And director mulvaney said yesterday regarding the president s tweet about calling for a shutdown in september, he said the president sent that tweet is he was frustrated by democrats spiking the football and thereby poisoning the well for future negotiations. He wants to win for all american and thats why hes fought so hard for this. Democrats obstruct routine things that they are for, do everything that they can to obstruct. Hes talked about how archaic it is in the senate because hes out there working to try to get health care or tax reform or cabinet through the senate. There are various things that the president is trying to do that are issues when hes having conversations with members of the senate or the house who will say im with you, great idea. I cant vote with you. Hes understandably frustrated and promises and goals that he set out with the American People to make the country better and to deal with multiple players of obstructionism. What will change between now and september to give you confidence that well get funding for the border wall then . I think theres multiple things. When you come in, this cr, there was a lot that was already carried over from last time because its not just a conditioning resolution. There are multiple bills part of the package that already have increases or underlying policy in them from the Previous Fiscal Year from the Previous Congress from the previous administration. A lot of the questions around health care. So phil mattingly, i want to begin with you and then well listen to other voices because the crux of this is, with americans with preexisting conditions, can the bhowhite ho, would those folks be covered . And when you look at the numbers of uninsured folks with preexisting conditions and its predicated upon whether or not a state would opt out, would everyone be covered or not . Reporter its impossible to know. Why would you want to move forward on a policy when you dont know the particular ramifications of it. And it would give people the opportunity to opt out and the requirement that the coverage, the cost of that coverage cant be shifted on an individual basis. So the prices couldnt be raised because they have a specific issue. A specific preexisting condition. So a state could opt out of that obamacare regulation. Now, the concern is that if a state opts out and you lose your coverage if you have preexisting coverage, your prices are going to skyrocket. Theres no guarantee that you have to be offered coverage that youd be able to afford it. Now, in this bill, theres a provision that if you already have preexisting coverage for a preexisting condition, you will be grandfathered in. Theres a protection right there. Your plan will be carried over into the next iteration into health care, trumpcare, whatever you want to call it. Those with preexisting coverage, a large percentage turn off and on plans. If you get off of your plan or if you move to another state, you lose that grandfathered status and, therefore, lose the ability to have your premiums stay at that lower level that it would have been based on a Community Rating system. Now, what the amendment would do is spend 8 billion to address the small population to help drive those premiums down. The big question here is nobody, whether its critics of the law or Health Professionals believes that 8 billion will be enough to actually address this. Thats what im asking. Its worth unpacking specifically what this is doing and why its their defense and the crux of the attacks that they are going to be facing and have been facing up to this point and why they are having a difficult time defending it if they cant commit to 8 billion being enough to adequately fund this portion and sean spicer said it was impossible to know, you cant make the claim that your preexisting coverage is equivalent to what individuals currently have. And i think thats the problem that im hearing from a lot of very skeptical members. Thats what lawmakers up here and i think the white house as well is trying to push back against trying to give people comfort that that money will address it in a manner with in combination with the highrisk pool money that they will be adequately addressed. If i may move past health care and id like to ask you about the moment where all of a sudden the slides appeared behind sean spicer of fences or border states or what have you and im also thinking about the Mick Mulvaney moment yesterday and democrats are essentially saying to this administration, what are you talking about . Were passing the spending bill with zero money for your border wall. So what are they trying to do . The president did not get money for a new border wall for his fiscal 2017 budget that funds the government through september. They will have another budget fight in the fall. But they are trying to say, look, were not getting a new wall across the u. S. Mexico border but in these places where there is broken fencing, they can replace that broken fencing with these 20foot tall structures which, by the way, thats been available through the department of Homeland Security budget during the Obama Administration going all the way back to the Bush Administration the traigs is tapping into that. But this is a question because there was a signature domestic proposal that you heard from donald trump back out on the campaign trail and by the way, theres no discussion anymore that is happening that we can detect about how they will force mexico to pay for this wall. Its going to be a wall, if ever passed by the congress and signed by the president , that u. S. Taxpayer also have to pay for unless somewhere down the road this white house can figure out a way to extract that money from the mexican government. But in the meantime, until they get a budget that theyll have to fight for in the coming months or years, they are going to have to be satisfied with replacing existing fencing with that stronger, tall steel fencing that you saw in the Briefing Room, brooke . Those supportive of him are willing to give him more time to get these things done but you have a lot of republicans who say, yes, we want Border Security but we dont want to be focused on this the whole time. The question about the budget, too, next september youre going to have fights all over again and when asked in the Briefing Room what kind of dynamics are going to be different then than now. And so i think those questions and, of course, will be almost a year after the election at that point, those questions will be more difficult to answer. Yeah, i think so. And in seans reply about this, he relished getting into this. This is a fight that the white house would quite like in many ways. And he wants to exert his personality on washington, very much a learning experience for him. Lots of centers of power. He seemed to be looking for an enemy or a political foil that he had during the republican primary race, for example. Or during the race against Hillary Clinton. So i think the fact that Hillary Clinton came out and was so vocal yesterday, talking about the election, its something that the white house would like to engage. Its ironic that it was kind of sad that people were talking about how donald trump had won the election. Well, only one person talking about that is donald trump. Rarely a day goes by without him reminding us about his triumphs in wisconsin or michigan or pennsylvania. And hes still sticking to that position that Hillary Clinton won the popular vote because of illegal voting for which theres no evidence. So i think, you know, if were going to have a conversation about the election, the 2016 election is an election that is never going to end. Well, theyre both still talking about it. Lets play a little bit of that sound, since were talking about this, sean spicer from the briefing. The president has confidence in the director. But i think clearly his point was after some of the comments made yesterday regarding the reason for the outcome of the election, we want to make it clear what exactly happened. So with all due respect to her, thats not how it works. You dont get to pick the day the election is on. Its set by the constitution. The president won 306 electoral votes and i think theres been plenty of analysis on the election and where people chose to spend their time and their resources and their messaging. And i think its somewhat sad that were still debating why the president won in the fashion that he did. I mean, stephen, i was just in washington last friday sitting next to jeff mason who brought his souvenir from his trump interview when they were talking about china. He pulls out this map showing all of the red that went for him in november of last year. But needless to say, you think that all this talk of Hillary Clinton and being the foe that the president wants is to his benefit . Thats for sure. You have to, also, question whether democrats want to get involved in this. They are trying to look ahead to sort of vet themselves to address the questions that Donald Trumps election brought up the fact that he actually captured a lot of democratic territory in the industrial midwest that he had a better economic than the democrats. We talk about the democrats and their way forward but the most prominent democrats in the Public Discourse now, a barack obama and Hillary Clinton and bernie sanders. So i think perhaps refighting this issue and im sure it will come up in the fall when Hillary Clinton has a book coming out which will talk about the election, she said yesterday she would ask for absolution. After an exhaustive almost yearlong investigation, all of the prosecutors and agents involved in this case have come to the conclusion that insufficient evidence exists to charge either officer with a federal crime in connection with this incident. Back last july, two white Police Officers shot sterling, an africanamerican man, outside of a Convenience Store and a bystanders video showed them pinning him to the ground before ultimately shooting him. Well show this to you, but just to warn you, it is graphic. [ bleep ]. [ bleep ]. [ bleep ]. Get on the ground that video led to widespread criticism and protests. Cnns nick valencia is in baton rouge for us this afternoon and, nick, we know that mr. Sterlings family and their attorneys have been finally briefed today. You talked to them a while ago. What did they say . Reporter they said they were not defeated, brooke, and had an optimistic tone. They feel as though theres a compelling enough case, now that this investigation goes into the hands of the state attorney general, that they will find justice, at least in their eyes, at the state level. I spoke to chris steward and Justin Bamberg and a state representative and they talked to me about their reaction immediately following this department of juts citistice announcement. The most important thing is it shows the mindset of the officer. The doj said when he walked up after interacting with mr. Sterling, he said, ill kill you, bitch. So, of course, that shows you what type of escalation that this officer was already setting. He did that flying tackle. So we feel very good that this case is going to be turned over to the attorney general. The deprivation of rights, i think the government here in the state of louisiana is going to have a package that they can work with. Quite frankly, you know, one of the big takeaways and the thing that we were looking at, salamoney needs to be gone from the force. His actions that day, if the supervisors and people in the department knew about that, maybe they need to go as well. There is some frustration among the Sterling Family as well as to how they found out. They found out much like everyone else did, tthe Washington Post report citing unnamed sources. They were told by the department of justice that they would reach out to them specifically and theyd be the first to know. Thats not how it happened. Many in this community are not surprised. Theyve been waiting for this news for the last 24 hours. We dont believe there are any planned demonstrations but there are rising tensions. In listening to a conversation earlier, one activist said he was ready to go to war and another saying they need to be more strategic. The focus is on healing for the Sterling Family and hope that they will get justice at the state level. Brooke . Message from the family, we will not be defeated. Nick valencia, thank you. Once the news began to spread, the Sterling Family and local leaders remained, as nick pointed out, really in the dark. They heard the rumors but had not been directly contacted by the office. The family cried. It had, quote, waited all this time for nothing. But just moments ago, their reaction after finally hearing from Justice Department officials. I want to Say Something i heard yesterday. I was at work and when i got back to my car, i saw my phone blowing up. I couldnt believe what i heard on the phone. I panicked. So yesterday to me was the first day that it happened. I went back to july 5th at 1 30 in the morning. I suffered all day yesterday. I suffered. And what i heard today, the suffering still continues. So now its not a civil matter anymore. Its a human matter. His voice still will be heard through us. So stay behind us because we love alton and we dont want this to end. Remember his name. I just want to tell everybody, thank you for supporting me and my family. Thank you for supporting my father who is no longer here with us but spiritually he is still here. No matter if we get justice or not, we have to depend on god because, guess what, god is an just god and hell always be there for us no matter what. He may not be there when we ask for him but exactly when we need him. I want to let everybody know, no matter what goes on behind those closed doors in that court, it doesnt matter. Still have to depend on god because i depend on god every day. God wakes me up every day. He puts me to sleep every day. I think of my daddy every night i go to sleep. God is there for me. My mama, my family, they are there for me. The family wants a state criminal investigation. They also want the officers involved to be fired. One of the lawyers said the state attorney general has phenomenal case. With me now, Charles Coleman jr. , civil rights attorney and former prosecutor. James gigliano and areva martin. Would it be appropriate for the state to open up an investigation and potentially file charges there . How likely would that be . Absolutely appropriate and very likely that that will occur. We have to keep in mind, theres a federal standard where the feds are only looking at whether there was a willful taking of mr. Sterlings life, where his civil rights were violated. Thats not what the state attorney general will be looking at. He can look at reckless conduct, at whether these officers escalated a situation that could have been deescalated and he can look at the statement that were hearing, one officer walked up to mr. Sterling and said, bitch, i will kill you. That evidence can be taken into consideration by the states attorney general. When you look at the totality of what the feds found, there will be state charges filed against at least one of these officers based on the press Conference Held by the familys attorneys. What about, james, the way in which the doj handled this . As nick had pointed out, the Washington Post report, i cannot imagine being the family and hearing about this through a piece in the newspaper. What do you make of how the doj handled it . It is unfortunate. Theres no way to remove the human component of this. Anybody who watches the video of the family in front of a microphone explaining how they feel about this you ache for them. You do. But you also have to understand that the Police Officers involved in this and i dont know them personally, but they are also entitled to due process. Police unions are collectively bargaining units. Those officers have a right until formal charges are brought, which is interesting in this case, normally its the state taking a look at something. A grand jury being convened and deciding not to move forward. And the defense to step in . Absolutely. The feds and as your other contributor just pointed out, the feds have a much higher bar to reach that standard. You have to prove what that person, that cop is thinking during that struggle. Brooke, that raises an interesting point overall when you Start Talking about this administration eight department of justice and how they are going to approach these cases. Typically, as james has already said, weve seen grand juries decide whether they are going to indict these officers for these offenses. This case begun under the administration of president obama and the feds have stepped in and they have begun looking at this. How within the past week, we three see civil rights cases with respect to police and their conduct involving black lives, whether thats Michael Flagler or altonsterli sterling. Weve had an issue in terms of looking at how was this department of justice going to deal with these cases with respect to Law Enforcement and excessive use of force. So how do you feel about it moving forward . Because youve used those names but also have names like tamir rice and eric garner. Let me just quote sessions saying, the doj will hold accountable any Law Enforcement officer who violates rights of our citizens by using excessive force. But the bar wont sessions has said a lot of things. Its important to point out his side. Absolutely. Hes said a lot of things. At the end of the day, actions speak louder than words. This administration has been very pro life enforcement from the beginning. Communities of color have been having an uphill battle with respect to getting justice and indictments or even having due process take its form with respect to Law Enforcement and how they interact with communities of color. With respect to the verbiage and rhetoric that weve heard, not just from Jeff Sessions but their position on Police Brutality and civil rights cases involving Law Enforcement, it doesnt look good. What about the Police Officers, areva . The family wants them fired. What is the likelihood of that . Well, brooke, again, based on what the family attorneys shared, they want the state investigation to go forward and not be i mpeded by comments tha were made and the prosecutor was also restrained in his remarks because they dont want the investigation in any way to be undermined. But from what i heard, listening to that press conference, there appeared to be pretty compelling evidence presented by the federal prosecutors to the families. Apparently there are six videotapes and it shows a 71second incident. From start to finish when the cops first approached mr. Sterling until he shot 71 seconds had elapsed and the attorneys say those 71 seconds will show enough evidence for the states attorney to file charges against at least one of those officers who they say conduct was heinous. Okay. Its important to remember these are two different sets of charges that were going to be talking about with respect to the federal investigation and what hopefully will take place at the state level. I got it. Quickly . Brooke, if i can just say, i understand that the attorney general is a political appointee, if anybody is saying that the career prosecutors who make determinations whether or not youre going to go forward with charges or not are politically affected, i would strongly throw a flag on that one. Okay. James and charles and areva, thank you all so much. Meantime, up next, the director of the fbi, james comey, says hes, quote, mildly nauseous at the idea that he may have influenced the 2016 election but still stands by his decision in the investigation into Hillary Clintons emails. The fbi director testifying today saying it makes him, quote, mildly nauseous to know his investigation into Hillary Clintons email server 11 days before the president ial election may have impacted its outcome but also said he would do it all again. Look, this is terrible. It makes me mildly nauseous to think we may have had an impact on the leelection. But honestly, it wouldnt have changed the decision. Everybody who disagrees with me has to come back to october 28th and tell me what you would do, would you speak or would you conceal . And i could be wrong, but we honestly made a decision between those two choices that even in hindsight and this has been one of the most painful experiences i would make the same decision. I would not conceal that on october 28th from the congress. One of my junior lawyers said, should you consider what youre about to do may help elect donald trump as president . And i said, thank you for raising that. Not for a moment because down that lies the death of the institution. I cant consider for a second whose political fortunes is affected in what way. I have to decide whats the right thing to do and then do that thing. We have with us brian fallon, a former press secretary for Hillary Clintons 2016 president ial campaign. Page pate and manu raju. Great to have all of you with me. Brian fallon, beginning with you, we just heard from Hillary Clinton herself yesterday essentially saying it was because of mr. Comeys actions that it cost her and at least a third of the reason why she thinks it cost her the election. When you listen to that today, what was running through your head . I actually thought jim comey had a rough go of it today. You dont often see him break a sweat. Hes a pro. Very polished. You saw him get rather animated in the clip that you just played and i think the senators asked fair but tough questions and i think he failed to enter one fundamental issue which is the double standard of the fact that he publicly acknowledged an investigation of Hillary Clinton at a very early stage and basically campaigned for close to a year under a cloud of an Ongoing Investigation and didnt make the same acknowledgement at all with respect to the investigation that we now know the fbi is still actively conducting with respect to donald trump and allegations of collusions with russia. So even just put aside the letter he wrote on october 28th, put aside from that infamous july press conference, just going back way early in late 2015, he publicly acknowledged the investigation into Hillary Clinton. Never did that with donald trump. He didnt have a good answer for why today at that hearing. It seems like part of the reason may be the timing. Manu, i want to bring you in on what brians question is. Why with the Hillary Clinton investigation, why not with then candidate or nominee trump and part of it and you followed up with Dianne Feinstein on the fears of concealment. Talk to me about that. Thats right. This was the concern that the senators had raised, why did james comey as the fbi director reveal these emails without going and getting a warrant first, getting looking at the emails and disclosing it later. Comeys argument is that this was much earlier in the the trump investigation was not nearly as advanced as the clinton investigation. The clinton investigation had been essentially closed in july and he had an obligation to reveal this publicly in october when he learned about these additional emails. I think it was very interesting, also, brooke, to learn exactly how he learned about the additional emails, that it was from huma abedin who had forwarded emails to Anthony Weiner that included classified information on that and she simply was just asking weiner to print it out to provide it to Hillary Clinton. A really remarkable chain of events that led to this decision to reveal this. And also, bill clintons decision to actually meet with Loretta Lynch on that tarmac. Right. That led comey to believe that he had to publicly reveal some of these things to show that theres transparency in the process. Some democrats did not buy that argument but that was the first time weve heard of comey shedding some light into his thinking along this investigation. Brooke . On the issue of concealment, we have sound from his testimony and then your conversation with the congresswoman mafterwards. When the Anthony Weiner landed on me on october 27th and there was a huge people forget new step to be taken, we may be finding the golden missing emails that would change this case. If i were not to speak about that, it would be a disastrous, catastrophic concealment. It was incredibly painful choice but not all that hard between very bad and catastrophic. I had to Tell Congress that we were taking these additional steps. I prayed to find a third door. I couldnt find it. Two actions, speak or conceal. And i dont think many reasonable people would do it differently what i did. If you were standing there staring at that on act 28th, would you really conceal that . So i spoke. I dont quite understand why he didnt get the search warrant before and quietly and see if those emails were there, anything there. But he did not. That became clear. That, to me, is a major point. Why would you do this 11 days before without getting the search warrant quietly and taking a look. Reporter because he didnt want to conceal potentially damaging information. How would he be concealing it . If it were damaging information there, he would announce that he was going to investigate. But he didnt announce. And there was no damaging information. So it was an important question from the senator and, page, what is protocol . You have these two Ongoing Investigations, both with regard to trump and associates and russia and then with Hillary Clinton and her private server. Whats protocol, the fact that he could divulge one and not the other . Protocol in a normal case would argue against the fbi disclosing any evidence. You can acknowledge that theres an Ongoing Investigation but certainly not disclose anything about that investigation. But this was not an ordinary case. That remarkable event, that made this case unusual from the very beginning. James comey was left with the ultimate authority, basically, to determine whether Hillary Clinton was going to be charged or not. It was also up to him to determine how to respond to all of the Public Information that was out there about that investigation. And i dont think there was a double standard here. He confirmed the clinton investigation at the beginning and then did not say another thing about it until he publicly announced that the investigation was closed. And as you heard him say during his testimony, he then had this mess basically dumped on his table with these new emails. I disagree with the senators argument about the timing. Its very different to disclose incriminating information versus the fact that theres an Ongoing Investigation. So before he sought the search warrant, he felt compelled to correct the record and said this investigation is no longer closed because i have new information that i need to look at. He had no way of knowing at that point whether that Additional Investigation would have taken a day, a week, a month or lasted into next year. And he said he was concerned about the credibility of some of the Senior Leaders within the doj and thats why he went to those cameras that manu referenced, because he was worried that he couldnt credibly complete the investigation. Earlier the president met with two congressmen who planned to vote no. Congressman billy long and fred upton are now voting yes. That is apparently because of an amendment to the health plan that would provide another 8 billion to fund highrisk pools and help those with preexisting conditions. Moments ago the white house said it is, quote, impossible to estimate whether that amount is going to be enough. If someone has continuous coverage, thats never going to be an issue, regardless of no circumstance anyone with continuous coverage with have a problem with preexisting conditions. If someone choes nse not to hav coverage for 63 days or more and were in a state that opted out and put in a highrisk pool then weve allocated an additional 8 billion over five years to help drive down the costs. For somebody to know what that number of people, is how many states will ask for and receive a waiver is literally impossible at this point. With me now cnn politics reporter m. J. Lee on the hill, and so on top of the question of whether or not 8 billion is even enough, we know the white house is also insisting anyone with preexisting conditions be covered. For a lot of other members that weve spoken to, particularly the moderate members who are in the tuesday group, they are still saying that that is not enough to change their votes, and, brook, i can tell you obviously the white house would like nothing more than to be able to have a vote on this bill tomorrow, friday or even saturday, but as of right now there has been no scheduling changes, and what that means is that leadership still not have the 216 votes. Just to share some fun color from capitol hill, obviously a very frenzied day. What that means for some members is they are preparing for maybe, and im stressing the word maybe, the possibility of having to stay a little bit longer in washington, d. C. , maybe past friday, even saturday, and for one member of congress, congressman phil rowe, he has a wedding to get to on saturday and its his own wedding, so a lot of uncertainty right now about what is going to happen to the schedule.
