We begin in South Carolina where outrage is growing after a policeinvolved shooting leaves an unarmed black man dead. This understanding that we dont want to be divided amongst a race. That was the scene just moments ago on the steps of the North Charleston city hall where a rally is taking place. The officer in question now in custody and charged with murder. An fbi investigation has been launched after that shocking video filmed by an unanimous source shows the deadly encounter. I want to warn you, the video youre about to see is disturbing. The man, 50yearold walter scott, you can see him running from the officer. This incident began with a traffic stop over a broken taillight. That officer, Michael Slager firing multiple times at scott as hes running away. As i said slager has been charged with murder. Cnns Martin Savidge is in North Charleston in front of city hall. Tell us more martin. Reporter theres a demonstration going on as you so pointed out. Its under the broad banner of black lives matter. There are people here from the local community and elsewhere. Theres probably several dozen people. Theyve been expressing a number of points of view. One of them has been that there should be the stepping down of the mayor of this community. Also they pointed out that there is a difference between the racial mix of the Police Officers which is about 70 white, versus the community which is about 50 africanamerican. And then on top of that there is just the anger over the shooting itself. Heres some of what was said. This has been a long standing affair. This has been a long standing occurrence and something that weve had to live with. What youre going to hear is the passion of the people right now. Not reacting to a video like you might be reacting to but reacting to a live situation and opportunity to finally share with the world and finally put the spotlight on North Charleston city hall. Its time. Its time. Reporter theres been talk that it is time for change. Thats pretty much what people have been saying here. No one is espousing any kind of violence. No one is espousing any kind of actual physical anger. They say change is needed here. Change politically. Change in the attitude of Law Enforcement and change in the attitude of local media which they say has too often been on the side of Law Enforcement and ignoring the side of victims. Martin savidge reporting live from North Charleston South Carolina. That officer is charged with murder. The department of justice, the civil rights division, is working with the fbi to figure out exactly what happened and so are we. With me now, hln legal analyst and criminal defense attorney joey jackson and former new York City Police detective harry. Harry, you watched this tape a lot. At any point as you watch that tape did you say to yourself this officer is in fear for his life . No. No. This was definitely not a justified shooting. I cant even see why the officer would have drew his weapon. This man was definitely running away from him. In a situation like that where he automatically drew his weapon and fired eight times at this man, i mean im just as shocked as everybody else seeing this video. Theres no way this officer can justify. He has zero defense in trying to protect himself from prosecution in this case. One of the most disturbing aspects in the case is the officer fired seven shots and then he paused and fired again. You dont learn that at the police academy, do you . Well i cant tell you why he fired eight shots, seven shots, paws paused and fired another shot. I dont know whats going through his mind. I cant understand it at all. Okay. We dont know what started it all, right . We know that this mr. Scott was pulled over because his taillight was broken right . Why would he get out of the car . Well what ive read is apparently theres a warrant out for him for back child support. Its really funny. People run for a lot of stupid things. You know, i had it happen to me before. At the end of said what are you running for . This is nothing. Im taking you in and youre out. Here apparently the guy didnt want to be arrested. Ran off. They got into an altercation where the officer tased him. Apparently the taser didnt work or he got the taser away from the officer. Still, he was running away from the officer. All he had to do was wait for his backup. If the officer did not want to fight him, thought he was too big or Something Like that all the officer had to do was follow him. Run behind him. Wait for his backup to come and then take the guy in custody. When youre going to arrest someone because you go back to your police car and you find out theres a warrant out for this guy, is it protocol to arrest him yourself or do you wait for backup . It depends. I have made many arrests on my own. It depends when someone starts resisting arrest the whole thing changes. Now you can be this guy can hurt me. It depends on how you feel as an officer. I used to call for a backup first and then place the person under arrest and if we got an altercation, my backup would arrive on time. Thats when i was by myself. Most of the time its two officers in a radio car. In North Charleston its one. That could be a problem. Maybe if there were two officers here this may not have happened today. There are protests going on right now at city hall. People are angry. Yet this officer has been charged with murder. Some people wonder what more do you want . He has been carol. If you examine it you have to look at the law and match it to what the officer was doing. There are three things that need to be evaluated here. The first thing youre going to look at is the immediacy of the threat. Was there imminent danger to the officer such that he might have been justified in drawing that weapon much less using the weapon. Second thing you turn to is the proportionality of the threat to the force that was used. Did he act in a way that was grossly disproportionate to any danger or threat posed to him. The third thing you look at is the reasonableness of the conduct. I think thats what ultimately a jury will be looking at. To the credit of this community, there was an arrest here. There was a charge here. And the mayor even is saying you know what . When youre wrong youre wrong. Ultimately we have a system of justice. It will be left to that system of justice. When you examine that against the backdrop of the three things i mentioned to you and then the other troubling facts, the shots to the back. The fact that when you look at the entire video you see the officer looking at and placing what appears to be some type of weapon next to the body. The fact that hes unarmed. So many things are troubling about this case. I think the people in that community are wondering theres been a lot of Police Shootings in the state of South Carolina. I have some statistics here thanks to paul callan. South Carolina Police fire their weapons at 209 suspects in the past five years. A handful of officers were accused of pulling the trigger illegally but none has been convicted according to an analysis by the state newspaper. Its rare for an officer to be found at fault criminally for shooting at someone. In this case theres video, right . If you live in that community, you would wonder how often does this happen and what dont we know . We cant really say that. 209 shootings and nobody held accountable in any of them . Do you know how many shot were white . Im just saying making turning this into a racial issue. We dont know if its a racial issue. We dont know what was in that officers mind at the time. Would he have shot the man if he was white . I dont know. Anybody who says they do know is lying. They have no clue. I have no clue. White, black or green, we can evaluate that video and make the judgment that the actions are unreasonable under those circumstances particularly when youre not close. The person is running away. Theres a distance. 10 15 20 feet. I dont know. We dont have a measurement. The department of justice is going to investigate that very thing. Is it racially motivated . That will be hard to prove. Unless this man says i did shoot him just because hes a black man, all right, its insane. You know that the standard of proof for a civil rights violation is very very high. Its high. Intentional deprivation of a right. If you look at this its just very troubling why shoot . The person is running away. What was the other justification and sometimes, harry, you just have to look at the surrounding circumstances to get what the intent of the individual was and to your statistics there about South Carolina shootings, i think we could agree that its very difficult anywhere to sort of get Police Officers i dont want to say to have them held accountable, each situation is different. Law enforcement officers you know what they have to act under split second direction. This person seemingly had time to act and that was the choice that he made. I dont know it was the proper choice. You cant go on the assumptions there were that many shootings, all the shootings were bad. You cant go under the assumption that all shootings were good. Im sure they were investigated. They were either exonerated or went to jail. Thats the system we have to work with. We cant make an assumption because there are so many shootings a lot of them are bad. I will say this. The officer in this video didnt appear stressed out at all to me. He appeared very calm. Supposedly he dropped that taser near the victims body to cover up his crime. Couldnt that be a cultural problem . I dont know if thats a cultural problem. I know thats a problem. If he did in the video you really cant see what hes picking up. I cant tell if thats a taser or not. Im sure were going to find out whether or not there was a taser or not. This officer did go back to where he first fired the shots and grabbed that taser and put it down near the body this guy is in enough trouble the way it is. Hes going to jail for the rest of his life. The fact that hes picking up anything and bringing it next to the body is troubling and goes to what we call a consciousness of guilt. If what you did was proper and appropriate, why do that in the first instance. We dont need to assume in this case. Why . Because of these things. Cell phones. People have them out. That recorded exactly what we see. Should we believe our lying eyes . The reality is that it seems to suggest what we say, we see. Period. I have to leave it there. Troops are limited in where they go. There are few places in afghanistan where they actually get out of major bases and this is clearly a meeting being held in the governors compound with afghan officials. There are diplomats there and security is pulled by u. S. Military in position outside of the building we understand as well. Now, this meeting ended and the u. S. Diplomats and military came out to take the helicopters according to Afghan Police that normally ferry them around that area. Thats when what were told by afghan officials an afghan soldier on top of an Afghan Military vehicle opened fire with a heavy machine gun. In these situations because these insider attacks called green on blue instance in which rogue Afghan Security forces attack nato personnel because they are increasingly common and theres Guardian Angels in place which is security detail of u. S. Soldiers whose job is specifically to protect u. S. Soldiers as they interact with Afghan Security forces. Imagine that surreal departure. Still to come in the newsroom, day two of deliberations in the boston murder trial under way. Jurors sending back questions to the judge as they try to reach a verdict. Well talk about that next. No verdict was reached but jurors did send two questions back to the court. Lets talk about that. There were two notes. The jury is paying close attention to the language and precise language being used. They had a question to conspiracy and to aiding and abetting. They wanted to know whether conspiracy was a single event or it would take place over a continuing amount of time. The judge said its not limited. Its over time. They also had a question about aiding and abedtting and whether that was two separate ideas or one. The judge said it was one. So when you think about what they asked about, conspiracy it applies to count one, using weapons of mass destruction and using a bomb to destroy a public place and destroying public property. Two are Death Penalty eligible. When you look at the verdict sheet, the verdict sheet has the counts that are listed and then they have to vote on subcategories and they wanted to know if they find him guilty of a particular charge do they then have to go to the subcharge. Can they say yes hes guilty of using a weapon of mass destruction or find that he killed all of them individually. The judge said they had to be unanimous on all of that. They are asking about conspiracy questions intrigues me. They are thinking very hard about whether the brother convinced Dzhokhar Tsarnaev to commit these crimes. I like the fact that these jurors are asking questions like this. It certainly is our system at work. These are people who you look at the nature of the heinous act could certainly phone it in and say its enough for me this person enacted so much devastation upon our community ill go back and vote guilty. Theyre not doing that. What does conspiracy mean . An intent to agree. Do the two have to agree to commit an act. Is it over a period of time . Is it not . Could you aid or not abet or is it one and the same . Its significant they are going back to determine do the facts match the law which would match that verdict sheet. Judy clark is probably saying to herself maybe a small glimmer of hope . Its interesting. Because shes the one who said look tamerlan brought the pressure cookers and the backpacks and it was tamerlans fingerprints all over this. So now they are basically saying okay that conspiracy does he have to have physically touched that or is just knowing this was going on knowing his brother was doing this does that mean he aided and abetted. Its parsing language on serious death eligible accounts. The jury may or may not decide whether hes guilty of all of them or some of them and then the Death Penalty phase of the trial begins. Its interesting. Before the trial starts all of them were asked how they felt about the Death Penalty. It was interesting to read some of their comments at the time. So juror number 138 on the jury is a white man who works for the water department. He said death can sometimes seem like an easy way out. It can go both ways i guess. Juror number 395, executive assistant at a Law Firm Says i thought i was against it but once you think about it things change. Then theres juror 229. A homemaker. If you asked me this question 20 years ago i would have said definitely not. So while some might think because of the heinousness of these crimes that it would be easy to sentence someone to death, it really isnt until you have to do it right . Its so true carol. You see it from their comments. What do you want on a jury . You want people like this who can be openminded and say ill kill. Its a consideration. Ill keep an open mind. Its difficult. I may apply it and may not apply. These jurors are Death Penalty qualified. All those people who came into the courtroom and said under no circumstance would i apply the Death Penalty, theyre not on this jury. Those with open minds are sitting there. So judy clark is trying to paint this kid as somebody who is enslaved to his brothers beliefs but people in boston feel he should not get the Death Penalty because that would mean he would become a martyr. It would be a much harsher penalty if he spent the rest of his life in prison. Why didnt she go that route . That goes to the whole do you believe in the Death Penalty or not believe in the Death Penalty from a philosophical point of view. The reason she didnt go that route is Dzhokhar Tsarnaev for all intents and purposes thought he was going to die that day. The note he wrote in the boat he was jealous his brother died and he did not. He thought okay god has a different plan for me. Im here. Ill tell my story of why i did this. Judy clark says he was brainwashed. Some people say, look let him rot in prison. Why give these want to be jihadies cause to come and do this since theyll reach heaven and reach their own version of paradise. So it is an interesting question about whether he should stay in prison. Thats what the anybody who said im against the Death Penalty, theyre not sitting on that jury right now and judy clark said keep an open mind just as you just said. Well see more about that when the penalty phase begins. We can presume there will be guilty here and well hear about mitigating and why shouldnt you put him to death or why should you put him to death. Should be interesting. Thanks so much. It pulls back really the curtain on the white house and you get to see every day that many recent first families have gone through. You learn who is the most particular nancy reagan, perhaps the most peculiar resident lbj and most paranoid many members of their staff said it was the clintons. As bill and Hillary Clinton prepare to fight their way back into the white house, a new book reveals details about the explosive arguments they had inside its halls. There was blood all over the president and first ladys bed. The blood was bill clintons. What did they think had happened . Everyone on the staff said that they were convinced she clocked him with a book. Reporter in an interview at the time clinton dismissed rumors she had thrown a lamp at the president. I have a pretty good arm. If i threw a lamp at somebody you would have known about it. Reporter insiders say the Monica Lewinsky scandal left her reeling. One summer day hillary was escorted to the pool. She wouldnt have to see secret service agents. No staffers. She didnt want to see anyone. She specifically said that. And so he was so proud he was able to make this happen. Reporter just a few of the juicy tidbits in a largely on the record account of life behind the scenes in the white house. Kate anderson interviewed dozens of former maids, chefs, florist, butlers and doormen dating back to the kennedy years for the residence inside the private halls of the white house. Their accounts of life at 1600 pennsylvania avenue ripped from the script of the cbs series Downton Abbey and the lack of privacy in the white house is a constant theme in the book. They describe bill and hillary as the most private first couple they worked for. I had staffers say the clintons were the most paranoid first family they ever had to work with. They didnt ever fully trust the staff. It took them a year to carry on a conversation while staff was in the room. The clintons had the white house phone system rewired to make their own calls instead of going through an operator. They were worried about people listening in on their phone calls. Clintons ultimately did get on with the staff and the book reveals sweet moments. For instance in the height of the lewinsky scandal, carol, there is a pastry chef who says that Hillary Clinton would call frequently to get her favorite dessert and he took a lot of pride in providing her that comfort and then also its interesting to note the female staff at the time in the res residence made it known they were happy that Hillary Clinton had relegated bill clinton to the couch. I dont know. It strikes me as wrong that the white house staff is dishing like this. You would think they would sign papers preventing them from doing that. I wonder if there are some protections now and maybe there might be in response to this book. I think its important to note that there are a lot of very positive antidotes in this book as well. But of course you get these more salacious tidbits and those are things that people focus on so much. You really do get a sense in the way a lot of people are infatuated with Downton Abbey you get a sense of the every day and its an interesting look inside. Im going to read it. In an interview with politico paul took direct aim at Hillary Clintons character and honesty saying theres a lot of stuff there that is going to shake the confidence of americans in her ability to lead in an honest fashion. Rand paul went onto say i think a lot of americans are going to say that doesnt pass the smell test. Most americans have moved on. I get that it makes interesting fodder for some people who live for this stuff, but in terms of how it influences voters and their opinions about whom theyre going to support for president , it wont have any impact. Do you agree . Monica lewinsky has come back into the public eye as well. I think that its going to remind americans of what maybe they didnt like so much about clintons first time around. I think the much bigger issue is whats happened since bill and Hillary Clinton have left office and about the enormous fundraising machine they built about the Clinton Foundation and some donors. These are interesting questions. I think the issue around having your own private email server i think theres a sense that these guys arent so accountable and that they spent a lot of time around very wealthy people rather than around the people who actually made them political successes in the first place. Those are much more interesting questions politically than the fact they might have been paranoid about staff. Paranoid which makes sense by the way. The paranoia thing might tap into the most recent email crisis because that would make you understand about why Hillary Clinton might have had that private server in her home.
