Candidate trying to discredit the elections and the election process before votes have even taken place. Its unprecedented. It happens to be based on no fact facts every expert, regardless of Political Party regardless of ideology, conservative or liberal who has ever examined these issues in a serious way will tell you that instances of significant voter fraud are not to be found. That, keep in mind, elections are run by state and local officials which means that there are places like florida, for example, where you have a republican governor whos a republican whose republican appointees will be monitoring these election sites. The notion that somehow if mr. Trump loses florida its because of those people that you have to watch out for. That is both irresponsible and, by the way, doesnt really show the kind of leadership and toughness that you want out of a president. You start whining before the games even over . If wherever things are going badly for you and you lose you start blaming somebody else . You dont have what it takes to be in this job because there are a lot of times when things dont go our way or my way. There is no serious person out there who would suggest somehow that you could even you could even rig americas elections. In part because theyre so decentralized and the numbers of votes involved. Theres no evidence that that has happened in the past or that there are instances in which that will happen this time and so id advise mr. Trump to stop whining and go make his case to get votes. And if he got the most votes, then it would be my expectation of Hillary Clinton to offer a gracious concession speech and pledge to work with him in order to make sure that the American People benefit from an effective government and it would be my job to welcome mr. Trump regardless of what hes said about me or my differences with him on my opinions and escort him over to the capital in which there would be a peaceful transfer of power. Lets talk more about the president s comments with my colleague Phil Mattingly who was there with a bunch of palm trees, looks like, in las vegas, the site of the final president ial debate, Phil Mattingly, nice to see you. Also notable in this joint News Conference requewith the Prime Minister of italy, the president of the United States said, listen, trump doesnt surprise me anymore, its the republican officials who are haranguing the president at his attempts at diplomatic conversation with russia and now look at trump and their endorsements of trump. Yeah, brook, this is the ideal nevada backdrop i have here. This is the most important point of what we saw from president obama today, you saw him talking about the elections and why the attacks donald trump has made on the system as a whole are dangerous to the entirety of the american democracy but theres a shift in the president s how hes talking about donald trump and the republican party. If youve paid attention over the last couple months and brooke, i know you have Hillary Clinton has tried hard to dissociate donald trump with the broader republican party. Over the last couple days and once again today president obama has done the exact opposite, hes tried to question Republican Leaders for maintaining their endorsements and not attacking Donald Trumps assertions when it comes to the election and russia. Thats a shift that underscores confidence in where the Democratic Party is going but its setting the table and tone for what happens next. Basically, that is this, anybody who endorsed, supported or did not criticize donald trump is going to have to live with that and perhaps pay far in the months ahead if Hillary Clinton is elected president , brooke. The president was also asked about whats been in the news recently. And this is cue the Hillary Clinton headaches which shell answer to which is back and forth between the state department where she was the boss and the fbi and its reported pressure coming from state to fbi to declassify or not this particular email. What was said today. Well, what you have is Donald Trumps campaign and donald trump personally seizing on this issue believing what they have is explicit evidence of a quid pro quo. This is the fbis notes from the investigation into Hillary Clintons email server and what it says is a state department official, a Top State Department official under Hillary Clinton, patrick kennedy, was basically asking the fbi to step down the classification of a specific email. And over the course of that process, an fbi official appeared to request a personnel advancement or increase in personnel at a foreign outpost, that looked like a quid pro quo. One of the officials described it as such. The fbi has denied this, the state department denied this. This is what president obama had to say. I think youve heard directly from both the fbi and the state department that the notion or the accounts that have been put out there are just not true. So, brooke, president obama echoing the fbi and state department, the Trump Campaign has seized on this issue, republicans on capitol hill have as well, this is not going anywhere, expect to hear about it wednesday night at the debate. Brooke . See you in vegas in a couple hours, Phil Mattingly, thank you. Donald trump still doubling down on his claimants that this election is rigged, that theres widespread voter fraud, even blasting Republican Leaders who are denying his allegations so we had cnn and our factchecking team take a look look at these allegations. Our Senior Investigative correspondent joins me now. The president today said this is unprecedented, based on no facts, what did you find. We took a reality check and we found actual cases of voter fraud occurring but they are extremely rare. They have is not been proven to be part of any vast conspiracy or attempt to regular elections and several republican officials i talked to from florida to philadelphia to out west believe this attempt to smear an elections validity is wrong and without factual basis. So heres what we did. We asked the Trump Campaign what evidence they have that the elections are rigged. They sent us an email listing out several studies they say prove their point. They actually dont. The trump camp cherrypicked information to conclude the entire election system is rigged. Its simply not, brooke. Researchers at Old Dominion University believe they found noncitizens voting in large enough numbers that the results could have decided the election in close races. That study is now being challenged because it was an online poll with a small sample size. The author does tell us he stands by his study and believes in a very, very close race, a local race decided by a few dozen votes or even a few votes noncitizens could, he says, sway a race. Its never happened. He has no evidence of it. Study two, pew research which showed problems with Voter Registration lists basically being outdated with dead people still listed as eligible to vote. But the study does not mention a single example of an actual vote fraud. None of those dead people voted. Study three is about voter fraud in philadelphia. It was done by a Philadelphia City commissioner and cites a handful of examples of fraud in philadelphia. But any conclusion that proves the system is rigged is completely false, according to the author, who is a republican. In the last two years, he tells me, eight people in philadelphia have been convicted of voter fraud. Eight people. Nothing that would swing an election. So you just touched on one of the allegations that dead people are voting, thats coming from Rudy Giuliani who says dead people are voting, theyre voting for democrats, not republicans, is that true . Again, were asking the Trump Campaign for specifics. They pointed us to a report of dead people voting in colorado. A Television News station uncovered a report that dead people in colorado have been voting in several elections over the past few years. How many . Six to seven. Six to seven. Total. The secretary of States Office says the minute they found out about it they began rescrubbing the system to try to eliminate even that possible avenue of fraud but this is six or seven people in all of colorado according to the secretary of States Office. Among these six or seven people involved, they were mailin ballots, basically sent to ho s homes, traditionally sent to homes that vote republican so the second part of the allegation was dead people, mostly dead democrats vote, we couldnt find any evidence of that as well. Thank you for checking. Facts are important. We talk about this election, drew griffin, thank you. Trumps rigged election claims also dogging some republicans in this reelection fight. Republican senators and three critical battleground states, florida, ohio, and pennsylvania had faceoffs with their challengers and in another sign of what an extraordinary Election Year this has been, all of the republican candidates had to step away from or flat out go against what their Party Nominee has been saying. I made an extraordinary decision not to support my own partys nominee, but his words were offensive, they were wrong, demeaning and degrading to women and for me that was the final straw, tracy. But i didnt make the decision lightly. I respect voters who take a different position on this, he did win the nomination. Our elections may not always be completely perfect, but they are legitimate. They have integrity and Everyone Needs to respect the outcome, i dont know how this race, my race, the president s race or any other race is going to turn out but we need to respect the outcome because that will be necessary to pull us together on november 9, the day after the election. Then theres this from florida senator marco rubio whos in a reelection battle of his own. He was in a debate monday and he said this this election is not being rigged. We have 67 counties in this state, each of which conduct their own elections. I promise you, there is not a 67county conspiracy to rig this election. Lets dig deeper into everything weve heard between folks running for office and from the president of the United States. I have National Political reporter from the Washington Post ef svie phillips and todd gilman from the dallas morning news. Great to see both of you. Good to see you. Let me get to these down ballot issues in just a moment and begin, todd, with the president. We played the soundbite at the top of the show where hes saying quit your whining, make the case ff your votes. Do you think the president was at all trying to bait trump into any sort of war of words . Absolutely. This is more than just a chris teak of questioning the integrity and the validity of the election. The way the president went about this, stop your whining, is designed to paint trump as a petulant schoolboy bully which jibes with Everything Else that weve seen thats unpleasant and offensive about trump and it goes straight to trumps vulnerability which is that he often takes this bait. It was very loaded and carefully calibrated language. If he takes it, if he runs with it, abby, how could that affect donald trump . His own supporters would love that. Yeah. I think donald trump is going down this road because he knows his supporters want him to. This is the type of argument that has originated on parts of the internet where his supporters are the most active with sort of talk show hosts like alex jones and so on, roger stone as you mentioned earlier so its important to his supporters trump air this and i think the Clinton Campaign and democrats largely, theyre sort of a lilt gleeful about this situation in which president obama can say donald trump is a whiner and a few hours later they can expect a tweet from donald trump addressing what the president had to say and it fits into a narrative that he sort of cant be left alone with his cell phone and might tweet things that are off message or arent about the issues that some of his Campaign Aides would like him to focus on instead. Let me pivot and talk about the debate tomorrow night. I got news in my ear from my executive producer. As were learning who may be brought we remember the last debate and the bill Clinton Accusers that mr. Trump brought in were learning that the Hillary Clinton campaign will be bringing meg whitman, megawhitmamegawhi whitman, republican who said im with her and mark cuban. Todd, thoughts on this move. Mark cuban again . I guess they must feel that the dallas billionaire is getting under trumps skin successfully. Its just reinforcing the idea. Theyre trying to get a little bit of a rise out of trump hes you know, he has shown as abbey said he raises to the bait often, he cant help himself, he hits back, he tweets, he digs in. Im not sure if thats quite as dramatic as bringing some of the bill Clinton Accusers last time but theyre going to do what they can to get in each others heads ahead of this debate. I think clintons main tactic again to just stay out of trumps way. Theres an old saying that you dont get in your enemys way when hes making a mistake on the battlefield. To a large degree that is her tactic now and for the rest of the three weeks. Amazing the drama on the stage then the drama in the seats. Ab abby, let me ask you about paul ryan, donald trump gave an interview and it appears he hinted that he thinks he being trump thinks paul ryan is rooting for him to lose. Heres the sound. Is paul ryan hurting you or helping you . Well, i dont want to be knocking paul ryan. I think he could be more supportive to the republican nominee. Were doing well. I think well win the election. Do you think he want you to win . Maybe not. Maybe he wants to run in four years, maybe he doesnt know how to win. Who can know . On the 2020 notion, abby, do you think trump has a point . Its so funny to hear trump say i dont want to be knocking paul ryan and then proceed to do exactly that thing. I think trump suspects a lot of the republicans who are trying to cover their backs by hedging on support for his candidacy or maybe walking away are doing so for their own political survival. I think paul ryan has more approximate problems than 2020, namely holding on to the house of representatives. Thats what ryan is focused on because he understands his job as speaker of the house could be in jeopardy if this ends up becoming a landslide that wipes out a lot of republicans who gave him that majority. 2020 maybe. Were looking at folks like ted cruz. Looking at 2020 and others but i think paul ryan has bigger fish to fry right now. I just want to see what happens in three weeks. Cant even wrap my head around another four years from now. Abby and todd, thank you both so much. Appreciate it. We are getting breaking news, let me move on to this. You know the story, this People Magazine writer accused donald trump of attacking her on the one Year Anniversary of marriage. In palm beach and maralago. Now people are coming forward. They say the story is indeed true. Jessi Jessica Schneider is working this. People magazine and Natasha Stoynoff fighting back against Melania Trump. We heard last night in the interview, Melania Trump said i remember that Natasha Stoynoff but i dont remember her after she got off the trump beat, after she had this happen to her. So today People Magazine is putting out this report. Theyre citing six people friends, colleagues, even a journalism professor who say, yes, Natasha Stoynoff told us about what happened. Interestingly one of her professors is tweeting about this. He says in 2005 Natasha Stoynoff phoned me distraught, crying, said trump assaulted her, she is telling the truth. Hes written several tweets of this nature. So People Magazine is coming out strong saying our writer has told multiple people about this in the days and weeks and months following this alleged attack and they said theyre not backing down off of the story. Interestingly, at the end of this Natasha Stoynoff says, hey, maybe donald trump doesnt remember this. In fact, pretty bitingly she said maybe hes assaulted so many women he doesnt remember. People magazine putting forth corroborating friends who natasha told her story to say no, this happened and they believe her. Thats what shes saying, theyre backing her up again. Just reminding everyone weve heard from donald trump multiple times saying theyre all lie, its fiction. I believe even talking about natasha specifically, he said look at her and look at her words. Theres that. You also now let me read this statement. This is accompanied from ivanka trump, Donald Trumps daughter, she said this is reacting to the 2005 Billy Bush Donald trump tape said his comments were clearly inappropriate and offensive. My fathers comments were clearly inappropriate and vensive, im glad he acknowledged this fact with an apology to my family and the American People. She goes on. The greatest comfort i have that i know my father. Most of the people who write about him dont, i do she finishfinish ed with, that gives me the ability to shrug off things that i read about him that are wrong. Ivanka trump. Now moving to Hillary Clintons campaign heading into unchartered territory, republican territory. Hillary clinton sending in toptier surrogates as she makes a big play to turn arizona from a deep red to a shade of blue in terms of these surrogates. You have chelsea clinton, bernie sanders, and michelle obama. They will all be in arizona this week. Add those appearances to the 2 million in tv ads the Clinton Campaign just bought up, clinton diverting more resources to downballot democrats meaning this isnt just about shoring up the senate but a realization that a House Majority could be in play. Joining me now, mia parish, president of the Arizona Republic and republic media. Mia, nice to have you on. Thanks for having me, brooke. Before we talk about your reddest of the red states, i want to get to this opinion piece that you wrote where you say you received debt threats, among them quoting youre dead, watch your back and you should be put in front of a firing squad as a traitor. All because your paper for the first time in its 126 year history endorsed a democrat. It has been a month since you came forward and did that. What have these what has that been like for you . Our journalists are used to getting Death Threats. I dont mean theyre common but that that is part of the work when you do things that are controversial and certainly this editorial was controversial but the type of Death Threats and the type of threats against people who are not journalists has been surprising. And the acceleration of the threats we do, calling for people to heckle, to harass, to boo, to threaten and sometimes to assault journalists in the course of their business has been very disturbing to me. So this is what your urinalists are dealing with all the while covering one of the most important elections of our lifetime. Your state, arizona, it has only voted for a democrat for president correct me once in 60 years, it was bill clinton in 96. Can you underscore how important this is that it could go blue . Its very surprising. Obviously we had not endorsed a democrat for president in our entire history, including when bill clinton won arizona. Its a very red state, its a very its a conservative state and that is our readership and tradition. We were founded as the Arizona Republican and that has been part of our history and is part of our present day so the idea that the Clinton Campaign is sending such high level surrogates into arizona is news. It is news and its also news what Donald Trumps been saying about this is a rigged election and especially when you look at these states that really could pave the path for him to the white house, states such as yours, where you have a republican governor, right . Where you have government in charge of securing polling stations. What do you make of mr. Trump saying there is widespread voter fraud and that its rigged. I as someone who recently registered to vote in arizona, its not that easy to register to vote here. It is a its a secure we would report it, there has not been in any way, any case widespread voter fraud that we would be that were aware of. Its tough to register not because somebody is trying to make it hard but because theyre dotting their is and not crossing their ts . They make sure you live a house, they make sure you live in the state and its a very thorough and thoughtful process. So by having just experienced it myself, i dont see and i dont obviously thats been widely reported as not an issue and im not experiencing that. Our reporters, thats something we look at report, investigate and take seriously and thats not something were seeing here at all. Keep doing what youre doing. We could be up late watching arizona november 8. Mia parrish, thank you so much. Thank you so much for your time. Coming up next, the third and final debate, both trump and clinton preparing for tomorrows showdown as new krcontroversies hover both candidates. Well talk strategy, predictions, expectations ahead. And when politics and comedy collide. What amy schumer said during her standup show in florida that prompted some 200 people to up and walk out. The comedienne is now responding. Im talking 90 minutes, commercialfree discussion is one word you could use on why Hillary Clinton and donald trump think they deserve your vote to become president of the United States. Swirling here, this new controversy surrounding clintons emails and accusations against donald trump. So todd graham, back with us, debate director at Southern Illinois university carbondale, he has coached five National Championship teams so, todd, the question predebate, when they say hellos and do the walkout, will they shake hands . My running bet is no. My running bet is theyll do it like they did the last debate. Theyll keep their distance and shake hands at the end. End of the debate is the more traditional, at least for the debates i coach so not at the beginning but yes at the end. Is it so wrong that all i do is think of snl and they did this and that . That was hysterical. It was a good bit. What about its different, were away from the town hall, back to the podiums and sprit p split screen, perhaps more of the back and forth. How do you think donald trump will be . You want him to be, what . Less fighter and more substantive . I do. I want him to fix what ails him and right now he has too much hyperbole and falsehoods in debates so when everything is the greatest disaster in the history of free trade or the biggest trojan horse of all time, combine that with the falsehoods once he gets fact checked whos doing the Fact Checking . Chris wallace will not be Fact Checking this is online afterwards. This is a problem with the debates is right afterwards when people are asked who do you think won the debate . They often times say a candidate won but later if you ask them they would change their mind because they found out some of the things the candidate said were false so i dont think Chris Wallace will be Fact Checking but two hours later when web sites come up and you see fact checks, people might want to change their minds. Its one of the problems with your convincing at the time but once we find out its a lie we dont trust you anymore. Chris wallace is the final moderator. Do you think hes a fox news host, they had a back and forth that made news when she talked to him after her convention on emails. How do you think he will approach her . I think hell be fine with Hillary Clinton. I think hell try to do his best to be a journalist and be fair for both. My tip to him, if you dont want to fact check, talk to them beforehand, in other words remember when he had slides in the one debate when he put up slides of ted cruz saying something or donald trump saying something . If you show those before the question, you dont need to fact check so you can show a slide of Hillary Clinton saying something and then you can say secretary clinton, since youve said that, whats your position now . You can do the same thing with donald trump. Donald trump is very good at saying i never said that, i dont believe that. But it looks bad to fact check him afterwards, perhaps Chris Wallace is thinking. But if you simply put up his quotation before the question or put up the slide before the question then it puts anymore the corner where he has to defend the words or say yes i said that but ive changed my mind. Finally in this era of debates were not only watching whos on the stage but whos in the audience. Were hearing the Hillary Clinton camp is bringing in meg whitman, a republican who said im with her. And mark cuban is being brought back. Is this an attempt at psych snout. Yeah it is an attempt at psychout but i dont think it will have much effect. You dont . No, theres been no real improvementments in the debating from either one. I dont think the audience thats there in front of them is making any difference at all. They have their set ways of debating, donald trump has terrible nonverbal communication during the debate and i dont think the audience it would be different if, for example trump was a smooth smoothie and hes performing great and you brought those or Hillary Clinton was doing great and then suddenly someone in the audience startled her. These are two pros at talking to cameras, i dont think there will be any difference about the audience. A smooth smoothie. Ed to graham. Smooth smoothie. Thank you, thanks for the laugh. You are welcome. We need laughter. Thank you. Next, speaking of amy schumer. Full discloser, im a fan of hers but its what she said about donald trump on stage in this megaarena that had nearly 200 people get up and walk out of her show in florida. Well talk with someone who was there. His take on what happened and also comedian judy gold, she knows amy, she can join me live on whats up with comedy next. Comedy and politics colliding. About 200 amy schumer fans up and out of her arena show down in tampa a couple days ago here. I want you to watch what exactly happened when she invited a trump supporter by the name of dave on stage. Right now its security for the country is probably the biggest thing. And hes going protect us. With all of his experience with ceasefires . Im not really voting for trump. Okay, you can go sit down. Thank you, appreciate that. That was just cool to hear what one guy who doesnt seem like a psychopa psychopath might want to vote for that orange sexually assaulting fake college starting monster. Ouch she didnt stop there. Amy schumer told folks in the audience if you dont like it, leave. So everybody point to the people booing. Just point okay, so goo. So vanity fair followed up with her. She released a statement and in part said this i want to thank the 8,400 people who stayed. We have always depended on comedians to make us laugh and tell the truth. I am proud to continue that tradition. So lets bring in pop use i cmu culture critic for the Tampa Bay Times who was there and judy gold, producer, writer, actress, you can hear her on her podcast kill me now. Full disclosure, i just read amy schumers book in a day, i think shes hysterical. She is. That said, jay, you were there, you were at the show, you saw the bit with dave. Tell me more about what happened. Well for the first half of the show it was about like you would expect. There was a lot of talk about sex, her body, her selfimage, her celebrity. The comedy she is more traditionally known for. Last couple years shes gotten more issueoriented but then she segued from sex and relationship to politics using donald trump in the past week and a half of accusations as a segue and then the mood changed a bit. It wasnt necessarily rehearsed material. If it wasnt it wasnt entirely fully baked. I know i wrote tense in my notebook in all caps and it got uncomfortable in the arena. Im not amy schumer, john what was rehearsed and what wasnt but when you see 200 people getting up and leaving, what are they saying . Whats the issue . Well, when she started when she brought up donald trump, you could hear amidst all the 8,400 people cheering, a lot of boos. It was a divisive reaction. Tampa has a conservative side. Its a military town and a lot of people might have been there who didnt necessarily know or love amy schumer for her issueoriented comedy and maybe they came to see a comedy show. At the beginning of the show amy said theres a lot going on out in the world, i hope we can come together and have a good show. Maybe they werent expecting to get a piece that was that doesnt feel like comedy. It just felt like she was stump speech ago little bit. Nothing wrong with that. If you go to a comedy show, part of the bargain is you should listen to what the comedian has to say but people didnt want to stick around whto when she veer back to more traditional bits. They got up and got out. Judy, full disclosure, youre buddies with amy. I know its great fodder. Whether its making fun of hillary or donald but the issue with amy schumer, folks said i went to a comedy show, i want escapis escapism, i dont want to hear about politics, there she went. If you were on the stage, what would you have done . First of all i want to say i just watched the bit and it was hilarious. She brought someone up, asked him a question and it was funny. She gave that person so Trump Supporters would obviously say it wasnt funny. First of all, is there a line in comedy . Theres a mine from not taking yourself too seriously and trump is not funny. Hes not funny. Hes dangerous, he says the most horrible things about so many different kinds of people and he has no sense of humor about himself. You see him on saturday night live, the biggest honor is to be made fun of on saturday night live. That means you made it. When someone decides to write a stretch about you on saturday night live, youve arrived and yet he can not laugh at himself. He does not see the humor. My mother used to say if i wasnt laughing id be crying and the things that come out of his mouth. You know amy and every other comic is we are social commentators. This is the zeitgeist right now. This donald trump Hillary Clinton and the constant soundbites that we hear from him are that is what every i go to a restaurant and thats all people are talking about. You cannot ignore it. If you watch the tape and i know because i know someone who was there there were about two dozen people who left. There werent 200 so there you have over 8,000 people laughing. I see comics who say antigay things or you know, misogynist things. Sometimes theyre funny and i can laugh at it and know its a joke. I guess my question would be, jay, pivoting back to you since you were there, if you are an amy schumer fan and if you follow her on instagram its clear where she is on how she supports Hillary Clinton and its funny im ing to donald trump saying were all to politically correct. And maybe hes right. Jay, do you think thats snare its comedy. To judys point, why are people taking themselves so seriously . How would you take that on . Well, you know, to be fair after the donald trump bit in her act, amy kind of launched back into more selfdeprecating material, ing she segued out of the nosoplanned interaction with the audience member into a story about performing at Hillary Clintons Birthday Party and there a lot of the punch line was i dont belong here, i should not be doing this and there was more of that for the rest of the set i dont think she takes herself too seriously she just wanted to take five minutes to talk about something serious. She said this is too important a time, i want to let you know where i stand and some people didnt have it but i think if theyd stuck around they would have seen she definitely does have a selfdeprecating side and they should know that if they bought the ticket going in and she wasnt afraid to use that part of her comedy later on. She did that very well. Well, amy, if youre watching, call me, we could do an interview. Judy gold, jay cridlin, thank you so much. Coming up, did you watch the president at the white house . Telling trump to stop whining. Just moments from now well watch donald trump take the stage. Will he respond to the president . For so many voters, the upcoming president ial election is all about the Supreme Court and who will nominate the next justice. This is a huge deal because three of the current justices are all over the age of 57 Court Appointments is the prime reason given by conservatives for supporting donald trump. The donald trump is saying he will undo what president obama achieved over the last eight years. Lets talk with this with gjoan biscopic, nice to have you on. Hi, brooke. As much as we talk about the tickets and theyre the ones who nominate, its also the down ballot races and how the Supreme Court is compromised. Work through three of the most recent Supreme Court cases over obamas last eight years that could change if the court were to lean conservative. Well, what it would take, brooke sfor the court to lean conservative not just with the seats open with Antonin Scalia but another one. Since you mentioned president obama, lets take his Signature Health care plan, the Affordable Care act. In 2012 and 2015 2014, rather, the court upheld it but this is something that donald trump has complained about and that if he were by chance to become president and put new justices on the court it could tip the balance but it would take more than a single justice because Antonin Scalia himself protested both of those rulings so it would take more than one and lets take another case that conservatives lost. The samesex marriage case of last year again, Justice Scalia was in dissent. With Anthony Kennedy tipping the balance with liberals far one so it would take two justices. So to get to your point its not just conservatives who might try to reverse liberal rulings but maybe in trying cases that went in the conservative direction to broaden them. Maybe to support Campaign Finance rulings or broaden individual gun rights in the heller case that scalia wrote. So with those cases that, i want you to hammer home for people why its not just important whos at the top of the ticket, joan, but down ballot. These are the folks who could have control. In the senate. Yes, exactly right. Here it is, brooke, right now any kind of nomination that comes from the president for the Supreme Court requires not just a simple majority but 60 votes to stop a filibuster so if, so the senate really matters because under the constitution the senate has the power to advise and consent and thats what weve seen in march since president obama nominated Merrick Garland to succeed Antonin Scalia, the senate has stalled. So whoever controls the senate starting after january 20 will control who gets on the Supreme Court. It wont just be a nomination by donald trump or nomination by Hillary Clinton, it will be who ends up in the senate and to go to your point about the down ballot there, if the republicans lose the senate it will be easier for Hillary Clinton to get somebody through if shes elected forthe republicans keep the senate it could mean more stalling into 2017. This is all at play, go vote. I sound like a broken record. Joan biskupic, thank you very much, appreciate it. Thank you, brooke.
