His fourth day of flatout denying these allegations, and he is threatening to sue the Washington Post for publishing this bombshell report just a month before the Alabama Senate race. Three days ago the Washington Post published another attack on my character and reputation in a desperate to stop my political campaign. They are untrue. Lets start up on capitol hill with my colleague our senior washington correspondent brianna keilar. Starting on the Senate Majority leader here. What are his options for the Alabama Senate race, will he endorse a writein candidate . It is not up to Mitch Mcconnell. He mentioned that, brooke, that theyre looking at this idea of the success the potential success of a writein candidate, but that really is up to the state party to decide. At this point youre seeing Mitch Mcconnell distance himself and hes had days to look at roy moore and see how hes responded to the allegations and Mitch Mcconnell is now of a growing number of republican senators and of course, hes the most important Republican Senatorial voices and he does speak for the conference, but he is joined, as well by senator Susan Collins who just a short time ago tweeted out that after having listened to roy moore and his denials and his radio interview, she says that the denials are not convincing and that he must withdraw, but again, this really comes down to the state party because this is a december 12th general election. The state party can decide whether they invalidate his nomination which would mean because hes going to be on the ballot no matter what. Theres no getting around that. Hes on the ballot. Right, if votes are cast for him if his nomination were invalidated then it wouldnt count. Its all eyes on the Alabama State party and also on the white house, how is the white house responding to this, brooke . Because theyre still saying the if true, if true, he should step out. Right. Well, were going to go to alabama, and see how alabamans are feeling about this, thank you so much up on the hill for us. As we have noted the statute of limitations has passed. This will not see the inside of a courtroom so it really comes down to who do alabama voters believe . And that might have a lot to do with why roy moore is choosing to stay in the race. This is a country based on justice and on a persons innocent until proven guilty, and that stuff needs to sort itself out. If he went to the lord and asked for forgiveness for that and hasnt done anything like that since then, i believe that the good lords forgiven him and as a christian i have to forgive him also. Im not going to vote for him because im a democrat, but ive known him a long, long time. The thing that bothers me about those charges is that hes been in public life, running for many offices and as many times as this has happened no one has said anything until now, and i dont think it comes from any place except washington. Roy moores wife has now weighed in on the controversy engulfing her husband, calling the allegations a quote, witch hunt saying the washington establishment and Democrat Party will stop at nothing to stop their campaign. My next guest is someone who sides with roy moore. He is Brandon Moseley from the alabama political reporter who just wrote an opinion piece on why he believes roy moore. I read your piece a couple of times over and you staunchly stand by and you believe in roy moore and not these female accusers, tell me why. Ive known roy moore. Ive known roy moore for 20 years. Ive covered his campaigns. I mean, i live in the county. I live in the county which is next to the county. I think if this was a serious if these allegationings were out there and were serious i probably would have heard them, but understanding that most people have not actually met roy and dont know him personally, were still talking about 38 years ago. Were talking about something thats past the statute of limitations. Let me jump in. You are use the word serious. Why dont you think these allegations are serious . Theyre 38yearold allegations. This would be a misdemeanor at the time under the code of alabama. The statutes been up since 86. If you go back and you dont elect anyone who has ever done anything wrong we wouldnt have had barack obama. I think he did cocaine. Bill clinton supposedly smoked marijuana. Okay, what . They werent eliminated from the ballot we are talking about allegations involving the Current Senate candidate of alabama. Let me stop you on the facts. Lets function in the factual world. Lets go back to the one involving a 14yearold Sexual Consent in alabama is 16 and you acknowledge that sexual contact with a 14yearold would have been illegal and would be considered sexual abuse by the books today, but brandon you make this argument that there wasnt a law against sexual abuse in alabama back in the 70s. So let me ask, are you saying that because there wouldnt have been a law according to you that that would have made it okay back then . No, im not. If roy moore committed a sin, thats a sin and thats not good, but were not talking about an actual crime here under thats prosecutable in 2017. I dont think you throw out 35 years of a mans career and his reputation because of an unsubstantiated allegation from 1979. Brandon, she was she was 14 years of age, and i dont know how much digging you did or didnt do into the law in 1979, but we did, and we found section 13a, 667, we found that this was on the books going back to 77, and would have been considered sexual abuse in the second degree. Care to respond . Which is a misdemeanor in alabama. Does that make it okay . If i am correct. No, but again, if, you know, roy moore has stolen a lawn mower when he was 21 thats bad, but thats not a reason 50 years later to all of a sudden, you know, throw him off the ballot or let Mitch Mcconnell pick the next senator of alabama. Sexual abuse, stealing a lawn mower, lets not even go there. You believe roy moores account, brandon and you want to believe the best in roy moore. Is it odd to you that he has not come out against these allegations point by point, line by line, accuser by accuser. Instead just shouts fake news and democrats when, lets all keep in mind, this now grown woman then 14yearold is a republican and voted for donald trump. The only accusation that would be a serious crime was that of the 14yearold, whether he gave alcohol to an 18yearold when the alcohol age was 19 in alabama. Again, the one that matters is the 14yearold complaint because that would be the most serious offense its become basically lee kaufmans word versus roy moores and corkmans account is different than the other accounts, and the other accounts roy moore dated some of these women, supposedly, as long as three months and they never got naked. According to corfman supposedly roy took off her shirt and pans and there was some inappropriate touching. On roy moore. Thats correct. You started the conversation. Im just trying to understand how youre feeling. You started the conversation saying you know roy moore for years and i dont know if youve met the president of the United States and im curious for the sake of conversation, you know, did you believe the Sexual Harassment and assault allegations against President Trump during the campaign . I believe that President Trump probably at some point in his life has acted inappropriately with women. Hes had three marriages e multiple mistresses. I still voted for donald trump. I mean, as a christian i can forgive a past indiscretion, certainly one thats not a crime at this time. If you knew these women if you knew these women, brandon. I understand. If you knew these women do you think your opinion of these women and their allegations would be different . If i knew these women i would be glad to pray that they, you know, for them and for their family, but i still dont think that we should abandon roy moore and vote for bill jones or some writein candidate because of accusations from 1979. As a journalist, i know you leave this piece saying you dont normally opine, although normally you are in this case, why didnt you call these women . You know, as journalists, we like to hear both sides of the story. You have roy moores side of the story and youve only read these womens side of the story and you are there on the ground in alabama. Why not call them, hear them out and report on that side of the story in your piece . The Washington Post had already done the story. They had their accounts. Reporters with local reporters have tried to contact some of them, but weve had no success. I was not assigned to by my editor to seek out these women for their accounts, but ive heard ive heard whatever the Washington Post put out and ive seen it, heard it or read it. Just as a journalist i still believe roy moore. Dont you think you should have a wellbalanced view before you put out there as i think you, you know, you call yourself an objective journalist, though clearly youve made your decision in this race. Why not pick up the phone and call these women . Ideally, these charges would have come out six months before the election and we would have had time to go out and interviewed the women interviewed all of the various stuff, but this all broke thursday in the Washington Post. Were talking about it here on monday as to whether roy moore should drop out of the race today or not. Based on everything i know at this point, and like i say, ive tried to research these women and their backgrounds as much as i could in the hours between that revelation and now. Sure. Two of those men now say the president got played by putin. Putin is committed to undermining our system, our democracy and our whole process, and to try to paint it in any other in any other way is, i think, astounding and in fact, poses a peril to this country. Putin that donald trump can be played by foreign leaders who are going to appeal to his ego and to try to play upon his insecurities. Hes really placing his relationship with the russian leader ahead of his relationship with the American Intelligence Community and hes placing it ahead of u. S. Interests internationally. The key thing here, as we all know is that russia did try to get involved in our election, the plot seemed to be hatched at the very highest level, that Vladimir Putin had to know this was going on, and now hes lying, if what trump says is true, directly to our president. So this is all kind of theater of the absurd, but i guess where the president is concerned if he gets a red carpet like nobodys ever seen then hes happy. Lindsay, do you think trump is getting played by putin . I do think hes getting played by putin and i think weve watched this play out over a number of months. Putin is a career, seasoned, Intelligence Officer and what Intelligence Officers do are they look for peoples vulnerabilities. They look for peoples motivations. They look for targets. They try to exploit those vulnerabilities motivations to their own ends, and i think weve watched that happen. Weve seen what an easy target President Trump has made himself to Vladimir Putin. Here is a tweet. Especially as President Trump has this big announcement upon returning from this asia trip. What what do you make of this, these words . Hes talking about being everybodys friend, eventually almost like hes having a fight in the school yard, but when the fight is over theyre going to hug it out. And i think this must be baffling both to the north koreans and also our allies around the world wondering if this president means what he says and says what he means. After less than three hours of fresh deliberations today a federal jury in new jersey told the judge they are deadlocked. They are deadlocked on all 12 of these counts in senator Bob MenendezsCorruption Case and apparently this judge has now ordered this jury, seven women, five men, to go back and keep trying. So dramatic turn of events, chrisly. Chris sillizza, deadlocked. Two things. One, remember that the new juror one of the jurors had left on a longplanned vacation. So they added a new juror in as of this morning. So a very brief time they decide that theyre deadlocked. Point two, as you know, brook, this is not the verdict. This is a note from the jury to the judge. The judge says back to the jury and go back and deliberate some more. Possibly they come to something, but human nature being whats, if theyre deadlocked theyre probably likely to remain deadlocks which brings an uncertain future. Left week, new jersey picked a new governor and it was a democrat phil murphy. The appointment power and say that menendez, this is down the line, and there was a new trial and he wound up being convicted, a democrat would almost certainly be governor and be in a position to appointment another democrat. Whats interesting about these brooshg began deliberating a a now just after 10 00 this morning and they sent this her the and note for the, that note came in around 2 00 p. M. Woe understand that prosecutors recommended that the judge urge them or order them to continue deliberating. We know that the defense team led by abby lowell and hes senator menendezs lawyer. He wanted to declare a mistrial because there were ups and downs over the last few days and we know that the judge had instructed this new jury that began deliberating anew this morning and its the allen charge that basically says if the jury comes forward and says that they cant reach a unanimous verdict the judge usually does implore them to go back and try again. Sometimes theyll do this. The judge will do this up to two times saying to the jury, no. Go back and try this again. Continue talking and continue deliberating. So its been really interesting because these jurors began deliberating next week, but as it was getting toward the end of the week, the federal holiday on friday one of the juror his previously told the judge she had vacation plans and as of thursday she could not continue deliberating. Of course, no verdict was reached on thursday. She left, not to come back and an alternate was named on monday, but there were some concerns this morning because that juror who was dismissed to go on vacation, she ended up talking to the cameras and she said she was feeling pressured and she believed in her estimation she believed that it would be a deadlocked jury. Thats exactly what were seeing now, brooke. Wait, let me stop you there for a second, jessica because we have sound from the juror in case you havent heard. Like you said, she got in front of cameras and heres what she middle. I told them they werent going to change my mind so there was no reason for them to try to change my mind. I was already in the courtroom for nine weeks and those nine weekis that presented everything i had to present. I didnt fall asleep. I paid attention and wrote my notes so what i saw in the courtroom he was not guilty of all count xs so was dr. Melvin. They are friends. So theres the juror. She has come out and spoken publicly and its my understanding that a couple of these current jurors, and doesnt that sort of poison the well. That was the defense teams urment this morning. There were fr there were proceedings in the court this morning where the judge asked have you heard news reports did you hear about juror number 8 who spoke out . Several jurors as well as as a few of the alternate jurors who were there throughout proceedings they sheep earnly raised this hand. So, yes, they have some of this reporting over the weekend and theyve had saturday, sunday and enough out, but he interviewed these lawyers, he didnt believe that they were unduly influenced here, and its been less than four hours since theyve been back in the jury pool because they could not get to a unanimous verdict any given then strush instruction to go back and try again. Just the fact that you have a u. S. Senator on trial put this into historic perspective for us. Well, just imagine how ill senator menendez is right now. He was probably hoping to get this behind him and instead he is living in realtime with it and you will flaer up on Headline News as something you dont want. We see politicians often and sometimes their career gets destroyed and he suddenly had the great moment of being a Vice President who was tossed out for bribery charges. If youre menendez now, you kind of want to be a bull and go forward, try to do other business of being a senator and hope that youve outlawyered your opponents on get a mistrial and get anything that you can to try to survive, but this is not a good day for him. Even if hes exonerated in the long run these things can play a huge toll, and if you spent years in a trial about bribery with a donor these are things that are problematic. New jersey is a democratic state. We saw that in the governors race last week. Menendez has won before, but these are the things that over time can erode the Political Capital that you have and ill make another nerdy political joke. Weve been following this corruption trial involving new jersey senator bob menendez and what weve now learn side this jury which essentially has started fresh today because theyve had to switch in this new juror is deadlocked and deadlocked just after a couple of hours of deliberations. They had been deliberating for about a week when one juror had to be excused for vacation and they bring in a new juror today and after just a couple of hours theyre deadlocked and the message from the judge to the jury is youve got to keep going. Just to you first. Your reaction just to this jury here. Its seven women, five men, deadlocked so quickly. Theyve been deliberating for a number of days and i didnt expect that to take too long, but i thought from the beginning that theyd have a hard time convicting menendez of these charges. The Supreme Court in the 80 decision in the governor mcdonald of virginia found that you really need a specific quid pro quo, meaning a gift and an official act in respect of that gift. There really wasnt evidence of that and indeed the prosecution used this sort of stream of relationship and the theory that has been knocked down by the Supreme Court in mcdonald. In some sense for the prosecutor where we are now at a present hung jury is a victory for them. I dont think theyll retry this case and i dont think its a proval case on the evidence that weve been able to read about in the press. Deadlocked on 12 counts. Well, brook, jury deadlocks are not unusual in criminal cases. They happen all of the time and a lot of times its one or two jurors holding out and after more deliberations they change their mind and we have a verdict, however, i have to agree with michael in this case and it made it hard to prove bribery across politicians and one of the jurors who had been excused from the jury because she was going on vacation reported that there was a deadlock and there was a firm group of jurors that were not going to vote guilty and or others who thought he was guilty and so this looks to me like it is going to wind up with a hung jury and i think you will see tomorrow what they call an allen charge to the jury and thats a charge sometimes called the dynamite charge and its designed to really get the jurors to get serious, to reexamine their beliefs and not to give up a conscientious belief, but to reassess all of the other jurors positions on it, but this is a tough, tough case for the prosecution and i have to agree with michael on that. One problem here is they have the two defendants, the senator and codefendant have a 25year 14ship and its very hard in a case of that long a friendship to prove quid pro quo because they have spent time together over a long period of time and that stream of benefits theory just doesnt work anymore, and you saw it in new york where in the conviction of the state legislators their convictions were overturned after the mcdowell the mcdonald decision by the Supreme Court. I had experienced Sexual Assault since i was 8 in this picture or a week after i was attacked and then people started talking with each other saying ive never told the story until now and i dont feel alone, and so, you know, i have this tiny platform thats this big and to be able to put my picture out there, i think sometimes when somebody sees that you are somebody who has been sexually assaulted which i have been and i didnt put it the in my tweet and i think people trusted that i kind of had their backs on it.
