We still doesnt know what exactly hes referring to but all of this is just part of what has been happening over the last several days, which is President Trump trying to lay out the argument for his border wall, both saying there is already wall being built but also demanding more money for a new border wall. He added an element today saying he wants to build a new wall or renovate wall by the next election. So President Trump really shifting his language on so much of this conversation around the wall, trying to gain the upper hand over democrats as the government remains partially shut down. Nowhere in this tenminute diatribe from the president today did he talk about where the compromise might be that might bring an end to this shutdown. He claimed he had spoken to federal workers who wanted him to keep the government shut down because they understand the need for a border wall. Thats another thing that we dont really have much of an idea what hes referring to. Day four of a Government Shutdown, there does not seem to be any end in sight. President trump is digging in his heels on this issue blaming democrats and implying that the border wall is going to be the fight hes going to have perhaps until nancy pelosi takes over the gavel of the house of representatives in january. And what happens he loses leverage when that happens, when the democrats take over the house. Before i let you go, abby, again today, yesterday the president on Christmas Eve fired off many, many tweets, including one going after his own fed chair, the man he put in this role, nominated and clearly has made clear publicly and privately that he has some regrets about doing. He went after the fed chair again on camera in the oval office on christmas day. You know, do you have any sense from people youre talking to that theyre trying to get him to stop, given the reaction and the effect that it had yesterday when the markets were open . Today it didnt have an effect because the markets are closed. Reporter well, clearly in this administration, folks are worried. There was an attempt over the weekend by Steven Mnuchin, the treasury secretary, to tweet out a quote that he attributed to President Trump quoting President Trump saying i dont believe i have the power to fire federal chairman jerome powell. President trump was basically asked to instill some confidence in his fed chairman today in the oval office and he declined to do that. Now, its clear that there is a disconnect between the president and his aides who have been advising him behind the scenes repeatedly, we dont believe you have the power to do it and even if you did, it would be catastrophic to the just to the electoral process but the president did not take an opportunity today to calm markets that have been roiled over the last several weeks because of his policies on the trade war but because he has been so frustrated with powell behind the scenes, that has boiled over into the public. While he voiced some support for Steven Mnuchin today, he did not voice any real support for jerome powell. He still says he thinks Interest Rates should not be rising and the fed should stop. A statement was put out on sunday saying the six big banks are liquid, raising questions whether there was a problem with their liquidity when nobody was asking that question. Its true in politics, its true in the schoolyard. I think thats why this could be a protracted, longterm thing. Democrats clearly believe that theyre on the right side of Public Opinion and that donald trump has said, hey, blame me if theres a shutdown. Republicans usually do get blamed in most cases for shutdowns regardless of the merits money merits. In this case i think trump has invited this. And for donald trump, its about pleasing his base. Hes shown he cares mostly about satisfying his base and this is the time to do it. Where does that end . I dont know. Matt, have you ever seen a president elected with just a base . Meaning only one time in 2016. But he had a lot of independent support and support from i guess what youre saying is people who became his base who werent naturally republicans before. But my point is at some point since hes looking at the calendar and looking at the fact that hes going into an election season and cycle, is this really going to swing it . First of all, i think reelection isnt his own considering here, its investigations that may be coming and possibly impeachment. When those are factors, having a very strong base actually really does matter because youre going to need them to stick with you, especially if things get really dicey. Going into the reelection, though, i think trump has made this really weird calculation. Any normal, rational politician would try to expand the base and try to win over people. Trump has never done it. And so the only theory, i guess, is that you plan on losing the popular vote and running that straight flush winning the Electoral College again. Do you see a scenario having covered these before, next week i guess, where the house is going to be democratic controlled. Do you see a scenario where he gets a win here, particularly when his cards are going to be worse at that point . I have a hard time imagining that nancy pelosi remember, she has a base to satisfy, too. And she needs to be elected speaker. So i find it hard to believe shes going to back down. Shes holding some pretty good cards right now herself. I think its also unlikely that donald trump is going to marshal the rhetorical ability to change minds over this. He has an argument about the border but i dont know that he has the eloquence to change minds. My guess that segment you were just talking about, it looks like hes moving the goalpost a little bit. Hes talking we dont need a 2,000 mile border, we can just have fencing in certain areas. Sounds like he is setting things up to declare victory without getting a victory. Over the weekend, bob corker, outgoing chairman of the Foreign Relations committee has tussled with the president. He said that this whole thing is phony. And it reminds me of something that claire mccakacaskill of missouri, a democrat who was defeated said to manu raju about more broadly what she hearse from republicans colleagues behind the scenes. I want you to listen. Theyre keeping their head down. Heres what theyre rationalizing in their heads. Now, theyll tell you if its just the two of you, guys nuts, he doesnt have a grasp of the issu issues, hes making rash decision, hes not listening to the people who know the subject matter. So they prescribed him with antibiotics and ibuprofen. He was released with his father and then it was hours later, last night, Christmas Eve, that he started throwing up. He was transplatorted immediate back to the Medical Center and died shortly after midnight on christmas day. Im sure you remember the beginning of december, a 7yearold girl was sick, she became to vomit and 48 hours after entering the united states, she died. There is not an official cause on either one of these deaths but the arm of the professional responsibility of Border Patrol is now conducting an investigation on what caused this little boys death. Both had made the 2,000 mile journey to come to this country. More questions i think now than answers but two children are now deceased. Its just absolutely horrible. What are your thoughts on that based on your firsthand knowledge of whats going on in some of these facilities . I want to condition what im saying that its too early in this particular instance to speak to the circumstances that led to this childs death, who is at fault, who is to blame. We wont know any of that until there has been a thorough investigation by the cpb and likely an outside agency. Until we know that, its too early to say what happened and who was to blame. However, what i can speak to is that in this country we have two realities when it comes to our immigration detention system. We have the legal reality, which says that the government must provide migrants like this young child and like jacqueline with a hot meal, medical attention and adequate shelter as soon as they encounter them. But the reality is the Detention Centers are in remote locations and face credible allegations of denial of medical care, physical assault, Sexual Violence against women and they found that 80 of the facilities did not meet their own internal standard for guaranteeing the basic health and well being of these migrants. These Detention Centers were designed primarily for young men because thats who traditionally came from the southern border up from mexico and central america. Now we are facing at this border an influx of families, mothers, young children, many people who are already in a vulnerable condition due to the trek and the system is not designed to handle them and tragically we see results like these two children diying. We have more questions than answers at this point. You mentioned the medical situation there. Jeans reporting is that this little boy did get medical attention. Were going to hopefully learn a lot more about the circumstances about that visit and why he was sent home. I do think one other thing just in terms of the facts as we know them that should be something that people should think about and possibly even worry about going haahead is the are isolated incidents and we dont know the circumstances. Right now the u. S. Government has a Record Number of Migrant Children in their care, 15,000. Worlds away in washington politically, the president keeps talking about the wall and how he wants to build a wall and what it would do. It would likely not prevent tragedies like this because people, the families, they were coming over the border to prevent themselves for asylum. So even if the wall were in place, we would still likely see horrific outcomes like this. Raul, thank you for joining me. Its a horrible story. Coming up, outgoing defense secretary jim mattis addresses the military one last time as we learn new details about his relationship with the president. And a sobering look in the white house about how National Security decisions like the one in syria, are being made. Secretary of Defense James Mattis resignation triggered anger and anxiety in the military and beyond. He received kudos and praise for his bravery and his judgment. But cnn has learned some defense officials are expressing some frustration with him. With me now to talk about that and more cnns pentagon correspondent barbara starr. Reporter well, you know, now that several days have passed and people have had a chance to chew it all over, i think what youre beginning to see is everybody has an opinion about what happened and what maybe should have happened in their view. So talking to some defense officials theyre raising the question he had been sidelined by the president , they werent getting along, trump was not paying attention to his advice on any number of issues. If and who knows monday morning quarterbacking, if the secretary had resigned sooner, could they have gotten someone else in who would have been more influential with the president. That is to say one does not understand who james mattis is because hes not a quitter. It makes it all the more interesting that he finally came to that breaking point to say he had to go, knowing that in his own mind over the question of withdrawing troops from syria. He couldnt by all accounts really support the decision because it would leave the kurdish fighters he promised to keep backing, it would leave them abandoned. Dana . Youre exactly right. He stuck with it for a long time, clearly having some battles internally. There was something that struck us that was in a newspaper in seattle from the secretarys brother, general mattis brother. I wanted to read it to you and get your house on it. He was very calm about the whole thing, very matter of fact, no anger. No one should assume that his service to his country will end. And the manner of his departure is yet another service to the nation. It is the very definition of patriotism and integrity. A lot of things to unpack there but the this evening that is really interesting is no one should assume his service to his country will end. What do you think that means . I think his brother, tom, probably knows him very well. This is a family with a long, many decades record, including his mother, who worked at the pentagon, of serving the country. And jim mattis his whole life with becoming an adult and joining the marine corps. When he retired from the marine corps, he went out to california and worked at the Hoover Institution as an analyst and kept very active in National Security circles. One suspect it is will probably start that way. He may rejoin some of the corporate boards he was on. Dont expect to see jim mattis completely fade away. Its our understanding hein wants to let some time pass. Well have to see whether he writes a book or starts speaking much more publicly about his experience as defense secretary. There has been collusion but its been by the democrats. Its to the the first time the president used that when talking about the democrats and talking about special counsel Robert Muellers ongoing investigation. So far multiple people linked to the president have pleaded guilty to various charges. With me now to discuss this is eli honig. President ial harassment, is that just his term for checks and balances . Well, ill tell you this, dana, i was a prosecutor for a long time, ive heard a lot of Different Cases and statutes. There is no such thing as president ial harassment on the law books. I think what the president is trying to do is create a narrative here that casts himself as a victim of robert mueller, of the Southern District of new york, of the fbi and hes now anticipating whats going to happen next week when the democrats take over the house of representatives and i think hes correctly anticipating hes going to see an onslaught of subpoenas and investigations. But even more sophisticated than that, hes trying to advance this notion that hes above the law, that because hes the president of the united states, he can do whatever he wants heeshs cannot be subpoenaed, he cannot be indicted and cannot even be investigated. I think were going to have a real legal showdown there. I think youre exactly right, that he is playing the victim. And it works. And some of his political advisers have told me that the more russia is in the news, the more it helps his numbers politically because those independents who are not thrilled with him, some of them tell their pollsters that they feel that hes getting a raw deal. So i think that is exactly right. That plays into it. You are an attorney. You dont just play one on tv like me. Do you if the president called you and said, hey, eli, i saw you on tv and i want some legal advice going into the next year, what would it be . A couple things. First thing id sap put down the phone, stop tweeting. You wouldnt be the first to ask him that. I think hes a tricky client. I dont think hed listen to me. Hes only digging himself in deeper, especially on the obstruction case. And i think this question would be well advised to take a page out of bill clintons book in the late 90s. When bill clinton was being investigated by ken starr, clinton created a separation. He said im going to go on being president day by day, independent not going to directly case publicly. My lawyer are going to handle the criminal investigation. Im going to create a separation so i can have myself not be distracted. Its a savvy way to approach what is really a difficult situation. Bill clinton cut deals with republicans, there was a shutdown then and at the end of the day, the republicans got blamed for it. Thats a different story. But youre right, hes not an easy client, lets say, when it comes to President Trump, which i think is an understatement, thing aboe biggest understateme the year. Id take the case. And also what observations about you take to use in the film . Initially it was hugely nerve racking. Was it . I had the idea at my uncles funeral but you never heard about this first case until uncle martys funeral. It was astounding. Oh yeah, at some point you were my age and you became Ruth Bader Ginsburg. How did you do that . Thats what i wanted to understand. I was pretty newly married and my wife and i looked to them as our role model. So shes at harvard law at one of very, very few women in this class. Nine in a class of 500. Then it goes through this first massive case where she is there with her husband standing in front of the tenth Circuit Court arguing this case for this man. Why choose to really focus on that case for the film . Because its the only case that ruth and matter ever argued together. So the story is about a marriage, its about a family. Its about the two of them fighting in court for what they also figured out to do at home, which is live as true equals. There is a line by this Harvard Law School professor, a court ought not to be affected by the weather of the dave but day but of the climate of the era. Can you speak to that . Absolutely. I have great confidence in my intelligence people, but i will tell you that president putin was extremely strong and powerful in his denial today. Angry democrats and republicans lashed out in disapproval. Senator mccain called it one of the most disgraceful performances by an american president in memory. But that wasnt the only 2018 trump shocker on the world stage. After months of rhetorical fire and fury with north koreas kim jongun, President Trump broke precedent by agreeing to a summit in june in singapore. After a nearly fivehour trump kim meeting, they announced what they called a denuclearization agreement. Despite the warm embrace, 2018 comes to an end with reports that the hermit kingdom is still operating secret missile bases. You have made history tonight it was the year of the woman with recordbreaking numbers of women running for and winning races on a local and national level. Especially congress. 14 women elected in the senate, bringing it to a total of 25. 102 women will serve in the house next year, breaking the previous record of 85. Women from all walks of life are flooding the hill, with one exception. Republicans. Only 13 gop women will be in the house next year. The lowest number in a quarter century. Supreme court fights are always high stakes, but President Trump never imagined what would happen when nominating brett kavanaugh, be someone he thought was a rather safe pick. Several women came forward, accusing kavanaugh of sexual misconduct, leading to a day of public testimony for the ages. Starting with Christine Blasey ford. I believed he was going to rape me. I tried to yell for help. When i did, brett put his hand over my mouth to stop me from yelling. Kavanaugh followed with a fiery defense. Im not questioning that dr. Ford may have been sexually assaulted by some person in some place at some time. But i have never done this. Fords story touched a nerve among women across the country who have been sexually assaulted and afraid to come forward or not believed. A new front in the me too movement. Republican jeff flake had Just Announced he was a yes vote, and this happened. Youre telling me that my story doesnt matter. A rattled flake worked with democrat chris coons to delay the vote for a week while the fbi investigated. Kavanaugh was ultimately confirmed to the high courts swing seat. Trumps second Supreme Court win in just two years. A kavanaugh no vote would cause trouble for some red state democrats up for reelection in places like missouri, where that states now gop senator elect, josh holly, protected it would be a gamechanger. And he was right. Big deal . Very big deal. Like, that could make the difference . Yeah, i do. Gop backlash over the kavanaugh fight energized their base, and helped republicans maintain their majority in the senate. And cnn projects that democrats will reclaim control of the u. S. House of representatives. On the house side, a very different story. Democrats found that blue wave and rode it back into the majority, winning 40 seats. Almost twice the 23 needed to take back the house. There was no collusion whatsoever. Its been over a year since special Counsel Robert Mueller was given the mandate to investigate russian interference in the 2016 election and any possible collusion with trump aides or associates. The president spent the year trying to undermine it. Its a terrible witch hunt. The Mueller Investigation has revealed that many in trumps orbit had contacts with russians. 16, to be exact.
