Whitakers ability to lead the attorney general is unconstitutional. They say it has denied each plaintiff the opportunity to cast a binding vote on whether to consent to defendant whitaker serving as a principal officer. Senator plumblumenthal, whiteho and hirono are all part of the committee that appoints president ial nominees and whitaker skipped that process. The lawsuit lists multiple other problems with whitaker, including his public criticisms of the russia investigation. So lets start at the white house, with our correspondent there, kaitlan collins. And kaitlan, that the doj just last week issued a defense as to why they believe that whitakers appointment is valid. Is that the same defense that the white house is using today . Reporter it is the same defense. And thats what theyre arguing. And weve seen President Trump take his own route here by saying, well, Matt Whitakers not confirmed by the senate, but neither was the special counsel, Robert Mueller, even though, of course, brooke, the special counsel is not a cabinetlevel position, therefore he doesnt have to be confirmed by the senate, even though Robert Mueller personally was during his times as the fbi director. But that doesnt matter here at the white house. They are focusing on defending Matt Whitaker. Weve seen President Trump do so several times over the last few weeks, as hes come under increasing scrutiny from democrats, like the ones you just showed there who have filed this lawsuit against Matt Whitaker. And it all really revolves around his criticism of the russia investigation. Now, President Trump was asked about that criticism and if he knew about it before he tapped Matt Whitaker to run the justice department, even temporarily, and this is what the president said about that. Did you know, before you appointed him, that he had that record and was so critical of Robert Mueller . I did not know that. I did not know he took views on the mueller investigation, as such. And when you found that out . I dont think it had any effect. If you look at those statements, those statements really can be viewed either way. Well, he says theres no collusion, he says chris, ill tell you what. He says you can starve the investigation. What do you do when a persons right . There is no collusion. He happened to be right. Reporter so brooke, the president says there that he did not know Matt Whitaker had criticized the russia investigation before he picked him. But that contradicts what sources inside the white house have told us, which is, in fact, that thats how the president notice who had Matt Whitaker was in the first place. Because he saw him on tv making those remarks about the special counsel, which the president later said in that interview there that he believed his criticisms were founded and that he was correct in his opinions on the special counsel. But another thing this president said in that interview is that he will not overrule Matt Whitaker if he does try to limit the special counsels probe, because in the president s words, matt wheritaker is a sma guy and he can handle it. Kaitlan, thank you very much. I want to focus in on that interview. We just played you a short clip here. This is the president s latest one on one, its filled with insults and inaccuracies and one rare moment of instrospection. But first, the president s revelation about the killing of jamal khashoggi. A source confirming to cnn that the cia has concluded that crowned prince Mohammad Ben Salman ordered the killing of khashoggi, who was a critic of the saudi royal. The president has yet to agree with that cia assessment. And he revealed in his interview that he is choosing not to listen to the audio of this f r father of fours torture and murder. We have the tape. I dont want to hear the tape. No reason for me to hear the tape. Why dont you want to hear it, sir . Because its a suffering tape. Its a terrible tape. Ive been fully briefed on it. Theres no reason for me to hear it. In fact, i said to the people, should i . They said, you really shouldnt. I know exactly i know everything that went on in the tape without having to and what happened . It was very violent, very vicious, and terrible. Lets talk to ryan lizza, our cnn political analyst and chief Political Correspondent for esquire. Ryan lizza, first on the fact that the president says he doesnt need to listen to this audio. Dont you think he should . I mean, look, i actually dont think its 100 necessary for him to listen to the actual audio to make a good decision about what the United States should do, right . I mean, i think that the bigger problem here are the comments hes made about basically seeing this issue as a nuisance, right . That is interfering with our relationship with saudi arabia, interfering with the trumps entire middle east policy, which is to place a big bet on the sides, rather than what they did is and that the trump is not caring about this issue enough or do something with teeth. Then i suggest its problematic that he doesnt want to listen to it. Because there are a lot of human rights advocates and a lot of Foreign Policy experts who think its a very sad day that trump doesnt see this as a sort of crisis in our relationship with saudi arabia. And i think thats the bigger problem. Right. And that full report comes down tomorrow and all eyes on this president and this white house to see how he responds to that. Yeah. I want to get to your perspective on the moment when President Trump unloads on retired admiral william mccraven. You know, this is the man who was in charge of the raid that killed Osama Bin Laden in 2011, and trump attacked the military for not having killed obl sooner. Here he was. Bill mcraven, retired admiral, navy s. E. A. L. , 37 years, former head of u. S. Special operations Hillary Clinton fan. Special operations excuse me Hillary Clinton fan. Who led command of the operations that took down Saddam Hussein and that killed Osama Bin Laden says that your sentiment is the greatest threat to democracy in his lifetime. Okay. Hes a Hillary Clinton backer. And an obama backer. And, frankly he was a navy s. E. A. L. For 37 wouldnt it have been nice if we got Osama Bin Laden a lot sooner . Okay, first of all, admiral mcraven took no position in the 2016 president ial election, so i dont know where trump is getting that from. And on top of that, he wasnt responsible for finding bin laden, he was in charge of that mission in abbottabad to capture and kill. So what is this really about . Is this about the trump prism to review people . You know, whether its those who voted for me and those he feels like who didnt . I think thats the right word. The trump prism, is this person a supporter or not. Does this person like respect and say nice actually, like and respect doesnt even matter. Do they say nice things . Because we know he hasnt. 100 . Anyone who has sort of lobbied trump and any World Leaders who have sort of figured out the trump relationship are very clear about this, if you talk to any of those people, he is as simple as that. Flattery will get you everywhere with him. Everywhere. And look, as you pointed out, mcraven was a nonpartisan military man for his entire career, as he said in a statement, he liked george w. Bush. He liked barack obama, he pointedly did not say he likes donald trump, but he made a very serious and significant comment about trump being a threat to democracy and, man, it doesnt get anymore sobering when someone like that makes a statement, someone as nonpartisan, who has served his country for as long as he has, makes a Statement Like that. All of us should, you know, pay attention. I mean, that doesnt mean that hes above criticism, of course. But the idea that the criticism of him should be that he took too long to find bin laden when that wasnt even his job, you know, of course, is absurd. But, you know, youre either for trump or youre against him. And mcraven crossed that line, obviously. There was a rare moment in this interview where President Trump actually expressed regret about his absence at arlington on veterans day. Here he was. I should have done that. I was extremely busy on calls for the country. We did a lot of calling, as you know. But this is veterans day. I probably you know, in retrospect, i should have. And i did last year. And i will virtually every year. Why do you think on that, with ryan, he was willing to go there . First of all, i mean, i know theres a reason youre playing that, because we are all blown away that he when he expresses anything approaching an apology. And frankly, usually, he regrets things because of the way that they play on cable and in the papers that hes obsessed, right . Its not so much that he let the troops down or he let veterans down, its that he got the you know what beaten out of him for not doing what every president usually does on veterans day. But it is extremely rare to actually see him, rather than just defend it, say, you know, he made he made a mistake. But i think hes apologetic or hes not happy about not going, because of the criticism and because of the way it has played and hes just been attacked from all sides over it. He has. There seems to be a general sense that were just not going to get the kind of growth that weve seen over the last couple of years out of some of these darlings of wall street, as we call them, like apple and facebook. And they are what we call derisking, taking some money off the table before year end. An emotional heartwrenching day of justice for a colorado family as a man was sentenced for killing his wife and two young daughters. The victims family agreed to a plea bargain, trading the Death Penalty for multiple life sentences without parole. 33yearold Christopher Watts pleaded guilty to strangling his wife, shanann and the couples young daughters 4 and 3. After burying his wife in a shallow grave, he stuffed his daughters in oil barrels in an effort to hide their bodies. Today, the family of the victims and the convicted murder got a chance to confront him and talk about how the deaths have forever changed their lives. God only knows what happened tat night. Life will never be the same without shanann, bella and celeste. Had all their lives to live. They were taken by a heartless one. This is the heartless one, the evil monster, who dare you take the lives of my daughter shanann, bella, celeste, and nico. I trusted you to take care of them, not kill them. And they also trusted you. The heartless monster and then you take them out like trash. You disgust me. You buried my daughter, shanann and nico in a shallow grave and you put bella and celeste in used containers of crude oil, you heartless monster. You have you have to live with this vision every day of your life and i hope you see that every time you close your eyes at night. Your daughter, bella marie, sang a song proudly. And i dont know if you got to see it, but it was, daddy, youre my hero. I have no idea who gave you the right to take their lives. But i know god and his mighty angels were there at that moment to bring them home to paradise. God gives us free will, so not only did you take the family of four, your family of four, you took your own life. I want the world to know that our daughter and her children were so loved by us. Our families have been irreparably broken by the needless deaths of shanann, bella, cici and nico. This is something we will never get over. We will always mourn the loss of our family and in that, we are united in our grief. I am still struggling to understand how and why this tragedy occurred. I may never be able to understand and accept it, but i pray for peace and healing for all of us. We know that our experts will tell us that it takes 2 to 4 minutes to strangle someone to death manually with their own hands. The horror that she felt as the man that she loved wrapped his hands around her throat and choked the life out of her must have been unimaginable. Even worse, what must bella, age 4, and celeste, age 3, must have experienced or thought as their father, the one man on this planet who was supposed to nurture and protect them was snuffing out their lives. They both died from smothering. Let me say that again. The man seated to my right smothered his daughters. Ive been a judicial officer now for starting my 17th year and i could objectively say that this is perhaps the most inhumane and vicious crime that i have handled out of the thousands of cases that i have seen. Deputies, i would respectfully ask that you take this defendant into custody and have him serve the rest of his life in the department of corrections. I know. Shaking your head. So am i. Pat lalama is with me. A crime journalist who has closely watched this case. Its like, you listen to these family members. I i have no words. And, you know, obviously, you want them to throw the book at him, just shy of the Death Penalty, as that was the deal they made, right . If he were to have plead eed guilty, but still, how do they reach this sentence . Well, i must tell you, brooke, chris watts fought and screamed all the way to this agreement. In his might i use the term narcissism, really wanted to put himself out there and make himself the hero and he was saving his children from, you know, the wife, et cetera, et cetera. But he finally came to what senses, if he has any, and determined that theres really nowhere to go. And interestingly, though, people want answers. Yes. Everybody wants an answer. The fact that he had a mistress is not the reason for this, brooke. Theres some underlying answer that even the prosecutors and the courts agree, even chris watts parents agree that everyone deserves an explanation. But you want to know why there isnt one . Im going to give you three words. Bella fought back. When you hear those three words that his own daughter looked at her father, the man that she called a hero, and fought back, at the hands of her own father, that tells you that this man is so morally, emotionally, and intellectually bankrupt that there really is never going to be an answer, brooke, ever. That she bit her tongue, that they saw that she had multiple times to try to fight back against her father, who was killing her. What so he goes away for the rest of his life. All of these statements that we heard from not only her family, his family, how impactful are these statements in affecting the judges decision . Well, i think in this case, im going to take a guess here, because i dont know this judge, but he clearly knew the terms of the plea deal. He clearly probably knew ahead of time those sordid, horrific details that the prosecutor so solemnly and forcefully laid out. And i think that the prosecutor did that because he didnt want to give that judge any other option but to give him the ultimate maximum on each and every count and thats what the judge did. And the judge even said, and you dont hear this a lot, brooke, ive been in courtrooms for a lot of decades, that judge said there was no more inhumane act than what he saw. And he gave him everything he could, short of the Death Penalty. And interestingly, it was shananns family that didnt want the Death Penalty either. They felt that fighting fire with fire or an eye for an eye was not appropriate. But the judge did Everything Else he could to make sure that that man lives with himself every single day until he drops dead. His wife, two children, unborn child. Last question, as he goes and rots in prison, how will he be treated by other inmates . Well, you know, theres an obligation on the part of authorities to make sure hes not put in harms way. But you know what, that doesnt always happen. Im not saying i wish for it, but its going to be a rotten life for him. The only problem, brooke, is i dont think he has a conscience. Did you see a tear in that hearing today . Did you see anything except his head down and glanced up every now and then. Even when listening to that description of his little baby girls being stuffed in separate vats, 8 inches in diameter, nothing from this man. They ended up inside of a car of a stranger, a hospital employee by the name of dave and they made a pact that if they had to abandon the car, this mom said that dave needed to save the baby and leave mom behind. 20 miles and 9 hours later, everyone survived. Through all of this, congratulations on lincoln, but my goodness, first of all, is Little Lincoln okay . Yes, hes doing well now. He only spent about 24 hours in the nicu and he is with us now out of the hospital. Doing well. Oh, my goodness. So take me back. I read about your story. You gave birth via csection, which is major surgery. And then you are physically forced to leave the hospital with your baby in a strangers car. What happened . Yes, they let us know early that morning that we were going to be evacuated and with less than five minutes after that announcement, they had a few gentlemen came into my room and lift me and put me in a wheelchair and wheeled me out. There were obviously not enough ambulances for the over 60 patients and so they started loading patients into private employee vehicles to get out of there as soon as possible. And you raced out of there with a man named dave, who you, i imagine, didnt know much more about other than his name. Nope. And how far into the drive did you turn to him and say, you know, heaven forbid, you jump out with my baby . Well, it was a lot more time than it was in distance. We were all in gridlock, not moving quickly with people getting panicky and leaving their vehicles and having to go around and so it had been quite a while in time, but not very far in distance. We hadnt even made it a mile. And the fire had surrounded us already on all sides of the vehicle, there were people getting out and david actually looked over at me and said, what would you want me to do . And i knew exactly what he meant. And i said, i would want you to take the baby and thank you, thank you so much, but i cannot run. I mean, i had an abdominal surgery. I wasnt even walking yet. I still had iv lines and a catheter, there was no way i was going to get out of there. So if it came down to it, he did ask me what i wanted, and we did kind of make an agreement right there. We didnt speak about it again after that, it was just known, if that is what happens, thats what were going to do. So the worst didnt come, thank goodness. Youre obviously, you are okay, dave is okay, lincoln is okay. Have you had a chance to see dave again and throw your arms around him and say thank you . Very briefly. He did make it a point to come, once we were settled in the hospital in chico, he came up to the room and visited briefly and met my husband, who was extremely grateful. Of course, this man that didnt know his wife and child was essentially responsible for saving our liveses and we were able to talk briefly. I asked about his wife, because we had talked about our families and we had prayed out loud and really just left it in gods hands, because there was no way anyone had control over what was happening. And so we did speak briefly then. And then he also called to check again later with the nurses station and let me know that they did finally find his wife, bonnie, and that she was also safe. Yeah, well, theres a lot of possibilities. We dont know for sure what the delay is. We requested his report back on november 7th. A week after that, we asked them for an update, saying wheres the report. And they said, were continuing to process it. Now, we dont know whats going on, but whats very strange is, heres what the process includes. Printed pdf and send pdf. The law does not allow you to make any redactions to that report. And it says on the top of that report, public Financial Disclosure report. The longer this takes, the more suspicious its going to get. Now, some of the possibilities include, you know, maybe theyre just not doing their job, which i doubt, because they have a very good ethics office. Another possibility is whitaker never filed his Financial Disclosure reports. They dont have anything to release and theyre banging on a store saying, youve got to get them to us. Another possibility is he left out information or added Incorrect Information and theyve been trying for months to get him to change it and he hasnt changed it. The only other thing that comes to mind is sometimes agencies will not process a Financial Disclosure report if a person is under investigation. Theyll wait until the investigation ends. I certainly hope that our attorney general who at least our acting attorney general is not personally under investigation, because that would highlight the fact that there really should have been a Senate Confirmation process with senators to vet all of the possible issues with this man. Sure. So, as these groups, rightfully so, are pushing for transparency in this regard, i want to go back to the weekend interview with trump and Chris Wallace over on fox, because he was asked, trump was asked, if he was aware of, if he knew of Matt Whitakers welldocumented past criticism of the special counsels investigation. And this was trumps response. Did you know, before you appointed him, that he had that record and was so critical of Robert Mueller . I did not know that. I did not know he took views on the mueller investigation, as such. And when you found that out . I dont think it had any effect. If you look at those statements, those statements really can be viewed either way. But i dont think well, he says theres no collusion chris, ill tell you what he says you can starve the investigation. I think hes right. What do you do when a persons right . There is no collusion. Thats simply most implausible thing i think ive heard in the entire Trump Administration and weve heard a lot of implausible things in the last two years. And he was brought in and interviewed at one point and considered to president s legal team defending against the mueller investigation. You cant tell me it didnt come up during that interview what his views were on the mueller investigation. The white house issuing a new warning to cnns chief White House Correspondent jim acosta, threatening to pull his press pass again at the end of month. Now cnn is taking the case back to court. This follows an initial ruling back on friday when the network won a temporary restraining order, forcing the white house to restore acostas credentials for 14 days. With me now, brian stelter, our chief media correspondent. Whats going on . Its a littlebit unclear whats going on, brooke. Clearly cnn was able to be victorious in round one in this case on friday, but then kind of surprisingly on friday night, the white house responded with a letter to acosta saying, hey, you did violate our rules. We havent really printed the rules anywhere, but you violated them and were going to take away our press pass once this temporary restraining order expires. Thats in 11 days from now. That means that cnn and acosta and the white house might be back in court after thanksgiving. This morning, cnn went to the judge saying, this is getting ridiculous, we need to have another hearing and settle this in a more permanent way and get a preliminary injunction. Right now were coming up against this interesting 3 00 p. M. Deadline that the white house created this 3 00 p. M. Deadline for acosta. They said on friday night, youre going to be suspended, we think, but its only a preliminary decision. Well make a final determination monday at 3 00 p. M. Well, its monday at 2 50 p. M. We havent heard anything from the white house. I emailed out to the White House Press shop asking if they have made that final determination. All of this in response to the judges final ruling on friday. The judge said, you didnt give acosta due process. You didnt tell him what you were going to do and give him a chance to appeal. So what were seeing the white house do now is trying to create a sense of due process, but cnn in its court filing said this morning this isnt real due process, this is retroactive, and so asking for another hearing to try to get this settled. Heres the cnn statement that came out earlier today, the company saying, the white house is continuing to violate the first and fifth amendments of the constitution. These actions threaten all journalists and all news organizations. Jim acosta and cnn will continue to report the news about the president and the white house. So, were in a little bit of a Holding Pattern here to see what happens. Does the white house really want to keep pushing this case, given they lost in court on friday. Are they really going to keep trying to punish jim acosta. Hopefully not, but we dont know. Hopefully not. Hes going to be a great speaker, but theyre backing away from a comedian. Why . I think a lot of people on twitter are saying this is cowardly. Even Michelle Wolf says this is a cowardly move by the association. They cant handle humor. I think whats happening here is because President Trump wont go to this dinner, it changes everything, right . If you dont have the president there and hes not making jokes and hes not ribbing on the press corps, its kind of weird to get a kmacomedian up there a make fun of him. So hes once again showing how hes changing the balance of these events in washington. He doesnt go to the Kennedy Center honors or the White House Correspondents dinner. So by snubbing these events, hes changing the makeup. The more provocative, the better. A lot of folks in the room thought maybe it was inappropriate when the president wasnt there to respond or wasnt there to make his own jokes, to have a night of comedy at his expense. Were told ron has been tasked, when he goes, to make a case for first amendment, so at least hell have a lot of journalists in favor of sure, theres a lot to talk about, but it wont be quite as funny. Braxton andrew was vacationing in mexico. He was alone. He disappeared last month while walking near his resort in the northern mexico town of urike. Diane gallagher has more on this whole investigation and how awful for this family. Tell us more about what he was doing down there and what authorities believe happened. So, brooke, this was something that he tended to do quite a bit. He would go to mexico, he would go to latin america, he was a spanish teacher and really loved the culture there. The governor of chihuahua claims that the Sinaloa Cartel is responsible for his murder. If that name sounds familiar to you, thats the cartel that el chapo used to command before he was captured and is now on trial. But in a Facebook Post from the governor, he pinned braxton Andre Andrews killing on a drug trafficker known as the crooked. He said the middle School Teacher died october 28th. The last day he was seen by anyone. He left for a walk from his hotel to this canyon area. His body was found near that town of urike, but beyond that, the death is shrouded in mystery. It appears the 34yearold spanish teachers body had been buried and then exhumed and then just left out in the open. But he hasnt gone into detail as to how he was killed or even why he may have been targeted at this point. He called it a cowardly and brutal murder of a totally innocent person, but then said it had nothing to do with an attempt to purchase drugs. Late last night, a Facebook Page has been run by his family and friends during this search confirmed they said with a sense of relief that his body was found and recovered. Theyre working on getting it back to North Carolina. After learning of his death, they posted patrick died during what he loved, traveling and meeting people. And then later, they added, although we are still grieving for patrick, we have work to do and we are asking for your help. We continue to search for justice for pat. A little bit later, senator thom tillis tweeted that hes working with the state department and mexican officials on the investigation, and brocoke, the past few weeks have been so difficult for his family and friends and the whole Community North of charlotte not knowing whats going on and getting this news and not having the answers. The school that he taught at canceled classes on friday because of the news. And in davidson, they lowered the flag to halfstaff to honor him in his memory. But really just so difficult for that community there.
