They interviewed him guys. The first time was three years ago. The second time with that bathroom bit. By the way, you hear a weird sound. Thats him burping. He does it on camera and he talks about the burping. Like theres something trying to get out of this man. It is absolutely bizarre. The twists get twistier in this case. The filmmakers two years ago interviewed him. He says this in the bathroom. They dont even realize its on the tape until about several months ago. An editor is going through it. They listen to it and they pick it up. Heres what andrew the director of this film told cbs this morning. But his microphone kept recording. We always leave the microphone on him. He knows that. He went to the bathroom while it was recording. It wasnt until months later that we had an editor listening to material that we had left behind. Thinking now we have to listen to everything weve got. Were approximate to finish the series. We discover we have this shocking piece of audio. Here they are, gob smacked that they have exactly what they were trying to get from him during this second interview. They confronted him about all this very finite detail about the murder of susan berman, a letter sent to police then and a letter that they found during their research that had the exact same block letters, the exact same misspelling of the word beverly. Right. Miguel stay with me. To eric and bob. The first question in this whole moment where you hear on this mic, i killed them all, of course could that be used in court . I believe it could. The question is whether he had the expectation of privacy in the restroom. Thats what theyre going to argue. He was miked up doing a documentary going into his life and he was willingly giving statements and being interviewed over and over about these issues. I believe its going to eventually get in. What would his attorneys do with this this. Theyre going to argue a reasonable expectation of privacy in the bathroom. Heres the problem. He knows hes miked voluntarily. He puts it on for the interview. Secondarily secondarily, it was a statement by a private citizen. All those arguments about constitutional violations and invading my privacy due to my miranda rights they dont apply here. Hes going to have a tough time getting this thrown out. What baffles me, miguel these filmmakers of the documentary, revealed this other piece of evidence. This has been investigated for years and years by law enforcement. But they find this letter durst wrote to this victim, susan berman. Tell me about that letter. This was a letter that was written bch her murder obviously that she used to be his publicist. They were good friends. He writes her a letter from his Downtown Office in l. A. Says good luck hope everything is great. See you in the future, bob. On the envelope, the outside the address, exactly the same as the letter sent to police after her murder telling police where the murder where the victim was. Saying this address, cadaver. That was the only thing the note inside the letter said. But the addresses on the letter the exact same block lettering. And the same misspelling of beverly. When the filmmakers confront him with this he gets very nervous. He starts burping and then sort of says well that could be a common misspelling. Anybody can misspell beverly. Go to the bathroom. The first thing he says in the bathroom is thats it youre caught. Its incredible. What do you do with this . This is the type of case that we see all the time where clients have just so much rope that they eventually hang themselves. He went to this interview and i would have never allowed a client to do this. There is no way do the documentary . Absolutely not. Because that is essentially a Police Interrogation on tape and you dont have the police rules intact. You dont have your lawyer who has to guide the questions or lawyer who can object to the questions. Its just him and a filmmaker asking him questions. That is so much rope to hang himself and he probably did. Were talking about final final question. Were talking about three murders here. The first wife her bold i has never been found. Now that hes in jail they have to be asking right, about her . Hes got his lawyer. He wont be giving any more statements. The issue is what has come from the reopening of the investigation. This case in los angeles is hot with the new admission. If they get a conviction in california i would think thats the end of this. Hell be spending the rest of his life and die in a prison cell. They have to see what new information they have that ties him to this crime other than the letter and his statement. Those two things alone is enough for a jury to convict him. The letter is damaging. Its horribly damaging. Im not a comparison expert but we dont need to hire an expert to tell you. Those are the type of details that get people either convicted or found not guilty. Get them acquitted. So i dont think it warrants getting me that mad. I think ignorance is pervasive unfortunately. Im not going to lose a lot of sleep over it. I dont think a lot of people will be losing sleep over this. But i do wonder is this mindset this criticism of ivf or by the way, these are two gay men saying this about gay parents, which we have to loop back to. Ive never heard this before. Is there a vein of people. I havent heard of it before. We were talking about doing a sidebar story. In conversation with women who used ivf, they feel theyve heard people not everybody agrees with it. I think we have to probably be honest that there are people around the world, maybe in more countries than in the United States who frown on this and what i would say is thats probably because they havent been touched by infertility in their families or they havent had same sex children who have gone and had a beautiful child. I think its ignorance, but i do think that there are still people, sadly, who feel this way and its probably something we have to acknowledge. I think theres confusion between ivf and Artificial Insemination too, which a a lot of people dont understand. When we had our child people implied it was a different method. Ivf is a medical method thats been used, as i said by not just gay individuals but by straight individuals who dont have the ability, are not fertile to have children. Another story i was doing recently on the rise of the 50yearold mother. You have women in their 50s using ivf. One doctor i talked to said some of the criticism is generational. Kids growing up in their 20s, 30s, even 40s, theyve grown up with ivf. As you said its been around for decades. Maybe people older, 40s, 50s, 60s. Not as familiar with it. They heard the term of the test tube babies. Theyre attitudes from older generations. Maybe. Youre looking at Dolce Gabbana. Im talking about these two gay men who have saying they believe you should only have children who come from traditional families. I realize this is italy and this is catholicism and who knows what else. Trying to somehow get where they could be and i cant. But the fact that theyre gay and saying this about other gay people. I think its indicative of how we have come quite a ways with lbgt rights in the United States. But there are a lot of countries who have done better than we have and so many more who have done worse. There are still lgbt individuals being persecuted and killed around the world. Italy has not progressed as far as other places in europe. That mindset, there are people i know in the south who in the 90s were gay and were so apprehensive about being gay or being considered gay, that they held some of those homophobic beliefs as well. You might be seeing that in a country thats not as far as we have. Its hard to believe coming from the same sex two men who are gay, who are same sex couple at one point. Right. And clearly they said in their apologies which some said was a nonapology apology, they were saying we never meant to criticize individuals choices. Yet, thats what they did when they spoke out. Its only with the backlash theyre coming forward and saying this is our notion of reality but we dont condemn other choices that people make. Finally, i had guests last hour who were hilarious and saying we cant afford Dolce Gabbana, the sunglasses and the wallet will do. Im wondering when you i think of madonna, right who loves Dolce Gabbana. Im sure they have quite a gay who love their fashion, who are connected to the fashion world who im wondering, im just wondering what happens to the brand. I think it will hurt a little bit. You have seen boycotts that have happened for other brands chickfila, that werent quite as successful. Dolce and gabbanas base of clientele is either individuals in large cities who have progressed in their views of lgbt issues or gay men and women. Those who support them. So i think its going to be a wakeup call to them and i think they probably deserve it. I agree. I also think they need to come forward in a much more meaningful heartfelt way if they want to repair any damage that they might see on the brand and really do a big mea culpa maybe right here with you. Reporter well obviously the palestinians are criticizing these comments but everyone here knows i think what Benjamin Netanyahu is doing is trying to pander to the right wing voedters. Essentially its been things hes been saying the past few months given the fact peace talks with the palestinians have soured and the palestinians are making unilateral moves but days before the election trying to reach out to every right wing voter. These are controversial positions but to the right wing base he feels he can energize them by letting them know he hears their concerns. There is a potential wild card in this election the role of arab Political Parties which have unified now for the first time. Heres your piece about that. Reporter he is a powerful new face in israeli politics. In a sea of jewish parties, campaigning at Hebrew University he is a star attraction. But he is not jewish. He is an israeli citizen of palestinian descent, one of 1. 6 million living in israel. Come election day, the bloc he leads, dubbed the joint list could hold the balance of power, a potential game changer for onefifth of the country who for decades has complained of being second class citizens. No one can ever ignore us again, he told us. We want to close the social and economic gaps between arabs and jews in this country. Walking through the neighborhood he is welcomed as a local. I walk this street every day, he says. I belong to each shop each person. Growing up here he says he identified with malcolm x. Now the 41yearold lawyer relates to Martin Luther king. Having convinced israels tiny splintered arab parties to team up for the first time he now wants arabs to get out and vote to unseat Benjamin Netanyahu who he says fuels racism and incitement against them in their own country. What makes people vote is the hope of change he says. We are 20 of the population. Together we can prevent him from forming a government. There is some skepticism but many here believe their native son can lead them to a better place. Many people didnt want to vote before this man told us. We asked for our rights but we never get anything. This is a good step and united, we can be strong. While his focus is on improving life for palestinians in israel and the occupied territories he says he needs israeli jews to help. Arabs alone cannot make a democracy strong he says. It must be arabs and jews together. A message that resonates back at Hebrew University where some jewish students are joining the fight against what they call institutional discrimination. Its not only a struggle of the palestinian minority within israel. Its a struggle of the palestinian minority together with the jews like myself. Reporter its not a vision shared by most in israel but the message is now is their chance. By finding a voice and using their vote, they can make that vision a reality. So its impossible to predict but hours before this election how is netanyahu looking versus others who want his position . Reporter well over the last few days we know he has been down about four seats pretty consistently. He has been bleeding a lot of votes. Herzog has remain pretty consistent. The votes netanyahu is losing are going all over the place but in the last 48 hours, netanyahu has been really reaching out, trying to energize that right wing constituency and it seems to have been working. Israeli channels here tonight are reporting that hes closing the gap. Some of his right wing supporters have been out today canvassing the area really trying to get out every vote. All the analysts we talked to say no matter how it looks right now, we have absolutely no idea whats going to come on Election Night and even when the results come out and we see how many seats each person gets it really does not mean that person is going to be the Prime Minister.
