Fashion. They have now been negotiating over the last year and during that period iran has, in fact frozen its program, rolled back some of its most dangerous highly enriched uranium and subjected itself to the kinds of verification and inspections we had not previously seen. Keep in mind that when we shaped that interim deal, Prime Minister netanyahu made almost the precise same speech about how dangerous that deal was going to be. And yet, over a year later, even Israeli Intelligence officers and in some cases members of the Israeli Government have to acknowledge that in fact it has kept iran from further pursuing its nuclear program. Now, the deal that we are trying to negotiate that is not yet completed would cut off the different pathways for iran to advance its nuclear capabilities. It would roll back some elements of its program. It would ensure that it did not have what we call a breakout capacity that was shorter than a years time. And it would subject iran to the most vigorous inspections and verifications that have ever been put in place. The alternative that the Prime Minister offers is no deal in which case iran will immediately begin once again pursuing its nuclear program, accelerate its nuclear program, without us having any insight into what theyre doing. And without constraint. And his essential argument is if we just double down on sanctions, iran wont want to do that. Well we have evidence from the past decade that those sanctions are not sufficient to prevent iran from pursuing its nuclear ambitions. And if it does not have some sense that sanctions will not be removed, it will not have an interest in avoiding the path that its currently on. So the bottom line is this. We dont yet have a deal. It may be that iran cannot say yes to a good deal. I have repeatedly said that i would rather have no deal than a bad deal. But if were successful in negotiating, then in fact this will be the best deal possible to prevent iran from obtaining a Nuclear Weapon. Nothing else comes close. Sanctions wont do it. Even military action would not be as successful as the deal that we have put forward. And i think it is very important not to be distracted by the nape of the Iranian Regimes ambitions when it comes to territory or terrorism. All issues which we share a concern with israel about and are working consistently with israel on. Because we know that if in fact, they obtained a Nuclear Weapon, all those problems would be worse. So were staying focused on the central issue here. How do we prevent iran from getting a Nuclear Weapon . The path that we proposed if successful, by far is the best way to do that. Thats demonstrable. And Prime Minister netanyahu has not given a plan that would achieve the same verifiable mechanisms that would prevent iran from getting a Nuclear Weapon. So i would urge the members of congress who were there to continue to express their strong support for israels security to continue to express their strong interest in providing the assistance israel needs to repel attacks. I think its important for members of congress on a bipartisan basis to be unified in pushing back against terrorism in the region and destabilizeing efforts that iran may have engaged with with our partners. Those are all things on which this administration and israel agree. But when it comes to this nuclear deal lets wait until theres a deal on the table that iran has agreed to at which point everyone can evaluate it. We dont have to speculate. And what i can guarantee is that if its a deal ive signed off on i will be able to prove that it is the best way for us to prevent iran from getting a Nuclear Weapon. And for us to pass up on that potential opportunity would be a grave mistake. Its not one that i intend to make and i will take that case to every member of congress once we actually have a deal. All right . Hold on hold on. Ill take one question. Go ahead. Do you feel like the speech he gave was appropriate considering his upcoming e lx election and upcoming deadline . You also talked to other foreign leaders today. Did iran come up at all . All the folks on the call today share my position that we should see if we can get this deal done. It was not a topic of conversation. With respect to the decision of the speaker to offer Prime Minister netanyahu to make his case i think that question should be directed to mr. Boehner. As i said, its very important for us not to politicize the relationship between israel and the United States. Other channels. And i think its important for us to stay focused on the problem at hand and the specific problem that is being debated right now is not whether we trust the Iranian Regime or not. We dont trust them. Its not whether iran engages in destabilizing activities. Everybody agrees with that. The central question is how can we stop them from getting a Nuclear Weapon . And what we mow isknow is that if were able to get a deal not only do we cut off all the various pathways for iran getting a Nuclear Weapon but we also know that well have a Verification Mechanism and an inspection mechanism where if they cheat and engage in a Covert Program, were far more likely to see it in time to do something about it. What i also know is if we dont have a deal as Prime Minister netanyahu suggested, if, in fact, hes right that theyre not trustworthy, they intend to pursue a Covert Program and they cheat, well be far less aware of it until it is potentially too late. What i also know is that he made the same argument before this Current Interim deal and even as officials in his own government had to acknowledge that iran has, in fact maintained their end of the bargain. So what im focused on right now is solving this problem. Im not focused on the politics of it. Im not focused on the theater of it. And my strong suggestion would be that members of congress as they evaluate it stay similarly focused. All right . Thank you, guys. Appreciate it. There he is the president of the United States. 11 minutes making his case why he believes hes right, the Prime Minister of israel is wrong as far as this ongoing negotiation for a possible nuclear deal with iran. Very strong back and forth between the president of the United States the Prime Minister of israel. Not every day you hear that. In fact i dont think weve ever heard that kind of back and forth between a president of the United States and a Prime Minister of israel at least in public. John king is here. Gloria borger is here. Theyre pretty angry at each other. Its presumably going to get worse. You kind of feel like youre eavesdropping on a private conversation. The that two leaders two disagree about a large issue, except the whole world is watching and the whole world is hearing this. The president made it very clear he was frustrated. He said why dont we wait until weve actually got something to talk about before we talk about it. He just made the point that if iran cheats were far more likely to find out about it if the we have some kind of a deal than if we dont and it would be too late. But then he went on to say, im not focused on the politics of it. Just wow. Forget the details for a minute. This is the president of the United States and the Prime Minister of israel within an hour or two of each other. The president said he didnt see the speech he just read it. Imagine if he had seen it because its pretty clear the Prime Minister is under his skin and under his skin pretty good. He takes 11 minutes. He didnt just say, nothing new, move on no questions. He took 11 minutes to rebut the arguments. Prime minister netanyahu stood up there and said, you know the president cant be trusted on this, hes too naive, he doesnt get it. You have the president of the United States a couple hours later saying hes been saying this forever, the Prime Minister forget him, dont believe him, im doing the right thing. Publicly to your point, allies are supposed to do this in private. This is spilling out so publicly, the two leaders themselves with the whole world watching with secretary kerry in switzerland at the table with iran at this very moment. Remember the remarkable part for me is remember where Prime Minister netanyahu was speaking standing in that spot in the house of representatives where just six weeks ago the president gave his state of the Union Address and said trust me im on top of these negotiations this will be a good deal if we can get it. Prime minister netanyahu coming in saying no. Even if they say that this isnt political, the point is its gotten incredibly personal between these two men. The larger question is how does this personal problem that these two men clearly have spill over into the larger geopolitical debate. I think thats a question were going to be discussing particularly after we see what happens in the elections coming up. The president basically said the Prime Minister he didnt say anything new. He didnt watch the speech but he said he read the transcript. There was nothing new there. The Prime Minister of israel he minced no words. He basically suggested and said in no Uncertain Terms the president is wrong, this is a horrible deal a bad deal, not only will it endanger israels security but potentially israels survival. Hes betting the security of the world. Thats what Prime Minister netanyahu said of president obama. So you have the president look if the president didnt think the Prime Ministers speech was effective, he would not have just taken 11 minutes to try to rebut it. If the president didnt think even though he disagrees with everything the Prime Minister said that the Prime Minister didnt just make his job harder didnt just complicate the negotiations for secretary kerry and then didnt complyicate his sales pitch to the congress if he gets the deal which is a big if. If the president didnt think the Prime Minister was quite effective standing up there today, you would not have seen that. The question is what happens now, whats the fallout, a, with regards to these negotiations, but b, with relationships. What leeway does the president give him when israel wants a new Weapons Program or objected to some arms sale to jordan or someone in the region. This is going to domino effect. Or israel needs protection. The United States has been there to help israel to avoid its isolation. Hold on one second. Were told the White House Press secretary is answering more questions on this. What i can tell you is very specific guidance has been given to agencies all across the government which is specifically that employees o of the Obama Administration should use their official email accounts when theyre conducting official government business. However, when there are situations where personal email accounts are used it is important for those records to be preserved consistent with the federal records act. In fact the president signed into law a bill at the end of last year that clarified the guidelines for how those personal emails can be properly stored and maintained. This is part of why the state department has asked all of the previous secretaries of state who have used any email as they were conducting official u. S. Business to send their emails to the state department so they could be properly preserved and maintained. Secretary clintons team in response to that request, reviewed her emails and complied with that request by sending all of the emails on her personal account that pertain to her official responsibilities as secretary of state. They did that even though many of the records were already maintained on the state system because those records were emails between the secretary of state and state Department Employees using their official government email address. So are you saying that her use of her personal email solely was appropriate, or was it a violation of this policy . Well what you should do is you should check with the state department who is responsible for administering this policy. But the policy as a general matter allows individuals to use their personal email address as long as those emails are maintained and sent to the state department which if you ask secretary clintons team thats what they completed in the last month or two. Given that shes not the first person to use personal email does there need to be some sort of system for archiving personal emails of highranking government officials like this . Well that is part of this law that i referred to that the president signed into law at the end of last year. It does establish clear guidelines for how individuals, if they are using their personal email to conduct official business can ensure that those records are properly maintained. Now, the official guidance that we offer to administration employees, and its certainly the guidance i followed here when ive been at the white house, is that i use my official government email address when im conducting official government business. It saves me the additional step of having to take a personal email and forward is to my government email so it can be properly maintained. Now, its not incredibly uncommon for one of you or one of your colleagues to send an email to my personal address. A few of you have it. But when i do that i will answer the emails, which i try to be pretty good about doing, but then i will take that response and forward the email to my official account so that the record of that email exchange can be properly preserved. Can you respond to the announcement from the house that theyll vote on a Homeland Security bill without restrictions . Well as you heard me say yesterday, the white house has been urging the congress for months now to do the right thing and that is pass a fullyear funding bill for the department of Homeland Security that does not include any politically motivated riders. The benefit of that is that is will allow the department of Homeland Security to plan and take the necessary steps to protect the American People. At the end of last year democrats and republicans on capitol hill got together and worked to hammer out an agreement about the appropriate funding levels for that agency. That agreement was reached at the end of last year but for several months now, Congressional Republicans have prevented votes on that compromise because they were trying to figure out a way they could capitalize on a political opportunity. The fact is trying to politicize something as fundamental to our National Security as funding for the department of Homeland Security is completely inappropriate, and we are pleased that congressional leaders in the house have apparently relented abandoned the search for political advantage, and are instead trying to move forward to do the right thing, which is to fully fund the department of Homeland Security. Roberta . When secretary clinton was using her private email address to do her work as secretary, was the White House Councils office aware of that . Did it sanction that . Well the responsibility for ensuring that Agency Records are properly preserved and maintained is the responsibility of Agency Officials in coordination with the National Archives and records administration. This is a fairly bureaucratic function but yet an important one. These records need to be maintained for a variety of reasons. One is its not hard to imagine that historians in the future will want to review these records to conduct their academic analysis about things that occurred in the administration. They also need to the records also need to be preserved and maintained so that legitimate requests either from private citizens or from congress to review that information can be fulfilled. So its the responsibility of the agencies to maintain their own Record Management plan if you will. But they certainly do that in close coordination with the experts at the National Archives and records administration. So white house officials that she may have been emailing with they didnt raise this at any point in time as you might want to use your official government or why arent you using your official government account . Was it just okay with everybody . Well as i pointed out, roberta n response to nedras question it is the responsibility of agencies to preserve those records even when those records exist on a personal email account. That is why in order to make it easier for everybody and to avoid circumstances where an individual may forget to forward an email we encourage people to use their official government email account when theyre conducting official government business. However, when a personal email account is involved the law suggests or the law mandates in fact that that record be properly preserved, and that can be done by forwarding it to an official government email where it can be preserved on the system. Again, thats what secretary clintons team did. They reviewed her personal emails to capture all of those that pertained to the conduct of her official u. S. Business and sent them to the state department so they could be properly maintained. In fact, i understand that hundreds of those records have actually already been provided to congress in response to a legitimate congressional oversight request. So that is i think, reflects a commitment on the part of the state department to not just following the federal records act but also coordinating and complying with legitimate requests from congressional oversight committees. Are there security concerns though with a highranking official like secretary of state using a personal email address for official business . Well again, for the specific protocols that are in place at the state department, you should check with the experts at the state department. These are their rules for them to manage. The president , what he insists that all the agencies do is live up to the obligations that they have under the federal records act. Michelle . How to you feel about those rules . Wouldnt that rule then allow a big space for emails to not be preserved if the use of a personal email on a regular basis is even allowed and thought to be okay long term . Well again, the guidance that we have certainly given to everybody who works here at the white house and i think this is consistent with the guidance that federal employees at agencies across the government have received is they should use their official email account when theyre conducting official government business. On those instances in which official business is conducted on personal email accounts its important for those records, those personal emails to be forwarded to the agency so they can be properly maintained. In most cases, at least here at the white house, its as simple as just forwarding it to your official government account so those emails can be properly maintained and preserved. But thats a personal responsibility. Do you think the rules need to be tightened up . It seems to leave a big gap there in whos going to forward that email and whos going to make sure that email is forwarded. I think the law is pretty clear about whats necessary to comply which is that its important to ensure those emails that may exist on ones personal email account are properly maintained. And again, that is why we saw the state department take the step of asking all of the former secretaries of state who have used email as theyve done their work to review their personal email in search of records that relate to the conduct of official u. S. Business. And secretary clintons team complied with that request by reviewing her personal email pulling together all of the ones that related to her official work as secretary of state and forwarded it to the state department so they could preserve and maintain those records. In fact use them to respond to legitimate requests from congress. In the speech we just heard from Prime Minister netanyahu, his whole premise of hating this potential deal was that iran is such a threat it cant be trusted really under any means. Do you think that he overstated that threat on the basis that a deal is being worked out . Do you think he did betray the trust between allies as you put it because he discussed some key points of that potential deal . Well michelle let me take the first part first, which is i think susan rice the National Security adviser, had a rather cogent way of summarizing our approach to this deal. Distrust and verify. As she laid out and even as the president relayed in his comments in the oval office there are a variety of reasons to not trust the iranians. There are numerous examples of the iranians not being honest with the International Community about their nuclear program. There are a variety of examples of that. In some ways the best example of that is the Nuclear Facility that the United States and our allies revealed early on in the president s tenure in office back in 2009. So that is why, as the president mentioned in the oval office any sort of deal that the United States signs on to will include historically significant verification measures. Were talking about detailed verification measures that would include, of course as you would expect the routine inspection of Nuclear Facilities in iran but it would also expand to things like regular inspections of Uranium Mines that exist in iran regular inspection of manufacturing facilities that are related to Nuclear Equipment that are critical to the functioning of the nuclear program. Were talking about an indepth rigorous inspections regime that can verify for the International Community that sooirn living up to their end of the deal. Now, the second part of your question was related to the fact he was talking about these points of a potential deal. Should he not have done that . Was that a betrayal of trust . Well again, the israeli Prime Minister is allowed to make the decisions as i referred to yesterday, about what hes going to say based on his own assessment of the best interests of israeli security. Thats his responsibility as the politically, democratically elected leader of israel. But the president has made clear that there are other concerns in mind principally ensuring that the relationship between the United States and israel isnt subjected to the turbulence of partisan politics. And thats why the president has chosen a somewhat different approach. Its why the president is not meeting with the Prime Minister on this visit to the United States. But it does not reflect any change in this administrations or this countrys commitment to israels National Security. Zeke . Going back to the emails, the president is a noted emailer in chief. Has he ever emailed with the former secretary of state, did they email when she was in office . You wont be surprised to hear that im not going to talk a lot in detail about emails to or from the president of the United States. The president s emails are subject to the president ial records act, which does have which is a little different than the federal records act. Hopefully you arent going to quiz me on that. They are subjected to the president ial records act that does require those records to be preserved and maintained. They have obvious scholarly value in the future. The second point that ill make about that is that if secretary clinton did email the president of the United States that under that protocol those records would have been preserved. Again, i think that sort of highlights the situation that secretary clintons team encountered, which is that a large number of the records that they reviewed in response to the state Department Request were records that already existed on a state Department System because they were emails between her and state Department Employees with state department. Gov email addresses. So when someone in the white house, in the west wing, had an email to send to the secretary of state, did they just use her private email account instead of she didnt have a state Department Email account. How did they get in contact with her . Did that never raise a flag inside the west wing . Well what ill tell you is that during her four years as secretary of state, she and i did not trade emails. So i do not know what her email address is. I can tell you that if there were emails between secretary clinton and white house officials, and im pretty confident that there were some emails, those emails werent just protected by or maintained by the white house email system. Those emails were reviewed by secretary clintons team and they were sent to the state department so they could be properly maintained on their system as well. Again, thats consistent with the requirements of the federal records act. The domain the secretary used to send these emails was rej registered just a week before the president took office the same day her confirmation hearings started. It seems this was set up for the purpose of being the vehicle for email as secretary of state. The president has said multiple times its the most Transparent Administration. Is this consistent with the president s promise to make this a Transparent Administration . Well, im not aware of all of the mechanics that went into setting up the email system you just described. I would encourage you to check with secretary clintons team or someone at the state department. Again, what the president has insisted on from the beginning of his administration as you alluded to is a commitment to among other things making sure that emailed communication to the extent that they are official government records are properly preserve and maintained. Both so that in the future they can be reviewed by historians but also so that they can be used when necessary to respond to legitimate requests from congress or the public to review those records. One last one. You said that secretary staff reviewed and turned over 55,000 pages of emails. Thats not 55,000 emails. And why should the American People take her word or her staffs word for it . Why is there no independent review . By going through this process, she set it up its on her word or her staffs word that these are the only emails pertaining to her official business at the state department. Why should anybody take that at face value . Why shouldnt there be a system in place to have an independent arbiter of that information . In terms of the number the 55,000 number is something ive seen reported. I havent verified that number. Ive been careful to avoid using it. I dont know if that refers to pages or emails or what. Im not disputing the number. Im just saying i dont know what the number is. I know there are a large number of records that numbered in the thousands that were turned over by secretary clintons team at the request of the state department. Again, this was a request the state department had made to all previous secretaries of state in both parties. Again, in the same way that secretary clintons team reviewed her personal email to make sure that they were forwarding on to the state Department Emails that relate to her conduct of official u. S. Business, the same is true of those secretaries of state who served in the republican administration. And ultimately thats what the law requires that if an individual uses a personal email account for official u. S. Business that information, that record should be sent and maintained in the system thats been set up by that specific agency. And that is why, frankly, we encourage people a lot of people dont have a team like secretary clinton does. Thats why we encourage them not to rely on remembering to forward an email but to just use the official government system set up to ensure those records are maintained. Youre in the cnn news room. Weve been listening in to josh earnest, the White House Press secretary, addressing a range of topics today. Everything from Hillary Clinton emails that are drawing controversy to of course netanyahus visit, his speech to congress today. Well talk about all those issues in just a moment. First, we have some breaking news just into cnn. The u. S. Justice department has found systematic discrimination against africanamericans by the Ferguson Missouri Police department. I want to go right to our justice reporter evan perez and our cnn legal analyst Jeffrey Toobin. Evan, first to you. This is some really stark findings by the Justice Department Civil Rights Division against what it said were systematic discriminatory practices by the Ferguson Police department and the citys Municipal Court. Ill give you some statistics that the Justice Department findings say show how much africanamericans were targeted for tickets, for jail fines, for Municipal Court proceedings and so on. 85 of vehicles stops between 2012 and 2014 were of africanamericans. 93 of people who were arrested were black during the same period. And heres another couple statistics. 90 of all citations were against africanamericans during this time. 95 of jaywalking tickets, which are a manner of walking in roadway citations, were against africanamericans. This is all a pattern that the Justice Department says shows the Ferguson Police were targeting africanamericans. They only made up 67 of the population of the city but they were disproportionately being targeted for tickets and for jail in the citys court system ana. And i understand that the department of justice went back a couple of years and went through the archives to come to these conclusions and these specific findings. When you talk about 85 , 90 , 95 of citations, violations going towards africanamericans, some might say, well the population there is predominantly africanamerican but important to note the population there is somewhere in the realm of 60 to 65 africanamericans. So these are still above and beyond that. I understand there were also some emails that were used as evidence of this racial profiling and discrimination. Right. Thats exactly what they found. They went through the email system of officials there working for the Ferguson Police and the court system. They found some really racist jokes. Ill read you a short one from 2008 after president obama took office. There was an official apparently who emailed this joke around. He said president obama would not be president for very long because, quote, what black man holds a steady job for four years . And theres another one, ana, from 2011. Again, this is a joke that was making the rounds on the citys email system according to the Justice Department. It tells a story of how an africanamerican woman has gone to the hospital in new orleans for an abortion and after she goes back home two weeks later, she receives a check for 3,000. She called the hospital to ask what it was for, who it was from and the hospital says quote, crime stoppers. Again, this is to prove according to the Justice Department that there was a real Racial Discrimination problem at this city Police Department in ferguson. All of this beginning after the shooting death of Michael Brown by a Police Officer in ferguson last summer. Evan stay with me. I want to bring in Jeffrey Toobin. First, whats your reaction . Youve been part of our ferguson coverage for months now. Well this is not a surprise because the anger that came after Michael Browns death was not just about Michael Browns death. It was about africanamericans in ferguson and in other surrounding communities around st. Louis saying that we are tired of being mistreated by the police and these numbers bear out what they had been saying that this was a really toxic relationship between africanamericans and Police Officers in ferguson. And so the question now becomes, what is the Justice Department going to do about it . And that is a good question evan. Do you have the answer of whats next . We expect tomorrow ana, that the Justice Department will present these findings publicly as soon as tomorrow. And then it will begin the Legal Process of trying to get a Consent Decree whereby the city will agree to some kind of Court Ordered supervision of the Police Department and the court system to improve the way they do things. The city for the record says theyve been working with the Justice Department civil rights investigation and that they already are making some of the fixes the Justice Department is looking for. They expect this is not going to be a very litigious process, but it is something thats going to go through the court system just to make sure that a judge is going to enforce any changes that the city makes. Ana, just to follow up on what evan says that is has happened often in recent history because of efforts by the Justice Department. Cities like new orleans and cincinnati have been essentially forced by the Justice Department to make changes in their policing policies because of these sorts of investigations. We can expect that the Ferguson Police department will have to make the same kind of changes. And we know the cleveland Police Department is another example back in december when the Justice Department came out with a ruling against its Police Department. I want to bring in our donna brazil whos standing by with us. Donna, whats your reaction to this news . Well im not shocked at all about these findings. I guess whats disturbing is that it took a young man to die for us to even unravel the horrible story that we hear in community after community, this Police Department using its power to disproportionately arrest people to find them almost as if to collect fines and fees from people of color simply because they could do it. So many of the protesters over the last couple of months in ferguson and elsewhere discussed this happening, discussed how Police Officers just pulled them over. Some of them getting fines for walking across the street and everybody says oh theyre just employeeing it up out of proportion. Now we know this report will bear witness to what theyve been going through. I hope the Justice Department follows up as they did in my beloved hometown of new orleans so that the Police Department can begin to reform itself and we can rebuild the trust between the department and the community at large. When i was in ferguson back when all of the drama was playing out with the protests following Michael Browns death, i sat down with the police chief who said certainly theres been no intention to discriminate against africanamericans, and he you know he said i welcome the Justice Department i welcome outside minds, experts in the area of how we might better reform our department to bridge the gap between these communities. So i want to make sure we throw out their side of the story as we dont have a whole lot of their reaction because this news is just breaking right now. But to donnas point, evan, this has to feel like a big victory to those protesters. Yeah it does. Im sure it feels like at least a measure of victory. You know a lot of those protesters also were looking for Darren Wilson the Police Officer who shot and killed Michael Brown, to be in handcuffs and to go on trial. That of course never happened. There was no finding in the state investigation, and we expect tomorrow when the Justice Department announces its findings that theyll also say that they could not find any proof of to bring charges against Darren Wilson for federal civil rights charges. So its going to be bittersweet for the supporters of Michael Brown and his family because those people wanted more than just this. This is something that attorney general eric holder had promised down there. He said they were going to bring justice on behalf of Michael Brown. And this is going to have to be it. Its going to to have to be a reform of the Police Department because in the end, Darren Wilson is going to remain a free man. Jeffrey, how do you suspect the Justice Department will hold officials there accountable . Well i think its more going to be looking forward than looking back. And that of course, is a mixed blessing because it doesnt have the accountability that so many people want. Certainly improved training. Certainly improved recordkeeping. Certainly changes in leadership structure, if not changes in the actual leaders of the department. But theres one point id like to just draw special attention to which is the issue of fines. This isnt just a ferguson story. This is a story around the country where communities that dont want to raise taxes arrest people instead and use them as Revenue Sources and say, you know, were going to fine you or were going to lock you up. Its something going on around the country. It has a racially divisive impact. Its something that everyone should keep an eye on because its a big change in Law Enforcement around the country. This is not going to be the case we dont expect for various reasons. Namely ive actually personally spoken to a lot of those conservatives who voted no. Critics are pouncing on Hillary Clinton over a private email account she used while she was secretary of state. Now, like other top diplomats before her, clinton did not always use a government account. Instead, she always used one of her own personal accounts. But that means its possible not everything she wrote was preserved for the Public Record as what happened with a government account. Thats leading critics to question how transparent shes being and whether shes trying to hide something. Joining me now, Donna Brazile and brianna keilar. Brianna, i want to start with you. Were talking about 2009. Why use a private account, not a government one . We dont actually know ana. Ive emailed Hillary Clintons spokesperson multiple times and called today, and i havent gotten an answer to this question of why she would use it. I heard someone speculate maybe its because that would allow her to centralize her communication so she could combine personal as well as her official email. But at the same time its really this outstanding question. She solely used a personal account. She didnt have this government account. We know somewhat recently there were 55,000 pages of emails turned over from this account to the state department which then went through them and pulled 300 emails that were turned over to the select committee on benghazi. At the same time youre hearing we have heard a statement from her spokesperson which is that she was adhering to the spirit and the letter of this law. Perhaps the letter having spoke within experts, thats the impression i get, but the question is really the spirit of the law. Because its about transparency and its about security. A personal email account is certainly less secure than a government account. On the issue of transparency, it appears the first line of discretion here on whether to turn over an email would be for Hillary Clinton or for one of her aides. Then you have this issue of if an email is deleted, there may be no way to know it. Theres not necessarily a backup on a personal email account like there would be on a government account. Anna clinton is not doing something that predecessors of hers havent done so what do you make of this . I think the problem here for Hillary Clinton, frankly, is that this builds on an already existing narrative. The clintons tend to push the envelope that, rules are not for them, theyre for other people. We see it when it comes to foreign donations to the foundation. Some of them were not even submitted for vetting to the state department. It comes to this thing with the emails where i think most people draw the conclusion that they were skirting trying to skirt the records act. Interestingly enough is a charge that my friend john podesta, whos reportedly going to run her campaign or be one of the senior advisers thats the claim he made against Bush Administration officials back in 2007. So yes, she was probably trying to skirt the records act. The reason theyre not responding to brianna is because theres no good answer as to why she wasnt using a more secure, transparent government account. First of all, theres more than sufficient information out there from the clinton spokespeople about what occurred. And theres so many links out there that i hope we can get the truth out there. First of all, this law was not changed, modified until 2014 long after she had left the state department. She has complied with the spirit the letter. When it was requested she give that information last october from state department trying to preserve these records she turned it over. So this notion that somehow or another this is a gotcha how would we know if it wasnt turned over . Just like jeb bush emails sure he used his discretion which i think is and many of his emails that he is releasing. But look theres a larger story here. And the narrative is when it comes to the clintons, theres not enough disclosure. They want us to disclose everything. Why dont we see what handwriting they put on the toilet paper so we can disclose that too. Shes disclosed this information. She has complied. I think the question is how do you know for sure . Its a big story because, you know what we love big stories when it comes to Hillary Clinton. Shes the only thing that keeps Republicans United because theyre divided about everything else.
