What a day it has been. Within a span of just a couple of hours, three breaking news stories. The president s long time associate and Campaign Adviser roger stone has been indicted for lying, obstruction and witness tampering. There have been monster delays at u. S. Airports today as well as our airtraffic control system has reached this breaking point on staffing, which led in part to what we just saw moments ago, the president of the United States announcing there from the rose garden this shortterm deal with democrats to put an end to the shutdown mess, keywords for now and so that is where we begin this hour. The president announcing a deal to end the longest Government Shutdown in u. S. History. It is only temporary. The deal reached with democrats only reopens the government for three weeks to give both sides more time to work out a permanent solution. The big announcement coming as federal workers missed their second paycheck on day 35 of the shutdown and as the president is still pushing for some type of wall or barrier at the southern border. As everyone knows, i have a very powerful alternative, but i didnt want to use it at this time. Hopefully it will be unnecessary. I want to thank all of the incredible federal workers and their amazing families who have shown such extraordinary devotion in the face of this recent hardship. You are fantastic people. You are incredible patriots. Here is what democratic sources say this deal entails. Funding the government through february 15th, the hopes of figuring out a permanent solution, again, key here, no money for a border wall right now but it does provide funds for Border Security and it includes a back pay provision for furloughed employees. Lets start with abby phillip and abby, i note this had before i noted this before. It was so shameful to hear the applause, you know, from members there at the white house applauding this man being the president of the United States who is the reason for his 5. 7 billion for this wall for the Government Shutdown. Reporter it was incredibly amazing to hear that from the peanut gallery who had gathered in the rose garden to hear the president and then applaud him on his way out as he begins to close what is an incredibly sad chapter in this countrys history. The longest shutdown ever, 35 days, federal workers going unpaid and at the end of the day, the deal that is going to be voted on today is the same deal that could have been voted on 35 days ago. It could have been voted on on tuesday before the deadline for federal workers to get their paychecks by today, but it wasnt. I think President Trump clearly acknowledged that hes not getting his border wall in this particular deal, but in the process of talking about what democrats are describing as a major cave on the president , the president reiterated so many misleading statements about whats going on in the border, some outright falsehoods about whats going on in the border to continue to press his case for that border wall. We have three weeks in which we will see perhaps real negotiations happening. Remember, democrats have been saying they dont even want to talk to the president about Border Security until the government is reopened. This could signal real talks back and forth about this issue. The president left that rose garden by saying this, that he would shut either shut down the government again on february 15th or he would use executive action to build the wall if he isnt given the wall by congressional democrats. There is a very real possibility that in three weeks we could be right back where we started on this shutdown here at the white house with no progress being made and the government about to be shutdown. One of the things that has been weighing on this white house is all the damage thats been caused by the shutdown but today when everybody woke up to hearing all this news from the airtraffic control system, being crippled by the shutdown, the stress being placed on federal workers, that was one of the main reasons, according to our sources that this pressure really started to really weigh on the president forcing him into the position that he is in right now. There is a real question, though, about whether the president is going to be able to get more out of democrats in the next three weeks than he has been able to get up until this point. Democrats have no reason to give the president his wall especially considering that he has a caved on this. He caved on the state of the union and they have shown that they can get the upper hand from a president who has not actually in his political life seen this kind of defeat before, brooke. Abby, thank you very much at the white house. Lets expand the conversation. With me now is Gloria Borger and elijah cummins. Gloria, is this a total trump cave . Well, yes, when you think about this could have been done weeks ago, that the democrats have been talking about reopening the government and lets have a discussion about some kind of immigration reform. The president said no, no, no, i need money for the wall. He didnt get money for the wall today. What was striking to me was that the president somehow today and my notes are not verbatim, but he did say that the democrats have finally acknowledged that having barriers, walls, fences are some kind of an important part of the solution. I havent heard that from democrats. They have in the past voted for certain kinds of barriers as we know, but thats not apart of this new discussion, so i dont know where hes getting that from and also, he hung out this notion that on hanging this Emergency Authority over your head which you were discussing in the last segment is very questionable legally and thats an issue for conservatives as well because a lot of conservatives think its an abuse of president ial authority. As carrie was pointing out. The clock is ticking on the viability of that and trumps phrase, i have a powerful alternative, i wont use it now dot dot dot. Right now as everyones reacting to this, right wing media is going off over this. How will the Sean Hannitys of the world defend trump on this . I dont know if they can. On my way over here i was texting with a conservative who was close to the white house and he said that this stabbed the base in the heart. This was trumps biggest promise to the base. They really wanted it and hes completely failed to do that and he failed to do it to nancy pelosi who is, of course, their favorite foe. Its really interesting. I was just at the capital. I talked to senator kevin cramer whos a republican senator. He voted no yesterday on the democratic bill which was essentially the same thing just a different date and today said he would support this and basically his reasoning was that the president was going to support it today, but i asked how he could defend it to the base and he said theres no question the base is going to be upset. Im not sure howl the sean han im not sure how the Sean Hannitys of the world will explain it. You still have these 800,000 federal workers or a lot of these contractors who wont get back pay, when are we getting paid . Thats a big question mark. Gloria, 35 days this thing has gone on. He is not getting a penny for his wall and i cant imagine that these federal workers are like, what was all this for . Right. And theyre also thinking whats going to happen in three weeks . Totally. We could be back at square one here in three weeks and despite the president s homage to the strength of federal workers which we have not heard a lot over the past three weeks from this president or his cabinet, he went out of his way to do that today, we know that the democrats are not going to give on the wall and that the president is going to be getting a lot of input from conservatives about how he messed this up. And so we dont know where we are going to be in three weeks. Maybe they will come up with some kind of a compromise that they couldnt get but if that involves dreamers, for example, we know where the democrats are and we know where the president is and theyll never agree on that. Then the base would really get angry. So im trying to think in my mind where do they go on this . Where can they go and maybe the National Emergency is the place they go or the president goes but that doesnt solve the issue either because it winds up in court. Eliza, whos the key lawmaker to watch behind the scenes moving this whole thing forward . Weve got to watch Mitch Mcconnell. He stayed quiet for a really long time in december. The Senate Unanimously passed a bill very similar to this one and the president said he wasnt going to sign it and so mcconnell said, all right, hands off. Deal with the democrats. And then we saw him come back on the scene this week. He held those two votes yesterday, one was the democratic bill, very similar to this one, the other one was the president s proposal, both failed. The democratic bill got a few more votes. They got six republicans on their side, but mcconnell basically people said that that was a message. He was trying to say look, neither worked weve got to come to the table and then we saw real movement. Watching mcconnell on this, the freedom caucus, the conservatives have a lot of influence on the president. They were in the white house when President Trump decided he was going to shut down the government. We need to be watching them on this. So far theyve stuck by him. Mark meadows said lets see how democrats do in these next three weeks, but they are very tapped into the base. We need to be watching Mitch Mcconnell who is understands congress very well and what deals can get done and the conservatives whispering in trumps other ears to just play to his base. I think Lindsey Graham is somebody you need to watch. Thats true. Hes sort of the newest trump whisperer. And but dont forget, Lindsey Graham is somebody who way back in the day signed on to comprehensive immigration reform, has always been for it, which is not where the president is, but who has been talking about a compromise and so i think he could end up being some kind of a gobetween but then hes not very popular with conservatives on this issue. Maybe hell play a few rounds of golf with the president in florida and they can figure it out. I dont know. Lets hope that is that is a game of golf that actually results in something here for everyone involved. Gloria and eliza, thank you so much. He is now out on a quarter Million Dollar bond after being arraigned in a Florida Court on a slue of charges among them, obstruction, false statement and witness tampering and here he was walking out of court. I will plead not guilty to these charges. I will defeat them in court. I believe this is a politically motivated investigation, but i have made it clear, i will not testify against the president. It all started with a dramatic raid this morning at his home in ft. Lauderdale seen here in the cnn exclusive video carried out by fbi agents were not being paid at the time because of the Government Shutdown, but the main takeaway is this and its a huge one, is that roger stone is accused of seeking stolen emails from wikileaks that could hurt trumps opponents in coordination with Senior Trump Campaign officials. This is the first time prosecutors have alleged that there were additional people close to the republican candidate who were involved. We dont know their names but we do know at least one persons actions. Let me read this section for you now. After the First Release of dnc emails, the senior trump official was directed to contact stone about any additional releases and what other damaging Information Organization one, organization 1 being wikileaks. The big question now is who in july 2016 could have been considered a Senior Trump Campaign official. With me now is ellie hoenig and elie was an attorney for the Southern District new york and jennifer is a former federal prosecutor. Lets just zief right in. Just between this moment, you know, in front of the courthouse with roger stone and that entire indictment, what is your biggest takeaway . To me now is no collusion is just straight up empty slogan. We now know for sure that the russian effort to hack the dnc and to put those emails out through wikileaks has now landed squarely in the upper reaches of the trump campaign. There is no getting around that. If you look at this indictment, we know every word that Robert Mueller puts in writing is correct, locked in and for a purpose. You can say no collusion. He hasnt been charged with collusion. Thats not a federal crime. This puts the hacking effort right in the campaign. The line the was directed he was directed to contact, do you think thats the most damning line of this whole thing . Its the one that most puts trump in the middle of this. Who could be directing Senior Campaign officials, no one other than the candidate. It really does read as if trump was on board with roger stones contact with wikileaks, getting the dirt from them, getting specific dirt from them on topics that they wanted to use in their campaign against hillary clinton. I always try to avoid passive voice and this was written in passive voice in the sense that it said directed was directed. It didnt say someone directed Senior Trump Campaign official to reach out to you know, you think thats purposeful. I do. I do. Jennifer and i hate passive voice. What when you do an indictment you name the defendant and everybody else gets a label individual one, executive one, Campaign Official one and by phrasing this in the passive voice it allowed mueller to side step that. He didnt have to say person one or official one or candidate one or anything like that. I also want to pick up on something that jennifer said. The coordination was not incidental. It was strategic. If we look at the emails laid out in this indictment, they are talking about where do we make these leaked emails count the most. Theres a part theyre talking about we want emails from a specific date range august 10th to the 20th. Theyre looking for something specific. Hillarys people are pushing back. These are strategically coordinated emails and texts that are now linked from the campaign to the russians. On the emails and the texts, you know, everyone says mueller knows all, everyone keeps saying that he has all the receipts, all the emails, all the documents. The prosecutors note that stone was in the possession of emails and text of the hacked documents at the exact time he lied. So my question would be why lie about something that is demonstratively false . That is so often the question that we ask ourselves youre like, hey, we got the email right here. Hes sitting there saying, there were no written communications between me and my conduit and yet there are dozens and dozens and dozens and he must know these electronic records dont just disappear. He didnt set fire to them and put them in the fireplace and theyre gone forever. Its hard to know that this was all part of this big bluster campaign that roger stone was carrying on. He was saying, oh, yes, it was me i knew all about this wikileaks stuff and then he said no, i didnt. The moment he goes before congress were now in a different boat. I want to give some credit to the representatives who asked the right questions here. Those folks dont know how to phrase questions in the right way. They make People Like Us cringe. This time they did. They asked the right questions. Thats the only time he was testified and subject to those penalties. Stone is a weird bird, right . He is . We were talking about some of his personal everyone should go back and read Jeffrey Toobins interview of him in the new yorker. Roger stones personal motto is admit nothing, deny everything and launch a counterattack. We saw it on the courthouse steps already. The nixon tattoo, the cameras, the mention of the godfather. Probably the last thing you want to quote from. Let me just it you both right now. Thats one of the huge stories. The other big story, the breaking news, the president and democrats making this shortterm deal now to reopen the government. This is what we just got from the president speaking at the white house. They are the eyes and ears for pilots on the ground, juggling countless flights each and every day in an extremely stressful job. Chris gilbert is with me now and jim marineti who is Southern Regional Vice President of the airtraffic controllers association. First and foremost, thank you so much for what you do. We are talking just quickly just for perspective. If you take thigh quill, you cant be an airtraffic controller for two days, that is how on point and how much of a perfectionist you have to be to do this job. You saw the president s announcement, the applause at the white house for the government reopening for three weeks. You called this irresponsible and we talked the other day. How did you feel about watching the president today . I was relieved. I was relieved to hear that the men and women are going to get the support structure that they need back in the facilities. Well start hiring again, training again, getting our people paid, first and foremost. Figuring out who really is going to lead the profession, who we can get back. Im concerned its for three weeks. I hope that theyve seen that the harm theyve done, not just to the Aviation System but to this country with all of the other critical components of government being partially shutdown, they dont do it again in three weeks. I hope they never do it again. We need to figure out a way that that doesnt happen. I dont know what that looks like but this cant happen again. What kind of harm has been done in 35 days . Theres been an immense amount of harm in such we are the largest safest most efficient airtraffic control system in the world. The Gold Standard that everyone else looks to and its going to take some time. The faa academy has been closed for 35 days. Those are classes that are hard to make up, the hiring and the training that has not been accomplished will be difficult. The Ripple Effect for that could take years to catch up. We were just catching up to 30 year low of airtraffic control staffing in this country. Working collaboratively with the faa to make this work and this has set us back. Have either of you given any indication when the controllers will be paid . No. We have a great relationship with the faa our employer and weve been in constant conversation with them about making sure that we keep the system as safe as we can during this shutdown without all the critical components we were missing. I think they will do everything they can to get money in the pockets of people that have been working before christmas without pay. We count on them to give them something. Then well figure out all the details later because theres a lot of pieces to put back together to get things back to normal. With all the pieces still not together, when will you all be sort of back to normal, like all running full speed ahead . Running full speed ahead is a relative term. Its not just airtraffic controllers. Aviation Safety Professionals all across the country and we have to think about the contractors that have been ignored through this process and we rely on to help us do various morndization projects. Who wont be getting back pay . That is a true statement. Theres a lot of its going to take a true collaborative effort to move this forward and lets do it the right way. I do believe the relationships we have built show promise for us moving into the future, but its going to take going to take some time. The next several months will be key. You mentioned this off the top, do you how worried are you that were going to be exactly where we are in three weeks or hopeful . We cant be there again. We have to be responsible. We have to figure out a way to get in the room together and work these things out. We cannot hold people hostage while you trial and work something out, whatever the issue is. They need to be leaders. You feel like workers have been hostages . Absolutely. Your face just told me all i need to know. Absolutely, brooke. A crisis was caused where there was none one month ago and it was done on the backs of federal workers. We save lives every day and to play with the public trust like that just really isnt fair to anybody and its not safe. Jim and trish, thank you so much. Thank you, thank you. As democrats have said all along, the solution to this impasse was separate funding for the government and then go over our disagreements from Border Security. Separate the funding of government from the discussion on Border Security and thats what we got and democrats, in the senate and in the house, were united behind this position throughout the shutdown and ultimately this agreement endorses our position. It reopens the government without preconditions, gives democrats and republicans an opportunity to discuss Border Security without Holding Hundreds of thousands of American Workers hostage. We expect the continuing resolution to clear the senate and clear the house this afternoon and be signed by the president today and before i go on, i think on both of us, we want to thank all the federal workers from the bottom of our hearts. Theyve worked so selflessly this past month without pay, showing up to do a job they knew was important, but for which they werent fairly compensated. The workers showed up despite the callous indifference of the administration who treated them as hostages, who treated them as pawns, who belittled their financial strain. Our dedicated Public Servants should never, never have to go through this again. We will do everything we can to make sure they wont have to and this past month is proven just how Vital Government Services are to the American People, whether its our food safety, our airports, our national parks, our economy, our National Security and so much else. The American People do not like it when you throw a wrench into the lives of government workers over an unrelated political dispute. Working people throughout america empathized with the federal workers and were aghast at what the president was doing to them. Hopefully now the president is learned his lesson. Now, once the president signs the continuing resolution, we in congress will roll up our sleeves and try to find some agreement on Border Security. We dont agree on some of the specifics of Border Security. Democrats are firmly against the wall, but we agree on many things such as the need for drug inspection technology, humanitarian aid, strengthening security at our ports of entry and that bodes well for finding an eventual agreement, but today the president will sign the bill to reopen the government along the outlines of what we have proposed and hopefully it means a Lesson Learned for the white house and for many of our republican colleagues. Shutting down the government over a policy difference is selfdefeating. It accomplishes nothing but pain and suffering for the country and incurs an enormous political cost to the party shutting it down. We cannot, cannot ever hold American Workers hostage again. Speaker pelosi. Thank you very much, mr. Leader and thank you for your leadership in bringing us to this important resolution now where shortly the senate will send over to the house the paper i came over to see the original paper and well get it probably in a half an hour, our two resolutions, one to open up government for all of the agencies of government and one to proceed to conference on the Homeland Security bill. Were please that had we reached an agreement to reopen government now so that we can have a discussion on how to secure our borders. It is very clear that we all understand the importance of securing our borders and we have some very good ideas on how to do that and that will be part of the discussion as we go forward. House democrats look forward to working in a bipartisan bicameral way to pass all of the bills to open government as we proceed into the conference discussion. I was forged in that culture and i know left to their own device thats the appropriators bicamerally and bipartisanly can come to conclusion. Sometimes it comes to the four principles of the leaders of the house and senate to weigh in and i think that we will have a very productive time and a short period of time to come to some conclusion. Were inspires by the courage were inspired by the courage by americas workers. They have shown such strong character but nonetheless they have to pay the bills when they come due whether its a rent check, paying their mortgage, their credit card bills, their car payment, the list goes on. Some of them didnt even have gas money because they didnt have cash or any more line of credit card ability to put gas in the car to go to work. Its really hard for some in the administration to understand how people live paycheck to paycheck and how marginal some of their existences are. It makes a difference in how they educate their children, how they put food on the table, again, how they pay the rent, et cetera. We thank them and are so glad that as the president said earlier, as soon as possible, or immediately, so i dont know which is faster, but the quickest of the two they will receive their back pay and the pay that is due today. Were grateful to democrats on both sides of the capitol for their unity that was very, very important in these discussions. Its sad, though, that its taken this long to come to an obvious conclusion. We talked about missed bills and Financial Security being shaken, sometimes questioning putting in question the credit how peoples credit is viewed and thats particularly problematic for our veterans many of whom are in their jobs with security clearances and a security clearance is affected if your Credit Rating is diminished. So we are grateful to our veterans who have donned the uniform of our country to protect us and moved on to civilian side to continue their Public Service and we want them to have all the respect they deserve as well as our other Public Employees, federal employees who are working so hard to meet the needs of the American People. We value their purpose. We appreciate their diligence in performing their jobs whether as the leader said keeping us safe in terms of civilian aviation, whether its the fbi, other areas of Public Safety but also just in so many ways, whether its food safety and the rest. The list goes on. Youre familiar with it, but we dont want in any way any shut down of government to diminish the respect that we have for the purpose of our Public Employees and the excellence of their service. Disagreement in policy should never be a reason to shut down government. I cant characterize the president s evaluation of i suggested we use a Conference Committee format. That Conference Committee has d democrats and republicans sitting at a table has worked very successfully on Homeland Security and everything and all of the other bills that havent been signed over the last several years even when the republicans were in charge.
