What ive been told by some people who are experts in washington and have lived there for dozens of years have said they do not believe that aides in this white house are prepared for what is going to happen and what the level of scrutiny is going to be with this oversight by a democratic house. President trump was allowed to push a lot of his staffing changes off until after the midterms. We saw that with the attorney general jeff sessions, but then he was faced with thun expected scrutiny on who he picked to replace jeff sessions, even temporarily and now hes going to face scrutiny when he replaces nelson at dhs, and who he does replace john kelly with, if kelly follows kirstjen nielsen. A lot of question of who wants to come into a white house that is in unchartered territory with democrats coming after their heels every day of the week. You pointed out the what ifs, how this will all work in the coming months. But going back to the photos, especially of the incoming senators, there is a face there, gloria, were about to talk to ryan nobles who has been in the weeds in all of this in florida. Reporter i think there were two really big pieces of information that came out of the hearing so far and the hearing is still ongoing. This is a conversation about floridas signature match law. The Nelson Campaign challenging the way this law is interpreted. The first big thing id point out is that the judge specifically asked one of the witnesses testifying from the secretary of States Office if any of these ballots were tossed out or any were voters attempting to vote fraudulently. She said there was no reason to believe that. Thats the first point. That is probably good for the Nelson Campaign. On the bad side for the Nelson Campaign, theres been a question about how many of these ballots are available to be counted in the overall total. They need a significant number of them. Im going to show you an exhibit brought into the court here. You cant see this. This is a spreadsheet of all 67 counties. Theyve gone through and called every county to ask how many of these ballots have been tossed out because of the signature match and theyve talked to 46 of the counties. So far theres only 3,600 ballots that qualify under this statute. So there were only be 3,600 ballots you could add into the overall total. Miami dade, the biggest county, has yet to report in, but Broward County has and thats the second biggest county. Were probably only talking somewhere in the range of 5,000 to 5,500 ballots total that you could add in to the mix. Thats probably not enough for bill nelson and that would only be if the judge said you can put all of these back into the overall vote totals. Those are the two big takeaways now. The big question is will the judge say yes, we can bring these ballots back into the counting process. He did seem skeptical when answering questions from the democratic lawyers there that the statute is pretty clear on how this all handles. They also spoke to county election supervisor here in leon county who said theyre very lenient with their standards. They do everything they possibly can to count these ballots. Today the National Transportation safety board interviews revealed new details about the frightening scene on that plane. Lets go straight to rene marsh, our aviation correspondent. Rene, what did they find . Brooke, as you mentioned, these are new details today. It was a boeing 737 that was headed from new york to dallas when that engine failed. The new information includes details about how the plane as it climbed to 32,000 feet, the pilots heard this loud bang and they felt an extreme vibration. Alarms were sounding in the cockpit. The veteran pilots struggled with equipment issues that prevented them for some time from communicating with flight attendants, air Traffic Controllers and firefighters, as well as each other, all while they were recovering from this steep turn and figuring out where to land. And then this account based on ntsb interviews with the flight crews as well as passengers, a passenger in seat 14a was still restrained by her seat belt, by her lap beth, however, the passengers upper torso, arms and head had been pulled outside of the airplane through a window. That is the account of people who were on board the plane. Two flight attendants and two male passengers pulled that passenger back inside. The passenger were talking about is jennifer riordan. She died as a result of blunt force trauma. She was the sole death on this flight with 149 people on board. During this critical ntsb hearing where they question the Airline Boeing and maker of the planes engine, cfe international, investigators zeroed if on the design and history. The manufacturer said this engine model had failed its first certifications tests in the mid 1990s but ultimately passed the second certification tes tests. Since then they made changes to prevent blade failure. Inspectors said they have discovered similar cracked blades in this engine model installed by other planes flown by other airlines. We should point out that the ntsb is still working this investigation, but this hearing was so critical because, number one, we got this new information about the details from their interviews, got to hear from the airline as well as boeing, as well as the engine manufacturer. But as far as what exactly caused this, thats still under way. All while another investigation is happening in indonesia, also involving a boeing 737, brooke. The most notorious criminal of the 21st century, id be a little nervous, not going to lie. Ive tried cases involving murderers and involving courtroom security but nothing like this. The reach this guy has is unprecedented. Theres an element of danger here. On the one hand it sends the message to the jurors this is a super dangerous guy. As a prosecutor, thats what you want tho convey, but on the othr hand, if theyre too scared, you dont want them to be afraid to return a guilty verdict. The u. S. Marshals a fantastic at protecting their courtrooms, juries, judges. Some of this may be for show. Some may to dissuade anybody from trying anything. Opening statements. We heard from the u. S. Prosecutor and this defense attorney. It sounds to me the message from the defense attorney is all of this is a myth. Hes not the leader of anything. Thats hes not the big fish here. That the jury is going to hear from essentially a bunch of scumbags, witnesses who are going to come in, who are informants, who are cooperating, getting sweet deals from the government on their own crimes. You know, thats a defense that we all put up as Defense Attorneys, but when you have a whole abundance of digital evidence that is corroborating, that is independent of this testimony, its going to be a challenge for the defense. There is Video Surveillance over fears of el chapo, wiretaps. So as a defense attorney, i hate video and audio like that, you know. Its pretty damning. And so thats whats going to be the problem here, is that you can attack the credibility of these witnesses during the trial, but its going to be very challenging to be able to refute the corroboration of those of the testimony of those witnesses. I also think the defense made a mistake in its opening remarks, and i think my formidable adversary here will agree, when you make these promises to a jury in your opening remarks, you better be able to live up promises like what . This is what the evidence will show. And one of the things the defense attorney did was, you know, hes not the big fish, because he spent a lot of time in prison, and meanwhile, the sen cartel was doing really well. And thats like dto 101. The government is going to be able to prove that Drug Trafficking organizations continue their business even when the big fish is in the hole. Sometimes its even up since hes been in prison. Exactly. What about the flip side from the prosecution . Theres two lines of defense here. One is attack all the coopers, like sara said. Standard fare in these kinds of cases. Here they have a dozen cooperating witnesses. Ive done cases with one cooperating witness. Its one thing to tell a jury this one guy shouldnt be believed, but when 12 come up, backtoback, supported by tapes, thats a tough uphill climb. The other piece is this bizarre, desperate theory that chapo was set up and it was this other buy, el mio. I dont know how theyre going to square that with tapes. The lawyer is good, tough, but this is a long shot. Before you go, tell everyone what you were telling me on commercial break. Okay, this could lead to el chapo. El chapo is a legend among prosecutors, and as far back as 10, 12 years ago, any time a dea agent would come in and try to get us to take cases, we would be skeptical. So with me now, cnns chief media correspondent, brian stelter, host of reliable sources. With more on what is happening. And tell me about the multitude of media organizations backing cnn. At this point, more than 15 news outlets, virtually all of the nations major news organizations supporting cnn this lawsuit. Just a few to name, everyone from the Associated Press to fox news, from nbc or the New York Times. From gannett to scripps. All these outlets coming together and saying they will either be filing friend of the court briefs to support the lawsuit or they put out paper statements saying they stand with cnn. Its one of these rare cases where we are seeing a lot of different rival news outlets all stand up for free press. Because frankly, brooke, while its about acosta today, it could be about somebody else tomorrow. Absolutely. Right now this hearing has just begun, just started in washington in the u. S. District court. Jim acosta is there, along with cnn Washington Bureau chief and cnns lawyers all inside. And cnn goes first. The argument made by cnns lawyers first and then government lawyers respond and then judge timothy j. Kelly will hear both sides, discuss with both sides. He may issue a ruling this afternoon. He may come out right away and respond to cnns request for whats called a temporary restraining order, the preliminary injunction cnn wants in order to get acostas press pass right away. So the judge could rule or take a break, talk with his clerks, come back later in the evening and make an announcement. However, this is not going to end today. No matter what the judge rules, cnn is also asking for a permanent response. A permanent relief in legalese, which would declare the Trump Administrations actions unconstitutional. That would i thay that would pr future reporters from suffering the same kind of punishment acosta has suffered. How has the white house responded . The doj responded to the lawsuit, basically said they believe they have broad discretion to decide who comes and who goes. Who is allowed in, who is allowed out. Theyre essentially arguing they can kick any reporter out whenever they want. This is a radical break with decades of tradition at the white house. As well as some case law about this. In the past, whether its republican or democratic administration, theres been a lot of permissive press access. Pretty much anybody can get a press pass. Thats the way it should work, given you want to have a variety of reporters and diversity of views in the White House Press corps. But trump is saying he has the right to kick anybody out. That claim is going to be tested. If i can see you what Sam Donaldson said yesterday, filing this brief supporting cnn. He said if the press is not free to cover the news because reporters are unjustly denied access then it is not free. And he said if denying access to a reporter or organization chosen to represent it, in effect serving the president s right to take that choice away from an organization and make it about himself. If thats permitted, then the press is not free. I think donaldson is making the key point here, brooke. Which is if any president , whether President Trump or someone else, is able to pick and choose who is covering the white house or who is asking questions, then thats not that doesnt live up to First Amendment values. It should be the right of cnn or the New York Times or fox news or the reuters outlet to choose who covers the white house. And in effect, by banning acosta, the president is trying to take on that power himself. You were on with me yesterday and we were talking to ted olson, one of our lawyers.
