The opinion says that the constitution requires a process other than the criminal Justice System to formally accuse a sitting president of wrongdoing. His remarks will no doubt increase the pressure already on House Speaker pelosi and her Democratic Caucus which is split on the impeachment. Her is jerry nadler as chairman of the House Judiciary Committee answered that question last hour. Congressman, will you move forward with impeachment proceedings and given what mueller has said, meaning that he feels as though a report said all that he needs to say, will you then subpoena him to testify in front of congress . With respect to impeachment question, at this point, all options are on the table and nothing should be ruled out. Lets start with jim acosta, our chief white house correspondent. And jim, listening to congressman nadler, he was careful with his words, but the white house is essentially saying bring it on when it comes to impeachment. Tell me more about the white house reaction to today. Reporter well, first a couple of things, Sarah Sanders the White House Press secretary gave a rare gaggle in the white house driveway a short while ago and said over here at the white house, they believe that the president was exonerated. That is not exactly what we heard from the special Counsel Robert Mueller when he said earlier today, if we had confidence that the president did not commit a crime, we would have said that. He also went on to say, as you were playing a few moments ago, they guided this Justice Department policy that the president could not be indicted for crimes committed and i asked Sarah Sanders that question earlier this afternoon. If donald trump were not the president , could he be charged with a crime . And here is what she had to say. It does beg the question, if donald trump were not the president , could he be charged with a crime, what do you say to that . I think it is real simple, what we have said and they looked at whether or not collusion or obstruction and all of those things have been determined to not have taken place. Collusion, conspiracy, obstruction and again we consider this very much to be case closed. Now, of course, brooke, they consider to t to be cased closed but they dont see it that way on capitol hill. Youre seeing Robert Mueller comments really sparked new calls for impeachment and one thing that Sarah Sanders did say and i think this also was note worthy, was that she said they are prepared for whatever comes and that they are essentially making preparations or have made preparations in the event democrats do pursue impeachment. It sounds like theyre prepared from a legal stand point and constitutional standpoint in terms of staring off with congress and as weve heard inside and outside of the white house, they see it as politically beneficial to the president with democrats clamor clamorering for impeachment and that works for the president and they worked back at clinton and said that works for the president. Well find out over the next 18 months. Nadler said all options are on the table. What does that mean . Tbd. Well talk about the pressure. It is on for this woman. House Speaker Pelosi is expected to respond on camera to muellers comments today and released a statement thanking mueller for his teams word to provide a record for future action in the congress and the courts recording the Trump Administration involvement in russian interference and obstruction of the investigation and went on to say that the congress will continue to investigate and legislative to protect our elections and secure our democracy. She said the American People must have the truth. Phil mattingly is our man on capitol hill. And i know lawmakers are out of town but youre in touch with them and what is their reaction to mueller today . Reporter responses coming fast and fur furious. And i want to hit on how careful jerry nadler, the chairman of the Judiciary Committee was when he made that Public Statement earlier. Not only was his Public Statement written and he read directly from it but his responses to predictable questions he was reading was also prepared for him. And whey said, all options are on the table related to impeachment, that not a shift. That has been his position throughout and the wideranging sweeping investigation into the Trump Administration into obstruction, he has long said if the evidence gets them there it is on the table and that for the moment has not changed. There is two pieces here and it underscores why jerry nadler is being careful. There is the impeachment piece and whether or not democrats want to pursue that and the whether Robert Mueller ends up coming to testify in front of congress. On the first, you note how key it is when Speaker Pelosi speaks. The reason why is because she and chairman nadler are the two people who really matter more than anybody else when it comes to impeachment. If they give the green light, it will start. If they do not, it will not. No matter how Many Democrats in the caucus decide they want to pursue that and to be clear there have been a growing number over the last couple of days, ten days, that want to launch an impeachment inquiry. They are not a Critical Mass and not a majority. Well see if that changes. And whether or not Robert Mueller comes to testify on capitol hill. Steny hoyer put out a statement he Still Believes that Robert Mueller should come up to capitol hill even though mueller said he hoped he would not have to. He believed the report spoke for itself and something to keep in mind here and a couple of democrats have been texting me about this, the power of the visual. The power of the special counsel even if hes just reading from the report, the individual on television being seen across the country, across the world reading those things that perhaps other people havent or only seen summaries of, that is something democrats want not just for political reasons but to back up the investigations theyve got ongoing and expect a push to still have them come up to capitol hill. But whether or not they will subpoena him and how the process will work, that is still being debated. Talking to john dean last hour, he said that puler has to he has to go to capitol hill. Maybe behind closed doors but he has to testify. Phil mattingly, thank you very much. Let me hit you all on a round robin on Robert Mueller speaking today. I think he made it clear he had his hands tied behind his back and couldnt indict a sitting president and said to congress effectually you dont. And reading between the lines of mueller and you guys are the lawyers, im not, it was pretty clear to me that what he was saying if, i could have, i would have. Bur i cant so you need to. Right. Thank you. Yep. Van . I think were in a delicate place. Were on the knifes edge and if you are pelosi, you have two responsibilities that do not go together now. You have an immediate responsibility to protect your caucus. Make sure youre on track for a victory in 2020. That would argue for caution. But if your concerned about the Republic Capital r. , how is a republican supposed to function. Speaking of pelosi. Perfect segue, here she is. He said if he had confidence that no crimes had been committed, he would have reported that. He pead a number of other statements about a president not being able to be convicted of a crime while in office. Tell us i know youve made one comment already this morning. What is your reaction to his statements this morning . Thank you, gloria, for your question and for the invitation to be here today. It is wonderful to be at the Commonwealth Club with so many members of the club and concerned citizens, especially my family, my daughter christine and her husband peter and fatherinlaw and hi grandson octavio. [ applause ] and understand my son paul is here. Paul jr. Is someplace. Welcome. In any event. This is a Family Affair for us always. We always like to hear whether were present or viewing or listening to what is of interest to our community. And i want to salute gloria duffy, shes just so remarkable and so blessed to have her in the role that we have. [ applause ] while she mentioned what i was doing while they were having a late Central America style dinner, ill tell you what she was doing during the day. And this was so reparkable to all of us because it was we were there to see what was happening. Madeline so we have a mirror on this. The second she gets to the answer, well take it live. But to your point, you were saying it is a delicate balance between responding to her caucus yes. Because the cries have become louder of protecting the r. Republic. And in that mother hen role with regard to the caucus will say you may want to do this but i know it may be bad for us politically. We may hand the presidency back over to him in 2020. And bad stuff could happen, i dont want to take the risk but he has a responsibility to the republican capital r. And whether you like or dont like trump, if you erase the names and you had an investigation person x. President x and you had an investigation where all of the facts came out and that investigation, however, could not lead to any kind of conviction or accountability by definition, the rules say you cant. There is only now one body that can do an investigation with the gloves off congress. And that is congress and that is her. So she has a big challenge today. And it is in some ways is no win because you have to sacrifice one or the other but i dont think that i think shes painted into a corner by the president s actions, by muellers statement and by her caucus and well see how she handles it. Your takeaway, asha. Three takeaways that mueller is saying here. First he said no hoax. He said no coup and then he said you can impeach. The first two are just as important because they are directly contradicting the narrative that has been put out by the white house. And with the third one, i think im sorry, lets try again. Special Counsel Robert Mueller now former special counsel mueller and what he had to say and as gloria indicated he did say if he saw any evidence that the president was not was innocent, he would have let us know. If he had any evidence that the president was not guilty, he would have let us know. But he didnt. He didnt. And i think that was very, very important. While i have the deepest respect for him, and thank him and his team for presenting the presentation of facts that will further lead us to help us in the congress and in the courts, this is a very valuable contribution. I am gravely disappointed in the Justice Department for their attitude, their misrepresentation of the Mueller Report to begin with, theyre hiding behind something that you could never find in the constitution, that the president is above the law and the misrepresentation even under oath by the attorney general to the congress of the united states. So we, as well continue on our path, which was led by our six chairman who are magnificent and adam schiff coming and jerry nadler and judiciary and Elijah Cummings, government reform and oversight, Maxine Waters, financial services, richie neal, the president s taxes and ways and means and eliot engel, foreign affairs, all have a piece of this. Last week we had three victories in the courts. One, Elijah Cummings court won the president s accountant, that they have to share the information to Maxine Waters the Deutsche Bank decision which is they have to share the information and three, not related to the russia investigation or that, but related to other problems with the president and his view of the constitution, is that we that the court said that he cannot use Defense Department funds to build a wall, to use that money to build a wall. [ applause ] we also had a victory in in adam schiffs committee in that the Justice Department under threat of subpoena and legal action decided that they would get certain Important Documents to the committee and that was a victory. That was four days four decisions in five days, very important to advancing our getting the facts to the American People. Getting the truth for the American People. Where it will lead us. We shall see. Nothing is off the table. But we do want to make such a compelling case, such an ironclad case that even the Republican Senate would at the time seems to be not an objective jury, will be convinced of the path that we have to take as a country. So you mentioned victories in court and mentioned the various committees doing thur their investigations. Some in Congress Want to go further. Representative steve cohen of tennessee opened a dedicated impeachment inquiry, Judicial Committee potentially, are you here in committee open a specific investigation of impeachment. No, you mean he as a member of the committee . Yes. Because the committee has not taken that position. Yes. So there are democrats in congress who want to go further than the existing committee investigations. How do you feel about that . Do you think there is a role for an additional dedicated investigation . Well, let me just say that im very proud of our house democrats. Theyve been very, shall we say, conscientious about how they reach their decisions and it is like 35 of them out of 238, maybe it is 38 of them out of 238 have said that they wanted to be outspoken on impeachment and many of them are reflecting their views as well as those of their constituents. Many constituents want to impeach the president. But we want to do what is right and what gets results. What gets results. And we have to remember [ applause ] so there are some and the president makes more of a fuss about the the 38 than the 200 who are over half of the congress, half of the democrats in the house, sit on one of these six committees. So theyre all on a path of finding more information. Just during the what would not become impeachment but the impeachment investigation of Richard Nixon took months and months of a Senate Committee that was solely dedicated to researching impeachment before they then decided to have articles of impeachment from te house which were never executed because the house and senate agreed and it was a Democratic House and a democratic senate. We have a different scenario now. So the case has to be very compelling to the American People so we are legislating and we wish the press would cover more of that. Thank you, gloria, some of the bills we passed and sent to the senate on safety and equal pay for equal work, violence against women act, gun safety, the list goes on. Climate action now. The list goes on. But in any event, were legislating and investigations and we are litigating. And were going to, as we go down the path, make a decision based on the strongest possible case to get the best results for the americn people and action taken by the special counsel today, i commend him for the work they did to present the facts. Now we have to get it unredacted for the public but nonetheless, and for the congress, by the way, theyll say to me, well show you and i say that is not it. The American People need to know. Were going to show me and then im bound by classified rules of the house, not to tell anybody. No, i dont think so. I dont think so. [ applause ] but in any event, i think that everybody wants justice. Everybody wants the president to be held accountable. And the most serious way. And everybody believes im talking on the democratic side, that no one is above the law. Especially the president of the united states. [ applause ] well come back to the remedies remedies the 2020 election and follow up. And there will be further questions but lets talk about legislative priorities. You mentioned some of the bills. Okay, so how Speaker Pelosi the target of key questions in the wake of listening to Robert Mueller this morning and i heard similar words spoken that would echo what we heard from congressman nadler on what we heard. Namely well continue on our path and nothing is off the table and no one is above the law. So let me on the political piece of this, gloria and van, to you, why is sounds like nancy pelosi, despite everything we heard this morning, is like, slow your roll. She hasnt changed. She hasnt changed and she also pointed out, we were laughing about this, there are only 38 democrats who have been talking about impeachment, not that she counted. With a list of their names. Shes been on the phone with them. And she made the point after that, we need to do what gets results and shes very aware she cant get impeachment approved in the senate and she said, you know, if we ever want down that road, it seems to me we have to be able to convince republicans to do that. And of course theyre not there. I think her caucus will feel that shes setting too high of a bar. That you cant do the job in the house unless the senate handing of a veto to the senate prematurely and shell get criticized for that. This is there is wisdom in what shes saying. This is a big country. And the people who are read the Mueller Report and outraged and compared to the country is relatively small. People are getting ready for graduation and summer vacation. Shes smart to say, youre going to have do a massive education job and when do you it, youll be up against the buzz saw of fox news, and a very riled up rightwing communication structure that will make it very difficult for you to make your case. So she doesnt want to rush into this battle. I think there is wisdom there. But for her to set the bar so high that sounds like shes giving the senate a veto before there is a hearing, think shell be criticized for that. And she didnt nake check bill barr but said im gravely disappointed by the doj. Yes, well, i think what mueller did today basically put out there, you have the split screen before that barr lied when he gave his press conference. That mueller was not bound by the olc opinion which he clearly was. But i think that for nancy pelosi, what i would say to her is youve got to name it to claim it and if that means saying the iword and impeachment and that will strengthen the congresss position with regard to the other committees and the information theyre trying to get because it is an explicit power mentioned in the constitution that is congress sole province. I also think that mueller would be more forthcoming and morrow bust if he were asked to testify as a part of formal impeachment hearings because hi whole point is in order for me to accuse or point the finger, there has to be a formal forum that has a process that ultimately results in the accused being able to clear his name and that would be let me because you brought up a great point. I want to throw back up in case you missed the sidebyside of the policy. Bill barr and Robert Mueller. Watch this. There was no evidence of the Trump Campaign collusion with the russian governments hacking. There was insufficient evidence to charge a broader conspiracy. The Deputy Attorney general and i concluded that the evidence developed by the special counsel is not sufficient to establish that the president committed an obstruction of justice offense. If we had had confidence that the president clearly did not commit a crime, we would have said so. Just, again, to reiterate your point, bill barr, to quote you is lying. And to hear from President Trump and the tweet from the white house and case closed, move on and yet you have bill barr still investigating the investigators. Which is it . To any of you. What is the deal. That is one of the questions nancy pelosi has to answer. And i think that what shes doing i dont think she can come out right now and say the iword. What is holding her back for people wondering. I think what shes doing, as a reporter ill use what i know. Shes reporting the story. She doesnt want to jump to the final end of where the story will go until she reports the story. And what she is doing and what her Committee Chairman are doing is theyve got the Mueller Report, but theyre also reporting the story. And they want to have enough facts exhausting all of the efforts. They want to have enough facts at their disposal so when they get attacked by republicans or maybe convince republicans they have enough, then maybe shell use the iword but i think shes being very meth a add methodical about this because the last thing you want to do is jump into impeachment and she mentioned the watergate example which is it took a long time. Months. It took a very long time. And republicans were dragged, kicking and screaming. Close us out. The thing that we have to keep in sight, though, is the other country here which is russia. Okay. If you are vladimir putin, this is just great. Because he frankly modest expenditure from his point of view and created total chaos and if i were President Trump, i would hope somebody is telling him, you know what, the best thing you could do right now is not be tweeting about this. You should stand up and say im going to crack down on russian interference. I want the next election to have all of this lifted. You dont believe that i got it on my own last time and ill prove you right. He is leaving himself vulnerable to the idea that he got the word now that there is something desperately wrong with our election and did nothing and profited from it. From a capital r. Republic voints of voint of view, that is irresponsibility on the president s part. If he wants the meantle of legitimacy he should go after russia hard and if he doesnt do that, well be in this for a long time. Thank you all so much. I want to get back to mueller. Talking about this man, now the former special Counsel Robert Mueller. What is being lost in todays unexpected statement by mueller is how extraordinary the moment was. Hes been completely silent for two years. Hasnt said a word. And what hed like to be his only and last Public Statement on the patter lasted just nine minutes. Gloria borger and van jones and Asha Rangappa and the morning that was and how lawyerly is that the right word he was. Yes, hes a very stayed understated person. And i think what was striking about what he said was, he said nothing more and nothing less than what is in the actual report. The most quoted i think saw on twitter was his saying, if we could clear him from obstruction of justice we would have done so and we could not. He said that twice in the Mueller Report on page eight and page 182 of volume 2 in case you want to check it out. Thank you. But i think what it goes to is how powerful it is to hear him say that in his own words. His own words. And why it is impossible to know what the effects of actually having him come in and testify in person would be on the Public Opinion and consciousness about what to do about what the facts are in the Mueller Report. So van, for people wondering, why cant he just say, hey, congress, its on you. Its on you. You do the do. Hey, if that that would be great. Dudes, like, a. B. C. And to impeachment. And you cant do that. But part of the reason that his service to the country has been so great is that in this incredibly divided country, the only people at the very far extremes were saying this guy, i dont trust. He is terrible. Most people had a confidence in him that he was laboring along and doing a good job and he kept silent and he wasnt leaking or calling press conference and so when he finally released the report, which most people have not read and read from it. It has weight. It has something called respect. And in this disrespectful postrespect and postability world hes a rare treasure. Other people have to figure out can they rise to the occasion but i thought he did a great job. He had a Great Service to the country. People say thank you for their service and rush to their own political agenda and we should take a moment as a country and to respect what he did. And i think the democrats have a big decision to make. Do they want to get in a fight with this guy. To force him to testify. Who they believe is god and they have respect for him and you heard nancy pelosi talk about him. What do you think they should do . I think they have to have him testify. They do. And the question is will they have to subpoena him. He becomes a private citizen now. I communicated with a senior democratic strategist today who said to me, he has no basis on which to resist a subpoena to testify. There are a lot of Unanswered Questions. And he has to answer them. And he said, you guys are being too soft on mueller. Youre letting him off the hook. That we have to know, why he decided not to interview the president. What does he feel about Campaign Finance violations. What about the office of legal counsel. Maybe behind closed door but he needs to answer the questions. For the public, i do go ahead. Well i would say even if the answers are literally reading from what hes already stated in the report, it is quite a lot. He lays out his legal theories and his basis for doing that and then people could hear it as opposed to having the responsibility of actually reading it. Institutions matter. Institutions matter. And congress as an institution has a role to play. And right now were in the pin ball machine where trump does something and congress it deals like this titfortat and it could feel very petty. Folks at home, this is not petty. This is very important stuff. Congress cannot just say, geez, you gave a press conference and you dont want to come. Okay. That is fine with us. Who are we . Were just the elected representatives of the nation. They have to do their job. And they like him. Democrats like him. Which is why it is such a difficult decision. Thank you. Thank you very much. But we still have a number of unanswer Unanswered Questions including why mueller never insisted on the questioning trump and well talk about a man who wrote a book all about Robert Mueller. Next. Robert mueller speaking publicly for the first time in two years for the longawaited russia report and hopes this is the last time hell speak about the investigation. There has been discussion about an appearance before congress. Any testimony from this office would not go beyond our report. It contains our findings and analysis and the reasons for the decisions we made. We chose those words carefully and the work speaks for itself. And the report is my testimony. I would not provide information beyond that which is already public in any appearance before congress. Cnn contributor aggravae graff is with me now. And so here we have him, the man speaks today. He said he hopes it will be the last time he does so publicly and hes saying that my report speaks for itself but you have several Unanswered Questions. Your first one, did mueller believe the president met the criteria for obstruction . Why is that important . Yeah, and this is where mueller said today that he wont deal in hypotheticals but i think it is really important that push on this question of if the president wasnt president , would he have faced indictment here . And i think the reading between the lines of the report it seems like thats true in at least eight of the ten possible instances that mueller looked at. Mmhmm and the next one, why didnt mueller push to question the president. Why not . This is in some ways the mostin ex plickable because obstruction is based on intent. Why was donald trump taking the actions that he did. And we dont know that from donald trump himself in this investigation. I think possibly the one and only answer here is not the only answer but one of the answers is that mueller believed that he knew why donald trump took these actions and that he took them with the corrupt intent necessary to trigger an obstruction charge. That mueller sort of felt he had all he had the answers that he would have needed. I got you. And then lastly, your question is were any obstruction efforts successful . Yeah, and this is one of the things that i think a lot of people miss as they sort of skip through the, well he didnt charge anyone with the underlying overarching conspiracy to collude with russia during the 2016 election but mueller makes very clear in his report that he feels that he was not able to get to the bottom of some key aspects of this investigation. And in an impeachment trial, trumps lawyers have to make real arguments. They cant reline on giulianitype spin. And everyone thinks the impeachment of bill clinton backfired against the republicans. But two things, the evidence and the gravity of the case against donald trump is infinitely stronger. And while the republicans may have lost a few house seats after the impeachment they won the white house they won a much bigger prize, the presidency, because the cloud of scandal blunted the vote for al gore.
