We have some pictures of him meeting with the captain of the uss sampson captain foley. Ana, this is really an international effort. Were going into day 11 of the search the United States the uss sampson uss ft. Worth along with a lot of other countries, singapore, malaysia japan, south korea, all involved in search and recovery effort. The weather, again, putting a big damper on things. It is really deciding the pace of the search at this point. These pictures give you a better idea of what exactly search teams are up against. Ana . David, what about the investigation into how this flight took off without the proper licensing or permits on sunday . Reporter ana, the licensing issue, they had a license to fly the route. Surabaya to singapore. It only covered four days of the week. Sunday wasnt there. The Transportation Ministry says airasia basically rearranged its schedule. The head of Civil Aviation saying this we asked the schedule change to fly on sunday it would have been a simple paperwork issue. This investigation is ongoing and what were hearing from the Airport Authority is four officers four officers from the Airport Authority have actually been reassigned during this investigation. These arent controllers but theyre officers somewhere in the administration of the authority. Very clear to note the Civil Aviation office says look this is a separate investigation into separate completely separate from the investigation into flight 8501. Still it doesnt bode well for airasia when theyre called out having a serious violation of their license. Again, well see how this investigation goes maybe a week or two before theres an outcome and some results. Ana . All right, thanks for the update. Lets discuss more about the investigation now mary schiavo, a cnn aviation analyst and former inspectgeneral of the u. S. Department of transportation. Mary good to see you. Does it surprise you indonesias government has not said more about this focus of the investigation, the fact that this airasia flight took off without the proper credentials . No it doesnt surprise me because they can be very tightlipped. In 2007 actually january 1, 2007 another indonesia carrier went down adam air, and there were discrepancies and the Great Questions about the safety of not just that carrier, but of indonesian oversight of its carriers and that led to the United States downgrading the safety rating of indonesia. Im not surprised theyre tightlipped here in the wake of this terrible tragedy finding out that not everything was up to snuff regulatorily speaking. The skies over Southeast Asia are considered pretty crowded so anything that adds to the sheer volume without prior permission would seem an undue risk. How important is it to determine if this was a systemwide failure that allowed 8501 to take off or Something Else . Well its important on many different levels. First of all its a carrier who is not following the law. Whenever that happens, be it something, theyre calling a paperwork issue. Whether or not you have good engines and inspected plane ready to fly, theyre all important to safety. The second is flow control and really how many aircraft are up in the sky. Granted they dont have a lot of private aviation over there but commercial aviation are assigned to specific flight levels and theyre up there in the altitudes where the planes were operating, 30,000 feet and above, and it can get crowded up there so that was an important thing and then finally, agreements among nations also dictate how many planes can go from one nation to another so they risk messing up a lot of these treaties among nations that allow the world to be full of aircraft from all different nations. If you had to guess, mary was this a testimonyic failure or maybe a breakdown on only the level of a few air Traffic Controllers involved . Well, since our own federal Aviation Administration says indonesias just a handful of aviation nations of the world, out of over 100, indonesia is one of about six that fails to meet the Safety Standards of the international Civil Aviation organization, my guess is its systemic and the regulations arent really enforced and the faa has already determined long ago that they really dont have an inspection force to really go out and thoroughly inspect the carriers. Who needs to be held accountable then . Well on two levels the carrier needs to be held accountable and already they dont fly here so there isnt much the u. S. Can do in that regard but they need to have a thorough scrubdown from the inspectors in the country, and then as far as the other nations of the world that allow indonesian carriers to travel to their countries, ours included we need to make sure indonesia is providing proper oversight. In this case since there werent any americans on board, the ntsb will play a small role but we have an interest because almost anywhere in the World Americans are traveling. We need to see and watch what indonesia does for proper oversight of the carriers. The worlds eyes are on indonesia, there is increased pressure in that country. Mary schiavo, thanks so much for your expertise. Thank you. Investors waiting anxiously for the markets opening bell this morning. It was ugly on wall street yesterday. The dow plunged more than 300 points. The s p fell about 2 and the main reason is crude oil. It fell below 50 a barrel. So how significant is that . Well its the lowest price weve seen since april of 2009. Cnn Business Correspondent christina aleschi joins me with one. 1. 42 for a gallon of gas in indiana yesterday. It sounds like good news but why is cheap oil such a bad thing, big picture at this point prices have fallen too far too fast and that is ugly for three major reasons. One its a direct impact on the major oil companies, we saw them take a major hit yesterday down 4 for the companies alone, dragging the rest of the market down with them. Also oil is seen as a gauge of economic activity. So when demand for it isnt very high investors start to question Global Growth prospects. Oil is used in everything from manufacturing to construction to transportation so theres some Global Growth concerns when you see a declining oil price. Also producing nations havent stopped producing. So we have a glut in addition to a potential pullback in demand. Also you really have to take a look at the countries that depend on oil for a source of revenue, places like russia and venezuela, when you have Falling Oil Prices like this, it could have a destabilizing impact in countries and that is something investors want to see. Over the past few weeks weve seen a roller koers on wall street. What do experts think will happen when the opening bell rings later this hour . Its tough to tell. Futures are indicating a pretty flat open but most traders and investors that i speak to say get ready for these wild swings in the market. Theyre here to stay and thats really a reflection of diverging opinions about Global Growth. But investors are going to have a lot to digest over these next couple of days. Well get some more information out of the fed on interest rates. Were going to get a view on jobless claims and also investors arent just focused here in the u. S. Theyre looking globally. Theyre looking at the eurozone. Still Major Concerns there. We have elections in greece that u. S. Investors are paying attention to and also stock investors are looking to the bond market and theyre seeing a major flight to safety and that actually could have Major Concerns for a lot of investors in stocks. All right Cristina Alesci thank you. Two new York City Police officers are recovering after they were shot last night. This is different from theal bush of a couple of weeks ago. The plainclothed officers were near the end of their shift. They responded to a call about a robbery at a Grocery Store in the bronx. The officers were traveling all together in one vehicle, observed two possible suspects. As they approached them one of the suspects entered the Chinese Restaurant while the other suspect remained outside on the street. As two of the officers approached the male on the street the other suspect inside of the store came out and fired on the officers. The officers returned fire and during the exchange two anticrime officers were wounded. Now there is Surveillance Video you see here showing one of those suspects inside the chinese food store, as police arrived, and moments later the man in this video, he pulls a gun, who runs to the door and begins firing at those officers as described. Now, police are still looking for the two men who managed to get away after they hijacked or carjacked a vehicle. Police have found that car. It had a black revolver inside but still no suspects. Both wounded officers are expected to survive their injuries thank goodness. With me is cnns miguel marquez. Two new York City Police officers shot in this case very different picture with officer liu and officer ramos. That being said, what remains is this rift between the Police Department and the mayor who, again, spoke out last night regarding these new shootings. Yes and he was quick to the scene there as well as the Police Commissioner which is typical for the politicians and the Police Commissioner here to go to the sort of scenes. Very serious situation with two more Police Officers being shot here. There you see the Surveillance Video, it is worth underscoring that these individuals were on duty. They were responding to a robbery. They were not ambushed or assassinated or they werent targeted in i any way like officers ramos andley u were late last year. The mayor speaking last night spoke about these two officers bravery. First i want to say that these officers did something that was extraordinarily brave this evening, and they did it as part of their commitment. These officers had come off their shift upon hearing this call. Went back out in search of these criminals, and the work they do this anticrime work is so profoundly important, but this instance where they went above and beyond the call as is absolutely the case of officers going above and beyond the call to protect their fellow new yorkers. Because these officers were getting off duty they may not have had their protective vests on. One was shot in the arm and the back the other the arm and the chest. Both are expected to survive. The reward for these individuals has gone up now from 10,000 to 12,000 they are now offering. Police really want to catch these individuals. One of them may already be under investigation or in custody. Someone checked into a manhattan hospital with a gunshot wound. Nypd is checking into that to see if theres any connection. Were listening to what the mayor had to say. Almost sounded like he was trying to reinforce the message, he wants all Police Officers in new york to hear given thrift between the two parties, when he talked about the bravery, his appreciation for their work and really trying to lift them up. Is this helping . Its the only play he really has. There was a long press conference at the Police Headquarters here yesterday in which the mayor and the Police Commissioner spoke about the crime numbers across the city for the entire year last year. He time and again could not say it enough how appreciative he is how thankful he is and what a great police force nypd is. He has a long way to if as we saw in the funerals and showed up to the hospital when officers liu and ramos were killed a few weeks ago police turned their backs and the hundreds and thousands perhaps at the funerals not a good sign and theres a lot of tension still with beat cops out there and this mayor. She is the lone survivor of a plane crash this weekend that killed her parents, her sister and a cousin. Her family has established this website now in a bid to raise some funds for what they say is the emotion, the physical and the educational support sailor will need moving forward. Family spokesman saying the focus is to protect this little girl and that as a result no more details about her will be released to the public. Joining me from nashville, illinois is cnns george howell. How is the Community Reacting there . Reporter ana, good day to you. It is a mix of emotions here on one hand people are thankful theyre grateful that sailor survived this crash, that she managed to get through the brush to find help. Theyre thankful shes alive, but at the same time this community is dealing with a big loss of the gutzler family and the fact that sailor must now grow up without them. Heartbreaking. It really is. Reporter exactly how 7yearold sailor gutzler managed to walk away from this deadly plane crash, while four others in her family died in the wreckage. Many are saying feels like nothing short of a miracle. Sailor crawled out of the mangled aircraft and then walked nearly a mile through the dark kentucky woods, wearing just a tshirt and shorts temperatures hovering in the 30s. When i heard it i was surprised in the sense that anybody could do that under the circumstances, but then i thought about it and i said well sailor that probably makes sense. Shes a scrappy kid. Reporter here in her small hometown of nashville, a community struggles to cope with such a horrific loss coming so soon after the holidays. Our community could never ever prepare for Something Like this. Reporter at the church that sailors father attended pastor Matthew Wietfeldt says the family meant a lot to the community and this this church. Aboard the twin engine plane where sailors mother and father marty and kimberly gutzler, her 9yearold sister piper and 14yearold cousin sierra wilder. Sierras grieving mother spoke with cnns anderson cooper. Sierra was so kind everyone to. Thank god i got to hug her and kiss her before she left. Reporter a family Spokesman Says sailor is now being raised by relatives but that no more details will be released. The spokesman saying our total focus is protecting her. Its a very difficult situation and a tough mood here in this town as they prepare for funeral services. Sierra wilder services are set for wednesday and for sailors mother father and sister set for friday. Ana, the family also asking the Services Remain private. We can only hope the strength and the courage being displayed after the plane crash will really carry her through this difficult time moving forward. George howell thanks for that update. Over the next couple of days an estimated 1200 people will file through a massachusetts courthouse as attorneys try to seat a jury in the Boston Marathon bombing trial and as that group is trimmed down to just 12 jurors and six alternates were getting some insight into this process, almost all of the potential jurors are reportedly older than the man accused of these attacks, Dzhokhar Tsarnaev who is now 21. The majority of jurors are white. Tsarnaev is an immigrant who grew up muslim. In three weeks Opening Statements are set to begin. Here to discuss hln legal analyst and defense attorney joey jackson and jury consultant richard gabriel, the author of the book acquittal. Richard, i want to start with you. You have counseled the defense in a lot of highprofile case the o. J. Simpson case, the Casey Anthony trial, can tsarnaev get a fair trial in boston . Well as we know these highfrom profile trials challenge the Justice System in ways that sometimes theyre unprepared and illequipped to deal with. The truth is that the constitution actually doesnt even guarantee us a fair trial, but it does give an impartial jury and impartiality is the key. In the boston area the defenses made a change of venue motion but because this convenient uwas so affected by these bombings not only because they participated in the marathon but the manhunt afterwards and some even were tweeting because of the investigation. Jurors have very fixed opinions about what happened here and were profoundly affected by that. The difficulty and the challenge in finding a jury is how jurors will be able to separate themselves and what they already know about this case from the evidence theyre actually going to be hearing from the witnesses in that stand. Its not going to be easy by any means. Joey your thoughts about the fair trial . Its going to be problematic for the following reason. You have a terrorist act that affected an entire community. Obviously it affected the nation but you have people who are so directly impacted by this and you look at the people whose lives were lost. You say its three people. You look at the 260 people who were injured, you look at the 16 amputees. You look at the fact that the community was on lockdown for five days as the police attempted to bring this under control, and so the argument is is that everyone was impacted as this. Of course the country as a whole grieves and feels for the boston area but you talk about boston strong. You talk about something that brought that Community Together and devastated the community, i think its very problematic. Obviously, ana, the other side to it is look theres 1200 prospective jurors that will be evaluated and interviewed. Can we not get 1 and 12 for the alternate jurors. I think that will be a challenge because this is a Death Penalty case thats what this is all about in the trial, maybe not so much about establishing guilt. If you are a juror who does not believe in the Death Penalty, period you are automatically disqualified from serving on this jury. Yes. What is the defense looking for in these interviews with potential jurors and what else are they trying to exclude . You know great points ana. The first thing is this. We know that massachusetts as a state does not have the Death Penalty. And as a result of that i think thats telling as to the feelings of the people in the community, those who there are many other states that do have the Death Penalty, 32 but the reality is is that its a federal trial and as a result of that, youre governed by federal rules. Now having said that i think that you can make the argument that look maybe people in massachusetts are predisposed not to give the Death Penalty but those people predisposed not to will not be serving on that jury, because if youre not its not about your personal views, ana. Its about whether you can put them aside and do what you think is proper and appropriate under the law. So thats going to be the issue. But the defense is going to argue, as a mitigating factor not as a defense, but as what we call a lessening factor theyre going to say that he was so under control of his brother, that his brother so influenced him, that his brother so led him to do that that its not his evilness its not his lack of humanity. He was really pushed to do this by his brother. Will that work to save his life . I dont think this is a case about guilt or innocence. Most people would agree based upon the compelling facts and circumstances hes guilty. The issue for the defense, could they spare his life . If its an argument and its compelling they have a chance i think its a slim chance. This affected so many people ana. Richard, what would the defense be looking for and how might that differ from the prosecution in terms of the jury Selection Process . Well, the prosecutions looking for very black and white jurors. Theres a lot of jurors who come to Death Penalty cases who say once we get past the guilt phase then its sort of an automatic application of the Death Penalty. Obviously those people shouldnt be included but they oftentimes are. The defense is looking for people who are more willing to accept psychological explanations for behavior. They as joey said are looking for people who will say he can be influenced by his brother. There are some because of the way he grew up at his parents and the ethnic strife in the country were toward the extremist attitudes. If jurors accept those, they can apply what they call mitigating circumstances to it and spare his life. The other thing is that he doesnt look luke a killer. So sometimes his appearance by itself can actually work in favor for him and allow jurors to think that he was unduly influenced by his brother. And we know he was there in person for that first day of jury selection in the process as it got under way yesterday. The dow pledged 330 points after a huge selloff. The s p down 2 . Crude oil fell below 50 a barrel for the first time in five years. Fortunately the dow is up 20 points as trading gets started this morning. Joining me is rana faroohar. Is the market expected to bounce back at least as were seeing in the early stages. You may see a bounce back today but i think youll see a lot of volatility over the next couple of weeks. The plunging price of oil is unprecedented, down 50 over the last few months and this has a big effect on russia big geopolitical imp indications and the markets are just beginning to grapple with the risk this is introducing. Of course oil prices and gas prices go hand in hand. Gas prices seem to be getting a thumbs up from consumers but they could be seeing as a measure of the economy. What are the implications here . So the good news for the u. S. Is that the fall that weve mean . Gas prices is an amazing boon for the u. S. Consumer equivalent of 100 billion tax break. You see spending figures go up. The one downside so the extent the Lower Oil Prices reflect lower Global Growth and tougher times in emerging markets where u. S. Companies sell goods, that can ripple back to the u. S. Its a tricky balance. In the short term i think that overall this is going to be a good thing for the u. S. Economy, even if it makes the markets trickier in the short term. Some experts have argued thats 30 per barrel of oil is possible. Thats still 20 lower than what were seeing now. What would that mean for the market in that trickledown effect . Again, it would be an incredible boon for the u. S. Consumer. One thing people are worried about is the u. S. Shale production. Lot of the bullishness on the u. S. Economy in recent months is predicated on the fact that we have so much Homegrown Energy from the shale oil and gas boom but that oil and gas here at home is expensive to get at. It costs about 70 a barrel just to get it out of the ground. When you have price this is low it starts to take some of that production offline. That could affect u. S. Jobs. So its this tricky balancing act between a boon for Consumer Spending and possible job loss here at home. You touched on this briefly. Id like to dig deeper. What about the joe yo political concerns over low oil prices . Russia is a factor here china is affected venezuela is affected. Absolutely. One of the fascinating reasons that oil is going so low not just the fact that china is growing more slowly or europe is in a slump is the fact that the saudis have kept pumping. Traditionally when oil prices go this low they take supply offline to bring prices back up. Theyre not doing that. Theyd like to put pressure on iran and russia with whom they have their own political strifes, we do too, and those country need Higher Oil Prices to make their budget. Oil goes this low, puts them in the bad position but the saudis can ride it out. Tricky geopolitical game going on. Rana toforoohar thank you. Its difficult to flind airasia flight 8501. Short time ago we learned that crews have recovered the bodies of two more victims. That brings the total to 39 now, out of 162 passengers. Most victims are believed to still be inside the fuselage of the airliner but divers are no closer to locating the bulk of that wreckage. Again, miserable weather has prevented divers from even entering the water today, and one huge question remains unanswered who is to blame for the doomed flight taking off without the proper licensing . There are now reports that several airport officials have been reassigned because of this blunder, as the Ongoing Investigation is still under way. Joining me now cnn aviation analyst miles obrien, david gallo, director of special projects for Woods Oceanographic Institution in massachusetts and peter goelz, former director of the ntsb. Good morning, gentlemen. Good morning. Good morning. David, muddy water, zero visibility in the java sea. What needs to happen to make the search easier or more effective . They need a break, decent weather at the surface to get in and out of the water safely and they need to see what theyre doing at the bottom and they cant and its dangerous to be in the water diving with the wreckage around if it is breckage. They havent identified a single piece of wreckage on the bottom of the ocean yet. Miles, when the water is posing this many problems how can maybe an air search be effective . I dont think an air search is going to help out much at all, given this weather situation. This is the very weather that we think is somehow linked to what brought the aircraft down. At this time of year in that part of the world, this is unfortunately what you get most days. If this happened six months from now, itd be clear, youd be able to easily spot the wreckage but of course that very weather that caused the crash mean there would be no wreckage probably. Were hoping for Mother Nature to give the searchers a break. Peter what concerns you the most its more than a week and we have not found the fuselage of the plane. Well what theyve really got to do is as david and miles confirmed, theyve got to get a break in the weather so that they can do some serious grid searching with side scanning sonar to find likely wreckage locations, and then drop underwater vehicles down to search him. Dropping a diver down at 140 feet is dangerous to begin with but the bottom time for the diver, if its a scuba diver s very limited. Theyve got to get underwater vehicles down on probable wreckage results from the sonar scanning. If they cant do that its going to be a very drawnout affair. David, give us some perspective. How much longer can the victims and the plane remain underwater before important clues are simply lost forever . Well every minute that goes by were losing something, and for the victims, for the families and loved ones every day is torturous. Its been more than a week so its just horrific. Im sure the pressure is on the teams. Theyre not going to go past do something thats going to be unsafe but as peter said it may be time for plan b here. This doesnt seem to be working and it may be weeks before the water clears visibility enough to put divers down for any length of time. And miles, we know the skies above Southeast Asia are crowded. Now word that indonesia is suspending some of the airasia routes. Who or whats to blame for this big uptick of planes in the air in this part of the world . Well i think this whole idea about licensing and the number of planes in the sky i dont want people to put too much focus on that as they think about a possible cause here. Even if that were kind of one extra aircraft up there, air Traffic Control still separates aircraft in identically the same way. It might marge nammly increase the workload on any given controller but if this aircraft faced a huge thunderhead and needed to get around it is up to the crew and is at the captain and pilots discretion to take whatever evasive action is necessary to avoid it and they have onboard Collision Avoidance for other traffic as well. I think when we think about this unlistened flight what, we need to think about is the efficacy of the regulators in the region and whether the airline itself was cutting some corners. Those are important questions, but not primary causes of the accident necessarily. Peter if the ntsb were leading the investigation which its not, of course its indonesias version of the ntsb would the ntsb doing anything different at this stage in the game than what youre seeing done now . Probably not. We might i think the ntsb has an open contract with the u. S. Navy to do underwater search for them and i think there might be a little more structured search for the wreckage but no. I mean this is an open water search its tough. I think the indonesians have done a pretty good job so far in zeroing in on the likely location and as miles said you know the probable cause of this accident is going to start and be in the plane. The Regulatory Environment could possibly be contributing but the attention is going to stay on the plane. All right, miles obrien, david gallo, peter goelz, thanks so all of you. What a way to welcome the 114th congress that is gearing up for our first session today, this morning on capitol hill republicans seize on their most dominant majority in decades. The gop now controls both houses swept into office by voters generally discussed with washington. Two months before the midterm Elections Congress languished with an Approval Rating of just 14 , that is barely above the alltime low. Many blame the bickering, the infighting of a donothing congress. The outgoing class enacted only 296 laws the second fewest in modern history. The current low mark is 284 laws which was enacted by the previous congress. All this has some republicans calling for a change of leadership. Ill likely be casting my vote for the speaker. Ive kept a very open mind since the election. Lot of this is going to unfold before me because its a roll call vote alphabetically. Reporter youre hedging a little . I want to let everyone know that ive kept an open mind throughout the entire process. I have to on all issues that are controversial. Every vote is so important as we set up for the new session. Reporter john boehner campaigned for you. He did. Reporter raised money for you. Dont you feel a little bit of loyalty or the need to sort of give back and give him your vote . Well for me theres no one really running against him. People contact me they say vote for luie gomer. I like louie. Ive been talking to colleagues. He only has one vote unless he doesnt vote for himself for everything im gathering. Im not aware of anyone else. Vote for tre gowdy for speaker of the house. Hes awesome but he seconded the nomination for the speaker. Im trying to take the reality on the ground at home and talking to supporters and really analyze how this is going to unfold today with reality here in washington. Two years ago they attempted to make a move on the speaker. It fell woefully short of expectations. It was very disorganized. I was watching from afar i was very unimpressed and its important that with he standehe we stand united. In ron rald reagan said the result is not doubtful. We shall not fail when we stand firm we shall not fail. I think its important as we move into the next week passing legislation on the keystone xl pipeline and the heroes act and improve the 40hour week to a 0hour week. Lso means yours is not one of those ruby red districts out there. Do you feel the need maybe more than other republican colleagues to reach compromise . To reach across the aisle because youre are . F a swing district . The dynamics have changed. If i was here in the last who years off democratic senate. I come from a state legislature in albany where you have a democratic governor and democratic controlled state assembly where i could not have gotten anything passed through the Legislature Without working with colleagues on the other side. Right now 382 bills that passed the House Chamber in the last two years they were dead on arrival on harry reids desk to go to the president s desk for them to sign or veto. We need to have an open dialogue with our colleagues regardless of where theyre from. We now have a senate we can work with to get all these Great Solutions on the president s desk. You are going to be the only republican jewish member of congress when youre sworn in in a couple of hours. How does that make your role and your place here different, if at all . Well ive always been very outspoken on Foreign Policy for our support of our strongest ally in the world, in israel. So there will be opportunities to speak about principles i stand for. We need a stronger more consistent Foreign Policy. We need to understand that our enemies do not respect weakness they only respect strength and we shouldnt be urging patience on the part of israelis while praising the Palestinian Authority when they choose to root out hamas. So there will be so many ways we can speak up for causes we believe in. I share with my constituents that will improve americas Foreign Policy. Theyre assuming these subscribers will have netflix and hulu and an antenna. But its not a replacement for the cable bundle with hundreds of channels. Its important because of its part of an e electrocution toward for more options. I can watch tv on my phone or the big screen tv. No cable box. How does it works . It streams through whatever device you have. Theyre adding more and more devices. Dish is the first to do this but wont be the only one. Im about to post a story on cnnmoney. Com about how verizon, sony and directv are going to do this as well. Its a way to preserve the cable Business Model. This is a lucrative Business Model for Companies Like time warner which own cnn. The fact that the vast majority of american households pay for cable is something thats remarkable even though its costly and people hate waiting for the cable guy. In this internet age, these companies have to figure out a way to preserve the cable model and make it more convenient and portable. This is one way to do this. When you talked about it could be screamed to any of your dices. Its 20 device so if you want to watch it on your phone, if you want to watch it on your tv if you have more than one tv, this might not save you money. You have directv at home i have time warner cable. I pay one price for my whole house. Well this is per person so if you have four people at home, you might have to buy four subscriptions to.
