Reporter so, our question, of course, as you said at the top, brooke, is when will crossexamination begin . The assumption is its pretty close. What we do know is that the prosecution has asked a lot of questions and there was a break around, what, 2 30 p. M. Eastern time that was supposed to go until about 2 45 eastern time. The judge told the defense to keep questions and crossexamination sharply focussed. Sort of telegraphing the things to come. Now, lets talk a little bit about the last testimony we heard from rick gates. Hugely important, almost anything he says about the case. I think one of the most interesting points that was brought out by the judge at the very end of that direct
defense . Because cant the defense just say this guy is an admitted liar. This is the guy who should be on trial. And really attacking his credibility . Well, he should have been on trial except he pleaded guilty and of course he acknowledged his criminality. So before the jury you have a person who unlike manafort has acknowledged his guilt and stands ready to be questioned. Now, the questioning will be very sharp because theres a lot of material for the defense to go into. And particularly in my view the fact that he actually stole money from manafort will be highlighted. There was no honor among these thieves. That will be a point which the defense, im sure, will spend a good deal of time on. But the overarching question is whether the two of them together
before they split up because one of them has turned states evidence, whether the two of them have reaped huge amounts of money, which they did not pay taxes on, which they violated any number of different laws and regulations about because of their greed. Thats what will ultimately be before the jury. On the greed, so you have gloria, this battle of two liars. You have the admitted liar and you have the accused liar. Ultimately it is the jury who will decide who they believe. Right. Also dont forget there are documents theyll be looking at. Theres an accountant, theres a woman who admitted that she was Falsifying Documents for Paul Manafort. The paper trail. Right. Its not just that you have one liar against another liar. There are no heroes in this
story, but you also do have things, emails, documents that they can look at, bank records. They can see exactly what was transpiring and then they can decide whether gates who after all is pleading for his life here. We know that. Thats why he turned states evidence. But then they can decide who theyre going to believe. As richard says, theyre going to attack gates because he embezzled money from manafort, so there you go. Not exactly a great guy here. But he admitted it. He is singing here. But i have to say that thats not the only thing the jury is looking at. Theyre looking at paper. Theyre looking at emails. So, those things dont lie. Is the documentation, which is such a key part of the prosecutions case, richard,
will that along with gates testimony be enough . Well, certainly the prosecution believes so. And it is a very strong case when you have this amount of Documentary Evidence as gloria points out and as well as witnesses who once worked for the two of them who acknowledge under oath that manafort was directing the operation, was the person who had the ultimate say so and where as gates might have done various administrative things and executed orders from manafort, the prosecutions theory is that manafort was the guy in charge. Hes the one with the different houses and the incredibly lavish lifestyle. So, thats going to effect the jury substantially. I was talking richard just staying with you, i was talking
with one of our lawyers last hour and they were saying if gates lies just even once like the teeniest of lies on the stand, once, his deal gets ripped up. Thats very rare in practical terms. While the terms of the Plea Agreement say that, unless there is an enormous lie and something that has been hidden, thats not likely to happen. But remember, they caught gates in a lie in his original proffer. And that was a problem for him. So, you know, youre not dealing with somebody who is unfamiliar with lying. But i dont think the jury has any great choices in saying this guy is a good guy. They were bad guys doing bad stuff. Listen, the prosecution didnt find gates by looking in
the phone book. Exactly. He was manaforts guy for many, many years. Right. That was the association that manafort chose. Thats something the prosecution will harp on, believe me. Let me turn the page on someone else, Michael Cohen, gloria, that the Wall Street Journal is reporting that Michael Cohen, trumps former attorney, could be facing new legal troubles. Theyre saying that cohen is under federal investigation for possible tax fraud, after underreporting, theyre saying, underreporting from his taxi medallion business. I imagine that would put additional pressure on cohen to try to speaking of deals cut a deal with the Special Counsel. Look, i think hes trying. I think hes been waiving a red flair saying i know all this. There are things i know that i can tell you that i would like to either deal with the Special Counsel or the Southern District of new york. He made it no secret that donald trump is no longer his mentor
and good friend. And so these kinds of charges, which the Wall Street Journal is reporting about are things that i think we would expect. Its been talked about in the taxi medallion business, for example, Taxi Medallions used to be worth a lot of money than uber came along and they were worth a lot less. And maybe he overstated his financial picture when he was trying to get some loans. So, it makes sense that these are things that they might be looking at. But we at this point in our reporting we do not know about any conversations that he has, that his attorney Guy Pa Tril Low has been having with the Southern District of new york. That is true especially in kansas in the governors race there, chris kobach a controversial figure in kansas, part of President Trumps now Depad Depanelled voter fraud. Donald trump went against the wishes of the Republican Governors Association and the establishment crowd, he went against the sitting republican governor in kansas and the big question is, if kobach wins the nomination tonight, does that put that kansas gubernatorial

He wrote, if you and i fall into bad moral habits, we can harm our families, our employers and our friends. The president of the United States can incinerate the planet, seriously, the very idea that we ought to have or less than the same moral demands placed on the Chief Executive that we plates on our next door neighbor is ludicrous and dangerous. Well start there with two conservatives with me here, scott jennings, cnn political
commentator and former Special Assistant to president george w. Bush and rich lowry the National Review editor and cnn political commentator. Gentlemen. Scott will take this first. Is he, im looking at you, first, my man. Im looking at you first. The 1990s pence seems like quite a different guy than the 2018 pence who is completely ignoring any sort of moral issue with trump. Do you agree with the 90s pence that a president should be impeached over moral violations . No, i dont think that was a good standard then, but obviously republicans talked much more that way then than they do now. And i think why dont they talk this way now . Well, obviously because you have a president of the United States who engages in conduct that no one should be proud of and no one should defend. One bright line is that he what set made the clinton scandal thermal nuclear, he continued his conduct in the office with an intern. Look, the republicans have given
up this ground for the time being. I think a key thing that happened in terms of the iteration of the party on this stuff was mitt romney, a fine, upstanding man got completely destroyed in 2012 and personally destroyed. So i think a lot of republicans concluded, we put up the boy scott. We got nothing from it. So lets go with this guy who is Something Else entirely. Again, hypocrisy . Well the constitution doesnt mention hypocrisy grounds for impeachment or morality. I argue Holding Someone to your own personal morals and trying to call that a high crime or misdemeanor is a really bad idea no matter who is in office. I disagree with 90s mike pence. I would also say that elections are not referendums theyre choices and im guessing that mike pence would argue that its immoral to do what go down the path of voting against republicans if it means putting a clinton in office. So, this is where it gets real dicey about trying to apply
morality to political situations. We have to stick with constitution. High crimes and misdemeanor, yes, Everything Else thats not what the founders intended. The president in a pa jurorty sense refer to him as, he does this interview with New York Times is candid and saying when hes asked about trump and the republicans not saying a whole heck of a lot, essentially trust me, ive stopped this from being much worse. So no specifics chis what he said, quote, i can look myself in the mirror at the end of the day and say i avoided that tragedy, i avoided that tragedy, i avoided that tragedy. I advanced this goal. I advanced this goal. I advanced this goal. Profound words. No, seriously, though, but with paul ryan, what do you think hes referring to specifically . I dont know if he literally means tragedy. Im sure he said influence on the president in terms of policy and things he said. But its not as though he
stopped him from launching a nuclear war or anything of that nature. I dont think anyone takes it that way but roughly speaking. This is a calculation that paul ryan have made, i can condemn the president s conduct and that will destroy me. The party my party will no longer support me and the president will be exactly the same the way he was yesterday and the day before, nothing will change except i will no longer have any influence and no longer have any ability to advance policy goals that i supported my entire career. Is that a compromise . Yes, it is. Is it practical and the only way forward for people elected officials in this position, yes. Do you agree . Yes. I think that both paul ryan and Mitch Mcconnell and everyone else concluded that, you know, falling into this trap of answering questions about the president everyday only suits the medias purpose and not their purpose. And their purpose is to govern. They cannot govern if they have a broken relationship with the president , so theyve chosen to
forge as good a relationship as they can. Seeing this comment tells me paul ryan is like a Genius Book Marketer because now when he leaves office and writes hz book and memoirs, everybody will turn to the chapter called tragedy, tragedy, tragedy. You dont think hes going back home to watch his children grow older, maybe he has other hell be back. Hell be back. He also said that trump just wants to troll, his word, and see heads explode by floating the idea of a second putin summit. Do you think that thats naive . No, i think he frequently floats things to cause 24hour freakouts and gets great amusement out of it. I do think he is also someone who reflexively wants to do what everyone says he shouldnt do. Dont do that. I will do that because i can. I think thats going on here. I think time and again this white house, this president has figured out how to send the news cycle, the 24hour cycle into a
frenzy, whether that is strategic in nature or just for their own personal amusement depends on the day. He gets bored when the news cycle isnt exploding. He wants to blow it up. I think the best way ke can describe it is the news has done a great job of giving insight of what these fires are looking like, what the men and women are carrying, 45 pound pack, chain saws, tools, and theyre working 16 plus hour shifts, like you said, so the work is grueling. The time frame and the pace that theyre carrying is at a high rate. Theyre really just being asked to do a lot. And theyre continuing to show up and continuing to do the job that theyre called to do. I just really commend them for everything theyre doing right now. Lot of these men have been doing since march. Here we are in august and theres no end to the sight of the season so far. What is it like when youre going out to fight such a fire and you dont know when youll see your family again . Its tough. Its tough. Its a motivating factor to put in the work and put in the effort. For me personally when i was out on the line, i would think of the families that were impacted by this and i would remember why were out here. Theres a bigger purpose than just myself. Every moment that you do get to talk to your family, you do get to talk to your children you really cherish and take the time to do that. There were nights when i had opportunities to read my daughter a book, i carry childrens books with me so i could read to her. A lot of moms and dads out there right now are really going through the ringer this gauntlet of doing this since march. And going back and forth and being pushed to the limit. Just having every opportunity that they can, they take to spend with their family when they do go home and do have a minute to talk. Its pretty tough. But we keep on our minds the bigear purpose of helping our communities. It needs to be done. I commend those out there making thesacrifice. Its incredible thinking you or anyone carrying childrens books to hop on the line to read them to your kids back home. What so far we know that these fires have claimed two firefighters and i know thats a loss you know deeply. How do you mourn the loss of Family Member yet keep going back to this dangerous work . So weve actually lost a handful of firefighters recently. We lost a captain on a Hot Shot Crew. We lost two dozer bosses and a firefighter from Redding Department as well. And its really difficult. Its a tough time. You know, the bonds that are created out there, bonded over a period of hard work and grueling work and it takes a team, it takes a family to accomplish what theyre accomplishing. So to be able to stay motivated and to be able to have that compassion and to be able to put things aside and know that theres a bigger purpose to this is kind of what theyre going through right now. Its not easy. A lot of these men and women to go back out on the line of losing someone, so they have things in place to where they get to go home for a few days and kind of just take some time off. But theyre right back at it. Its not i wish i had the best answer, but i know theyre doing the best job with it. No, i know they are and were thinking about them, these men and the women. So, happening right now in this federal courthouse in alexandria, virginia the man who flipped against his former boss, Paul Manafort is being crossexamined right now on the stand, were talking about rick gates. This happening after a couple Key Developments today. Gates testified that manafort recommended a banker who gave him a loan to be secretary of the army. He also told the court about emails that showman that fort directed him on what to do with secret, offshore accounts. Gates testimony is what happens when prosecutors convince insiders to flip on friends and colleagues. Gates also just remember he was a Senior Trump Campaign manager. And i think this trial its worth noting doesnt have anything to do with the 2016 kban, right . Right. This is about manafort and gates and what they did visavis ukraine earlier in the decade. Lots of money. But what you noted in the open there, brooke, i think is super important which is this is why the Government Works to turn witnesses and make them into
cooperating witnesses because gates has the goods on manafort. His financial struggles. Illegal loans alleged. All these sorts of things that only someone who is working that closely would be able to do and we obviously know on the horizon you have michael flynn, formal National Security adviser and we have not seen this, a trial relating to the 2016 campaign and then Michael Cohen in the news today trump former lawyer who obviously is under considerable pressure to flip because of what he may be facing. So i think if youre donald trump or don jr. , Jared Kushner youre paying close attention. Has to make you nervous. So its my understanding that its some point today the name trump came up in court. Yeah. But we dont know which trump. Correct. That is referring to. But has to do with baseball
tickets. Yankee baseball tickets. Apparently never claimed and that manafort sort of earmarked for a trump. We dont know who. Why is this of note . It is an interesting piece in that this is the first time to your point that the name trump whether its donald trump the president , don jr. , eric trump, ivanka, we dont know but its come up in the trial so its a couple things. It illustrates the fact that, yes, it does come up through the Mueller Probe and the reason he is on trial right now. What was uncovered by bob mueller and all of the tweets are right in the sense of not directly related to the 2016 campaign and what Paul Manafort did there.
