My next guest knows the pain of losing a child. His son sean bell was celebrating his Bachelor Party when he was shot and killed by police eight years ag goechlt he was leaving a nightclub with two friends when an altercation occurred. Thats when a team of undercover cops got involved. They fired 50 shots, ultimately killing bell. He was set to get married the next day. In 2007, three officers were indicted on multiple charges in bells case. Just one year later, they were acquitted, but they were later fired from the new York Police Department, and the city later agreed to pay bells family 3. 2 million. Bells father william joins me now. Thank you so much for coming in, sir. I appreciate it. Thank you. First of all, i want to get your reaction to the grand jurys decision. I dont know what they were looking at, if they saw this film. You see a couple officers have their neon his neck and his head pushed into the concrete. Now, a healthy person couldnt withstand that. Youre talking about five or six big men. Come on, thats a little kind of extreme. They really put something on him. I want to read you something that congressman peter king said, and ill show you what he said, too. First of all, he thanked the grand jury via tweet for doing justice. Then he told wolf blitzer that the officers actions were not responsible for the death. You had a 350 pound person resisting arrest. The police were trying to bring him down as quickly as possible. If he had not had as asthma and a heart condition and was so obese, most definitely he would not have died from this. Off the ser involved came out and apologized and said he feels really badly that he caused mr. Garners death. When you hear congressman king say these things, what goes through your mind . He dont really mean what hes saying. The man is 350 pounds. Youve got over 1,000 pounds on him. Like i said, with the Health Problems he had, it happened quicker. Without the Health Problems, he still would have had a lot of pain and a lot of he would have died either way, a healthy person, cutting off wind. You went through some of the same sort of thing. You sort of have to justifying your son was killed by police, right . Im sure a lot bad was said about your son. Thats always. Thats always the case. Regardless. Every young man that got killed, never had a weapon. Nobody had a weapon. Why is it so justified to kill these young people if they dont have nothing. They they was afraid, in fear for their life. He was a big guy. Id be afraid of him, too. They say a young man lunged at them. Youre supposed to know selfdefense. You can knock them out, hit them with a laser. With a taser. With taser, yes. In fairness, garner, while he did put up his hands, police say he resisted arrest. I want to read you something from the New York Post. Eric garner and Michael Brown had much in common. On the last day of their lives they made especially bad decisions, each broke the law, petty offenses to be sure, but sufficient to attract the attention of police. There are many new yorkers, politicians, activists, trial lawyers, all the usual suspects who will seek to profit from a tragedy that wouldnt have happened had eric garner made a different decision. He was a victim of himself. Its just that simple. I dont know how to take that. How do you create your own demise . I think theyre saying, youre breaking the law, you should expect bad things to happen. My son wasnt breaking the law. 50 shots. Did he deserve that . Lets think about that. Michael brown, thats breaking the law . Think about what theyre saying by breaking the law. A lot of people havent broken the law and still end up dead. Where do we go from here . There are protests all across the country right now. The president , hes gathered civil rights leaders and Community Leaders and religious leaders and police from across the country. What more can be done . Well, im going to say this. There are a lot of people that appreciate what im saying. Ill say this. If they committed a crime like we all see that they do, put one of them in jail. One of them have to go to jail to prove that youre tired of this. Of course theyre going to kill somebody and say it never going to happen to me. Look at my officers. Look what theyre doing. Theyre not on the force, but getting a pension, getting a paid vacation for the rest of their lives. Here, i have to suffer for the rest of my life. They will keep going on and have a family, have kids, have their own kids and raise them. But im short that. There were protests after your son was killed. Yes. There were protests after trayvon martin. Yes. Protests now. Is this the Tipping Point . Weve got to start doing more than that. Protests, it seems like theyre doing nothing. What do you mean by more than that . I dont know. Weve got to change the laws, get some laws that protect the people. Everything is protecting the police. I understand they have a hard job. Dont get me wrong. They have a very hard job. I admire them for what they do. Then again, some of them get too power hungry maybe. Theyre overboard. They dont care about another persons life. They figure whatever they do or asay is okay. Thats our problem. They need to change it by protecting them too much. You protect a person too much, their head gets swollen and they dont know how to react. They figure whatever i do its okay. Thats what i see after my son with more and more and more. Chasing a young man into his house and shoot him. Marching and protesting, its a good thing. Makes people aware of whats going on, but its not enough. Weve got to change the laws. Hell no the time for remorse would have been when my husband was yelling to breathe. That would have been the time for him to show some type of remorse or some type of care for another human beings life. Reporter new york citys mayor also saying last night that black lives matter, which he was echoing the phrase that many people out on the streets last night, whether it be here in times square or throughout the city were using as well. Many of those demonstrators say they will continue to protest in eric garners name. Carol . Jason carroll, i want to ask you about the difference between what you witnessed in ferguson after the grand jury decision and what you witnessed here in new york city. Tell me how they were different. Why was it so calm here in new york and not so calm in ferguson . Reporter part of it was due to the police response, the mayors response. Immediately after you had the incident with eric garner in july, you had william bratton, the Police Commissioner come out and say there would be the need for first retraining, more than 30,000 officers in terms of how they dealt with physical confrontations. He said there needed to be a review of the use of force in the department. Still supporting his police off section also the mayor and the city making continuous efforts to reach out to eric garners family. You really didnt see that in ferguson. Remember after the grand jury decision in ferguson, basically the mayor and many city officials went somewhat silent. Not the case here in new york city. You had the mayor immediately out in front of this speaking from the heart as he talked to the people right after the grand jury decision. You did not see that in ferguson. I think a lot of people here feel as though that made a difference. But also remember, carol, this is a big city that has dealt with controversial shootings in the past and unrest as a result of that. So they had experience to draw from which they did not have in ferguson. That is true. Jason carroll, reporting live from times square. New yorks mayor bill deblasio opened up his conference by talking about his biracial son, dante. I spent some time with ben garner, erics father, who is in unspeakable pain. Its a very hard thing to spend time trying to comfort someone you know is beyond the reach of comfort because of what hes been through. I can only imagine. I couldnt help but immediately think what it would mean to me to lose dante. Life could never be the same thereafter, and i could feel how it will never be whole again, things will never be whole again for mr. Garner. I dont know if that made a difference. As Jason Carroll told us, the protests in new york were peaceful despite thousands and thousands of people taking to the street. Was the difference between new york and ferguson the way Public Officials talked about the controversy . Clearly. I think the mayor really understood, and whats unique here is when he looks over at his breakfast table. He sees a young man who has been impacted or could be impacted by, not only stop and frisk, but these policetype shootings. Its a different dynamic. Thats why its really important that hes the right person at the right time to tackle this issue, because its not politics. Its personal. Boyce, i want to show you these two headlines from the new york tabloids. The New York Daily News says we cant breathe, right . And this is what the New York Post says, it was not a crime. It certainly shows there was a split in america. Ill ask you that question. Is there two Justice Systems, one to serve white americans and another to serve black americans . I think we have to realize we live in a country where there are people who always love police for good reason. When they see police, they know theyll be safe and be protected. Then theres a segment of society, particularly young black males who fear police, many of whom feel this way for logical reasons because the police are not there to serve and protect everyone. In many cases theyre there to protect the rich from the poor or the white from the black. I remember riding along with a cop one time my dat was a Police Officer for 25 years. I respect good cops. I remember a cop once telling me that theres a line in his city. He says, look, if youre black and youre past this line, theres a very good chance youre going to be stopped, theyre going to ask you questions, try to find out why youre there. I think the presumption of criminality amongst peet people of color is what people are fighting against. I hope the nypd is intelligent about this. What they have to understand is people are no longer afraid. Theyre speaking up on this because so many people have a personal experience with this kind of harassment, profile and brutality. Its going to have to stop. Paul, i want to ask you this question because you were in a former prosecutor, lived in new york city a long time, worked with Police Officers. Is the Justice System unfair to africanamericans . I think you can say yes and no to that. Certainly i think they are subjected to aggressive policing in a way that white new yorkers are not. I think theres certainly pear separation in the black community that they dont get a fair shake. I think if you look at cases on a one by one basis, sometimes its harder to prove that. The reason i say that, for instance, even in this eric garner case, is this case about race . Did this happen to him because he was black . Or did it happen to him because he was a 400pound man that the cops had trouble subduing . Would it have happened if he were hispanic oration or white . There were no racial epithets used in the eric garner case. There may have been a racial component to it. Certainly black people would say callan, you dont know what youre talking about, it happens to us all the time. It doesnt happen to you. It happened in this case because of race. I think new york is a place that strives to be fair because we have such diversity in the city and its reflected in our judiciary, our grand juries, police force and other areas. Can we do a better job . Yes, we can do a much better job. One of the things i read, and ill pose this question to you, eric, the reason there werent violent protests here is because there still is some sense of trust between the Police Department and the community. I agree. I agree. I think you have a mayor that understands that. Also i want to touch on the dynamics of what is at the core of the problem. At the core of the problem is we use Different Police tactics based on the communities that we are serving. You cant continue to go from zero to 100 when you are in a community of color and then you are very contemplative decision, slow moving form of enforcement. Eric garner, there was an opportunity for a conversation. There was an opportunity to deescalate the situation. That is how its used when you police on park avenue in manhattan. When youre on park place in brooklyn, theres no time for conversation. You believe youre supposed to go from zero to enforcement and that enforcement oftentimes is using Deadly Physical force. You were a Police Officer. Yes, i was. If you were involved in that whole eric garner mess, how would you have handled it . A couple of things. One, its about a conversation. Its about ensuring that i see this is a large person, get the necessary reenforcements there and have a conversation. Youre being placed under arrest. If i have to use nonlethal force, such as a baton, a taser, other nonlethal methods to make sure that im subduing the person, this is whats being done in other communities and not being done in the communities of color. I saw this as a Police Officer, i talked about it as place officer and continue to talk about it as an elected official. I got word that mayor deblasio is going to hold a press conference late are today and talk about the retraining of the police force in new york city. Thats a good thing, right . Absolutely. I think its a great thing. One of the things ive heard from a lot of cops ive spoken to is many of them are following orders. Many of them are just following their training. The good cops out here, i think they want to solve the problem as much as anybody else because i dont think they enjoy going into communities where people are already afraid of them, people already hate them. They want to weed some of this out as well. So i think that retraining police in terms of how they view all suspects is critically important. Even if you talk about new york, which i think does a better job than ferguson in dealing with this kind of thing, you have to remember there are tens of thousands of young black men in Rikers Island right now who were arrested for very petty crimes. Theyre spending years in prison for things that College Students do every single weekend, maybe carrying 5. 00 worth of marijuana in their pocket. We have to realize its the profiling and how you engage with a young black male that makes all the difference here. I guarantee you that if eric garner were a wealthy guy on wall street, theres a very good chance he would have been dealt with in the same way. Paul, i want to get your perspective. You come at it from being a former prosecutor, you come at it from a different angle. What do you think about this . I was a prosecutor in the same place that eric adams was a Police Officer, brooklyn. Im very much familiar with what happens on the streechlt i rode homicide cases in all the tough neighborhoods in brooklyn. My perspective is weve got to work on this. We have to train the police to be more sensitive in their relationship with africanamericans. I absolutely agree with this, i do not think this would have happened on park avenue. It happened where it happened because those cops for whatever reason felt threatened in some way by this big man and probably encountering a white 400pound person on park avenue, the threat level would have been less. Ill tell you something else, he was left to die on the street, and i think to me you could argue about whether taking him down on the ground was legitimate or not under the circumstances. They had the right to arrest him. But when the man said he couldnt breathe repeatedly, not to get an ambulance to save his life immediately is an utter and complete disgrace. No one administered cpr either, right . The grand jury didnt think it was criminal. We have civil remedies for the family that will deal with this. Theyll have a big lawsuit against the city of new york for this. This wasnt handled correctly. I have to leave this here. I want to continue the conversation because its great. Starting tomorrow the new york city Police Department will launch a Pilot Program putting cameras on its officers to record their encounters in public. Later today new york mayor bill deblasio will hold a News Conference about police retraining. Lets talk about these body cameras. Lets bring our panel, Brooklyn Borough president and former nypd captain eric adams, founder of yourblackworld. Com. Lets talk about the body cam thing, eric. We saw the video of eric garner and what happened. Yet the grand jury did not indict garner. Would a body camera have helped . It may not help in this case, but its a powerful tool. I push for it as a Police Officer and a state senator, as well as the technology that allows you to place cameras on guns. What the footage does is three things. One, it exonerates when the Police Officer didnt do anything wrong. It allows the criminal Justice System to look at Realtime Data and, three, allows for training. You can look at these videos, screen them through out the Police Department. What did we do wrong in this case . I know some people maybe disenchanted saying you had a video here. Dont let this get in the way of Real Technology being infused. Its really hard to not let that get in the way. Its interesting. I remember seeing a study in psychology where they showed that with children, when they know theyre being watched, they tend to not steal as much, not engage in sneaky behavior as much when they know theyre being watched. I think that applies to all human beings. I think officers, theres real evidence to show that, if officers know that somebody is watching the interaction, theyre more likely to do things by the book and to follow the law. Im in big support of these cameras. I think if you look at the eric garner case, for example, understand this is not the first time that someone has been unjustly killed by the police. This is the first time, though, that the whole nation got a clans to watch the entire interaction from the time he said im tired of you constantly harassing me to the point where he said i cant breathe. Thats what led to people being so reactive to this case. If this were something we were reading about with secondhand accounts, i dont think the effect would have been as great. Eric garner may have lost his life. But i think a lot of people will benefit from this tragedy. I must say garners family doesnt believe that. We got fresh sound from eric garners mother about body cameras. Lets listen. They had a video that represents a body camera. It did nothing. Try something else. So paul, ill throw that to you. So pictures sometimes dont tell the whole story. So what can we trust as citizens when we see these things . Its a good point. The problem with pictures is the angle in which the picture is taken. I watched commissioner bratton yesterday discussing this issue. If you had multiple cameras filming what went down, maybe you would have a different result. The officer that applied the choke hold said it wasnt a choke hold. I was putting him in a headlock to try to force him to the ground. We only had one angle to slow of that taken by a bystander. If all the Police Officers in the encounter were wearing body cameras, maybe an angle would have been better and you could have defined for certain whether it was a choke hold or not and maybe it would have changed the outcome. I want you to take a look at this video that was taken of this 12yearold boy with a toy gun in cleveland. We had video of this little boy pointing this bb gun at by passers. A man in the gazebo thought it was real. When you look at this video, it doesnt talk too much about what the officers saw. The officer said it didnt look like a 12yearold boy. It looked like a 24yearold guy. From this angle it does. As you can see, the Police Officer is a lot closer, right, eric . Exactly. Thats what the camera will help, it will help in these cases. Its a piece to the puzzle, not a panacea, not to fix all our problems, but it takes the conversation into how do we look at what happened on that scene . Let me tell you. We should not misinterpret this conversation that the communities of color dont want good policing. They do. They dont want innocent people to live their lives this is a National Problem and we need to look at this in a very national approach, how do we resolve this issue. Can you imagine if we didnt have this video what their story would be. This is an issue weve been dealing with for too long and its time to make more progress than weve made. All lives must be valued, all lives. We want you to rally, but rally in peace. Im determined to get justice for my husband. According to the new york medical examiner the choke hold that called eric garners death, he ruled it a homicide. His weight, his asthma, heart condition were contributing factors. New york congressman peter king believes if garner had cooperated with police he would still be alive today. I feel strongly the Police Officer should not have been indicted. Ive been following this case from the start. You had a 350pound person who was resisting arrest. The police were trying to bring him down as quickly as possible. Sanjay gupta joins us to try to determine what the truth is in this case. What killed eric garner in your mind . Its not just my mind. The medical examiner has release add report, carol, as you said. It was the choke hold, it was the pressure on his chest. It was the fact that he was what is known in a prone position, on his abdomen and chest on the ground. Those are the things that they say were the cause of death. Let me tell you, carol, just to put this in more perspective. They call this a homicide. They have different categories that they can essentially label the type of death. When you take a look at the type of categories, this is essentially what they had to choose from in terms of the manners of death, natural, accidental, suicide, undetermined and homicide which they picked. They didnt say this was an accidental death. They didnt say this was an undetermined death. So i understand the fact that they wrote, there was the other issues with asthma and obesity and heart disease. But theyre not saying that had anything to do with this death. Those are factors that he happened to have as well. The cause of death they say was a homicide due to that choke hold and pressure on his chest. But here is what people are saying, dr. Gupta. Theyre saying since garner was able to say 11 times i cant breathe, it meant he really could breathe. You cant talk when youre being choked. First of all, a couple things there. Choke holds can do several different things. One is they can compress the trachea. They also compress the carotid arteries that give blood flow to the neck. So there are several things that go on there. When he says i cant breathed and hes able to say that, and people say obviously he can breathe. First of all, theres a pragmatic sort of thing. She was in distress, so maybe still moving air across his vocal cords. The other part of this, sort of more mechanical. Think about this. When you talk, youre pushing air out across your vocal cords and thats how you make sound, thats how you make words. Its challenging to get the air back into your lunges if theres too much pressure on your chest. You have to expand your chest and rib cage to get air back in. He probably was having difficulty doing that. Its one of these things, hard to read too much into that. I wouldnt say simply because he was talking meant he obviously had no trouble breathing. There obviously was so trouble and it was probably progressive live getting worse. Dr. Sanjay gupta, thanks for making things clear for us. The continue seer ver zee surrounding garners death has many people asking whether there are two Justice Systems, one for blacks and one for whites. When lets talk about that with Vanessa Deluca and cnn legal analyst and prosecutor paul callan. Welcome to both of you. Before we get into that, the coroner ruled garners death a homicide. Wouldnt the grand jury would have taken that into consideration . They most definitely took it into consideration. Did it matter . Certainly its a piece of evidence weighed with all the other pieces of evidence in a case. Bear in mind when a case goes into the grand jury and even if it was tried in front of the regular jury, cause of death is always a big area of dispute. Dr. Gupta makes a compelling point that the m. E. Said choke hold and prone position and chest pressure caused the death. If youre the grand jury looking at it and theyre looking at the video, too, theyre saying he was still breathing after he hit the ground. So maybe the choke hold didnt kill him. Maybe it was the cop pushing down on his back causing the chest pressure. They were investigating pantaleo, the cop who administered the choke hold. Im speculating here because i dont know what went on in there, but ive presented a lot of cases to the grand jury. Thats the kind of hyper analysis they do. I think maybe the complexity of the medical situation caused them to say, well, we cant say it was all him. It might have been this guy. Is it fair to blame him for what the other guy did. The other officers got immunity, right . Yes, they did, to testify. I have a feeling thats what went down, that the grand jurors felt what happened was terrible but they just didnt think the proof was sufficient to nail one cop for it. I had former Police Commissioner of new york city on, smigser in schaeffer. He said he thinks the grand jury transcripts should be released, just like they were . Ferguson so people could read them for themselves. Would that satisfy your readers . I dont know that it would satisfy our audience completely. I do believe transparency is something that is sorely lacking here. People want answers. Were hearing from our audience of 13 million. Theyre all expressing outrage, grief, despair, disbelief at what theyre seeing. Theyre wondering is the system equal . Is justice applied equally for all of us . Where are the consequences and where is the accountability. When you see no indictment its almost as if there are no consequences, that there is no accountability, so, yes, theres incredible frustration. Theres a hash tag trending right now that i want to talk about. Its called crimingwhilewhite. Its used to disparity. I shovt shoplifted when i was 14. Criming while white, college parties, underage drinking, police let us clear out the party before responding to noise complaints. Here is another one. Tonight, black protester and i both ignore barricade and walk in street. Four cops pounce on him, im told to get in the pen. So paul, as a former prosecutor is there some truth to this trending hash tag . Are white suspects treated differently than black suspects . Theres a lot of truth to it. Frankly, when i was riding homicides in brooklyn, i saw it. Im not going to justify it, but ill tell you why it happens. A lot of times the police are most on alert and most fearful when theyre in high crime neighborhoods which sadly tend to be minority neighborhoods. Thats changing, by the way, in brooklyn especially, as the economics get better. Im talking about when i was riding cases in those days. The cops are on edge, fearful and afraid people have guns. More people do have guns than in wealthy areas. So, yes, the people in wealthy areas get better treatment. Now, it shouldnt work that way. People should be treated the same and we shouldnt be making assumptions about people based on where they live and the color of their skin. Thats what the law says. Human beings enforce the law and we need better training of our Police Officers and these body cameras we talk about in the last segment i think will have an enormous effect on policing because when the cops pull their tough guy routine in the minority neighborhoods, now theyre going to be on tape. I think theyre going to have to change their tough guy routine. I have a personal anecdote to share. Years ago i was sitting in a car at night admitted night with an africanamerican black friend of mine. We were just sitting there talking in the car, after drinking, a long night. I remember a white Police Officer knocked on my car window and asked me if i was okay. Why did he do that . Right . Because i was sitting in the car with a black man. Thats why he did that. I didnt know what to say to my friend. What do i say . You think about how much images that we see daily of black men and women, of black children, theres hardly any balance. Its primarily what youre seeing is really negative. If we saw a balance, maybe there wouldnt be those perceptions. Maybe there wouldnt be those leaps of judgment, maybe there wouldnt be this tendency to just assume, make assumptions about what someones intention is. Maybe there would be more treatment of people, all of us as human beings. I think, though, what muddies the water for people and it is understandable was that Michael Brown and mr. Garner both had committed crimes, right . They werent angels, they werent totally good guys, so theres some justification for the police to act in that manner. But does that mean that that had to end in death . It doesnt necessarily mean that. We dont know all the circumstances. But we do know, even when you look at some of the hash tags criming while white, you see example after example after example where those incidences did not end in death. Carol, the other thing, you have to look at cases individually. I dont think its fair at all to compare the brown case to the eric garner case. I mean in brown, its undisputed he had done what they call a strong arm robbery in the convenience store. Its undisputed he struck ld for the cops gun, the gun discharged twice. Its undisputed that he punched the officer in the face. Thats in the brown case. Eric garner is very different. I didnt see him punching any police off sefrmts sers, i see a big angry man saying youre arresting me for selling cigarettes, im not going to put up with it anymore. He was taken down. There was no consideration given to the man when he stopped breathing. I think its a very different case than the brown case. I think its unfair when you throw them in the same basket and say this is an indication as to how Police Conducted themselves in america. You have to look at cases individually. They were given to the university by the austin state Mental Hospital some three decades ago. Even as he was photographing them for a book entitled mall formed, he was hearing that half of the collection was missing and cure rateders were speculating about where they went.
