Of violence against africanamericans perpetrated by Law Enforcement, Police Officers and the black lives Matter Movement across the country. Having said that and i will reiterate, its the goal of my office to seek justice in whatever form that may ultimately mean is still undetermined. However, the investigation thats being conducted by the Texas Rangers, assisted by the fbi is ongoing and in real life in realtime things take time. They are diligently working and consulting in my office advising us and letting us know what they are doing. Today, we have a bit more information that were going to share with the media and the public to try to have some idea of what went on in the Waller County jail and to understand what was going on in theof miss sandra bland. This is another piece of evidence that we have. There are many more that need to be gathered and observed and analyzed by the authorities that are investigating in my office and again ultimately by the Waller County grand jury. Todays purpose of this press conference is to share some information from the Harris County medical Examiners Office regarding miss blands autopsy office. Today i have joining me two of my prosecutors that ive made preliminary assignments to on the criminal cases that may result from this incident here in Waller County. I want to reiterate that were dealing with two different incidents. The incident on the side of the road in prayirie view and the incident of miss blands death in the Waller County jail. I have today with me here to my left in a suit warren and i will be actively engaged and handling any matters that arrive that involve miss blands death in the Waller County jail. Warren is a longtime Harris County prosecutor. He teaches around the country on that subject matter. Joining him to his left is miss mia magnus a senior prosecutor mia joins me in her Prior Service and also has 20 some odd years of experience prosecuting cases in the city of houston. And im here to tell you to the state and the world and the nation this office is well able and equipped and ready to handle any of these case if criminal charges are deem necessary. Any of these cases have criminal charges that are deem necessary. Miss magnus will be handling in conjunction with Tiffany Bradshaw any criminal that may be determined to be committed by the dps trooper on the side of the road. I want to reiterate, once again, at this point it has not been determined that there have been any criminal activities or charges by any party at this time. I also want to clarify because i keep seeing it coming up that there are multiple investigations. The department of Public Safety is condutcting their own investigation. The trooper did violate dps policies and that i was not happy when i saw that video. Thats a different story than what he did that amounted to criminal violations. If after all of the evidence is gathered analyzed presented to a Waller County grand jury that a determination has been made that there are criminal violations my office would have a part in that. Secondly as far as the jail and the sheriff, the fact findings by the Texas Jail Commission those as well are civil violations that will be dealt with in the civil courts or in the administrative areas of texas law. Those violations even though they have been determined are not something that my office deals with as far as criminal prosecution. And in that respect, thats why im not commenting today on the procedures being used in the jail. Having said that im going to call up mr. Defam. He has a presentation that hell be making in regard to the findings of the Harris County medical office. He may or may not be taking questions after that. Miss magnus will not be taking questions today in this press conference and i would ask that you would allow her time to work on her portion of the case. Please do not contact her. Appreciate you being here and appreciate the opportunity to come before you and detail for you the pathological findings that weve received in this case. There are not going to be any opinions expressed about whether or not a crime has occurred or any facts that occurred in this particular case. These are simply pathological findings as discussed between me and members of the Harris County medical Examiners Office. I do intend to display some photographs to demonstrate some of the pathological findings that we will be discussing. However, i am first going to discuss them and their significance or potential significance in this case before i display the photographs. Once if any of you are streaming live i recommend that you not show these because some of these may be graphic. We do not want to display these to the public but want to make them available to the immediate kbra to understand the significance of what occurred in the jail and the cause and manner of death. The Harris County medical Examiners Office as you know has listed the cause of death as hanging. And the manner of death as a suicide, based upon the physical and pathological findings of their highly qualified assistant medical examiner in this case which has been reviewed by dr. Wolf who is second in command at the Harris County institute of Forensic Science. Mr. Math iis has a difficult job ahead of him. He has to ball the privacy interests of the family of the publics right to know of the media access to an open and honest government. Hes done an excellent job of conveying to the media that limited information that we have as it becomes available to you and the media so that you can convey it to the public. Some of the information that were releasing today, we feel compelled to release because of specific allegations from some individuals about the circumstances that occurred in the Waller County jail and or on the streets of prairie view texas. So with that im going to start discussing some of the more significant pathological findings the autopsy report will be discussed with the Harris County institute of Forensic Science. It may be made available tomorrow. Keep in mind a distinction between pathological findings versus the toxicological findings. Theres been Significant Interest about the toxicological findings. First of all, the Waller CountyDistrict Attorneys Office the Texas Rangers and all officials investigating this case are confident that the Harris County institute of Forensic Science did an excellent job in the autopsy. We have not asked for and nor do we intend to ask for a second autopsy. Some of the confusion that may have come about with regard to the second autopsy request may have been done at the request of the family of miss bland. They may have requested a second autopsy for themselves. That is with their purview and capabilities. We would endorse whatever they want to do and we hope they will be publicly disclosing their information as we have been with ours. The second information is, in reference to toxicological findings. Theres been claims about a substantial amount of marijuana found in her system. I can tell you that there has been a confirmation of those results. However, the results are preliminary and were done through a specific scientific test that is done in the field to determine the presence of marijuana test. Thats an enzyme test which is a very reliable screening process. We have requested and the Harris County institute of science has done tests through the standard used by forensic labs around the country and is accepted around the world and, again, being the Gold Standard for toxicological testing. That may be released tomorrow. There is a set protocol for incustody death to look for certain substances in these types of investigations. Mr. Mathis has asked for additional testing on behalf of Waller County. Were listening here to this News Conference being given by a number of officials in the death of sandra bland and they are about to view some photographs to make some examples from this autopsy. Were going to pull away from this right now and come back to it momentarily. I want to pivot to donald trump there about to speak. Presuming these are live pictures along the u. S. mexico border. I have Jeremy Diamond on the phone. Lets just listen to donald trump. Id like to introduce, first the mayor. Hes going to say a few words and we were treated so nicely and learned so much in such a quick period of time. The mayor has done a fantastic job. Good afternoon, everyone. Im the mayor of laredo texas, and were excited to have mr. Donald trump here in laredo texas. Its presided us an opportunity to show mr. Trump what laredo is all about. Its the number one land port in the nation. We do laredo per se does over 40 of the mexican trade. Laredo is known for obviously transportation. You can see the big trucks behind us and we are now nafta has been very good to us. Were excited about that. We also have oil and Gas Production in our county and also provides a revenue to us. Mr. Trump has brought up certain issues. The immigration issue, in particular. We at least i feel particularly that Immigration Reform is needed. We need protection in the border area. We need to secure the border but we also need other elements. You know obviously the immigration to enact a bill. With that in mind its a pleasure to have mr. Trump, the excitement that he brings is also very on the plus side for our city and we appreciate all of the attention comes from this gentleman right here. Thank you, mr. Trump. Mexico is absolutely booming and jesus, the city manager and pete have done a great job here and the fact that mexico is doing so well its just doing beyond beyond what anybody ever thought. I have thousands of mexicans and hispanics and when it comes right down i dont know if you saw the poll but they did a big poll in the state of nevada and im way ahead and, more importantly, as far as im concerned, im way, way ahead with the hispanics, well into the 30s. Second is at 11. I have a great relationship. Over the years, thousands and thousands of hispanics have worked for me and now work for me and the relationship is very good. Question . [ inaudible ]. How many people ki8lled . Five people were killed by marines. By american citizens. That means that killers come from all over the world. Yeah i agree with that. They come from here and all over the world. I agree with that. You keep seeing that theres a danger but the crime along the border is down. What danger are you talking about . Theres great danger with the illegals and we were just discussing that but we have tremendous danger with the illegals coming in. Have you talked about your fear to the mexican officials about sending them over the border . Yes. I have heard it and in fact the Border Patrol invited me. I think most of you have that invitation. We sent it. The Border Patrol invited me and then canceled because, frankly, they dont want to get involved. The reason they invited me was because of a tremendous problem and the tremendous crime and all of the things that you are talking about so they invited me and then at the last moment i mean we were virtually in the air and said we cant get involved. I heard they got those orders from washington. What evidence specifically have you seen . Well be showing you the evidence. How . [ inaudible ] called you a racist. We just landed and there were a lot of people at the airport and they were all waving american flags and in favor of trump and what im doing and virtually everyone that we saw, there was such a great, warm i was actually surprised. But there was such great warmth at the airport with all of those people that were there. Were very very honored. Yes, go ahead. Its one thing to say thing they were chanting for me. [ inaudible ]. I didnt see that. Being here on the border [ inaudible ] . I think meeting the mayor and jesus, the city manager, these are tremendous people. They are doing a tremendous job. Come on jesus, say a word. This man im going to steal him to run something for me. Hes fantastic, the city manager. Thank you, mr. Trump. Welcome, everybody, to the city of laredo. You know this is one of the greatest cities on the border and were a vibrant city and, as mr. Trump mentioned, the trade that we have here with mexico this is where the rubber meets the road and all of you can see it right behind us. This is where all of the trade comes through that mexico at United States have in common right here. And not only that this is where it goes to the rest of the world. Ill tell you what we wouldnt be where we are if it wouldnt be for the support that the mayor and members of the city council that are also here with us councilmembers we have very fortunate to have the support that they provide for us in order for the city to be the number one land port in the country. Thank you very much. Why is immigration [ inaudible ] mr. Trump that the way to make the border safe is to build a long wall . Thats a federal issue and we have our comments on that. What is your comments . We dont think thats necessary at this time. I think theres other ways that we can Work Together with the federal government. I think right now we have a process that we Work Together with Border Patrol and everybody to be able to get these things done. The relationship that the city of laredo has with the federal government with all of the Law Enforcement agencies is a tremendous one. Thank you. This is one section. But there are different sections. What could you do to change the illegal immigration well the one thing you have to do and, as jesus was saying and the mayor was saying theres a huge problem with the illegals coming through. And in this section its a problem. In some sections its a massive problem and you have to create you have to make the people that come in they have to be legal. Very simple. [ inaudible ]. You have to let people do their job, the Border Patrols, which, by the way, i see the unions are very much involved with the Border Patrols but you have to let them do their job. They want to do their job. Thats why they invited me. I didnt come here. The Border Patrol invited me because they have such a problem. They want to be able to do their job. If they cant do their job, believe me they are unhappy. They want to be able to do their job. Are you still in favor of a wall . In certain sections you have to have a wall. And by the way, the wall the wall will save you a tremendous amount of money but you absolutely there are yearareas that you have to have a wall. What about the threats from el chapo . I dont know anything about it. In the last couple of days you said that if the gop party didnt treat you better im a republican im conservative im running and in first place by a lot, it seems, according to all of the polls. I want to run as a republican. I think ill get the nomination. Well see soon enough. I think ill get the nomination. The best way for me to win is to get the nomination and run probably against hillary. Hillary is the worst look easily shes the worst secretary of state in the history of our country. Shes going to be beaten and im the one to beat her and i will take jobs back. S. History. Lets talk to Gloria Borger lou girgulo and daviding a ingaguilar. Grower yeah gloria, what struck you . That somebody locally seemed to be saying its not necessary to build a wall at this time and then when mr. Trump was asked about it he said that in certain sections you have to have a wall so i think while everybody gathered agreed on the immigration problem, i think that there seemed to be a little bit of disagreement on the immigration solution. Also i think he was a little softer on running as a thirdparty candidate. He didnt he didnt trash the Republican National committee. He said he wants to run as a republican. Right. He wants to run as a republican. What he said to the hill was a not so veiled threat. If he runs as a thirdparty candidate, he can selffund and this is going to be a very close election. I do think he kind of softened that. I think he also said that hell be showing evidence about his theory that mexico is throwing criminals across the border. He didnt show it but said he will be. Let me lou, with you, let me hone in on what donald trump said. I talked to the editorinchief of the hill and he interviewed donald trump. Hes very frustrated with the rnc. They have opined when it comes to their feelings on donald trump. Reince priebus, the chairman, essentially called him up and said tone it down. Whats the story here . Does donald trump want to run as a republican or does he want the thirdparty ticket . I think theres no doubt that mr. Trump wants to run as a republican but hes looking for fair treatment and, unfortunately, sometimes a Party Chairman on both sides of the aisle come out with comments that negatively impact the openness of the race. And i think mr. Trump is looking for a fair shake from the rnc and i think if he gets that theres not any question that he wants to run as a republican. His message is resonating and i think that the Republican National committee has to take notice because if they dont, obviously they are not going to have another winning election. And we need as republicans, a candidate who can articulate the concerns of the public and clearly trump is articulating those concerns. Immigration is a huge issue and cant lose sight of it. Can we do we have the polls . Id love to show the abc Washington Post poll. It showed well have the numbers in a second but if it comes to be a jeb bush Hillary Clinton race you have how it would result between those two. But if donald trump were to run as a thirdparty candidate, he would take a significant chunk of the votes from jeb bush ala the ross perot incident a number of years ago. What would it take for him to say im not running as a republican im running third party . I havent spoke to donald trump about that but from all indications close to him, his interest is not to run as a thirdparty candidate. I think his efforts in going to the border today in visiting multiple states is not just casing the New Hampshire primary, the iowa caucuses. He has a National Strategy geared to be able to win across the country. People are taking notice and i think, brooke, we all have to realize there is a loss of the parties. One only has to look at Bernie Sanders. The number of people that hes drawing is significant and with that i think the republican and democratic parties better take notice of these two gentlemen before they find themselves in a difficult position. Yeah. Let me loop back on that point with david. I want to bring your voice in with u. S. Customs and Border Patrol protection. You know how this works. When youre hearing, you know some of what donald trump said about building a wall, at least having a wall at portions of the border he was also saying that the Border Patrol cant do their jobs. Can you just fact check that for me . Whats true . Whats not . Sure, gloria. Thank you for the invite this afternoon. Its brooke. Brooke. Whats critically important here is to put forth the reality and theres been a tremendous amount of advancement in the border area. Today as we speak, we are literally 80 below what used to be the apprehensions as recently as 2000. The numbers this year on detentions and arrests are going to be at about 350,000. The peak year was in 2000. In addition to that the country has added a tremendous amount of personnel and technology and infrastructure to include a wall that was designed by the Border Patrol itself placed exactly where it needed to be. Now, does more work need to be done on the border . Absolutely. The status of the border is somewhere between a more secure than ever border before and a border out of control. Its somewhere in the middle. More work to be done but a tremendous amount of work has been done. And what we need to look at is the thriving nature not just of the border but the border region where our two countries meet. Over half a trillion dollars worth of trade on a yearly basis now. Over 1 Million People a day cross these borders into the United States on a daily basis. The businesses are thriving along the entirety of the southwest border. Some of the safest cities in our nation basically, exist along our nations border with mexico. The work continues. The men and women of the Border Patrol continue to do an outstanding job. Today as we speak, the men and women at the ports of entry are doing a great job and were seeing more apprehensions of narcotics at the port of entry literally because of the work being done between the ports of entry. Its being forced towards the ports of entry. You would know. You would know. Sure this is your realm of expertise. David and gloria and lou, stand by if you will. I want to bring in Jeremy Diamond who is on the phone. Hes one of our cnn political reporters and hes actually on the ground there in right along the border. Hes traveling in the midst of this scrum in laredo texas. Youre there, you heard that News Conference. What of all of this has resonated down there . Hi brooke. We just left the press conference at the border where trump you know what he was saying he was going on about immigration. He was going on about mexican trade. But i really want to take you behind the scenes real quick because the scene was pretty intense. It was the Classic Media circus. When he got to the podium he took a pause there and said wow. It was really something. Even for him he was kind of surprised at the amount of media there, or at least kind of taken aback at first and from there you had reporters hurling questions at mr. Trump coming out of a meeting with the mayor who is a democrat and its clear that they have policy differences but both were very respectful and it was definitely an Interesting Press conference. Im curious, jeremy you talk about the trump media circus. How many people were there behind the media that we cant see . There were dozens of reporters being shipped right now in two different buses. Kind of this big trailway kind of bus. There was more than a dozen cameras there. I saw at least four different telemundo channels. Thats to tell you the interest there, not just from outlets englishspeaking outlets but a lot of Hispanic Media on the ground here. Gloria borger given all of this im curious. Lou made a point ive talked to a number of huge Trump Supporters saying listen hes resonating with americans because they are sick and tired of washington and he doesnt come from that perspective. Yep. And they have a point. You know, i think if you look at the election as it is playing out so far and we are a while away from the election. Yes. Youd have to say that a substantial part of both parties coalitions are antiestablishment. Look at the trouble that Hillary Clinton is having right now visavis Bernie Sanders and some of her own numbers on whether she cares about peoples problems because she is viewed in the political arena. And then you look at the rise of donald trump who is viewed as antiestablishment antipolitician. Hes very relentlessly on message about this. And i think it does resonate with a segment of the Republican Party and i think and the people i talk to and other campaigns, their hope and establishment republicans, if you will their hope is that Trump Supporters are more message loyal than personally loyal to donald trump. That at some point if he doesnt succeed as the nominee, that they are hoping that they can transfer those people into support for the Republican Party its very tricky for them because trump has had his feud with the Republican National committee and, you know they have to navigate this very carefully or else they worry that they are going to push him into a thirdparty candidacy which would really hurt them. I mean we talk about ross perot. Right. Remember this. In 2000 ralph nader got less than 3 of the vote and if you talk to people who support al gore they will tell you to this day that nader threw three states and al gore would have been president right now and only had 3 of the vote. So close elections, thirdparty candidates really matter and, you know you heard mr. Trump say i dont want to be a thirdparty candidate. He wants to be a republican. But he has the money to back it up. Gloria borger and David Aguilar and lou thank you very much. When we come back, the aurora colorado shooting case of james holmes. We have a verdict in phase one. Back in a moment. Breaking news right now out of colorado where the jury has reached its first verdict in the sentencing phase in the trial of james holmes. Lets go to ana cabrera. What have they found . James holmes could possibly receive the death penalty. There are three phases of the sentencing hearing, this small trial expected to take about a month. They just finished phase one in which the prosecution had to prove beyond a reasonable doubting a griaggravating factors. What they did was they come back with their verdict saying the prosecution proved four aggravating factors and this moves into the next phase. Its the defenses turn to put on a case of mitigating factors, reasons why they believe james holmes life should be spared and that he should be sentenced to life without the possibility of parole. They will present character witnesses, family members, friends. We know the jurors will hear from a fifth grade teacher of holmes and likely really emphasize holmes Mental Illness. During the guilt phase of this trial, we heard from several Mental Health experts who all agreed holmes suffers severe Mental Illness. Now, the jury did not believe that that Mental Illness made him insane at the time of the crime which is why he was con convicted of murder but that could play a key role here in the sentencing phase. The next phase is crucial because the jury will they be determine whether the mitigating factors that the defense presents outweigh the aggravating factors that they found him guilty on. If they outweigh they could decide that holmes should be sentenced to life in prison without parole. If they dont find that to be the case it moves to a third phase in which well hear from the victims who and their impact statements prosecution trying to make their case for a death sentence and, again, that will ultimately be the end of this case when they move through that phase and will decide on life in prison or parole. This just keeps moving along, brooke. Okay. You are all over this, ana cabrera, appreciate the updating there in the phase one. We are going to take a break. She was arrested for resisting arrest and was placed in a jail cell and then committed suicide, say the sheriff. The details of the autopsy are next. The other breaking story of the day, new details from the District Attorney in Waller County texas, speaking out about the death of sandra bland. Officials there say scabs on her back and shoulder and arms shown from her own autopsy, shes the woman found dead in a texas jail cell who may have tried to kill herself in the past. That detail comes from the Waller County jail documents. Sandra bland filled out after her arrest on july 10th. Three days later, she was found hanging in her cell. The sheriff says it was suicide. In fact he released blands intake form with her handwritten responses. These are some of the questions she was asked. Have you ever been very depressed . Yes is marked. Do you feel this way now . Yes. Have you had thoughts of killing yourself in the last year . Yes. Are you thinking about killing yourself today . No. Have you ever attempted suicide . Yes. And it shows it was because she lost a baby. But while this paperwork may help to confirm perhaps this was indeed a suicide, it also contradicts it because another page this one typewritten here shows this under the question attempted suicide, the answer is no. Waller countys d. A. Says bland had marijuana in her system and that brings us todays News Conference at the top of the hour. Joining me now hln legal analyst joey jackson and cnn contributor and forensic scientist lawrence koblinsky. Joey you heard the whole News Conference and what they said about the mark onss on her body. There was a phone call apparently she made early on. We heard the message that she left with what appeared to be inconsistent with someone who wants to commit suicide. She take as job, she moves and went grocery shopping. It was a major concern as to whether her state of mind would be consistent with someone wanting to commit suicide. But what the prosecution did was look at the forensic evidence examining what it may show in terms of suicide versus an actual you know someone killing her, doing something inappropriate to her. And what they did was focus on the body parts. In terms of looking at the hands, what they were talking about, there may be defensive wounds in the event that there was someone who attacked her and those defensive wounds on the hand would be consistent with some type of struggle. They were nonexistent according to the prosecutor. In addition to that, fingernails. Perhaps in the event youre involved in a fight, there may be something under your fingernails. They looked at her neck strangle, they said it was more consistent however, with someone who would have committed suicide. In terms of the back what they looked at on her back that may be consistent with what occurred on the street in terms of her encounter with the police department. So what they did and also showing the graphic photographs, was to establish that these are the different body parts in addition to others and it would appear according from the forensic examination and testing, everything would be more consistent with a suicide than it would be a struggle. They even went as far as to look into the eyes showing photographs of what the eyes may show and apparently you know they become more bloodshot or theres some redness in them that would be indicative of a struggle that was violent. That was not existent. The prosecutor went through everything in an attempt to be transparent to show what happened from their perspective. Larry, this is your area of expertise. How do you interpret these details . Well frankly, i think the autopsy was well done. I think the structures in the neck were examined very carefully. I think people will pay special attention to the cartilage and the bone if it was a manual strangulation, these structures would be evident. I have heard nothing that would indicate other than a i think one of the things a medical examiner needs to do is study the and determine whether or not she had the capability of putting this trash bag above on the ceiling structure and setting this up as a hanging. We do know this was a partial hangic. Her feet were on the ground so once its established she could have committed this act independently, theres nothing else thats been found that might indicate a violent struggle took place. Okay. So the conclusion is basically one by ruling out all other alternatives. So at this point obviously toxicology needs to be done before this is completed, but finding the presence of thc is not going to make much of a difference. Yes, its a mindeightering drug but it would not explain much except for, you know people who are depressed will often use drugs, and this is a drug of use, so its not surprising. We dont have the data yet. Well have more on the tox report when its released but it seems everything is pointing to a selfinflicted asphyxia. In other words, the marine of death is not a homicide. It appears to be a suicide. Thats precisely what these officials were saying in Waller County texas, but to be clear, this is not what the family believes and theyre waiting for the independent autopsy. Im older, but thats okay. I think women and men dont realize what serious political and especially cultural transformations, legal transformations began in the 1970s that changed the world. Its a big deal. Give me some examples. You ran through some good ones there. It was the very idea the cultural idea that women should be treated squeally as men. In Public Private life. That truly was a radical notion before what was called the Womens Liberation Movement of the 1970s. Thats a big deal. I dont want to overstate it because we havent accomplished a lot of the goals were on our way. A fraction of what menner paid. A fraction of what white men are paid. We dont have an equal pay act or still, this idea that women should be treated the same as men . That came into being 23491970s. It affected us in major ways. In 1960 half of 19yearold women who were unmarried had not had sex, by the late 80s two thirds of the women had done the deed by age 18. Wouza, thats a change. I dont want to conflay the Womens Movement with sexual liberation though they do have some things in common. But it was also a liberation of men and sexuality and whole new conversation for many and it had to do with the Birth Control pill. It was invented in the late 60s. By 1969 6 million women were on the pill. That transformed bodily autonomy and sex and pleasure for the next decade. Also down in the west village, what a couple weeks ago when the Supreme Court made that ruling that all started in the 70s with gay pride, the riots, the marches, thats when it happened. Statistic stovall riots were in june of 1969 when police raided the stonewall bar. It was an ugly raid. Finally the patrons fought back protested, rioted. That led to gay pride marches. It wasnt until the 1970s that the American PsychologicalAssociation Even took homosexuality of its official list of diseases. You have this confluence related to Sexual Identity and the roles and relationship between men and women in society. Again, you know we have made tremendous strides.
