Trump as soon as this year, as soon as next month. Likely before christmas. House Judiciary Committee announcing its first hearing it will have next week on wednesday. A panel of experts discussing the constitutional grounds of impeachment. According to a committee aide, the hearing will be discussing the constitution grounds for president ial impeachment. Various experts will testify on the application, the constitutional framework of high crimes and misdemeanors and see how that applies to the president s conduct in this case. This case being what the House Intelligence Committee has been investigating over the last several weeks, which is looking into how the president handled a policy with ukraine and whether or not he used his office to pressure ukraine to announce investigations that would help him politically, help his chances in 2020. Now, essentially the process will look like this. Theres going to be a report put out by the House Intelligence Committee next week. Probably early next week. Then the house Judiciary Committee will take over from there and have their first hearing wednesday. The one with constitutional experts. Like lly there will be addition hearings an that. At that point expect articles of impeachment drafted by that committee that will detail high crimes and misdemeanors democrats will allege the president committed while in office. The Judiciary Committee votes on those article of the impeachment then going to the full house to be considered and likely thats going to happen before christmas, making trump almost certainly the third president in history who will be impeached. Also in this hearing, the president and his staff and his counsel will have the opportunity to participate in the hearing. According to a letter of the chairman of Judiciary Committee just sent to President Trump, hes inviting trump or his counsel to come participate in the hearing, question witnesses. Democrats say part of an effort to show the president rights in questioning these witnesses. Something the president s complained about so far in this process. The judiciary process going forward, allowing the president to participate. See if he ultimately does. Theyre trying to shift the argument away from the facts collected by the House Intelligence Committee and now the house judiciary considers what remedies are needed, whether impeachment is needed. Thats what the debate will be. All facts point to the signs the president within weeking could be impeached by the house before the Senate Considers whether to remove him from office. I heard two key dates. December 25th, the deadline for the entire house to vote impeachment. Manu, you have crucial news in the inquiry regardings 400 million the president withheld in military aid from ukraine. Whats moved on that . Reporter the House Budget Committee provided a summary of documents it received from the White House Office of management and budget about the 400 million in aid to ukraine, and the questions about why it had been withheld. According to these documents it show as timeline of how the wider white house took those steps to withhold military aid and does not provide the precise reasons why but interesting dates part of the process. One date in particular, july 25th. The day President Trump told president zelensky of ukraine, had that phone call, urged zelensky to open an investigation into joe biden, into the 2016 election interference. The same day we learnfromth fe documents that evening, a career official named mark sandy place add hold on military aid to ukraine. Now, that came about a week after there was a Conference Call announced internally, but the First Official action happened july 25th. And sequentially over the next couple weeks. A top political appointee mike duffy came in over the course of the next few weeks, a hold before all minutely released and that is central to the investigation as well. Why was that aid withheld . Used for political reasons . Thank you so much. Manu raju on the hill. To a court ruling, a federal judge reminded President Trump that president s are not kings, words that came from his pivotal decision, katongy brown. The white house has been blocks this claiming absolute immunity. To make the point as clear as possible, absolute immunity from compel political process simply does not exist. Indeed absolute testimony immunity for white house aides appears to be a fiction. While the law is on congress side, time is not. No telling when don mcgahn might testify. He is, of course, appealing. So is the department of justice and the house agreed to wait a week as appeals are filed. And the president of the United States, he is tweeting. He says that fighting for future president s, but that he would actually like people to testify, including mike pompeo, rick perry, mike mulvaney, members of his tight inner circle who likely will direct firsthand testimony to offer. Per the latest ruling, could they go before the house . Whether the president likes it or not . Bring in a former federal prosecutor and a professor at nyu school of law. Wow. Start with the judge. Everything she said. Right . Including her point about absolute immunity, she says clearly in no Uncertain Terms the white house cant claim. What do you make how she went about this and what about these officials who refused to testify . First thing to know about judge jackson, a really good and respected judge. An obama appointee related by marriage to former speaker of the house paul ryan. She has on both sides of the aisle and a meticulous judge. Wrote 120page statement, spelled it out. Exactly right. The idea the president could preclude all highlevel white house officials from testifying is an absolute fiction and thats what she said. She used lets use don mcgahn. He needs to physical appear and testify before congress, how i interpreted it. Could he not sit there and say, you know, executive privilege. Executive privilege. Not answering this. How do you thread that needle . If youre don mcgahn . Absolutely right. In some way a sweeping opinion but only about whether had he has to show up. All the judge said is, youve got to show up. All other privileges still apply. He could take five. He could assert executive privilege. So this is just another step in this chess game thats going on. This procedural chess game. Its going to end up in litigation. Theyre already saying theyre going to appeal. Going to be a stay and where its headed. A bigger issue. Hard to imagine a more significant wound than alleged interference with congress ability to detect and deter abuses of power within the executive branch for protection of the people of the United States. I mean, if this ruling were to be overturned, what would this mean for the balance of power in government in the United States of america . I think shes exactly right. The whole purpose of Congress Oversight function is to serve as a check on the other political branch. The president. If congress cannot call witnesses and compel them to testify under subpoena, then it is completely hobble in exercising that oversight function and basically prostrate before the executive. It creates an executive that looks more like a monarch. What they are trying to avoid. A significant chance mcgahn would win on appeal . Do you agree . I disagree and would not want to be on that side of the argument. The house has the way better argument. The District Court judges opinion follows clee precedent. I dont think its going to happen. If anything what would happen a delay in the process. Which is part of the chess game thats going on back and forth. Maybe call it checkers, because its lets subpoena, okay. Say no. Okay. Lets subpoena. To be clear, the procedure is the punishment for congress. They are on the better side of the argument as was said but the fact its litigated and indwheed will be testified to will be litigated slows everything down and slows down mown meant um. Move to judiciary chairman Lindsey Graham says the impeachment trial should follow federal trial rules. Here he was. Well, if you have a trial what are the rules of the trial . A good rule to start with. The trial in the senate should mirror trials all over america. Hearsay not admitted unless a valid exception in any trial in america. So lets apply the federal rules of evidence to the trial in the senate and let the chief justice of the United States rule on whether or not evidence is admissible. My belief is 90 of the testimony being used by the house violates hearsay rule. Melissa, back to you. Isnt impeachment a purely political process . Like, this is not a criminal trial. How can how is it valid for him to say that . The house senators, or the senators can come up with rules how the trial will be conducted. Theres plenty of case law makes it clear they can do that, but its not like an ordinary criminal trial with the standards rules apply. It should be said a lot of the evidence presented in the public hearing was not hearsay testimony, it was not hearsay when mr. Holmes heard that conversation on the balcony of the restaurant in kiev. You may quibble about what he heard and whether he heard it and it was loud enough for him to hear with veracity, but he heard it firsthand. And republicans say hearsay. Right. And everyone testifying, the president tweeted he would like all witnesses to testify, right . This is what hes saying and then quote unquote fighting for future president s. My thing is they could show up tomorrow and say ready to testify. Right . But its its this administration thats keeping them from doing so . And thats a perfectly fair point and its true. Aultimately i think Lindsey Graham is saying have the federal rules of evidence to apply. Theyre pretty permissive. All evidence already gathered is coming in. If you do it under the federal rules that apply now. Okay. Khan and melissa, thank you very much. Now to this. In keeping with that tradition today i will issue a pardon to a pair of very handsome birds, butter and his alternate bread. Thats true. Look at you. Their names were chosen by the students of Harold Christian academy in north carolina. Great state. Bread and butter were raised in tar heels state by farmer welly jackson, whos here with us with his wife tara, and their lovely family and i want to thank you very much. Great job. Did a great job. Thank you very much. Thankfully bread and butter have been specially raised by the jacksons to remain calm under any condition, which will be very important, because theyve already received subpoenas to appear in adam schiffs basement on thursday. True. Hundreds of people have. It seems the democrats are accusing me of being too soft on turkey, but bread and butter, i should note that unlike previous witnesses you and i have actually met. Its very unusual. Very unusual. In any event i expect this pardon will be a very popular one with the media. After all, turkeys are closely related to vultures. I dont know if i like that line, but there is a little truth to it. But today after the birds, well retire to gobblers rest at virginia tech, great college, where they will be cared for and enjoy a terrific life. This thanksgiving we bow our heads in gratitude for the newfound prosperity and spirit thats taking place all across america. The country has never been more successful. Our militarys been rebuilt. We captured the number one terrorist in the world and killed the number one terrorist in the world, al baghdadi and i want to thank our military, because theres nothing like our military. I want to thank all mighty god for the shedding of his grace on our nation, our nation is special, and we especially send our love to members of the United States armed forces serving all over the world. Were forever thankful for those who wear our nations uniform and the family whose support them. The families are so important. Y it can neverish t isbe the samet those great families. Because of them we celebrate another wonderful thanksgiving in siafety and peace. It is a very special country a very special place. The rose garden, at the white house. If you look back here, thats the oval office. Some of you havent been here before, but every time we walk on to the grounds of the white house we realize how special it is. So now we have reached the moment, bread and butter have been waiting for so patiently, their president ial pardons, melania and i wish all americans a very happy and blessed thanksgiving. We love you all. Butter, lets talk to you for a sikd, becau second, because im going to do something youre going to be very happy about. Uhoh. That looks like a dangerous bird. It just escaped. Ladies and gentlemen, he presents bread and butter. Listen, ive been doing this show nine years. Thats a lot of turkey pardons and theres always cheesy humor, but what did he say . A complete pardon. Full and complete pardon. Oh, so many things to say. Lets just let me just, kate bennett, bringing you back in at the white house. Turkey impeachment humor. On behalf of this current president. Reporter right. With a little discussion about having met witnesses and being part of schiffs testimony and i mean, very basement. Right. Sort of a Current Events turkey pardon. The president , a pretty jokesfilled speech there. I dont think anyone was anticipating. Looked like Melania Trump enjoyed it. Smiling largely there and certainly tinged with a bit of real news and real happenings, perhaps his way of blowing off steam before he pardoned butter. Yep. Yeah. Somehow working in adam schiff and baghdadi in the turkey pardon. A democrat is walking back remarks about impeachment. Mi michigans Brenda Lawrence didnt see the value of removing President Trump wa office. We are so close to an election. I will tell you sitting here knowing how divided this country is i dont see the value of taking him out of office. Wow. I want him censored. I wa censured. I want it on the record that the house of representatives did their job and they told this president and any president coming behind him, that this is unacceptable behavior, and under our constitution, we will not allow it. Well, today congresswoman lawrence issued this statement about the public impeachment hearings saying, the information revealed confirmed that this president has abused the power of his office, therefore i continue supported impeachment, however i am very concerned about Senate Republicans abtsds the fact they would find this behavior by the president acceptable. With me now, hillary roeary ros democratic strategy. And nice to see you, hilary. Who do you think got to her . Speaker pelosi . Well, i think she probably any one of her colleagues of michigan all who support impeachment. This is emblematic of the tore carry that a lot of democrats are feeling across the house, which is that they are spending all of this time and a lot of Emotional Energy on this impeachment and all they hear from republican senators is, nope. Were not going to do anything. We dont care what the facts say. They experienced that in the hearings from their House Republican colleagues and its discouraging they are hearing it from their Senate Republican colleagues. So might it also be emblematic how other democrats are feeling . Not optimistic where this impeachment is heading . For their party . I think what we saw when nancy pelosi and the house leadership decided to pursue impeachment was a huge reluctance to do this. I think we saw that from a significant portion of house members. Even the ones most aggressively in favor of impeachment didnt really want to do this. They want to focus on Everything Else that matters to country but they did it because they felt they had a duty to the public, a duty to their office, uphold the constitution to not led a president abuse his office. They all come to this. Ambivalent about this, we would much rather talk about other things. New cnn polls are in showing all the public hearings didnt move the needle much on public support for impeachment. Since october, numbers the same. 50 in favor. 43 against it. Why do you think there was no change . Some of that testimony was pretty compelling. The testimony was compelling, but, you know, unlike what weve seen in the past, honestly, i hate to put it this way, but republicans had zero compunction to lie. So what i think too often the American People saw was sort of a he said she said and didnt pay nudge attention to actually what the witnesses were saying. I do think the republican defense of, you know, obfuscate, deny, lie, actually had an impact, and having said that, i think that the support for keeping trump in office for a minority of the country but a significant portion of the country is baked in, and that, you know, we laughed during the campaign when he said, laugh with horror. I could walk down fifth avenue and shoot someone and no one would care who supports me, and i think we have seen that come to pass. Hmm. Uhhuh. Hilary rosen, thank you so much. Nice to you have on. Giuliani says he has not heard from prosecutors and has not been accused of any wrongdoing, but prosecutors reportedly are cloe closely looking into giulianis firm and two indicted associates his lev parnas and fruman. Money larundering, conspiracy, the list goes on. Parnas and fruman arrested trying to leave the country and indicted on charges of abusing a Shell Company to funnel Campaign Donations to a protrump superpac and pleaded not guilty. Rudy giuliani meantime seen as a central figure in the whole impeachment inquiry and made himself oddly accessible to the media throughout the process. So when hes not butt dialing reporters, true, or leaving accidental voicemails raling against the bidens which actually happened, giuliani prefers responding directly. And on the receiving end of many of text and many an hour of the day according to your piece. I mean, you write what its like texting with giuliani. Did you tell him youd be writing a piece . And showing the texts . Reporter i was inspired after a series of unusual interactions with mayor giuliani, and i learned that many other reporters communicate with him this way. Receive all manner of colorful messages from him at all times of the day and night. I just think its a very unusual feature of an International Political scandal to have one of these central figures so accessible to anybody seemingly who wants to talk to him. I see on twitter all the time people who arent even contacting him for reporting but sometimes just contacting him to yell at him and he engages with them. I dont think weve ever really seen that before. Certainly not at the level he communicates as often as he does in the american political scandal. What is texting with him like . Its an adventure. You never really know what youre going to get. Sometimes he engages. I spoke to one reporter who said they found that you really have to try and push his buttons to get him to respond. Hes much more chatty that way. I think it just depends on what your contacting him about and whether or not he feels like talking. I didnt even realize you could like your own texts. This is a thing he does often. The more you know. Truly. He likes his own texts probably the only person i communicate with who uses that feature seemingly earnestly and sometimes seems as if hes doing that instead of responding for efficiency. Other times its not really clear why hes doing it. Many other White House Reporters i spoke to deal with the same thing when it comes to how he reacts to questions that are asked of him and were all trying to sift through this. Hes a resource, and its an interesting way to try and get information, but its what we have to do. And im sure youre grateful he has been so accessible. There is also a conversation, you point it out in the your piece, theres been a lot of, what happened to Rudy Giuliani . But you quote his good friend bernard kerik, ashurg you she razor sharp. How did he defend him . Kind of back to his old prosecutorial self. If you hang out with giuliani agency he does a couple times a week you see no difference how he behaves now and has always behaved at Police Commissioner who has known him a very long time. Had an up and down relationship but very close to him. Others i spoke to who have known him a long time were less confident. Pretty concerned. Said theyve noticed somewhat of a decline over the last several years, and when you look at the people who hes been associating with now a part of this scandal, the people who were indicted, doing business in ukraine, some people sigh spoke with say its been a concern among those that cared about him for a long time. Hes associated with people who perhaps dont have his best interests at heart and not really vetting those around him. It wasnt a surprise to some people who are close to him to see this play out as it has. You and your whole piece quoting one White House Reporter in this, this person said to you, almost no point in talking to him, he is objectively news worthy and in a position of great power. So last question, olivia. Are you still texting with Rudy Giuliani . I am still trying to. I think he got irritated with me over something i wrote about joe biden and sent me an angry text in the middle of the night. We havent recovered yet but im hopeful. Im an optimist. Glass half full kind of gal. Like it. Thank you. Thank you, happy thanksgiving. Same to you. A woman calls 911. Dispatchers do it across the country. The difference, Pepperoni Pizza is not a code word. Its not universal that thats the code word for Domestic Violence. Thats false. Let me just say it is special. I hear you and i appreciate your humility but the fact you picked up on that, that there was an eventual arrest. When youre on the phone and she wants this Pepperoni Pizza what did you think was happening on the other end . Probably close to half if not more than our 911 calls are false calls. Theyre pocket dials or someone complaining of, they think theyre ordering a pizza. A lot are false calls and of course that was my first thought. But we are all train topped listen atopped trained to listen and see if Something Else was going on. In this case, there was Something Else going on and i was able to pick up on it and follow through. We follow through on every 911 call. Its not unusual to stay on the phone and just to make sure nothings going on. What we all do. You have been doing this for 14 years. Just telling me commercial break, youre two days away from your anniversary. Have you ever gotten in all your years, tim, a call like this . No. This was the first one and ive never heard of anyone else getting a code, coded pizza, pepperoni domestic code call. Never heard of it. Plenty of other calls and theyre all different. No. First one to order a pizza that wanted police assistance. And then you referred this obviously to police. How did you know to relay the message . Well, during the phone call when she pretty much agreed with me, you can read it between the lines she agreed there was Domestic Violence going on. Once she did that i immediately notified officers and sent code 2. No lights and sirens. The suspect was in the house probably does not know shes called the police. I asked them to turn off their sirens not to spook him maybe he would escalate the situation or flee or in any way harm anybody else in the house. Go up, knock on the door and ask or tell him, hey, your pizzas here and resolve the situation with no violence and nobody hurt. Thats the goal. To make sure everybodys sage. Incredibly astute of you. So often 911 dispatchers dont get the praise they deserve. I hear you saying youre not special and anyone would have done this, but what do you want people to know when they have an emergency and need to call people like you . 911 .
