The russia investigation in disgraced and discredited. The president s tweet coming after the New York Times revealed over the weekend that White House Counsel Don Mcgahn is cooperating, extensively, with team mueller. Cnn has learned that President Trumps personal lawyers were not give a full account of what exactly was discussed there, but President Trump says mcgahn is not a rat and insist he allowed mcgahn to be interviewed. Remember here, you and i, american taxpayers, pay mcgahns salary and not the president. We start with Jeremy Diamond live at the white house. Tell me more about the communication between trumps legal team, his personal lawyers, and the white House Counsel, don mcgahn. It kicked off this weekend with the remarkable revelation that you mentioned that the white house and the president s personal legal team were not fully debriefed by don mcgahn or his attorney about the 30 hours of enter vice that we can now confirm that don mcgahn sat for with special counsels team. A source familiar with mcgahns interview says that mcgahn did not provide any incriminating information to mutual better the president. Nevertheless, don mcgahn has been the white House Counsel since the president stepped into office. He was around on the campaign before then and particularly during his time at the white house he present for a series of crucial moments including the firing of fbi director james comey, the president s attempts to fire the special counsel, robert mueller. For now, brooke, the white house is declining to comment any further on this. They put out a statement over the weekend insisting that the president and don mcgahn have a very strong relationship. Nonetheless, the president is using this of course as an opportunity to criticize special counsel once again. Some of the tweets that you just mentioned over there. He is using in particular these 30 hours of interviews with don mcgahn as a jumping point to say that mueller is looking for trouble. Brooke. Jeremy, thank you. Just the backdrop to all of this, the president s frustration here, keep all this in mind as well. Right now his former Campaign ChairmanPaul Manafort is close to learning his fate. Jurors are still deliberating whether manafort indeed committed bank and tax fraud as prosecutors are alleging. Trumps former National Security adviser Michael Flynn already pleaded guilty as a result of the special counsels investigation. We are hearing Michael Cohen to be charged by tend of the month. Two more great voices joining me to analyze all of the above. Paul rosen swag, in addition to being senior counsel to ken starr, also the executive director of policy at the department of homeland security. And welcome back to jack wynn. Gentlemen, i have questions for you. Paul starting with you here. On the motivation of don mcgahn to cooperate with the mueller team. According to the times, in this breath taking piece over the weekend it seemed to be the fear of trump setting mcgahn up to take the blame for any possible wrongdoing. So if you are don mcgahn isnt it a no brainer to cooperate . I think it is a no brainer and it is a no brainer for a more fundamental reason, which is that in the end he doesnt have that much of a choice. As you said in the opening, he works for the people the United States. And theres a very limited scope to the confidentiality of his agreement of his discussions with the president , especially when they involve conduct that might be legitimately the subject of criminal investigation. So far from beyond being afraid of taking the fall, full, he simply has that obligation as a servant of the American People who works for us in effect. Uhhuh. To the point of that, very important dliniation, and jack you know all about this as white House Counsel. The white House Counsel is not the president s private lawyer. The white House Counsel protects the office of the president. Officers to you. Just explain why executive privilege and Attorney Client privilege are important distinctions here . Well, this is really not a matter of Attorney Client privilege for the reason that paul largely outlined. Don mac began is not working for the president as his personal attorney. As paul mentioned, don mcgahn works for the people of the United States. Like all government lawyers do. And in that regard, he has an obligation to cooperate with criminal inquiries, grand jury proceedings, and the like. All that said, this i think the president was really not well served in the way this unfolded. What i mean by that is that there was certainly at least an arguable basis for the white house to assert executive privilege if for no other reason than that they might have been able to negotiate some terms of the interview with mr. Mcgahn. But they waived it. They waived it. Thats the point. Yeah. They ended up waiving it. And that waive will now cause consequences in terms of others who may be interviewed in coming days. Indeed, i think that one of the really serious implications of this whole thing is that others are standing by. They see that don mcgahn went in and talked to the special counsel. They know that he may have been a better witness than the president. What i mean by that is that the president would have been presumably guarded and not as forthcoming. Don mcgahn for the reasons you outlined had ever interest in the world in essentially telling all. So presumably, he did. Others now, again, we are assuming here that there may have been something untoward, something concerning. If others have guilty knowledge, they are sitting there, having watched the president s counsel go in and testify before the special counsel. Nobody wants to be the last one standing. Nobody wants to watch ones colleagues go in, spill the beans, and be the one who is last in line to cooperate. I think there is a good chance you will see a lot of people making phone calls to the special counsels Office Asking when their interview can take place. Sure. And we dont know none of us know what beans mcgahn could be spilling. But, paul correct. To follow up on jacks point on privilege here, on executive privileging since they waived it. Heres my question to you. Jim acosta reports that trumps team still thinks they can assert the executive privilege despite the fact they have waived it already. Can you retrospectivecally say hang on a second we take back our waiving of the executive privilege and therefore everything you have said and cooperated with the team should be discounted . Thats highly unlikely to be successful. Okay. There is a rare circumstance in which there is an inadvertent waiver that you can call back. If i for example, sends you a privileged email by accident because i typed the wrong name into the to line. Sometimes you can unring that bell. But in all other circumstances it is almost uniformly the law that a waiver in one circumstance will redown all the way down the line in all the institutions to which it can be put. You cant put the egg back in the yoke, you cant unpeel the banana. Was that careless on behalf of of the trump legal team, gentlemen . The waiver doesnt even have to be formal. As a practical matter they have waived the privilege. As paul said, its going to be very, very hard to you know, reel that back in. Okay. Go ahead quickly. I was going to say, im not so sure that they were wrong. There is sense in which, portraying themselves as cooperative, especially in a circumstance where the ability to claim the privilege is a little problematic in the first instance, might have been might have been a good decision. But now that they are skrum scrambling it certainly seems the me it wasnt as well thought out as it should have been. Okay. Not least of all because they couldnt be sure they could debrief mr. Mcgahn. Yeah. Its the breast taking while they were totally focused on what might unfold in term of the president submitting for an interview. They took their eye off the ball. Completely took their eye off the ball and it hit them in the nose. Lets go back to 1998. The president thin was bill clinton. And a republican senator by the name of Mitch Mcconnell stood to defend the then special counsels investigation from partisan attacks. Roll it. Our nation is indeed at a crossroads, will we pursue the search for truth or will we dodge, weave, and avoid the truth. I am referring to the investigation of serious allegations of illegal conduct by the president of the United States. That the president has engaged in a persistent pattern and practice of obstruction of justice. Mr. President im deeply troubled today because judge starrs pursuit of the truth is being undermined every step of the way every single day in the press by those whose sole mission is to attack and impugn the Court Appointed independent prosecutor and the congressionally created process. Ball, is it as simple as this was then, and this is now . I think thats it. There is nothing worse unanimous a situation aal ethicist. It has flipped for Mitch Mcconnell. So when he tweets that his white House Counsel isnt, quote a john dean type, then all caps a rat, for meeting with and talking to special Counsel Robert Mueller, you have to wonder, what does the president moon by calling dena rat . So flashback, 1973, where john dean, then president Richard Nixons white House Counsel flipped and helped bring down nixons presidency. Is this the rat trump is tweeting about . The one who was in the white house and became somewhat familiar with its inner workings, the watergate matter was an inevitable outgrowth of a climate of excessive concern over the political impact of demonstrators, excessive concern over leaks, and insatiable appetite for political intelligence all coupled with a doityourself white house staff regardless of the law. Now, just this past sunday, heres john dean calling in and talking to anna cabrera, being called a rat by president of the United States. He must be a john dean type rat. All caps on that rat, too. Yeah. No kidding. Whats your response . What do you think about that . I did respond in tweet that i dont think that trump understands whats going on. We know hes somebody who does not really reveal his full factual problems with his attorneys. They have to sort of find it out the hard way. I have with me, cnn president ial historian tim and a half tolly. Anna asked the perfect followup question, which is trump isnt siding with the truth. If he sees john dean as the rat, dot, dot, dot, are you seeing nixon as the hero . Well, i learned when i was director of the Nixon Library that there is a core of people in the United States who are nixon watergate defenders. For them, john dean is a villain. So President Trump, who was friends with roy cohen, is channelling that kind of hatred of john dean. Why did they hate him . Lets talk about why they hate john dean. In march of 73, john dean goes to the president n. In a famous conversation called the cancer on the president y he leys out the cover up. He lays this out and he says mr. President , we have a problem. We are paying hush money. We are being blackmailed by these watergate burglars. And he tells this to the president so the president can stop it and say, were not going this. But instead, the president says, well, how much money is it going to cost to keep it going . John dean comes out of this conversation, and then over the next couple of days begins to think that oh, you know what they are going to hang me out to dry. This president knows about the coverup. Hes in the middle of it. And auto im the next to go. He goes to a he gets a criminal defense attorney and then he goes to the prosecutors. This is in late march of 73. Yeah. Then he becomes the first insider to testify that the president was involved in the coverup. And he does this in front of the world in the summer of 73 before the Watergate Senate watergate committee. Thats why hes considered a villain. It turns out hes telling the truth. Well, let me tell you this. He didnt know about the taping system. All this testimony he gives when he doesnt know whether anybody can actually prove it. But he knows its true. Then the tapes are revealed. Then the tapes are played. He makes a few mistakes. None of them are perjury rous. It turns out he is telling the truth. The president is at the center. But for nixon defenders they never forgave him for turning his back on the president even though that meant committing a crime along with him. Not only is our current president referring to this man who told the truth, calling him a rat he also compared the special Counsel Robert Mueller to one of the most disgraced men inis tree, senator joseph mccarthy. Its bad enough that he is using godfather language to talk about dean. What he said about mueller is beyond outrageous. Its poisonous. Lets step back a bit and talk about joseph mccarthy. The United States faced a problem in that the soviets were penetrating the u. S. Government. Their greatest penetrations that happened had happened in world war ii. There was a reason to be concerned. Joseph mccarthy see as political opportunity. Hes not talking to the people in the fbi who know the real story. He is not talking to people in the cia. He starts making up figures and saying there are 200 soviet figures in the state department. Completely made up. Every charge he leveled was made up. He was a demagogue. He was take americas natural fears and fanning them. All right, who in our political universe today is taking natural fears that americans might have about isis b terrorists, and fanning them for political gain i dont think its robert mutualer. It is a question my next guest is asking herself understandably show as the priest abuse scandal engulfs the church. The leader of that church failing to say one word about abuse or survivors in sunday prayers. But released a statement rttle. In part it reads the victims outcry was louder than all the measures meant the silence it. The lord heard that cry, and once again showed us on which side he stands. That response nearly one week after this harrowing report brought by this pennsylvania grand jury revealing allegation after allegation of sexual abuse of more than 1,000 children by more than 300 priests. One survivors who was abused in chile and now lives in philadelphia says he is encouraged to see the change in language coming from the pope. This is how he describes his pain. Its like a bullet that stays in your body and travels around and hurts you constantly. Karen is a columnist with the washington post. She wrote this piece, why am i still catholic . And so, karen, thank you for abouting with me. As you you described for me as you did so beautifully in the piece about sitting on sunday in the pew and how you felt when they were wanting the hive. I think we as catholics have taken a lot of sort of body blows over the decades. I mean, these reports come out over and over again. But what happened as a result, you know i would take issue is a catholic is allowed to do that. But the pope here, it was not that god heard the cries of the victims. It is that an attorney general in pennsylvania dug deeply into the church to uncover this. So i found myself sitting in the pews and wondering, you know, why am i still in this church . A church in which i was born. A church that represents more than my faith. It really represents a big part of my identity. And it was just my luck that we actually had a very inspiring sermon yesterday by a very young priest who really implored catholics to remind ourselves that, you know, god really is present in this place, and that change from the church that we have to stay there if change is going to happen. He wears his compass, you symbolically wear yours. Back to the letter from the pope. Nowhere does the pope acknowledge in detail the criminal coverup by these priests. Because survivors, they are still struggling today. Absolutely. I think the crime here was not just the crime that was committed by the individual clergy on their victims. I think that the actions of the church hierarchy, the bishops, were also criminal. They colluded. They conspired. They were obstructers of justice. The fact is that these people should be judged not just in the eyes of god. They should be judged and expediently in the eyes of the law. And so the many, many years, many decades of trying to essentially just shuffle these priests around, i think its finally catching up with the church. Right. And now its about accountability. It got us thinking, if former president jimmy carter now is not holding back on how he views this president i am wondering first from you on bush 41, bush 43, what do you think it would take for either or both of them to come out publicly and criticize this president . Well, to some extent, they have. I mean, president george w. Bush back in october gave a speech. He didnt mention donald trump by name but he took on trump itch in a pretty direct way. And president bush 41 made it known he didnt vote for the president. And President Trump wasnt invited to the funeral of barbara bush. I think all the past president s have criticized him in one dre or another. Thats unusual. But trump is in a different category. Hes an institutional an,ist and an institutional arsonist. I think he is trying to burn down the presidency. And these are men, regardless of their party, all of whom had respect for the office and understood its magesty and its importance in american life. Trump doesnt seem to see that. In fact, quite the opposite. He seems to relish trying to take it down and to diminish it in the eyes of the public. And they may well speak out against it. As you mentioned one of the former president ed didnt actually mention trump by name. If you dont say his name in your criticism, does it truly have the same effect . Peter, to you. Oh. You know, it has an effect, if you go back and read the gorge w. Bush speech everybody knew who he was talking about. President bush and others may ratchet it up. Willic make a difference . I dont know. But you may have something happen analogous to what happened with the intelligence agencies and the head of the cia and all of these various other people. Thats what got us wondering. Yeah, they spec out because of what happened with john brennan and the clearance. They felt like that had crossed a line. I wouldnt shock me if trump does something or continues on this trajectory that other president s either separately or together speak out. Because i think he is a threat in ways that are just unusual, as i said. Hes not interested just in attacking truth. He wants to annihilate truth. He wants to destroy the concept and categories of truth itself. We see it from his own mouth, from his advisors like Rudy Giuliani this last sunday. Leah im wondering bigger picture, also. Peter brought up the brennan letter and all the people who signed it. Can you envision a moment in this country when all of the living president s we should put obama also in the category certainly of criticizing the president but not mentioning him by name but Everybody Knows what he is talking about. Can you envision a moment when all the past president s come together and put their own politics aside and for the good of the country and because of the magesty of the office that they held speak up against the actions this president what do you think would have to happen to precipitate that . Right. We are at a moment like that after charlottesville last year where it felt like there was going to be you for example there was going to be this gettogether of president s who would come out and speak out forcefully or issue some kind of a statement about donald trump, about the nation. Inste instead, what we have gotten piecemeal over the past couple of years is president s speaking out in veiled terms. Jimmy carter in fact, in doing this enter rue and calling donald trump out by name, particularly given jimmy carters own conflicted not so easy presidency but also the way in which he revolutionized the post presidency. For him to speak out and say this and speak so forcefully and say donald trump is a total disaster is really something quite novel and quite different. I think what we will see Going Forward is that president s will continue to play this slightly polite role but will also continue to take veiled or not so veiled shots at the president and critique the president. Again, i think if we do have a moment like charlottesville again where it feels like what are they waiting for . Charlottesville happened and i sit here every day and talk about the latest moment in this white house. The name calling, what have you. What will it take . I think it takes another moment or another kind of incident like of the scale and of the scope of charlottesville. Something that shakes the nation to its core. Unfortunately, with a we know is that these what we know is that niece incidents have been few and far between over the last few years. So i wouldnt be surprised if something happens in the next couple of years, next couple of months maybe even the next couple of weeks that really does force the former living president s to come out and issue a statement together. Again, i would not be surprised with the exception of jimmy carter, if they continued to speak in these kind of very direct terms but at the same time refusing to actually use Donald Trumps name. And kang, i know just reading about you as an actress much of your work has been out of singapore and malaysia. You havent been as face to face with dealing with racism in the way that Asian Americans have. And you have been working with so many Asian Americans in this film and just as you alluded to everything going on in this country as a backdrop, what was that experience like for you . What did you learn. I think one of the best thing about acting is the fact that we inhabit worlds that are not our own. We inhabit them in a very intimate and detailed fashion. And we learn so much. Similarly, it was exactly the case here with my experience with crazy rich asians for myself as an asian chinese in a majority chinese community. Certainly although the rhetoric of inclusivity is something that we are familiar with i dont encounter any sort of negativity on an everyday basis. Also, singapore, as a country, i think is very, very, very overly sensitive about the fact that we need to be diverse all the time. Were a very small country. And i think any sort of dissension is just looked down upon. And so we are constantly having policies for inclusivity. When i started filming for crazy rich asians, the rhetoric for inclusivity in the United States for not just the Asian American community but for all minority communities in the United States became very real to me because of my relationship my growing relationships with my colleagues, my fellow actors. When i came to l. A. Last week for the l. A. Gala, the emotion that i felt in the theater, on the streets, all the people that have been writing to me on my social media that are part of minority groups all over the world it really exemplifies the fact that the feeling of needing a voice is so yes. I just was curious my final question is no matter the color of your skin or your believes what do you ultimately want people to take away from your film as they walk out of the Movie Theater .
