This white house has not presented any evidence of that. President has not. So once again you have the inappropriate Political Behavior on the part of the white house going on during the course of that campaign. When you have a white house making those kinds of allegations about a defeated opponent, that is just something thats just not normal in the course of events in a Political Campaign or to have a white house do from the pod tomb Briefing Room. So i dont know if you noticed this right now, brooke, but there are some kids in Halloween Costumes going back to the oval office to meet with the president. Perhaps there will be some trick or treating going on in the oval office. But i think there might have been a fair amount of that going on in the Briefing Room a few moments ago, brooke. I thought i had kids. It was none any to see little faces as you were asking these heavy hitting questions. I forgot my costume. Maybe someone can be jim acosta. Jim, thanks so much as always. And on jims latter point, how Sarah Huckabee sanders, how he kept saying, my collision, and if there is any collision, its between dnc and Hillary Clinton. What collision would they be talking about . Well, they have raised this story that was first surfaced by Breitbart News organization about the awarding of a youre ran youre rain um contract. On the merits doesnt hold substance. But as appearance there is enough politics that they are continuously going back to this, as i think in legal terms a diversion, mueller has Serious Investigation on his hand, and diverts the American People. So trying to take this purchase case from 2009 and have it be the news of the day instead of mueller and his investigation and new revelations about the meetings at trump tower with don junior none of which is good for the president. Right. Privile pivot, pivot, pivot. What do you make of it . Yeah, you can also argue what were they doing with the contracts. But you can also argue we are six, seven years into a republican majority in the house, at least, they had plenty of opportunities, you would think, to look into this issue. This week they announced an investigation. Tan, remember, this was talked about during the course of the campaign. We know the campaign was saturated with tons of information and different allegations here and there. But there is it a question to be raised about why now, whats the timing . And also if you kind of look at this in the larger landscape here, you do have republicans who are saying, okay, yes, weve had these majorities, why are we spending so much time going after our own president. Why not Hillary Clinton . Im not validating that. Thats arguments you hear from republicans. I think its also worth considering when you look at the president hes very em battled. His leg lislative agenda has be stalled. Also the fox poll shows his Approval Rating dropping among core constituency of white men. So he does have some allies in congress who are interested in that as well. I want to take the conversation back to whitefish to Montana Company that got Something Like 300 million, right, to help put the lights back on and Everything Else in puerto rico. So ambassador eisen, you are the ethics guy. What questions do you have . Again, the white house saying this was puerto rico call. Federal government had nothing to do with this despite some of the questions. What are your questions, sir . Well, question number one is whats the qualifications of this company thats two years old, just two employees when Hurricane Maria hit. Question number two, zeinke or other Trump Administration involvement. Whitefish is it a very small town. The ceo of the Company Admits he knows him. Is that really a cohenincidence . And the final set is political contributions that whitefish investors and those close to the company massive political contributions to mr. Trump and those around him. Does that have anything to do with this contract . It is ahead scratcher. And, again, secretary is saying to the president he had nothing to do with the fact that this Company Based in the town where he grew up had absolutely nothing to do with him. But caitlyn isnt this another controversy involving a cabinet member, this one now fill in the blank . Absolutely. And look at what this company will be tasked with doing. Huge job. Its a huge job. Administration has been under fire of course for handling of the puerto rico. And there are questions to be raised about Sarah Huckabee sanders saying we had nothing to do with this, local issue, there are questions going to surface. There is it an audit under way. Certainly. But there are going to be questions about how puerto rico officials locally knew about this company specifically just given how small it was and there are questions about the qualifications, of course. But, yes, certainly add utudit under way. Back on this fbi informant and how the president had tried getting this gag order lifted here. Ton that piece. Whats the next step here if the gag order is lifted . Well, well hear what the informant has to say. But i want to echo what michael said. And i thought it was terrible that Sarah Huckabee sanders wouldnt answer jim acosta question. In the absence of some evidence that any of this has to do with Hillary Clinton or that there is any connection to make these unsubstantiated allegations, its the big lie strategy and its reprehensible and we should not stand by and let the white house do t its truly shocking. Its an obvious effort to start an alternative investigation. Look, if there is a basis to believe that something improper happened, put the evidence out there. But to refuse to answer questions and to make these allegations and to have the white house engaged in politicizing criminal matter, it has the most disturbing historical echos, its profoundly troubling from ethical perspective. Can i add something to that . Yes, please. They are trying to lift a gag order on an informant who was in the Russian Organization that is charged with having done bad things. Well the person who ran the operation was prosecutored in the United States by Rod Rosenstein when he was United States attorney for the district of maryland. So he ended up pleading guilty. Sentenced to four years in prison. They have all sorts of evidence and after dave its. They know everything about this case. So the lifting the gag order doesnt add anything to what they already know hand couldnt share with congress. So which is why it strikes me this part is political theater rather than trying to get to the bottom of what happened. They know what happened. They have the evidence. Its in the Justice Department. And rod rossen stein is the one that lead that prosecution. So this is not legitimate from a Law Enforcement need to know standpoint in my estimation. Okay. Well keep digging on that. Let me, before i say good buy to you, caitlyn, lastly, to me hearing the young woman in the White House Press pool asking Sarah Huckabee sanders about this Massive Movement by hollywood within journalism of capitol hill of women speaking of finally after feeling silenced so manile years asked about it, and she wrote, this is my note, weve been clear on all of this from the beginning, and all we are going to say on it. Do you think that was a swing and a miss . Completely. And it seemed like it wasnt even interesting, right, to the white house. Which, you know, of course we all covered the campaign . Donald trump was accused of a lot of things. This question was hugely important given the context of this week. And provided a great opportunity for the white house to gain some better ground here. Right. Especially coming from Sarah Huckabee sanders who is a woman in this role, who is a mother, lots of opportunities missed here. Why do you think she said nothing . Really not even accepted the question. But, also, i think it left on the table she said you know we have already commented on this. And the comments are not supportive, right. The comments that have been made before are kind of this thing kind of happened. So to leave that as the statement, given all of the revelations that we have seen over the past week, i think was certainly a missed opportunity. But good for jackie for asking that question. Moments ago we saw the press briefing. Sarah Huckabee Sanders said the president was pushing for transparency to lift the gag order. This informant may shed new light on influence clintons in 2010 as u. S. Was approving the sale of a uranium agency. And keep in mind it was Hillary Clinton that signed off on this deal along with reported eight other federal agencies. Watch dogs, including the ranking democrat on the House Intelligence Committee feared the president may have crossed a line here when he directed, according to sources, his white House Counsel to tell the Justice Department to, quote, facilitate the lifting of the gag order. Congressman adam schiff tweeted this, if the president personally got involved, it is disturbing. This is how the white house responded. If dealing with congress, i know thats probably something new for a president to actually push for transparency, but thats what hes done. And that was the purpose of what he was trying to do in that process. Lets get some analysis. Cnn and Legal Security analyst senior lecturer at yale and former fbi special agent. Good to see both you. We saw Sarah Huckabee sanders a minute ago talking about how the president is pushing for transparency. Comment on this case, but im curious, are there other examples of president s trying to get involved indecisions over the department of justice . Or is this really unprecedented . Really, as Sarah Huckabee sanders usually goes the other way. But on a bipartisan basis, president s typically are trying to contain information in the executive branch. Thats the usual behavior. So for the president to be encouraging this. And, look, there is a difference between him saying this is what he would like to see and giving a direct order. Saying do it. Thats right. And this is not crossed into that territory. Nonetheless, when you are over in doj you know what the president wants, and you undoubtedly if its plausible and reasonable to do t its one more item on the scale in favor of that transparency. So i would note that Going Forward this kind of transparency is an expectation now that the Trump Administration is setting. So in its first year of its first term, i think its pretty noteworthy to see this sort of position being taken by the president. And you nodded on the transparency note. What do you think of what ken just said . Well, i think that the president simply does not seem to understand the boundaries between the department of justice and the white house. And we saw this as early on with comey and trying to interfere with that investigation or trying to give some influence there. And, look, the reason that we have these policies is that we are built on a system that is based on the rule of law and the equal applying of the law to everyone. And when you even have the perception of a politicization of our investigations, it causes problems. People lose faith in what investigations are about. And its especially problematic when you are dealing with former political opponent which is the case here. And ill just note that it is interesting that we are not seeing a consistent push towards transparency to go back to what ken was saying, across the board. I presume that the white house will be happy to see the russia investigations that mule letter is conducting be shut down completely. They seem to only happen when it benefits the political agenda of the administration. And thats where it becomes incredibly problematic. Maybe, and i think you hit on this a second ago, ken this is for you, the president having never been in politics, not understanding where the lines should be drawn, but certainly the white House Counsel should. And they demand transparency, but then wont reveal like when and where he goes and plays golf. So is it possible that the president still doesnt understand the line . I certainly think that for someone who came into government as the president , that there is a learning curve. That learning curve is going to last through the duration of the administration. You can just expect that it will flatten out as time goes on. I also agree that white House Counsel don mcgahn is doing an awful lot of educating but that is what a lawyer is supposed to do and provide the guard rails. Were they provided in this case . I dont know the taens to that. But lets assume for the moment they were. Just for purposes of discussion. Then its up to the president to decide how to proceed. A lot of people forget even when you are the attorney general of the country or of the state, as i was, lawyers advise, clients decide. And heel make a decision how to proceed even if its atypical as long as he stays inside the law. And hes not outside the law. Hes in safe territory. And this decision is, and we ought to know it is a political discussion. And thats not irrelevant. Its important especially to the American People and prospective on our democracy as you heard earlier i think thats very important. But we have also just been through a lot of years where we solderable politicization of the Justice Department. Go ask former governor of virginia, ante party membed tea there is a bad history here. And until both sides are willing to essentially declare a trues, i dont see it ending. How should doj respond . Well, doj, this is apparently going to be a continuing education effort. I dont know if we need to Bring Back School house rock or what, but i think that, look, there are times when the president can reach out to doj. If there is it a need to coordinate on an investigation that implacates his constitutional duties like a Supreme Court case or Something Like that, that could be one reason. Or to set policy priorities. He does have the ability to do that. And he should coordinate with his attorney general on that. But for Something Like this, where there is clearly so Many Political mine fields, i can tell you, brooke, it has impact on the ground. I was a fbi agent. I knocked on doors. You ned people to talk to you. And when people start to believe their Law Enforcement is acting on political an agendas and whoever is in the white house, it impacts other things that happen, and its really important to make sure that that piece of it doesnt get adulterated. You would know. That happened under president obama and his attorneys general. That is actually the problem that began here. And we are seeing what some people now see as a continuation of it. This is not a decision to prosecute. This is not anything like this. This is transparency decision. Totally different category. Okay. Well leave it. Thank you. Good to be with you. There is a lack of ethical and moral and consciously sober Decision Making in the white house. And so i think thats what you run into when the white house itself has no clue whats going to happen. Ambassador nikki haley she sits down after wrapping up a trip to africa. Hear how she responded to speculation she may replace Rex Tillerson as secretary of state. Also how the American Teams in niger got split up. Getting some breaking details now about the ambush in niger that left the four soldiers killed and how the American Team separated in two separate groups. Lets go to chief correspondent with some of the details here. How did they separate . Reporter well, brooke, we are learning the fire fight was more complex than we knew initially. This one u. S. Team splitting into two groups during the fire fight. One vehicle disabled so one of the groups continued on foot as this fire fight, ambush was under way. And this group was attempting a counter attack. A tenth go to out flank the attackers. And during the middle of this did kill some 20 isis fighters. But we are also learning during the two groups they lost communications between one group and another. And that group that had those four american kia helps explain some of the confusion as they were trying to sort out as this fire fight was ending who was killed, who was missing. In fact, you may remember that the first reports back to the white house were of multiple u. S. Forces missing. Four missing. Though that was quickly updated to be three killed and one missing. So the key here, this was a complex fire fight, and in the midst of it these u. S. Forces were trying to fight back. They split up into two groups. One though they had lost their vehicle, they continued on foot. They tried to out flank their attackers. In the midst of this they managed to take out their attackers, some 20 it is estimated. But adding to that they lost communication in the midst of this as well. So we dont know why they lost communication, thats still unclear. Reporter its not clear yet. But keep in mind in a fire fight there is a lot of ways that could happen. One vehicle was disabled. Could be that the radio in the vehicle was destroyed. Also possible they were carrying their Communications Equipment that is destroyed on the person, bullet, green nnade, et cetera, thats not clear, but add to go the confusion is one group tried to keep track of the other group of americans involved in this ambush. So elise is with us live in congo. Tell us what nikki haley shared with you. Well, brooke, its been an incredible week with nikki haley. Weve traveled to parts we havent traveled before. She went to ethiopia to south sudan to look at the conflict there. Then weve been throughout congo visiting dispoliced people stuck in a camp they cant leave because violence surrounding them. And nikki haley said she came here to africa to get a firsthand look at how these nations with conflict and instability, with humanitarian disaster, can become a breeding ground, if you will for terrorist groups. And in fact shes come here to prevent the next situation where we found in niger where u. S. Serviceman was killed where threatening the United States. Take a listen to secretary excuse me to Ambassador Nikki Haley. You know, you said you made the argument why africa is important to americans. You have to solve these problems before they erupt. Because we could be looking at the next conflict zone that is going to turn into a safe haven for terrorists. And we have seen that happen in other places too. You know, its so important that everybody not just talk about the middle east and how we have to be careful of the middle east. You know, you see the actions that the administration is taken in the middle east is all because we want to deal with the situation there. So we dont have to deal with it in the United States. It is the same thing for africa. We have to deal with the situation here on the ground so that we are not dealing with it in the United States. What you have to look at is these african countries and all countries, if they take care of their people, if they respect the voices of their people, then you get true democracy. If they dont listen to the voices of their people, conflict will erupt. Extremism will happen. And the United States will have to deal with it. This is all about making sure we dont get to that point. And nikki haley said if the u. S. Doesnt do more to help solve these conflicts, these kids, hundreds of thousands affected by the conflict will grow into adults with no future resenting the u. S. For not doing more. Thats the very kind of person that isis and other extremists are looking to recruit, brooke. So you mention all these countries and how substantive this trip is for her, and i know you slipped, shes not the secretary, but, elise, there has been speculation that perhaps this. Not yet. This could be an audition for nikki haley to become the next secretary of state. What are your thoughts on that . What are you hearing . Reporter well, look, i mean, look, shes really doing the kind of work that is the provident of the secretary of state. Sitting down, head to head with world leaders, with african dictators, and giving them the kind of lay down the law of the United States. But if you remember back when we met with nikki haley in july, she told us that the President Trump offered her the job and she said no, i dont think i have enough Foreign Policy experience. I said, look, there is a lot of rumors that secretary tillerson is not happy would you take it . She said i dont like it. I dont want to move to washington. I dont like the drama. And happy in new york. And i have to say its a good gig because she gets to act as one of the top diplomats for the u. S. But isnt under the thumb of the president in washington where cabinet members are subject to a lot of drama and dis traction. And the president ial very eagle eye. Glad you asked her. Do we want to believe that the off ye soviets believe that lbj was behind the conspiracy. All we were missing was any real proven answers on what happened. And i think that the sad news in all of this is that all of the people who could really tell us are dead. Either they are dead a year, like fidel castro or 35 years like jimmy hoffa. Maybe the documents that were withheld and that we might get to see within the next 180 days will clarify things but this spawned all kinds of interesting stories and no real proof. That call, right, that the cia director which you alluded to, which you hear it cutting short before he answers the vital question did Lee Harvey Oswald have any connection to the cia. Whats your interpretation of my interpretation of all of this is that the fbi and the cia were getting extraordinary reports every five minutes i think probably getting a report that never quite checked out. And i think that to me the most interesting thing maybe in all of this is jay edgar hoovers reaction after jack ruby was killed, which was what he seemed more worried about than getting to the bottom of who actually the assassin was, was what the reaction of the American Public was going to be. And he worried that the Dallas Police had ignored his warnings to them that somebody might try to kill Lee Harvey Oswald and he understood with oswald dead, the public would never believe the simple story that oswald was the assassin. And he worried what this would do to american Foreign Policy and worried what it would do it the confidence of the American Public in accepting lbj as the next president. I think this behind the scenes stuff what was really going on. What was going on in terms of assassination itself, we may never know now. Larry tye, thank you.
