Sean spicer simply is not going to answer the question of were there tapes or not because he doesnt know im told and hes not been told to answer it. It was a stunning answer, which really a stunning repetition. Lets listen to that when sean spicer was asked about this issue just moments ago. Several republicans have joined democrats in seeking Additional Information from the white house in writing about the existence of any tapes producing of tape asks any further information about the potential. Taping. Is the white house going to cooperate with those requests . I made it clear the president has nothing further on that. Does that mean that the president will deny . I was very clear that the president would have nothing further on that last week. The legislative branchs question, thats what youre saying. I made it clear what the president s position is on that issue. Big points to alexis for trying to get every which way on that e question, but making it clear hes not going to answer it. Jeff zeleny telling us right there that he believes sean spicer. He has reason to believe from talking to sources that spicer does not know. Thats not it terribly surprising tr two reasons. One, the job of the press secretary at some level, this is true for donald trump, barack obama, whoever, its plausible denial blt. What you dont know cant hurt you. You did know. So only of some of that is their walled off. Theres no way the press secretary is in on that. There were foiks we know. The press secretary is much to our frustration covering the white house. Think about not only that youre in a job where youre high profile and get made fun of by snl and people are asking questions you cant answer. There are constantly stories about your boss not being happy with your performance. Were not shock me that sean didnt know for those two reasons. How long will this answer hold . This answer that we heard from sean spicer that the president made it clear he hz nothing further on that. It will hold if thats the answer they want to run with. Were not going to stop asking about it because its substantiative at the same time. We have nod talked about secret white house tapes since before i was born. So its a big deal. It relates to the president ask his conversations with the no i fired fbi director. Lets not forget why were dealing this w this. This is why its so difficult for anybody in sean spicers job whether its him or whoever will try and speak for him. The president is the one that told everybody about that. Its not like we went through some really good shoe leather reporting, which is being done every day and we dug up the fact through sources that the president has been taping people. The president went on twitter and warned jim comey he better watch his back because tape itting everybody. So the president has created this crisis of his own doing. And because the president said it, it has an immediate credibility of at least being potentially true as opposed to one outlet through sources talking about something that may or may not be true. I think thats why this is such a big deal. Thats why were going to keep chasing it it so hard. If the president had never admitted to this, it would be much less of a serious matter and i think that at some point it would be dropped. Now its hanging out there. Its something that members of congress will want to know about. Sean spicer is going to continue to get asked about this and they may make a decision not to say anything further, but i dont think its going to call the dogs off. I want to talk now about what the top of the briefing was. I want to bring in the former executive director at the Cyber Security center. He said, quote, the worm is in the wild. He also said that some folks, as we understand it, who have paid havent had the their data recovered and also tried to dispel any anybody this was something that was developed by the nsa. What stood out to you about that . The first thing is the only thing they can confirm whether something was. Developed by the nsa and they are not likely to do that. And also theres different ways to interpret that fact because it could have been discovered by a Third Party Security researcher who sold it to the n sark nsa. Thats part of the trade is intelligence agencies around the world hire security researchers and hackers to come up with what we call both vulnerabilities they discover and exploit. Thats a possible explanation for that. In terms of being out in the wild, it is out in the wild. Its a huge problem. Here in japan, they watched the entire flight. It lasted 30 minutes. The United States believes this missile reached an altitude of more than 2100 kilometers, thats more than 1300 miles. It traveled an additional 700 kilometers or 500 Miles Landing in the waters off the coast of russia, just 60 miles or so from the Russian Pacific fleet. This is significant because it shows that north koreas missile capabilities continue to increase. The think tank says this may be the best performance of a north Korean Missile that has ever been seen. So now the question, how will russia respond. Vladimir putin condemning the missile, but also warning and this remark believed to be aimed at the United States, warning against intimidating pyongyang. They held a ewe that the joint military exercises were partially to blame for the escalating tensions. Its one of the reasons china has resisted imposing crippling sanctions on the north korean regime, which it has long support ed as a strategic buffe between china and u. S. Allied south korea. But the timing of this launch is significant and humiliating because it happened just hours before a major Global Economic forum that he is hosting in the chinese capital. The Trump Administration is reiterating its calls for more and heavier sanctions against pyongyang over the last decade or so sanctions have done little to stop north korea from conducting dozens of missile launches and five tests, a hafr that officials told me last month will continue no matter what the rest of the world does. This was certainly something new we hadnt seen before. So that sense it was a surprise. If you look at the range that this system would have if it was flown on a normal trajectory, it would get something between 4500, 4600 kilometers. The only real target that that brings into range is the u. S. Forces in guam. That doesnt concern me all that much because the accuracy is so low that im not sure it could really target that very effectively. But what it does is it tells the United States that as we have seen in the past, north korea is continuing to develop the nuclear program, despite sanction asks having Trouble Getting International technology. I think were learning here that if somethingen doesnt change, if theres not a way to freeze its program, its on its way to. Developing a longrange missile. Youre seeing this as a data point in the general development of the nuclear program. When you hear the threats then, it sounds like from north korea and the really what north korea is say iing you see that is hyperbole about how far this missile could go. Its worth keeping in mind that north korea has been able to hold south korea, u. S. Forces in south creer at risk and also forces in japan. So its certainly had a way to threaten both neighbors and the United States. On top of that, it seems to e me that the main significant of this is really seeing a step forward toward something longer. But this missile is still only about half the way to the u. S. West coast. I think the argument that it could carry heavy war haed is probably not true. Thats probably bluster. So the jury is out on this. I really think the lesson of this is that the United States needs to find a way to sit down and try to cap this program and figure a way out of this. Thats actually what i wanted to ask you about next. The Trump Administration is trying to figure out how to deal with north korea. Sitting down and having a discussion about this and capping this, as you said. In your expertise having watched many leaders try this, what do you think is the best approach . Well, i think the first thing that should happen is the United States should call for talks about talks. Informal talks, itten doesnt have to be sitting down for formal negotiations to figure out where both sides are and what they are willing to talk about. I think that needs to be done without preconditions. One of the problems in the past is that u. S. Leaders have said we want to sit down and talk about denuclear larization. The response to that has been well maybe thats the outcome, but that shouldnt be the thing we decide at the beginning. So i think there needs to be an approach that says lets talk about talking and see where we can get. A couple days ago, the north korean official talked about once again that north korea would like to talk to the yieund states. We really need to see if thats true. A little fact check on that. Has he ever stood up and said i said before i wanted the ban all members of the islamic faith from entering the United States of america, i was wrong, i have consulted with lawyers. Im now addressing it simply to security. Has he ever said anything approaching that . Yes, he has said several things approaching that. I think its detailed in various briefs the best one is probably the Southeastern Legal Foundation brief and shows that over time the president clarified that what he was talking about where Islamic Terrorist Groups in countries that shelter or sponsor them and over time he and his advisers clarify that what he was focused on with groups like isis and al qaeda. You asked mr. Wall has the president ever disavowed all of these statements. He just cited on the briefs because the truth is theres no such statement. Starting in 2015 when he called for a shutdown of muslims entering the United States, then a few months later, i think islam hates us. We cant allow people coming into this country. You had a seattle federal judge originally rule against the administrations first travel ban that was followed up by the court of appeals. While the white house made some tweaks, they issued the second travel ban and low and behold, once again, were in front of then ninth Circuit Court of appeals. And its clear that what the candidate said on the campaign trail then candidate donald trump could be of considerable importance to these three judges that you just heard that exchange there with the judge wondering whether or not trump has disavowed some of his past campaign statements. What youre hearing the solicitor general say is what he said on the campaign trail doesnt matter so much. Its his actions now and his words now. They are trying to make the argument that the president has clarified his positions. That hes trying to ban people from certain terrorist groups in the countries that harbor those terrorists from coming into the country. But the state of hawaii, which brought the case forward is saying that any objective observer can can say this is a travel ban against muslims. We have never seen anything like this in it the country and the president s words what he said on the campaign trail should be very important that context matters. Thank you so much for that. You wrote back in february about the use of campaign statements and you said that basically this isnt fair. This is not just an issue of whether its fair, but its not something that can be used in court to make it th case. Why is that . Its unprecedented to look at the private statements of a politician before he even took office to interpret otherwise perfectly valid measures. The court is not saying that theres anything wrong with the travel ban. Essentially what they are saying is theres something wrong in their opinion of donald trump. They are disqualifying from taking the immigration policy. The solicitor general said, yes, this was something he said. He talked about the shutdown of muslims entering the u. S. But he said that statement, that opinion was qualified over time. So then why not go with the statements that were qualified over time . I think the difficulty for the president is that he has not clarified. Hes doubled down on his original statements. He has time and time again reaffirmed and ratified that we know what he means on the very day of the signing within a week of him being elected to office, he specifically said im not changing my mind. Im not going in a different direction. You know what i mean. In fact, we do. Federal courts did realize he was simply reaffirming and delivering on his k578 Campaign Promise to engage in an absolute shutdown of muslims entering the country. Its not even large ly a shut down of muzs entering the country. The president has the authority to control tr foreign countries. As it happens, they have muslim majorities. The court is suggesting because of the understanding of trumps believes, hes not allowed to control immigration from a quarter of the worlds countries. Next are they going to say hes not allowed to conduct military operations in muslim majority countries. All of the military operations that the u. S. Is conducting are in muslim majority countries. So this threatens not just to disqualify them in terms of immigration policy, but to cripple the president s. E we learned something last week in testimony on capitol hill about some of the folks in the u. S. Who have been detained for terrorist activities and i think some people were surprised to learn that a lot of them actually hailed from iraq. I believe if im quoting this testimony correctly which has been dropped from this ban since the last time this was challenged. So if youre trying to look at this just in the efficacy of the ban, in keeping people who may be coming from companies that could foster terrorism, how does this make the case and not convince the judges to look instead at the statement of the total and complete shutdown of muslims in the u. S. . Of course, iraq was dropped from the list to satisfy an earlier ruling in the court. So the attempt to dro draw. Up in iraq. To that, i want to add for our viewers it was dropped because theres a lot of information known about folks coming from iraq. Then we saw this testimony. So youre saying thats just sort of ridiculous to look at that change. And at the same time, in order to be valid, it doesnt have to capture every terrorist or respond to every security threat. Theres broad discretion that immigration matters. So long as theres plausible danger, which would be hard to say the president is justified in using the discretion which they have given them in the matters. The problem with the position is that youen dont have to ban all muslims from the kocountrie. If you say were going to ban some muslims, or mostly muslims or people because of the faith and god to whom they pray, that by itself, if thats the primary purpose violates the constitution. This would be a harder case if this defended national security. If this was not a very thinly vailed pretext. Millions of people here in america are adherence of this state and billions of people around the world. That makes it deeply troubling and deeply a violation. Theres a clause that prioritizes religious mierts through. Some people pointed at that and said thats clearly making protections for crist hristians husband lim muslims. Hes tried to lawyer his way around. We have found and should be thankful they dont fall for this. They are able the true purpose based on the words that came out of the president s mouth, he seems clear his purpose was to for religion. Thats contrary to everything our country stands for. What the judges are doing here is not reviewing the executive order. They are reviewing donald trump. And they are saying this is fine. Any other president adopted it shs theres no problem. But we believe donald trump has nasty views. Were going to disqualify him tr performing the constitutional functions of the. And these countries have a lot in common other than being muslim. These are countries that were president obamas list of unstable countries with poorly functioning governments. These are countries the u. S. Is conduct iing or has recently conducted military operations. So ta they are picked because they are muslim countries, this is disingenuous. As it happens that president obamas list where the country has forces in combat operations happened to be muslim countries. No one can suggest because they are muslim. This wasnt boys being boys. This was criminal activity. What has been the response to you guys from penn state officials . What have they said to you . I have had dialogue with the president of the college. But penn state has been fairly silent. No one came to the wake or the funeral. No one . No one. They are not always the best sources though, like a Time Magazine cover supposedly from the 1970s warning of a coming ice age, and another Time Magazine from 2008 talks about surviving global warming. But knowing hes so motivated by, that you now have top aide who slip things on to his desk like in the case of the tax reform or in the case of the Time Magazine covers. It was k. T. Mcfarland, his Deputy National security adviser who put the Time Magazine covers. Astounding that someone at his level is putting Something Like that in front of him when its completely false. Normally you would have a process in place in a white house that before something gets to the president you imagine their most valuable resource is their time. You dont want to give them things unless they absolutely need to see it, but thats not how donald trump works. An open oval office policy, people coming in and out, phone calls with friends.
