A man named Eugene Harvey. He was an employee, a baggage handler with delta. And Authorities Say he was able to smuggle guns into the airport through an Employee Entrance where there was no screening. Once he was inside, he met up with another man, mark Quinton Henry who did go through screening because he had a ticket to fly. And the two of those men would meet in the terminal in a bathroom and exchange the guns, and then henry got on a plane and flew from atlanta to new york. This happened 20 times between may and december. And the reason they got caught is because henry was then selling these guns on the streets in new york, and he didnt know this, but he was selling to a man who was selling to an Undercover Police officer. And authorities were able to track the scheme back to these two men. Now, to give you an idea of the scope of this, how big it was, well, when henry was arrested, he was found with 18 guns, seven of them were loaded, and in total, 153 firearms were recovered, two of them were assault style rifles, brooke. Im listening to this and im looking at the numbers, and im just like shaking my head. It is unreal. And thank goodness that none of them went off loaded, you know, assault rifles on an airplane in a carryon. Thank you, stand by and await as we hear news on charges from this brooklyn d. A. But let me bring in former fbi assistant director tom fuentes, and here in new york, joey jackson. So, gentlemen, this is that story today where, i mean, we all jump on planes, we all, you know, have to walk through and get xrayed and walk through the metal detectors, et cetera. Tom fuentes to you, to think of this happening, your reaction. No, its unbelievable, brooke. But, you know, its even more scarier than what you just said that a gun might go off. When passengers are boarding an aircraft, the cockpit doors are wide open still. Every time ive boarded one, and i fly very often. Ive not seen the cockpit doors lock yet. Youre exactly right. I hadnt even thought about that. So hes carrying on loaded guns, assault rifles that are loaded and the cockpits sitting there with the pilots and the crew and imagine from there on. I dont have to spell the rest of it out. I know were waiting for this brooklyn d. A. And youre the one sitting here with me shaking your head. Yes. But what listen, brooke, this couldve certainly been disastrous. And, you know, you look to Law Enforcement to break up rings like this. Apparently they did. But it goes deep. If you think about this and sara spoke to the length of time it was occurring. I mean, how big actually is this ring . You have certainly a conspiracy, which is multiple people engaged in a criminal activity, agreeing to further that activity. You have the smuggling of guns with drug, you know, with gun trafficking coming from, you know, one area to another. You have the aiding and abetting of this, the crimes and the list of crimes. What kind of charges are we talking about . Exactly those. So theyll charge conspiracy, theyll charge the trafficking and guns, theyll charge the aiding and abetting. And a laundry list of other charges depending upon and remember, these investigations, you know, at this point, they scratched the surface. How many other people were involved as they pull out Text Messages as they evaluate computer systems. As they continue to unfold this, you know, how many other airports goodness forbid are involved, as well. That is what im thinking. Tom, listen, ive been through Atlanta Hartsfield jackson a gazillion times. And to think theres a side door where a guy walks through with the guns, guy with the Airline Tickets the one that grabs the guns and takes them on as a carryon on the plane. And at least so far last hour, i dont think this airport has changed security for some of these employees. I have to imagine that will change, correct . You would hope so. But, you know, i dont know what in the short run theyll do to stop this. You know, and just imagine youre talking about being able to carry on one personal item and one bag and how much could you put in a bag. How much explosives. Contraband drugs. Theres all kinds of bad things that could happen to that aircraft once the contraband is actually taken aboard like that. And as i mentioned, with explosives or firearms, the cockpit door is open while dozens of passengers are boarding. Mmhmm. Joey jackson, final question. What more do you want to hear from this brooklyn d. A. . Listen, you want to know, obviously, the extent of this. And when whenever its an inside job, you get concerned. Because these people have access to things that normal people dont. And so how many other employees were involved. How long is this been going on . Are there any other airports out there where this could be connected to, you know, and just what was the overall extent and nature of this criminal enterprise . It would be interesting to see whats unravelled here. Were watching, standing by for it, out of brooklyn and hearing from the District Attorney. If i could add, brooke. Hes exactly right. And thats why they would have allowed it to go on so long with continuing buys, continuing deliveries, to try to make sure they had everybody that could be involved in the conspiracy. And apparently, they were pretty confident, it was just these two guys. Got it. Eight months. Thats what they say. Joey and tom, thank you, both, very much. Thank you, brooke. Sony has announced it will release the movie, this comedy, the satire called the interview. Maybe wont be playing in a megatheater chain near you, instead the comedy about the assassination of north Korean Leader kim jongun will be sent to a select few independent theaters for limited screenings on Christmas Day. To the most dangerous country on earth, kim jonguns people believe anything he tells them. That including that he can speak to dolphins or he doesnt urinate and defecate. Oh. Youre telling me that man doesnt pee or poop . Everybody pees and poops. But he does talk to dolphins . This, of course, was the film that triggered the cyber hacking out of sony film studio and threats of 9 11like retaliation. That was enough to at least initially have sony pull the film. That decision as you watched definitely did not sit well with president obama who on friday called it a huge mistake. But today, we do have a statement from the white house on sonys reverse decision as the president made clear, they write, we are a country that believes in free speech and the right of artistic expression. Also, actor seth rogen breaking his twitter silence with this. Tweeting the people have spoken, freedom has prevailed, sony didnt give up the interview will be shown at theaters willing to play it on Christmas Day. James franco tweeting this, victory, the people and the president have spoken, sony to release the interview in theaters. Joining me now, one of the theater owners, paul brown, owner of the terrence theater in charleston, south carolina, also have michael joining me, as well. Were going to talk with him in a moment. But first, to mr. Brown on the phone with me. So, let me begin with when did you first hear that sony would be releasing this film . Did you find out today . Yes. My motherinlaw called me this morning really early in the morning to tell me that the film was going to be rereleased and they were picking a select few theaters. We had originally, we had originally were scheduled to release the film on Christmas Day prior to all of this happening. And then, you know, it was pulled and then, you know, i guess sony targeted a certain number of theaters they wanted to try to see if they would reach out to them. I know they have sent an open letter to sony with respect to showing the film and, you know, the importance of freedom of expression and artistic freedom, and we followed that suit and supported that letter. You know, i feel like it was an hour ago, we were reporting on two smaller independent theaters, and now that list is growing and growing. I do have to ask you, you know, initially when we were reporting about that threat when i believe it was roughly saying remember 9 11 as far as what could happen on Christmas Day if these theaters release this film. Did you ever for a second sort of think that could even be remotely a possibility . Well, you know, its always been a safe place. We feel like, you know, there are a lot of, you know, anonymous type threats out there. If we thought this was a danger to our audience, we wouldnt have shown the film. Its important to take a position, one without a larger corporate agenda. And offer a variety of choices. Theyll make the choices. Sony wants to release the film on video on demand. A lot of theaters oppose video on demand. Our theaters never been hurt by video on demand. The experience of gathering and seeing a movie together, especially a comedy, far exceeds any sort of video on demand type experience. Weve shown a number of videos released afterwards. We havent been hurt by that at all. Okay. Paul brown, thank you so much. Thats it. Appreciate it. Yeah. Thank you very much. You got it. You got it. Happy holidays to you. I want to talk more about this with michael, a columnist for out. Com. Here you are back, were talking about this reversal. Are you surprised . Im not that surprised because, brooke, the entire world came down on sony, including the president , George Clooney was starting a petition saying lets stand up to terrorists. I had a little sympathy for sony as i expressed on this network because who knows what the right thing is to do in the face of what seemed like credible terrorist threats. But the whole world came down on them and was in favor of freedom of expression at any cost. Sony, lets be fair from the beginning said its not us, we wanted to release it, it was the large theater chains not interested in doing it. Thats the question, right . So initially, all those theaters backed out last week, and so then sony yanked it. And now its sort of reverse. The smaller saying, okay, the smaller independent houses like paul browns, we talked to the next step, are bigger theaters going to say, why not . Well, the bigger theaters have erred on the side of caution so far. And its perfect that the indie theaters are picking it up. They are into edgy films. And people live on the edge, the people that program these theaters. The larger chains are much more corporate, a lot of executives having meetings and theyre very cautious to an extreme. But i think theyre going to pick up on it. Theyre going to see that lets hope there are no incidents. People are going to show up. And they can make money from it. And thats the bottom line. I had someone on last hour from variety. And he made a point i hadnt heard yet as far as like the talent in the film. The seth rogens and james franco francos, this was rogens baby. If this wasnt shown. Well, i think, not only the talent, but i think sony wanted the film to be shown. They spent money on it. It was their Big Christmas release. You do . I do. I honestly believe that. And theyre proving it by allowing it to be shown in different theaters, and its going to build. Theyll also be a vod release, im sure. And i wont have to thats what sonys saying. I wont have to go to charleston or austin to see it. I hear its not citizen cane, by the way. Well, this is the position. Having talked about it day in and day out, you know, might make someone like me or someone else, you know, this is the kind of buzz you cant really pay for. Much more of a must must hs it was a couple of weeks ago. Thats the sequel. Michael, thank you so much, columnist for out. Com. Appreciate you coming in here. Another story here. Who is trying to take down north koreas internet . The u. S. Had hinted it would retaliate. The president specifically saying it would be a proportional response. Wouldnt say more than that. Now north korea is offline at some point for nine hours at a time. Who is behind this . We will hear what u. S. Officials have to say about that. And fears in france after a driver yelling about palestinian children. Now, heightened concerns over lone wolf attacks this holiday week, well bring you the latest there. The brooklyn District Attorneys office. And looks like a number of guns on that table. So were watching and waiting for this. This is, of course, the News Conference in the wake of this huge story thats broken the fbi ultimately caught this gun smuggling scheme between atlanta and new york airports back and forth eight months assault rifles being smuggled on airlines on carryones. So were going to look for those charges in the criminality of this whole thing. Lets talk about this. While the u. S. Continues to investigate the hacking into sonys Computer Network and its ties to north korea, north korea trying to figure out its own internet crisis of sorts because there has been yet another network outage. But the question still remains, who or whats behind it . Cnn Global Affairs correspondent joins me from the state department. And elise, you have been asking excellent questions of your own. What are you hearing . Well, brooke, obviously the u. S. Wants to maintain an aura of mystery. Did they do it . Everyone would assume this was a tit for tat. And you would remember the president said this would be a proportional response from the United States. Yesterday, Deputy StatesDepartment Spokesman created a Little Mystery when she said that some of the u. S. Actions would be seen and some of them would be unseen. So today, i tried to pin her down a little bit about whether the u. S. Was involved. Take a listen. So just pointblank, was the u. S. Involved in anything related to the internet shutting down in north korea . I would this isnt our internet, elise. I would go ask did the u. S. Undertake any type of Cyber Operations that couldve led to the north korean internet being down . I dont have any information to share with you about youre not saying absolutely not. I think, im not going to comment on those one way or the other, and i would caution you from assuming that means im not assuming, im asking. And thats true, brooke. We cant assume that the United States did this because as we know, a lot most of north korean internet runs through china. Chinese state department, state telecommunications company. So if the u. S. Were going to do something to like this, this would also impede on chinese sovereignty. And its also entirely possible that the chinese just kind of turned the North Koreans off to send a message. But clearly, someones trying to send a message to north korea that what they did with the sony hacking was unacceptable. The mystery continues. Thank you so much. In washington for us. And many of you kept up with the top stories of the year. Of course on twitter and social media sites. So which hash tags made the list of the top ten this year . That is ahead. And is there a link between europe and the upcoming holidays . France has seen two crashes that raised fears of terrorism. Could it be a preview of new attacks or coincidence . Also, watching and waiting. Lets go to brooklyn. Kenneth thompson speaking about this gunsmuggling on airplanes. Lets watch. Good afternoon. I am brooklyn District Attorney ken thompson. And were here to talk about a very important case. I first want to identify some of the people who are standing up here with me. First of all, i want to identify william schaefer. Hes the chief of investigations here in the brooklyn d. A. s office. Next to me is the chief of our violent enterprise bureau. And next to her is tara linech. Im also joined today by First Deputy Police commissioner ben tucker. Who is going to say some words here, as well. Were also joined by chief thomas pritel of the nypd crime controlled bureau. And were joined by fbi special agent Richard Frankel who is in charge of the Criminal Division here in the new york office of the fbi. Were also here with the case agent, the detective who led the way for the nypd. Detective jarrett. Now, im going to leave it up to Deputy Police commissioner tucker to introduce other members from the nypd. But were here today because gun violence is literally tearing our country apart. In brooklyn, far too many people have been victims of gun violence so far this year. And were determined to do something about the gun violence. So so many months ago, my office joined by the nypd. And we began an investigation into illegal firearm sales here in brooklyn. That investigation led us to an individual named ernest. He actually sold an undercover agent over 100 guns right here in brooklyn. 40 caliber weapons,. 380 caliber weapons,. 9 millimeters. We were determined to get to the source of these guns. And our investigation led us down to the state of georgia. And letters from an individual named mark henry. What we learned was truly frightening. Henry is a former Delta Airlines employee. He worked with a current delta employee Eugene Harvey who works down in the Hartsfield JacksonInternational Airport down in atlanta. Those two individuals breached the security. They breached the security to smuggle so many firearms, so many guns on planes from atlanta to new york city. The flights originated in atlanta and landed here in new york at john f. Kennedy airport. They also landed at laguardia airport. Between may 2014 and december 2014, mark henry literally took about 20 flights with guns on them. On commercial airliners. We were fortunate that we were able to get all the guns that they tried to put on the streets of brooklyn. And what i want to do is just want to show you. And im going to go through how this happened. Ooum going to walk you through how this happened. So its crystal clear. What i want to do first is show you one of the guns that mr. Henry smuggled on the plane. This is an ak47. This gun can shoot through a car door, can shoot through an apartment door, can shoot through a bulletproof vest. In november, mr. Henry bought this gun on a delta commercial airliner to new york. Theres also an ar15 and assault weapon he smuggled on the plane. What i want to do is walk you through in detail. And were going to answer your questions about how this happened and how long this is going on. But in order to do so, i have to go over to the charts. Im going to show you. So what we have here is mark henry the former Delta Airlines employee. He worked for delta between 2007 and 2010. He was a baggage handler. He was fired in 2010. His mother had worked for delta for many years. First with pan am before merged with delta. His mother was a long time employee. They both worked down in atlanta. What he did, what henry did is he worked with the current delta employee, Eugene Harvey. Eugene harvey is currently a baggage handler down at the airport in atlanta. Henry would meet with harvey sometimes at harveys house in atlanta and give him guns that harvey was to smuggle into the airport. Sometimes they met at henrys mothers house or other locations down in atlanta. Henry would give harvey the g s guns. Now this is critical. The problem down with this at this airport in atlanta is that the employees dont have to go through screening. And so when the employees arrive at the airport, they can get into the terminal without going through any screenings. Henry knew that, and so he worked with harvey. So henry would give harvey the guns outside the airport, harvey would go through all he had to do, he could park in an employee parking lot, badge himself in and in the terminal with the guns. Henry would go through the normal tsa check points, like any other passenger. With the knapsack that wasnt quite full. So he went in as a standard passenger. But they had a Meeting Place that they would meet. Different in the airport. Sometimes it was in the restroom, sometimes it was at a credit union. But they knew. And so, they would meet at the airport, harvey would find he y henry, give him the guns, henry would take the guns, put it in his knapsack, and then henry would literally catch a delta flight to new york. We know that henry did this on at least 17 occasions between may and december of this year. We also know based on investigation that henry has been smuggling guns on commercial airliners for years. For at least five years. The investigation is ongoing. Now, what i want to do. So if hes on the plane, like any other passenger with these guns, now i want to show you some video from the airport so you can see exactly how this happened. Please direct your attention to the screen. So on december 10th of this year at the airport, youre going to see at 7 30, youre going to see mark henry. Thats him right there. Going through the normal tsa check point. He has a knapsack on him thats not full. Now, he can you stop that just for a second . Now, this is important. His flight was about 8 15 from atlanta. But what he did going between the tsa check point, he and Eugene Harvey sent Text Messages to each other about the meeting location. And harvey told henry im going upstairs now. Henry said im coming. So they met in the bathroom of one of the concourse there and they exchanged the guns. So the next video, the next clip youre going to see, harvey n now im sorry, henry now has the guns in his knapsack and hes heading to catch the flight to kennedy. This is henry on the left walking towards this flight. He has a knapsack on, and he has a bag in his hand. Thats mark henry right there. The next clip youre going to see, this is a still photo. Henry is walking to his flight with the guns in his knapsack. Now, youre going to see him boarding the flight to jfk. This is henry coming into view. And he has these at least 16 guns in his knapsack. With ammunition, with clips. So hes catching his flight at gate a1. So now, hes on the plane. Now he arrives at Kennedy Airport that morning at about 10 30. And hes literally getting off the plane at Kennedy Airport. And he has a knapsack on him. And you may say i cant see the knapsack, youre going to see the next clip. The next clip shows mark henry leaving jfk that morning. Right there, can you freeze that . That is mark henry with the knapsack that he filled with guns down in atlanta at Kennedy Airport leaving the airport. That knapsack had 16 guns in them, in it. So he walks out of the airport, and once he left the airport, we as part of our investigation started to follow him because we knew he was on that flight. Now, i want to go back to just this board real quick. So henry is now in new york city with the guns. He just left Kennedy Airport. His destination is brooklyn. Mark henry lives in the section of brooklyn. So does ernest, he lives there, as well. Henry comes to brooklyn and he gives the guns when he arrives to ernest. He is the guy in brooklyn who we allege who sold these guns to the undercover agent. You see mark henrys a guy down in atlanta who gets the guns and brings them on the plane. But he brings them to this guy ernest who then sells them to our undercover detective. Our undercover detective purchased over 100 guns from ernest from his home. And then he literally would come out his house and sell his guns right in front of his house and go back upstairs and enter his house. On 43 occasions right here in brooklyn between may and december of 2014. Now, its also interesting is, we investigated ernest very carefully. And by investigating him, we learned about other folks involved in this conspiracy. One is greatly grayline smith. Sold guns to him, as well. Smith lives in crown heights, and he also lives in snellville, georgia, which is right outside of atlanta. He not only sold weapons to our undercover detective in our case, he sold nine guns to a guy named adrian aline. He also lives in canarsie. The nine guns he got, he sold to a separate nypd undercover detective. But its key, all of these guns emanated with mark henry. And so, what we have here in this particular case is if we just security down in that airport because these employees are not required to go through screening, they were able to bring bag full of guns and bag full of guns through into the terminal and put them on commercial airliners. Also important to know that mark henry was able to fly all over the country because he had a certain companion pass. He didnt have to pay for his tickets. Its something they give employees. And he got it because his mother was a long standing employee. So he had unlimited, the ability to take unlimited flights for life all over the world. And so, we know that he has traveled not only to new york but also gone to the dominican republic. The investigation is ongoing. And so what do we have here . On december 10th, the video thats depicted there. Once he came out of the airport, you followed him to his home in canarsie. He went into his home with the knapsack for a short period of time. For a few minutes and then he came out. At that point, he said my son is home he has nothing to do with it. He made that admission right after we stopped him. We looked into that bag and we found 16 guns that were wrapped up individually in different bags within that bag. We also found three other guns in mr. Henrys car. We also arrested ernest. And we searched his home. And we found a gun there. In total, we seized 153 guns as part of this investigation. And those guns were directly traced to georgia. We have now five people in custody. We have im sorry to interrupt. Sure. Sure. We have five individuals who are in custody. The five individuals are mark henry, ernest linau, adrian aline and grayline smith. We have indicted four out of the five. The only one we have not indicted yet is the delta employee. He has been charged by federal prosecutors in atlanta with selling guns and with violating the security at the airport. We intend to also charge him here in brooklyn. And so, this investigation is deeply troubling. Not only creating havoc throughout the country, but now the scheme really poses a threat in terms of terrorism. They could have easily put a bomb on one of those planes. And so were not trying to alarm anyone. We have worked carefully with our partners in atlanta. Our federal partners. The tsa has been outstanding. The federal air marbles have been helpful. The u. S. Attorneys office down there, the fbi has been involved. Delta has been so cooperative from beginning to end, once we learn that mark henry was involved in guns, we didnt know for sure he was transporting guns until we caught him on december 10th. But delta would let us know every time he was flying. And so they were they were crucial in this investigation. We are determined. This is an example were not just going to buy guns on the street of brooklyn and call it a day, we intend to trace down the source of these guns no matter where it takes us. If it takes us to atlanta, thats where were going. Because weve got to do more to stop these guns. And i hope that now we will do all we can to make sure that no one can ever get into an airport whether they work for the airport or not. Without being screened. This is absolutely stunning. Just imagine all the planes flights. There could have been a loaded ak47 up above as a carryon. Precisely what was happening for eight months. Huge, huge case. Youve been listening to the District Attorney because they have arrested these five individuals. Joey jackson sitting here, and hes been listening to me and this whole thing. This is the first time he really heard the details of how this gun smuggling scheme worked with these different people right parts of the puzzle. The guy walking through secur y security, former employee, current employee, who was able to go in Atlanta Hartsfield jackson airport, which is the busiest in the country. Absolutely. One guy had the empty knapsack, the other guy had the guns, walked into the bathroom, put the guns in the knapsack and this guy would hop on a plane with guns. Very troubling, brooke. But what we should take solace in is the fact they were investigating, they were on top of it, and, in fact, from what this press conference shows, they have compelling evidence to establish this was a conspiracy involving these five individuals that the brooklyn District Attorney went over. And apparently, and you see it right there, brooke, and apparently each of them having a separate role which would get those guns from atlanta, bring them on to the streets of brooklyn and selling them to an undercover officer. Thereby giving more information and ammunition in terms of this prosecution. Theyre facing significant penalties. They wont see the light of day for a long time. 43 different times selling to from may to december. And thats, you know, thats whats troubling. And you would say, you know, look maybe they could have taken action previous to that, but why . It seems as though the authorities had it well underwraps. They wanted to know the extent of this whole enterprise was. And they were confident on december 10th they had uncovered and unravelled this whole enterprise and made the arrest there. And, brooke, there was an admission at that time when before they executed the search warrant to actually get the guns, it was an admission by mr. Henry in terms of what he was doing and what the guns that were in his bag. And to the point, the brooklyn District Attorney saying, look, today it was gun, tomorrow it could be bombs. That they were able to walk into the airport because there were obviously lacking, the security screening for these employees. You know, you and i were listening, you said thats going to change. A lot more fallout. And also to the d. A. s credit, you know, say, were not just going to call it a day. Were going to look at every single one of these guns. Quickly, i want to get to the delta statement. Delta cooperating with authorities in this investigation. We take seriously any activity that fails to uphold our strict commitment to the safety and security of our customers and employees. Joey jackson, thank you. Absolutely. Thank you, brooke. And you know what, its important investigation. I think when you look at what you talked about in terms of it could have been something else, the d. A. Talked about it, bombs, thank goodness they brought this under control. Thank goodness and thank goodness none of those guns went off on those planes. Joey, thank you. Well be right back. Right now, across the world, there are growing concerns of lone wolf attacks this holiday week. And in particular, and in the aftermath of the deadly hostage situation in sydney, the Prime Minister of australia issued this dire warning today. An attack is likely. We dont know when and how an attack may come. But we do know that there are people with the intent and the capability to carry out further attacks. Thats australia, this is france. Fears there, as well, after a vehicles crashed into groups of civilians with a driver yelling something about palestinian children. Joining me from washington is our cnn terrorism analyst. And paul, let me begin with france. The attacks linking back to terror. How big of a threat is france facing . France is facing a very, very big threat from terrorism right now. The french Prime Minister says its the biggest threat the country has ever faced. Probably of all the western countries it faces the highest threat. Why is this . Because theres a significant degree of radicalization amongst immigrant communities living in suburbs on the outskirts of french towns which are very often run down. A lot of french extremists traveled to syria, about 400 to believed to be fighting now. And 200 on the way with almost 200 back in france. Concern that people have experience in killing people could kill people, as well, in france, brooke. And then why is it, paul, when we talk about the holiday week, and fears of some sort of attack then, why is that more likely according to officials . I think theres a lot of concern now because weve seen attacks over the past few weeks in the west that there could be some sort of copy cat attack. We saw that hostage attack in australia, at least one terrorism attack in france over the weekend. Those three terrorist attacks in north america recently. So concern that there could be a copycat type of strike. Also, in the past, documents captured the compound suggested that al qaeda might want to strike around the christmas period, for sort of psychological reasons. A lot of people are traveling at that time. But generally speaking, terrorists launch plots when theyre ready to go rather than on a particular date, brooke. Okay. Back to australia. And this is my final question for you. When you look at the when you look closer at the high alert facing australia and the talk from officials, you know, of raising this alert to extreme. What are you hearing about this increased terror chatter . Well, australian officials are not elaborating on this. But i think their concern is there could be somebody inspired by what they saw last week play out in australia, which was this hostage drama, this deadly hostage drama by an isis sympathizer, isis supporters have glorified this guy online. And theres concern that another extremist could launch an attack. Australia is also dealing with a significant terror situation, brooke. All right. Youtube facing a big, big lawsuit from some musicians. They are telling the site to take down thousands of videos or else they want a billion dollars. And look at all of the green on the screen. North of that 18,000 mark. Well look at the dows historic day, coming up. Its just ordinary fleece but the comfort it provides is immeasurable. The america red cross brings hope and help to people in need every 8 minutes, every day. So this season give something that means something. Clap along if you feel like happiness is the truth pharrell, just a dozen of artists, not happy that music is readily available on youtube. Or face a 1 billion lawsuit. This boils down to a battle over Performance Rights. To help us understand this is david lowry. David, nice to see you. Thank you. Thanks for having me on. So what do you think . We know this new music group called global music rights, representing some 40 artists, we mentioned pharrell but 40 are behind this. Do you think its value lid . Yes, i do think its value lid. Songwriting is bizarrely hyper regulated by the government, essentially. Theres a department of justice process that you go through whereby you license your Performance Rights to companies, anything from a restaurant to a company as big as google, which has youtube to license your songs. This is because the organizations of songwriters, unions for songwriters, they have been under this department of justice Consent Decree since 1941. So whats happened now is some songwriters have left and formed a new pro so they are no longer under this Consent Decree. And so these artists, in my view, are right fully claiming that there is no longer a license for youtube to perform these songs and they want to negotiate over this license. Its pretty cut and dry. It doesnt sound it sounds pretty complicated to me. When you answered youre like, yeah well, yes. Everything to do with song writing is incredibly complicated. So relatively, its cut and dry. Youtube is claiming that they still have the rights to perform these songs, from what i can tell. This isnt a lawsuit yet. This is just threats of a lawsuit. Yeah. It looks like that they are claiming they still have the rights to perform these songs under the Consent Decree with these two companies but the songwriters are now longer part of those companies so it would seem like they dont have the right to perform these songs. And youtube looks like its going to rely on a loophole to continue to play these songs. I see a comment from one of their lawyers that they want these songwriters to go through the sort of notice and take down, like notify them of each infringing video and take them down. That was never the point of the law. David, what is this all about . Im thinking about what we covered a couple of weeks ago, it was spotify and taylor swift and now all of this with youtube, what direction are the artists trying to go to . Well, spotify artists have complained about the rates they get from spotify. Youtube is much lower. And apparently spotify is not a lot at all. Yes. Exactly. And youtube is even lower. So a lot of artists are just they are unhappy with this. I mean, why do we have to be why do we have to be a part of the service if it doesnt pay us well . Thats thin that just seems like a fundamental right. They are not paying me enough, i dont want to be part of this service. Talking to singers and songwriters. You can understand where they are coming from and they are frustrated. David lowry, thank you so much. Well see what happens with youtube. Appreciate it. Thank you. And before i let you go, if you have not checked the dow today, let me say happy holidays to you and your 401 k because, hello, the dow hitting the 18,000 milestone for the first time ever.
