to contact phone companies to find out who belonged to those records. You dont have the clerical staff to do 3,000 subpoenas. Yeah. What they are talking about is not workable. It means not having capability, which is fine. Dont call it an intelligence failure if Law Enforcement cant solve these cases. Certainly the big concern people are uneasy with the idea the government collecting information on them even about their phone records. The real question is has the program helped track any of these bad guys . Both sides are being extreme in their assessments of the program. There is absolutely no proof any of these powers on the patriot act stopped an imminent attack. There is no proof these programs invaded peoples privacy. I think the truth lies somewhere in between. These authorities are being used to set a baseline to begin investigations that then may ultimately result in a good counterterrorism case. Thats important. Heres the irony of everything going on whether you are a republican or democrat. The house compromise over the patriot act ends up being sort of rather rational at this stage. We dont often say that about the house. Its the senate the mcconnell side saying no changes to the patriot act and paul side saying get rid of it. Its at these far extremes which we expect from the house. The house compromise is a compromise that got bipartisan support because it has more oversight which is necessary. Let me bring in a professor of Public Health at the university of texas in dallas. Let me start with the gravity of this injury. As a patient, kerry is 71 years old, quite active. How potentially serious of an injury is this for him . Why its a very serious injury. The bone hes broken is the longest and strongest bone in the human body. It can take a lot of force to break it. In this instance he was biking at a slow speed. We typically tell patients it can take up to six months to recover from this type of injury. Thats after surgery and physical therapy and lots of rehabilitation. There are a few things that bode well. First thing the doctors in europe have given him the allclear to fly back to the u. S. That is reassuring. The other thing he didnt lose consciousness at the time of injury which means he probably wasnt in agony and didnt lose lots of blood. Those two things are reassuring. Hes being flown back to boston. Thats because kerry previously had surgery on his hip in boston and his new injury is located close to that old one. How valuable is it to have the doctor who did his hip surgery work on the leg injury . Its fine to have the same doctor. It can be useful to have someone who knows the patient well. We know the secretary of state is no stranger to injury. Had that hip replacement in 2009 and knee surgery in 2005. A broken nose a few years ago and jaw surgery. Its helpful to have a doctor who understands everything thats been going on for the patient. It can make a difference. If you were your patient, how long before you would give him the okay to go back to work . This is a busy guy. Hes very very busy. He traveled to more than 60 countries since hes been secretary of state. Would you typically tell a patient it takes at least six months to heal. It depends on the fracture they had. Has been holding negotiations with the government of afghanistan and qatar to extend this travel ban. How are those talks going . The Senior AdministrationOfficials Say all weekend these talks have been going on between the u. S. Government qatar government and afghanistan government. Last we heard friday, what was supposed to be a decisive meeting held between qatar and americans saturday. Details had not been made public. That hasnt surrounded the chatter surrounding the controversy of the release of the taliban five. Earlier today on state of the union four star general Stanley Mcchrystal talked about the trade for bo bergdahl and the taliban five. Its important to get them back. Weve got to decide what we deal with. The five back presumably theyll go back to the battlefield. They wont change the dynamics. Its not going to change the balance of effort there, five guys. Its something weve got to watch. We wanted to introduce you more specifically to these five individuals that the u. S. Relinquished to secure bergdahls release. They were mid to my level officials within the taliban. One was the chief army staff under the taliban regime accused of war crimes during afghanistans civil war in the 90s. Another denied his role and importance of level of access to taliban officials. The third reportedly an al qaeda intelligence member. He denied links to terror groups and contends he was detained while trying to help u. S. Officials find and locate senior taliban leaders. A fourth was a minor taliban official and the chief of communications. Perhaps the most high profile was said to be an early member of the taliban with direct ties to osama bin laden. As you mentioned, the concern is that they will rejoin the taliban and strengthen that group. I was watching that interview and it was a great interview. He was alarming by saying its presumed they will go back to the battlefield. I did take away that he said these goes have been out of the game a long time and maybe will not go back to be the leaders they were. Lets hope that is the case. Thank you very much. I respect him, but hes wrong. They are like rock stars. If they dont go directly back to the battlefield, there will be a great psychological edge to the taliban. We have to take seriously the potential of their return. I would like to see their presence in qatar extended. We have to do more to try to figure out what we are going to do to monitor them. Qatari do not want additional surveillance upon them. Its in our interest to figure out what will happen. I talked to senior leaders, one worked for Stan Mcchrystal and said these guys will put a great bit of wind in the sails of the taliban should they get back. James clapper said one of the taliban five contacted militants and senator Lindsey Graham said one of the men met with members of an Al Qaedaaffiliated group. Isnt that a huge red flag . As colonel schaeffer was saying the whole thing is a red flag. The real red flag we dont have a handle on the way we are fighting this war on terror globally and here at home. Why did we have to release these five particular people . They were chosen by the taliban. What we are seeing is things not thought through like the patriot act expiring. Why are we allowing that to expire . Why arent we discussing it figuring out whats good and bad about it . Why are these things politicalized . I agree with colonel schaeffer and disagree with general mcchrystal. Look at al baghdadi he was nothing and went to prison and by the time he got out of there, he was head of isis. Qatar officials have been meeting. There doesnt sound like a deal to extend the travel ban. What pressure can the u. S. Bring to bear to force a deal . A great deal. Qatar depends on us for economic support. Jonathan is spot on. He said it there we dont have a plan. I cant believe state department started negotiating three days before the travel ban expires. This is totally insane. We dont have an idea of what these guys would do. We see guys go back all the time to the battlefield after having been detained and take up huge leadership roles. They dont have to be current, but effective. We have to be clear here of what we expect to occur when these things happen. It was a bad trade. Five four star generals for one individual who probably would be held accountable to have deserted his post. I dont think we know what we are doing. Let me ask you about another topic. Let me change focus to isis and iraq. This is brandnew video that shows the countrys military bombarding isis Anbar Province with air strikes. Colonel, weve seen air strikes from Coalition Forces aimed at isis for months. This strike is from the iraqi air force. Is this a sign they are getting stronger and could be more successful in the fight against isis . They have to be. There is no doubt here when you see large armies amassing in open broad daylight. You have to do something. Ash carters comments were true. Iraqi army has to get its act together. We should do more to motivate it. Who can we work with . S we underutilized our own air force. We are running three to five sorties a day. What is your take . I think colonel schaeffer could agree and tell you if we just allow these other host nation individuals to fight their own war and we are not over there at least advising them and sometimes leading them into battle you are just fighting skirmishes. Nobody fights like we fight. They are really good fighting in their area of operations. And maybe their village. Once they step out of that area throwing bombs down a range does nothing. I think there are negotiations going on and private parties are also engaged. Friends of at least one of the individual who has contact with the huzis. They are trying to get him out. A series of mysterious shooting in Northern Colorado had the community on edge. John jacoby was cycling when he was shot and killed. His attack follows several other incidents along a stretch of colorado highway which injured 20yearold corey romero. Police were not officially connecting any of the shootings but now they are. Erin, what can you tell us . Reporter authorities are working to solve this mystery. Jacobys death marks the first homicide this small town has seen in eight years. Now some of the shootings are linked people are very nervous. Two random shootings. Authorities say are linked. Fears in colorado there is a sniper on the loose. Be vigilant. Be aware of surroundings. Reporter the warning came friday as Police Revealed there is new evidence connecting the shooting of john jacoby to the shooting of cori romero. Police wont say how they are linked but say the victims appear arbitrary. The two victims knew each other . There is no indication of that at all. Reporter may 18th in windsor, jacoby was shot twice and killed while riding his bike. Five miles away a month earlier, romero was shot in the neck while driving. Adding to the mystery, two dozen reports of shattered car windows. Those have not been linked to this event. Its not theyve been discounted either. Reporter the news has this rural town on edge. It makes you stop and think. Its scary. Reporter when asked how concerned people should be about the shootings, the police chief said its impossible to say. They are leaning on the public for assistance asking anyone with information to come forward. Do you know if they put extra security precautions in place or what people are doing to protect themselves . Reporter at this point, not clear. They are not in that press conference there, police chief did not mention any additional security precautions. Basically, the fear amongst many there is they are being left out by the government to face isis on their own. And the Conspiracy Theory is perhaps there are some proshiia politicians in baghdad and it might be okay with the notion of a sunni failure in the defense of that area. So therefore, the shiia fighters doing all the fighting here could sweep in and, quote, save the day. A sectarian picture. A devisive issue around there.
