We saw last month the u. S. Embassy there, shutting down and pulling out the staff. That has also had an impact on the operations. Officials have said that they will continue this these Counterterrorism Operations remotely but it was believed that the shutting down of the u. S. Embassy would have an effect and an impact on the fight against terrorism there in yemen. Fred . And then there were the mosque bombings earlier in the week. Is there a connection . Well what were hearing from our colleague barbara starr, from her reporting, that this evacuation of these hundred troops was because there was a prison break, a couple of prison breaks on thursday and friday where al qaeda prisoners were on the loose. Now, of course theres also the deteriorating security situation as you mentioned, the devastating attacks we saw taking place in the capital sanaa on friday targeting a houthi mosque the Houthi Rebels is a shia group that have taken control in recent months of the capital there, and an attack that is said to have been claimed purportedly by isis. Of course a very Dangerous Development in that country where we know that al qaeda in the Arabian Peninsula has had really the upper hand there when it comes to the operating terrorist groups in that country, so this latest attack fred has many people concerned about what this means. Is this the start of a new, dark chapter in that country, the emergence of isis possibly there, before thought to have very limited capabilities still in that country, and also the possibility of trying to drive yemen into a sectarian war. Isis and al qaeda, of course sunni militant groups attacking here what we think as the shia rebels in that country, driving it to a conflict similar to the up with weve seen in iraq and syria, this sectarian violence so a lot of concern about this and now this happening with the evacuation of what is believed to be the last of u. S. Intelligence representation still in yemen likely . Its virtually zil at this point. You may have travelers going in occasionally but its rare. We are blind in yemen except for satellites and intercepts. This is a huge setback and as the civil war progresses there, and it is getting worse, youve got the houthis moving today, youve got al qaeda in the arab Arabian Peninsulas has taken over a couple towns, the chances of avoiding a fullon civil war in yemen i think are also zill and our intelligence correspondence will get worse by the day. Its unfortunate, seeing a al qaeda mini state in yemen is not a good turnout for this of events there. This is a significant blow is it not, because the u. S. Invested so much. There had been some milestones that the administration had boasted about that it appeared as though yemen or at least keeping an eye on terrorist atifts there was activity there was clear in terms of advances of u. S. Intelligence was able to make. How undermining is this . Well very fred. The president has described yemen as a success story. Its clearly not. I dont thinktst think the United States or anybody understands the virus of the Islamic State, sunni fund mentalism whatever word you are using seems to be spreading in areas where theres power vacuums, libya, iraqsyria, and its unclear to anybody how to stop this right now. Lets also talk about tunisia and what took place there. Isis claiming responsibility for the attacks that happened there and in large part isis being able to say and demonstrate that its reach is growing. What does this tell you about the reach of isis and how it is able to infiltrate if not set up camps like weve heard in neighboring libya, but actually carry out threats . Well for tunisia, this is an enormous setback because you look at the border between libya and tunisia its porous people cross it lot of weapons in libya. There is a civil war going on there now. You know how do you seal a border like that in the desert . Virtually impossible. But i dont really think the Islamic State is controlling these attacks. The United States has the ability to close down their communications monitor them. I think the Islamic State is simply claiming victories its not really in control of so im not that worried about that. But im worried about just general chaos because people facing chaos like this the default position is radical islam and thats what should concern us. When do you suppose counterterrorism officials can learn from say the most recent attack that took place there in tunisia in terms of how to anticipate the next plan . If i were a westerner i wouldnt set foot in the middle east anywhere beirut tunisia, iraq libya the obvious places. Its not safe. State control and the middle east is deteriorating by the day and its wise to stay away and certainly dont go to public place like the bardo pew seem in tunisia. Appreciate it. This story out of new orleans, louisiana, this morning. Police shoot a Man Threatening tsa agents with a machete and bug spray. Travelers were sent scrambling as 62yearold Richard White stormed a Security Checkpoint. An agent fought white and used a piece of luggage to block the machete when a Police Officer opened fire shooting white in the leg, chest and face. Reporter a chaotic scene at new Orleans Armstrong international airport. An injured tsa officer is wheeled away on a stretcher after police say a machete wealding man who used wasp spray attacked security staff at a concourse checkpoint. He walked down the tsa preline, encountered the tsa officer who was checking the boarding passes with the scanning machine to be scand. He was challenged at that point in time by the tsa officer. The response was, he pulled a can of wasp spray and sprayed the officer in the face. Police say the suspect identified as 62yearold Richard White, then encountered two more tsa agents and started swinging a machete. The incident apparently continued through the security area until the suspect was shot three times by a Jefferson Parish sheriffs deputy. White was taken to a hospital for surgery. Police say a shot from that sheriffs deputies also hit a tsa officer who was being chased by the suspect. Her injury was not life threatening. The incident sent passengers and airport workers scrambling to safety and closed the airport for a short time. Police do not have a motive in the attack. We dont know whether or not this individual was a member of the traveling public. We suspect not. He has been a taxi driver. Hes recently received a chauffers license. Has little or no criminal history. Lets talk more about this. Joining me jonathan gilleyham a former air marshal and fbi agent. In your view how do you suppose the suspect got so far with this kind of weaponry . Its not hard to get to the point where he got. You know, the fact is in the Airline Industry weve taken the bureaucracy of government and a private company and put them together and when they make their security in all these airports the policy they have they basically have created bottlenecks and all their security is in one location. You literally could walk up to the Security Checkpoint where with a marching band. Nobody is going to stop you before you go in the doors. As far as youre concerned, it seems as though response was really quick and it avoided something far worse . That is true. But had it happened in another area in the airport, the response would not have been the same. The fact is that, you know theres armed Police Officers you have a massive amount of tsa people but theyre all in that area. Had somebody snuck something through or had they done the same attack outside on the curb it the Response Time would have been a lot slower and potentially there could have been a lot more injury and even death. And what does this tell you about the preparedness a at this airport, which, you know, is a sizable airport given you have so much tourism, but not considered one of the largest ones. What does this tell you about the security in place, tsa response sheriffs deputy who was nearby how people Work Together . Ill tell you fred when bob bear was talking about the middle east that attack that was in tunisia, for instance, that was outside of a museum but they didnt attack the museum. They hit the bus. If, you know somebody has been convicted and theyre a felon and have certain types of almost seems like it was face recognition by saying that this one officer recognized that felon. Thats a one in a million chance too. When somebody is a sex offender they have to register as a sex offender. It might be time for us to start looking at certain types of crimes and people if youre a felon you have to register as, you know a certain thing. In the case of any type of crime with using a weapon or using a bomb making material something that you have to sign be on a list and when you present your credentials, its known that youre in that airport. Well fredricka, weve heard from the fire commissioner that the fire started slightly after midnight in the kitchen due to a malfunctioning hot plate. These are used commonly by jewish families here to keep food warm on sabbath and it just ripped through the house, went up to the second floor. What the commissioner said they havent found any evidence that there were smoke detecters on the first or second floor. The mother and the daughter as you mentioned, they jumped out of the secondstory windows and escaped, but seven children between the a ages of 5 and 15 were killed. Firefighters rushed to the scene, obviously hoping to scoop the children out of their bed and save them. In the end the commissioner is saying this is the highest death toll in a fire accident in the last seven years. Take a listen to what he said. Seven children lost their lives this morning at this occasion, this very tragic occasion. Its a tragedy for this family its a tragedy for this community, its a tragedy for our city. Now, the other another detail from the commissioner is that they have not been able to reach out to the father yet. He was at a conference and they havent been able to reach him. This is a difficult moment for this community. A lot of people because its sabbath, its a tight knit Jewish Community, they havent been watching their tvs or had their computers on so theyre finding out about the accident on the way to and from the synagogue and its a terrible shock. People are really feeling this. Oh, my goodness. So, shasta just trying to envision here so clearly all the chirp, perhaps kind of dispersed throughout the household. You said the mother and 14yearold were in the second level, right, and they were able to jump to their safety but is there any detail from officials about where the other kids were in the house and why it was no one could try to retrieve them and the mother and 14yearold were able to survive by jumping out . Fredricka, the family that was on the second story, but a lot of the children who didnt survive were in the back of the house and the mother and the teenager the 14yearold who did were in the front of the house. They were able to jump. Again, just part of the problem, according to the commissioner is that they just didnt have the smoke detectors. I imagine well discover soon how much of a role the smoke inhalation had in this. The commissioner said this was devastating for the firefighters to not be able to save these children fredricka. Yet anothers twist in the case of millionaire murder suspect Roberts Durst in custody charged with the 2000 murder of a friend but he could face charges in other states where officials are combing over cold cases and now his attorneys tell cnns jean casarez their client isnt well and needs medical care. Reporter robert durst sits behind bars this weekend at the hunt correctional facility about an hour outside of new orleans. Hes in their mental facility there and his attorney tells me it is not because hes a suicide risk he is not. He does say he has a medical condition, that he needs to be in a hospital setting, but its because of what we heard in open court, that recently he had neurosurgery or brain surgery, because of a condition called hydrocephalus. The attorney tells me that during that surgery they inserted a stent or a shunt which is like a tube and when necessary for fluid drainage. The attorney tells me also in recent years, that his client had cancer of the esophagus and surgical surgery of his neck. While robert durst is behind bars the fbi is asking Law Enforcement to search all of their cold cases, their murder cases, that are unsolved in areas frequented by or lived in by robert durst. Theyre asking them to see if there are any time periods when durst was in town living there or visiting and murderers that are yet unsolved. The one that all eyes are focused on is in Northern California young woman by the name of Karen Mitchell who went missing in 1997 when she was 16 years old. There was a sketch artist that actually did a rendering of what a witness says was the last person who was seen with her, as you can see, a striking resemblance to robert durst. In looking through property records, however, what i see is that although he purchased property in that area it wasnt until two years later. The defense response to all of that is that Law Enforcement is just trying to pin something on their client because they just dont have a case in los angeles, and that is the issue on monday. It is a bail hearing in louisiana for local state charges, but the big question after that hearing, will robert durst then be extradited here to los angeles to face firstdegree murder charges . So the last of the american troops who were stationed there, and of course the embassy was evacuated back in january. Are there any u. S. Personnel in yemen . Reporter well of course the Counterterrorism Operations in yemen, fred have been surrounded with a lot of mystery. But what we do know at this point from officials, these are the last of u. S. Forces there on the ground there, in the process of evacuating as you mentioned. A hundred special Operations Forces members from the alanad air base. We saw the u. S. Embassy there last month, along with other Diplomatic Missions from the country. And this does come after months of a deteriorating situation. A security situation, and a political crisis in that that seems to be is continuing to worsen. Aqap and Arabian Peninsula had a hold on yemen but if isis is doing the pushing and shoving and bombing there, what does this say about these two terror groups in yemen and what does this say about the i guess deterioration of maybe aqap also . Thats youre absolutely right. And whats frightening here is that essentially, the Islamic State is being more radical than al qaeda in the Arabian Peninsula and more successful. The islamics say their claims by their supporters of an attack in tunisia that killed mostly foreigners and two suicide attacks in yemen. This is a huge problem propaganda for them. Theyre not necessarily involved in planning these attacks, but the fact these young men are carrying out attacks across the region, it breeds the chaos they want to see. Its breeding this kind of sunnishia clash across the region that really helps them. And its really a very alarming situation. So attacks in yemen, attacks in tunisia. So these attacks across the globe are happening close together by calendar dates, but there are some slight differences in how these attacks are being carried out and making it more difficult, is it not, for Law Enforcement to try to prevent it, because everything is changing apparently from attack to attack. It is. And in tunis it was young men armed with rifles. Two were killed. And many accomplices, but they were very effective carrying out, so many foreigners used suicide bombers in yemen, hard line sunnis to create tension with the shias. Yemen more and more looks like syria. And then which looks like somali and libya, the attackers trained in libya. So i hate to be alarmist but this is a dangerous situation. Instability is steadily spreading across the middle east. When we talk about growing, were not talking about the threat growing, but the presence and it seems like you mentioned the camps in libya, the residency, so to speak, of isis is growing. Thats whats so disturbing. If a young person wants to you know get training and declare allegiance to isis they can do that in parts of libya. They can do that in parts of yemen. They can do that in syria. And its this is you know im talking about a change thats occurred just in the last few weeks. And, you know i dont theres no easy answer to this. Police shoot a Man Threatening tsa agents with a machete and bug spray. Travelers were sent scrambling as 62yearold Richard White stormed a Security Checkpoint and at one point an agent fought back and with that machete you see on the ground and the tsa agent using a piece of luggage to fight back and thats when a Police Officer opened fire shooting white in the leg, chest and face. Reporter a chaotic scene at new Orleans Armstrong international airport. An injured tsa officer is wheeled away on a stretcher after police say a machetewielding man, who also used wasp spray, attacked security staff at a concourse checkpoint. He walked down the tsa preline, encountered the tsa officer who was checking the boarding passes with the scanning machine to be scanned. He was challenged at that point in time by the tsa officer. The response was, he pulled a can of wasp spray and sprayed the officer in the face. Reporter police say the suspect identified as 62yearold Richard White then encountered two more tsa agents and started swinging a machete. The incident apparently continued through the security area until the suspect was shot three times by a jefferson paris sheriffs deputy. White was taken to a hospital for surgery. Police say a shot from that sheriffs deputy also hit a tsa officer, who was being chased by the suspect. Her injury was not lifethreatening. The incident sent passengers and airport workers scrambling to safety and closed the airport for a short time. Police do not have a motive in the attack. We dont know whether or not this individual was a member of the traveling public. We suspect not. He has been a taxi driver. Hes recently received a chauffeurs license. Has little or no criminal history. Unbelievable scene there. And several bystanders did suffer minor injuries. New york mayor, bill de blasio is going to address the public about a horrific fire this morning that killed seven children in their home and they were all siblings. You can see in this video here the house is nothing but a burnedout shell now. There were two surrendervivorssurvivors, a mom and her 14yearold daughter and they literally jumped out of the window to escape the flames. Cnn correspondent Shasta Darlington is with us now from brooklyn. This is a horrible situation. I dont know how anybody there is going to be able to recover from this. Thats right, fredricka. The fire commissioner is saying this is not only a tragedy for the family and the tightknit Jewish Community but devastating for the firefighters on the scene. Listen to this. Firefighters forced their way in extinguished fire on the first floor, which started in the kitchen. Pushed upstairs and found the children in their bedrooms in the back of the home. This is the largest tragedy by fire that this city has had in seven years. Its difficult to find one child in a room during a search. To find a house full of children that cant be revived, im sure this will take its toll on our members for quite some time. Now, the fire started in the kitchen, it was a malfunctioning hot plate. Theyre commonly used in the Jewish Community to heat food on sabbath, and the fire quickly spread to the second floor. The commissioner said they didnt find any evidence of smoke detectors on the first and second floor. Again, the mother and daughter were able to survive by jumping out the secondstory windows. But seven children between the ages of 5 and 15 were killed. One was killed right here on the scene. Others in the hospitals in the region. Other details from the commissioner they havent been able to contact the father who is away at a conference to let him know. I spoke to a neighbor who said he saw the house engulfed in flames, and the three really just moved back here after living in israel. Shasta, how about the mother and 14yearold . Where are they . Are they hospitalized . Whats their situation now . Reporter they are hospitalized in Critical Condition with severe burns. Robert durst, the focus of hbos true crime documentary series the jinx was charged with first degree murder this week in the 2000 killing of his longtime confidante susan berman. There are a lot of different threads to this story and were going to take the next 20 minutes or so to look at this case and well be talking to our legal guys about what kind of evidence authorities really have against him. Thats coming up. And kyung lah meantime gets us started with a look of what led to dursts arrest. I think he has the ability to be a sociopath, but i think hes also a narcissist. And you put the two together its basically the bottom of the barrel. Jim mccormick mincing no words about robert durst. They were brothers in law. Durst marrying his baby sister cathy mccormick. Jim says his sister wrote in her journal she feared her husband, that he abused her. She was planning to divorce him. January, 1982 they have a fight. And she vanishes. Immediately, mccormick suspects durst. We spoke last week just two days before dursts arrest. Theres too many you know, subtle he clues and bits of circumstantial evidence that were adding up to a preponderance of youre guilty. One of these subtle clues, durst takes four days to report her missing to homicide detective, mike struck. Struck never nails his prime suspect. Keeps coming back to the fact that we never found her body. We had a crime scene. No evidence. No evidence no crime scene. The case grows cold until 2000 when investigators reopen it. This time the millionaire flees new york to this rundown apartment in galveston, texas. Hiding out, crossdressing and posing as a mute woman. For months he is speaking to virtually no one, except this woman, susan berman. Durst and berman were decadeslong friends. She was his con if fidanteconfidante corresponding by letters and phone. Investigators decide to interview, but before she could be questioned christmas 2000 someone shoots berman execution style in her home. The killer sends police this anonymous happenedndwritten note shown in the jinx. It lists an address and one word cadaver. When she died what did you think . I said bob is eliminating witnesses and people who have knowledge of cathys passing. In the jinx, a new stunning revelation by the stepson of susan berman. In a storage box, the stepson comes across a letter durst sent to berman shortly before she died. Dursts handwriting, the killers note to police they bear remarkable similarities. Down to the misspelling of beverly. The address on the front is exactly like the cadaver note. Remember durst is living as a mute woman in texas but police are able to track him to california at the time of bermans death. So what says durst, on the jinx. California is a big state. Death continues to follow the millionaire. Less than a year later, october 2001 at dursts texas Apartment Building his name morris black, goes missing. Blacks dismembered body parts begin washing ashore in galveston bay, 22 of them a torso, limbs, but no head. The fact that the head never showed up thats his home run. Thats his luck process. And that ghoulish luck actually becomes his legal defense. Durst admits he chopped up blacks body but only after shooting him in the head in self defense. No head no bullet the jury buys it. Robert durst, not guilty. Do you think hes teflon . No. No. I think hes been wellprotected by others. And enabled by others financially. Are the walls coming in on robert durst . I would think so. And in the final episode of the jinx robert durst is presented with a close match between his handwriting and the killers. On camera he appears unfazed. He then walks away to the rest room his mic still on. The camera records as he talks to himself. There it is. I killed them all, of course. Killed them all. Of course. Do you have hope . Good to see you, fredricka. So avery, you first. Do those muttered remarks by durst, spoke into a hot mic, neutralize twoparty consent rule in california . Well thats a rule in california where both parties have to consent. I dont think it applies at all. The fact is its an unfettered stream of consciousness, its exactly what prosecutors are looking for. This is an admission. Its going to be part of the evidence evidence. The only challenge, i think the prosecutor is going to be facing here is how much weight is the jury going to assign that admission. And i think thats that rises or falls in terms of where this case is going. But then richard, what is this about. Hbo was working with police to come degree. And if that is the case can his defense argue entrapment that the mic was intentionally not turned off when he went to the bathroom . Well the argument could be is hbo actually an agent of the government. Fred its really its almost a bar exam question whether that statement is admissible or not. You have issues of authenticity. It was made two years ago. Maybe more than two years ago. Chain of custody on that. Was it a knowing waiver by him, which obviously it was. Its hearsay. There is no probative value of it does it exceed the prejudicial value. I think its admissible. Even if it is admissible fred this is not going to make a first degree murder conviction this recording. The defense will have a hay day on this. We have not heard anything about any exactly. Physical evidence. Still no dna, right, in large part. So still mostly circumstantial . Thats right. Why would this make a difference or how does it make a difference . I think it does not make a difference fred. When Law Enforcement gets frustrated they jump and make mistakes. This is ridiculous. There is no way they get a conviction off this or the letter. The envelope by the way, which if you look at the handwriting, you can make a determination that its different. And a lot of people outside really that its different . I dont look at the es. Just look at the es. Theyre not the same. Beverly, spelled the same way . Youre going to get a handwriting expert looking at it. Battle of experts. I think its going to be there is no getting around there is no getting around the reality of that admission. Youre right, it is getting in. And as i say, this case doesnt turn on anything other than a jury either accepting or rejecting the weight of that admission. And its the most important thing prosecutors avery, isnt all of the other evidence or lack thereof, wouldnt that weigh more than this admission or whatever you want to call it . Well it is an admission. And you know let me tell you something. If youre defending the case, youre going to raise issues. Youre going to raise issues the judge is going to let it in. Youre going to deal with issues for example, of dna. This guy is a convicted felon, theyve got dna evidence all over the place. Whether they can apply it here we dont know right now. But frankly, if i were prosecuting, i would like to move forward on a case. So has he even proven he is very clever and maybe that muttering or whatever that was, was just to kind of add fuel to the fire and he may have been playing everybody, you know . I mean and this is just another page of fred cleverness. The defense will say, its part of a theatrical performance on a documentary being done by hbo, and thats vein it was done in. Fred there are serious questions of probable cause of first degree murder. First degree murder charges based on this fred. Theyve got a long way to go. California better have more than this recording and the writing samples samples. They better have more or theyre going to get laughed out of court and hell get another victory. Okay. Theyre also looking into his potential involvement in the case of a missing california teen. Heres cnns dan simon. Reporter the fbi is putting out a call to local Police Departments to examine cold cases where durst lived over the past 50 years. The wealthy real estate heir has a reported net worth of 100 million, and lived or owned property in several states including new york vermont, texas and california. We are certainly interested in any information that may or may not come out of interviews with mr. Durst. If information comes to us that allows us to further our investigation, we will certainly take the opportunity to do that. Reporter one case that has piqued interest is in the small torn town of yreka, california. She was on her work at a daycare center. According to local news reports, she was last seen leaning into a light blue car she may have gotten into. A witness gave police the a description of the man behind the wheel. The sketch bearing a striking resemblance to robert durst. Durst apparently knew Karen Mitchell she volunteered at a Homeless Center which durst frequented he had a habit of doing in different cities. In addition, mitchells aunt ran a shoe store, and durst had gone there several times, one time dressed as a woman. Reporter author and Investigative Reporter matt burtbeck wrote a deadly secret chronicling robert durst, copies found in dursts houston home. In new orleans, where he checked into this hotel using a fake name Court Documents also reveal he had more than 40,000 in cash mostly in 100 bills. A rubber or latex mask to disguise identity some marijuana, and a loaded wesson. 38 revolver. A Law Enforcement official telling cnn he appeared to be on the lam and planned to travel from new orleans to cuba. Durst was arrested in new orleans on saturday and charged with the 2000 murder of susan berman his friend and spokeswoman. She was killed just before investigators were to question her. The arrest coming a day before the final installment of hbos documentary about his life when he made this alleged confession while talking to himself in the bathroom. What the hell did i do . Killed them all, of course. Dursts Attorney Says not to read too much into those comments and durst himself has long denied any involvement in bermans death and his wifes disappearance. I was chilled, and actually vindicated, but chilled by the open and unsolicited admission of guilt. Reporter thats Jim Mccormick who says he hopes durst will admit to killing his first wife and others. Tell his lawyers to bug off, and he wants to have this thing over and put behind him. And in a phone interview with cnns jean casarez, Robert Dursts attorney talked about other cold cases, saying quote, they seem to be going to great length to pin Something Else on him they must not have much of a case to begin with. When Law Enforcement get desperate, did he say per addo done don henley the eagles. They want him bad. Hes not a very likeable fellow. Hes worth 100 million. Hes got incredible legal teams surrounding him and protecting him. When they get desperate, they make mistakes. When they manufacture cases, Defense Attorneys have a field day punching holes in them. There is just and unless they put together the great type of cold Case Investigation and they can core ran rate with hard fax, this guy is going to walk on everything. Leaving something out here. What. Are we leaving out . What is he leaving out . Im not part of it. While all of us were doing legal last week the fbi zeroed in on this guy. Why . Because in the first flight between new orleans and havana guess who was booked on it . He had 40,000 in cash. He had a latex mask. So what . Really . So what . You dont think that means anything . Right. Put it all together. He knew the walls were crumbling down. He knew they were zeroing in on the susan berman case. And thats exactly why this case is moving forward. They got him just in the nick of time. Except it also boils down to what the evidence. Were talking about the admission. Exactly. And or are you saying he anticipated that that muttering, that being caught on tape was going to be enough to represent these walls coming in on him, because weve heard from investigators nothing of any new evidence. I think, fred what happened here was, the investigation has been going on for a couple of years. Exactly right. He knew that. And hbo has been providing information to authorities over the past two years. So i think that that relationship right, yeah. That he was a target here. And knowing he was a target the question is and the theory is well he was going to flee the country and run to cuba and flight is an element of guilt. Therefore, there it is. But fred i agree with you. It all comes down to the evidence. We dont know right now, there is nothing new here fred. Nothing. This is ridiculous. Anybody asking the question. For all the trouble that robert durst has had, and all the allegations and all the activities involved in what lawyer on earth advised him to move forward and do the hbo special in the first place . This is just absolutely mind bogging. No one is even talking about that. Yeah. How in the world did they convince him to do this . Maybe now thats our water under the bridge and now, you know thats for sure. Secondguessing as to why that was allowed to happen. Lets talk about what is moving forward. We know the fbi is asking various jurisdictions, all these places he has been to look at these cold cases one more time reexamine, see if there is any connection between durst and these places. We already know from dan simons piece he has property in at least four States New York vermont, california and texas. So what needs to happen in many of these jurisdictions to reopen these cases to try to draw some parallels to durst . Again, its going to have to boil down to dna or some sort of evidence. Thats exactly right. Dna is everything. Dna is everything. Because what else is there other than assumptions. On the yreka case involving Karen Mitchell that was 1997. New evidence we dont know probably not. But i think there is some value in exploring, taking that statement that was made in the hot mic, and trying to dig deeper to see if they can dig anything up. Right now, the only thing thats hot is susan berman. The other cases the mic statement is ridiculous fred. Were talking months more of investigative work. Oh yeah. Right. But fred you know you put on forensic files on hln every day and you see them solve cold cases all of the time. The question is will they be able to find some sort of forensic evidence locking him in. Will they be able to have some sort of guarantee. Because otherwise, fred you may get a looseygoosey investigator who puts together a charge against him, hes going to get blown out of the water. This guy is too good. We begin with more on our developing story. The u. S. Has decided to pull its last remaining troops out of yemen. Sources tell cnn about 100 special Operations Forces are being evacuated from the air base. This has been triggered by concerns the security situation in yemen is deteriorating. Were joined now from baghdad. So this is the last of the american troops who were stationed there, the Embassy Personnel had already been evacuated weeks ago. Are there any americans left operating in any capacity there in yemen . Reporter well fred heres what we know. Sources in the region familiar with the situation say the u. S. Is in the process of evacuating these 100 members of these special Operations Forces that were based in the al anad base in yemen because of the deteriorating security situation. Of course the u. S. Counterterrorism operations in that country are really surrounded with mystery, so what we do know we believe these are the last of u. S. Forces there, and as you mentioned, of course the u. S. Embassy was evacuated last month. And there has been a lot of concern about the impact this is going to have on the u. S. War on terror in that country. Of course the situation has been worsening in recent months as we have seen. The u. S. Ally there, the government of president hadi pushed out by the Houthi Rebels who took control of the capital and other areas. The u. S. Really wants that ally in its war there against one of al qaedas strongest franchises al qaeda and the asian peninsula, aqap that has used yemen as a base. And this news fred is coming a day after we saw the devastating attack yesterday in sanaa on the shia mosques, hutha mosques, a sec taran war, Something Like we have seen in iraq and syria. And that those attacks have been pur pore deadly claimed by isis claiming it is not only aqap operating in that country but now seeing that emergence of isis possibly there. Gosh. All right, thank you so much in baghdad. Were also following new developments on the terror attack in tunisia. Reuters is reporting that tunisia authorities have arrested more than 20 suspected militants. A gunman opened fire at the bartow museum killing 23 people in total and led to a nationwide security crackdown. Earlier officials said two suspects received weapons training at camps in libya. And in a new audio message, isis is claiming responsibility for this attack. Cnn cannot independently confirm the authenticity of the message, but it is troubling, nonetheless. And back in the states an incredible story out of new orleans. Police shooting a man who was threatening tsa agents with a machete and bug spray. Travelers were sent scrambling as 62yearold Richard White stormed a Security Checkpoint and at one point an agent fought back white and his with that machete machete, and with a piece of luggage. Thats when a Police Officer opened fire shooting white in the leg, chest and face. Reporter a chaotic scene at new Orleans Armstrong international airport. An injured tsa officer is wheeled away on a stretcher after police say a machetewheeleding man attacked security staff a concourse checkpoint. He walked down the tsa preline, encountered the tsa officer, who was checking the boarding passes with the scanning machine to be scanned. He was challenged at that point in time by the tsa officer. The response was he pulled a can of wasp spray and sprayed the officer in the face. Reporter police say the suspect, identified as 62yearold Richard White, then encountered two more tsa agents and started swinging a machete. The incident apparently continued through the security area until the suspect was shot three times by a Jefferson Parish sheriffs deputy. White was taken to a hospital for surgery. Police say a shot from that sheriffs deputy also hit a tsa officer, who was being chased by the suspect. Her injury was not lifethreatening. The incident sent passengers and airport workers scrambling to safety and closed the airport for a short time. Police do not have a motive in the attack. We dont know whether or not this individual was a member of the traveling public. We suspect not. He has been a taxi driver. He has recently received a chauffeurs license. Has little or no criminal history. All right. For more on these three top stories, lets bring back former fbi agent, former navy s. E. A. L. Jonathan gillian. Lets begin with the attack at the new orleans airport. Can you ever you know really prevent Something Like this from happening . Well i do believe that you can prevent a lot of this stuff. Were not going to lay out auto the preventions right now in these few minutes we have. But i can tell you the awareness and having different protocol as to where people are scanned and how far they can move into the airport, i think we have come so far now to the point where all attacks that have happened in the United States at an airport, whether by a mentally deranged individual or someone who had terroristic or nefarious intentions always happen basically where you check in or at the area where the security is located. My real fear with terrorists is that downstairs where you come and get your bags where you have literally 2 to 300 people gather at one time that theyre going to hit there. There is no security there. Either way, what youre seeing in airports is your biggest nightmare in these soft targets that there are large congregations of people that gather either because theyre backed up in security or theyre getting a bag. These things im telling you, fred ive been a part of a group when i left the air marshals we went around the country looking at these different soft targets. You know a lot of these answers are already there. But policy keeps them from enacting the correct procedures and security awareness. Mindboggling, but thats absolutely true. A lot of times, its just policy. Wow. Your expertise runs the gamut from a usair marshal and u. S. Navy s. E. A. L. Lets switch topics and talk about overseas particularly in yemen, when youve got 100 American Special Operations Forces now evacuating and they represent the last of u. S. You know military there in yemen. How concerning is that to you, and what does it take to evacuate them . Well it takes a lot less to evacuate them than it would say Embassy Personnel, because the way special forces in the military in general works, is that theyre very efficient at going in and coming out of a country. And you know fred one of the things you have to look at just like im looking over my shoulder behind me here this is spring now. Were in spring. And things dont look like we think they should look like. A lot of the times when you see these military operations and you hear that special forces is moving out, it may not be exactly what it sounds like. I mean is there a ship right off the coast . Are they going theyre actually staging somewhere else or are they completely getting out of yemen . If thats the case the mission in yemen is over. And i cant believe thats the fact. I mean theres still sources that are in yemen, agency still running, you know covert operations im positive. And special forces will have a leg in there, somehow, some way. Dont you worry if the situation is deteriorating as such and calls for this evacuation how will it ever be stabilized enough to return to continue the kind of progress or continue the kinds of Counterterrorism Missions that were being carried out there . Well stabilization is not really a word that goes handinhand with yemen, first of all. And i think, you know we have our footprint in there, and i dont really think it matters a lot whether our footprint is just off the coast or if our footprint is you know at the airport. As long as we maintain the sources and the whether it be human sources or Different Technology allows us to see whats going on. I just think right now there is a sectarian war going on. And it does alarm me a little bit the fact that the overall war on terror really does not and this doesnt just have to do with our government. All the governments need to realize, this is a global war. And i dont see an effective plan that encompasses this whole thing. Lets talk about tunisia, and Authorities Say there has been an arrest of some 20 people as it relates to that terror attack involving people getting off that bus. Isis has promised number one claiming responsibility for that. And isis has been promising that soft targets will be its mission. How can any country really ensure the safety of anyone as they travel particularly when you talk about these soft targets or places where large gatherings of people will converge . We used to have a group that was mainly used by the dod, but called red cell a group of s. E. A. L. S that right after s. E. A. L. Team six, they were created. And basically what they did, they lived exactly like a terrorist unit inside the United States planning attacks on dod installations. And, you know they were very efficient at finding where the vulnerabilities of these even hardened targets were they could exploit. I think there needs to be another team like that. I run a consulting firm. They either need to reach out to contractors, to develop this team or they need to develop inside the dod again. Because heres the facts. You could build a thousandfoot wall and put hundreds of soldiers around the compound. I am going to figure out a way to manipulate your vulnerabilities to get in there. And i think we saw it in benghazi at the cia compound. They had security there. It was you know kind of secret. But they just simply went in got somebody in there, and paced off how far they needed to throw a mortar and hit the building. And thats where we had two s. E. A. L. S killed working as contractors. A bad guy and Unconventional Warfare which we call terrorism is not a criminal. Hes not looking to get in get something and get out. Hes log looking to kill or cause terror. And thats totally different. We can defeat that if we forward think them, and we start putting the policy just like the airports we start identifying the soft targets, where the vulnerabilities are, the avenues of approach and developing the procedures to counter that rather than just going off of policy that you know makes people look good or comfortable. Senate dysfunction is part of it. But part of it i think, is just stubbornness on the part of republicans to move nominees period. They say theyre holding up her nomination until they get to this Human Trafficking bill with a controversial abortion provision in it. Would you encourage democrats to let the bill go through so you can get a confirmation . You dont hold attorney general nominees hostage. For other issues. This is our top Law Enforcement office. Nobody denies she is wellqualified. We need to go ahead and get her done. Lynch was nominated more than 133 days ago, and only one nominee ever took longer to confirm, president reagans nominee back in 1985. The democrats then controlled the senate, and took more than a year to confirm him. Im joined now by cnn politics Senior Reporter steven cullenson. We heard some democrats claim the delay to confirm lervelg lynch is racially motivated. What is really going on here . Whats really going on is this is one of the first clashes between the republicans and the democrats in the new senate on exactly how the senate is going to be run. Mitch mcconnell and the Republican Leaders says hes not going to bring up the Loretta Lynch confirmation until we have a bill passed on Human Trafficking. You might think that Human Trafficking is one issue that even the senate could agree on. But thats not the case. The democrats are complaining that republicans have inserted some language on abortion which they object to. So it hit a stalemate. Behind the scenes whats happening is republicans are determined that the democrats arent going to hold their control of the Senate Majority hostage. Democrats have an incentive to gum the whole works up to make it difficult to pass anything so in 2016 they can go to voters and say these guys cant run the senate hand it back to us give us the presidency in 2016 because republicans just cant govern. So its a much wider clash than just know over Human Trafficking or president ial nominee. Get is also can they not multitask, can they not doctors both issues . Everything is held up because they cant agree on one matter . Why cant they move on to the other matter resolve that and go back to what they are trying to resolve . Thats what democrats say. And the senate is actually going to move on to considering a budget as well next week. So were going to have even more of a logjam going on. I think eventually well get a vote on Loretta Lynch because democrats want to get her confirmed. You heard how the president there in that interview really wants to get her confirmed. Eric holder attorney general, wants to retire. So eventually its going to happen. Right now, both democrats and republicans both have an incentive to not have this vote and to blame each other. A ferocious fire this morning took the lives of seven children and they were all siblings. Ranging from ages 5 to 15. The childrens mother and her 14yearold daughter did manage to survive, only after jumping out of the window to escape the flames. Last hour new york mayor, bill de blasio addressed reporters after he toured that burnt home. So this is a tragedy that has very few examples for us to look at. Its so painful, its so difficult. It is unimaginable what you see in there. You can literally see what was a home for a large and Strong Family and now it is wiped out. Every room empty and burned and charred. And you can only imagine that this beautiful, vibrant family 24 hours ago intact. And now so many lost. Cnn correspondent Shasta Darlington is with us now from brooklyn. Heartbreaking situation. Bring us up to date on where this investigation goes, and how the surviving mother and daughter are doing. Reporter well fredricka, what we know is that the fire started in the kitchen shortly after midnight. There was a malfunctioning hot plate. Hot plates are used pretty widely among the orthodox Jewish Community to keep food warm. The fire spread quickly up the stairs. And according to the commissioner no functioning smoke alarms on the first or second floor. So the fire just consumed the second story. As you mentioned, the mother and her 14yearold daughter were able to escape by jumping out those windows. But her seven other children between the ages of 5 and 15 were all killed by the blaze. One girl was killed right here on the spot. The other at the regional hospitals. You can imagine how devastating this was for the firefighters. There were some 100 people on the scene, desperately trying to save these children. And obviously, at the end of the day, to see that so many of them didnt make it has been very difficult for the new York Firefighters here. What we also heard from the commissioner a short while ago is that they have located the father. They werent able to initially, because he was away at a conference. Kppa delta roe is the latest to be accused of bad behavior. The local chapter has been suspected suspended after allegedly posting photos on a private Facebook Page. Some of them the girls passed out. Here is cnns sara ganim. Reporter more than bad fraternity behavior this could be criminal. Police are investigating the Kappa Delta Rho fraternity for these photos members allegedly posted to an invitationonly private Facebook Page. Photos of women who appear to be passed out, partially naked. Others in compromising embarrassing positions with comments from brothers like this one, lol delete those or we will be on cnn in a week. Well here you are. We are looking for any victims, any potential victims to come forward and contact the State College Police Department and come forward so that we can do one of two things. We can aid in the identification of any perpetrators that will aid us in the investigation and prosecution of anybody responsible for these despicable acts. Reporter police say some of those responsible are current students and some are alumni. And its one of those alum who blew the whistle, going back to police with screen shots like this one depicting a naked woman passed out. Police say other photos show elicit drug sales, and this one of brothers showing their bare butts. Police say its a hazing incident. The fraternity was swiftly suspended for a year penn state saying the conduct was, quote, highly inappropriate and appalling appalling, offensive, and inconsistent with values and expectations. Its just the latest example of a fraternity exposed for bad behavior. This week the university of houston suspended five members of sigma kai after hazing allegations surfaced. Police are also investigating that to see if criminal charges are appropriate. Pi epsilon shut its doors last year at the university of mississippi, after three of its members draped a confederate banner and placed a noose around the statue of the schools first black student. And this horrifying video of members singing a racist chant led to the shutdown of the sae chapter at the university of oklahoma. The national sae organization announced an initiative to combat Racial Discrimination and insensitivity among its members. We started a comprehensive investigation of all of our chapters to determine if any others have engaged in behavior similar to what we saw on the video from our former chapter at the university of oklahoma. Reporter sarah ganim, cnn, new york. So what is going on on College Campuses today . For a bigger conversation im joined by neil irvin, executive director of men can stop rape. Plus attorney and radio personality, mo ivory, and sam jana a senior at Penn State University, and editor in chief of the schools newspaper the daily collegeian. A member is defending the frat saying a photo of someone passed out is just and im quoting that person satire. No harm meant. Just kind of open season. So is this comment kind of indicative of what a lot of young people on campus seem to believe . Im not sure that thats exactly what it most students here believe now. There is a lot of discussion about that article and that anonymous student after the article was released. What was the conversation like after that . A lot of people think he doesnt know what satire means. Our Editorial Board heavily criticized that speech for just basically ignorance. Hmmm. And is so you know mo a lot of parents are hearing this you know their kids are either in school or maybe like in your case youve got a 16yearold and youre thinking about colleges looking at them now. What do you suppose, you know are the worries now for parents and their kids who go off, youre proud your kids are going off to college and they are met with all kinds of Big Decisions . But these are not good decisions, clearly. No, absolutely. And i think parents have always been worried about what will happen to their kids when they go to college. But it was things like will they not go to class and drink too much and do sort of the normal Things College students do. I dont think parents worried nude photos of their child would end up on social media, because we didnt have it before. I think its a total i think first parents have to talk to their children about the realities of what are going on. I did talk to my daughter about the sae thing. I did talk to her about the penn state. And i did talk to her even about uva and what was happening. She had an invitation to come to uva for prospective students. And i really told her, im just not sure thats the environment i want you to be in. But can she really escape that environment . Probably not at any college. But i think that you have to talk to your children about the idea that for example, i think privacy has gone away. Like students just dont have a sense of privacy anymore. And what privacy means. Not only for themselves but for other people. Because were in such a world of sharing. So they think if i take an embarrassing picture of you, i can go ahead and blast it out to everybody. And they dont understand the ramifications of that. So i guess thats part of concern, too, neil is what is the environment now . I mean is this representative of the environment on College Campuses or the environment as it surrounds fraternities that were talking about a callousness, insensitivity, maybe even entitlement, neil . How do you see it . I think all those characteristics can play out for some who are part of a College Campus college environment, or part of a fraternity. And so i dont think in these moments where we have found me not being a member of a fraternity i dont think that we can in these moments where we find this behavior and we all think its deplorable it has to be held accountable, we have to do away with it. There are so many others. Lets remember that someone put that video out for us to find. An alum told on the images that were there. And so i think there are many within the culture, within the campus culture, that are actively working to hold people accountable, and to change it. What we would like to see is more of that. What we would like to see is more men seeing this both as active members, as alums to chapters but even if youre not in greek life its not only in greek life where were seeing these kinds of attitudes. And i think youre right, fredricka. Entitlement play out where we think we can do what we want to do and that we are not accountable to anyone outside of these walls. Right. So i think there is a lot to do. While its commendable that one or a few have decided to speak out, i guess, sam, the worry is is there a level of complacency that those who were engaged in this kind of behavior felt like the tone is right, the environment is okay it will accept this behavior im not alone, there is a private Facebook Page in which to view these images of these young girls. So sam, talk to me. From your level, theyre on campus interacting with your colleagues there. Is there kind of a sense of we can get place here in this environment that maybe wouldnt be acceptable elsewhere, and lets just try it . Im not sure. I think a lot of the problems we have seen like this have been within the Fraternity System. I agree, its not that but i think were holding these people accountable. Weve students here who held a rally at our Administration Building yesterday, pretty much demanding that these students are immediately suspended. That the one who posted these photos. So there is a high level once we find out applauded for doing that. We sort of like once we is thats the bad thing. Instead of somebody that was trying to break down the system. The allure about pledging to a fraternity. Why did they do it what is it that you know brings them to a fraternity or to the whole, you know pledging process . Sure. Well im not a member of a fraternity myself. [ no audio ] real quick, you pledged as a college student, i have plenty of friends who did. I never did, but i understand why people wanted to pledge. Has the reason behind it changed . Certainly, im sure. I want to say that for sure many of the i cant speak for the majority fraternities but in the historically black fraternities and sore rorties, its been about the service, improving community, about scholarship, about being the best student you could be. When things like this happen do you think that kind of blemishes, you know absolutely. The social is supposed to be the most minimal part of it with the most part being the service. About 100 special Operations Forces are leaving the al ahad air base with concerns of the security deteriorating. Our cnn correspondent is joining us now from baghdad, so troops are leaving the embassy emptied out, whats left . Reporter well thats the big question here fred now, we do believe from these sources that these are the last of u. S. Forces that were present in that country, but, of course Counterterrorism Operations especially in yemen, its been surrounded with a lot of mystery so it is unclear whats left yet, but weve heard concerns over the past month. You mentioned evacuation of the u. S. Embassy and staff there last month, and this is not only with the u. S. Losing presence on the ground but it also lost an ally the government that was in u. S. Ally that help the u. S. In its fight against terrorism in that country has also been pushed out in recent months by the rebels who are not necessarily an american ally either. One of the main slogans is death to america. This in a country where the United States has been targeting the leadership of al qaeda in the Arabian Peninsula, aqap using yemen as a base. Theres been a lot of concern about the political instability in the country, that security vacuum were seeing and concerns about al qaeda there, one of the strongest al qaeda franchises in the world, really exploiting this security situation and instability in the country to really consolidate its presence and become a greater threat, not only to the region but also worldwide, and, of course we are hearing this news of the evacuation fred after that devastating attack a number of attacks yesterday. We saw on a she ya mosque sparring fears of a dark chapter in that country beginning now with the possibility of a sectarian conflict there between the sunni and shia. The attacks yesterday were claimed by isis reported by. Now, its unclear, we cannot confirm, but if thats the case, theres concern, about what it means, emergence of isis in yemen. All right, thank you so much there in baghdad. So what does it mean for u. S. Operations in the region . I want to bring in colonel shaeffer best known for criticism of intelligence failures leading up to the 9 11 attack so you actually say you saw this kind of thing coming in yemen weeks ago including the mosque attacks. What were the signs to you . Clearly, ungoverned spaces are the magnet for terrorist organizations. Afghanistan and somalia were all used by terrorist organization for essentially training operational planning, and support. This is where weve seen the slippage rapidly occur over the past six months and i think it was four weeks august here on the show with you we talked about the fact that i felt that isis would very quickly move into the space, and sure enough here we are, four weeks later, there they are. Most thought it was going to be aqap that would dominate there in yemen, but now it appears isis is giving it a little competition or should we even be thinking of them as separate entities . They share ideologies although they are different names. I think what we can consider is isis is a very effective virus who anything they touch they take over. We see now boek ha rom pledging allegiance to it and isis is in information, told by Senior Pentagon officials, the concern in afghanistan is not the taliban, but isis trying to recruit and radicalize there. Lets be very clear here. Isis is out for itself. It essentially is trying to emulate the empire. Thats what they are trying to do. Theres an effective strategy executed to sub soon the effective elements of al qaeda. As the reporter said in the runup to the interview, al qaeda on the Arabian Peninsula is known as the most effective element of al qaeda launching operations expedition operations overseas. This should be a great concern to everyone. You heard our reporter talk about how the u. S. Has lost an alily in yemen now. Right. How much a setback, how devastating is that as the u. S. Tries to participate in stabilizing that region . This is hugely bad, president obama stated in the speech how he wanted to see iraq, you know stated how successful yemen model is. I cant fully blame president obama. He has a completely ineffective staff, ambassador susan rice and ben rhodes are horrible National Security advisers not understanding whats going on in the regions. Its not that we dont have professionals who understand whats going on. Its just you have people at the top, at the National Security counsel sill not letting the pent gone cia, and other elements to do their job to advise the government correctly on this. At the same time al qaeda is growing, boko has horam, and the shared ideology is that the u. S. s fault . Not at all. I think what we have to be leerclear on, again, as i mentioned in the beginning, ungoverned face spaces are key. Anywhere isis finds haven, syria, iraq, anywhere theres ungoverned spaces thats where we need to be concerned. We talked about the idea we put forth about putting together an arab nato a Red Sea Treaty Organization to help reestablish government in the ungoverned spaces. Its not necessary its necessary to defeat them militarily and go forward with the idea of how to settle victory, and that must be by bringing in good effective govern nans in the spaces. To do that you need a nato type organization primarily sunni at this point to establish good order. Thats the issue. We did not create the problem, but we have to work with allyies to solve it. Thank you. Thank you. U. S. Soil an incredible story from new orleans where Officials Say all concourses at the louis Armstrong International airport are open after last nights violent attack. Police shooting a Man Threatening tsa agents and travelers were sent scrambling as 62yearold Richard White stormed a Security Check point and an agent fought back with a piece of luggage, and thats when a Police Officer opened fire shooting white in the leg, chest, and face. Reporter a chaotic scene, an injured tsa officer wheeled away way on a stretcher at a machete wielding man and using wasp spray, attacked security staff in a concourse check point. Walked down the preline, encountered the tsa officer who was checking the boarding passes with the scanning machine to be scanned. He was challenged at that point in time by the tsa officer. The response was he pulled a can of wasp spray, spraying the officer in the face. Police say the suspect identified as 62yearold Richard White encountered two more tsa agents and started swinging a machete. The incident continued through the security area until the suspect was shot three times before a sheriffs deputy. White was taken to the hospital for surgery. Police say a shot from that sheriffs deputy also hit a tsa officer who was being chased by the suspect. Her injury was not life threatening. The incident acceptability passengers and airport workers scrambling to safety and closed the airport for a short time. Police do not have a motive in the attack. We dont know whether or not this individual was a member of the traveling public. We suspect not. He has been a taxi driver recently received a chauffeurs lans little to no criminal history. Every room empty and burned and charred and you can only imagine that this beautiful, vibrant family 24 hours ago in tact and now so many lost. Cnn correspondent is in brooklyn with more. Shasta . Reporter the fire started in the kitchen. There was a malfunctioning hot plate which are widely used here in the orthodox Jewish Community in brooklyn to heat food on the sabbath. Flames rose quickly according to the commissioner. There were no functioning smoke detectors on the first or second floor. We believe when the flames reached the second floor, that that is when the neighbors who live behind them noticed this blaze, and this is what one of the neighbors had to say. I just heard somebody say, mommy, mommy help me through a window we saw everything through the back of our house. The house is in flames. Very heavy, thick, thick smoke. So thick. You saw the flames shooting out all over the place. Reporter there were two survivors, a mother and 14yearold daughter jumping out the second story windows. They survived in Critical Condition in the hospital but the rest of her children all seven between the ages of 5 and 15 were killed by the blaze. One girl was killed right here on the spot and the others were declared dead at different regional hospitals. What the commissioner has said this is a tragedy for the community, but also just devastating for the firefighters on scene trying to save the lives of these children. There were some 100 firefighters here. He also said the mother herself made a vail yent effort to save the children but the flames were too fast. Another detail we just heard, and thats this the nypd has found the father. He was away on conference and did not know about this tragedy so hes been found, and we can only imagine how devastating this will be for him. All right. Thank you so much. All right, the future of the entire Fraternity System at Penn State University is now in question after one of the universitys frats Kappa Delta Roe posted photos of nude and partially nude women on a Facebook Page. The school suspended the chapter for a year and investigation is now underway. Penn states president says the university is considering whether fraternities even have a place on campus. Police say they have not been able to identify any current and former students involved because all of the Facebook Accounts on the page were wiped clean. One frat member who spoke anonymously to philadelphia magazine defended the page saying quote, it was a satire group. It was not malicious whatsoever. It was not intended to hurt begin. It was not intended to demean anyone. It was an entirely satire group, funny to some extent, yes, some of the stuff, yeah raunchy as you expect from college age guys but you can go on, any one of hundreds of thousands of sites to ak says the same stuff, and obviously a lot worse and more explicit. Unpacking this big story, first things first. On the issue of administrative action that the school can take thats clear. Theres a student code that addresses the desemination of material like this without consent of those who you are photographing. Certainly, the school and event they are able to identify the people who did this, and presumably they will there is certainly, you know software to restore different types of computers. The administrative side of it is disciplined under the code. Its dicey moving into the area of criminal charges. Pennsylvania is one of 16 states that does specifically have a law dealing with the issue of posting photos like this but here is the problem. That law is very limited in the following respect. Its a law really that deals with the issue of revenge porn that is youre in a relationship and they are after because you possess material you know that may not be flattering of your the person you dated before you post that. If you are the expartner or current partner, the law criminalized it. However, if you are not the expartner or current partner, the law is silent as to its applicability to the person who is posting, therefore not applying and therefore the other issue to be considered is they have to be posted with the intent to harass, annoy, alarm, disturb disturb, humiliate and degrade. Those are the issues that Defense Attorneys are looking at but that latter one isnt it easy to argue theres intent to harm to embarrass, i mean, nobody would want their photographs, their bodies photographed like this and posted on some public site. Its a beautiful question, but heres the Defense Attorneys argument to potential charges that could be filed. Its a private site, certainly, it should not exist, and we know private site on public domain. Exactly, but you had to be invited into the page. The concern that the defense attorney will raise, theres a couple issues to be raised. First thing is there was a site like this before. That was shut down. Another site, 2. 0, we are speaking about was created, and in order to have aeszccess to the pictures you need to be invited. To the extent this the defense, the argument posed in the event that charges are presented, they will say its a private site. If we intended to harass embarrass, humiliate, et cetera we do it publicly but it was amongst a brotherhood, we did not do so. Thats the argument. Okay. What about the means in which to get the photographs . Apparently theres a former member of Kappa Delta Rho telling the police about the page and went on to say that apparently there was drugs allegedly involved here quoting now, marijuana and edibles, concentrates medication and cocaine according to the affidavit in order to get these women to participate unknowingly in these images. Yeah sure. Absolutely. That makes it a little more difficult because certainly when you deal with issues concerning any types of drugs, you need a toxicology which sub stannuates drug use. Certainly, you can identify a drug a Police Officer can subjectively watery bloodshot eyes odor of alcohol on the breath or some type of intoxication or drug. Without demonstrating that there was such drugs, it may be problematic, but, certainly, the beat will go on. I think that if they dont prosecute under this statute, if they prosecute at all, they certainly could intend not under revenge point statute but on general harassment statutes but the applicability of the statute and law here drugs involved or not, and we dont know it could be highly problematic, and again, pennsylvania one of 16 states well see a number of other states moving forward and as Technology Just burgeons you know were using it in such a different way, and the law is not keeping pace with the level of technology.
