Other than donald trump, the basic question for everybody else is this. How do you wrestle a tornado and the tornado is in the form of donald trump. So for some people that means try to make sure a tornado passes and have running room in the future and other people may say, look maybe i should take them on as a strategy. Well see how that unfolds. If you take on donald trump, that could boomerranang. Donald trump is the central figure in this debate, obviously. Lets take the tornado, your word a step further. They are all mindful of the candidate not there, Hillary Clinton, but donald trump front and Center Understanding everybodys strategy is different, what would you do . Take him on . For somebody with not a lot of money and not in the race much longer if they dont catch fire taking on donald trump may be a good play. Thats going to get the attention and look tough and strong and i think that would be a good strategy for some candidates. Keep in mind hes a very seasoned counterattacker and it could boomerang. We found out there was a phone call between donald trump and bill clinton in may after we officially knew Hillary Clinton was in the race and he had to know that donald trump was going to get in for 2016. What could one hear from bill cosby because were especially mindful because of all of these stories as gel because that judge in pennsylvania released the deposition just last month from 2005 when we heard all about the quaaludes and wanting to seduce women. What you could expect to hear from mr. Cosby, i would imagine, is going to be a lot of i dont know and a lot more of i dont remember. From miss allred. Well this is the first of 9 to 12 debates so i think its really an introduction to america for a lot of the candidates. So the goal is not to have a really bad moment and hope to make a good impression. I think the toughest part will be moderating the debates and keeping the flow of the conversation going and keeping candidates to the timed limits. I know you point out there are many more debates but this is the first, which makes it a biggy in and of itself. Yes. How concerned are you that the candidates will be going after each other or attacking someone not on stage, Hillary Clinton, instead of answering questions and deliver specifics. I hear you laugh but its an honest question. Its a risk. No its a real risk. I think the moderators will try and get them to answer the questions but i wouldnt be a bit surprised if some of our candidates decided to mix it up. We have 17 candidates. You have to start to draw distinctions. I think you have to do it earlier in this race because there are so many candidates. It should be exciting. You say 17 with a smile, steve. Well when we first made a list and started this committee two years ago, we had 23 people on the list and we really thought that 8 or 9 would end up filing. But two our surprise there are 17 and, who knows, there may be more. Final question back in your state, in new hampshire, we know donald trump was a noshow at the forum on monday night. Im sure youve been talking to voters. Do they care that he didnt appear on that stage or will that mean that that will be more eyes on him tonight . Well, i dont think who are offended that he didnt show up. I dont think people took much umbrage to it. Donald trump is a legitimate candidate and anybody who thinks not is badly underestimating him. He will do well. It will be interesting to see the play between mr. Trump and the other candidates. Steve deprey there in cleveland, with only a couple hours to go. Here with some of the predebate rituals. Before a debate, i say a little silent prayer and drink a diet snapple. I like to be relaxed so i play solitaire. I take my phone and listen to motown to mellow me out. I go for a run. Its a great way to relax. Youre not taking phone calls, youre just out running and that clears your mind. Before the debate i normally call my mom to get advice. Hey, mom i cant say that on television. I got a video from my very trusted political advisers. Let me check on that. Hundreds of pieces of paper because they have all of the advice that people have given me about what to say during the debate and light them on fire. Im going to be me. So whatever coming out, its me. So snapple and motown aside here ought to be inside the last minute preps. Does this one even really matter . Lets talk about it with the director of debate welcome to both of you. Todd youre up first here as we call you our resident debate coach. You wrote this piece for cnn. Com. I want to begin with the happy hour debate so to speak. In a sense you could say they have no speaking time no donald trump to deal with the advantage of being perceived as an underdog. What ive read from you, youre calling this a loser scenario. Well it is sort of a loser scenario in a couple of ways. The first is, youve got a new one, brooke. Youve called it the happy hour debate. That doesnt seem president ial. One of the things i talked about in my piece is that their language matters and were calling this the jv debate the secondtier debate were calling it other sort of derogatory names and its not good to be associated with that if you want to be president and the history of debates in the country, if youre left off the main event, you have no chance of becoming president. It was Lindsey Graham who i grabbed that from. Thats what he called it on twitter. I agree with you, language absolutely matters. Mercedes Carly Fiorina, im wondering when we talk about the big debate the top ten, why isnt there a woman up there . I would have loved to have seen Carly Fiorina in the top ten. I think shes an incredible voice for conservative women in particular and shes also made a case against what would be the political establishment on the republican side. Again, this is a first debate. I think what youre going to see, even in the happy hour debate you might be able to see some new pieces coming out, some headlines from the candidates especially from an individual like carly. We cant brush up the 5 00 debate. We have so many debates to look forward to in the upcoming months its just the beginning. It is just the beginning. Americans are getting really introduced to a lot of these folks this evening and todd to you, when you look at the sheer time constraints of answering responses, how much is going to be substance. With ten people in the debate you need to make a statement about the debate that people remember. Four years ago, herman cain gained in the poll because he had the catchy 999. It wasnt necessarily getting him getting out zingers against the frontrunners, he set himself apart from the other candidates. Thats what they need to do in the main event. I hate to disagree with your other guests but if youre not in the main debate i dont think the campaign is just beginning, i think the campaign is just ending. Mercedes to you. Thats a great point about the introductions. Recently we watched the Hillary Clinton jeb bush back and forth. Shes honing in on him, so quick to react to what he said tuesday afternoon. Im curious, just your perspective on why she hasnt really taken on trump. Do you think perhaps its just a sign that shes not taking him seriously . Shes probably wise not to take on trump because god only knows he would take on hillary. Look shes being aggressive. She knows that jeb bush could be that frontrunner that she is focusing on jeb bush again. Shes not necessarily ignoring trump or Governor Scott walker or even senator marco rubio. But at this point, governor jeb bush he has the money and most of the endorsements. Of course he still needs to convince the conservative base of the Republican Party to support him. So its still a long haul but i think shes going to go and punch him where she can early on to see if she can make inroads there. Shes probably wise to stay away from donald trump because i think donald trump would quickly attack. Todd ive spoke to a lot of supporters of donald trump and one reason why they like him is because hes not a washington insider. Im wondering how he strad geldles that but also acts president ial on the stage this evening. You know what it always plays to be the outsider early on in a debate. I think somebody like trump is going to be fine for a long time. If he says the word loser in the debate thats a shock for sure. That goes over well in the beginning, in the early season. But later on when we widddecrease the field, hell be fine. One thing to remember anybody who attacks trump takes time away from thems receives because one of the things that happens in these debates, when you attack someone, they get to answer you. I think its unwise to attack trump, not because he will attack you back but because it gives more time to the frontrunner and thats something you dont want to do. Theres a lot of debris out there beyond the wreckage potentially from mh370. Each debris item based on where it sits on the surface or below the surface, is vulnerable to different energies from the wind the waves and the current. So if it happened to be sitting at the surface at the water, its possible. The particles sort of move around and this chart shows the debris in western and eastern directions. Why do you think we havent seen debris then wash up on the shores of australia . Yeah its hard to say. But certainly the current operate in a fairly distant way based on where the plane may have hit the water may very well indicate where the debris quickly drifted. Again, much of the debris from the plane likely sank because it is very dense. However, these lighterweight objects that may be in the windage may have moved northward and caught very quickly into the westerly moving currents. On the notion that Something Else that has perplexed me we dont know if a large chunk of this airplane is still sort of together and on the bottom of the ocean, we dont know how many pieces it could be. But im wondering and who knows when they will find all of that right, but how long could that remain under water and sustain the salt water damage in especially thinking about the black boxes . Its difficult to say but debris persists for very long periods of time in the ocean. Upwards of decades and particularly when they sink to the deep ocean in some of the areas where the search is its thousands and thousands of feet deep you have very very cold waters and so they can be preserved for long periods of time. In charlotte now North Carolina its the focus on this Police Officer on trial for involuntary manslaughter. For the first time dashcam video was shown from that night just moments before ferrel was shot and killed. He had crashed his car so he walked to a nearby neighborhood and knocked on the door of a home wanted help. The woman who answered was frightened and called 911 thinking thinking ferrel was trying to break in. Thats what police were told when they got to the scene and the dashcams were rolling. We are going to show this to you. Just a warning, youre about to hear this young man lose his life. 12 shots were fired and ten of them hit the 24yearold man. Get on the ground get on the ground get on the ground [ gunfire ] lets talk about this with cnn legal analyst sunny hostin and joey jackson. Weve seen the video. We were anticipating the video. I want to walk through how either side could see it differently beginning with you, the prosecution. The family said it would show the officer raising his arms saying wait before he shot. Thats not on the video. Maybe it happened off video. But i will tell you, what struck me and were talking a lot about the victims actions as opposed to the officers actions. Lets talk about both. Thats where the focus need to be because the officer is the professional and trained to respond in a crisis. And tasers were drawn when he was approaching and perhaps that is why the prosecution is saying he didnt run towards them, he was running away from the case tasers and thats the prosecutions theory. But i think its shocking that an officer would resort to deadly force. That doesnt make sense to me. I suspect it doesnt make sense to the prosecutors trying this case. This officer was responding to a call from a woman who sounded terrified on the phone. We played the 911 call the other day, thinking it was a potentially violent intruder. What strikes you about this . Theres a few things that are going to happen. Each side is going to use this video to bolster the argument that they are making. For the prosecution, hes clearly not armed at all. You see both of his arms and theres no weapon whatsoever. Number two, if you do the countdown, its three, max four seconds between the time he says to stop and shots are fired. So how reasonable could that be . Number three the sheer quantity of shots. There are 12 shots fired. The defense point is there is not compliance. He was not complying to stop number one, he was running towards us, number three, i had each side in that courtroom slow the tape up. Walk the witnesses through the tape. On crossexamination, the defense pointed out those two points noncompliant imminent fear prosecution saying unreasonableness of your action. You clearly didnt need to shoot. I think what is fascinating, though youre talking about the reasonableness of his actions. The officer is the trained professional not this young man in a car accident. Other officers similarly trained, similarly situated did not shoot him ten times. They did not act that way. I think that is a very, very strong part of this for the prosecution. Critical. Because thats the legal standard. Because im right. You are right. And im going to tell you why. The Supreme Court has said that you measure these things by what an objective officer would do a reasonable officer in that officers position. You have three officers there, two are not shooting and i think the prosecution is going to i want to show you something from today. He did what he could to show that other officer who responded who did not use this gun. To your point. Watch this. When you ran around to the end of the defendants car and saw observed the defendant shooting him, you never pulled your firearm, correct . Correct. And when he ran past you, you call what you told what you were going to do . Yes, sir. What was that . Possibly put him in a sleeper hold. A sleeper hold like a chokehold. To your point, not pulling a weapon. Looking potentially, as equally as important, how the other officers responded. This is something i talk about all the time. I talk about officers being trained to deescalate. Deadly force is your last option. When youre talking about a case where three other officers are experiencing the same thing in realtime rather than pull their weapon and shoot 12 times, these other officers were looking at the scale of escalation and they were saying i maybe would have put him in a chokehold which we can talk about that with the eric garner case. Im not sure thats the appropriate method but he chose not to act as this officer did and i think thats going to be so critical to the prosecution and perhaps to the jury. Absolutely. But very important to note and this is the Supreme Court says officers have seconds to act. Thats also why it hasnt been indicted in 30 years, absent potentially that video there would have been an indictment here and weve spoken about the first grand jury not even indicted. Times are changing. They certainly are. And the communities are demanding accountability. And i think thats what is taking place here. Sunny hostin and we have video surveillance. Dashcam, et cetera. They are confused about what unlimited means. They wonder if they take six weeks vacation, are they sending a bad message to the boss. Theres a concern there. But i believe for this one, women and men and i think this is very different in the sense that i have my own personal experience cht i was a federal prosecutor working for the federal government. I had a problem pregnancy, a torn placenta. I had to borrow leave. Other prosecutors had to donate time for me so i could spend time off. Thats insane. And i had to cobble together medical leave, shortterm disability and all of this and i only got three months off. I can tell you that with my daughter and i was at a private firm as a partner, i got less time. You cant get that time back. You cant get the bonding time back. Youre a nursing mother. You are still irked over this. Im still upset about it because i really feel in terms of having a healthy relationship with your child and a healthy relationship with yourself. Right. The mothers guilt that comes from having to leave your infant home with another caregiver or a Daycare Center when you would love to be there is its a feeling unlike anything else. And i dont know what it is about the Tech Companies, the googles and facebook and ive been to these workplaces where you roll in its sort of show up wherever you want but they get their work done. They get their work done. They believe in if it you have good work life balance, youre going to come to the table and innovate and have better ideas. I feel like these companies are setting the stage. Hello, rest of corporate america. And hello america. Were way behind European Countries in this. I think its disgusting quite frankly, that in our country today women who make up so much of the workforce have to sacrifice their bonding experience with their child to be a productive person in our society. I think its disgusting and i still think what the federal government did to me when i was a young thriving prosecutor is despicable. Its despicable. There is an issue about women. Companies want to attract women. Other Companies Want to as well. There you go. This is the way to do it. Get them back in the workforce when they want to be there anyway. You mentioned briefly, culturally in europe australia or wherever else they take vacation and its like hey, i didnt take my vacation time. Its perceived differently. Because we think as women well be penlized and put on the thats not just a women and male thing. I think its changing. In fact montano does not have a tennessee drivers license. Our investigation shows that he arrived at the theater 20 to 25 minutes before the film began. He actually made a stop in the dollar store before walking over to the theater. He purchased a ticket to the mad max film requested a cup of water and went into the auditorium. In the minutes that followed there were two women also seated in the auditorium. According to those women, montano was staring them down. He was carrying a backpack duffle bag as well as a backpack. At one point, he stood up put the backpack on the duffle bag on went toward the women, suddenly put the bags down and sat back down. Ultimately he gets back up goes to the row where those two women are and abruptly and suddenly without any provocation, begins dousing them with chemical spray. The man seated with those women, who you all met yesterday, steven who spoke outside the theater, attempted to intervene on behalf of his family members. It was then that montano used his ax hatchet to cause a laceration to the mans shoulder. Those persons then fled the Movie Theater. Montano actually blocked one of the doors forcing those inside to go out the opposite door as they ran out. As you know officers were working at a crash nearby. The sergeant will talk about that in a moment. Individuals ran to those officers Police Officers rushed to the scene. Well talk about that in a moment as well. After officer fritzs encounter and he backed out, members of our s. W. A. T. Team entered the theater. At that point, the movie had been stopped by a member of the Police Department. The film had actually begun when officer frith was in the theater but the film had been stopped by a member of the Police Department. The theater at that point was dimly lit. The s. W. A. T. Officers responded that montano moved to a position of recover. They gave him repeated instructions to he directed himself and his arm up towards the officer prompting and the officer at that point believed montano had fired at him. The officers reported the s. W. A. T. Officers reported that montano was also hurling objects at them including canisters. Canisters of pepper spray. There was he was also carrying a canister of propane. Our close examination of that canister of propane shows that it was gashed probably by the ax hatchet. He also had lighter fluid and a lighter. Theres a great possibility that he intended on using this propane canister as some type of an explosive. However, when he gashed it with the cutting instrument with the hatchet, all of the propane escaped, essentially rendering that propane tank useless as far as an explosive is concerned. The s. W. A. T. Team members continued to try to bring him into custody. Again, he refused all of their commands. Ultimately he decided montano decided to go to the rear door of the theater. Before he actually exited he threw the gun he was carrying. It is possible that gunfire from s. W. A. T. Team members damaged that gun. As you have seen a photograph of it it looks like its a state of disrepair. Its possible that the gunfire from the s. W. A. T. Team members as they were shooting back at his arm that he kept reaching around toward them actually damaged the gun. When montano came out the theater, out the rear door he had a hand up underneath the duffle bag that he was wearing over his chest. The officers at that point perceived that he could have an explosive in that duffle bag. He was also carrying his hatchet or ax in the other hand. The officers deemed him to be an imminent threat and at that point opened fire on montano and he was fatally wounded. The investigation is continuing. The officers involved remain on routine administrative assignment as is practice in the department while the investigation continues. Throughout this matter we have talked to a number of people, a number of witnesses. We have yet to find anyone who had any dialogue with montano other than the simple purchase of the movie ticket and the request for a cup of water when he entered the theater. We have yet to find anyone who engaged him in any dialogue. His motive for all this is yet to be determined although we know and you all know he has mental issues he has been diagnosed as a schizophrenic in the past. My understanding he was committed at least three times and has a commit tal in another state. Hes been in a number of states in the eastern u. S. Over the past several years. At this point, im going to ask officer frith to explain to you his arrival, what he encountered and what he saw and what he did. I want to remind you that the Police Department is making an exception to our policy officers involved in Critical Incidents are not subjected to media interaction or involvement while the investigation is taking place. Were going to make an exception today but questions, if any, will be very limited. And the same goes for the sergeant. Officer frith . Good morning. Yesterday i was working in the area of the hickory mall around 1 13 i heard over the radio that there was an armed suspect in the theater. I was in close proximity with another officer and we immediately responded. Myself and three other officers responded. We all arrived pretty much at the exact same time. At that point, i noticed there was two citizens that were possibly wounded immediately called for an ambulance and knowing that again, the information that he would be a suspect was still inside immediately proceeded into the theater to actively engage him. We were directed to the theater where he was at which was theater four. I directed two officers to hold security on that on those two doors, and myself and another officer went upstairs into the projection booth where we tried to clear the theater as we could. We were unable to identify any civilians or shooter at that point. At that point we went back down to the entrance of the theater and just by pure chance i went to the left and immediately upon entering the theater, i was engaged with what i perceived to be small arms fire from the small caliber handgun to my right i heard three audible pops from what i can recall and i felt what felt like a discharge from a weapon the pressure hit me on the right side of my face. At that point, i turned to my right and immediately engaged the figure because, as mr. Aaron stated the movie was still playing and all i could see was the silhouette of the figure. I engaged that silhouette with my rifle and waited for the other officers to come and sergeant you can take it from there. I had worked the accident just down the street and had just left that scene when i heard officer arnett call for a man with a hatchet and a gun at the theater. So i started backing out and when i arrived in minutes, i encountered the two females and a male the same victim that officer frith had encountered on the front sidewalk. The females were covered in a dye that covered their shirt down. It was a redcolored dye and thats common in some sprays and the man told me he had been hit with a hatchet and i said where and he showed me the gash. From that point, within seconds of talking to them i heard a gunshot inside. I knew they were inside clearing the building. I moved to the front door and could see them up the hallway, moved into the front door and encountered officer frith with his patrol rifle covering a doorway and i had asked him what happened. He said the guy came to the door he pointed a pistol at me and pulled the trigger. He said i stepped back and shot. I asked officer frith, did you hit him . He said i dont know. I shot center mass. From that point, i directed them into a hallway other officers into a hallway of cover. Other officers were arriving. We didnt know whether there were still folks in other theaters so we took up positions to cover them both sides of the hallway. Tactically cleared that made it safe. Went into the theaters actually two people had come out and tried to get out. We held them in place until we made it safe. We pulled them out and took them out under the cover of officers. When we had that secured, we held what we had and checked on the eta from our srt or spot team. When s. W. A. T. Arrived, they immediately came in with their patrol rifles. The decision was made to enter the theater. This theater is set up i dont know if youve been giving maps but the theater is set up with doors that face each other and open out. A brief plan was made for use a flash bang. That was relayed to the officers in the hallway. When they opened that door the flash bang was deployed the s. W. A. T. Officers went in and got behind the rightmost outer seats, rear seats, and took up a position there. Within seconds, they encountered the subject at the far end of the theater and shots were fired. There were i would be afraid to say how many shots were fired, but severity. There were two other three s. W. A. T. Officers behind the seats and one standing. What we also encountered was tear gas that was so dense that he had put into the air, i guess, with the canisters, and it made it nearly impossible to breathe. When you encountered it, it was real heavy, too. When that happened i had taken up a position in the doorway where i could see what was going on with s. W. A. T. And could see the officers in the hallway. We radioed for a gas mask. All the patrol officers have gas masks. We didnt realize it was going to be that heavy. When they brought us masks, i saw the officers with masks, ran, got them brought them back to the s. W. A. T. Officers who were still in the theater engaged with the suspect. When i say engaged, there were multiple engagements there was one, stop see what hes doing, he shoots at them some more and he engages them again. I dont know you may be able to tell me how many times that occurred but gave the gas masks to the s. W. A. T. Members, they suited up with those and were better equipped then to deal with the problem from that point, that continued, i embarked out and watched the outer perimeter until the suspect exited out the door where the officers on the outside dealt with the threat. All right. Youve been listening to quite the details from they two nashville Police Officers what really unfolded this time yesterday, the active shoot speaker, in the national area. Its noteworthy they said essentially breaking protocol and talking to members of the media, talking to the public to explain what happened. I i think one of the takeaways one of the bags they were really worried because of the propane and gases there could have been a planned explosion. Again that suspect David Montano is dead. Next bounty hunters surround a home where they think a fugitive is hiding. When that door opens, its the police chief. That story is next. Instead of busting a criminal, a bouty hunter became one. This was the home of the police chief, the cell phone video shows the attempted raid at this Police Chiefs house. 11 bail bondsmen were part of the operation, and the owner is charged with trespassing and disorderly conduct. They wouldnt go off of some sort of social media and break into a house looking for, you know a criminal. Thats what i was left wondering. Apparently this tip came from social media. I imagine you get a lot of tips. How do you vet them . We investigate them do title searches, we investigator the person giving the tip s you know, we use all of on you resources. We have a lot of retired Police Officers working for us all our guys are bonded insured, so they have a lot of information that they have access to that the general public doesnt. What is a bail bondsman . And how do you make money . Basically bail is set by a judge. People cant afford to pay cash so theyll hire a bondsman pay us a premium, which is a nonrefundable fee, theyll pledge collateral. When the case is over the collateral runs. If the defendant does not show up in court Phoenix Police point out several of the people who tried to raid the home they had handguns and the job has serious responsibilities but when you look at the laws and the policies you say this would never happened here in new york you know but its different arizona compared to new york. Basically in arizona all you have to do is present year fingerprints to the state, and you become licensed. In new york city you have to have training you have to take classes, coalses, you have to be fingerprinted, background checks done on you. So its an expensive process to get a license in new york.
