Trump now saying that he believes that thbelieve s that is something the Justice Department should be looking at temperature and t. And the search is under way to find out which staffer wrote that article. And the president does want the identity of this reporter to be revealed. But obama also called out the Republican Party for not holding this president accountable. What happened to the Republican Party . Its central organizing principle in Foreign Policy, the fight against communist. And now they are cozying up to the former head of the kgb. In a healthy democracy, there are some checks and balances on this kind of behavior, this kind of inconsistency. But right now, there is nothing. And by the way, the claim that everything will turn out okay because there are people inside the white house who secretly arent following the president s orders, that is not a check. Im being serious here. That is not how our democracy is supposed to work. These people arent colleelecte. They are not accountable. You have to think about President Trump. And what he is trying to do. A lot of people will say and it may be true that listening to obama galvanizes the republican base. And i think that would always occur. But i think if obama continues do this and raises the stakes of this election, particular ly in those s suburban not rat districts, i think he can do a lot of good for democrats. It is interesting listening to the two reactions. You have conservatives saying here he is, lecturing us. And the liberals say this is leadership. And this is the wom that peop obama that people have missed and people have been craving for. It is true that this is unprecedented for a former president to take a sitting president to task. But desperate times call for desperate measure. And this is what he said in the speech. And the other thing he did is not simply just criticize trump or go after politics of fear and resentment, but he also linked donald trump directly to the Republican Party, which is consequences for the midterms. But then also gave democratic voters including unlikely voters, reluctant voters, something aspirational. So something to think about, something to go forward, a vision for what the country could be, including something that really wouldnt have been in the conversation two years ago like medicare for all. So he is trying to do something transformative that speaks liberals and progressive, bringing them together in a time crisis. And i wanted to underscore your point because also when he mention tsz dangs dangerous tim is not Hopey Changey obama. This is what is up and if you dont like it young people and potentially swing voters, go vote in november. Yeah, he set the stakes and i think in a way he was talking to republicans. Because he was saying to republicans, look, what happened to you guys . Youre the guys who were the anticommunists. Youre the guys who were against trade tariffs. Youre the guys against the big deficits. And what are you doing here . What are you doing . Look at what donald trump has done on those particular issues, which is by the way what that anonymous oped piece also said. I mean, he was kind of scratching his head saying, look, if you are a republican, youre not the republicans that i know. These where is your guts, your conviction, your courage of your conviction . Why arent you saying to this president , and some republicans are, but why arent you saying to this president , you know what, we hate these trade tariffs. We dont like these deficits as far as the eye can see. And so he was also putting republicans on notice saying, hey guys, wake up to the fact that he is not conservative either. So what is it, 60 days ago, everybody keeps using the football analogy of Fourth Quarter before november 8. And i just think that you have the two quarterback, trump and obama on, and i obama, and if you are a democrat, do you have problems, and we know that obama will be out speaking and that could be a good thing for democrats, but isnt it a big problem for democrats that he is really the only quarterback they have right now . Well, for one, i think democrats everywhere are rejoicing that barack obama has decided to hit the road. And we also know that joe biden is hitting the road and a few other folks. They couldnt be happier that a former sitting and popular president has decided to come out and campaign hard and really reach out to people. But we also know that there is people have been calling it a blue wave, you can call it a progressive push, we know that there are all of these candidates on the state, local, municipal level who are running and trying new approaches to outreach, going after unlikely voters, voters who havent come out in the last election, disaffected voters. And one of the most fascinating thing about the speech, barack obama spoke to those people lecturing them a little bit saying if you want to change, you have to come out and do it. But also saying that donald trump is a symptom, not the problem. That in fact we spoke a lot about Hopey Changey things, but there was a problem in the United States and we should be talking about poverty effort, we should be talking about health care, we should be talking about, you know, money and income and trade and tariffs and things that ordinary Americans Care about. So there really is i think were really seeing this Coalition Push that could have a big impact on the midterm elections. And i agree. And i think one of the big issues is going to be health care. The democrats are going to go after the republicans and say they are not fighting for your preexisting conditions in court. And they are not going to fight for it legislatively. Here is what weve got from this white house. So we have known that they floated this idea from rand paul, the notion of lie detector tests. And we also know trump wants sessions to investigate this. And according to the times, there was even a discussion of asking senior officials to sign these sworn affidavits that could be used in court if necessary. So all of the above, does that not just underscore how serious this white house is in finding this person . Im sure they are. I dont think any of those will go anywhere. I mean, it is a critique of the president of the United States. It is not the release of state secrets. This behavior is not the snowden like behavior that we saw. If it were by the way, i might have a different feeling about it. Not a National Security issue. No, not yet a National Security issue. And perhaps never a National Security issue. But for me, the most significant aspect of that oped is the revelation if it is true that there has been discussion of invoking the 25th amendment on this president s watch. And i wish members of the media who had the access to the cabinet members who are asking the question of was did you, was did you, was did you, would ask a second question. Which is, have you ever participated in any conversation relevant to the 25th amendment pertaining to this president. So a quick followup. As a lawyer you know that it would pertain to section 4 which means that it would have to be the Vice President and the majority of the cabinet to bring this forth and essentially say this president isnt fit. And then twothirds majority would have to sign off on this in congress. Never been done before. Do you think that is a probability . No, i think very unlikely based on the facts as they exist now. You just want to know i have a recollection of you and i discussing a year ago the fact that a group of Mental Health professionals wrote a book and they raised the president s fitness and 25th amendment. They were on the outside looking in. They had never met much less examined the president of the United States. I wrote that off. This is different. If it is true you, then i think it needs to be tracked. I think it is very significant if it is true. Speaking of opeds, i have in my hot little hand here fresh off the presses this Washington Post oped from the u. S. Ambassador to the u. N. Nikki haley. This is in response to the New York Times piece. I too am a senior Trump Administration official. If i disagree with something and think it is important enough to raise with the president , i do it. And he listens. Sometimes he changes course. Sometimes he doesnt. That is the way the system should work. The author, she write, and the frenzied media reaction to the oped hurts all of us who are trying to do our jobs for the country by throwing gas on a fire of endless distraction. Does she have a point . Is this author a hero or coward . I have two reactions. One is to say that im sure nikki haley wants to relieve any question that might sxits in supporters of the president s minds that she could be the individual responsible for this. But secondly, there is a question here of accountability. I mean to whom is this person who penned those words for the New York Times now accountable . Is there something undemocratic about what they are doing insofar as they wont stand up and take ownership of it but tend to use this means to criticize the president. What im really saying is those cheering on this behavior in this instance perhaps need to ask themselves what about the day when President Trump is gone and it is a progressive, it is a liberal who is there, what if someone should stand up and similarly critique the conduct of their boss, how will i feel about that. Im not so sure this is a healthy precedent. Sure. A great point if the shoe is on the other foot. And add in the nuggets on the explosive book from bob woodward. Trump mentioned that and he said woodward acknowledged that under trump other nations are more accountable for their defense spending. Here is the president. And then this i had yod woodward who wrote this book which is all fikts said that i said Something Like that, but he put it in a very crude manner. The concept is true, but the way it was said was very, you know, hey, i went to like the best college, i did lots of good you you read this thing, the quotes were wrong. All these john kelly, general mattis, they were all writing i never said that, i never said that. Well, it is fiction. But they do put down the concept of i said that and i said isnt that horrible, isnt that drcru. Crude . You know what, i want to have our nation protected and i dont want to be taken advantage of by other countries in the world. Michael, you have all kinds of people who call into your show. This is what i really wanted to ask you about. Trumps words about this idiot woodward he says, or the nuggets coming out of the book or who done it and then the mystery in washington behind the New York Times. Do the people care . So short answer is no, not those people who need to be swayed. Let me tell you something that i did a bit deceitful on my serial xm program this book. I read book excerpts, only they werent woodward, they were fire and fury excerpts. The point i was trying to make to the audience, they are virtually interchangeable. I think woodward has a certain stature a statu statu stature that Michael Wolff does not, but i think people believe the story even those who support the president. So i dont think that the woodward book itself moves the needle. Maybe the wolfe boom and the omarosa book and the woodward book, but not individually. And it seems like your takeaway is not trumps behavior, but how those around him either enable or react to it. Well, thats right. I think that woodwards book doesnt officially come out until next week, but i did have a chance to read a copy. And to me that is what is really new about this, were beginning to see reported vetted accounts from people respected journal journalists like bob word ward. We know President Trump has a problem with the truth. We know about his erratic character and his unconventional, the term the white house likes to use, the unconventional ways. But i think trying to understand what has been going on behind closed doors by those who surround President Trump, that is where the reporting is new and fresh and kind of eye popping, right . I mean this is an incredible story bob woodward called it an administrative coup detat. Whatever you want to call it, the chief economic adviser to the president was reduced to stealing papers off of his desk in the oval office to prevent a major Foreign Policy move. And by the way, i think this is connected to Foreign Policy which is why i wrote my column about it and why were talking about President Trumps behavior this week and not so much about what is happening in syria and the imminent battle in id will i be idlib. And then professionally, it is one of the most awesome experiences because the Supreme Court gets the most challenging and often controversial cases where there is a circuit split. And you are working with some of the countrys most amazing attorneys, thoughtful, you know, clerks and justices. It is a wonderful experience. So it was a life highlight for you. It really was. And she is a tremendous she a terrific manager too. She is somebody who works extremely hard. She is very devoted to justice. There is no, you know, sitting around and i thikicking your fe and chewing the fat. It is a thoughtful, quiet, work intensive place. And she works extremely hard. She expects a lot out of her clerks. She is very respectful peoples opinions. And she is a night owl. So if you are working late and you have questions in the film, her own kids are like she would go up at 4 00, 5 00 on in the morning and catch up on the sleep on the weekends. The vmi case, what was it like working with her and what was her approach to this case . So working on vmi was both absolutely thrilling and terrifying at the same time because it was her first womens rights case as a sitting Supreme Court justice. And i knew a great deal when womens rights, i had worked closely with big constitutional law scholar, ran the stanford law review where we wrote articles about gender what yola. But she knew everything there was to know about gender law and equity, every case, every brief, every footnote. But you know, this was a really exciting, exciting case involving whether or not Virginia Military institute could continue to close its doors to women. And she looked to one of justice oconnors opinions to help clarify the standard for gender classification. And used the words exceedingly persuasive justification. If you want to bar your doors to women, you have to have an extremely pervasive justification to do so, otherwise you open your doors. And we had the great good fortune to go back together 20 years after the decision which was a very moving experience to see these, you know, young cadets, women cadets, come up to her and thank her for opening those doors and allowing them to pursue their dreams. And boy, were they thriving. Which would be part of the legacy that shes left. Her legacy would be her legacy is the work that she has done as an advocate bringing cases to the Supreme Court to establish gender justice as we know it today, equal rights for women. And then turning around and living that by stepping on to the d. C. Circuit and the Supreme Court and becoming the incredible influential and profound justice that she is.
