That question slamming the kmer Commerce Departments reasoning saying it must demand something other than the explanation offered. So then on tuesday when you had had the commerce secretary capitulate announcing the sense qu census would not include this question. However, the next day, the third of july, the president sent lawyers scrambling when he tweeted he was not dropping the request to add this Citizenship Question. That brings us to the president and today. I just spoke with the attorney general. We have a number of different avenues we can use all of them or one. Were doing very well in that issue. Were spending 15 to 20 billion on a census. Were doing everything. Were finding out everything about everybody. Think of it, 15 to 20 billion and youre not allowed to ask them are you a citizen . And by the way, if you look at the history of our country, its almost always been asked. So were fighting very hard against the system that is a very difficult system. But well make a decision. The attorney general is working oen th on that right now. Kaitlyn collins is there and that crowd of reporters shouting questions at the president. He laid out a few options to all of this. He said he had several but he didnt go into detail. Essentially he did confirm that what weve been reporting behind the scenes, one thing they are looking at is potentially doing an executive order. Heres essentially what the president is thinking on that was. Are you going do an executive order on the census . Were thinking about that. There are four or five ways we can do it. Thats one of the way thats were thinking about doing it. Were doing well on the census. We can also add we can start printing now and do an deigned an addendum. He said, yes, were looking at this executive order. There is not a lot of detail how this would work. This is still unclear. Behind the scenes, officials are working on this, scrapping Holiday Plans because they had to work on this after the president suddenly reversed course from what the Justice Department lawyers said earlier this week. Another interesting dynamic here is we have reported behind the scenes that president is frustrated with will better ross because he doesnt like the way he handled this. Thats what chief Justice John Roberts said this argument that the administration needed to make the argument better. I asked the president if wilbur ross job is safe. He said yes it is, hes a good man. But the Supreme Court didnt like whatever wilbur ross answer was. But does it sound like the president even though he is complaining about him behind the scenes says he does have confidence in him. Sarah murray is joining us. Michael zeldin and former federal prosecutor. So on the law of this, michael, the notion of having this addendum like printing now, having this addendum of the question later or an executive order, this is, of course, all after the u. S. Supreme court has spoken. Is that constitutional . Yes, if the court says it is. What we have to remember is what the court was asked to decide was litigation that was begun in april of 2018 where the Commerce Department said they are adding a Citizenship Question to help enforce the Voting Rights act. The Supreme Court said what they put forth was contrived. It left in place this injunction against including that Citizenship Question on the census but gave the administration the right to go back to court to see if they could come up with a noncontrived answer. They had that answer do now in the maryland courts. So well see if they can come up with a rational that the court says is acceptable constitutionally. So far, in the last year and a bit, they have not been able to convince a court that their reasoning is constitutionally based as opposed to discriminatorily intended. Lets back up five steps. Sarah murray, why is this even news . The question is important. If it is added to the census experts including the scientist at the rates and its going to scare latino families from responding. Its going to scare any household from responding even if there are immigrants in the United States illegally. That has big reprecushions for how we allocate federal dollars and how congressional seats are portioned to the various states. The reason were dealing with this now is because there was this agreement among the Trump Administration after the Supreme Court decision, okay, were going to start printing the census without the Citizenship Question. You know, we have run out of time essentially. The Supreme Court spoke. We need to move forward. Then President Trump said go back to the drawing board. Figure out at decisional options. They are on a very tight time line. If we continue to push this forward and wait for the drop dead moment which is october, were going to have to take dramatic steps and spend a hot of resources to make sure that people actually respond to this in time. Perfectly timed, we were talking about an earthquake yesterday. I want to bring this up, the Justice Department lawyer was caught off guard by the whole thing when the president tweeted while making this argument in court. This doj lawyer, the tweet this morning being the president s tweet, the tweet this morning was first i had heard of the president s position on this issue just like the plaintiffs in your honor. I do not have a deeper understanding of what that means at this junk tour other than what the president tweeted. Im doing my absolute best to figure out what is going on. Have you ever seen that . No. In light of the litigation, that is the decision. Its rare that a decision is made and announced that hasnt been accepted previously by the president. He makes up his own mind and hes not adverse to change his mind. When you heard the president saying, you know, i sprekt the chief justice but come on back. Let me add to that, we got this in. This is from the doj telling the federal judge, in the event the Commerce Department adopts a new rational for including the Citizenship Question on the 2020 census consistent with the decisions of the Supreme Court, the government will immediately notify this court so that it can determine whether there is any need for further proceedings or relief. But proceeding to discovery now in connection with the new decision that has not yet been made would be premature. It would be also extremely inefficient. Just turn that quote around for you in real time, michael. So translate that for us, please. What theyre trying to say is were trying to come up with a new explanation which if on its face it is sufficient, we dont think you the court need to engage in full discovery in our trial that is about to take place but rather we can just decide on the merits that our argument is sufficient and send it back up to the Supreme Court for them to decide whether that new argument is no longer contrived and meets constitutional muster. So theyre trying to avoid discovery. They want to take the deposition of wilbur ross. But that didnt get taken. And now they want to do that. And on wilbur ross, sayer yashgs all the mixed messaging, the president essentially saying is confident in the commerce secretary but, i mean, might we be on commerce secretary job watch . What do you think . Theres to doubt the president is frustrated with wilbur ross. My colleague kevin over at the white house has great new reporting on this today. You know, this sort of like early backing down that wilbur ross portrayed by putting out that statement, that isnt sit well with President Trump. No surprise. He likes to fight out an issue until the bitter end. Sources are telling us that at least for now wilbur ross job looks safe. Mainstream democrats who are very progressive on social issues and very strong on education, health care. Look, my north star is the middle class. When the middle class does well, everybody does well. How do you do better for them economically . And not with the 70 tax rates . I do raise the tax rate to 39. 5 . I do, in fact, eliminate the ability for them to write off Capital Gains the way they do now. I would raise the raise billions of dollars and raise the Corporate Tax freight 20 to 28 . I raise billions of dollars. Trump will say thats what brought the economy up to where it is the tax cuts. Ask the people in this restaurant how that economy came up. Ask them how good they feel about it. Ask how the stock market helped them . How about driving us two trillion dollars greater in debt helped hem. Do you believe undocumented people should have health care in this country . I think undocumented people need to have a means by which they can be covered when theyre sick. We should build more clinics around the country. When theyre ill and sick. People need this is common decency. Its unpopular. I know it is. Well over 50 polled say undocumented americans undocumented people should not have health care on our dime. Ill tell you something, in emergency, they should have health care. Anybody in the country. Hes playing it works for him, this issue of law and order versus left that seems like its open borers because it means its lawless. Yet, people are running close to you now who are saying decriminalize coming in to the country illegally. Do you believe that should be decriminalized . I dont. No, i dont. I think people should have to get in line. But if people are coming because theyre actually seeking asylum, they should have a chance to make the case. I would be surging as we did, surging folks to the border to make the concrete decisions. Why are they coming . The reason theyre coming is because trar heyre in trouble. Crime rates are high, education is terrible. You cant turn on a light switch. What do i do . You do the following things to make your country better so people dont leave and we will help you do that. Just like we did in colombia. We went down and said okay. I was one of the architects. What do you say to the people who say yeah, i like joe biden. I think his ideas are the old ideas. The new ideas i see a warren, i see a sanders. You poll lower than them on ideas for the future. What do you say to them . I say to them, take a look at my ideas. I havent seen where people say what ive seen around the country is vast majority of democrats are where i am on the issues. We have to be aggressive. And theyre big ideas. The big idea on education on health care, on dealing with the environment. Its just i love how, you know, all of a sudden i wish i had been labelled adds moderate when running in delaware back in the days. 80 of the party say center left. I am center left. Theres a disconnect. Center left. Thats where i am. Where its not is way left. Now, look, thats what we can find out. Thats what this debate is about. Do you think you need if you win the nomination to have a female vp . I think it had been great to have a female vp. If i dont, it will be great to have a female president. T whose issues are best proepd in their wheel house . They demonstrated they know how to deal with them. You would consider not having a woman as vp . Look, heres the first thing about being a vp. I learned. And that is that in todays environment, there is so much a president has on his or her plate, they need someone they completely trust and have the same approach, political approach and you can delegate significant authority. The president when he delegated authority to me from the moon shot to ukraine, he gave me the authority to make decisions. Because he knew i knew where he was. He knew that i knew something about it. He knew we were sin lock step. Do you think a democratic ticket can win without a woman in one of the two slots . Well, the answer is yes. But i dont think that i think it helps having a woman on the ticket. And there is a hot of really qualified women out there. Is Camilla Harris, assuming she doesnt win outright, is she still somebody you would consider as a running mate . Look, one of the things im not going to get into because it got news before is when i was asked i dont have the nomination. Im presuming who i might pick as a Vice President. Thats easily flipped on me and says biden is arrogant. So im not going to comment on any individual. A woman came up to me, i guess it was, i dont know, a month ago. I guess i was in new hampshire. Said all right. Im almost done. Why shouldnt i vote for a woman . I said, you should. If you think that person is most qualified at the moment right now to deal with our problem, vote. Im not suggesting you vote for women. Look, i have spent my career from writing the violence against womens act to say my daughters and granddaughters can do anything, i mean anything, anything that a man can do. Anything. And so i dont have a doubt in my mind. If i started naming some of the people around the country, women who are not running for president as well who are fully qualified to be Vice President again that is presumptuous, man. So there is a lot of really qualified women out there. In terms of last question. In terms of what we havent seen from joe biden yet, i remember last question. Last question. I promise. Okay. Ill be there if a second. Last question, i promise. The last thing i remember talking to him about politically with you both was, you know, what is the quality . You know, he was asking me what do you take if your father and this . Bow bid beau biden said to me, nobody fights like my father. What does that mean to you to fight harder than anybody else . It means two things. One, to fight without being personal. To fight and convince the role of a president is to persuade, persuade. Not just go out and fight. If they want someone to clench fists, bear knuckle fight, closed hand, closed heart, they got one of those guys right now. Thats not me. I have been pretty darn good to bring people together. The whole idea of america is that when were together, there is not a damn thing we cant do. And we is v. A National Reporter for the washington post. Great to you have both on. Matt, let me set this up. The Vice President made it super clear that hes not chasing the left. You heard him note that while alexandria cortez may have won the primary that mainstream democrats won the general elections and the mid terms. He also said the vast majority of democrats are where he is on the key issues. When we look at this poll taken right after the midterms, it shows that 54 of democrats and democrat leaning independents would rather see the party become more moderate. That is compared to the 41 who say they want it more liberal. Matt, shows numbers do seem to back up joe biden. Yeah. And i think youre seeing him put forward a more forceful case for centerism in this interview than he did certainly on the debate stage. We expected the debate to be a showcase of biden and Bernie Sanders, sort of articulating visions for the party. And it didnt turn out so much that way in part because of Camilla Harris and her own line of attack. But i think joe biden and the campaign is increasingly making that case on matters of health care or immigration, two key issues that hes putting forward a more centrist vision and one that they argue has a better chance of defeating donald trump in the general election. There was also Something Else that biden talked a lot about in our exclusive interview, that being barack obama. And youre out on the trail. Im curious, how much does that resonate . How are voters responding to that . You can see it as a double edge soared. One for older folks and older as in pull the lever voting for obamabiden or the Younger Voters who just dont have that motional connection. When biden brings up president obama, oftentimes that is one of the loudest applause lines. As talk to people as theyre leaving the biden events, theyre pointing back to his experience, his ability to work with president obama. And i remember being down in South Carolina just back in may and i was at a farmers market. It was unaffiliated, undecided voters. There is a woman i spoke, to africanamerican woman who said that so many in the black community and older black community, they base a the hoff votes on people they know, people that have been around for a long time. And so that obama connection she argue was very, very important for joe biden. Biden is going to be heading down to South Carolina tomorrow and sunday for a two day swing. And one things that going to be really note worthy to watch is how are these voters responding to that debate interaction that he had last week on the issue of School Bussing . Is this something resonating with them. When i was asking about bidens work with segregation of senators in the past, a lot of people said, hey, we get that. He had to work with these people to get things done. So its going to be interesting to see whether the school bu bussing issues resonate. I want to ask about health care, matt. Biden says he has a plan that is rational that, will cost a hell of a hot less than medicare for all. But then in the same breath, he said that his plan also allows you to buy into medicare for all if you want to. He has not given a major address or put forward decent policy proposals on health care. We know its something that is Campaign Advisors and he have been talking about. But there is a lot of open questions around that. I think that argument that you increasingly hear him put forward is we have to stick with obamacare and build upon it. Rather than taking it away and dealing with private Insurance Companies the way that Bernie Sanders wants to deal with him. He seems to be increasingly eager for that fight that we heard more of that from him on the campaign trail. But as far as how he pays for things, he has not articulated. How about the last question. It would help democrats to have a woman on the ticket. When he was asked if it would be Camilla Harris who he would select as a running mate, he said he didnt want to be premature noting that he still, of course, doesnt even have the nomination. I know its early. I know its very early. But do you think senator harris debate performance hurt her chances in chances if biden is the nominee . I think its really unclear at this point. Biden has been using that answer for a while saying it would be premature to talk about specific people. But were really struck me in that interview when he was talking about his vp choice he is wasnt ruling out a woman. That triggered in my mind, he is suggesting he wants someone that is also center left . Would that preclude Elizabeth Warren from joining the ticket . There is a lot of women across the country who are not running for president who could also be brought up into that conversation. Were very, very early. That was only a portion of the interview. There is the criminal case. But the charges really mirror each other. The civil case was assault, battery, intentional emotional distress. Criminal case is stemming from an alleged ins dment july 2016 on nantucket island. This young man who was 18 at the time worked at this restaurant. Everybody heard that kevin spacey was going to come that night. He stayed after hours with a change of clothes, wanted to meet him so bad. Met him. They really spent the evening together, the latter parts of the evening. He has a phone and is texting his girlfriend the whole time with texts that i think help the prosecution that hes touching me. Hes inappropriately doing things. And the defense said this are text thats are missing. We deserve that cell phone. He didnt give you the whole picture, prosecutors. So the judge actually said, all right. This young man and his family, they have to turn over the actual phone to the defense. They now say they cant find it. They dont know where it is. And so the judge said if you cant find that cell phone by monday, july 8th, i want the family to be in court and tell me why you cant find it. So then what happens for him monday . Kevin space quliy him. If that cell phone cannot be found which the defense alleges have texts on it that could actually help show it was consensual or the nonexistent, thatting in ever happened because there are no eyewitnesses as to this alleged groping in the restaurant.
