And the answer is, because over the even the past couple of days even hours, some some donors some important staffers in key states began to choose other candidates. He knows how this game works. Hes done it twice. Hes got to fish or cut bait for lack of a better way of saying it now he wants to actually do it. So why is he making the announcement this way, by phone . Thats a good question. Look, heres whats been going on behind the scenes over the past couple of weeks since mitt romney as you pointed out told some donors in new york that hes seriously thinking about it. If you talk to anybody who knows mitt romney they use the word data. He say data driven guy. Hes asked his closest confidents since beginning of time with him to gather data. Thats polling, information, from people who have been with him from since the last two elections in key states. To see what the genuine appetite is for a third mitt romney run. So hes been looking the that and crunching those number us. Of course when you run for president , its not just about numbers, its about fire in the belly. Do you really want to go through this again . Do you want to put your family through this againy so those are the things that hes been weighing. Hes going to do this by confidence call now. He wants to get the message out asap. One other thing i wanted to point out is that theres been a lot of talk understandably so about ann romney. Shes so often publicly said no no no i dont know how many ways i can say no hes not going to run. Ive been told over the past few weeks shes been much more positive encouraging him to do so. For various reasons, mostly because he and she and the relevant of their family know that this is something that he has always wanted to do. And if they see the data and hes gault the fire in his belly, theyre with him for a third time. All right. Dana bash stand by. If romney does throw his hat into the 2016 ring hes facing a slew of possible gop contenders. A lot of chatter throughout. Look at those heads on the screen. As for the democrats, cue the crickets the short list includes Hillary Clinton and joe biden. It just seems like its going to be a repeat of the gop primary, i should say . Well youre going have a much provided field, they believe its a much more established or credible field. You have an ideological split, the Tea Party Like ted cruz. The libertarian, perhaps mitt romney an ideological split in the field. Scott walker and a generational split. The younger guys. Rick santorum before i would take sarah palin and donald trump out of that i think theyre mostly trying to get attention. Ben carson former fox news contributor, bobby jindal, the governor of louisiana. There are at least two dozen republicans taking a look at this. As dana noted, mitt romney is still at the top of the pack even if he believes a decent number of had his donors or a decent number of his operatives he would start with a bigger or better insfrafrastructure than any other candidate. Mitt romney would say i think im better than jeb bush. I think i have a better chance over Hillary Clinton than anybody in the field. Just last night after president obama spoke at a democratic retreat, romney tweeted back to have a debate with obama. All signs point to that he wants to run. With the close of the inner circle who governor romney has talked to the last time and gone off to do his assessment. And were two hours of finding out what that is. Lets talk about some of romneys closest supporters and advisers. Gloria borger has talked with some donors. What are they telling you, gloria . Well i talked to a couple of donors who believe that romney will as one put it quote, lean in on this phone conversation to running. He knows hes got to make a decision quickly because hes going to lose the donors otherwise. Hes going to Lose Campaign staff otherwise. He just lost his former Iowa Campaign chief Campaign Staffer to jeb bush yesterday. But i think theres something more personal underlying this in talking to people who are close to romney. Yes, as dana points out is with him and because she is with him because he really believes had he should be president of the United States. You know about a year and a half ago, i interviewed them both in park city utah. I asked mitt romney if he would ever run again. This was after the loss. He said oh id do it in a minute. And i sort of couldnt believe him. And ann said huh . Because she clearly was not as enthusiastic. But if mitt romney really wants this and will do this their son sonnetagson tag romney would be involved. Its like the band is getting back together sort. Some people are scratching their heads about this but romney believes hes better than anybody else in the field. One thing he has on his side he believes hes been the nominee before. Hes kind of been to the super bowl once. Even though had he lost. He feels he can withstand the kind of scrutiny and the kind of campaign that will be ahead of him. Interesting. So you mentioned ann romney. Yes. And i want to remind people what ann romney said in 2013 lets listen. I feel like you know we did our best. We had had our turn. We gave it our all. I believed in it completely. I believe in my husband completely. And now i feel like its time to pass the baton on to someone else. So thats what she said in 2013. And i think that has to hit especially hard on the families. As you recall fees 95 men were sent to the prison nation of qatar that promised to keep an eye on them at the same time the u. S. Was conducting a Surveillance Program monitoring intercepting all of their communications. Apparently within the last several weeks one of them tried to make phone calls to former Taliban Associates u. S. Intelligence picked it up very quickly. They caught the call. Now, what does this all mean . Some in the Intelligence Community have said as long as we caught the problem, its okay. I will tell you that several sources tell me that there is considerable concern about this. It is not a good sign. They may have caught the communication, but this is not a good sign. Theyve had detainees do this return to the battlefield, shown that activity in the past. Its happened before but in this case of course its very distinctive because of that political controversy surrounding the five for one trade swap to get Bowe Bergdahl back. These five detainees from Guantanamo Bay all were suspected of fairly significant activity in operating with the taliban in afghanistan. Thats what got them picked up and sent to gitmo in the first place. So likely to see a lot of additional criticism from this from many republicans, in fact democrats here in washington. Wasnt someone supposed to be keeping an eye on these men . Yeah you know heres the deal the qataris promised and apparently have promised again to keep a very close physical eye on them. They are not allowed to leave the country, well they may be within the next several months that travel ban expected to be lifted it is that classified u. S. Intelligence Interception Program of their communications their email their cell phone traffic that caught this. So the u. S. Intelligence community was working very closely, we are told torsion try and make sure that all of their communications were monitored. One of them apparently felt they could get away with it. Trying to clear the snowplows with dump trucks trying to get the snow out of the city because 6 to 10 more inches are expected to fall between today and tomorrow with the potential, carol, with a third storm, another storm to come sunday into monday. All of this is significant, because when you get to that many that high of snow totals on the ground that leads to problems removing the snow. Yeah the rap mogul booked with suspicion of murder. Well tell you what happened in the middle of the day, according to sheriffs deputies. Right now, a former new England Patriots player Aaron Hernandez sits in a courtroom accused of murder. Hernandezs defense team claims he was targeted by police because of his celebrity status. As soon as they found out that Aaron Hernandez, the celebrity Football Player the new england patriot, was a friend of odin lloyds, aaron never had had a chance. It was over. How does that play into his future . The prosecutors argue hernandez not only orchestrated the killing of his former friend odin lloyd but tried to cover it up. Today several key witnesses are expected to take the stand, including lloyds mother lloyds girlfriend. And a criminal scientist at the crime green. Joining me by phone, clark panel, he was a jury foreman in the panther trial. Clark, i want to start with you, tell me what it was like to sit on a jury in the rae carruth trial . Well it was very interesting and very enlightening to be able to sit there and listen to all of the different versions of what happened. And then try to sort through it with my fellow jurors to come to the conclusion that we did. Was it i mean did rae carruths celebrity status affect any of the jurors Decision Making . I dont think so. We had a mixed jury. I think it was like seven men, five women. All of us were locals. So we knew about the panthers. And we knew about rae carruth, but i dont think that that really played into the decision of anybody. What do you expect the jurors are feeling now as they sit through the beginning days of this trial . Well if theyre like me you know lot of us are like this i believe in the system. Once you get into a courtroom and youre told you can you hear certain things and youre told to disregard them thats hard to do. Youre told that you know you can take notes, but you cant take them home with you. You cant watch television. You cant read the newspapers, et cetera, et cetera. And, you know to have all of that coming at you right on the first day or two of the trial, to me it was very overwhelming. I was just kind of Walking Around in a daze for the couple of days i guess. I cant even imagine. So joey one of the difficulties of the attorneys in the courtroom is a, to make the jury understand where theyre coming from right . Yeah. And in this case especially for the defense attorneys. They want to paint a picture of Aaron Hernandez of this rich handsome football. In fact one of the lawyers said this is the picture of Aaron Hernandez. With his arm around his girlfriend smiling. This is not the picture of a murderer . Uhhuh. Hes the orchestrater hes the murderer this is the guy, but to remember that this is what the defense is doing, it goes to motive. And you never have to establish a or prove motive but inquiring minds want know. Why would he do this . Hes got everything 40 million, a fiancee, a beautiful child. Why would he do it . Does it make sense to you . If not, you cant convict. And thats the deal. For the other side for odin lloyd, right, prosecutors are theyre trying to paint a picture of odin lloyd as this drug dealer guy. Not this loyal son. I dont think its a surprise that lloyds mother is going to take the stand today, danny. Theres no question in every one of these cases, theres a subtle amount of character assassination that goes on involving the victim. Because after all, theyre not here speak for themselves. Its subtle sometimes not so subtle. But its critical to paint a picture not only of the defendant and who he is but the victim and who he was. Because jurors will make that decision based on that kind of relatability. And if the defense agrees showing that the victim was not the ideal citizen then that may affect the jury deliberation. Maybe not even consciously. Either side is doing it whether admitting it or not. So clark, did that enter into the rae carruth trial . I suppose that it did. It was a long time ago, so i cant remember all of the facts. But i suppose that the as one of the attorneys said you did their character assassination on the victim in this in the rae carruth trial. And, you know, she worked you know et cetera. And i dont know if that really made anybody emphasize or not believe that rae was the instigator of this. Right. Just to remind our viewer rae carruth was convicted of orchestrating the death of his girlfriend who was pregnant at the time. Clark, interestingly enough i used to be a prosecutor now a defense attorney. We always wondered you know what the judge admonishing the jury dont read anything dont review anything dont Pay Attention to all of the media crush youre getting over it. But you have analysis night after night, paper after paper, so the issue, clark, did that influence you or anything that the other jurors in terms of whether the media was covering it . Did you really follow the instructions that the judge gave the jury not to look at any of that stuff . I can only speak for myself. But i did. My wife was very faithful about getting the newspaper in in the mornings before ive had a chance to get up. And if there were articles in there, shed cut them out. If we were watching the tv at night, and something came up information or details about the rae carruth trial, then we turned off the television. And i have to think that the majority of the other jurors did the same thing. You know i never heard anybody say, when we were sitting around that hey, did you see the newspaper article, or hear what was on the news this morning. Well thats thats awesome. Im glad. Followed the judges instructions. Makes you feel better doesnt it . Yeah the judge admonishes the jury constantly dont follow that stuff. That makes it difficult. Were surrounded with information. My wife cut out all the articles out about the trial. He put them in a notebook for me so i could read what had happened. The swiss cheese newspaper. Last question for you, clark, are you going to Pay Attention to this trial, this Aaron Hernandez trial . I wont follow it on a daily basis. Hes been arrested and booked on suspicion of murder as sheriffs vers say he ran over two people killing them in the middle of the day in l. A. s compton neighborhood. Now, the trouble started yesterday according to sheriffs deputies yesterday afternoon when an argument broke out on a biography called straight out of compton about the hugely popular 90ess rap europe mwa. You see video of suge night calmly smoking that cigar. Saying the argument ended outside a burger joint when knight ran two men over in his truck. Killing one of them and injuring the other. There were witnesses. There were witnesses. Lets go ahead and hear from one man who was there when it happened. All i hear is argumenting. And i turned to look out, i seen suge knight turn around and go to his car. Backed his car up and put it in drive. And he hittery carter. He ran him over twice. So you can understand why sheriffs investigators are looking into this case. And hearing from some of the witnesses have arrested him on the suspicion of murder. Sheriffs deputies though have not confirmed the name of the victims. Knights attorney told the l. A. Times this morning that he is positive that knight would be exonerated by tuesday. Suge knight rose to fame when he cofounded dr. Dre records in 1991. But knight constantly found himself surrounded by violence and legal trouble much like the music hes produced. The last time knight made headlines back in august last year after he had been shot six is times in a packed hollywood nightclub during a preawards party. There was a fight that broke out there. He did obviously survive that. Then back in 1997. Knight was sentenced to nine years in prison for violating parole in another case. An assault case. He got out four years later, serving his time. Ended back in prison for another two years after violating his parole again for striking a parking attendant. His legal battles turned into financial battles. They were demanding 200 million thats an outrageous sum. Nobody is going to pay that but they did that calculated because japan said they were going to. And they said if you publicly fight isis were going to come after you. These are the demands. This is part of the theater of hostage terrorism. Yes, theyre winning, theyre dragging this story out. And its the Media Attention that fuels this terrorism. So yes. The fact that theyre bringing two nation state not only an arab nation but a western country, japan and getting more legitimacy that they have indeed established a caliphate and bringing it to the negotiating table. Youre saying even though it appears as if isis has driven underground because theyre not showing proof of life right . If they havent been driven underground, then why arent they . Well a proof of life video doesnt to be aired in the open. It can be a video or snap with the newspaper or headline proof of that again, i think theyre just driving this out. Theyre very calculated in the way they do this as long as this keeps focusing the Media Attention, they will extend the deadlines. They did this in iraq. When they thought it was getting the worlds attention they would push to the right. As long as they think they can milk this for exposure and attention and worldwide focus on isis itself or the islamic state, theyre going to continue to drive this out. So there are protests going on in jordan over this incident. Are you saying that isis meant for that to happen . Absolutely. Theyre trying to drive a wedge, you know theyve got the pleas from the family. This is a very powerful family. Pilot, the jordanian pilot. Of course theyre seeing the Division Within an arab nation. So of course they want to drag this out. So as soon as they say, they showed did the transfer release. The prisoner swap or they showed that they killed both the hostages, guess what stops. The protests stop. The king of jordan is under pressure. They want to drag this out as long as they can theyre orchestrating this the difficult demand outrageous demands, its all part of the process. Again, i stick to my guns here that theyre absolutely in the drivers seat in the Current Situation in these negotiations. So in your estimation, is jordan reacting appropriately . Well this is a i mean im not i dont know what brought them to bring out openly that they said they would be willing to trade the pilot. Now, they could be doing this behind the scenes but that it was released publicly again, these type of things you really dont want the attention. You want to do it behind closed doors. Every time a news media story broke, and i worked a lot of cases, it drove such a it threw a wrench in the works of what you were trying to coordinate. In our case we were trying to coordinate hostage negotiations. We stuck to a firm policy of no concessions to terrorism. But weve changed that policy. So how the the u. S. Isnt in any position to be telling the jordanians you cant do a prison swap so we did it last year for Bowe Bergdahl. Theres not a lot of good options for jordanians in this situation. I was just going to ask you what option they have and what they should be doing . Well the smartest thing for the jordanians in particular they should be you know trying to go into you know islamic back door channels. Theres going to be connections. Theres going to be certainly discussions within the tribal networks. And thats probably the best way this is going to be done and all cases well, not all cases. Most cases in iraq when we did get a western hostage in particular because of using networks negotiating behind the scenes. And times, many times, a gesture of goodwill. And thats what they may do. Because if they do kill this jordanian pilot, it will probably get jordan right back in the game of wanting to support the air strikes or support the mission. It wont win them any favor its in arab world with the arab states. So if theyre smart, they will release this pilot, because it will engender tremendous goodwill within the arab community. And of course theyre targeting goodwill in the arab world, regardless of the terrorism theyre doing to the west with the western beheadings. That would be my take on it. We first heard that one american was injured and another details the shooting took place at a gas station, the main highway that runs east from the capital of riyadh towards sort of the east of the country that police gave chase on the attack as it exchanged gunfire with them and he is now in custody, according to the police. The one thing that we have so far from the Saudi Press Agency is quoting a Police Spokesman saying that one american dead and the other injured. At this time. Other sources telling us that the person whos been injured in stable condition at the moment carol. So is there an indication that the americans were targeted because they were american . Reporter its not clear. At this time. And the details, i think, theyre probably going to going to be hard to get at. Physically hard to get clear details inside of arabia. We should learn more the contacts in the past few months there has been attacks on westerners in here. In november in riyadh the capital, a danish worker was driving in his car, home from work and another car pulled alongside him, fired a pistol at him. And he was injured in his shoulder. Now, that was recorded on video and posted by a group for people claiming to be associated with isis. You have two americans, one was injured in a shooting in october last year. That was put down to a workrelated dispute. But it left the question of was this some kind of radical islamist type of attack. Also in the past couple of months another american injured here that raised the same questions. But, again, getting the claim of responsibility as there was in november for the shooting of the danish man, its very difficult to know precisely for sure here from what happened carol. Okay. Andrew i want to start with you. The president of dartmouth says hell ban hard alcohol from campus because he thinks that that will in part help stem the amount of sexual assaults con campus campus . Is he right . No. I dont think this plan is going to get us there. It doesnt deal with the root of the problem which is just the presence of this greek system on our campus in the first place and banning hard alcohol will not work and probably cause more problems than its looking to solve. Why do you see that . You know weve seen in the past prohibition doesnt work. Fraternities are able to break the rules. The identity that a fraternity will follow this rule i find it laughable to be honest with you. Do you think that drinking is at the root of the problem of sexual assaults on campus . No i absolutely do not think that. I agree with andrew. You know at the end of the day alcohol does not rape. Rape is rape. Sober people rape. Children are assaulted. What we have at hand here is a rain rape culture we need to deal with and banning alcohol is not going to solve the fact that campus sexual assaults are at epidemic levels. College males admit they would rape if they knew they would get away with it. Banning alcohol is not the solution. Notre dame did something similar and it pushed binge drinking and underage drinking off campus. And i dont know if you have been paying attention to this terrible case out of vanderbilt, two Football Players convicted after raping an unconscious woman. Their defense was they were so drunk they didnt remember it. It was the drinks. By banning alcohol, is that giving potential rapists an excuse to attack . I think that by putting all focus on alcohol and not on the cultural systems that can produce this individual behavior and then the individual perpetrators themselves were just too its an easy solution to put forward if youre the president of dartmouth or a school like vanderbilt or notre dame. If it will accomplish anything its clearly not. By putting the focus on alcohol did it it is quite frankly absurd. And by putting most of the focus on fraternities is that helpful either . I dont know of any statistics that say that most sexual assaults happen inside these fraternities. You know what . Fraternities are definitely not helping the situation. Definitely encourages and promotes culture where men kind of feel like they can do what they want and get away with it and to a large extent weve seen across College Campuses in the u. S. Thats what has been happening. But thats not where the emphasis should be. Rape culture is when we normalize male Sexual Violence and blame it on other factors. Blame it on womens behavior. Women were asking for it. Blaming it on alcohol. Blaming it on the greek system. We need men and women need to understand women definitely understand it better but understanding the concept and definition of consent. Why do men feel like they can do this . Why when they are drunk or sober want to sexually assault women . This is what we need to address.
