Obvious conclusion and one they could have drawn a long, long time ago. And then just days after President Trump was accused of meddling in the federal case against his longtime friend and adviser roger stone, another former member of the president s inner circle may also be getting an assist from attorney general bill barr. Were talking about Michael Flynn, the former National Security adviser who pleaded guilty to lying to the fbi. Officials tell cnn that barr has ordered a reexamination of several high profile cases including flynns. Lets get right to the white house and cnns john harwood. John, how is the white house reacting to all these developments . Reporter brooke, the president s speaking right now at a border policy event. Have not heard, at least as i came out to the camera, him address the mccabe developments or the flynn developments so far. Well see what happens the rest of the day on twitter and in terms of his own remarks. But i do think the second of those two events that you recounted is much more significant than the first. With respect to andy mccabe, that was a case that was made difficult even though the Inspector General had pointed to places where he argued that andy mccabe had lied, the president himself had injected himself publicly in that case in all the ways that bill barr was complaining about the other day. That was going to be a difficult problematic prosecution under any circumstances. But in the case of flynn, that reflects the real sense of momentum that the president and his allies have been acting on ever since he was acquitted by senate. Remember, a few weeks ago Michael Flynn sought to remove his guilty plea, withdraw his guilty plea. That was denied. Then we get to the sentencing phase of the case and youve got bill barr ordering a review, which is what bill barr and the Justice Department did with roger stone. Of course, the president complicated that by speaking out and causing a backlash, which required barr to give that extraordinary interview to our colleague Pierre Thomas of abc yesterday, but this a case where the president and his the People Associated with him are really going hard at what they consider the deep state, the intelligence agencies, all sorts of reviews going on. The question is going to be how far does that go . Is this a matter of bill barr going through the motions and then ultimately stepping back, or is he actually going to try to open and move the ball, reverse some of the actions that have been taken in these cases. We wont know the answer to that for a while. No, i think thats the key question. I thought you hit the nail on the head using the word momentum. Well come back to that in just a second. Lets go to our senior justice correspondent now, evan perez and also susan glasser, a staff writer for the new yorker and a cnn Global Affairs analyst. Evan, just first to you. Last couple of days at doj have been a whirlwind, lets put it that way. And well get to Michael Flynn in just a second. First the decision not to charge andy mccabe. Why announce it now, and was this at all expected . The mccabe case was difficult as john has hinted. Theres a lot of problems with it. It was always going to be a very difficult case. Brooke, i think one of the things that you have to remember is just a couple of months ago they had indicated to the mccabe team that they thought charges would be coming. So the question is what has happened in intervening period that has caused them to reverse course . And we still dont have an explanation for that. We know that this is a case that came out of an inspector ygenerl investigation. Today is valentines day as you know, brooke, so this is a bit of a valentines day surprise, i think, for the president s supporters. The idea that mike flynn who has been campaigning with the idea that he was maliciously prosecuted, that his case is now going to get this review, is i think, being welcomed by some of his supporters. But at the same time one of the things thats happening in the court dob cket, in the court documents, you see that the department has to make sure they can defend this case because mike flynn is fighting it, so that could also be the explanation for what is happening here. Lets jump to the mike flynn news and dig a little deeper. We know that the attorney general bill barr has ordered prosecutors to reexamine several high profile cases including flynns. Susan glasser, your assessment . El witwell, look, first of as is very much it seems part of the wholesale assault on the Mueller Investigation that the president has wanted for a long time. Lets remember that flynn actually pleaded guilty, you know, in the mueller nfg investigation. So hes now subsequently had a rupture and complained about it. But if you look at President Trumps rhetoric around not only the flynn case but, you know, anything associated with the Mueller Investigation essentially has been toxic to the president. Hes been at war with it since the beginning of the investigation itself. Skpe you kn and you know, i think in many ways taking a step back, it seems like the president in some ways has already won. He has essentially sought to undermine confidence in his own Justice Department, his own fbi, and the legal system as part of this Political Campaign against being damaged, and you know, you saw the attorney general make this interview yesterday. The effort to restore credibility, though, is going to be very, very difficult. Trump has passed into question the independence of american prosecutions at this point. Let me get to that bill barr interview. If people havent seen this, evan, this is going to be for you. Bill barr is the central figure in all these huge doj headlines weve been reporting on this week. But last night he addressed President Trump directly on the issue of how the president s been inserting himself in these cases via twitter, and suggestions that he is doing the president s bidding. Here was bill barr. So youre saying you have a problem with the tweets . Yes, well, i have a problem with some of the tweets, not going to be bullied or influenced by anybody, and i said at the time whether its congress, newspaper, editorial boards or the president. Im going to do what i think is right and, you know, the i think the i cannot do my job here at the department with constant background commentary that undercuts me. So here is what everyones wondering, and especially after this flynn news has broken today, like, is that evidence that there is now this line in the sand between bill barr and President Trump, or is this more of like a wink wink, mr. President , i got you . I think its a bit more complicated. I think youre hitting at the complication thats going on behind the scenes, brooke. I think one of the things thats happening for bill barr is that he absolutely needed to Say Something to show a little bit of daylight between him and the president because, frankly, the Justice Department inside, theres a lot of discomfort with the events that happened this week with the roger stone case, and just everything about, you know, his rhetoric, the attorney generals other rhetoric in the way he talks about things, it matches the president in so many ways. Thats one part of this. The other part of this, in that interview he also communicates very strongly he still stands by his decision which was disastrous this week. The way they roll it out was bad. They were abiding by Justice Department policy, which is to be tough on crime, and so he was doing a couple of different things. He was, again, giving a message to the troops but also telegraphing to the president that, look, im still doing the things that you want me to do. I just wish i would stop talking about it. Mmhmm. And suzanne, i know you wrote about barrs remarks and the impeachment and trumps behavior Going Forward. Let me quote you, a month ago congress had at least the theoretical power to do something about his overreaching. Today thanks to the senates clear vote it does not in the history of the trump presidency, there will be a before impeachment and an after. It is too late for lessons learned, and its most definitely too late for bill barr to complaint about the president s tweets. The con strastraints are gone. The leverage is loss. Are we, susan, then at this Tipping Point . Is there anyone who can and will serve as a check to the president . Thats whats striking. You know, you can read, again, theres ambiguity in the attorney generals interview. Hes essentially saying im on the team with you. This is a tactical dispute, i cant be as effective as you want me to be in your agenda casting into doubt and into question the museller investigation and anyone who is critical of trump. Is it two guys on the team having a dispute about tactics . Is it barr and Mitch Mcconnell in the senate trying to restore a sense of leverage or constraints knowing that the president has been on a tear ever since this acquittal. You know, my own view is that, you know, we know President Trumps personality pretty well wel. This is man yesterday morning in a tweet he called it the quote Justice Department, im putting scare quotes around that. This is the guy who the Justice Department reports to him. This is a key part of the executive branch, so his view is very clear, which is theres no such thing as independent justice in america. And you know, i think bar has been right there with him from the beginning. So its really hard to see this as anything other than perhaps a way to restore some credibility inside the department, but i think this notion of independent justice in Trumps Administration has been pretty much tainted. I dont think theres going to be credibility Going Forward nrn unfortunately. Whatever you think about donald trump, thats something we havent seen before. I was about to report on what youre you give me the news about his response to andy mccabe, go ahead. No, i hadnt seen that actually. Can i let me if i may because i think we do need to get to this. Weve just learned from jim acosta at the white house. President trump was angered by the decision by federal prosecutors not to pursue charges against andy mccabe. Go ahead. That was predictable, but also brooke, you noticed this morning in his tweet this morning reacting to the barr interview, he makes his point again saying, look, i hear you bill barr, but if i want to interfere with the Justice Department, i can do it. Im just choosing not to. Does he respond on twitter to andy mccabe, i think this all just continues to unravel and could get quite dangerous. Well see. The other breaking story on this today, Michael Avenatti, remember him, the attorney who first made headlines for representing Stormy Daniels in that lawsuit against President Trump. He has now been convicted on all charges connecting to the attempted extortion of nike. We have more on that. Avenatti tried to extort nike by threatening to publicly accuse the company of illegally paying amateur basketball players unless it paid him millions of dollars. And so now the jury just found him guilty of attempted extortion and wire fraud and his Attorney Says he will appeal. Nike just released a statement. Let me read part of this for you. Are you surprised . Not surprised but this is a shocking turn of events for someone who was riding so high. If you can recall in 2018 or so, Michael Avenatti was a mainstay on cable news where he was representing Stormy Daniels and taking on donald trump even at one point he considered running for president and started making visits to iowa and meeting with potential voters so to see him in a federal court being convicted on all three counts and we should note this is not the end of his legal charges. There are two other federal cases waiting for him, one in new york and an additional trial that he will face in the spring in los angeles. Right, which, according to, you know, elie honig who called in with regard to the charges in california, his guess was that legally speaking thats an even steeper hill to climb for Michael Avenatti. Do you agree . Oh, absolutely. The charge in california stems from his interaction with clients and the allegations are that he actually stole money from his complianlients that we of settlements he had obtained on behalf of his clients. Those cases there are bank records, there are documents so the case for the prosecutor becomes a lot easier. The nike case involved conversations, a tape recorded conversation that avenatti had with the representatives of nike. When he gets to california theyre going to be looking at pretty clear written documentation that i think is going to make it difficult for him to prevail. Areva, thank you for weighing in. Lets get you back to the race for 2020. The eight remaining democrats are setting their sights on the more diverse contests in nevada and South Carolina. Joe biden, senator amy klobuchar, Pete Buttigieg are out west today, while Senators Elizabeth Warren and Bernie Sanders are reaching out to voters in the carolinas. South carolina poses a specific test for the candidates courts africanamerican voters. I think hes going to outperform everyone and the expectations. I think its joe bidens race to lose. Im not endorsing anyone, but i do believe just from, you know, being raised here in South Carolina, this is joe bidens race. I also think that ironically enough, i think the story not just going to be joe biden doing well, but i think tom steyer is going to outperform Bernie Sanders. Hes going to outperform, amy klobuchar, Pete Buttigieg and elizabeth warren, and i think thats devastating for sitting United States senators and those people who run for president before to be outperformed or actually even had a close race between somebody people didnt even know a year ago j you took the words right out of my mouth. I had this woman on yesterday, tamika isa tamika isaac desi tamika isaac vine, shes also undecided and she name checked tom steyer. This is something she told me. Honestly, tom steyer has made a whole lot of leeway here in South Carolina, and particularly with my constituents. Hes been in a lot of the neighborhoods and my constituents like him and i like his record. Certainly Vice President biden has a long history with our state, so he is up there as well, and elizabeth warren, so it will be really interesting to see as the next couple of weeks who really speaks to the issues that are important to the folks that i represent. Are you surprised or not surprised by the folks she name checked there . Im not surprised at all. The biggest problem tom steyer has is black folk didnt know tom steyer before he started running for president. So that trust, that familiarity just simply isnt there, but he actually has tried. Hes worked it. Hes been in the community. I cant say the same for pete and amy and elizabeth warren. I mean, its just especially when you come to someone like amy klobuchar, its just its disappointing and disheartening for individuals not to even try in these communities. Its going to be reflective not just of South Carolina but when super tuesday comes around, i know were worried about texas and california, those delegates are going to be split to kalamazoo. When you come down south, if biden and bloomberg are able to run away with delegates, that means theyll have an advantage going out of super tuesday, and im not sure pete and amy and elizabeth truly realize that. So astead to you then on joe biden who certainly has been trying, right, in South Carolina. He left New Hampshire in the middle of the day on primary day. The news today is he says hes going to finish first and second in South Carolina. You see the numbers, this is this recent quinnipiac poll showing his support among black voters dropped neurosurgemore t points since january. Is the support for joe biden still there in South Carolina . What do you think is happening with that decline in the black support . Well, i think that we should be clear. Joe biden remains the favorite in South Carolina. Thats been true since this race started. That will be true until the primary happens. When he says first or second, lets not let him spin. Joe biden needs to win South Carolina, and he needs to do so in a way that does prepare the kind of comeback kid narrative that we were talking about. He needs to amass delegates in there because he knows most importantly that Michael Bloomberg looms on super tuesday, and hes heavily invested in a lot of those communities that biden needs to win to start wrapping up those delegates and take back the momentum he lost in the first two states. We reported yesterday that there is some cracks that are showing up in that South Carolina firewall that the Biden Campaign themselves know, they are trying to reassure that ground game. Theyre trying to make sure hes investing more time throughout the state because they know that tom steyer has invested a lot of money in the state and has put up a lot of advertisements in the state. They know that someone like Bernie Sanders enjoys support particularly among younger black rotors. If voters. I think bakaris point is true about amy klobuchar, elizabeth warren, and also Pete Buttigieg. These are candidates that are relying on moderate i shouldnt say moderate for elizabeth warren, but these are candidates that are relying on growing their nonwhite support, but we have not seen much evidence that thats true so far. This Washington Post report describes in disturbing detail what the president s words are doing to children at school. A team of reporters went through about 28,000 news stories and found this. More than 300 incidents of trump inspired harassment involving school kids. And you can see from the posts graph, 14 of the cases are against students who support trump. But the vast majority of harassment is against minority students, children of color by fellow students and teachers who use trumps words to bully. And Hannah Nathanson is one of the Washington Post reporters behind all of this. The investigative report is called trumps words, bullied kids, scarred schools. Hannah, thank you so much for being here. Thank you for having me. In your quite lengthy piece, right, you all detail story after story of examples of harassing behavior. Can you just give our viewers just a couple examples of some of the words used by these children to bully kids . You know, you hear people are hearing things at sports games and hallways, like go back to where you came from. A very popular one especially at sports games is build the wall, and in some cases, merely the president s name has become a shouted form of an insult. And how much damage is this bullying causing . I mean, you know, obviously its hard to quantify, but i would say that the students we spoke to for this story, a lot of them even in cases where the incidents happened several years ago, the damage has lingered, and you know, theyre still upset. It still affects the way they move through the world daytoday. Anecdotally, it can be life altering this kind of thing. You gave examples, you know, of suicide as an extreme right, in one or two of theese cases. Also you found kids who support trump and theyre being bullied as well. Yeah, i think its really important to note that this is also happening against students who support the president or show up to School Wearing gear that is protrump. In one of the incidents we documented in the story, a kid was actually forced to change his name because his last name was trump. Its not that he was a supporter of the president. In fact, the reverse, but he wound up changing his name because he was being bullied by classmates for having the same last name as the president. And whos looking into this . Whats being done about it . So no one really tracks this was one of the discoveries that came out of our reporting so we based our report on every incident of bullying we could find publicly reported in the news. No School System has really been tracking this. That being said our reporting did show that School Systems around the country are starting to realize this is an issue, particularly as we approach the 2020 election, and there are some positive instances that we found where School Systems are starting to be proactive and convene classes, for example, on how to have a civil dialogue where they try to teach students how to disagree with one another over political matters, frekor example. And some might be doing things like pursuing student led mediation groups where students work with their peers. I think, you know, as much as some of the examples and the stories are disheartening, one of our findings was is School Systems are starting to find ways to deal with this. It is the president s own wife, the first lady who literally created be best to prevent precisely this kind of bullying at our nations schools, and here you have this incredibly lengthy report detailing how much bullying exists in part because of the president of the United States. Two things, one things changed. The American People dont like our institutions much, and so there was a time when youd make the argument that somebody should spend years in congress or spend years in the Governors Office and the American People say, yes, yes we want people with political experience. Right now theyd say no. We want people from as far away from washington, d. C. In terms of political experience its not what it was. When people were asking those questions about barack obama in 2008. The second point is about what kind of experience. You know, before barack obama, the previous the only previous senator to become president of the United States was john f. Kennedy and the argument always was you dont elect senators to the white house because they have no managerial experience at all. You get governors. Really with time what weve learned is its not what job they had before, it was the judgment they showed, regard letters of t less of thei size of responsibility, what judgment did they show . What about President Trump . That answers the question, President Trump, there are ways there are ways that a business person could lead the country if they show good judgment. The president has shown us poor judgment. In fact, thats why he was impeached, and thats why senators including mitt romney agreed that he should be convicted, not a majority mind you but quite a few senators. What about also thinking of senator john mccain, and we were talking in the commercial break and you were saying to me when you think about someone such as a john mccain and some of the people who would have been his supporters and his audience, that would be a Republican Base many of whom have been supporting a donald trump. Whats the difference . Oh, my god. You know, we always think that this is the worst. We americans like to reinvent ourselves. Its one of the great things about our country. It keeps us always young and as a country young, or youthful. We forget history, and one of the things we forget is that nastiness in our history is nothing theres nothing new about nastiness. When you watch the show, the 2008 episode of race for the white house, youre going to see that there was some real nastiness in the crowds that mccain spoke to. Some of what we see today and some of what became birtherism later in the obama years, thats there, but the difference is this. Mccain turns to his base and says stop it, please. Stop it. Were better than that. Dont let that anger define us. Let this debate, let this contest be aon principles and ideas, not on conspiracies. It was beautiful, and he didnt just do it once. He did it multiple times, and two of those cases are right there in the show. Its going to make you sad. Its going to make you very proud of mccain, but it will make you a little dismayed about how far we have fallen when our leaders dont substantial doubt stand up to their base and say please, we americans are better. President trumps interview on Geraldo Riveras podcast, he was asked how impeachment affected him personally. I know because i know you, what a gut punch impeachment was for you, but im not sure that, you know, heart to heart youve expressed that feeling, you know, that feeling of assault, of insult. Why dont you share that with us. What was that like for you . Well, its a terrible thing, and you know, i think of nixon more than anybody else, and what that dark period was in our country and every time in the white house i pass his beautiful portrait of various president s, right, but the portrait of richard mi Richard Nixon, i sort of i dont know, its a little bit of different feeling than i get from looking at the other portraits of president s.
