Fired back saying this to the judge saying today is one of the most meaningful days of my life. I have been living in a personal and mental incarceration ever since the day that i accepted the offer to work for a real estate mogul whose business acumen that i deeply admired. The father of two then added he was committed to, quote, ensuring that history will not remember me as the villain of his story. Cohen also brought up this recent insult from the president. Hes a weak person and by being weak, unlike other people that you watch, hes a weak person and what hes trying to do is get a reduced sentence. It was because time and time again i felt it was my duty to cover up his dirty deeds. Lets start with carasca oscane. Why three years . Reporter he pleaded guilty in an agreement with the government. They use the math that you get to this number of this range where he was facing between four to five years in prison. You know, cohen and his lawyers said that, you know, he really shouldnt serve any time because hes trying to make amends, hes cooperating with the investigation, with the special counsels office, but the u. S. Attorneys said, hey, hold on, these are serious crimes, this is tax evasion. Youre lying to a bank amid Campaign Finance violations and the judge ultimately agreed with them. He said he wanted to encourage cooperation, which is why we see him serving 36 months, three years, less than the potential four to five years, but he also said given the importance of the special counsels investigation, that Michael Cohen lied to congress, that these crimes needed to be faced with deterrence. He wanted to deter other people from lying in such highprofile events. He said democracy and our Democratic Institutions depended on people cooperating and being truthful when working with the government. He said he committed crimes far on his own that were very serious in and of their own and thats why cohen deserved to serve three years in prison, let it be a message to other people out there, brooke. Three years. He goes to prison in march. Lets take a deep dive in all of this. Attorney general berit berger and you, sir, you called it, three years. Yeah. Lucky guess. I think we saw the perfect en encaps lags of his wirise and fall. I cooperated but kind of, not really. I take full responsibility but everything i did was for the president. It was a bad day for Michael Cohen. It was also a bad day for the president. He got blamed a lot. We call it the empty chair phenomenon, you blame the guy who is not there to defend themselves. That said, all the things that Michael Cohen said reflect badly on the president. The sdny didnt mince words but mueller said he did speak the truth, said he was cooperative, he doesnt go to prison until march. Might he continue to cooperate in that time . He might. Everyone heard cohen was first pleading guilty and was in a cooperative stance. People had high hopes. They say think of the cases he could break open. I think after todays sentencing, in my mind its unlikely that his continued cooperation would be significant. Thats for a few reasons. One, its harder to use a cooperating witness after theyve been sentenced because your leverage over them has been weakened and, two, the Southern District of new york went out pretty far on a limb in saying he had this pattern of deception, that he had been engaged in all of these lies. It is harder to call somebody as a cooperating witness when their history of lying and deception has been highlighted for a court. As you were telling me yesterday, its like sdny, its all or nothing. You fully, fully cooperate or deuces, youre off to prison. We dont play around, yeah. Lawyers for cohen told the judge that cohen thought trump was going to shut down the Mueller Investigation. And so that is whether essentially cohen goes to mueller and is like, whoa, whoa, whoa, ill cooperate. That is significant. So, yes. I would immediately be on the phone with cohens lawyer and say you say he wants to be a good boy and cooperate, lets hear about that. How do you know that . Right. What was being said . That argument didnt ring true for me. If the argument was i, Michael Cohen, believed that the president was about to shut it down so i cooperated, but he didnt fully cooperate. The Southern District made a point of saying he declined to go into certain areas. Are you the hero or not . Bigger picture, as weve learned, as he said he had talked to the white house before talking to congress. We know manafort had talked to the white house as recent as the spring, as he was, quote unquote, what we thought at the time cooperating and it leads one to wonder what was going on. We should also just remind everyone that cohen is still cooperating and the investigation is to the Trump Organization, trump tower meeting and things that would directly impact trump. Cohens lawyers compared this moment to watergate, seeing him as a john dean type. The judge is reminding everyone and we were tacking abolking ab tough this judge is, no, hes not the hero. Is it possible that he could in a sense rewrite history so that he isnt the villain in the end . I think thats definitely what his intent was in doing all of this and he was trying to get in front of all this. I think his position as a lawyer played a really significant role in his sentencing today. When the judge talked about how he is held to a higher standard, Michael Cohen himself talked about how he had this Blind Loyalty to trump. All of which is to say that Blind Loyalty is really the one thing that a lawyer is not supposed to have with their client. There are high ethical and legal guidelines for lawyers as to how theyre supposed to interact with their client. Blind loyalty is not one of them. Youre there to advise and counsel, not to help facilitate criminal plans. We know that cohens lawyers went after trump. The question now is how does trump respond . We saw trump last week saying throw the book at him. In that reuters interview last night, trump said, number one, it wasnt a campaign contribution. If it were, its only civil. And even if its only civil, there is no violation based on what we did. We did. Hes all over the map. He didnt know about it, now he knew about it, now its something we did. Ultimately i think the wagons are circling on the president here. The news that just came out is that the Southern District has immunized ami, which was the vehicle. Were about to get to that. That was the vehicle for one of the payments. If you sort of do the math here, cohen convicted, pled guilty, pecker and weiselberg immunizei, and ami, corporate, who is left in this . The president. The person standing in the middle is the president. Is the Southern District gearing up to indict the president . I doubt it. But this Campaign Financing is a growing problem for the president. Some more in depth, some less in depth. Don jr. , ivanka trump, jashd kushner. These two people work in the white house. Cohen was his closest adviser for a decade, guy he relied on, fixed his problems. Manafort was the campaign manager, rick gates was the Deputy Campaign manager, jeff sessions, michael flynn, National Security adviser. Time and time again you go through this and think and you and i have talked about this before, this all adds up think of this as smoke, smoke, smoke, smoke. Theres not a fire on here as it relates to donald trump yet, right . My gosh, the smoke is so thick at this point, its hard to see in front of you. I think thats something that donald trump in maybe his more honest moments is coming into realization of. This is a lot of contact to have with a foreign entity. We know because the Intelligence Community told us was actively interfering in an election to help donald trump and hurt Hillary Clinton. Lets go back to Michael Cohen. His attorney in court compared the russia probe to watergate. Lets delve into that as someone who will know. He was a Watergate Special prosecutor and hes now a cnn legal analyst. Richa richa richa richard, welcome. They were comparing Michael Cohen to john dean. Well, john dean well to jail, remember, and he pleaded guilty and that was a condition of his being a cooperator in watergate. So notwithstanding everything that john dean had to offer by way of cooperation, he also pleaded to a felony and did jail time. So what were looking at with cohen, i think, is rule 35 of the federal rules of criminal procedure, which allows for a convicted and sentenced defendant to make a motion for reduction of sentence based on if he continues to cooperation. Based on substantial cooperation with the government. So thats still open to cohen. In the Southern District, you cant go halfway. You can say youre going to cooperate fully and not do it, and he did not. There are all kinds of things. Hes got a lifetime in his professional life full of stuff, tax evasion, a variety of different scams unfortunately that have come home to roost and were uncovered by the Southern Districts search warrant of his office, hotel and so forth. And so that information did him in. Then came the very significant cooperation that he has offered to special counsel mueller. And that will continue, in my opinion, and he will have the opportunity to get another bite at the apple, as it were, on his sentencing. So today is a reflection of the ethos of the Southern District. If youre going to cooperate, cooperate 100 . You cant do it halfway. Theres no kind of sort of cooperating with the sdny as weve all learned. So he will continue cooperating, at least we know that for sure with regard to the Trump Organization. Well wait to see if rule 35 comes into effect. Let me ask you about this. Cohens lawyers went after trump. And so the question is how will trump respond, right . So last week we know trump had said throw the book at him. And then in this interview with reuters last night trump said, quoting, number one, it wasnt a campaign contribution. If it were, its only civil. And if it were only civil, there was no violation based on what we did. We did. Yeah. So every time the president opens his mouth to opine on some aspect of the investigation, he only digs himself deeper into a hole. And this is why should this be any exception to the trump rule of making everything worse possible . So what i look for in the next phase of the Mueller Investigation is the financial piece of this. And i think there is information not only that mr. Trump will hear from cohen, but also from the Trump Organization and the individuals who are cooperating with the special counsel from the Trump Organization. And the question in my mind is whether there is information that suggests that the russians directly or indirectly have provided assistance over the years to mr. Trump that then can be used to compromise mr. Trump and may explain some of the very unusual behaviors that we have observed toward russia. Support for the war in yemen. They would not allow the change. Essentially makes it easier for the House Republican leaders to deny that from coming up to the floor as a vote. This comes as of course the white house has fought furiously to try to deny, reject that bill at all costs as theyve aligned themselves with saudi arabia and with that war effort in yemen. This comes the same date that the senate is moving on a similar plan to pull back u. S. Support in yemen. It was expected to hit the floor in the next hour or so, but because of the houses efforts, theres virtually no chance this is going to land on the president s desk before the end of the year, essentially confronting him on this issue. Brooke, this is all part of a larger effort in congress to try to figure out how to respond to the murder of jamal khashoggi, the americanbased journalist who of course was killed in october in the saudi consulate in istanbul, but some republicans dont want to go the way that some democrats and some other republicans want to go, which is to try to pull back from the saudi war in yemen. Theyre looking at placing the blame directly on the crown prince of saudi arabia for his role allegedly in that murder. But this one effort here involving with trying to cut u. S. Assistance to the saudiled war in yemen appears to essentially fall by the wayside because Republican Leaders are opposed to it and they inserted that measure into an unrelated provision, rule, denying that from going forward. That has never been done before. We talked late last year in the wake of the me too movement, this revelation that lawmakers were using taxpayer money to pay out the Sexual Harassment settlements.
