I have Danny Cevallos who has just been seated who can sort of walk us through these different counts. Danny, i know that the jury deliberated for 7 1 2 hours. He was accused of nine counts related to this alleged rape. As we walk through some of these counts and details, if you have kids in the room, some of these counts are pretty graphic in nature, just to explain what has happened here. Tell me about this verdict. I am not surprised that if he was convicted he would be convicted of three counts or whatever counts there were of misdemeanor Sexual Assault. Because the law in New Hampshire can be tricky, as with all states when it comes to Sexual Assault cases. With the misdemeanor Sexual Assault, it did not matter whether or not there was consent. The mere fact that there was sex, given their ages, would have been a guilty verdict on the misdemeanor. But consent would have been a defense to the aggravated felony charges. So thats why early on the defense was not consent but that we did not have sex. The defense of no sex was the only defense that could have resulted in a not guilty as to each of the charges. Im looking at jean casarez. Were doing this quickly and on the fly. Appreciate you sitting down. Jean casarez has just joined us. Three felony counts of aggravated sex assault. One felony for using Online Service to lure the accuser. Three misdemeanor sex assault charges, another misdemeanor for Sexual Assault and another for endangerment of a child. Bottom line, what does this tell you . That he was not convicted of the most serious felonies, the aggravated felonious Sexual Assault, the ones that can be 20 years per count. Not convicted of that. He has a seconddegree felony, which under New Hampshire law, its 3 1 2 to 7 years so this is prison time here. It is. This is very serious and you saw his reaction. This is a young man that had been accepted to harvard. Im told these are live pictures within the courtroom. And he broke down, when that first guilty count was read, he broke down. He sees the severity of this, the seriousness of this, a young man going to Divinity School but Harvard University had accepted him and now he is a convicted felon. Lets back up. Just in case people havent been following this so closely, this is a case of someone at this extraordinary Prestigious School in New Hampshire where apparently it was a tradition to and im using quotes, this is how they spoke, score in the senior salute, see how many young women n. This case, if she was a then 15yearold, he could be with. And so there was how many young women these young men had been this. Thats what this was all. It was all about that. The defense began their Closing Argument really an assault on the school, that the school became the parents of these kids as they boarded there and the school allowed this to happen. The school was not on trial. This one young man that youre looking at on your screen was on trial. But its also significant that they found him not guilty of the most serious charges, the aggravated felonious Sexual Assault, because an element of that was lack of consent. That was an element of the most serious crimes that they found him not guilty of. So that speaks volumes also in the sense of her story. Jump in on that. Heres how a jury might have reached that result, although it feels a little inconsistent. As i said before, the aggravated fe felonies were not based on the victim at all. Because he fell within that fouryear safe harbor. The miss deneen nor, on the other hand, he fell exactly within the range of years between the victim and the defendant that you could be convicted of the misdemeanor. So i was not surprised that the misdemeanor conviction would happen. When it came to the aggravated felonies, consent would set that defendant free. The jurors simply couldnt agree or just decided that there was some element of consent there that did not merit a felony conviction. But these are confusing Sexual Assault laws as they can commonly be in all of the states because there are two defenses involved. There is either no sex or there was sex and it was was con section assume and then you have the complexity of the ages which varied so drastically from state to state when you have a young defendant and young victim. So heres the one thing we can definitively say. This jury believed that there was sex. They believed that there was sex because that was in question. That was an element of the guilty convictions, as danny is saying. His story was that there was not. So they, at least in part, did not believe his testimony. Let me jump in. Ive just been handed now weve got the statement from the rape victim and her family passed along by the spokesperson. This is just part of a statement that ill read to you whats been highlighted for me. We still feel betrayed that st. Paul school allowed and fostered a toxic culture that left our daughter and other students at risk to sexual violence. We trusted the school to pro tenth her. It failed us. We continue to feel anger and disappointment for the lack of character and integrity that the young man of this school showed. Saying that these young men should bear the shame of these crimes along with owen la brie. It was our young daughter who took the stand and requested justice. We a we a we a we admire her bravery which made this measure of justice possible today. Measure of justice. Thats a very interesting comment. You know, another charge that was before the jury was simple assault. The unprivileged consent to bite her chest. They found him not guilty on that. And remember, there was testimony and he had admitted that he did that. Key word, unprivileged. In other words, she consented. So the jury may have believed that she consented to him doing that. Its really a divided verdict, just as danny is saying. They believed bits and pieces of both. When you were talking about prison time for him, you were saying that could range, what, between 3 1 2 to 7 . 3 1 2 to 8 is the class b felony of using a computer to illicit and lure. So can he just turn around and appeal what has happened today . Hell appeal they will file a directed appeal based on any number of problems that happened during the trial. But, again, that computer enticement is not again, not a surprise because its pretty clear that a computer was used. This was the facebook message . Yeah. Email, facebook message, sending anything over the computer as you see a lot in child sex crimes, those are very easy elements to make up. After all, the proof is in the electronic pudding. It is right there. All you need to do is get a subpoena for the records and that can be easily satisfied. If thats the only thing he was convicted of i cant stress this enough, all require the consent and not based on the age of the victim. That means on some level the jury believed there was some consensual activity. Because if they felt it was not consensual you can read the statute and the language of the statute, the aggravated felonies requires the absence of consent, one by surprise and the other based on different kinds of sexual contact. They all have that element of absent of consent. And they were not guilty on those. This was a predominantly male jury, was it not . And look at the message that this jury is sending not only to this defendant but to the school, to st. Pauls in their community, that for generations has had this senior salute and the school, from my understanding, has stayed silent, really, as this has gone on. Now they are going to have to talk about this. Well, im sure the school, i imagine, will have a statement in the wake of what happened. We are now learning today a little more about the intentions of that killer after he murdered two journalists live on television this week. Investigators telling cnn Vester Flanagan had a getaway plan in a car, extra ammunition, disguises. He was not driving aimlessly. He had a specific destination in mind before he was caught by police and turned the gun on himself. Although investigators are not saying where he was headed, we heard from Governor Terry mcauliffe speaking outside of the tv station wdbj just a short time ago. As we heard today, there was more ammunition in the car, he had more selfaddressed envelopes. So, you know, we clearly cant get into his mind and we cant find out exactly what he was planning to do but obviously there were some bad intentions and im just thankful our Law Enforcement did in a manner that nobody else was hurt. We are also learning that flanagan may have inadvertently helped police pinpoint his location because after killing Alison Parker and adam ward sent a text message that he had, quote, done something stupid and that friend may have given the police a cell phone number to track him. You see around here, really nothing on the walls, heres what you do see, a lot of him, refrigerator plastered with photos from his apparent modeling days, from his days as an onair person at tv stations, the apparent just blocks away from the offices of our cnn affiliate wdbj where he once worked. I can also tell you this today, Funeral Plans are set for one of the victims, a service for the cameraman, adam ward, will be held next tuesday at the First Baptist church of roanoke. We havent heard from the family from adam ward. I want to ask you about adam. You know, it was his fiancee sitting in the control room when he was murdered and you spoke to adams best friend katie last night and she talked to adam the day before he was killed. What about that conversation would you mind sharing with us, sir . Brooke, southwest virginia, a very closeknit family. Immediately i started getting the calls wednesday morning and one of those calls was from katies dad, who is my cameraman on saturday morning. He said, katie was his best friend and shes really hurting right now and i officiated her wedding two years ago and i was there as an announcer. I reached out to katie last night, talked with her and asked her specifically, you know, what is helping you heal through this process, what are you holding onto and the first thing she told me, brooke, was prayer. She quoted c. S. Lewis. I pray because i cant help myself. I pray because im helpless. I pray because the need flows out of me all the time waking and asleep. It does not change god but prayer changes me. And so thats my goal, to come out into this community and with the powerful tool of prayer to offer hope to all those hurting today. You mentioned, pastor mccracken, that you met adam at katies wedding. I heard he was a proud Virginia Tech hokie. What do you remember about him . That katie was talking about him, all of the friends of katie, she walked me around and introduced me to everybody and so i was overwhelmed that day but everybody around was just smiling just like adam and happy and joyful. You know, adam and alison and vicki and all of these people have closeknits to our congregation, in addition to adam and miss katie being best friends, and people have been raving about what kind of person adam was. Katie said he was the personification of christianity, always happy, always joyful. I think that what my endeavor through all of this and goal through all of this is to get the church out of the building. When you look at the great commission, first word is go in matthew 28 16 and i think weve replaced the word go with come. The buildings are getting bigger, staff is getting bigger. Yeah. And i think that helps her with the liberal base which has been wary of her and certainly the Democratic National committee is putting out a lot of press releases about him and jeb bush. The republican side is so unpredictable. Shes taking him on using humor. I think that resonates. M. J. , weve seen a much more contrite Hillary Clinton. Weve seen with jokes regard to this email debacle and now were seeing a different Hillary Clinton. She addressed this today as well. Here she was. Its a little confusing and i certainly understand why for the press and for the public to try to make sense of this, like something wasnt classified in 2009, 2010, that maybe now it should. Im trying to do a better job of explaining to people whats going on so that there is not all of this concern and theres some sense made out of the confusion and to answer peoples questions. M. J. , why do you think the sudden change in tone here . Do you think its a direct result of how america has been perceiving her and her trustworthiness, as weve seen in polls . Well, brooke, as you mentioned, shes tried the humor method and didnt work very well when she jokes about how she likes snapchat because the messages disappear all by themselves or when she is asked about the server being wiped, am i talking about a cloth being used to wipe the server . That wasnt perceived well by certainly her critics and some other candidates and i think the campaign and certainly others have to understand that even though they keep saying that this is not a serious problem for them but in terms of the public perception, this has been a problem for her. A new poll came out that 61 of people do not find her to be honest or trustworthy, that is a big problem and obstacle for her. Forgive me. We need to break away from that. We have andy parker, the father of slain 24yearold journalist Alison Parker. Lets listen. This was, as you all probably know, ive been doing a lot of media here over the last couple of days and its been i havent watched it but im sure you have and its been gut wrenching for me to try to get through anything without breaking down in tears and today was probably the worst because this was alisons home. Her home station and i met the people that she worked with and the people that really loved her and it was it was profoundly difficult for me. But i think that the grief and the outpouring of sympathy has not been only here but around the world has been incredible. I mean, incredible. You know, for alison and for adam. Alison alison was a force of nature. She was an absolute force of nature. And i think that her life is going to have meaning not just as a journalist but if we can effect meaningful changes in our gun laws here, this senseless murder will not go in vain. And i think you all know this has been my mission and im taking it up and i was pleased that the governor of virginia has stepped up and is right there with me. And i would encourage other politicians to be as courageous as he and so thats the plan. Im im not going to let this drop. And as ive told many of you around the country and around the world, the people that ive spoken with, you know, each time you think theres a Tipping Point with sandy hook or aurora and then nothing gets done. And i know you guys have to do your jobs. Look, my daughter was a journalist and she would want me here telling the story. Im doing this for her. But as journalists, i saw a piece that dan rather wrote, actually the day of the murder, and he said, our profession, meaning journalism, were not doing our jobs staying on point with this and keeping this on the front burner, not the back burner. This stuff cant go away. You cannot let this die. And i know youve got other news to report on but this cant be the story for three days and then, oh, gee, lets see what donald trump has to say next week or whats donald trump doing . You guys she was one of you. She was one of you. She was in the fraternity. She was a journalist. And frankly, you guys should be concerned because now when were out here like this, i mean, everybody is a target. Everybody is a target. So youve got to be with me on this and weve got to do whatever we can to hold these peoples feet to the fire and not be afraid of the nra fighting any kind of reasonable legislation tooth and nail. Were not trying to take peoples guns away. All we want to do is keep crazy people from getting guns. And theres got to be a way to do it and im going to dig down in the weeds and start to learn the process. Its too raw for me yet but i guarantee you, somebody has the answer for this and somebody has a reasonable answer for this and im going to find it and im going to make it happen. Andy, your daughters killer passed a criminal background check and was able to legally buy his weapons. Maybe this is a deeper issue than i think it is. How do you know if somebody is mentally unstable . Well, thats what weve got to find out. If there are warning signs, you know, theres got to be a way. But, you know, we can solve that problem but we need to at least start by having background checks and lets close the loopholes on people being able to get guns at these gun shows. I mean, there are reasonable initiatives out there and reasonable proposals that have been made. You know, who needs you know, who the state legislature in virginia passed a law that you can buy a machine gun. Who the hell needs a machine gun to go hunt. What makes you think or how do you think this will change things after all of those other massacres and shootings. Shes one of you guys. Shes one of you guys and not that that makes you special, but, you know, you have a voice. And you need to use that voice and we need to keep the pressure on the politicians to not be afraid of the nra. I mean, listen, the best thing that the nra could do right now, most of their members support reasonable gun control. The membership does. But the politicians that give money from the fra, they dont do anything and its time we hold these peoples feet to the fire and shame them wherever we can. And i want to go to the Virginia Legislature and i want them i want them to look me in the eye and tell me why cant we have a reasonable proposal, any reasonable background check, you know, the things that i want them to look me in the eye and tell me. What would they have been able to see in his background that would not have allowed him to get a gun . He was never charged anything and was not committed . I dont know the answer to that question other than he had a history of he was disturbed. You know, he had to be escorted out of this building when he was let go. There are warning signs that people can look at and say, wait a men. Theres a problem with these other shootings. With sandy hook, there are problems that you can look at. And theres no guarantee. Look, its wearing a seat belt in a you drive around in a car and we all need to be wearing seat belts but thats no guarantee that its going to save us from an accident and getting killed. You know, but weve got to do something. Its a step. And thats really right now, thats all im advocating. Lets just lets enact reasonable gun control measures and do something reasonable and then, you know, we can tackle the Mental Health. And part of that is the Mental Health issue. We have to be able to you know, when there are warning signs and there has got to be a reasonable way for us to do this. Did your daughter ever express a concern over the state of gun laws . Not as a reporter but as your daughter . She you know, listen, i dont own a gun, we dont have a gun in our family. Im probably going to have to get one. Sad to say, but, you know, i unfortunately, thats just the world we live in. Why do you say you need to get a gun . When youre in the media, as you know, and when youre taking on an issue like this, there are a lot of people that take exception to what youre saying. Have you already received threats . I have not but i dont want to take any chances. She was always concerned only because, you know, she knew, like all of you know, when youre visible and when youre in the public eye, you could be conceivably be a target. But, you know, did she consciously dwell on that or was she always saying that, gee, i think my life is in danger . No. She didnt live like that. She lived with you know, her life was her life was full of joy and she always saw the best in people. And she touched people so many people and thats why they loved her. And she just this was Something Like this would never occur to her. I want to go to iraq to cover the war on terror and to cover isil, thats not what she wanted to do. She was good at hard news and you can ask the news director down there, thats what she she enjoyed that. But she also loved what she was doing here. It was the complete it was totally different but something that she enjoyed doing and she never would have anticipated anything like this. So no, i mean, that was never in the back of her mind. Can you tell us about your visit to the station today, how it went and go through how difficult it was . I spoke with the governor and his wife and they were gracious to come here and, again, i have a new found respect for him. He is hes a guy that he means what he says. Hes not afraid to stand up and, you know, hes grown a pair. Actually, he already had a pair and i wish other politicians would do the same thing. I have not heard a word from the first the First Official to call me was terry mcauliffe. I have not heard a word from senator cane or senator warner. I see the tweets and all of that stuff that say, gee, were so sorry for the family and i understand that and appreciate that but i knew those two guys. They campaigned with me when i ran for the house of delegates and its very disappointing that these that senator cane and warner havent at least given me and call, number one, and come out against this. And i think its part of it is, you know, as politicians, we live in a very conservative state. But again, its time to do something. Its time to do something, folks. Stand up, take a stand, and do something. Would you have advocated for your daughter to have a firearm before this happened . No, not really. Because, as i said, if she were and im going to use you guys as an example right here. You know, if you had an ak47 strapped to your waist right now, do you think youd see somebody coming from behind you to attack you . No. You wouldnt. Theres no way you do t because you know why, youre focused on me, your job, your photographers are focused on their jobs. They wouldnt have seen it coming and it wouldnt have made a difference. And the station has suspended shots outside the building sure. Right. Exactly. Because you know why . Theres going to be some crazy that is going to say, wow, i could do that. I could be on national television. This would be really cool. Im going to do that. Its the copycat. Its copycatting. And as i say, you guys need to worry about that stuff and thats why you guys need to be with me and i challenge the president yesterday on i was interviewed by the bbc america and the journalist asked me what the biggest the biggest concern that president obama had and he thought his biggest failure was that he was not able to enact gun laws and the question was, well, do you think any president could do it . And i said, absolutely. Because nobody thought he would Pass Health Care reform. Nobody thought he could get a deal done with iran. Nobody thought hed open up the doors of cuba. And i said, of course he can. Hes not up for reelection and i looked in the camera and i said, mr. President , its time for you to take a stand and do this. Help me. I will help you do this. Sir, this is a delicate question but can you say anything about alisons arrangements at this point . Well, its i appreciate your delicate we were having a its a celebration of life on monday with family and friends and for obvious reasons, you know, we cant really disclose where this is going to be because, you know, unless its part of the news organizations, wed be glad to share that with you as long as you kept it private. But, you know, we would have all kinds of well wishers, im sure, and then we would also have people that probably didnt would not need to be there but then she alison was always she loved the river and she, you know, was auto great athlete, as you all know. Anything she touched, she did it well. And she was a great paddler. We just got back from a great weekend near brison city and she loved it down there and it was one of the places that she thought that she and chris were going to get married. So at some point, were going to go down there with her ashes and thats where shed want to be, in the river. Sorry. Yall have any other questions . [ inaudible ]. I would express my appreciation. You know, my phone is exploding with messages and, you know, im trying to get around to reaching everyone and old friends but from what ive heard, just like youve said, the outpouring of affection is not just here, im getting messages worldwide. Also, again, reiterating the fact that he got a phone call, has been in close contact with the governor there in virginia, terry mcauliffe, and how he says he essentially wants to become the john walsh of gun reform, calling politicians cowards, saying that some kind of sensible legislation needs to happen. Weve heard him earlier this week and hearing him again. You know, he is in favor, he says, of sensible gun control legislation. He says he doesnt want to take peoples guns away, just wants to encourage everyone to remember the tragic events of the week and pushing to End Gun Violence in america. To a bigger discussion, i have oun senior legal analyst Jeffrey Toobin and Danny Cevallos here and polo sandoval. Jeffrey, let me bring you in here. We heard from one of the reporters asking mr. Parker the question, essentially in this case, the gunman passed the background checks, bought these guns legally. Listen, we have seen this push in the wake of first graders being murdered in an Elementary School and still the question remains, what can be done . Well, what could be done is a very different question than what could be done politically. What could be done politically today is nothing. Gun control is just not happening in the United States congress. After 2012, there was a very strong push by the president to get a strong background check bill and it didnt even pass the senate much less the Republican House and. Thats right. After the 2014 elections, hes been much more conservative, much more probed on pro Second Amendment congress than it used to be. So at least for the foreseeable future, notwithstanding all of these tragedies, the political prospects for gun control, i would say, are zero at the moment. President obama, to my knowledge, has not spoken directly with mr. And mrs. Parker but i can read you what he said in an interview just yesterday with regard to the tragedy in roanoke. He said, what we know is the number of people who die from gunrelated incidents around the country dwarfs any deaths that happen through terrorism. Danny cevallos, to you. The Supreme Court actually expanded the reach of the Second Amendment . A very famous case expanded the Second Amendment, which is an amendment that is not often dealt with by the Supreme Court but now that 14th amendment applies to the state when it comes to owning and keeping guns, keeping and bearing arms in your home for selfdefense. And if there is this newfound right to keep and bear arms in your home for selfdefense, then that means that eventually somebody without a record, somebody who is lawfully permitted to own a firearm will get a firearm and they have the potential to just snap one day. Your heart goes out for all of these parents. I just spoke with the daughter of the principal from sandy hook yesterday who lost her mother, i spoke with the father of a young man who was shot and killed randomly in california. And its just like you know, you feel the passion and especially hearing from mr. Parker, you know, saying, no more, this ends now. I cant even begin to crawl under their skin and feel what they are skinning. Polo sandoval, you are in roanoke and hearing mr. Parker at the very end talking about alisons passion for white water kayaking and and plans to remember her at the river. Reporter right. And eventually take her to the river and thats where she would really remain and at this point i think what we noticed here and what we felt was a fathers pain despite this revamped effort that were now seeing to call for stricter gun laws. We heard from mr. Parker and he did tell us that this was perhaps one of the most difficult days in the last 48 hours and mainly because he was here and he was able to have the opportunity to speak with the coworkers that his daughter spent so much time with and what was interesting, though, is when he said that he knows that this struck an emotional chord and he wants to use that to put out his daughters message. Breaking news out of New Hampshire where this young prep School Graduate just learned the verdict in this rape trial. 19yearold owen labrie was accused of sexually assaulting at the time a 15yearold, this girl at st. Pauls school last year. After deliberating for 7 1 2 hours, jurors acquitted him on the most serious charges of felony rape but did find him guilty on three counts of misdemeanor, Sexual Assault and other charges. Accusing the defendant of Sexual Assault by knowingly engaging in presentation with a teenager. Guilty or not guilty . Guilty. You say madam foreperson, that the defendant, owen labrie is guilty . Yes. So say you all members of the jury . Yes. Accusing the defendant of simple assault in that he knowingly caused unprivileged physical contact to a female juvenile, guilty or not guilty . Not guilty. Today, the victims Statement Issued this, in part, quote, today a measure of justice has been served for victims of sexual violence. While he was not convicted on all charges, owen labrie was held accountable in some way by a jury of his peers for crimes committed against our daughter. Let me bring in jean casarez and Danny Cevallos is back with us. Jean, can you walk through the counts . Sure. He was found guilty on three misdemeanors, one felony four misdemeanors, one felony. And i think the impact of this is, maximum pell penalty is 11 years. They are still in court. Heres the most concerning, a felony. Its a class b felony of using a computer to seduce or elicit a minor. They are arguing now on bail or to be remanded into custody until sentencing but the prosecutor just said that because of that computer conviction, that he will have a lifetime of a sexual offender registration. A registered sex offender. On the felony, use of computer services, what does that mean . What happened . It means it can mean as little as using your iphone, using your laptop, sending anything over electronically. That kind of crime comes in very often in pornography cases. Prosecutors are increasingly and legislators, i should say, are increasingly adding this as a separate crime, mostly because it is a very and exceedingly easy crime to prove beyond just the fact that somebody sends a message over the transcript, they have to prove the intent. In this is case, apparently the prosecution showed that the intent was to entice as it was described in the statute. Its interesting, too, because that statute may have, in defining a minor, a different definition than the definition of the aggravated felony which depends not only on the age of the victim but the age of the defendant. From my reading of the felony that he was convicted of, i dont believe theres any Safe Harbor Provision for a defendant of a particular age. I think youre right. What danny is saying is the law. The facts are, there is a senior salute. So he emails the victim and we dont have to say alleged victim anymore. She is a victim. He emails her saying id love to take you, you know, to the chapel and to walk and it just seems so pure and beautiful. She says no. She says, i really would like to but, no. So he gets a friend and he says to the friend, youve got to help me here. That was via some emails along with conversations, youve got to get her to say yes. She did say yes. Some of the emails were very pure but the juror must have looked at the intent of the senior salute and they were looked at to seduce and to get this young girl for purposes of sex. There were questions during this trial as to whether or not sex happened and it sounds to me that obviously this allegation of specifically the worst of rape, they were saying, yes, the sex happened but not rape, correct . Thats what it appears to be the mindset of the jury. The charges that he was convicted of, sex had to have occurred. They are still in the courtroom but we see the defendant on the screen and the moment those guilty charges began to ring out, he started to cry. Now, we dont know if he was confident, if he was scared. Hes a young kid but he realized the severity of what was happening on the first charge that was read, guilty, was that computer count which now we see is one of the most serious, a young than that had been accepted and was on his way to Harvard University. So now they are in the courtroom still. They are trying to figure out, you were saying a bail issue, right . Bail pending sentencing. Right. Youve just been convicted. At some date in the future youre going to have a sentencing date to decide how long youre going to go away. Up to 11 years. Right. Can i stay at home and wait. The prosecution is going to always argue, hes got a reason to run. The defense is going to argue, hes made all of his court dates, nothing has been changed other than hes been convicted. Hell show up for sentencing. The prosecutor said hes been living with his mother but we can argue that his mother was a coconspirator in this because she helped him delete some of those email messages. Thats what the prosecutor argued. Bail is a bizarre thing where every point a prosecutor makes, a defense attorney can equally take that point and turn it into a point in his favor. If you have a lot of money and youre an upstanding member of the community, why would you ever run . Everybody would recognize you. The prosecution would argue, he can flee to cancun and well never see him again. Every side in a bail argument has two points. And the defense just said, lets give him a curfew. So the defense so strongly wants him out, they say well even add to the conditions. Going to the victims family saying there has been a measure of justice. Just as you said it, he was not convicted on the top aggravated Sexual Assault counts, the counts that could have put him in prison for 20 years per count or 20 years in prison all together. He was found not guilty of that. What has the school said sort of through this whole thing . I have not seen that they have said anything at this point. Danny, have you seen anything . I have not. They are in a mine field of potential not necessarily criminal but civil liability. Exactly. But if there is a civil case and i have to suspect there will be, what does that say for any school, whether its a fancy prep school or Public School that holds a prom, that holds any sort of event that encourages kids to get together . Will this create a new era of civil liability for things that go awry . Because as much as this is a terrible case, having practiced a lot of juvenile delinquency law, all you have to do is walk into any Juvenile Court in america and these kinds of things, unfortunately, are happening everywhere, from the prep schools down to the regular schools. After murdering a tv news crew, a 24yearold and 27yearold, Alison Parker and adam ward during a live broadcast this week, the killer, Vester Flanagan, ran and now were learning more about what his getaway plan may have been. Investigators telling cnn that he was not driving aimlessly when he got into that rental car loaded with a gun, extra disguises. Investigators are not saying where he was headed. We are also learning that he may have actually accidently helped police pinpoint his location after murdering these two, he texted his friend and apparently the text said this. Done something stupid. That friend may have given police his cell phone a possible way to track him down. We also have this today, photos inside of his apartment not too far from that tv station. And looking at this with me, bed stripped down to a mattress, not too much on the walls. But on the refrigerator, plastered with images of himself from his modeling daying, from his days as a tv news reporter. Faces of his. We have heard from Alison Parkers father who made a plea to the news media and government officials to do something about gun control. He responded to a question about whether alison was ever fearful in her role out and about as a reporter. Listen to this. Did she consciously dwell on that or say, gee, i think my life is in danger . No. She didnt live like that. She lived with her life was full of joy and she always saw the best in people and she touched people so many people. And thats why they loved her. And she just this was Something Like this would never occur to her. Its different this time and you guys have got to help me make a difference. Polo sandoval was there and hes in front of the tv station. The memorial has been growing the last couple of days. Back to mr. Parker and his words, he has been pleading with media and, of course, the government to do something in the wake of such a senseless tragedy saying why cant we have reasonable background checks, commonsense, he wants to go to the Virginia Legislature and have them look him in the eye and tell him why. Reporter right, brooke. Just in that small portion you were able to play, you felt a fathers pain. Obviously the last couple of days have been extremely difficult for mr. Andy parker. Today, though, perhaps the hardest, as he told us, as he did go within the walls of the station. He went inside the station today and managed to speak to several of his daughters fellow colleagues. And it was obviously very difficult for him, as he heard the stories and the lives that she touched. Youll see that makeshift memorial that has doubled in size today alone weve seen strangers come and go, an endless flow of people bringing food and flowers and bringing their support, in general. Most of the people that i have spoken to didnt even though andy ward oral son parker. So, again, today we did hear from mr. Parker himself. And he renewed this push for the call for stricter gun laws. The same question, though, is interesting. It was posed for him which was posed to Virginia Governor tear remcauliffe earlier and that was at least his response in knowing that this individual, Vester Flanagan did in fact pass the gun check. He said more needs to be done to prevent another father from feeling the same pain. Brooke . I want to stay on that, polo sandoval, thank you so much. Given this tragedy in roanoke this week, the questions continue to be peppered. What now . I spoke with two people, just absolutely shattered by gun violence in recent years, a father and a daughter. Youll recognize both of them. I interviewed live on the show yesterday and seems to have touched a number of people. Today i wanted to pause and share part of that conversation one more time. Whats important to me now is trying to make sure no other parent or family in this country has to go through what my familys gone through. Its terrible. And we can do better than this. You know, i hear from politicians from time to time in answer to what you do about gun violence. They say, its complicated. Thats not political leadership. Thats an excuse. You know . People used to come to steve jobs all the time and say, we cant do this, we cant do that. Steve jobs was a leader. He said, go back and figure it out and he helped figure it out. So i refuse to accept that kids like mine and alison and adam have to die in this country in the way that we do, that occurs every single day. This is the United States of america, the 21st century. Were americans. We can figure this thing out and we can do a lot better. We owe it to our kids and our families. You know, the situation weve gotten into in this country with gun violence is unacceptable. Were its just you know, 20 kids, 20 little 6 and 7yearolds died in the sandy hook Elementary School shooting, six adults, including ericas mom. We as a country didntdo anything. Thats disgraceful. You know . And i called the nra and craven and irresponsible politicians including me. We didnt do enough to support those parents when they tried to get legislation through congress. We need to do more. Every day in this country, 88 americans are shot and killed. Its ridiculous and we need to do better. Erica, final question to you. This is cnn. Im brooke baldwin. Prosecutors will not retry a North Carolina officer who killed an unarmed man, shooting him ten times. A judge declared the trial a mistrial. Kerrick opened fire against Jonathan Ferrell who was looking for help after a car accident. The prosecution will no longer seek charges against the Police Officer. Weve heard from roy cooper. He held a press conference in the last hour explaining why not. Our prosecutors believe unanimously that a retrial will not yield a different result. We as a state need to learn from this tragedy. More consistent and better training for our you Law Enforcement officers can save lives. But most of them understand that officers must be held accountable when they do not follow their training. As happened here with tragic results. Bringing in civil rights attorney who is live in los angeles, areva, thank you for coming on. Hearing from the a. G. , saying that it would not yield a different result, how can he definitively know that . Well, typically, brooke, once theres been a determination that the jury cant reach a unanimous decision in a criminal case, the prosecutor has to make the determination, the decision whether they are going to retry the case and they do that by looking at a variety of things, starting with the jurors own statements. They will poll the jurors and find out, what was compelling to them about the evidence that was presented and what wasnt persuasive. They will look at the charges and use all of that information to determine whether they can, in fact, get a different result with the same evidence that they have available to them. I can tell you from reading statements from the familys attorney, they are very disappointed that they will not go forward with a retrial. Now to learn that the attorney general is not going to retry the case has caused a disappointment for them. How rare is this, a, to have a mistrial and, b, for the attorney general to say, totally dropped . Neither are rare in our criminal justice system. You often will have jurors unable to make unanimous decision. Looking, getting 12 people to agree to anything can be difficult where you have the dash cam video. They are just there trying to get help and you have the defense saying no, he was going after the Police Officers. So two very different stories were painted about that evening and jurors could not decide which story to you know, which was the most credible story. They cannot get 12 jurors to convict this Police Officer. Its not uncommon that you get a mistrial and its really not uncommon that a prosecuting attorney will decide not to retry a case. I think this case has to be looking at a larger narrative and raises the question about whether something could be done to deescalate this situation if the officer believed he was in danger rather than killing this young man who apparently was just trying to find help because of this car wreck that he was in. She calls donald trump the flamboyant frontrunner and has essentially tried to tie him to the rest of the party. She said in that speech it used to be the party of lincoln, the party of trump now and i think on the other hand you have republicans obviously trying to distance themselves from trump. But obviously Hillary Clinton there and other democrats essentially trying to say that donald trump represents this party and she named other republicans, too, jeb bush and said all of their policies are the same in terms of immigration and in terms of womens issues as well and she clearly wants that fight. I talked to some of her aides and they know that this isoftentimes shes strongest on these issues and polls reflect her as strong on these issues. Something like twothirds of women think she would be strong on these issues. Donald trump is definitely not one to stop, not firing back. He called her comments earlier in the week disgusting. Jeremy diamond, he has also come forward and talked about potential tax policies saying, yes, he would raise taxes on the wealthy which, of course, would include himself. Heres what he said on msnbc. We have to simplify the tax code, take away some of the deductions and hedge funds have to pay up. Now, im going to lower taxes but these Hedge Fund Guys are making a lot of money. I can tell you that i have friends that laugh about how little they pay and its not fair to the middle class and the middle income people and the middle class, were destroying that. Thats what built this country and we are destroying the middle class in this country. So i will have a plan, the hedge funds wont be happy but pretty much everybody else is going to love it. Well, jeremy, according to a gallup poll this spring, only 29 agree for the rich. Can you tell me what about this do you think donald trump thinks will help him win republican votes . Yeah. Listen, hes certainly tapping into a populous anger in the country and this is a part of that. Its going to be a hard sell to conservatives if he says hes going to raise taxes on the wealthy across the board. Lets be clear, hes talking about raising taxes on Hedge Fund Guys. Some conservatives who weve talked to in recent days have said it there might be a way that trump could do that. Hedge funds are taxed with capital gains, with carried interest taxes which is a lower rate. So if he finds a way to perhaps eliminate that special category or, as Grover Norquist told cnn, if he could dramatically cut other taxes, there might be some wriggle room there. We have licensed counselors that work with women on some of the deep issues. Its okay to be angry. I left with nothing. I got my two girls and left. I worked so hard to not lose them and then i lost them. Any mother that comes to us who doesnt have her children, we help get her children back. Now, the nation is pausing to honor the resilience of the people all along the gulf coast. Earlier today, president bush there and his wife visited a new orleans high school, one of dozens that was absolutely destroyed. Hurricane katrina is a story of lost beyond measure, its also a story of commitment and compassion. I hope you remember what i remember, and that is 30,000 people were saved in the immediate aftermath of the storm. Well tonight at 9 00 eastern, new orleans yans plan to pay tribute to the First Responders who saved so many of them from that great flood. President obama describing kat ral as quote, Natural Disaster that became a manmade one, failure of government to look out for its citizens. Staying on katrina and remembering ten years ago, theres an old wooifs tale that a hurricane can induce labor. That the drop in pressure can trigger an arrival as one of mother natures violent phenomenons is heading its way. Well, ten years ago as katrina churned towards new orleans, my next guest felt labor. Her son wasnt do for another week, but katie headed to the hospital, as it turned out delivering her baby boy would be the easy part. Katie and her son, Hatcher Campbell who turned ten today join me live from new orleans, awesome having both on, and hector, happy, happy birthday. Thank you. Thank you very much. Youre so welcome. Katie, to you first, i know you, you delivered hector early that sunday, about 24 hours before those federal levies failed, can you just remember for me and for all of us, what it was like in the hospital, no air, no lights, and at what point you were separated from your newborn. Right. So the lights went out, just as the storm was hitting, about 24 hours after hector was born. And there was actually no electricity fairly quickly, one of the generators failed, and he was down the hallway pretty quickly in an airconditioned area where they thought the newborns would be safer. Did that make you nervous being so quickly, having to be separated from him . It did. And we also had been there was a woman across the hall from us who got a phone call just as the storm was blowing in, and she started streaming and hung up the phone. And it turned out that her mom was on the roof of the lower ninth ward. We knew something was wrong early. Even though we were pretty safe in the hospital which is a brick building that there was something going on outside that wasnt right. Something going on that wasnt right was a huge, huge catastrophe. At what point in time, katie, did you realize what was happening outside of this hospital . I think we found out because hectors dad is a cigarette smoker, he would Smoke Cigarettes from people with the hospital coming in and out. They were able to tell him, its flooded all the through certain wards or its flooded all through certain neighborhoods and its getting worse. On monday we were hearing that and we were really alarmed. We didnt know it was going to go beyond the lower ninth ward which flooded during betsy. We really were concerned that we wouldnt even be able to get out of the city. Katie, i have more for you, but let me turn to the birthday boy who was too young to remember any of this happening, but hector, youre a big tenyearold now, and im sure youve heard all these stories of how your mom had you and all these years later in new orleans now, such a special city, what do you understand happened . Well, i understand that the levies broke and people were, most, most of the people got out, but some people that didnt have cars or transportation didnt, um, didnt just stayed there. And they had to go through the water, like with the oil and stuff, with the trash and stuff to like the superdome where like, they had to stay on the roof or something. Like some people saved other people that, like their neighbors or either other people that was, that were in the that was in new orleans. You got it. So people wandered around. You got it. You knew he did great. He understands. And you know, i think whats also incredible, katie, is the fact that hes going to, the dr. Martin luther King Charter School in the lower ninth ward, an area that was absolutely destroyed. Hector, let me stay with you, how were you all at school talking about katrina . Well, um, well our teacher lives in the east, so she, um, so, like she, like she heard about, um, the lower ninth ward, like it was, like it was just in certain places, like, there was so many, um, breaches in the in new orleans from the levies and stuff. So thats pretty much what we talked about. For like half of the session. Mom, you want to jump in . He asked questions and stuff. Yeah, i mean, so you talked about for half the day today . Yeah. Thats a good summary, i think. I think the hard part was that, i mean the lower ninth ward where hector goes to school, there are still stoops that sit on the lots there from houses that floated away. And thats like its own little personal reminder of what happened. Every day we take him to school, i see that. And i know that they do talk about it in school, its almost like it lives around them because through the, the lots that are, remain high grass and the stoops that sit there from people whove never come back. Katie, just final question to you, ive got about 60 seconds left. Beyond birthday cake in hectors future, it is a significant time for a lot of people in new orleans, how will you be, i dont know, commemorating, honoring, remembering, moving forward . Well, i think that i always am so glad that, given katrina i had Something Wonderful to carry out. And it sustained me through those times after katrina. And he still does. So thats how that works. Hector, any final words from the birthday boy . I love the kiss from mom. Um, i pretty much, like it was a very scene of the, of new orleans, and like, other, other people were very, very, like, their lives changed forever because they had to move to different places.
