Reporter we understand they are on their way. It may have been the runway and the condition out there. Very cold temperatures and heavy snow throughout the day. Pilots are reporting throughout the day, investigator conditions on that runway. The Port Authority saying minutes before pilots were reporting that everything was okay. I can say that from everything we know at this point, that plane, when it hit the runway it lost control almost immediately and it hit that embankment about 4,000 feet down the 7,000foot runway. Its almost perpendicular to the runway with the nose, the cockpit of that airplane up over that embankment and hanging out over flushing bay. The landing gear ripped off the front. The cone of it the front part of it completely ripped off. The left wing was damaged during the landing as well. And leaked fuel. As much as a thousand gallons of fuel leaked onto the runway there. They were able to contain it very quickly and they are starting to clean that up. At this point, that runway 13 the inbound runway is still closed. The outbound runway is now open and very very slowly flights are starting to creep back on to the schedule to get people out of here at laguardia. I can tell you since they have announced the situation here in the american terminal one terminal over is much less chaotic. People seem to be getting through the terminal and starting to get on flights hopefully. Amazingly, despite how hard that plane came down and hit that embankment 24 minor injuries two, perhaps three people transported to the hospital. But everybody aok. Good news for sure. Please advise crash rescue Laguardia Airport is closed at this time. The pilots in that communication, they had no choice but to turn a different direction to go land at jfk maybe, maybe newark. Ultimately it is in general to land when the runway is open in bad conditions. Youre a pilot. How difficult is it for you to know precisely whether its safe to land . Well, there is a lot of instrumentation at an airport that give you uptodate Realtime Data what is going on the wind conditions the visibility the height of the ceiling, and a key factor is the braking action on the runway. The one thing that is required to get that information is a truck needs to roll down the runway with a sensor behind it to determine the braking action. If the weather is changing quickly, its important to get out there relatively frequently to give a proper update to the pilots so they understand what they are getting into. One thing to consider here this runway 13 was basically what we call a quartering tail wind. Meaning ideally you want to land into the wind. In this case they landed with tail wind that was partially a cross wind. The reason you would select to do that this particular runway has what we call an instrument landing system which allows you to land in worse weather than in the other direction of the airport. While the other runways would have been better for the wind you might not have been able to land because you wouldnt have been able to see the runway soon enough based on the amount of data you get from your navigational gear it. So a lot of factors that go into these decisions on whether to land and its quite possibly this glit as youre landing in a cross wind would have been banking hard to the left to compensate for the cross wind and landed and maybe in a gust maybe that wing was damaged in some way and that could have led to all of the events we have now seen unfold. Obviously air Traffic Control is in communication with pilots. We know pilots are giving the airport and controllers information after they land about what the conditions were like. We know that about two hours prior to this plane landing, one of those pilots said landing conditions were poor. Now, apparently just before this plane landed according to the Port Authority, there was a pilot who said that conditions were good. How quickly do those conditions change . First of all, you got a very dynamic situation. The wind was changing. The temperatures were changing. It was moving from rain to freezing rain ultimately into snow. So you had a very dynamic weather picture. Lets not forget its kind of a subjective thing. One pilot might say that was most problem but he might have learned how to fly in northern krarned. Canada. Who knows. A lot of things go into it and its important the airports get out there and determine what the traction is and clear the runways especially when they are in this dynamic situation. You try to get realtime information to pilots but things are moving fast in aviation. Absolutely. Planes are moving fast thats for sure. When you look at the pictures you see just how close the plane came to landing in the water. Are you surprised it didnt go over the edge . Well, frankly, that berm there, that dike probably saved the day as far as heading over into the drink. I always think about laguardia as kind of a stationary aircraft carrier. Not overrun space. 7,000 feet runways in any direction. It is, you know its varsity landing for airliners. So they need to Pay Attention and get it on the ground. Thats why you frequent get a hard landing when you land at laguardia and same as Reagan International airport and midway. A lot of short runways with no overrun space require and attentive crew and throw in bad weather and low visibility and a slick runway and you got a precipitation for prescription for trouble and that might be the series of events that led to this. All of us who drive a car know how quickly the conditions on the ground can change and you get caught offguard but these planes are coming in how fast . Maybe 160 miles an hour. A lot of speed. What they tell you to do is land and before you hit the brakes make sure youve got directional control make sure youre headed straight down the runway before you apply the brakes because you could get into a fishtail scenario. Land and compensate for the cross winds and you might be a little skew. Then further increase the braking. In this case were the brakeds ais asymmetrical asymmetrical . Or was the slipperiness of the runway not uniform and perhaps it was more slippery one side than the other. When they hit the brakes off the side they went. Some of these drivers stranded in their cars or their big rigs some 200 big rigs we are told are along this road as well. They have been there more than 12 hours and this line stretches well beyond a mile. The National Guard has been dispatched to help rescue some of these stranded drivers. Our Martin Savidge is staying on top of developments from atlanta. Martin how long have these people than stranded . Some says 6 00 6 30 last night. Most people say it seemed to bog down around 11 00 last night. We have good news for us at least a positive glimmer and that is that the National Guard of kentucky is reporting that they had been rescuing people and taking them to warming shelters. Now that process is starting to go to the reverse. In other words taking people from shelters back to their vehicles. That suggests that they have made progress on opening the roadways and you need to get the drivers back in the vehicles to get them on the move. So it sounds good. But as you point out, the Traffic Cameras show there are still hundreds if not thousands of people that have been stuck. Many of them since late last night and upwards of two feet of snow fell in central kentucky and the main highways we are talking about are i25 western part of the state and i65 in the central part of the state. The problem has been that most folks didnt have a lot of food and water. They were rung low on fuel and trying to stay warm last night. They got stuck because of the heavy snow. Its steep inclines on some of these highways. The big rigs they slowed and then eventually stopped and that backed everybody up. We are not talking a mile or two. In some cases, 30 40 even possibly 50 miles of a traffic jam oh, wow that has been the problem. Once everybody stopped, the snow continued to fall at an incredible rate and really starting burying vehicles where they stopped. You not only have to get them moving in many cases, you have to get them unstuck. You couldnt get the plows through because the vehicles were all stuck in the road so its the chicken and the egg. Get the tow trucks in and clear the traffic and get the plows moving and get everyone safely going again. Knock on wood that there hasnt been a major emergency where Emergency Responders have to get anywhere quickly according to the Kentucky Governor we just talked to no major injuries or no major fatalities. We got sound in first sound from those passengers who just got off that plane that skidded off the runway at Laguardia Airport. Listen to how they describe what happened. Probably two more inches it would have went into because the only thing that stopped us was that gate. I was in a window seat and saw the plane hitting the gate and approaching the water very quickly. You said the plane hit the gate . What do you think when you see this . Get ready to swim. Im thankful im here because once we got off the plane, i could tell it was a little more serious than i thought it was. Because, you know, getting off the plane and im jumping out the window and sliding down the wing and they say hurry up. I see gas coming out on the left wing. I dont think he expected to hit the ice i dont think so. Reporter what was it like . A little bit anxious. Qi i didnt feel out of control. I thought the pilot was in control. So i think the pilot did a good job, a really good job. Reporter eyereaction of the passengers . Passengers were calm and going woe. We knew we were on the ground and immediate sense of calmness. Then they said you can leave via the ramp and we slid our touchys down on the wing of the plane and were caught by a fireman wow. They really had positive attitudes when you think about it. Lets bring in our miles obrien who is with us a pilot himself. This has to be a total nightmare situation. If you are a pilot and you have some 127 passengers lives in your hands. Yeah. Thats part of the job, and you dont want to be in that situation, but it sounds like they responded well once it happened. One thing i do want to point out, you know, and this will come out in the investigation is this there are situations where planes get into trouble like this where there is no immediate concern of a fire. And, yet, the decision is made to send passengers out the exit doors and down the slide. In this case the slides didnt work but out the exit doors and that is where the injuries occur. Sometimes the better decision would be in fact to have the passengers sit tight and wait for some steps to come out so they can walk down in a more orderly way. I dont know International Case there was concern because of the fuel spill there might be a fire but the fact is the injuries occur in these cases mostly because people are shimmying down a wing and they break an ankle. So i thought the passengers saying just get ready to swim is a great testament to how people in these situations need to think about what they should be. People say where should you sit on a plane . I always say to them dont think about where youre putting your back side. Just keep your head in the game and know where the exit rows on. Not the primary one. In this case if you look to the front that wasnt going to get you out because of those fences. How do you get to the back one and how many rows behind you is it . What are you supposed to do . Pay attention when you land and cinch your up seat belt and be ready and think about what is going on around you. A lot of people zone out and fly without thinking and that is when you can get in trouble in these situations. A few back and neck injuries we were told. Nothing major. We are told there are minor injuries. Is that like whiplash would you think . Im going to guess most of it had to do with the evacuation. They did its quite possible they landed very hard and that could have been part of it as well. Of course, you know its not a sixpoint restraint and not even a threepoint restraint. You just got your waist belt. You can, in a sudden stop get in a situation where you cause back or neck injury but i dont know at this point where that was the cause. Her sentencing trial ended in a hung jury and after this mistrial was declared, alexandras family wept as the judge and the lawyers picked a day for sentencing. At this time the court is declaring in this trial. Are we ready to proceed to sentencing . Your honor, miss arias is requesting approximately 30 days. My understanding, from our previous conversations is april 10th was available. To the court, i dont think we had a time april 10 will not work for the state. The next of kin have requested that the sentencing be set either on a monday or a tuesday. All right. We certainly will accommodate that request. So you could hear the sobbing and the crying in the background. Next month, judge Sherry Stevens will sentence arias to life in prison either with or without parole parole. Former prosecutor nancy grace is joining me now. Nancy, i want to get your reaction to this mistrial announcement. Well, you know, i could say we saw it coming because as of last thursday it appeared as if the jury was deadlocked. But then it seemed as if there was renewed hope that this jury would reach a unanimous decision. Well those hopes were dashed today when the jury came out to say they were hopelessly deadlocked and as it turns out, the vote was 111. We have spoken to the jurors and the one juror that held out for life behind bars the other 11 wanted the Death Penalty, had actually seen the lifetime movie about jodi arias, and said she was no longer willing to deliberate with the other jurors. Frankly, once you stop deliberating i dont mean change your mind but once you refuse to deliberate further, thats when youre thrown off the jury and an alternate is brought in. You know what i noticed about the clip you just played . It was so odd the Travis Alexandra family is two seats back. Ive been in that courtroom for months. Bent over physically bent over in pain. And arias and her lawyers are just acting like they cant hear the people behind them screaming and crying. I imagine inside she was celebrating because basically they spared her life. She wont get the Death Penalty because not just one, but two hung juries. I mean does that say anything . What was it about this case . It wasnt just this one jury that had to decide her fate this was the second jury. Youre right. The first jury was also hung, a mistrial so to speak. This jury was hung by one juror. There have been two juries hearing the Death Penalty phase. One juror, one female juror held a unanimous verdict in this case. You know what i think it was . Especially in this case. These jurors indicated that coming into it this juror had already made up her mind and i think that frankly, in the voir dire process, jury selection, i dont think she was honest with the court or herself. I dont think that that juror believes in the Death Penalty under any circumstance. One of alexanders sisters released a statement saying quote, the real justice will be in the after life when jodi burns in hell. What is your reaction to that . What do you say to this family . You know what . I tell them the truth. That i have been there and been through a murder trial where someone i loved very very deeply was murdered. Time goes on and the pain never goes away but you learn how to deal with it daybyday. And as years passed travis will be alive in their mind and jodi will be a distant memory to them. You know the way that nature intends the way that god intends it they will heal but, for right now this jury is basically prolonged their suffering by not coming up with a verdict way or the life or death. Its up to the judge to decide whether she will spend the rest of her life in prison or up for potential 25 years from now. She will still be a young woman. This plane skidded off the runway bursting through a fence before stopping as you can see, just feet from those icy waters. Twentyfour people were hurt but no injuries were lifethreatening and describe the injuries as mostly minor. A total of 312 passengers and crew members on board at the time. Some of the passengers said they knew immediately when that plane touched down something seriously was wrong saying the jets wheels had little or no traction. In the meantime, in kentucky different story. Travelers stuck in a slow motion disaster. This snowstorm has turned highways including interstate 65 into parking lotting. I know youve been trapped with his family. His wife is with you as well on the highway. First, how are you holding up . Well, we are doing fine. We are prayerful and we know that god is with us in spite of the weather, in spite of the inability of the state official to move the snow and to move the road blocks. We believe that things will get better. We have been on this parking lot on i65 south since 2 00 a. M. This morning and we have just started moving for the first time. We have not seen any emergency vehicles deployed by the state. We saw one National Guardsman but not even close to any of the cars or vehicles near us. We have not seen anyone making an assessment of the conditions of the passengers that have been just sitting at a standstill for the last some 12 hours, some 14 hours, some as long as 20 hours. You must be starving. You must be exhausted. Well, we are a little tired but mentally i feel those who may have small children many of them have walked to try to get food and water. Many people are now running out of gas. With we noticed some cars have been abandoned because they have run out of gas. What have you been doing to try to cope with all of this . Well, you know, we just literally, we have been prayerful and keep each other up. At least there is a group of us. We have one young lady we pushed one young lady out who was near us on our way a gas station to pick up some supplies. I feel, you know we are concerned about the people who are traveling alone on this highway and dont have any support and that is a concern. And we have not heard from any governmental officials since we have been stranded indicating when we would be moved, what was causing the delay. So apparently this road was shut down early last evening without communicating to motorists to say, dont go any further on i65 south. We are going to close it because of inclement weather. That was not shared with any motorists. We have huneddreds of trucks and cars just lining i65 south near elizabethtown, kentucky. We understand that that line goes back possibly up to 50 miles. So that explains why it is slow going. I want to tell you, though, reverend wilson that we have gotten word that traffic is starting to move there. Im glad to hear youre starting to move slowly but surely. Hopefully, the end is in sight. We also spoke with the governor of kentucky who told us that they have sent the National Guard your way and they are making their way there to help rescue some of the folks who are still stranded who may have now run out of gas. He avoided local and federal criminal charges but it looks like former ferguson Police Officer Darren Wilson will still be headed to court. Lawyers for the parents of Michael Brown, the teen shot and killed by wilson in August Announced today they are planning to sue at minimum wilson and the city of ferguson. Now attorneys for Michael Browns family say they reject the just released Justice Department report that cleared wilson and they insist a civil jury will realize wilson did not have to shoot brown. The Justice Department report did more than assert that there was not enough evidence to file federal charges against Darren Wilson. In fact the report actually backed wilsons story. I want to quote from page 12 of this report. Its an 87page report. It says quote, as discussed throughout this report wilsons accounts is corroborated by physical evidence and his perception of a threat posed by brown is corroborated by other credible eyewitness accounts end quote. Now, listen to how attorney general eric holder spoke of browns killing as he talked about a separate report how Ferguson Police and its courts discriminate against africanamericans. Clearly these findings and others included in the report demonstrate that although some Community Perception of Michael Browns tragic death may not have been accurate the widespread conditions that these perceptions were based upon and the climate that gave rise to them were all too real. Some of those protesters were right. Im going to turn to Torry Russell from hands up united. Whether Michael Browns hands were up when he was shot has been a point of contention for quite some time. It has been sort of the rallying cry of this movement of protesters in ferguson and all around the country. Now the Justice Department is saying officially its not clear if browns hands were up. Does that make you rethink your groups perspective, perhaps even the groups name . Of course not. His hands were up. If you ask what the community would say the credible witnesses, there is some static in my ear, his hands were up even from the initial day of the rest of creative hands up his hands were up the witnesses say that and theres enough evidence at least for probable cause to go to a grand jury and beyond that to a real trial. You say you still believe his hands were up but when you look at the documents, if you read the report it goes through many witness accounts. A lot of those witnesses, some of them recounted their stories, saying they actually werent at the scene of the crime. They werent a witness at all. Other witnesses, they told different stories to different people. They told the media one thing but they told Justice Department investigators another thing about the circumstances surrounding the event. Ultimately all the witnesses combined even the credible witnesses, could not prove that the hands were up. Some of the witness accounts went against the physical evidence the ballistics reports and the autopsy reports. So how can you believe maybe one report the report that is scathing against the Ferguson Police department but not believe the report that cleared Darren Wilson . I think i even think the report is first of all, its 200 days too late. All the report came from people on the ground. All the kianas and the people he spoke about during days and weeks in jail thats who hes talking about. The report is actually finding there was no civil rights charges for Darren Wilson but you know some a little bit of ambiguous accountability for ferguson. Ferguson is just a microcosm of whats going on in American Society which is police is racially biased stopping people and it always leads to black and brown people being killed in this country. I think you bring up you bring up a good point. Because ferguson was a flashpoint in a much bigger issue, like you said. I think a lot of people in the community are now relieved they feel maybe vindicated by the findings of this second report which also found that police were targeting blacks generating unfair arrests and tickets all to raise revenue for the city. But do you think the truth would have come out if Michael Brown hadnt been shot to death . I dont think so. I think this country has a race problem. The reports show that again, poor black and brown people in this country are not given Accountability Measures against the system or the police. What does accountability mean to you . It means that we are not a case study in ferguson. That you dont sweep this under the rug. Chief jackson, they need to be fired. If they are using their Police Officers as a Collection Agency then they are violating the constitution said by attorney general holder, then either thats a racket and they need to be hit with the rico act or the department along with elected officials need to be fired immediately.
