Rye not watch. New fallout and new questions this morning, did Michael Browns stepfather cause a riot with his words . And hands up. Hands up. Hands up. Hands up. A phrase, a call, a symbol, how a silent gesture has said more than any words possibly could. This morning, we ask this hands up. Dont shoot. Does it further the movement or incite violence . Lets talk, live in the cnn newsroom. Good morning. Im carol costello. Thank you for joining me. Louis head speaking out this rng mo, let me set the stage before we get to don lemon sitting to my right here. On the night the grand youry decision was reached louis head, Michael Browns stepfather maybe incited a riot when he uttered these words. Watch. Burn this [ expletive ] down. Burn this [ expletive ] down. Burn this [ bleep ] down. Somewhere in there louis head said burn the bitch down. A number of businesses were burned in ferguson and that night the Ferguson PoliceDepartment Said yesterday it was thinking of filing incitement to riot charges against mr. Head. Mr. Head talked with don lemon, sitting with me right now. He gave me a statement to read. I wanted to do an interview with him. He did not want to do an interview but a source close to him wants people to know. Something came over me as i watched and listened to my wife, the mother of Michael Brown jr. , react to the gut wrenching news that the cop who killed her son wouldnt be charged with a crime my emotions admittedly got the best of me, this is my family. He goes on to say i was so angry and full of raw emotions as so many others were and granted i screamed out words i shouldnt have screamed in the heat of the moment. I was wrong and i humbly apologize for what i want for the community. Its important to read the rest of the statement, to place blame, its more nuanced than that, but to place blame solely on me for the conditions of our community and country after the grand your jury decision goes way too far and is wrong as the decision itself, to declare a state of emergency and send a message of war and not peace before a grand jury decision is announced was also wrong. In the end ive lived in this community for a long time, the last thing i truly wanted was to see it go up in flames in. . Spite of my frustration it hurt me to see that. Its time to rebuild. If we are to honor Michael Browns memory we need to Work Together to make rebuilding happen. I plan to do my part in earnest truth. Signed from louis head, feeling the pressure that he needed to Say Something about this and show some remorse. Even though his wife said he spoke out in anger we had not heard from him. Have we heard from the Ferguson Police when theyll decide if theyll charge . I havent spoken to the Ferguson Police today. My producer spoke to them yesterday about it and justice reporter evan perez is digging on this. I dont think the prosecutor knows anything about this. I dont think its gone beyond the Ferguson Police chief making statements on another network looking into the possibility. So im not sure how much is there. Well have more information for all of you coming up in the newsroom. Don lemon, thank you, i appreciate that. Charles barkley, scumbags, what he calls looters in ferguson who burned buildings after the grand jury decision and he is sticking to that comment plus he says its ridiculous to think white cops are out there killing black people. Barkley opened up in a radio interview and last night he sat down with Brooke Baldwin. Lets begin with the news of the day, Michael Browns stepdad is being investigated for saying eight different times burn this b down the night the grand jury decision was made public, and hes being investigated for inciting a riot. Do you think that is fair, should police be pursuing that . No, i think under the circumstances this has been an awful incident for everybody, and i just think theyre just, it clouds the discussion. Ing there theres so much noise you never get to the crux of the discussion. So no, i dont think they should pursue charges against him. What about all the walkouts and the protests and youve definitely caught some, you know, slack for call some people number one i havent gotten any slack. I dont do social media and i dont sit around and read what everybody thinks about me. Scumbag comment . Respond to that. When you loot peoples property thats what you are. Thats against the law, thats against your property. You dont want people to do it to your house the stepdad he dont want people to burn down his house. Its all a bunch of noise. People protesting peacefully thats what the country was built on but to burn peoples property, Burning Police cars, looting peoples stores, thats 100 ridiculous. Do you think we would be seeing all of that, had this been a black Police Officer, had Darren Wilson been black and all the facts remaining the same, we would still have a slain 18yearold. Would the outrage be there . No, because we have a racial issue in this country. Weve always had a racial issue in this country, and the biggest problem with it is we never discuss race until something bad happens. We never have meaningful dialogue over a cold beer when things are going good, but what happens is, everybody, when something bad happens everybody has a tribe mentality, everybody wants to protect their own tribe, whether theyre right or wrong. What do you mean when theyre right and wrong . We all got bad characters in our group, we all got bad characters. My grandmother told me you individual merit. You dont care what every jackass has to say. Black is not always right and white is not always wrong. You got some bad apples taking advantage of the situation and thats unfortunate, because this is serious somebody lost a child and this is something we need to seriously sit back and discuss and figure out what happened, what went wrong, but im going to say this. The notion that white cops are out there killing black people is ridiculous. Its flat out ridiculous, and i challenge any black person to try to make that point. This notion that cops, cops are actually awesome. Theyre the only thing in the ghetto between this place being the wild, wild west. I hate that narrative coming out of the entire situation and the thing that bothers me the most, brooke, is that the notion that all these people are standing here saying if they indict him they were already going to riot. No matter if there was an indictment or not . No question. Because your mind does not go from let me sit here and listen and let me go and just start Burning Police cars and tearing down buildings. That just doesnt happen. You know, im hearing so much from different people, friends, people who come on my show, africanamericans saying listen, brooke, you know, i was taught as a young age, i have different rules than you do when i deal with police and there is a lot of getting that off peoples chests right now because of what happened in ferguson, theres a lot of anger, theres a lot of frustration. What can we as a country do with that, this energy right now . First of all, we can open a dialogue and i think thats probably what i did was open a dialogue. Brooke, in fairness, theres some black people out there who are crooks and when the police come to your neighborhood, its a tense situation. The only time you interact with the cops is when things are going wrong. Thats the only time we ever interact with the cops, but first of all, we, we as black people, we got a lot of crooks. We cant just wait until Something Like this happens. We have to look at our self in the mirror. Theres a reason they racially profile us at times. Sometimes its wrong but sometimes its right. So to act and sit there and act like we hold no responsibility for some of this stuff, thats disingenuous. And Brooke Baldwin joins me now. s aa tough guy. He says i dont care what people say but people have been calling him stuff like uncle tom. In the wake of the radio interview, part of the reason why i picked up the phone, lets stop talking about you, i want to talk with you. This is just him speaking within the africanamerican community. Hes like we cant agree to disagree. There have to be names and labels like uncle tom and traitors. This is sort of his reputation. People run into on the street they say thank you for speaking your truth all the time. His issue is initially when the whole story broke and there was so much misinformation he and still his heart absolutely bleeds for Michael Browns family he said initially i was infuriated because he was hearing dribs and drabs and he assumed the shots hit him in the back and he didnt want to talk to anyone until the grand jury had made the decision. He has, Charles Barkley told me, he has read through all of the minutia of the testimony, the forensic evidence. He was citing the autopsy with me. We talked for a half hour and he said people just jump to conclusions. They hear headlines, and were a society that lives in 140 characters or less and we dont get on to the second and third graphs of a piece, so he has thus made his conclusion based upon what he has read. He says the facts of the case and if you dont agree with him, he says sorry. I do like what he says about getting the conversation going, because its important to have this conversation in a meaningful way, right, thats what hes trying to do. For sure. We chatted long after the interview. Charles barkley is a man who likes to speak his mind and he has a lot of Police Officer friends and ive heard, too, from officers, im sure youve had Law Enforcement on your show, black and white and he said some of their fears are just based upon how people are feeling about certain officers, certain people feel targeting africanamericans, africanamerican youth. Some cops are saying to charles, listen, you may be on your own and thats a frightening thing to think about. Brook baldwin, thanks. I appreciate it. Shes coming up at 2 00 p. M. Eastern time, lots more. The entire interview with Charles Barkley in the newsroom with Brooke Baldwin 2 00 to 4 00 eastern on cnn. Ill be right back. [ male announcer ] this man has an Accomplished Research and Analytical Group at his disposal. But even more impressive is how he puts it to work for his clients. Morning. Morning. Thanks for meeting so early. Oh, its not a big deal at all. Come on in. [ male announcer ] its how edward jones makes sense of investing. I told you at the top of the show the Ferguson Police were thinking about filing incitement to riot charges against Michael Browns stepfather, louis head. Louis head gave a statement to our don lemon saying the last thing i truly wanted was to see ferguson go up in flames, but still the police are investigating. You see the pictures of the night when that grand jury decision was announced not to indict officer Darren Wilson. Justice correspondent evan perez has been talking with police authorities, has some new information about these possible charges. What can you tell us, evan . Well, carol, we dont really expect these officials do not expect any charges to come from this investigation. Locally people look at this as something of a stunt by the Ferguson Police chief tom jackson who has said a few inflammatory things in the last few weeks, if you remember he also said that officer Darren Wilson would be welcomed back to the force if he wasnt indicted. Lot of people took that as something very inflammatory given the tensions down there, and this one is sort of seen in the same way. The reason for the fact, for the view that this likely wont get to any charges is the fact that this incitement of riots charged would stage a high bar simply because you have to prove that anyone out there went and rioted and burned things down based on what this one individual said, the stepfather, louis head. Thats a very difficult thing to prove and frankly Law Enforcement down there wants to try to cool things down. They dont have any appetite for bringing charges in Something Like this especially in light of all the reaction to the grand jury decision. One of your sources said he wished the police chief would just shut up. Why doesnt he . This is partly the reason why theres been an effort down there to try to have him step aside. This Police Department and this community is trying to hear and all he keeps doing is stepping in it to frankly to cause problems and thats the view of a lot of people down there. Theyd like him to move aside. So the department can move ahead with reforms. The Justice Department is still doing an investigation of the Ferguson Police department then i think youll see some pressure on jackson as time goes on. Evan perez reporting live for us this morning, thanks so much. On to other news and something you will not see anywhere else, we take you inside kobani, thats the syrian city thats been torn apart by isis. Cnn got incredible access to the heart of this town. Our Senior International correspondent Nick Paton Walsh and his crew made the dangerous trek across the border and into kobani. Weve been taken down this street towards the Eastern Front line behind those curtains theyve put up to protect them from snipers, two of the fee miami ypg fighters are escorting us down there, near the Eastern Front where theres been much more intense fighting in the past three or four days. While we get differing figures from who you speak to here about how much of the city is controlled and you see here quite remarkable devastation caused by the explosives used. Isis far from giving up this fight, trying to take ground every day. The move toward the official Border Crossing three or four days ago that was a substantial advance. They tried, they were beaten back but each night particularly last night, with he had very intense clashes further down this street towards the Eastern Front here. You can see the absolute devastation here as we get closer towards isis positions here to the north southeast of the city. Some of this caused by air strikes but the constant every five minutes thump of mortars pounding into kobani for months now. We can see turkey literally just behind us, but here theyre edging through this wreckage closer and closer to the places where isis is trying to push forward. Just incredible pictures of devastation. Nick paton walsh joins us live from the turkish side of the border with syria. I cant believe civilians are still living there. Its hard to know how many are in there. People are coming back to protect their homes but its hard to see how anyone can live. The conditions are remarkable. You hear a Coalition Air strike go in, normally three separate explosions, it shakes the walls and the floor youre in and around you during the nights you hear the mortars land, often homemade bombs, a gas canister for example for domestic heating filled with bits of scrap metal and launched indiscriminately at civilian areas. During the night we think we heard some of that shrapnel clanging as it hit the concrete streets around the area where we were. Very difficult time for civilians there. They say food is lacking, fuel for heating and its increasingly cold winter and increasing now isis moving towards the center of the city. Weve been told 20 , 30 were in isis hands. They have about half of that city, the fight still ranging at night. Endless machine gunfire, hard for children. One group scuttling into a room to show us where they hid when bombs began to land, simply cushions piled on them for protection. Carol . Wow. Nick paton walsh reporting live for us this morning, thank you. Still to come in the newsroom, bill cosby may be heading to court after all. Bill cosby may be forced to respond to allegations of Sexual Assault for the first time in nearly a decade. Woman in california has now filed a lawsuit claiming the comedian molested her at the playboy mansion in the 70s when she was just 15 years old, that means she was a minor, right . Jean casarez joins us now details on this, and that matters. And we got the complaint it does. We got the complaint right here, filed yesterday in California Superior Court and carol, what is interesting is that this alleged victim, and she is named in the complaint, judy huth, she says it was 40 years ago, in 1974, she was 15 years old, her little friend was 16 years old and they went to a park, the complaint describes, in san marino, california. Bill cosby was filming a movie there, they went up to meet him. He said the next saturday, i want to you come to my tennis club, so they went. She then says he said lets go to a house. They went to a house and its alleged in the complaint that he forced her to drink a beer every time he won a game of billiards. Then according to the complaint he said, ive got a surprise for you. Its alleged he took them to the playboy mansion. She then said i have to go to the bathroom. She went to the bathroom, he led her to one off of a bedroom. She comes out of the bathroom she alleges he is sitting there on the bed and begins to sexually molest her. Those are the facts as alleged in this complaint which was filed yesterday. So because she was 15 at the time, she can go ahead and file this complaint and because of the california law, it allows her to do that. Thats the big question and thats still going to be a question. Every state is different with their laws but in california, they passed a law in 1990 which states that if you suddenly as an adult, not only realize that you were abused as a child, but you connected then to psychological injury or illness, and the study shows that sometimes you dont understand this until youre an adult, you can bring an action within three years of that discovery. Heres Something Else that i think is fascinating. I was looking at some of the procedural notes under california law, before somebody files an action like this, you have to go before a judge in his chambers or her chambers and you have to file a certificate of merit as an alleged victim, and the judge needs to look at that, to see if there is some corroboration, to see if theres some authenticity of what youre saying and a Mental Health professional has to file a certificate of merit. Furthermore, its a john doe in an action thats filed until there is corroborating information thats presented to a judge, and this complaint states the name bill cosby. Not john doe. So any word from the cosby camp . No, weve reached out to marty singer, his attorney, throughout the night. We have no response at this point but with an action being filed there will have to at least be a legal response from his team. Uhm auto sure youll be on it. Jean casarez thanks to you. Full of school kids, two buses collide, three people are dead and authorities want to know why. It has become a rallying cry in the wake of the Michael Brown shooting, hands up dont shoot, the phrase inspiring a nationwide movement of the same name earlier this week. The students at yale joining with others across the United States walking out of class and work to protest. In the sports world, members of the st. Louis rams raising their arms as they ran onto the field in sundays game. Their actions slammed by the st. Louis county police who said it was offensive. Even capitol hill several members of the Congressional Black Caucus raised their hands on the house floor. Former head of the cbc wolf blitzer speaking about their reactions across the country. I think some people on the right are trying to make that into some kind of black panther statement and it was not. It was a symbol of their belief that something has to be done and frankly youll see a lot of that around the country, the same withal raches saying michael ploun was angelic. They were saying its a problem and we need to have it addressed. Lets talk about the gesture. L. D. Granderson is a cnn political commentator. Good morning, l. Z. Good morning, carol. Do you agree with the congressman . Absolutely. You know, i think from the very beginning, if you go back and look at all the media coverage, many of the people who were surrounding Michael Browns body as it was lying on the ground werent saying he was an angel, werent saying he was innocent. They were saying his hands were up, and if you go back and look at the grand jury, most of the witnesses gave an eyewitness account of his hands being up. We have cell phone video of them saying his hands were up, but more importantly, at that time, many people, myself included, were talking about the fact that the emotions surrounding this wasnt isolated to the Michael Brown and officer Darren Wilson, wasnt isolated to ferguson. It was symptomatic of a much larger issue and that is the distrust between minorities and the police force and the hands up gesture continues reminding us of that disparity. Lets get back to what the congressman said and i know what you said about the witnesses who said Michael Brown had his hands up but there are also witnesses who didnt say that, who said there was no indication that Michael Brown had his hands up and i want to read something that rich lowery wrote on police co. He says the bitter irony of the Michael Brown case if he had actually put his hands up and said dont shoot, he would almost certainly be alive today. His family would have been spared unspeakable loss and ferguson, missouri, wouldnt have experienced multiple bouts of rioting. If Michael Brown did not have his hands up, isnt that true . Well, i dont know. Theres a video in september of a black man pulled up on video in south carolina. The Police Officer says show me your drivers license and i. D. So the black man reaches back into his car to present the wallet with his i. D. In it and the Police Officer starts to yell and shoot him and he actually shoots this man with his hands up as hes falling back. That is on video. So i dont know what the Political Writer perspective of the world is. All i know is there has been multiple evidence for many people in Minority Community that sometimes crooked Police Officers do bad things, and to do bad things in the shadows but the minorities who suffer from this they see it and because of technology, because of dashcams and hopefully because of body cams, the Larger Society are beginning to see some of the things that the Minority Community has been experiencing by corrupt Police Officers, not the Police Department but corrupt Police Officers for a very long time. Well, were at the point now though when were actually talking about this and some plans are being put into place to try to combat the problem, right . Were talking about it. So some Police Officers say that protesters continuing to put their hands up, it just incites bad things when we should be talking to one another in a civil way. Well, i think that suggesting that nonviolent protesting incites violence is very shortsighted and goes against what weve seen throughout history. It is not the nonviolent protesters that causes violence. It is usually one of two things. People who are hidden within the nonviolent protesters who are causing violence and those who object to the message of those who are protesting and find no other way to engage this group but to be violent themselves. Weve seen that in our countrys history but global history, you look at india and the way they reacted to gandhi. He was not violent but he was beaten. Instead of focusing in on whether or not nonviolent protesters are inciting violence they should focus why theyre protesting and protesting because of incidents in south carolina, because of what happened with and i understand what youre saying, but also, officer Darren Wilson has to have protection. Hes receiving Death Threats. He cant live freely. So isnt that a problem . Well its also a problem that you have a large swathe of community in the United States that felt as if they havent been able to live freely for a very long time, again, ferguson is a microcosm of the problem. Look at the arrest rates, the amount of times pulled over, look in new york city and the evidence of stop and frisk producing basically no contraband and yet they continue to do it. Those people are not living freely either so i can definitely sympathize with Darren Wilson feeling as if hes being handcuffed by this incident that happened in the summer, but keep in mind, all that this energy and emotion you see connected to this trial, to this case and to officer wilson is not solely about him. It is about decades and decades of this frustration bubbling over, and if i can just add one more thing about living freely, you know, George Zimmerman is alive today. He also was the target of multiple Death Threats and also the target of a lot of violence. I havent seen a single report in which he actually has been attacked and as i said today, he is still alive, and so i dont want to dismiss officer wilsons concern but i havent seen a report in which people have actually retaliated against the men and women who have committed these atrocities against unarmed people. L. Z. Granderson thanks for the conversation. I appreciate it. Thanks, carol. Checking other top stories for you this morning, is a woman detained in lebanon the wife of isis leader abu ak are al baghdadi or not . Iraq says no. Sadly it is that time of year losing College Football coaches get the axe and the biggest to fall so far is brady hoke. Michigan fired hoke after a disappointing 57 season for the once dominant program, but there was, was there more to hokes firing than just losses . Back on september 27th, hoke kept his quarterback, shane morris, in the game against minnesota after a particularly hard hit. At his press conference the following monday, hoke said morris did not suffer a concussion. In a classic middle of the night statement dump the Athletic DirectorDavid Brandon said morris suffered a mild concussion and mistakes were made, possibly shouldnt have been allowed to play the rest of the game. Before we get into the concussion controversy, what happened in michigan . Once mighty michigan . Its just sad. Yes, theres no doubt, and i do want to say about this concussionish e, brady hoke was fired because he lost football games. The concussion issue certainly added to a feeling of distrust around the program this season but that is not why brady hoke was fired. Brady hoke was fired because his win total went down every season and that is not the direction you want to go and also had an impact in the attendance. Michigans last football game, and this goes to how bad the program has fallen, worst attendance in nearly 20 years. Now when you michigan prided it self on the fact they sold out games. You bite into the universitys cash cow like that, youre losing your job, thats whats going on and they havent been good for such a long time. It used to be the big ten and michigan and ohio state were the rivalry now it seems nobody cares. You dont want to tell that to people in columbus, ohio. You should take a look at this picture, these blankets are what they were putting on babies born in the michigan game. Theyre still into it there. They were indoctrinating the newborns whether they like it or not. There is no question. It. Ohio state won 10 of the last 11 of the games. Certainly people around the country are not going to pay as much attention and the big ten in general flipped so much, people look the at the sec, the iron bowl, alabama. Things have changed. Lets go back to the concussion for a second. I know coach didnt know about the concussion because there was miscommunication on the sideline but still he took the blame. The kid took a hard hit, right . So you say hoke didnt get fired because of, that he got fired because he was losing which i find sad. Shouldnt that enter into the picture somehow . I think they took a look at more seriously with doctors doctors communication on the sideline and maybe when the Athletic Director got fired that may have played into it but with the coach it comes down to the win loss category. Thats a lot of time what football is about and the fact that, yes, concussions have not taken the stage as much when we look at the pro level. Weve had all sorts of incidents that weve seen and all sorts of postconcussion syndromes when you look at players who have retire. But was what does it come down to . Wins and losses. Rachel nichols, i appreciate it. Still to come in the newsroom, america talks back about Climate Change. Are yo a believer . A naysayer . Divest harvard is a campaign i cofounded at harvard. Were trying to get our endowment, which is 36. 4 billion to divest from fossil fuel companies. Wow. Thats an insane amount of money. It is. Its the largest endowment in the world. But, you know, we think harvard is not a cooperation and that profits shouldnt be our main motivator. Our main motivator should be about the students and how can we invest in fossil fuel companies that are threatening our futures . Its an immoral bet against my generation. Have you met with any of the higher ups at harvard . We have. When the students meet with faust our meetings are off the record and we have no way of telling people we hear in these private meetings but we need to because the arguments make no sense. Theyre inconsistent and illogical. One of our trustees, a wealthy white man, told us Climate Change affects him because he needs to install a 50,000 bulwark on his summer home in canada. Then we had another trustee tell us that we should thank b. P. For developing Renewable Energy rather than divesting. I think if you look at the effects of the fossil fuel economy on communities today, the destructiveness warrants a rethinking of where we get our energy. Its not one day we turn off the switch on fossil fuels and bam we have Renewable Energy economy. This is a process. Were trying to show how the fossil fuel industry has spread climate denial throughout our society and spread all this confusion about whether Climate Change is real or not. But Climate Change is real and it is caused by humans and we need to do something about it. I did reach out to harvards president and shes not talking, at least to me. She did write a letter to the harvard community. Dr. Faust said divestment is likely to have a negligible Financial Impact on the affected companies. And she added you have a stronger voice if youre invested in the fossil fuel industry. If you want to read more, i have an oped on cnn. Com. You can post a comment on my facebook page.
