For the first time in more than a decade the nsa must stand down on some of its most controversial surveillance tactics aimed at catching terrorists. Lawmakers failed to pass a bill to extend three key provisions of the patriot act including bulk Data Collection of phone records and roving wiretaps on suspected terrorists. That means the agency is now forced to stop collecting telephone data on millions of americans across the country at least for now. The white house now warning of Serious National Security consequences calling the outcome a irresponsible lapse. Lets bring in athena jones on capitol hill this morning. Reporter strong words from the white house and tough talk on both sides of this issue in a rare sunday session. Senate leaders are trying to make sure the lapse in this law, a law that many say is vital to fighting terrorism, is over as soon as possible. Im not going to take it anymore. I dont think the American People are going to take it anymore. Reporter the heated debate over the patriot act pushing beyond the midnight deadline in washington. Forcing the nsa to immediately stop collecting telephone megadata on millions of americans across the country. They want to take a little bit of your liberty but they get it by making you afraid. Reporter senator rand paul blasting the Domestic Surveillance Program calling it an illegal spy program on americans as counterterrorism officials also lose the ability to obtain roving wiretaps allowing them to listen in on potential terror suspects as they change cell phones. With the advancement of isis across the middle east some senators say this program is needed now more than ever. Isnt this program as critical as it has ever been since its inception given the fact that the middle east is literally on fire and we are losing everywhere. Reporter the nsas authority could be restored as early as tuesday when Republican Leadership expects a final vote on the compromised mill the usa freedom act amending the patriot act requiring a specific targeted warrant for obtain any call records from telecommunications companies. Were in the mess we are today because of the majority leader. Reporter harry reid blaming his republican counterpart Mitch Mcconnell for not having a plan. After an aboutface, mcconnell who had wanted to renew the patriot act as is says passing the compromise bill is the only realistic way forward. I believe this is a program that strikes a critical balance with privacy on one hand and National Security on the other. Reporter what happens next . I spoke to an aide to senator mcconnell this morning and he said a vote on final passage of the usa freedom act could come as soon as tomorrow. Of course a lot of things have to fall into place correctly for that to happen and this is the senate so anything could happen. I should mention that they also plan votes on some amendments to this bill and so if those amendments pass the senate and if they change that law, theyll have to send it back to the house of representatives for consideration. They say were safer because of this bulk collection of data but everybody thats onbjective that looked at it says no case has been cracked. No episode of terrorism has been prevented. I think they should be worried about whether were having the right conversation about this issue or not. A lot of complaints about these programs suggest that it is the government thats collecting this data and in reality we have massive collection of private data by corporations by former governments and so really americans every day consent to a lot of their data being collected by all of these different sources. So theres a privacy issue here that never seems to get addressed and then the second issue is at what stage are these bulk collected data programs relevant and my contention would be that its really relevant most of all after an initial attack and at what point do you want the government fully equipped to know whether theres a followon attack and track where terrorists are going and communicating. After the attack and not before. I ask you this because the man in charge of president s review of nsa is richard clarke. He served under president clinton and george w. Bush. He says the nsas bulk collection is not netting terrorists. Shouldnt he know . Well he should know more than he talks about. In reality, he wouldnt know what these programs are doing now being a decade out of government. But in reality when we look at the boston bombing, at what point do you want authorities to be able to track the people who are involved . At what point do we want them in the minutes, hours after an attack to be going to courts and getting warrants and then beginning thing e ing aing ae aggregation of data. This is not an easy nut to crack and there are Fourth Amendment challenges. This is a clash of providing for defense and bill of rights. Most are important and i wonder whether the current conversation were having is informing the public. Senator rand paul has been accused of using the nsa to further his president ial ambitions. Do you think he is . Theres no question the base of his Political Support is identified close with the post post 9 11 world. Nobody could say we got it right in the immediate aftermath of 9 11 and surely review and revision of these programs would be warranted. Those calls you can imagine are coming in from those Foreign Ministers offering to wish him well. Secretary kerry was expected to open the u. S. Embassy in cuba in the coming weeks. He also has whats going on with isis right now. Hes going to miss that conference in paris, which will be taking place tomorrow. He wanted to call in to that conference but his doctors intervened and said its a very serious injury. We need to get you back to the United States and see whats going to happen. I dont think hell have any type of major surgery. What we understand is the doctor is going to set his leg. That will be a delicate procedure and then there will be a certain amount of rehab. I think hell make every effort to take part in these negotiations carol. All right. Frederik pleitgen spoke with medical experts in london. Tell us more about this. Its very interesting. Of course we always have to be careful when we speak about new cancer treatments and what breakthrough theyll be. I can tell you by speaking with experts that they are excited about what they are seeing out of the study that comes here from the u. K. This is called immuno therapy. It teaches the immune system to fight cancer. Now, that sounds simple at first but one of the things we have to know about cancer is one of the reasons why its so nasty is that the cancer cells, the infected ones they mask themselves so therefore our immune system dont recognize them as something that shouldnt be there. What this new treatment does is a combination of two drugs. One is already available. Another one is about to get certified and the combination of these two drugs apparently boosts the immune system to make it stronger and at the same time the second drug allows our immune system to recognize these cancer cells and therefore to start fighting them. It was tested in a little more than 900 people who had a very late very bad form of skin cancer. These people who were terminally ill and the cancer either became smaller, at least didnt become bigger and in many cases went away all together. Its unclear whether or not it will stay away or whether or not it will come back. This is certainly something that is causing a lot of excitement in the medical community to see in some cases or in this one form of cancer this has caused major results, carol. Sounds so promising. When you signed up to facebook youre required to use your authentic nape and your authentic identity and not required to use your legal name only the name that people call you by or know you by and you prove this through a picture i. D. Or facebook even says you can show a piece of mail or even a magazine subscription. Heres the problem from the folks behind this my name is campaign. They say that because they look different or they have different names that they are using for real reasons that their accounts are being suspended or shutdown and they say this is happening wrongfully. As you said these are people that include native americans, victims of Domestic Violence those who are victims of stalking political dissidence those in the gay and lesbian and lgbt community. I want to show you stories from people behind this my name is campaign who say their accounts were wrongfully shut down. One store saying im the victim of kid nalling and sexual assault. My abuser has found me on facebook and messaged me under fake accounts. This person using a different name not as a cloak but as a shield. Second story to show you. This person adopted against their wishes. Their name was changed and now this person goes by the name boogie but this persons facebook account was shutdown as well. Shutting down an alleged fake account is easy on facebook. All you have to do is go to a clickdown box and click report. This group is saying that this process of shutting down the accounts isnt fair right now. Facebook has come out and said the following. I want to go to their statement saying that we are committed to ensuring that all members of the Facebook Community can use the names they use in real life having people use their authentic names makes them more accountable and helps us root out accounts created for malicious purposes like harassment, fraud, impersonation and hate speech. The point being that facebook has a process in place because it doesnt want people hiding behind unanimous names and harassing people on facebook. You know you are sharing information and pictures to people you hope you actually know. Facebook does say that that you have had an ongoing conversation with these groups and they are in the process of seeing about making changes but that there is an ongoing dialogue going on. I also thought that one of the things that stood out to me was the fact he said that he went on youtube and watched the crash and watched the funeral and i just thought, wow, hes literally trolling the internet to see what happened because he didnt remember and he said he watched it over and over again. There is some movement on a case that does not involve samesex marriage but it does involve freedom of speech and facebook and what exactly you can say on facebook and not have that comment be termed a threat against a loved one lets say. Lets go to the u. S. Supreme court and pamela brown has more on this. Good morning. Good morning to you, carol. This is significant because this is the first time the Supreme Court is ruling on social media and free speech and today it ruled that a pennsylvania man wins in his conviction overturned. He was convicted after saying several threatening seemingly violent messages on his Facebook Page targeting his estranged wife one way to love you, a thousand ways to kill you and talked about dumping her body in a creek. He was convicted based under federal statute, the standard of how a reasonable person would perceive the threat. Today the High Court Said thats not enough. You cannot convict a person. Thats not sufficient to convict a person based on how a reasonable person would perceive the threat and in this case these facebook messages. What the high court did was send it back to lower court and have them decide whether recklessness or enough or how the person making the violent statements intended them to be perceived. This is a narrow win for the pennsylvania man who was convicted. The high court is telling the lower court that it must revisit his case and decide what should happen from here. A loss for the government and again its a big deal because on one side of this you have Domestic Violence victims who were concerned that this is only going to cause more problems for them and this gives a license for people to post violent messages online and on the other hand on this debate you have parents who were concerned that their teenagers would be prosecuted for their posts on social media. So again its the first time the high court is taking up this issue of free speech and social media and it found that its not enough to rule or to convict someone based on how a reasonable person would perceive a threat. Pamela brown reporting live this morning. The Supreme Court has ruled in favor of a muslim woman who sued amberbercrombie fitch for being refused a job for wearing a head scarf. What did the u. S. Supreme court rule . Its an important decision. In terms of a decision that can impact many people in the country. This one deals with what accommodation a business has to give to peoples religious beliefs. You have an individual who applied to abercrombie who wears a head scarf out of religious beliefs but did not make clear that she would be required to wear the head scarf as part of her interview process. Abercrombie argued they needed to have knowledge of these religious conditions and it didnt meet the standard in terms of title 7 to be free of religious discrimination. The court came down rather heavily. 81. You are imposing too high a standard. You are required to accommodate religious practices in that even though abercrombie argued it was applying a neutral policy to all of its employees, the court said thats not good enough. Its not enough to say that youre applying a neutral policy that impacts one religion or a couple of religions differently. Now, how is this going to affect most people . Its going to have a big impact. Its telling businesses that they will need to accommodate even businesses like abercrombie that argue they have a socalled abercrombie look that they wanted their employees to assume this image of the abercrombie customer thats going to be more and more difficult to maintain in light of this decision. And then also as was stated earlier, this decision in terms of the facebook is enormously important to people. It deals with what can constitute a criminal threat and i cannot overstate how important that decision is. It was a narrow ruling by the court. If the court had accepted the governments view it would have led to a far greater criminalization of comments on the internet. Interesting. Jonathan turley thank you for your insight. Tell me how . I think that because hes the senior sitting senator in South Carolina his impact on the race could be significant given that South Carolina is number four in the voting states. So we all know that a lot of the candidates go down to South Carolina because of it being the first primary in the south and he has the advantage of a 20 plus year career in South Carolina and access to major donors and Political Consultants and ground game. This throws a little bit of a wrench into things for candidates like marco rubio or jeb bush who kind of would pull from the same pool of individuals and now Lindsey Graham is in a position where he can monopolize all those. Hes doing this because hes basically an extension of the failed policies of john mccain a lot of people would think. And hes running as a hawk. There are a lot of other people in this race running as a hawk too. I will say it will be interesting because there are many other candidates running as hawks. Lindsey graham knows how to turn a phrase doesnt he ron . He does. Hes very good and very adept at the one line zinger if you will. Hes really honed his career not only just being in the United States senate and house of representatives but a lot of people forget that he was a judge advocate general, a lawyer in the United States air force. He knows how to argue on his feet. Hes very very quick. Hes very smart and i think one of the things i would add to what tara said a few moments ago is that being a sitting senator in South Carolina a lot of establishment folks who have been previously leading in polls, scott walker and jeb bush if Lindsey Graham gets into this which hes doing right now, he can be the king maker and the person that could derail a jeb bush and he could derail a scott walker or a Chris Christie and make it more difficult for their path to the nomination. Lindsey graham also for being a hawk as weve heard on Foreign Policy the 2016 election is going to hinge a lot on Foreign Policy. Hes been to iraq. Hes been to afghanistan. Hes been to the region. He knows Foreign Policy. I think that gives him a strength that a lot of other candidates may not possess. Interesting. I want to take our viewers back to central South Carolina because the prayer is now over and back to dana bash. You know its interesting, dana hes been around a long time Lindsey Graham. We dont know much about him personally. Reporter thats right. He doesnt talk a lot about his past. You know a lot of politicians have humble roots. Lindsey graham is one of them. You see behind me the stage set up. The building there was a building that inside of which was a bar and a restaurant a pool hall that his parents owned. His father did the bar. His mother worked on the grill. He and his sister and his parents lived for a long time in just one room. I was just walking through there. Its a small room in the back of this restaurant. That again is kind of a typical up from your boot straps kind of story. Whats unfortunately not typical and tragic is that his parents died within 15 months of one another when Lindsey Graham was in college. His sister was just 13 years old. He had to really be a father figure to his sister. Eventually he adopted her in order for her to get military benefits. Hard for him to talk about it. Hell talk about it here and his sister will introduce him. In doing so one thing hell say as it relates to policy is that unlike a lot of republicans who perhaps dont understand the idea of government assistance hes going to say he does because he was on it and he understands the necessity of keeping it solvent when you are talking about medicare and Social Security and also medicaid and that the idea of being able to reach across the aisle in order to make that happen is a lot of what youll hear in addition to what we were just talking about which of course is what hes known for being a hawk on the National Stage and how much that differs from rand paul. Its going to be a horse race. Thats the challenge that the party has when you have this many candidates. He also is considered a traitor because of his position on immigration reform. He and john mccain another person not popular with conservatives, who are important in these early primary states. Conservatives can make or break a candidate early on. Theres going to be competition there for those votes and i dont see how Lindsey Graham breaks 5 between now and august. I really dont. Interesting. I will say, ron, you know Lindsey Graham and rand paul on the same page would be interesting and spicy. It would be the fireworks display that a lot of viewers who arent tuned into politics right now would really see and draw contrast from. If you look at senator graham he thinks that we should have kept 10,000 troops in iraq and of course rand paul says that we should be a lot more retrospect and not have troops there. They are almost a ying and a yang. They both need each other and can fund raise off each others presence in the race.
