The manhunt for the two escaped killers finally over. 23 days after breaking out of prison david sweat is hospitalized in Critical Condition this morning. He was shot twice while running from a state Police Sergeant. And nearly disappearing into thick woods. More importantly, sweat was just two miles from the Canadian Border. His capture comes just two days after fellow escapee richard matt was spotted by police and shot to death. While his death with his death, rather investigators are hoping sweat can survive and reveal how the two orchestrated such an lab tratelaborate escape plan. Were covering this story from all angles. Lets begin with cnns sara ganim outside Albany Medical Center where sweat is being treated. Good morning. Reporter good morning, carol. Yeah no change in condition since he was brought here last night. Still in Critical Condition. The governor telling cnn this morning hes in critical but stable condition, and the state Police Telling us that he is beginning to talk a little bit, which is important because investigators are going to want to interview him to know not only how did they pull off this brazen escape but how did they stay on the run for nearly 22 days in sweats case . Was there anyone else helping them . We know two people who worked inside the prison have already been charged but were there more helping them pull off the escape. Across this region which has been effectively shut down at times with road blocks and housing searches theres a collective sigh of relief as this comes to a close, including a sigh of relief from his mother. I felt like a big lift was off my shoulders that he was captured and he is alive. My son knows if he would have came here i would have knocked him out and had them guys take him to jail by themselves because thats just the way i am. I have always done it to him when he was bad. David sweat was not armed when he was captured yesterday. He did have some things on him though. He had poptarts, bug spray, and maps carol. Those two last things particularly interesting given that the rough terrain that he were navigating over the last three weeks as they made their way out away from the prison, and just to give you some perspective, he was about two miles south of the Canadian Border about 16 miles away from where his partner, richard matt was shot and killed. You know 1300 different searchers involved in this carol. At the end of it though it all came down to one state Police Sergeant who spotted him and was able to capture him and keep him alive. Carol . Absolutely sara ganim reporting live this morning and praise is flooding in this morning for that state Police Sergeant jay cook. The hero cop who single handedly captured sweat. A 21year veteran. He spotted sweat jogging along the road less than two miles from the Canadian Border. Sergeant cook called out to sweat from inside his car. The fugitive took off running. Cook got out of his patrol car and gave chase and then opened fire. The new York Governor Andrew Cuomo spoke to cnn a couple hours ago. Sweat turned around, started to run. The state trooper sergeant chased him through the field. They were only about a mile and a half from the Canadian Border. Sweat was headed for the border and a tree line. The trooper knew he would loose him in a tree line he couldnt catch sweat. At one point he goes down on one knee and he fires two shots at sweat stopping sweat. Lets bring in cnns Polo Sandoval in constable where the manhunt finally ended. Tell us more polo. Reporter carol, good morning to you. There is this sense of relief in the communities here in upstate new york. I can tell you that really the people here followed very closely that threeweek manhunt that played out like a hollywood movie and then ended in a dramatic scene in the field you see behind me. This is actually where that Police Sergeant with the new York State Police and this very dangerous individual this convicted cop killer went head to head but there is though really a sense of not only relief but also a sense of normalcy. You see this manhunt was obviously very scary for the individual that is called this area home but also to a certain extent even inconvenient with a series of road blocks and School Closures during the early stages. For a family about four hours south of here carol, the manhunt was extremely personally. Im talking about the family of deputy kevin tar see ya from broom county new york. You see hes a sheriffs deputy that was brutally shot and killed by david sweat in 2002 during fourth of july perfect. After this escape wounds that look a long time to heal began to hurt again. We heard from the family releasing a statement thanking the estimated 1200 men and women who were searching for these dangerous individuals and wevent went on to reflect on that tragic day. To have someone you loved shot ambushed shot 15 times and then run over with a car simply for stopping to check unusual activity in a town park is a main no one can understand if you have not been through it firsthand. Even more amazing that Sergeant Jay Cook was able to take him down a steady hand and two shots before he was able to disappear into the woods. It is Pretty Amazing with hundreds of officers scouring the woods, it was a solo cop that spotted sweat. What a fantastic effort by led by the new York State Police a combined effort of local, federal, state, and tribal Law Enforcement agencies as well as im sure coordination with our canadian koub ter parts just across the border. Just a great feat of Law Enforcement to get both of these extremely dangerous men who had killed without comepunction and would have killed again if not for the actions of Sergeant Cook so what a great end pentagon. I was surprised Sergeant Cook was out patrolling by himself. Are you . Not so much. I mean the rudolph case ended in a similar manner with a Rookie Police officer, a 19yearold murphy North Carolina Police Officer on patrol who encountered him, relied on his training and did all the right things. There are 800,000 people in this country that every morning get up and put on a uniform, strap on a gun, and pin on a badge and serve as that thin blue line between evil and the public they serve. Its not that surprising. As the governor indicated, Sergeant Cook was a shift supervisor. He was on the perimeter. He was checking the perimeter. He was undoubtedly moving from station to station checking on his guys and he encountered this guy. It tells me there was a good plan in place, and Sergeant Cook was obviously extremely well trained, extremely competent and did all the right things to bring this to an end. Are you surprised that david sweat was out in an open field jogging along the side not at all . No . Not at all. He was obviously trying to move very quickly. People are creatures of habit. One of the things that happens in a lot of these manhunts is folks go to areas they can very quickly cover Ground Railroad beds fire breaks power line rightofways, places that theyre unobstructed and they dont have to break brush. And they have this feeling of i can move quickly but then dart into the woods, which he apparently was trying to do when Sergeant Cook ended his flight. And just the way he was caught he was in camouflage he was not armed which actually surprised me, but he had a backpack. He had poptarts in there and maps. What does just his general appearance tell you about those 23 days on the run . Well he and his matt were semi resourceful. They were able to get to cabins to meet some of their basic needs of shelter, clothing food water, and you can remain on the run for a relatively lengthy period of time if you can meet those basic needs. But he was obviously expending many more calories than he was taking in. He was tired. He obviously was had a plan had maps knew roughly where he was, and correctly by the new York State Police they indicated a couple 72 hours before he was caught that they thought he was headed northwest towards the Canadian Border and thats exactly where they found him. More key decisions out of the u. S. Supreme court this morning. Pamela brown is there. Two rulesings have rulings have come forward. What are they . The first one that has come out today is a major ruling on a lethal injection, and today the high court in a majority opinion, 54, cut along ideological lines, ruled that the controversial drug used in lethal injection does not violate the constitution. Challengers to this drug had said that it equates to cruel and unusual punishment and that its a violation of the constitutions eighth amendment, but today the justices said in this majority that the petitioners failed to establish merits of claim, that the use of this drug violates the eighth amendment. Also it talked about the compelling evidence that the other side brought forth saying that a certain dose of this drug guerin at this guarantees virtual certainty they will not feel pain. Justice breyer raised the question of whether the high court shuz takeould take up the constitutionality of the Death Penalty. This is what he said in his dissent. He said for the reasons i have set forth in this opinion, i believe it highly likely that the Death Penalty violates the eighth amendment. At the very least the court should call for full briefing on this basic question. Important to note this case was not about the constitutionality of the Death Penalty but Justice Breyer raising this question here today with this ruling upholding the use of this controversial drug thats used in lethal injection. Testifies used during the botched execution of Clayton Lockett, as you may remember carol. That was a little over a year ago, and that is partly what led to this case making it up to the high court and this ruling today. Carol . All right, pamela brown reporting live for us. I know youre reading through the second key decision and well get back to you once you have done that. I want to bring in Jonathan Turley a professor of law at George Washington university, also a constitutional scholar. Thank you so much for being with me. Just to make it clear for people how someone is put to death in this country, its a threedrug cocktail right . Theyre sedated first, the next drug paralyzes them and the third drug kills them but this particular Supreme Court decision centered on the first drug, a set tiff. Dative. Thats right. And actually the states have had trouble with this drug because the drug they prefer has been withheld in the manufacturer. There was an International Outcry for companies not to intri supply drugs for lethal injection and that was successful. The states had been running around to try to get the drugs they need to carry out executions and then there was a botched execution using this very drug where the inmate was clearly suffering or at least writhing during the execution. But the outcome is not surprising here. What is a little surprising is breyers dissent where he really confirms that many of these decisions are a substitute for the bigger question. You know should Death Penalty be constitutional . And Justice Breyer is saying im not satisfied that question is answered. I think we need to look at that when we look at these types of drug regimen cases. Thats interesting. And by the way, just so people just want to refresh our viewers memory Clayton Lockett was a killer in oklahoma. Took him 43 minutes to die. He was writhing on the table and grunting and making sounds at times and finally he died. And i guess they took it to the u. S. Supreme court because it violated the amendment that applies to cruel and unusual punishment. Right, the eighth amendment. How could someone take 43 minutes to die and that not violate the constitution . The state has said this was botched, that they i believe say they missed the vein or the vein collapsed. But their argument is that doesnt mean that the protocol the regimen itself is cruel and un unusual. I thought it unlikely they can declare this hundred constitutional unconstitutional. On one hand theyre trying to revent the drugs from getting to the states but the states are saying all this effort is meaning we have to improvise a little and youre making it more likely there will be these types of problems. The court basically said this was far off the mark. For something to violate the eighth amendment, you need to show more than a botched execution, and this just isnt it. And i think thats the reason Justice Breyer is saying lets stop pretending were argue being what drugs to use. We need to do straight on the question of is it time for the United States to declare the Death Penalty unconstitutional . All right. Jonathan turley thank you for your insight. I appreciate it. Three weeks after two coldblooded killers broke free from a new york prison it only took two shots to take down inmate david as we had thanks to this man. Fastacting Sergeant Jay Cook. There he is. Sweat is now in custody. Hes recovering at a New York Hospital after being wounded in the torso. Sweat was captured after being spotted jogging alongside a road. When Sergeant Cook approached him in his patrol car, sweat took off and thats when Sergeant Cook exited his car, chased sweat on foot and then opened fire before sweat could disappear into the thick woods. Now that the manhunt is over authorities are hoping to put all their focus on the investigation. Im told hes talking a bit. Obviously hes in the care of medical professionals, and their priority is to save his life. We hope that he continues to talk. Our investigators are very keenly interested in what he might have to say not only as it pertains to his escape and the department of corrections of course would follow up on that but from my perspective how he managed to oelude capture for the last 23 days. So lets bring in cnn legal analyst and criminal defense attorney danny cevallos. Welcome. Theyre trying to question this guy right now as hes recovering from two Bullet Wounds to his torso. Do you think theyre speaking to him as he slips in and out of consciousness . How does that work normally . If hes that much out of consciousness, there wont be much use to intergatrogateing him now. This is a bait unusual. It unusual. Police use the reed technique, and they are allowed to lie to a suspect in order to extract a confession but nos at typical suspect confession. They know what happened. What they want is the details. So i dont know that they need any pressing information at this moment. They may wait until he recovers and, again, if hes in and out of consciousness, any information really wont have that much value to him. Why would he talk . Well there are a number of different reasons. Typical suspects may talk because theyre made promises by the police or they think theyll get some favorable treatment. And thats probably the motivation here. This is somebody who is already going to be in prison for most of the last of his life. And hes probably thinking im going to be in solitary confinement. And thats the key. What the question is what carrot can you dangle in front of this inmate and most likely its prison classification. New york state allows for even people who have pretty bad crimes of commitment to move up and down within the system. As you know these two inmates had made their way to the Honor Program at Clinton Correctional Facility although it is my guess that they will probably not he will probably not be back in the Honor Program. Hes going to be in the shu and the shu is special housing unit and thats not as pleasant. A safe bet. As far as the other Prison Guards at the Clinton Correctional Facility those who might have had something to do with the escape even inadvertently, theyre probably pretty nervous right now. Theyre incredibly nervous, but my guess is this. Talk about cooperation. Now, this escaped inmate is one thing. Prison guards are something totally different. Why . Because they have a lot more to lose. They probably dont have prior convictions. Theyre new to the system even though they work in the system. Theyre new to being interrogated and my experience is that people who are not familiar with the system want to get out of it as much as they can, and theyre going to be more willing to cooperate. These people have families. They have jobs. They used to have careers. They have more to lose. So it is my guess that when faced with the prospect of incarceration, they have and will and will continue to cooperate with authorities and give them all the information, even if that means naming their buddies who also work at the facility if there are any additional people who should be scrutinized. Reporter were just learning the High Court Ruled that an independent voter created commission is upheld. Essentially, these commissions it was created in arizona to draw congressional districts intended to curb partisan jerry man dering. The High Court Held these commissions are okay essentially. Essentially essentially. The Arizona Legislature argued the commissions take away its power to be a part of the congressional redistricting. Under the constitution it said its allowed these powers. A number of sats have actually created these independent voter created commissions as a result and today the high court siding with them and essentially what this does is give the citizens a greater role in the process of drawing congressional districts. Here is what Justice Ginsburg said in that 54 majority opinion with kennedy joining the liberals. She said partisaniery manders this court has recognized are incompatible with democratic principles. She goes on to say the people of arizona turned to the initiative to curb the practice of jerry man dering and ensuring members of congress would have a habitual recollection of their dependence on the people this is a big case that has Major Political implications here, and this this also comes on the heels of an opinion on lethal injection. The court upholding the use of a controversial drug in lethal injection. We wreshtappreciate it though. For the 13 republicans who have thrown their hat in the republican ring the Supreme Courts ruling on samesex marriage is provoking a range of reactions. While none of the candidates have applauded the decision there is a difference of opinion on how the party should move forward. Jim acosta joins me with more. Reporter unlike the president and his fellow democrats who are really on the same page on this issue republicans are far from united in their response to the Supreme Courts decision to legalize samesex marriage. While some gop president ial candidates say its time to respect the ruling others say its time to start throwing up some road blocks, and that is something a few states are beginning to do. Days after the Supreme Courts landmark decision protecting samesex marriage Many Republican president ial candidates are nowhere near the path to acceptance. It is fundamentally illegitimate. It is wrong. It is not law and it is not the constitution. Reporter some states opposed to the ruling are beginning to fight back. In texas the attorney general has said county clerk kansas city reject samesex marriage license requests citing religious objections. While in mississippi and louisiana, officials are dragging their feet saying theyll await a separate Appeals Court ruling on the issue. I think it is wrong for the federal government to force christian individuals, businesses pastors, churches to participate in wedding ceremonies that violate our sincerely held religious beliefs. Reporter they are framing it as a fight against the white house. If i become president , i want to remind people please dont campaign if i would put out a nativity scene during christmas and say if its my house i get to do with it as i wish. Reporter as more moderate voices in the party want to take a deep breath. I believe in traditional marriage but the Supreme Court has ruled and its the law of the land and well abide by it. Reporter gop strategists fear a backlash against the high court will only help Hillary Clinton. I am asking them please dont make the rights the hopes of any american into a political football for this 2016 campaign. Reporter advocates for samesex marriage say they want to turn the courts attention to laws they say are still tilted against them. Reporter and as for those states that are bucking the Supreme Court, all of this will put the white house and potentially the Justice Department in the position of playing referee to determine what exactly to do with these states that dont supply with the Supreme Courts ruling and that could be the biggest question the president faces all week long but, carol, the real test is inside the Republican Party. These gop debates that are coming up in the coming months just got a whole lot more interesting. Youre right about that. Jim acosta reporting live from the white house this morning. Lets talk about what jim was just talking about. I want to bring in democratic stratist Chris Kofinis and Dana Rohrabacher adviser sara set meier. Theres a split among republican candidates. Which way do you think they should go if they want to win the nomination. Well this is very fascinating but this is also what happens when you have this many candidates. Youre not going to have monolithic opinion on Something Like this. You have a diversity of opinion, and meanany of them are legitimate and theyre based on different legitimate and precedent reasonings behind these things. Whether its politically viable or not, that will be determined through the campaign. Thats why we have elections, a primary process, thats why we have a nominating process. Wouldnt it be best to say the Supreme Court has decided, we have to listen its the law of the land lets move on and talk about the economy and national security. I think thats probably what a lot of the candidates would like to do. Youre seeing some of those candidates doing that already. Jeb bush casic, i think marco rubio said the same thing. Then there are other legitimate concerns that some other republican candidates are bringing up about the poor legal reasoning behind this. However you feel about the end result i dont think most people are arguing about that some are, but most people most voters 60 of voters feel like you know what. Gay mare religion isriage is something were accepting of and the protection of the right of conscience is something for religious folks in this country need to be concerned about and i think if the republicans find a way to balance that then we can have a productive discussion but i dont think they want it to be the wedge issue it was like in 2004. Lets talk about the issue of religious liberty. Thats a legitimate concern among some conservative christians. Will i be forced to marry these two people even those i dont believe in samesex marriage. If you look at the decision and especially the written decision by kennedy, the idea that because you have, you know certain religious beliefs allows you to discriminate against others is not something i think its almost like youre talking about a reverse right. Im going to take away your rights in order to protect mine. Its just not where the country is. Part of i think the beauty of the constitution is an evolving document. Its not what republican conservatives like to believe but its the reality of the actual agreement. The notion that somehow were going to go backwards after this incredible jump forwards the republicans are going to be in a terrible place in the primaries and in the debates arguing against this. The country has moved forward. You know to sit there and talk about how somehow we should go back in the past it is not the way you run for president , especially in 20152016. And it is certainly something that Hillary Clinton could pounce on right . Conveniently for her. Hillary clinton was very definitive about her position on samesex marriage not that long ago where she said its between a man and a woman. Who was president obama but thief conveniently evolved on this because its politically expedient for them to do so. And i think thats do you think thats the only reason . Possibly. I mean but thats up to them to have to define it. I know what they said and what they believed and what they used to get elected a couple years ago. And now because Public Opinion has shifted somewhat so have they. Versus some of those in the Republican Party who actually have principles and are honest and steadfast and sincere about them. As far as i dont think going focusing on the importance of religious liberty is stepping back. No it is not. The freedom of exercise of religion is in the bill of rights. Its something that is that this country was built on the exercise with all due respect. Wait a second. The exercise of religious freedom does not allow you to discriminate against others based on Sexual Orientation or race. These arguments were not talking about that. Wait a second. The arguments about religious freedom being used to protect your beliefs to discriminate against others with the same kind of arguments used during the Civil Rights Movement the same kind of arguments used again interracial marriage so personally i find it kind of offensive that somehow allowing a gay couple to get married is going to infringe on my christian beliefs. That is not the way it works. Forcing someone to perform that is what infringes. I find that as a christian i think we should make this clear though. It is highly unlikely that in a church that a priest would be forced to conduct is samesex marriage ceremony. Thats open to interpretation. No, no. No its not. The way that kennedy wrote his opinion yes, it is and that is the problem here. Good morning, pamela. Reporter good morning. And the ruling today on the epa is a setback for the Obama Administration carol. The justices authored by scalia in a 54 opinion said that the epa unreasonably interpreted the Clean Air Act when it regulated e migmissions at power plants without taking into account the cost to industry. So basically saying that it was okay it regulated emissions but that it didnt take into account the cost to industry at the beginning like it should have and the liberal justices said this was micromanaging the ep a and the that the epa did take cost into account but just at a later stage. This is a loss to the Obama Administration and this ruling comes after two other big opinions released today, especially the lethal infection opinion. The justices with alito writing the majority opinion upheld the kotionality of a controversial drug used in lethal injection. In an interesting turn of events Justice Breyer read the dissent on the bench, one of four justices to read from the bench on this opinion and he brought. The question of whether the high court should take up the constitutionality of the Death Penalty in general. Certainly a dramatic end to this term here at the Supreme Court. Carol . And just quickly redistricting in arizona, the court also upheld that independent panel can handle redistricting and not just the state legislature, correct . Reporter yeah.
