For some unknown reason the pilot crashed here on highway 285. At this time, we dont know the cause of the accident and we wont be speculating what might have happened. Ill be here for another few hours. Well be documenting the scene and collecting evidence. After that the aircraft will be moved to another site in griffin, where we will further the investigation. Where, sir . In griffin, georgia. Were going to head over to peach tree dekalb. I havent had the opportunity to go to the tower yet to see if there was any radio calls made by the pilot before he crashed. [ inaudible question ]. From what i understand, there was four passengers on board. They all perished. Know anything about the pilot . As soon as we get that ill be able to answer that question. [ inaudible question ]. Its not going to be difficult. Of course, the airplane is somewhat complex, but it shouldnt be a problem. Once it gets to Great Britain s tos to griffin, well be able to reconstruct it and figure out what happened. What are the key factors you look for . At this time im going to look at everything. Its going to to be a laundry list of items. Im going to look at the maintenance that was last done on the aircraft. What we understand the airplane just fueled over at peach tree dekalb. Also well look at the pilots experience. Right now i cant say what im going to look at specifically because i dont know. Once we start getting further into the investigation, ill be able to figure that out. What i need to pinpoint. The aircraft itself what will you try to find . Im going to reconstruct the whole aircraft and start from the beginning and just move my way through. Whats left, you can actually do that . Yes, i can. [ inaudible question ]. Im not at this point, i mean ill take everything into account, but i cant say factually i havent spoken to anybody that might have said that or heard that. Until i take a look at the aircraft im not going to speculate on that. [ inaudible question ]. No its a general aviation aircraft. The unit thats on it is an elt which is emergency locator transmitter. That wasnt needed in this particular accident because we know where it is. So theres nothing on there that will tell you anything that was wrong with the aircraft . Well, theres a lot of information there that would tell me what happened with the aircraft but until i start looking at it im not going to be able to tell right now. How long will it take you to reconstruct that . That would probably take me about two weeks to reconstruct. Then after that the report will probably come out within six months to a year. Two weeks just to reconstruct it then you may or may not have answers. Well thats speculation. Generally speaking are there specific things youll be looking for . Well as the investigation progresses there will be specific things im looking for. At this time im not looking for anything specific. Im looking at everything. All right . How much longer does the highway need to be closed for your work . Right now, once the aircraft is removed, they should be able to start opening up the highway again. So right now its being moved. As soon as its done we can start opening up the highway again. Were waiting for ntsb to conduct their onscene investigation, and were in the process of doing the cleanup. The moment we can we already started coordinating with the Georgia State patrol and other agencies so we can start cycling the traffic safely so we dont have that surge of traffic all the sudden hitting an open road. So its a very methodical system of how we reestablish traffic back on the freeway. Is it going to be opened by rush hour . We believe so. Ntsb is working very hard. So are the other folks here doing our best to try to get this going as quickly as possible. As safely as possible. Youre taking it to the airport now in griffin . Yes. So thats it . [ inaudible ]. We dont have any of that information. Were following the lead of ntsb and working with them. Thank you. All right. So those were just some updates we got from ntsb. Obviously theyre on the we dont have that information. Are there indications theyre not local . I do not have that information. Okay. We just wanted to make sure we were getting the tail bit of that. This was a singleengine plane, four passengers on board, or four individuals on board who died after this plane took off just outside of the atlanta, georgia, area around 10 00 a. M. Eastern time this morning. Crashed into the median there of a massive, massive interstate here in the atlanta area. If youre familiar this is basically like the beltway of atlanta. What youre looking at right now, unreal flames and smoke here. This is video we just got in from a driver on i285 in the atlanta area. Martin savidge, i think i have you here. Youve got a little bit more on what were looking at. Unreal. Also incredible you have these four individuals who died but given the fact this is such a massive highway in the atlanta area i understand no one was even injured driving this morning, correct . Reporter correct, yeah. Thats what firefighters say is miraculous out of this whohorrific tragedy. Although it was witnessed by literally hundreds of people because it was the tail end of rush hour. This is one of the most heavily traveled highways in the Atlanta Metro area. A horrific scene they witnessed, but thank goodness nobody else on the ground was injured, despite the fact a number of vehicles were damaged by flying pieces of aircraft. Theyve already opened up the westbound lane of i285, which is welcome news. Its friday which means the afternoon rush is probably already under way. It starts right after lunch in atlanta. So this is having a tremendous impact. Again, the greatest impact is the tragedy to the families of the victims who were on board. All we know right now is that there were three males and one female as well as a family pet. Theyre in the process of notifying families at this time. The bodies were removed some time ago. You can see theyre collecting parts of the aircraft. Theyre going to be key, especially the engine probably, because it may give us insight as to how this unfolded. It appears to have unfolded quickly. Peach tree dekalb airport, where they took off, from is about a mile away if that. Whatever happened, happened very fast. They came down on the highway, and it appears they hit the center median. As you already saw from that home video, i believe, just incredible fire. There would have been a lot of fuel for the flight. And there was heavy black smoke and not a whole lot that remained of the airframe after that. Flames. According to flight aware, the plane was headed to oxford mississippi. Thats the home of ole miss. We just heard the official saying they will reconstruct this plane because the question is why, why did this happen . He was saying what it could take two weeks to do that. Reporter right. A small general aviation aircraft like this does not have a black box. Its going to be the wreckage itself maybe some radio communications. Weve heard there were some that were made very quickly that could indicate what the problem was. The growing threat of jihadists here in the United States is leading to something huge. Security threat levels at all United States military bases in this country have just been raised. Lets go back to the chart. Today the threat level jumped from alpha, which states there is a possible threat of terrorist activity, to bravo, which means the threat is now increased and predictable. An official telling cnn that the fourstar admiral who oversees all bases in the continental United States has now signed an order raising the, quote, forced Protection Level. Perspective, the threat has not beened a bravo since the tenth anniversary of the 9 11 terrorist attacks. And all of this is happening as the fbi is warning isis is recruiting hundreds perhaps thousands, of americans online. Joining me now, former cia counterterrorism official. And rosa flores, whos at ft. Dix there in new jersey. Rosa what does this mean as far as security starting right now at bases like ft. Dix . Reporter we have to start with the end goal here brooke. That is to protect u. S. Military personnel, u. S. Military assets resources, you name it. Thats why were here. So i want to show you the lay of the land here. This is ft. Dix. This is their entrance gate. You can see that cars drive in they drive out. Were not going to be able to show you closeups of anything thats happening close to that gate for obvious reasons, for security reasons. But heres what we do know. We do know the checks are going to be random. There are going to be canines, possibly. Theyre going to be checking photo i. D. S. Theyre going to be doing things in a random manner. Why . Because thats how military personnel prepare for something thats a random threat. Now, a few things. Why . Why is this happening . Why are we in this bravo state of alert . Thats because military personnel, the security is telling us that there are possibly thousands of people in the United States who are following isis sympathizers with isis possibly in the United States. So thats what is necessary at this point in time. Now, why is ft. Dix resonating . As you know back in 2007 six men had a plot to attack this particular military installation and it was busted by authorities. Now those men, of course some of them still in jail and thats why its important. But again, we cant forget the end game here brooke. That is its to protect those u. S. Military personnel, u. S. Resources to make sure that the u. S. Is ready for any particular threat for any random threat. All right, rosa. Thank you. Phil let me tap into your intel mind here. In hearing from this defense official telling cnn, let me quote this official. There is no specific threat but the water temperature has gone up a couple of degrees. So can you translate that for me . I mean what would prompt a raise in force Protection Level here . Sure. Ideally in the intelligence world you have specificity, that is wheres it going to happen when is it going to happen who are the plotters and what kind of device are they going to use. The reason you dont see that often is if you have that kind of specificity, you usually know enough to disrupt the plot. In other words, you can arrest or kill the people involved in plotting. A lot of times what you see in this business though is information that has an informant, for example, saying hey, ive been talking to isis guys and theyre saying one of the things theyre thinking about is putting out more information to attack American Military installations. Very general. It gives you no specificity, but your option is to say, we dont have enough specificity to stop this but we want to the put it out in the event that people in charge of military installations want to do more. In this case stepping up the security level to bravo to protect their facilities. This happens it used to happen more often right after 9 11. Less frequently now. But why military phil . This is fascinating. Back when we faced the initial stages of al qaeda, they wanted to disrupt the entirety of the american economy, political system and military. The pentagon thats a military target. That pennsylvania plane in shanksville shanksville was going toward the u. S. Congress. There are people in the United States who are responsible for projecting American Power overseas. Because theyre projecting American Power overseas and killing us in places like iraq and yemen, they are legitimate targets. Theyre probably to hit. Thats not a civilian in a restaurant. Thats not a civilian in an economic zone. Thats a Police Officer and a military officer. Its a very simple way to persuade a kid whos 17 years old that if you want to go attack a target its not an innocent civilian. Its the people responsible for killing muslims in places like iraq. Back to your point about specificity and what people could be looking for or lack thereof, i know theres a lot of gray area when it comes to this. If youre Law Enforcement and youre monitoring theres so much talk about based upon what we saw in garland, texas, over the weekend. Tweets social media. If youre listening to chatter, how do you know what to look for . I have to imagine theres a lot of talk and then only certain people follow through. And you cant waste resources. You cant. Theres a couple characteristics you have to look at. Weve talked about several hundred people from north america. That is United States and canada going overseas to join isis in syria and iraq. A lot of them have come home. Number one on list has got to be people who have shown enough willingness to join a terrorist group that they traveled overseas. Like the case you saw in garland a closed case because that kid was prosecuted successfully. Which people have already shown intent in the past over history are cropping up now, continuing to talk about these issues. I tell you the problem in this case. This is what fbi director comey talked about. Several thousand people who have never been arrested who have never traveled but who have shown interest in isis. What do you do with them . Wouldnt they be on the radar . They would be potentially. One of the things you have to look at is this shift between talk and violence. People who are talking about acquiring a weapon people who are talking about actually conducting an operation. But for that number of people for a Security Service like the fbi, thousands of people talking, youre trying to understand not what theyre doing. Thats pretty straightforward. What theyre thinking. That is impossible for Security Service. When is a 17yearold overnight going to say, well yesterday i was interested in isis i was online i was following somebody on twitter. The federal government is now turning a watchful eye to the Baltimore City Police Department. Just today our new attorney general Loretta Lynch announced the Justice Department is launching an investigation into the departments patterns and practices, and this comes at the urging of baltimores mayor following charges brought against all six of those Police Officers in the wake of the death of freddie gray. Lets go to our National Correspondent suzanne malveaux. What will the doj be looking at . What does that investigation entail . Reporter this is way beyond what theyve looked at before. Before was just whether or not they were violating Police Policy but this is much much broader. The question really being, is it a pattern or practice within the baltimore Police Department to violate the constitutional civil rights of its own residents . Thats whats going to happen. It starts immediately. Brooke i have to tell you, the people who ive gotten to know in baltimore covering this story, theres a great sense of relief. They say theres been harassment and abuse thats taken place for many years among some of the Police Officers. People in this community. So we heard from the attorney general Loretta Lynch earlier today telling us that the reason why this is so important is what many people have said before which is that theres a trust that has been broken between the community and this Police Department. Today the department of justice is opening an investigation into whether the baltimore Police Department has engaged in a pattern or practice of violations of the constitution or federal law. This investigation will begin immediately and will focus on allegations that baltimore Police Department officers use excessive force, including deadly force, conduct unlawful searches seizures and arrests, and engage in discriminatory policing. Reporter so brooke this is the response from the fraternal order of police for Baltimore City. They say they welcome the involvement of the department of justice and look forward to working with their representatives to heal the wounds of our city and improve the relationship between our community and department. Additionally we suggest as part of this comprehensive expectation the doj also consider expanding the scope of their review to include the practices and policies of the mayor of baltimore, stephanie rawlingsblake. The point being here and you can kind of hear it in this statement there, that theyre not happy with the mayors leadership. They believe she in part is responsible as head of the Police Department as one of the agencies underneath, you know her own authority that she also needs to be held responsible for whats going on. Were also, as well, going to be hearing from the attorneys of the family of freddie gray. They too, are very relieved that theres going to to be some federal help in dealing with this broken city. Allegations of wrongful arrest, racist and homophobic text message, even forcing prisoners to fight one another. Some officers in the San Francisco Police Department and now nearly 3,000 cases could be subject to new scrutiny. What does all this mean potentially . Thats next. San franciscos District Attorney just made this announcement saying he has now enlisted these three retired judges who will pro bono sift through all these cases to see if people were wrongfully arrested or convicted. Heres the fear from the d. A. That the bias seen in the text may have bled into their investigations. At one public meeting, a fellow officer gave a reminder of how offensive those messages really were. Silver backed gorillas n words, monkeys. I feel personally betrayed by our department because my dedication loyalty, and service to this city is still not respected by some. Wow. Dan simon is with me. You sort of hear the tone and tenor of some of these texts. What else did they say . Brooke this is really ugly stuff, and its very serious. But first, let me give you a little context in terms of how these Text Messages came to light. They surfaced earlier in the year in the federal Corruption Case of a Police Officer. So this was a byproduct of that. You had 14 officers either sending or receiving these messages. I just want to give you a little flavor in terms of what was said. They included phrases like white power, references to the kkk, the limplgynches of blacks and repeated use of the n world. Also there were hateful words against gays, mexicans and filipinos as well. Because of this you have the d. A. Dropping this absolute bombshell, announcing that 3,000 cases are going to be reviewed to see if they may be tainted by these officers due to racial bias. This was the d. A. Explaining that announcement. I want you to think for a moment what is the potential impact in our Justice System when a juror in a criminal trial questions the credibility of the arresting officer or the evidence that is being presented because they believe that this process may have been influenced by racial or homophobic bias or some other form of bias. Can justice prevail under such conditions . Well the police chief declined our request for an oncamera interview, but his spokesperson told us that the chief has already spoken out forcefully against either homophobic behavior or racist behavior on the part of the Police Officers but hes yet to comment about this revelation that 3,000 cases are now under review. Brooke . So thats the chief. What about these 14 officers . Whats their status . Well, the chief has recommended that at least eight of these officers be terminated. I can tell you that three of them have reportedly resigned but the other six apparently their offense was not as severe as some of the others. But what will happen to them its unclear at this point. All right. Dan simon, thank you so much. I know youre working on this and will have more tonight at 7 00 with erin burnett. San franciscos District Attorney says some of these cases investigated by these 414 officers have already been dismiss. The d. A. Is also looking into a case of jailers forcing inmates into quote, gladiatorstyle fights. According to some of the local news outlets there, two inmates say they were promised hamburgers if they won these fights and threatened with mace and beatings if they refused to do battle. With me now, criminal defense attorney former prosecutor randy zelen. Have you ever heard of gladiator. Gladiatorstyle fights and that theyre betting on them . Only on game of thrones. So the answer is no. Id like to think im not being naive when i say that. When you hear about 3,000 cases and we were talking during the commercial break. You were referencing the fact that so many of these have gone through the system in a vacuum at the time. Now trying to look at these cases with different eyes how do you do that . Well lets not lose sight of the fact were always talking about evidence. Merely because a Police Officer behaved badly, brutally insanely. The evidence is still the evidence. Thats where you get into this notion of harmless error. A judge will say, what happened here was wrong, but it wouldnt have changed the outcome. The evidence is what the evidence is. But what happens is where the evidence isnt now perhaps they werent looking for it at the type. Or didnt want to look for it or buried it destroyed it changed it. So its not simply a matter of im not a nice person because i say mean things and im biased or im prejudiced but ive actually done something to make evidence go away to change the case where if true facts were known, my god, this man, this woman would not be in jail. So what do you do if they dont have the full picture, the full pieces of evidence looking back at these cases . What you do is sometimes you do is circumstantially. If you dont have that smoking gun, you develop change. You go from point a, you want to get to point d, you create chaining along the way. Common sense, this is how it must have happened. Now if you have a completely different smell in the air, the temperature in the room is different because now you know that it wasnt done in a sterile, normal atmosphere but in an atmosphere of hatred and bias and prejudice. Now all of the sudden maybe the evidence looks different because its now under a different prism. And lord only knows if youve got people in there who dont belong in that jail you got to get them out. Final question, since so many of us are or so many people in general are looking at these cases, given all these examples of Police Brutality and some not, but some are, are people going to be looking at cases now with different sets of eyes . Not just San Francisco, but anywhere else. On the one hand you want to say as a human being, i hope so. As a defense attorney quite frankly, this is manna from heaven. Once upon a time a jury would look at a Police Officer no matter what a judge said. He or she is no more credible than any other witness, but people respected Police Officers. They loved them. They protected us. If this cop said he did it then my god he must have done it. Now you have a different atmosphere. People dont trust the police. Many still do. But right now in this climate, there is definitely distrust. You get more and more and more of this and youre not going to want your Police Officer dad coming to school anymore saying hey, this is what my dad does for a living. Good to be here. Heres my question. This hasnt happened just context wise since the tenth anniversary of the 9 11 terrorist attacks. So what do you think, you know, Law Enforcement are picking up . We know its not a specific threat. Well look what you have is a situation in which there arent isis doesnt have operatives here the way al qaeda guys sent to blow up the twin towers were. What they have is a pool of disaffected, radicalized allies who might be motivated to do some freelance attacks themselves. And that i guess, is whats worry. Like what you saw with the recent attacks in texas where people drove there, tried to make some trouble, and got shot down in the process. Why on the notion why target the military . I was watching some of our coverage earlier. One of my colleagues here was pointing out back when james foley was executed he referenced his brother, and he said this i died when your colleagues dropped that bomb on those people they signed my death certificate. He was sort of saying its a soldier for a soldier. Do you think that could be part of the motivation here . Its an interesting question. Actually i think its a good thing theyre targeting soldiers and military officials as opposed to civilians. After all, the definition of terrorism is not just about the nonstate actor of the terrorist but who the target is. Its an interesting question. If were in a war against isis and isis is attacking u. S. Soldiers even if theyre noncombatants, its an interesting question whether its terrorism, but its certainly better theyre going after armed officials who can shoot back. Still, its not a good thing. Its a better thing than it would be them going after soft targets like a local mcdonalds or a movie theater. The point being, look we have im not saying its a good thing theyre attacking soldiers. My point is that soldiers know how to defend themselves. Our military has Strong Security procedures in place. I think that this is not a sort of call for the entire United States to be in an uproar and scared to walk out the door or travel to the subway. I dont think were in danger of an imminent largescale terrorist attack. Okay. I referenced your ebook a second ago. I know something you included there on isis strategy is the tactics that washington has used to combat isis mirror those that was used against id but they will not yield the same results in this new age of modern terror where these isis attacks, unlike al qaeda, they seem to be smaller, more intimate. How has counterterrorism strategies have they even caught up with that . Its actually very interesting. Isis unlike al qaeda, is trying to build an actual Islamic State on the ground in syria and iraq in the region, and thats where its real power base is. Theyre also trying to pick up affiliates elsewhere allied with their brand. Their primary focus has not been attacks against american targets certainly in the United States or even in the region. Its been gaining ground in syria and iraq and their territory and holding it and building a state there. So to extent theyre moving more towards what al qaeda used to do which is try to generate spontaneous attacks all around the world, that would be something of a change in strategy. But i think their prime focus really is more about building something thats on the ground and durable in the region than it is attacking the United States or the far enemy over here. Okay. So far, more than 20 survivors of that massacre have testified in the murder trial of james holmes. Holmes is charged with killing 12 people and injuring 70 others during a midnight showing of the dark knight rises. He has pleaded not guilty by reason of insanity. Testimony has been extraordinarily emotional. Late yesterday, the jury heard just gutwrenching details from amanda teves. Her fiance alex died wild shielding her from the bullets that sprayed that entire movie theater. I want to play some of this for you. There are cameras in this courtroom, but some of the audio, its pretty disturbing to listen to. At first, i didnt know what was going on but alex did. And he put his arm around me and pulled me down to the ground. What happened when you got down on the ground . I was just really confused. I kept asking what was happening and alex just kept shushing me and saying it was going to be okay. Until i heard someone yelling that theyd been hit. What do you remember after you heard that . I thought it was craig. I thought that was alex saying that craig had been hurt. And then i looked down at the ground at my hands, and i realized they were just in a pool of blood.
