It is a busy morning here in the cnn newsroom. We are following three major stories as they unfold. President obama and the first lady leave next hour for dallas. There they will attend a private memorial for the five Police Officers shot and killed last week. Both the president and former president george w. Bush will speak at the service. Also, this morning Hillary Clinton and Bernie Sanders sharing the same stage again, hitting the trail in New Hampshire less than two hours from now. The Sanders Campaign has been slowly inching toward this unity event. Sources say a clinton endorsement is coming. And just one hour from now, the nations top Law Enforcement officer gets grilled o capitol hill. Attorney general Loretta Lynch will face House Republicans and their questions on Police Shootings, Hillary Clintons email investigation and lynchs controversial meeting with bill clinton. We begin this hour with todays Memorial Service for those five dallas Police Officers murdered by a sniper last week. President obama and former president george w. Bush will also meet privately with the families of those killed and those injured in the attack. Now, the nearby Arlington Police department will handle security duties to help give the exhausted dallas Police Officers a break and to allow some of them to attend this service for their fallen caomrades. Susan malveaux has more on the memorial. Reporter good morning. It is a hot, muggy day here in dallas. As you can expect, you hear the bells tolling in the background. This is going to be a very Emotional Service and really a critical time for healing for this city. Were going to see a number of dignitaries this morning really trying to bring the city and this country together. Later today what were going to see is a number of dignitaries, mayor Michael Rawlings who is going to be talking about the need to recognize these Police Officers and their families. So were also going to see texas senator john cornen. Following that, president george w. Bush and laura bush will be attending and president bush will make some comments as well. We are going to hear from the police chief as well. Brown who has been so eloquent and sensitive and strong in these times for his Police Officers and his community. And of course president obama, michelle obama, the first lady will also be here. What were told is hes been working on his remarks for days now, that he is really taking pen to paper, that this is something that is very personal to him and its important to strike the kind of balance that he needs during this time, sensitivity and strength recognizing the fallen officers and their families but also the call for social justice as well. Thank you. Now as dallas mourns, much of the country seeps. More protests erupted across the country for the fifth straight day and well into the night. Here demonstrators gathering outside the Governors Mansion in atlanta chanting black lives matter. This is what were learning about the dallas killer and the bomb making materials found inside his home. Victor blackwell joins us from dallas with the latest. Reporter some of the strongest concerns about the evidence being pulled out of that shooters home surrounding those materials. Cnn has now learned from multiple Law Enforcement sources that those materials are essentially three and a half pounds of powders, three strait powders found in his home, all perfectly legal, potential bomb making materials though, but also elements that could be used by gun enthusiests. We know something was assembles, no bomb ready to detonate. It appeared this shooter was someone who liked to explode things by shooting them, so perhaps he had an interest in i. E. D. S but this was not someone who had any really bomb making expeers th experti expertise. We also heard from the chief a few words for the protesters across the country. As you said weve seen them for five nights. Heres what chief david brown said to those protesters who have questions and concerns about police practices. Were hiring. Were hiring. Get out that protest line and put an application in. And well put you in your neighborhood and we will help you resolve some of the problems youre protesting about. Weve also heard some very poigna poignant words from the trauma staff at Parkland Hospital where many of the injured were taken after the shooting. And doctors one drama surgeon, dr. Brian williams, who talked about what he was feeling that night and has felt since, but also about the deaths of black men across the country. Watch this. I think about it every day. That i was unable to save those cops when they came here that night. It weighs on my mind constantly. This killing, it has to stop. Black men dying and being forgotten, people retaliating against the people that are sworn to defend us, we have to come together and end all this. Reporter dr. Williams there pairing together the two conversations that we will very likely hear president obama address today as he comes here to dallas. We understand, of course, that he has had some very heavy involvement in writing his comments today, not relying simply on speech writers. Well look ahead to that, scheduled to start at 1 30 eastern. So touching to hear from that doctor. Thank you for that report. Today is a major day for Hillary Clintons campaign in New Hampshire. This is where eight years ago she and barack obama joined forces in a bid to unite democrats after their bitter primary. Today clinton returns to this state, this time as the presumptive nominee and with Bernie Sanders by her side as she looks to win over him and his supporters. Jeff zeleny has more from New Hampshire. Reporter good morning. It has been 35 days since Hillary Clinton effectively clenched the democratic nomination. Ever since then, democrats have been rallying to her side. Shes been campaigning across the country with them. Well, today here in New Hampshire in just a couple hours Bernie Sanders is going to complete that circle, finally going to give that endorsement to her candidacy. You may wonder why it has taken him so long. He has tried to push the Democratic Party platform to the left. Hes fought for things such as the 15 mandatory minimum wage. He did not get everything he wanted in that platform, but he certainly got more than he started with. So today hes going to give that endorsement. You may wonder why it matters at this point, but i can tell you it does. The Clinton Campaign believes Bernie Sanders will be a key ally in this fight against donald trump, particularly in states like New Hampshire. Bernie sanders won New Hampshire by some 22 points. The Clinton Campaign has not been back here since. This is Hillary Clintons first visit to Battle GroundNew Hampshire. They believe Bernie Sanders will be essential here and in other states like ohio and michigan where he also won. So today the endorsement is the beginning of what they believe will be a partnership. And next week in the democratic nominating national convention, he will also have a speaking role to continue his argument. Today for the first time well see them on stage together likely Holding Hands up in the air, Bernie Sanders finally dropping his own race and endorsing his long time rival. Now clintons private email controversy is not over. Its expected to be front and center next hour as attorney general Loretta Lynch is on the hot seat on capitol hill. She faces lawmakers for the First Time Since announcing that Hillary Clinton wont be charged for using that private email system while secretary of state. Her controversial visit with bill clinton came days before the conclusion of this email investigation. We know that the republicans on this committee are not satisfied with the answers so far, that the Justice Department and the fbi have given as to why Hillary Clinton will not be facing charges. As a matter of fact, theyve just sent another referral over there for the Justice Department to do another investigation as to whether or not mrs. Clinton lied when she testified before Congress Last year. Lynch of course is going to have to answer questions as you mentioned about that meeting on the tarmac with bill clinton charging up the stairs to her airplane and having a 30minute discussion with her in the middle of and while she was considering what to do about those charges, about those charges against Hillary Clinton. But it feels like the context has changed a little bit. Last week we had the fbi director james comey who answered four hours of questions in the house. And he explained why he was recommending no charges against mrs. Clinton. And also we have the fact of the shootings in dallas and the ones before that in minnesota and in baton rouge. That also has changed the context of this conversation that youre going to see on capitol hill today. Simply because the Justice Department is part of the evident effort to change how policing is done in this country. Theyve done a lot of investigations of these shootings and of Police Departments and how they do their jobs. We expect there are going to be a lot of questions from republican members of congress as well as democrat who is want the Justice Department to do more about these shootings. And you look at her opening remarks that have been released and it really solely focuses on what the Justice Department is doing on making sure that depending on which race you are you are not treated very differently. At the crux is race. And the shooting deaths of not only africanamericans at the hand of police, but the killings of police themselves. I want you to listen to this interesting perspective we heard from the lead surgeon there in dallas who tried to save these five officers lives. Clearly when im at work dressed in my white coat, the reactions i get from individuals and the officers i deal with on a daily basis is much different than what i would get outside the hospital in regular clothes. And my fear and some mild inherent distrust of Law Enforcement, that goes back to my own personal experiences that ive had over my entire life as well as hearing the stories from friends and family that look like me that have had similar experiences. I dont understand why people think its okay to kill Police Office officers. I dont understand why black men die in custody and theyre forgotten the next day. I dont know why this has to be us against them. With me now is former nypd detective and Law Enforcement consultant tom verney. Protesters say that this is a systemic problem. What do you think can change the way africanamericans like this doctor we just heard from feel when they encounter Law Enforcement . One of the key things, of course, is that theres a fundamental mistrust of Police Officers because of a history of a select few, but also because there seems to be an inability of the Justice System to be able to successfully prosecute those officers who do engage in Excessive Force and tarnish reputations of very good officers. And one of the ways in which we can successfully prosecute those rogue officers is to have a discussion about changing the standard by which prosecutors can hold them accountable. Right now the common man is held to a common and reasonable person standard but officers are judged by only other officers standards. Youre talking about accotability. Tom, i want to talk to you about prevention. Some people are calling for more training for these officers. Do you think thats the answer . You know, im always an advocate for more training. By the way, id like to express my condolences to the family of the officers and thank you to the doctor who attempted to save their lives under tremendous duress, im sure. So when it comes to training, theres always you can never have enough training when it comes to Law Enforcement. We were talking about the fact that we still live in a largely racist, sexist, homophobic society. If thats our society as a whole, then the police are going to mimic a lot of these things we have inherent in our society. So our society need to have a gut check and to kind of root out this systemic racism thats been in effect for hundreds of years. And only then can we really start fresh. You can screen cops all you want, but weve all been socialized to believe certain things about certain people. That needs to stop. And whether you know it yourself, there could be a subconscious level of racism within individuals thats innuani influencing your perceptions and the actions you take when you encounter people. When we have these Police Related incidents like the shooting in baton rouge, like the shooting in minnesota, i always advocate people to try to take a step back, let the facts and circumstances and the evidence come out before weighing in fully to determine what happened. Instead of playing monday morning quarterback and signed, sealing and delivering the cops based on very little if any information. Thats critical. Once all that information comes out, listen, if its found that these cops acted in a biassed or racist way, then you wont find anyone in Law Enforcement that would have a problem with them being fired, jailed, sued and otherwise. When you look at ferguson for example because thats one of the incidents that have caught so much attention and fire with the protesters. And we do know that there was an indictment of darren wilson, the officer involved in that particular case and he was cleared. But the department of justice did find in their investigation racism all throughout that Police Department. And so you look at those types of investigation results. You look at some of the statistics and studies that show black people are more likely to be pushed to the ground and pepper sprayed than their white counter parts. There is factual proof that this is happening. Laura, president obama is going to dallas today. Here he is, the nations first africanamerican president and here we have still this tremendous racial divide that is so raw right now in our country. If he cant fix it, who can . Dialogue is important. But people have to understand its not simply about dialogue. They have to take a threepronged approach. Protest is one way to be heard and get the attention of the media. But there has to be legislative action that takes place. There is prevention but Accountability Breeds prevention. And our Justice System is geared around being able to ensure that we deter bad behavior through accountability in the criminal Justice System. What president obama and other leaders have to do and recognize is this has to be a threepronged approach. It has to be structured in a way that people feel heard and there is results coming. One of that is to be able to have a successful prosecution and for police within to root out internally people who are doing the wrong thing and try to prevent this at their end as well. Still to come, Bernie Sanders says hes with her as he is set to endorse Hillary Clinton today. But what about his supporters . In new york state, we believe tomorrow starts today. Every day since then she has been waiting and wanting an endorsement from her rifle Bernie Sanders. Today that wait is over. Sanders may be coming around himself, but what about his supporters . Gary, if you hear sanders officially throw his support behind clinton, will you follow . Absolutely not. No . Why . Because we know through the process that we understand clearly that neither one of them got the magic number for either one of them to be named the president ial the presumptive nominee. And so we know that any process of that by senator sanders means a forfeiture of his delegates. We dont see that happening today. It doesnt necessarily mean a forfeiture of his delegates, although clinton does have a majority of the pledge delegates as well as those super delegates that are expected to vote for her at the convention. But lets say today Bernie Sanders comes out and essentially withdraws from the race as he is suspending his campaign. Is that different in your mind in Going Forward that would give you that sense of i guess conclusion in order to support Hillary Clinton as a democrat . There is absolutely nothing in the world that would make me vote for Hillary Clinton or anyone of the major organizations who are organizing across this country. There is nothing that we will do to get behind Hillary Clinton. In fact, what we will do is ensure that she will not win this presidency. I want to ask you for about that, but let me bring tracy into the conversation first. We do know that clinton has made efforts to reach out to sanders supporters. Notably she agreed to this 15 dollar federal minimum wage, backing a public option when it comes to healthcare. She also supported tuition free college. Besides a verbal endorsement, what else does she need from sanders . Its true they had been working together alongside other to bringed to ed ttoday to fru. Everyone understands this unity is so important because of what the choice in this election is. While i support any individuals personal decision to cast a vote, i do think that the responsibility that any voter bears in electing or voting for donald trump is an astonishing thats a personal choice. Ill just leave it at that. But in the meantime i think we can see senator sanders and secretary clinton continue to Work Together as they have. Those are really important strides that you noted. And i think theres more of that that well see. Most importantly, we know that over 85 of senator sanders supporters have already said they will vote for Hillary Clinton. So now the focus is on this general election and the choice for Hillary Clinton or donald trump. So tracy, are you just writing off supporters like gary who say right now theres no way hes going to vote for Hillary Clinton . Absolutely not. Again, i do respect the choice of my voany voter. I also respect the fact that we had a contested primary. Its about getting to the point to make that choice. So certainly we hope that her numbers continue to rise. We hope that her supporters grow and that senator sanders, his support and the support of so many of his own people will cause people to really think carefully about ultimately joining the unified Democratic Party. We know donald trump would like to see some of the sanders supporters come join him. In fact, just as this show was Getting Started here today in the last half hour we heard from the Trump Campaign who released the top five reasons sanders supporters will never be excited about Hillary Clinton. He talks about clinton backing in his words virtually every trade agreement that has cost the workers of this country millions of jobs. He says shes in the pocket of wall street. He calls clinton equal to the establishment. Are these the reasons you wont back Hillary Clinton . Is this the root of your angst, gary . Thats mainly what it is. I mean, and then primarily because we continue to see what the urban communities across this nation that we are always the ones who are left out. These folks show up and they want our support and votes. They want us to support them. But when elections are all said and done, it does not benefit those who are in the disenfranchised communities. Do you support trump . Definitely not. We would explore our options for a third party candidate. Were not coming back to the Democratic Party. You cannot expose us to the corruption of the Democratic Party and ask us to gets back in line with that same corruption. Its just not going to happen. Absolutely. Those are options that we will definitely explore. We have third party options. And we understand the way the game is played. We know right now that we are the ones that are in power. And i want to correct her. You dont have 85 of sanders supporters. We have 55 of the supporters in this country that say they will never vote for Hillary Clinton. Thats where we are at with that. He actually matched the description of an Armed Robbery suspect. Now he was shot last week and killed during a traffic stop. His fiancee streamed the aftermath of the shooting on facebook live. Well hear from his family in just over an hour from now. Also, weve learned theyve hired tv judge linda hatchet as their legal counsel. The east baton rouge District Attorney has reaccuse recused himself from the case citing a possible conflict of interest. Cnns Boris Sanchez is joining us live in baton rouge. That store owner has now filed a lawsuit against police. Reporter thats right. That lawsuit, some serious allegations. But you mention the east baton rouge District Attorney recusing himself from the case, essentially saying hes simply too close to the family of one of the officers involved in the shooting. He says that they have gone over more than 400 homicide cases together and his father is part of the security detail charged with making sure that the District Attorney is safe. So in order to avoid any Public Perception that perhaps he was partial in this case, hes simply stepping aside for this one. He said he warned officials very early on it was a possibility that he would recuse himself. The other thing thats breaking news is that security footage from the triple s mart, calls growing louder for that footage to be released an attorney obviously which is a legal right here. Aside from that, we called the baton rouge Police Department about this lawsuit. They did tell us that the security footage has been handed over to the department of justice. Are you surprised at all . Well, the line has been pushed and pushed throughout this entire election season. Consider the fact that donald trump said hes going to look for a justice to go after Hillary Clinton. So we have also the past with Justice Scalia giving speeches in private scenarios where he piece been very critical of the obama add straks. This is actually just stating that she believes shes uncomfortable, but didnt say she wouldnt follow the law. Right. But is it really appropriate or even ethical for her to say these things . I think its unusual. The u. S. Supreme court is supposed to be very objective. They supposed to maintain a poker face and wait for these cases to reach them. I think this whole conundrum were in right now is based on the fact that theres been this mishmash of politics with the conservative side of the court and the liberal side of the court so that this was inevitable i would believe. You talk about the importance of objectivity with our justices. What if trump is elected president . Could these Public Comments she made be grounds for recusal from certain cases . I dont think it would be grounds for recusal from certain cases because we know that scalia, Justice Alito as well as chief Justice Roberts were not fans of the obama administration. They made clear of that during the many oral arguments i witnessed. I dont think its grounds for recusal, but i think its making people feel very uncomfortable. The u. S. Supreme court is the only branch of government that has a decent approval rating. At this point irt might start falling as well if Supreme Court justices continue to make these type of comments. We know theyve come from Justice Thomas wife, Justice Alito shaking his head no during the state of the union address. Were pushing the envelope with our court and i hope does stop soon. I think one of the issues in this particular incident is, what if, again, trump is president and she votes against some of his policies, could it put potentially Supreme Court rulings into question . I dont think so, and ild tell you why. The affirmative action case of fisher versus texas as well as the Voting Rights cases, these are cases that were known to the justices back when they were attorneys. They took a stance against those particular legal issues and those laws years before they ascended to the Supreme Court bench. So their opinions are known. Having an opinion is not the same thing as saying that youre not going to follow the law. I think theyre different. As you pointed out, it does make one uncomfortable. The Justice Department is not only investigating some of these shootings, but also doing a lot of work to try tone courage better policing tactics around the country. You can expect a lot of conversation about that and not only criticism of what the Justice Department has done in these investigations, but also pushing for more work pour the Justice Department to improve policing around the country. Ana . Were looking at live pictures as Loretta Lynch gets ready to testify before the house and judicial committee. Lets talk more about this. Joining me is john brownstein, cnn political analyst, art broad are rick, laura coats and malika hernandez. We know lynchs relationship with the clintons has been called into question. She took the fbi recommendations to not charge clinton. She met privately with bill clinton days before the investigation wrapped up. Shell be asked about all this today. Do you expect it to change . I dont think so. If you look at this, the entire arc of this episode, it has taken a toll on Hillary Clintons public image. Doubts about her honesty, about her judgment. It is has really left a bite on her. What youve got is a situation where republicans, frustrated the fbi is not proceeding, are going to look for every possible way to keep this story in foreground. I look at this as one of those many fronts, like asking for a Justice Department investigation relationship with congress, question her relationship with the meeting with bill clinton. The paul ryan trying to deny her. There will be a cessation of these kind of issues through november. This may be her single biggest vulnerability. As ron just pointed out, Republican Leaders in the last 24 hours officially asked the Justice Department to open a new investigation as to whether Hillary Clinton lied under oath when she said she didnt send classified material when shes talking about emails from the private server. Do republicans have anything to lose by dragging this out . Absolutely not. I think the upside for republicans at this point, as we are entering a very contentious and partisan president ial election season with november coming up and polls showing that Hillary Clinton is leading donald trump at this point, i think youre going to hear about this ad nauseum really. As ron pointed out there, youll hear about this in campaign ads, hear about this certainly from donald trump in almost every speech he gives, he already mentions it. This goes to Hillary Clintons primary argument about her cant da see which is she is the one that is experienced, she knows what it means to be president. She has the judgment to be president. So then you have this investigation coming out clearing her, but also raising questions about that. I think youll hear comeys comments from his initial press briefing and some from the hearing as well in ads and whatever comes out of these other hearings, Loretta Lynch and the additional calls from republicans to keep poking around. Kind of teeing up to what we expect to hear, the chairman of this committee, bob goodlet says no one is above the law. And Law Enforcement is taking her actions seriously, that she is not above the law. I wonder asking you, art, do you think it appears that Law Enforcement has taken her action seriously. We did hear the fbi director testify that she did send classified information. Director comey is a straight shooter. His explanation of why theyre not pursuing any charges rings true for me. Theres two sides to this. Theres the criminal side and then theres the administrative side. If secretary clinton was still working for the government, she would more than likely lose her clearance. I had the same type of clearance for about 15, 20 years when i worked at Homeland Security and at the department of justice and with the u. S. Smashmarshall. Based on her description of being extremely careless, she would lose her clearance. If it was me, i would have lost my clearance. I think her being the secretary of state, she should very well know the most of the information she deals with is classified and should not be shared with foreign governments. I think really what it comes down to is i accept director comeys explanation as to why theres no criminal charges. The other issue, she no longer works for the government at this current time, but she definitely would have lost her clearance zb as we are watching the live pictures right now from inside this house chamber, there you see attorney general Loretta Lynch getting ready to take her position. We saw her shake hands with chairman bob goodlet as shes getting ready to thaek their questions. We expect her to deliver opening remarks regarding the police shoot tngs and what the Justice Department is doing and what happened in baton rouge with alton sterling. We welcome everyone to this mornings hearing and oversight of the department of justice, and i will begin by recognizing myself for an opening statement. Welcome, general lynch, to your second appearance before the house Judiciary Committee. The flags over the capitol are flying at half masta in recognition of the five dallas Police Officers murdered in cold blood last week. This was not an arrest gone wrong. The person who carried out this appalling act of terror and hate stalked and murdered five Police Officers and injured seven others and two civilians ostensibly in retaliation for recent Police Shootings including the shootings in minnesota and louisiana last week. We mourn all those tragedies. The divisiveness between police and our communities must end. I ask we observe a moment of silence for all those who lost their lives in these tragedies. Thank you. We must not give in to hate and lets motion prij reason. We must bridge the divide and embrace one another as americans. We must have faith that the institutions that have sustained our republic for the last 240 years will deliver fair, impartial justice to victims of crime and punish the guilty. I look forward to your thoughts on this important matter. The American People also expect government officials to abide by the law just like everyone else, and to be reprimanded when they break the law. Thats pretty much the case from former secretary of state Hillary Clinton. Last week fbi director james comey announced he would not recommend criminal charges against secretary clinton for her use of a private email server while at the state department and the mishandling of classified information. The timing of and circumstances surrounding this announcement are particularly troubling. On monday, june 27, attorney general lynch, you met privately with former president bill clinton aboard your plane on the tarmac of the phoenix airport. Despite the fact that his wife was the target of an ongoing criminal investigation. This encounter is even more troubling if the fbi is also investigating improper donations to the Clinton Foundation which was founded by former president clinton, a member of the foundations board of directors. Five days later, the fbi held et cetera first and only interview with sk tear clinton after a yearlong investigation. Three days later and on the first day back from a holiday weekend, director comey publicly announced that he was not recommending charges against secretary clinton. A mere 24 hours later, attorney general lynch, you issued a press release announcing no charges would be brought against secretary clinton. While director comey may have refused to criminally indict Hillary Clinton, his announcement and testimony is nonetheless a public indictment of her conduct and character. Though director comey declined to recommend charges, he laid out sufficient facts to warrant a referral to the Justice Department. That forces one to confront the question of whether someone who was not in secretary clintons position would have faired as well with the fbi as she did. Secretary clinton stated repeatedly that no classified information was contained within her private email system. The fbi found 110 emails in 52 email chains contain classified information at the time they were sent or received. Secretary clinton stated repeatedly that no information in her emails was marked classified. This was not true. The fbi found some of these emails were marked classified. Secretary clinton said all relevant emails were returned to the state department. This is not true. The fbi found thousands of workrelated emails that were not returned. All this evidence, according to director comey, amounted only to, quote, extreme carelessness by secretary clinton and her staff. And although the director admitted there is evidence of potential violations of the statutes regarding the handling of classified information, he went so far as to publicly declare that, quote, no reasonable prosecutor would bring such a case. This defies logic and the law. Contrary to director comeys assertions, the law does not require evidence that a person intended to harm the United States in order to be criminally liable for the mishandling of to be sure, congress has set forth a variety of statutes on this subject with different intent requirements and penalties. Were a rankandfile federal employee to do what secretary clinton did, they would face severe punishment including termination, revocation of security clearances or criminal prosecution. Even director comey acknowledged this fact at a recent congressional hearing. But secretary clinton is not facing prosecution for her actions. This has now become an issue for congress in that it appears secretary clinton testified falsely when appearing under oath before the select committee on benghazi. Yesterday i and oversight and government reform chairman chafe fets asked the United States attorney for the District Of Columbia to investigate secretary clintons testimony before congress. Secretary clintons extreme carelessness possibly jeopardized the safety and security of our citizens and nation. Her extreme carelessness suggests she cant be trusted with the nations most sensitive secrets if she is nevertheless expected president. Frankly, the fbis conclusion leaves many more questions than answers, and we hope, madam attorney general, to get answers to those questions today. Thank you and its now my pleasure to recognize the Ranking Member from michigan, mr. Conyers for her opening statement. Thank you, chairman and welcome madam attorney general for being with us today. The news of the past few days have been full of questions about violence, civil rights and the safety of our Police Officers. I want you to know that we take seriously the burden of each of these questions on your office. It will not have escaped your attention that were in the middle of an election season. You may also know that there are just three working days left until we break for the summer and really not much more time after that until the congress ends. Elections are about choices, and a short working schedule is about seth priorities. As you are no doubt aware, one of this committees top legislative priorities is criminal Justice Reform. Weve already found consensus on a range of such issues including sentencing, prison and Asset Forfeiture reform. The chairman of this committee and i also stand on the precipice of an agreement on policing reform legislation. Given the events of the past week, the need for this measure has never been more urgent. Questions about the use of lethal force by police are not new, but the nation is newly engaged, and the issue after ferguson, staten island, cleveland, North Charleston and baltimore. Over the past week, we saw the same sad themes play out in baton rouge and minnesota as well as the horrific killing of five Police Officers in dallas. I believe its more critical than ever that we reach a final agreement on Police Accountability and standards. At the time when africanamericans are 30 more likely than whites to be pulled over while driving, more than three times likely to have their car searched and more than twice as likely to be shot by police, it is imperative that we restore public faith in our criminal Justice System. We must finish this work for both the communities that feel so much anguish this week and for the officers who patrol our streets every day. Its my sin tear hope we consider this matter before we adjourn. Unfortunately there are many other areas where we are not been able to advance bipartisan initiatives. Id like to tell you that we are prepared to have a substantive discussion about the manner in which we will restore section 5 of the Voting Rights act. The pre clearance mechanism was used for decades by your department to restore a sense of fairness in jurisdictions that have known prejudice for generations. Since it was struck down, we have seen at least 17 states enact measures designed to restrict access to the ballot box. Bipartisan legislation has been introduced that would have restored this vital tool long before voting began this year. But mr. Sen sin burner of was cons legislation sits untouched. I would also like to tell you that we are prepared to address the discourage of gun violence in this country. The events last week in baton rouge and minnesota and in dallas and the anger and sadness felt in communities across the nation are what one commentator aptly called the horrific predictable result of a widely armed citizenry. This epidemic claims nearly 33,000 individuals every year. It inaffects our churches, our schools, our homes. It places our Police Officers into the direct line of fire. It makes our citizens afraid, but weve not held a single hearing on this topic, not when 26 children and teachers were murdered at sandy hook, not when our colleague was shot in phoenix and not when the body count reached 49 in orlando. Last month every democratic member of this committee wrote to our chairman goodlatte with a list of specific policy proposals to address this violence and, to date im sorry to say we have received no response. I would also like to tell you, madam attorney general, that we have an answer for the millions of undocumented immigrants who came here in search of a better life but weare forced to live i the shadows. Some of us have put a great deal effort into antagonizing and vilifying that community. This community has offered very few solutions acknowledging that these families are here to stay. Elections are about choices, madam attorney general. There are only three working days, some count it less, left this month, and then we adjourn for seven weeks. How will my colleagues on the other side of the aisle choose to fill that time . Today apparently secretary Hillary Clintons email takes precedence over gun violence and civil rights. Let us be clear the criminal investigation is closed. There was no intentional wrongdoing. Director comey whose reputation for independence and integrity is unquestioned has explained his reasoning in great detail. If any of my colleagues are not yet convinced, it is because they do not want to be convinced, and in their zeal to call secretary chin ton a liar or maybe even a criminal, despite the fact and despite the law, i fear we will have maisse an opportunity to engage with you on more worthy subjects. We may also spend time today talking about the alleged wrongdoings of commissioner cosco anyone of the Internal Revenue service. Some of my colleagues want to use one of the remaining working days before the break to move his impeachment directly to the house floor. I hope they do not. In many ways this gesture is totally meaningless. There is bipartisan consensus that the commissioners critics have not proved their case and there is virtually no chance of a conviction in the senate. But i believe that the rush to impeachment although ineffectual would set a dangerous precedent for the congress and the American People. Once we cross this line, e with write a new rule. Whatever the merits of the charges the house may impeach an official without due process, without the right to counsel, without the right to present eviden evidence, without evidence presented to this committee and without the right questions of the evidence presented against him. Elections are about choices. Here is the choice we face as the clock runs down on the 114th congress. We can spend a few days that remain on conspiracy theories and political snipe iing that drives our constituents further apart from our neighbors, or recan attempt to solve one of the longest of problems facing this country today. We should choose to do work, the work we were sent here to do or the public is right to choose somebody else to do it. So i look forward to our conversation today, madam attorney general lynch. Im grateful for the opportunity to appear before you today to discuss how we can continue working together to ensure the security of our nation and the strength of our communities and the safety of our people. As we gather here this morning, i know we are all thinking of the two bailiffs who were killed and the sheriffs deputy who was wounded in the shooting in the courthouse in michigan yesterday. The department of justice stands ready to provide whatever help we can to state and local authorities as they investigate this heinous crime and our sincerest condolences are with the friends, colleagues and loved ones of the devoted Public Servants we lost. Of course, this incident follows on the heels of a series of devastating events that rocked our nation last week. The tragic deaths of alton sterling in louisiana and Philando Castile in minnesota and deployable murder of five brave dallas Police Officers, lorne ahrens, michael krol, michael smith, Brent Thompson and Patrick Zamarripa who were protecting a peaceful protest along with several comrades who were wounded. The department of justice including fbi, atf, u. S. Marshall service and u. S. Attorneys office in the Northern District of texas is working closely with our state and local counterparts and we will offer any assistance we can as the investigation in dallas unfolds. Among other resources, we will send assistance to the victims and their families. Our hearts are literally broken for the families and loved ones of those we lost in these tragic events 679 our gratitude goes out to the brave men and women who wear the badge, who carry of safety on their shoulders and risk their lives every day to keep us safe. As we grapple with the aftermath of these events, the department of justice will continue to do everything in our power to build the bonds of trust and cooperation between Law Enforcement and the communities that we serve. That has never been more difficult nor more important. We continue to offer our state and local partners funding, training, body worn cameras, deescalation training, education and implicit bias. In the last month we announced we announced we would provide it to federal Law Enforcement agents and prosecutors. We will continue to promote the recommendations of the president s task force on 21st Century Policing through training and technical assistance. Our Civil Rights Division plays a Critical Role in ensuring constitutional policing and accountability and in rebuilding trust where trust has eroded. Through our office of Justice Programs and our office of Community Policing services, we will continue to give local departments the tools they need and training they require to come home safely. At the same time that we are working to support police and citizens in their of forts to bring stronger and more united communities, we remain committed to keeping those communities safe and secure. Just one month ago today, 49 innocent lives were take even in an attack on the pulse nightclub in orlando, an appalling act of terror and of hate that underscored the urgency of confronting threats to our nation wherever theyve merge and whatever form they take. Theres no responsibility that this Department Takes more seriously. Were moving aggressively for those who seek to receive training from or are inspired by foreign violent extremist groups, and weve arrested more than 90 individuals since 2013 for conduct related to foreign fighter activity and homegrown violent extremism. Were working closely with our counterparts abroad to pursue terrorists and investigate attacks around the world. As the recent ins dmens turkey, bangladesh, iraq and saudi arabia have reminded us, terror knows no borders. In the face of violent extremism we must stand with our Global Partners in readiness and resolve. I want to close with a comment about the investigation of secretary clintons use of her personal email server during her time as secretary of state. As you are aware, last week i met with director comey and career prosecutors and at who conducted that investigation. I received and accepted their unanimous recommendation that the thorough yearlong investigation be closed and no charges be brought against any individuals within the scope of the investigation. While i understand that this investigation has generated significant public interest, as attorney general it would be inappropriate for me to comment further on the underlying facts of the investigation or the legal basis for the teams recommendation. But i can tell you that i am extremely proud of the tremendous work of the dedicated prosecutors and agents on this matter. Thank you for this opportunity to make this opening statement. Thank you, general lynch. Well now proceed under the fiveminute rule with questions for the witnesses. Ill begin by recognizing myself. Before being confirmed as attorney general in may of last year, you were first nominated by president obama to serve as United States attorney for the Eastern District of new york and originally appointed to the u. S. Attorney post in 1999 by former president bill clinton. The existence of secretary clintons private email server was first brought to light in march of last year, one month before your confirmation as attorney general. A few months after your confirmation, the inspectors general of state and National Intelligence requested the department of justice investigate whether classified information was stored on her private email servers. The fbi opened an investigation into the matter. Given she was a political appointee of your current boss and more importantly the wife of your previous boss, why did you not see fit to recuse yourself from the investigation . Wouldnt recusal or appointment of a special prosecutor have removed any appearance of impropriety given your service during bill clintons presidency . Thank you for the question, mr. Chairman. As ive said on several occasions before, when the referral came into the department of justice it was received and referred to experienced, dedicated career agents and prosecutors who handle matters of this type every day with independence, with efficiency, with thoroughness, and the matter was handled like any other matter. It was reviewed through the chain by those independent career agents and prosecutors. In considering the matter, there was no connection, there was no need for recusal or an independent prosecutor. As i indicated before, im incredibly proud of the dedicated work they did over the past year. Let me follow up on that then. Two weeks ago, roughly a year into the fbis investigation and a mere week before director comeys announcement, you met privately with your former boss, former president bill clinton, on your plane at the phoenix airport. Why was this meeting, particularly in light of your previous appointment by president clinton, not grounds for recusing yourself . With respect to my conversation i had with former president clinton in phoenix, it was a conversation that was held on the airplane, on the tarmac. The former president indicated he wanted to say hello. I agreed to say hello. We had a social conversation. Nothing of any relationship to the email investigation was discussed, nor were many specific cases or matters before the department of justice discussed. Well have followup questions to that later. But let me turn your attention to director comeys conclusions on a variety of points. Secretary clinton stated she never sent or received information marked as classified on her server. Director comey stated that was not true. Do you agree with director comey . Director comey has chosen to provide great details on the basis of his recommendations ultimately provided to me. Hes chosen to provide detailed statements. I as attorney general am not able to provide any further comment ton facts or the substance of the investigation. General lynch, i think you would agree that the ultimate responsibility for a prosecutorial decision does not rest with the federal bureau of investigation but with the department of justice which you head. Have you not taken a close look at the work done by director comey especially given the extreme National Interest on this issue to make a determination whether you and those working for you agree or disagree with director comey . As i indicated, i received the recommendation of the team, and the team was composed of prosecutors and agents, it was a unanimous recommendation as to how to resolve the investigation and the information they had received do you agree with the conclusion . I accepted that recommendation. I saw no reason not to accept it. I reiterate my pride and faith in their work. Secretary clinton said she did not email classified material. Director comey says there was classified information emailed. Do you agree with that . I would have to direct you to director comeys statement. Director comey says theres evidence of violations of the stuts regarding the handling of classified information. Do you agree with director comeys statements . Again, i would direct you to director comey as for the basis of his statements. General lynch, director comey made a recommendation, but made a recommendation to the department of justice which you head. You would have to come to the final conclusion on whether or not to act. I would presume before you acted, you would look at his conclusion to determine whether you agreed with them or not. As i indicated i received a briefs from the team which included, not just the prosecutor, but the agents and director comey. Their unanimous recommendation p question that does not regard the specific facts with regard to secretary clinton. Director comey said there was not clear evidence secretary clinton or her colleagues intended to violate laws regarding the handling of classified information. My question is, is intent to violate the law a requirement under 18 usc section 793f . I think the statutes that were considered here speak for themselves. To answer further would require a discussion of the facts and the analysis of this matter which as ive indicated im not in a position to provide at this time. The team reviewed this matter and it was a unanimous team decision. You made a decision following their recommendation to you that you were not going to prosecute and the matter was closed, is that correct . I made the decision some time ago i would accept the recommendation of that teamnd was awaiting that recommendation. When i received it, there was no basis not to ak sicht. I reiterate my pride and faith in them. I appreciate your faith in them. The concern here is regard to your sworn oath to uphold the United States constitution and the laws there under including 18 usc section 1924, and to conclude no prosecution would take place without examining and drawing conclusions regarding the questions ive just asked does not seem to be a responsible way to uphold your constitutionally sworn oath. At this time, id recognize the Ranking Member of the committee, the gentleman from michigan, mr. Conyers for his questions. Thank you. Thank you for being here again, attorney general, and thank you very much for your frank and candid discussion with us that is now taking place. Im looking for answers and views of some events that im going to string together and ask you to discuss as far as you can and in an appropriate manner. Baton rouge, Louisiana Police shot and killed ashton alton sterling. Video shows that he was shot while being pinned to the ground by two officers. Outside of minneapolis, police shot and killed Philando Castile at what should have been a routine traffic stop. He was armed, but reports suggest that he repeatedly told police that he had a valid permit for the weapon. In dallas, a gunman killed five Police Officers and wounded seven others in what appeared to be a wellplanned attack. This terrible act in the middle of and other wise peaceful protest in a city that has become a model for Community Engaged policing. So i think youre qualified to advise us here as both the chief Law Enforcement offer . The United States and the first africanamerican woman to hold that post. How can we make sense of these events during these trying times, maam . Thank you, congressman, for the opportunity to speak on these issues. I believe you have truly outl e outlined the issue of the day facing our nation. It is my hope that, as we all look at these tragic incidents, that we will take the opportunity to draw closer to each other, to have the Difficult Conversations about race and policing in this country involving all sides, involving all issues and all points of view. I have spent the last year as attorney general touring this great country, meeting specifically on the issue of police and community relations, and i have sought out jurisdictions that have had extremely troubled relationships but have, in fact, made the conscious decision to pull themselves back from that brink and develop a positive relationship between the community and Law Enforcement. It can be done. I have seen it done. You have cited dallas as one example of a Police Department that through its Community Policing efforts has crafted a strong bond with its community. So that when there is tension, theres an outlet, a way for discussion. I believe, congressman, the key to many of the problems we face is communication. Communication and truly listening to one another, listening to individuals who feel, for whatever reason, separated and at a distance from the goals of this great country. Individuals who feel that they do not have an opportunity to fully participate in this great democracy as well as listening to our praef members of Law Enforcement who talk to me every day with great poignancy about why they joined this wonderful profession, their desire to protected and serve, put people on the right path, to build a better country and build Strong Communities because they live in those communities. All of that must be recognized as well as the pain of Law Enforcement who feel themselves under attack as well. By recognizing our common humanity, our common loss and our common goals, we can, in fact, work on this difficult problem. Thank you for your response. I would like to ask you in a friendly way how we can as a committee, what is it that we can do to address the problem . We seek your friendly advice in that direction because we want to Work Together with all the branches of government and the house Judiciary Committee is in a very unusually important position to play an Important Role in this. Yes, thank you, congressman. The department of justice is actively engaged in working with both communities and Law Enforcement to further these discussions. Of course, efforts in our grantmaking arena are important there, and we welcome and appreciate the support of this committee and others in making sure the departments grantmaking operations are fully funded. We also provide a great deal of support for Law Enforcement through training and technical assistance. For exam, the Bulletproof Vest Program and our funding for bodyworn cameras for so many Police Departments. Again, we thank this committee and so many members of congress who have provided bipartisan support for those efforts. We would hope those efforts, and funding in particular, would continue. Those are a few examples of the ways in which we hope to continue to receive support. I would also note that the issue of criminal Justice Reform is a larger canvas upon which this conversation is being writ. Certainly we support the efforts by so many on this committee and others throughout congress to push that important legislation forward. Weve provided assistance in terms of many of the details that have been raised in the context of this legislation. I know this committee in particular has spent so much time and effort on that. We appreciate that and all the issues that have been raised. That is an important way towards dealing with making our criminal Justice System more effective, more efficient and more fair. That in and of itself will go a long way in restoring faith and trust in the overall criminal Justice System which is often a problem raised to my attention during my travels. The department looks forward to continuing the support those important efforts. Im so pleased that you would be with us today, and i hope we can continue this communication because its very important for all the citizens in our nation, and i thank the chair. Thank you, mr. You are in charge of the department of justice. The buck stops with you. I am concerned you keep on saying you have deferred the authority that by law is yours to director comey. Let me give an example. Mr. Comey has said secretary clinton was extremely careless in her handling of highly classified, very sensitive information. Now, the criminal statute uses the word gross negligence. I cant for the life of me figure out what the difference between a strict liability statute that relates to the removal and retention of classified information. So it doesnt matter whether secretary clinton had the intent to do that or not, the fact is that the fbi said that she did it. Now, i think that what director comey has said is that secretary clintons actions essentially meet the definition for prosecution under the statute. Why did you defer to director comey when the responsibility is yours . Thank you, congressman, for the question. Let me be clear that my decision was to accept the recommendation of the team of agents and investigators who worked on this. These are the career attorneys as well as dedicated investigators including the fbi director who worked on this matter for over a year. Theyve reviewed the facts, followed the facts. They looked at the law. They applied the facts to that law and came up with a unanimous recommendation, a joint recommendation in effect that was provided to me. I have a limited amount of time. The fact is that whether its extremely careless or gross negligence and a strict liability statute, i think that the language of the statute is clear. Now, ive noted that the Justice Department over the last several years has prosecuted several servicemen for doing the exact same thing that secretary clinton did. In one case actually reached a judgment of a court that prohibited that serviceman from ever having a security classification again. You have a problem, madam attorney general, that people think theres a different standard between the servicemen and secretary clinton and the fact that the language is almost synonymous if not synonymous saying no prosecution of secretary clinton and prosecution and conviction of the servicemen. You have a burden i think to convince the American Public that you dont have a double standard. Youre not meeting the burden. How do you plan to change the argument that you make to the American Public so that they can be convinced that the thing was correct and you made the right decision rather than simpl deferring to people in the fbi and prosecutors. Congressman, every case stands on its own separate facts and application of those facts to the law. You have to refer to the specific facts of the other matters that youre referring to. With respect to the investigation of the former secretarys handling of classified information, her private email system, again, i can tell you and this entire committee and the American People that all of the relevant facts were considered, investigated thoroughly and reviewed by the entire team which again is composed of career independent investigators as well as lawyers and their recommendation upon a full and thorough analysis was the matter be resolved in the way it was recommended to me. As ive indicated, i determined to accept that recommendation and did, in fact, accept that recommendation. One final question. One of the Service People who was prosecuted basically sent an email out that his fellow marines were in danger. He ended up getting prosecuted for warning his fellow marines that their lives may be in danger. Now, here in the case of mrs. Clinton, the private email arrangement was simply to avoid public scrutiny. So in terms of the intent of major Jason Bresler and secretary clinton, major bresler was doing it to stave his colleagues. The other, secretary clinton, was to avoid transparency. In terms of the bottom line, thats the hoop that you have to jump through in order to regain your credibility with the American Public. Were all sickened by the killings of alton sterling in baton rouge and Philando Castile outside st. Paul. According to the aclu, mr. Castile was if 123rd africanamerican to be killed by Law Enforcement this year. That is, of course, no excuse for last wokes vicious murders of five Police Officers in dallas. The knowledge that mr. Steerings and mr. Castiles death come among the long list whose encounters with police might have gone differently had they not been black, mist spur us to act. I appreciate the work you are doing and your department is doing in this regard, and i hope youll keep us informed on that. I want to go to a different matter, related unfortunately, exactly one month ago today, a lone gunman killed 49 people and wounded more than 50 others in an lgbt nightclub in orlando. Mass shootings are an alltoocommon occurrence in this country. In 2016, 229 mass shootings, defined as when at least four people are shot. Every day nearly 300 americans are shot in murders, assaults, sue said attempts, accidents and police actions. 48 are children and teenagers. This is a distinctly american problem. More than 33,000 americans lose their lives to gun violence each year. In the United Kingdom in 2011, 146 deaths to gun violence, denmark 71, portugal 142, japan just 30. The United States, 33,000. You cannot tell me no one can tell me that the American People are a thousand times more mentally ill that people in these other countries. A recent study in the american journal of medicine cor said the gun related murder rate in the United States is 25 times higher. We have held there is an epidemic of gun violence. How has the majority in Congress Responded . Emergency hearings about Hillary Clintons lois lerners emails. We have held zero hearings on gun violence, passed no bills tood dress the issue, done nothing to require universal background checks, continue to allow militarystyle assault weapons on our streets, not even prevented those on the nofly list from purchasing guns. I was proud to join john lewis in protesting the republicans abdication on this issue. Ms. Lynch, what does the assassination of five dallas Police Officers last week tell us about the nras favorite adage, the only thing that stops a bad guy with a gun withes a good guy with a zbhun what about an Armed Society is a Polite Society . Congressman, thank you for raising this important issue of gun violence in our society. I dont have a comment on the nras comments or statements never mind their position, but what do you think of the statement that the only thing that stops a bad guy with a gun is a good guy with a gun. Is that true . Does it work . Congressman, i think the issue, as is usual, doesnt really lend itself well to after for richls and short statements. Its my hope that the work of many on this committee and indeed throughout congress in having the discussion ha has begun on this issue will continue so we can, in fact, continue to work on the serious issues of access to firearms in our society. Earlier this year i did make several recommendations to the white house which were accepted for important ways in dooling with this issue, ranging from clarifying guidance for those engaged in the business and must provide background checks for purchasers, ranging from clarifying rules on acquisitions of certain types of firearms and those in certain business capacities such as trust, but also as part of that, a very important part of that was a request for additional funding for atf, for more resources to deal with the information and the issues arising out of gun violence as well as funding for hhs, to deal with the issues of Mental Health that place so many mary cans in jeopardy. A loophole in federal law allows the transfer of a firearm to anybody were going to break away from this hearing right now. Were hearing from attorney general Loretta Lynch testifying before the house Judiciary Committee, hearing from republicans and democrats asking very different questions. Ill bring back our panel and talk act what weve already heard so far. Ron brownstein, when you listen to this, its clear republicans want to hammer her on the clinton email probe. Shes quick to shut them down when democrats continue to talk about the gun violence and Police Shooting issues. What do you think self fekive in how she is responding to their questioning . This is what were going to see i think for as long as congress is going to be around. The republicans want to argue that the decision not to prosecute clinton was improper, that her actions warranted prosecution, that the attorney general is simply using the fbi decision as a very formidable defense against that. On the other side, democrats want to argue the republicans want to rehash the issue that has been decided and theyre short changing other concerns of the country ranging from gun violence to Police Interactions with africanamericans. The bottom line, the majority of americans as weve seen think Hillary Clinton should have been prosecuted for what she did in her email private server use and exchange classified information as we now know from the fbis testimony. Nia, does what were hearing from the attorney general held or hurt Hillary Clinton because she is essentially refusing to answer questions about the email probe . I think that same poll also shows that a majority of people who support Hillary Clinton, Something Like 60 said even though they disagreed may have disagreed with the fbis decision, that that decision wouldnt affect the likelihood that they would support Hillary Clinton, Something Like 30 said it would make them less likely to support her. I think a lot of this is baked into the cake. I this e we talked about the upside, republicans continue to go after Hillary Clinton, go after the attorney general and go after this decision. I think we also see the downsides here, too. On the one hand, youll have goodlatte going after attorney general lynch. Then you have conyers who is trying to frame this in the way the Hillary Clinton campaign wants to frame it and essentially say this is a witch hunt, that republicans essentially believe in conspiracy theories and this is all about politics and essentially a waste of time. From what attorney general lynch called the important issues of the day that are facing this country, namely gun violence and instances of Police Interactions with africanamericans and other communities. I think if you look at this theater and weve seen this over and over again with Hillary Clinton, her benghazi testimony, for instance, last fall, they have come away from some of these hearings not necessarily upsides, but certainly they feel like they are able to score some points as well in some of thighs events.
